The Jammu & Kashmir State Power Development Corporation (JKSPDC) is wholly owned by the State Government of Jammu & Kashmir. JKSPDC was incorporated as "Jammu and Kashmir State Power Development Corporation Private Limited" on 16th February 1995 under the Companies Act, 1956. Subsequently, the Corporation was con- verted to Public Limited Company and the name was changed to "Jammu and Kashmir State Power Development Corporation Limited" and a new Certificate of Incorporation was issued by the Registrar of Companies, Jammu & Kashmir, at Jammu on 24th November, 1999. JKSPDC on 18th January, 2016 has filed the Annual Revenue Requirement (ARR) for FY 2016-17 with the Hon'ble Jammu and Kashmir State Electricity Regulatory Commission (JKSERC) in respect of its hydro electric stations, transmission line and gas based thermal power station. The ARR Petition has been filed in terms of the Regulation 45 of J&KSERC (Conduct of Business) Regulations, 2005, J&KSERC (Terms and Conditions for Determination of Transmission Tariff) Regulations, 2012 and J&KSERC (Terms & Conditions of Determination of Hydro Generation Tariff) Regulations, 2011 as amended from time to time. The Commission admitted the Petition on 5th of February, 2016 and directed the JKSPDC to publish a public notice for inviting objections/ comments from various stake- holders. 1. Hydro Electric Power Stations JKSPDC has 22 hydro electric power stations (HEPs) with a total installed capacity of 770.96 MW; this includes the 9 MW Mohra HEP which has not been functional since the floods of 1992. 18 hydro power stations were made commercially operational on different dates prior to April, 2009. Baglihar HEP Stage-I has been commissioned on April 1, 2009. Stakana HEP having an installed capacity of 4 MW was handed over to JKSPDC in March 2011 for its operation and Sanjak HEP having an installed capacity of 1.26 MW was ener- gized in October 2011. There has also been a capacity addition in Baderwah and Pahalgam station in September 2012 and July 2013 respectively. The details of total installed capacity, unit wise installed capacity and date of commission- ing of all the generating stations maintained by JKSPDC are mentioned in the table below: Table 1: Details of Hydro-Electric Power Stations 2. Gas Based Thermal Power Stations JKSPDC owns and operates Gas Based Thermal Power Stations as listed in the table given below which are operated only on call from Transmission & Distribution Utility i.e. JKPDD because of prohibitive cost of power generation from such sources. Government of Jammu and Kashmir bears only the cost of fuel whenever the units are operated. Table 2: Particulars of Gas Turbine Stations 3. Transmission System JKSPDC has a dedicated 400kV D/C line to cater to evacuation of power from BHEP and two bays at 400kV Kishenpur substation of PGCIL. The tariff for the same has also been proposed by JKSPDC separately as a part of the Petition. 4. Energy sale within the state The entire quantity of the electricity generated by the hydro electric power plants which have been commercially commissioned is being sold within the state to the JKPDD with the exception of Baglihar HEP Stage I where 50% of the power generated is sold to JKPDD and the balance 50% is sold through Power Trading Corporation to meet the lender's require- ment. 5. Present status of billing energy JKSPDC has submitted in its Petition that the billing of energy is presently being done as per the Tariff Order issued by the JKSERC on 27th February, 2015, applicable for the finan- cial year 2015-16. 6. Determination of Tariff of 8 HEPs JKSPDC has filed this Petition for determination of tariff for FY 2016-17 in respect of these 8 HEPs in accordance with the provisions of the JKSERC (Terms & Conditions of Determination of Hydro Generation Tariff) Regulations, 2011. The proposed Annual Fixed Charges (AFC) for FY 2016-17 and the indicative tariff proposed by JKPDC for these 8 HEPs have been summarized in the table below. Determination of Tariff of 10 Old HEPs JKSPDC has filed this petition for determination of tariff for FY 2016-17 in respect of the below mentioned 10 old HEPs in accordance with the provisions of the JKSERC (Terms & Conditions of Determination of Hydro Generation Tariff) Regulations, 2011. The proposed Annual Fixed Charges (AFC) for FY 2016-17 and the indicative tariff proposed by JKPDC for these 10 old HEPs have been summarized in the table below. Determination of Tariff of Baglihar HEP Stage I Baglihar HEP was declared commercially operational on 1st April 2009 along with 68 km of 400 kV D/C transmission line from Baglihar to Kishanpur for evacuation of power from the project. The 400 kV D/C transmission line has been connected with 2 nos. 400 kV lines terminating bays at Grid sub-station Kishanpur of PGCIL. The Petition for approval of capital cost pertaining to the Baglihar Hydro Electric Project was submitted as per the directives of Hon'ble Commission in December 2010 and the cap- ital cost was provisionally approved by the Commission through Tariff Order dated 16 June 2011. The tariff proposal and AFC requirement for the FY 2014-15 was submit- ted and the Tariff Order has also been passed by the Commission. The JKSPDC has now submitted the tariff proposal for FY 2016-17 in this Petition on the basis of the same param- eters as approved by the Commission. The tariff proposal has been submitted on the basis of the following: a) For Baglihar - Hydro for FY 2016-17 The proposed AFC and tariff applicable to the Baglihar Hydro project for FY 2016-17 has been worked out by the JKSPDC in accordance with provisions of the JKSERC (Terms & Conditions of Determination of Hydro Generation Tariff) Regulations, 2011. b) For Baglihar - Transmission System for FY 2016-17 The tariff Petition for Baglihar-Transmission system has been prepared in accordance with the JKSERC (Terms and Conditions of Transmission Tariff) Regulations, 2012. The Annual Fixed Charges (AFC) for FY 2016-17 required and tariff proposed by JKSPDC in respect of Baglihar HEP Stage I has been summarized in the table below. Table 5: Proposed AFC & Indicative Tariff for FY 2016-17 for Baglihar HEP Stage I 9. Determination of tariff for Sanjak HEP Sanjak HEP was energized in October 2011. JKSPDC has submitted that the project cost has been considered based on estimated completion cost and valuation report. The design energy of the HEP has been calculated in the same procedure as that adopted for calculating design energy for HEPs already approved by the Commission. The Annual Fixed Charges (AFC) for FY 2016-17 required and tariff proposed by JKSPDC in respect of Sanjak HEP has been summarized in the table below: Table 6: Proposed AFC & Indicative Tariff for FY 2016-17 for Sanjak HEP 10. Determination of tariff for Stakna HEP Stakna HEP having an installed capacity of 4 MW was handed over to JKSPDC in March 2011 for its operation. JKSPDC has computed the tariff based on the procedure defined in the Regulations notified by JKSERC vide no. JKSERC/11/2011 dated 20.04.2011. The Annual Fixed Charges (AFC) for FY 2016-17 required and tariff proposed by JKSPDC in respect of Stakna HEP has been summarized in the table below: Table 7: Proposed AFC & Indicative Tariff for FY 2016-17 for Stakna HEP 11. Compensation on account of O&M expenses incurred for Gas Power Station Gas Power Station I and II are operated on the directions of the Power Development Department / State Government. The Transmission and Distribution Utility, JKPDD requisi- tions its operation only in acute emergency conditions because of high/ prohibitive cost of fuel for generation. JKSPDC has submitted that in order to maintain and keep the gas tur- bines in running condition for operation in emergency, staff has been provided and timely plant maintenance is also being carried out by the JKSDPC. JKSPDC has requested for the reimbursement of expenditure incurred by the Corporation on upkeep of the gas turbines. The below table summarizes the O&M charges claimed by JKSPDC on account of opera- tion of gas turbines. Table 8: O&M Charges of gas turbines for FY 2014-15 12. Additional submissions: The JKSPDC has also requested for:- a) Passing of suitable directives by the Commission for taking over Mohra Receiving Station by JKPDD from JKSPDC. b) Allowing Water Usage Charges to be claimed from the Distribution Utility as pass through. c) Approval for reimbursement of an amount of Rs. 64.17 Cr. paid by the Corporation as Income Tax for FY 2014-15 by JKPDD. d) Approval for reimbursement of tariff filing fee of Rs.3.00 Lacs. Besides, the following projections have also been made in the petition:- e) Requirement of funds for Renovation & Modernization and Stabilization. JKSPDC, how- ever, has not sought any additional capitalization on this account because of the works being on-going. f) Arrears amounting to Rs. 2,519.24 Cr. upto 31.3.2015, payable by JKPDD, on account of cost of power purchase from the Corporation. 13. The Commission has directed JKSPDC to invite comments/suggestions from the public on the above Petition through this notice. 14.
