The properties are situated in Michau Street, only one block away from the beach and the Strand CBD, and take up just under 5 000m². The eight cousins in- herited the properties from their grand- father, Jakobus Petrus Niehaus. Their great-grandfather had bought the pro- perties in the early nineteenth century. The two oldest buildings in the block have become worn down with time and the improvement of the block is seen to be a positive move for the Strand. The old manor house is a declared heritage building and can therefore not be demolished. It dates back to the early nineteenth century and is part of the original Strand Village. The estate agency holding the sole mandate for the sale of the properties, Harcourts Platinum, says the properties will be sold as one lot through a tender process. Initial bidders have been re- duced to one forerunner who is current- ly conducting a feasibility study to deter- mine if the properties can be developed into a profitable business endeavour. Five of the eight properties are cur- rently vacant while the four buildings on the other three properties are occu- pied by tenants. Lee Coetzee, an estate agent at Har- courts Platinum, says the properties are mostly zoned single residential, which means the successful bidder will have to apply to the City of Cape Town if they plan on developing anything other than residential homes.     after the eight cousins who own the

    Crayfishworth over R100 000 seized

    More than 1 000 crayfish were confiscated on

    the N2 close to Lwandle last Friday after po-

    lice receiveda tip-off that crayfishwerebeing

    transported in a pink Toyota Quantummini-

    bus.

    Members of the Flying Squad searched the

    vehicle at about 06:45 and found1 013 crayfish

    with an estimated value of R140 000. Three

    suspects, aged 32 to 43 from Mitchells Plain,

    were arrested and charged with the posses-

    sion and illegal transporting of crayfish.

    In a separate incident, Gordons Bay police

    confiscated 970 shelled abalone last Wednes-

    day at about 21:00. Twomen fromHermanus

    were arrested andhas appeared in the Strand

    Magistrate Court.

    Gautengverdict wont affect Cape

    The prospect of toll booths lining the N1

    and N2 in the Cape has resurfaced after

    oppositiontothee-tollprojectinGauteng

    was dealt a severe blow last week.

    The Supreme Court of Appeals last

    Wednesday ruled in favour of Sanrals e-toll

    project in Gauteng, dismissing a challenge

    by the Opposition to Urban Tolling Alliance

    (Outa).

    Sanral has proposed toll plazas on the N2

    between the R300 and Somerset West; be-

    tweenSomersetWestandthe footofSirLow-

    rys Pass; and between Houw Hoek and Bot

    River. Toll plazas proposed for theN1would

    be at the Old Oak interchange and between

    Worcester and De Doorns.

    TheCity ofCapeTowngainedan interdict

    against Sanral in May, preventing it from

    taking any steps to implement the toll roads,

    pending the final determination of the citys

    review application. The court also granted

    thecitysrequestforSanraltoprovideitwith

    anumberofdocuments thathad formedpart

    of its decision-making process.

    BrettHerron,theCityofCapeTownsMay-

    oralCommitteemember for transport, roads

    and stormwater, says the city is confident

    that Sanrals victory in the Supreme Court

    last week should not affect the citys litigation

    against local toll roads. This is because the

    citys case differs from the Outa case in a

    number of respects, he says.

    Our application is to review and set aside

    the decisionswhich led to theN1 andN2being

    declared toll roads on the basis that these deci-

    sionswere legally flawed,andthusthedeclara-

    tionoftheN1andN2astollroadswasunlawful.

    In addition, and most obviously, the road-

    works proposed under the Winelands Toll

    Road project have not yet been constructed,

    Herron says.

    Sanral has previously stated it urgently

    needs to implement toll roads in the Cape to

    upgrade and maintain the roads and address

    safety concerns.

    Stuart Pringle, chairperson of the Helder-

    berg Subcouncil, believes the proposed tolling

    of the N2 will have a devastating effect on all

    localeconomicactivity.Itwillhaveanegative

    effectonfarmersintheareaasthecostof trans-

    porting their produce to the harbour will in-

    crease. It will burden those who commute to

    Cape Town for work and will have to fork out

    more for transportwith extra financial strain,

    especially since there is no alternative route

    available, Pringle says.

    BernhardWiese, chairperson of the Helder-

    berg Chamber of Commerce, says that the im-

    plementation of the toll-road projectwill nega-

    tively affect any local business.

    Besides transport costs thatwill skyrocket,

    property prices will also suffer because it

    would cost so much more to live in Somerset

    West. Another concern is that the infrastruc-

    ture for public transport in the Helderberg is

    underdeveloped, says Wiese.

    Herron says Sanral is yet to provide the city

    withallthedocumentsitrequested.Onceithas

    all thedocuments, thecitywill formulateasup-

    plementary document for filing at the High

    Court. We suspect the matter will be ad-

    dressed in court early next year, if all goes

    well, Herron says.

    Donorboosts restoration

    The estimatedR1.5 toR1.8million resto-

    ration of the Church Street Methodist

    Church in Somerset West is set to com-

    mence soon following the donation of

    R1.4 million from an anonymous bene-

    factor.

    This comes in the third year after the

    front facade collapsed on 13 June 2010.

    Reverend Jean Murcott, resident minis-

    ter for the congregation, says that plans for

    the first phase of development on the 153-

    year-old churchwere submitted in July and

    passed by theWestern Cape Heritage Coun-

    cil.

    The first phase of development will main-

    ly consist of restoring the facade, replacing

    the windows, filling up any cracks, restor-

    ing the vestibule, and excavating a new

    storm water drainage system.

    However, the start of development is de-

    pendant on a permit from the City of Cape

    Town to implement the new storm water

    drainage system.

    According to Murcott, the congregation

    is still awaiting the way-leave permit.

    If it were up to the congregation, we

    would have the building restored yester-

    day. But, it is of utmost importance to have

    an adequate drainage system installed to

    prevent the undermining of our church

    building for a second time, Murcott ex-

    plains.

    Stuart Pringle, chairperson of Subcoun-

    cil 8, says that negotiations are still under

    way for the granting of the stormwater per-

    mit.

    The second phase will include all the fi-

    nishing touchessuchas theplasteringof the

    church building, refurbishing the seating

    and ensuring electrical compliance.

    More than 24 years remain on

    a controversial lease contract

    betweenthe residentsofFleur

    Park in Gordons Bay and the

    City of Cape Town.

    The pristine holiday resort

    made headlines in 2011 after

    Tony Ehrenreich, ANC caucus

    leader in theWesternCape, criti-

    cised the City of Cape Town for

    the lease contract and described

    it as a waste of public resources

    that onlybenefits a few individu-

    als.

    The City of Cape Town inher-

    ited the lease from the previous

    Gordons Bay Municipality.

    The lease had been signed in

    1986 andallows the owners of the

    homes the right to lease the land

    for a total of 49 years.

    However, the lease rights need

    toberenewedeverytenyearsun-

    til the lease term expires in 2035.

    Earlier this year, City of Cape

    Town Mayor, Patricia de Lille

    announced that the lease for per-

    manent Fleur Park residents

    will be increased at the next re-

    newal period in 2016 to a mar-

    ket-related price (Fleur Park

    only benefits a few, District-

    Mail, 7 February 2013). At that

    time, residents were paying

    R1 200 per month.

    Alderman Ian Neilson, the

    City of Cape Towns Mayoral

    CommitteeMember forFinance,

    however, says resident are cur-

    rently paying more than R1 200

    and the lease will escalate annu-

    ally until the lease renewal in

    2016. He would not reveal cur-

    rent lease amounts when asked

    by the DistrictMail.

    However, the DistrictMail es-

    tablished from a resident that

    they now pay R1 833.50.

    Neilson says the City of Cape

    Town does not approve of the

    lease contract and would not

    agree to the establishment of a

    similar scheme in such a prime

    public location today, but adds

    that established property rights

    have to be upheld.

    While the current council

    cannotpredict theactionsof a fu-

    turecouncil, it ishighlyunlikely

    that the leaseholds at Fleur Park

    will be extended when the cur-

    rent 49-year-and-seven-month

    leaseholds end.Weenvisage that

    the area will be returned to a

    public amenity.

    A permanent resident of Fleur

    Park who spoke on condition of

    anonymity, confirmed that the

    permanent residents own the

    structures and have several

    years left on their lease contract

    for the land rights. Why should

    we not stay in the structures we

    own?

    The resident says the home-

    owners association contributes

    to upkeep of the resort. Most of

    the home owners are swallows

    whodonot live therepermanent-

    ly. As far as DistrictMail is

    aware, residents havenot organ-

    ised any formal opposition to the

    expiration of the lease in 2035.

    Residents share their plans

    for the CBDs

    The Strand Central Business Dis-

    trict (CBD) is opting to implement

    a Special Rating Area (SRA),

    where business property owners

    pay additional rates to uplift the

    CBD (Sakekern veg terug, Dis-

    trictMail, 3 October 2013).

    The additional rates will then be

    used to revitalise the CBD through

    various initiatives.

    Somerset West property owners

    are following suit and have esta-

    blished a forum that is promoting

    the establishment of an SRA (Fo-

    rum established to campaign for

    SRA, DistrictMail, 3 October

    2013).

    The DistrictMail hit the streets

    to find out what residents would

    like to change in the Strand and

    Somerset West CBDs. Here they

    share some of their ideas.

    Gerry Arrow said the Strand CBD

    is not safe and described how he

    was the victim of a business rob-

    bery two years ago. The top priori-

    ty for revitalising the Strand CBD

    should be fighting crime, and he

    also proposes that authorities make

    it easier, in terms of rates, to start

    a small business, which in turn will

    Nadia van Lill believes that local

    authorities should create more

    space in the Strand CBD for in-

    formal traders to do business,

    which will help to address pover-

    ty, unemployment and in turn,

    crime. Job creation is the key.

    Danie Smuts says he would like to

    see larger dustbins installed in the

    Strand CBD, because the City of

    Cape Towns green dustbins over-

    flow before they can be emptied.

    He further identified the need for a

    zebra crossing at Millers in Strand

    Main Road. His final change would

    be to add cameras to the park in

    the Strand CBD. He says he does

    not feel safe when visiting the park

    and believes that security cameras

    will make a positive difference.

    Juanita Parkin strongly believes that

    the Strand CBD needs to establish a

    trademark for itself in order to attract

    more tourists. She says businesses in

    the Strand CBD should be more inviting

    and create jobs for the local vagrants.

    There should be more of a community

    feeling.

    Caryn Cronje says she does not

    feel safe in the Somerset West

    CBD. Her top priority for the re-

    vitalisation of the Somerset West

    CBD would be safety. To achieve

    this, she proposes that security

    be more visible.

    Suzette Wandrag feels that the Somer-

    set West CBD would attract more shop-

    pers if the environment is cleaner. She

    says stricter law enforcement, designa-

    Shark Spotters get shelter at Kogel Bay

    Shark Spotters, the non-profit orga-

    nisation that keeps awatchful eye on

    shark activity at the City of Cape

    Towns favourite beaches, has put up

    a hut at its Kogel Bay post.

    The hut went up at the end of Sep-

    tember to provide protection against

    the harsh Cape Town weather.

    Shark Spotters has been on duty in

    KogelBaysinceJune2012aftera fatal

    shark attack on David Lilienfeld (20)

    in April that year.

    Over the last 12 months, the Shark

    Spotters recorded 17 shark sightings

    at Kogel Bay.

    According to Sarah Titley, project

    managerofSharkSpotters, this is the

    same amount of shark sightings re-

    corded at Fish Hoek over the past 12

    months.

    KogelBay is oneof fiveCityofCape

    Town beaches where Shark Spotters

    are permanently based.

    The other permanent beaches are

    Fish Hoek, St James/Kalk Bay, Mui-

    zenberg and The Hoek (Noordhoek).

    Shark Spotters are stationed at Clov-

    elly, Glencairn and Monwabisi dur-

    ing the holidays.

    The spotters recorded a total of 180

    sightings last year over all eight

    beaches.

    Protocol for the flag system:

    A green flag means that spotting

    conditions are good.

    A black flag means spotting condi-

    tions are poor.

    A red flag means there is a high

    shark alert and a white flag means a

    shark has been spotted.

    Guesthouse, we had various inci-

    dents likepaintballshotagainstour

    walls, rocks thrown against glass

    doors, eggs thrown against walls

    andwindows.Earlythisyearaglass

    door was shot with a pellet gun,

    causingthedoortoshatterintopiec-

    es. So, damage due to naughty chil-

    dren we had quite a fair amount of

    over the years.

    On the night of 3 October, naugh-

    ty children climbed onmy bounda-

    ry wall and stole two of my flags.

    My front-of-house manager is a

    religious woman and on Friday

    night prayed for the protection of

    our property and that those who

    wronged us will make right.

    morning when we found our flags

    in a bundle just inside our gates

    with a sorry note and a chocolate.

    I justwanttosaythankyousomuch

    for bringing it back.

    Being naughty and having fun

    with friends in the night is one

    One day you might also own a

    will stop trading as a guesthouse at

    neighboursandlocalbusinesses for

    bringingyour friends and clients to

    stay at Ivory Heights.

    Conduct ofMetroRail securityguardsunder the spotlight

    I would like to bring to your atten-

    tion an incident that occurred on

    Thursday 8 August.

    I had an appointment at Tyger-

    berg Hospital and decided to use

    Metrorail to get there.

    I livewithinwalking distance of

    Van Der Stel Station and wanted

    to take the 07:35 train to Bellville.

    I crossed the railway line and pro-

    ceeded towards the station plat-

    form via the path parallel to the

    line.

    When I arrived on the platform

    I was confronted by two security

    guardswhoinformedmethatIwas

    not permitted to use this route to

    access the station platform. I apol-

    ogised for any wrongdoing and

    suggestedthattheyaccompanyme

    to the ticket office.

    I pointed out that the train was

    about to arrive and that time was

    of the essence.

    However, they insisted that I ex-

    it the platform by the route that I

    had arrived, passing a sign stating

    NoThoroughfare, cross the rail-

    way line (illegally, I assume) and

    proceed over the pedestrian

    bridge to access the ticket office

    and the platform.

    If the train had not been a few

    minutes late, I might have missed

    myappointment. Ididnotmention

    to these two good gentlemen that

    I suffer from a fear of heights and

    that using the pedestrian bridge

    was, toputinmildly,notapleasant

    experience!

    To sum up my complaint: I ap-

    preciate the zeal with which these

    two individuals carried out their

    duties, but did not appreciate the

    manner they carried out their du-

    ties.

    I also did not have the time to

    ask their names. I appreciate the

    fact that there are visible security

    at stations and on your trains, but

    plead that you do employ suitable

    people.

    Maybe some lessons in interper-

    sonal relations and common sense

    would go a long way in improving

    the public perception of your com-

    pany.

    Imust firstapologise for thedelay

    in replying to Mikes complaint. It

    is clear that he understood the logic

    of their actions as well as the need

    to observe safety issues in the rail

    systembut disagreedwith theman-

    ner of execution.

    The Rail Safety Regulator and

    other pressure groups constantly

    applypressure onMetrorail to com-

    ply with operating rules to prevent

    rail fatalities hence theunrelenting

    and staunch attitude adopted by

    employees.

    While I perfectly understand the

    predicament that Mike found him-

    self in, I cannot fault the guards for

    carrying out their responsibilities.

    The employeesmandate is to car-

    ry out their responsibilities dili-

    gently and with utmost respect to

    the commuters.

    Anything short of that is not ac-

    ceptable: If they were rude I would

    definitely take action.

    I commend Pearlsons restraint

    in dealing with the employees per-

    ceived lackof empathy. Ihave taken

    your advice for customer relations

    training for our staff the matter

    is already under consideration.

    I encourage rail users to be vigi-

    lant in observing the safety rules

    that apply within the rail environ-

    ment.

    teng looks set to commence unless

    Cosatus planned protestsmarkedly

    change the situation the Western

    Cape isnext in line forSanralsunfa-

    vourable attentions.

    The City of Cape Townwill put up

    a valiant fight against Sanrals toll

    roads,butcivil societywill alsohave

    to step in.

    Cosatu staged mass protests

    against the e-toll project inGauteng.

    Will Cosatu in the Western Cape be

    launching similar opposition

    drives?

    Motorists and bikers also held

    slow-drive protests on Gautengs

    e-toll routes. And then we saw the

    rise of anEverydayHero in the form

    of Wayne Duvenage leading the

    court challenge against e-tolls.

    Most of this happened after the e-

    toll infrastructure had been built

    and Sanral was already in debt for

    the construction work.

    Will CapeTownalso put up its big-

    gest opposition once the toll plazas

    are already installed?

    Helderberg residents also need to

    sit up and take notice now already.

    While youmay be able to avoid pay-

    ing toll fees by being creative about

    your routes, other motorists and

    truck drivers will do the same so

    expect local non-highway routes

    to becomecongested and suffer from

    thewear and tear of increased loads.

    Dont put all your faith in the City

    of Cape Towns litigation to sort this

    one out. Local leaders should start

    getting on top of the detail now al-

    ready because too late comes all

    too soon.

    After weeks of planning, the Dis-

    trictMail team pulled off a fantastic

    event, with 424 people participating

    in the almost 5 km walk.

    While the newsroom was still

    busyputtingtheDistrictMailof10

    October tobed, the first

    participants started

    showing up in high

    spirits.

    Several stalls went up

    in theDistrictMail park-

    ing lot, while staff lit the fire and

    startedbraaiingchickenwings.The

    proceedings were officially kicked

    off by Radio Helderberg, who en-

    sured a festive atmosphere with

    great music.

    All were impressed by the Strad-

    ford House Pre-primary School

    Drum Majorettes, who gave a won-

    derful show before the fun walk be-

    gan.

    in order to satisfy

    your objectives. Its

    no good worrying

    yourself to death

    about not having

    enough. You can al-

    ways make a plan.

    Retirement plan-

    ning starts with how

    much capital you

    have and how much

    incomeyouneedand

    there is no magic

    wandtochange frogs

    into princes.

    But a good finan-

    cial planner will work with you

    onhow toachieve realistic objec-

    tives.

    Be careful of taking on exces-
