HyrjeGjatë vitit 2006 Fondacioni i Shoqërisë së Hapur për Shqipërinë-Soros (OSFA) veproi si një stukturë e transformuar që synon t’u përgjigjet kërkesave të realitetit shqiptar për hapje e demokraci. Nga një institucion kryesisht grantdhënës OSFA u fokusua më shumë në projekte operacionale që u realizuan në partneritet me anëtarët e Rjetit të Shoqërëisë së Hapur për Shqipërinë (NOSA). Gjithashtu gjatë vitit 2006 OSFA rriti fokusin në tre fusha prioritare: qeverisja e mirë, integrimi europian dhe shoqëria civile.

IntroductionDuring 2006, the Open Society Foundation for Albania (OSFA) started to operate according to the new institutional arrangement designed to respond to the newly created requirements of the Albanian reality for increased openness and democracy. From a mainly grant making institution, OFSA started to focus increasingly on operational projects implemented in partnership with members of the Network of Open Society for Albania (NOSA). The focus of OSFA and its implementation partners was on three priority fields: Good Governance, European Integration, and Civil Society.

Në fushën e qeverisjes së mirë OSFA dhe partnerët e saj punuan për thellimin e decentralizimit, rritjen e pjesëmarrjes së qytetarëve në qeverisje, forcimin e transparecës dhe luftën kundër korrupsionit, gjykimin e ndershëm dhe të drejtat e njeriut, përmirësimin e praktikve të politikëbërjes duke u mbështetur në përvojat më të mira botërore, monitorimin e premtimeve elektorale, nxitjen e partneritetit publik - privat etj.

Në fushën e shoqërisë civile u thellua puna për përmirësimin e kuadrit ligjor me synim forcimin e ligjshmërisë, rritjen e llogaridhënies dhe përmirësimin e imazhit të organizatave joqeveritare. Një numër trainimesh të organizuara në rrethe të ndryshme synuan forcimin e kapaciteteve të shoqërisë civile duke rritur aftësinë menaxhuese dhe lobuese të tyre. Fokus të veçantë patën grupet e mënjanuara të shoqërisë. U monitorua strategjia kombëtare për Romët duke evidentuar problemet dhe duke sensibilizuar opinioni publik për ekzistencën, afatet dhe ecurinë e kësaj strategjie si dhe kushtet e vështira ku ndodhet sot komuniteti Rom.

Gjatë vitit OSFA mbështeti një varg iniciativash të shoqërisë civile për të mbrojtur liritë qytetare dhe të drejtat e njeriut në kushtet kur qeveria, duke u fokusuar në luftën kundër krimit të organizuar dhe korrupsionit, draftoi disa projektligje të diskutueshme si ai i monitorimit të skafeve, i luftës kundër nepotizmit, i informacionit të rezervuar, ligji i policisë së shtetit etj.

Në fushën e integrimit europian, OSFA mbështeti një varg projektesh që synonin rritjen e ndërgjegjësimit qytetar për proceset integruese, duke bërë të mundur pjesëmarrjen e shoqërisë civile dhe të grupeve të interesit në ligjërimin për integrimin. Një varg produktesh dhe rezultatesh tërhoqën vëmendjen e publikut. Kështu u mundësua botimi i Gazetës EUROPA, e cila sjell më pranë qytetarit shqiptar Europën e Bashkuar dhe procesin e Integrimit. U konceptua dhe u botua libërthi interesant «Pasaporta e Stabilizim Asocimit», i dizenjuar këndshëm dhe me ligjërim të thjeshtë që shërben për të divulguar të dhëna konkrete nga kjo marrëveshje.

Rëndësi e veçantë iu kushtua monitorimit të procesit integrues. Një seri debatesh, anketimesh, botime raportesh dhe konferencash vijuan përgjatë gjithë vitit 2006. Ato ndikuan për angazhimin e shoqërisë civile në proces, për të vënë thekse konkrete mbi përfitimet dhe humbjet që do të kenë qytetarët dhe grupet e interesit,

In the field of good governance, OSFA and its partners worked to deepen decentralization processes, increase civic participation in governance, strengthen transparency and anticorruption, enhance human rights and fair trail, improve practices of policy making based on international best practice, monitor election promises, promote public-private partnerships, etc.

In the field of civil society, work continued to improve the legal framework for legitimacy, accountability and transparency of the non-governmental organizations vis-à-vis both the public and the government. A number of training programs in various parts of the country aimed at strengthening civil society organizations with special focus on their institutional management and lobbying capacities. Under this same field, special attention went to the marginalized groups. The monitoring of the National Roma Strategy was completed. The dissemination of the monitoring findings and recommendations helped build the public’s knowledge of the strategy itself, its objectives, as well as the status of its progress with regard to timelines and actions taken to improve the living conditions of the Roma community.

During 2006, OSFA supported a number of initiatives by civil society to protect civic liberties and human rights when the government, in the name of the fight against corruption and organized crime, drafted controversial legislation, such as the moratorium on sea vessels, the by-laws to combat nepotism in the public administration, the law on classified information, the law on state police, etc.

In the field of European integration, OSFA supported a number of projects aimed at increasing public awareness on integration processes and enabling the participation of civil society and interest groups in the integration discourse. A number of outputs and results came to draw the public’s attention. The journal EUROPA, which strives to bring United Europe and integration processes closer to the Albanian citizen, was made possible. The Passport of Stabilization and Association, an interesting and user-friendly pocket book was produced and disseminated widely to spread information on concrete aspects of the association processes.

Special importance was dedicated to the monitoring of integration processes. A number of public discussions, surveys, reports and conferences took place in 2006. They helped engage the civil society into the integration processes by highlighting the benefits and costs to be borne by citizens and interest groups. These projects helped move

Një pjesë e konsiderueshme e këtyre projekteve janë mbështetur nga Programi Lindje-Lindje, që inicohet nga Instituti i Shoqërisë së Hapur. Përmes tij u organizuan një varg diskutimesh që mbuluan çështje të rëndësishme rajonale si : Statusi final i Kosovës, Marrëdhënia dhe perceptimi i ndërsjelltë mes Shqipërisë dhe Greqisë, Kthesat dhe kujtesa historike, Debati për librin në Ballkanin Perëndimor, Zgjedhjet e lira në vendet e Rajonit etj. Programi bashkoi individë dhe institucione nga Evropa Qendrore dhe Lindore duke përcjellë përvoja, duke nxitur dialogimin dhe shkëmbimin e ideve, në mbështetje të progresit shoqëror të rajonit.

Gjatë vitit 2006 OSFA vazhdoi punën e një varg projektesh të nisura më parë që synojnë mbështetje për reformat në arsim. Ndër to mund të përmendim: hartimin e Kodit të Etikës së Universiteteve, Fuqizimin e Agjensisë së Akreditimit, mbështetjen për Qendrat e Informimit Studentor etj. Po kështu OSFA ndërmjetësoi debatin e gjerë që përfshiu botën universitare në lidhje me projekt-ligjin për arsimin e lartë, duke ndihmuar në shqyrtimin e përvojave të vendeve të tjera, në përmirësimin e dialogut mes palëve etj.

Pasqyrim më të detajuar të veprimtarisë së OSFA-s dhe partnerëve të saj gjatë vitit 2006 do ta gjeni në informacionin që përcjell ky raport, ku krahas përshkrimit të projekteve synojmë edhe krijimin e transparencës menaxhuese e financiare.

public discourse from political rhetoric towards the actual interests of citizens.

The East-East Program of the Open Society Institute supported a number of projects on the integration subject. Funding from this program enabled a series of discussions about important regional issues such as: Final Status of Kosova, Mutual Perceptions and Relations between Albania and Greece, Historical Turns and the Return of Memory, Publishing Markets and Publishing Cultures in Western Balkan Countries, Free Elections in the Regional Countries, etc. The Program brought together individuals and institutions from Eastern and Central Europe to exchange experiences and ideas and encouraged dialogue to promote regional progress.

In 2006 OSFA continued to work towards the completion of a number of projects launched in the previous years. Mention can be made of the projects of the University Code of Ethics, the Strengthening of the Higher Education Accreditation Agency, Support to the Student Advising and Information Centers, etc. In addition, OSFA helped create an enabling environment for the broad-based discussions of the university circles concerning the drafting of new higher education legislation. OSFA’s contribution consisted in making available the experience of other countries, bringing together the different stakeholders and maintaining the quality and standards of dialogue.

More detailed information on the OSFA activity and the activity of partners in 2006 is provided in the pages of this report. In addition to describing program work, the report fulfills the requirement for management and financial transparency of the organization.

Qeverisja e mirëTeksa shkëputet nga një tranzicion i vështirë, Shqipëria bën hapa përpara në përmirësimin e qeverisjes dhe vendosjen e shtetit ligjor. Tashmë në vend vepron një legjislacion bashkëkohor, jep ndihmesë një media përgjithësisht e lirë, po konsolidohen bazat e ekonomisë së tregut dhe është rritur respektimi i të drejtave të njeriut. Aktualisht, administrata publike dhe ajo e pushtetit vendor përballojnë një varg sfidash që lidhen me decentralizimin, pjesëmarrjen e qytetarëve në qeverisje, rritjen e transparencës për publikun etj. Pikërisht, këto sfida përbënë edhe objektin kryesor të veprimtarisë së OSFA-s gjatë vitit 2006 për përmirësimin e qeverisjes.

Good governanceIn its strive to come out of a difficult and protracted transition period, Albania is making important strides ahead towards good governance and rule of law. The country has now a modern and up-to-date legal framework and a largely free media. The market economy is being strengthened and human rights are being respected ever more. Presently, central public administration and local government units are coping with a number of challenges related to decentralization, participation of citizens in governance, increase of transparency, etc. It is precisely these challenges that were the object of OSFA activity in the area of good governance in 2006.

OSFA veproi në këtë fushë në kuadër të NOSA-s duke bashkëpunuar me disa nga institutet më të suksesshme në vend si Co-Plan, ISPL, ISB etj. U punua për thellimin e decentralizimit duke rritur pjesëmarrjen qytetare në qeverisjen vendore; u ushtrua trysni për zhvillimin e proceseve të ndershme gjyqësore si dhe respektimin e të drejtave të njeriut; u kërkua rritja e pjesëmarrjes së grupeve të interesit dhe të qytetarëve në hartimin e politikave dhe bërjen e ligjeve.

Për secilën nga objektivat u zbatuan një sërë aktivitetesh të cilat shfrytëzuan profesionalizmin dhe bashkëpunimin e shumë ekspertëve të fushave përkatëse, grupime profesionale ose grupe interesi, si dhe organizime kolektive qytetare.

Kështu, duke punuar për thellimin e decentralizimit në nivelin e pushtetit lokal, OSFA konceptoi një projekt për nxitjen e partneritetit publik-privat duke ndihmuar e bërë publike rastet më të sukseshme. Një tjetër projekt gjatë vitit 2006 ishte ai për bashkëpunimin ndërkomunor në qeverisjen vendore për shërbimin e transportit publik në rajonin e Tiranës duke sjellë analiza, studime, projekte dhe duke lobuar për këtë çështje. Po aq i vlefshëm rezultoi projekti për shqyrtimin e praktikave më të mira të politikëbërjes në vende të ndryshme dhe aplikimin e tyre në Shqipëri.

Duke e cilësuar gjyqësorin shqiptar si një nga tribunat për mbrojtjen e të drejtave të njeriut, OSFA mbështeti gjatë vitit 2006 kryerjen e një vargu analizash për vlerësimin e kuadrit ligjor dhe standardeve demokratike në gjykatat e vendit. Ajo ofroi gjithashtu advokaci përmes partnerëve të saj për eleminimin e shkeljeve të rënda si dhe zhvilloi sondazhe të opinionit publik në katër gjykata pilote. Por një nga drejtimet më të rëndësishme ishte mbrojtja e të drejtave dhe lirive qytetare përballë disa projekt-ligjesh të propozuara nga qeveria si paketa antikorrupsion, projektligji i policimit etj. OSFA dhe organizata të tjera aktive në këtë fushë si Komiteti Shqiptar i Helsinkit, Qendra për Demokraci dhe Zhvillim, Grupi Shqiptar i të Drejtave të Njeriut, Qendra e Studimeve Parlamentare etj., vepruan me efikasitet për të shmangur mundësi abuzimi me liritë qytetare.

Në linja të përgjithshme veprimtaria e OSFAs në lidhje me përmirësimin e qeverisjes u shtri në disa

OSFA acted in this field in the context of the NOSA arrangement and in close collaboration with some of the most successful institutes in the country such as Co-Plan, IPLS, ICS, etc. The focus of activity remained on the deepening of decentralization and increase of civic participation in policy and decision making at local level. Human rights and access to justice were central and so was the strengthening of interest groups to input into central policy processes.

A number of initiatives were launched to attain each of these objectives specifically. They draw on the professionalism and cooperation of many experts, professional associations and interest groups, as well as civic and community-based organizations.

Thus, while working for the deepening of decentralization, OSFA implemented a project to encourage public-private partnership by disseminating successful models implemented at local level. Another project in 2006 was designed to encourage inter-communal cooperation to improve public transportation in the greater Tirana region. The project conducted analyses, studies and surveys; it disseminated findings, provided recommendations and in the final stage lobbied for achieving improvements to the public transport service. Equally necessary and useful was the project of learning from international best practice in policy and law making to upgrade Albania’s policy and law making experience.

Given the importance of the judiciary branch of governance for human rights implementation, in 2006 OSFA supported the conduct of a number of analyses to assess the legal and regulatory framework, as well as the implementation of democratic standards in the country’s courts. Based on surveys in four pilot courts in the country, the project carried out advocacy for the elimination of human rights violations. However, one of the most important directions of work in 2006 was the protection of civic rights and freedoms from eventual infringements that might result from certain legal packages proposed by the government such as the anticorruption and police draft laws. OSFA and other pro-active organizations such as the Albanian Helsinki Committee, the Center for Democratization and Development of Institutions,

Bashkëveprimi Ndërkomunor në Qeverisjen Vendore dhe Zhvillimi Rajonal

Ky projekt, i ndërmarrë nga Co-PLAN në kuadër të NOSA-s, shqyrtoi mundësitë për një bashkëveprim të mirë midis njësive të pushtetit vendor. Qëllimi i tij është përmirësimi i shërbimeve publike gjatë reformave të decentralizimit.

Projekti filloi në janar të vitit 2006 me analizën e reformave për decentralizmin e vendit dhe delegimit të kompetencave drejt qeverisjes vendore. Gjatë muajve mars-prill u kryen intervistime të shumta me institucione dhe organizata të përfshira në këtë proces, si Ministria e Brendshme, Minisitria e Punëve Publike, Transportit dhe Telekomunikacionit, USAID, PNUD, GTZ, SNV, Shoqata e Ujësjelles-Kanalizimeve dhe përfaqësues të pushtetit lokal (bashki/komune/qark).

Më pas u përzgjodh për analizë shërbimi i transportit publik në rajonin e Tiranës. Zbatuesit e projektit zhvilluan konsultime me ekspertë nga bashkitë, komunat, qarku i Tiranës dhe ekspertë të ministrive. Më 19 korrik 2006, grupit këshillimor për projektin zhvilloi një takim pune me pjesëmarrje të gjerë nga Ministria e Transportit, përfaqësues të Bashkisë së Tiranës, kryetarë të komunave, drejtues të shoqatave të bashkive dhe komunave, etj. Takimi vuri në dukje vështirësitë aktuale dhe mundësitë e një bashkërendimi të ardhshëm mes pushteteve dhe institucioneve përkatëse.

Në fazën përfundimtare të projektit, dhjetor 2006-janar 2007, u organizua seminari «Shërbimi i

the Albanian Human Rights Group, the Center for Parliamentary Studies, etc., took effective steps to avoid potential violations to civic liberties.

In broad lines, OSFA activity in the field of good governance spanned over several directions concurrently: surveys of legal and policy frameworks; submissions of policy options and recommendations; monitoring of court proceedings through direct observations; continuous oversight and monitoring of government strategies and budgets; advocating for certain issues; pressuring for change; strengthening the capacities of local government units and civil society organizations; piloting of best practice partnerships; struggling for increased transparency of public institutions, etc.

Inter Communal Cooperation and Regional Development

Launched by Co-PLAN in the NOSA framework, the project reviewed opportunities for better cooperation among the local government units. The goal was the improvement of public services in the context of decentralization reforms.

The project started in January 2006 with an analysis of the country’s decentralization reforms and the delegation of powers to the local level of government. In the months of March-April, Co-Plan conducted a survey of organizations and institutions with a stake in the process such as the Interior Ministry, the Ministry of Public Works, Transportation and Telecommunications, USAID, UNDP, GTZ, SNV, the Association of Water Supply and Sewage and representatives of local governments (municipality/commune/region).

Following the survey stage, the project focused on the analysis of public transportation in the greater Tirana region. The project implementers held consultations with experts at the municipalities, communes, the region of Tirana and the line ministries. On 19 July 2006, the project advisory group held a working meeting with representatives of the Ministry of Transports, the Municipality of Tirana, heads of the communes, leaders of the Associations of Mayors and Communes, etc. The meeting pointed out the actual difficulties and real opportunities towards coordination of relevant authorities at all levels.

Në të u paraqitën gjetje dhe rezultate të nxjerra nga zbatimi i projektit mbi «Bashkëveprimi ndërkomunor në qeverisjen vendore dhe zhvillimi rajonal» dhe të dhëna nga pyetësorët me qytetarët e rajonin të Tiranës. Pjesëmarrësit, drejtues dhe specialistë nga Prefektura, Bashkia e Tiranës, institute aktive në këtë fushë, shoqata mjedisore etj., diskutuan mbi domosdoshmërinë e integrimit të shërbimeve publike në rajon, duke shmangur fragmentarizimin aktual. Ata vlerësuan njëzëri konceptimin dhe funksionimin e një Autoriteti Metropolitan për Tiranën, me qëllim vendosjen e standardeve të njëjtësuara në shërbim të qytetarit. Një nga përfitimet më të dukshme të kësaj do të ishte zbutja e trafikut të ngarkuar në kryeqytet dhe ulja deri në shkallën 25% e ndotjes mjedisore aktuale.

Rekomandimet e studimit janë tashmë objekt i lobimit që po bëhet pranë institucioneve përgjegjëse.

In the concluding stage of the project, in December 2006-January 2007, Co-Plan held the seminar: Public Service Transport in the greater Tirana Region. The Seminar presented findings and outputs from the implementation of the project Inter Communal Cooperation and Regional Development. The seminar focused on the presentation of findings from the questionnaires with citizens in the region of Tirana. Participants,

including from the Prefecture, the Municipality of Tirana, professional institutions, environmental associations, etc., discussed on the necessity to integrate the service of public transportation in the region and to avoid actual fragmentation. The seminar welcomed the proposal of creating the Tirana Metropolitan Authority to work towards the establishment of standardized service delivery for citizens. Significant results from implementation of this initiative would be the relieving of the heavy traffic in the capital city and the reduction of environmental pollution to 25% of its present levels.

Recommendations of the study are now the object of lobbying efforts with the responsible institutions.

Gjykimi i drejtë dhe të Drejtat e Njeriut

Instituti për Studimet Publike dhe Ligjore (IPLS) në kuadër të NOSA-s ndërmori projektin mbi Gjykimin e Drejtë dhe të Drejtat e Njeriut. Ky projekt, që i përket fushës së gjyqësorit, bazohet në zhvillimin e tri elementeve kryesore : 1. Aksesi i Palëve në Gjykim; 2. Procesi Gjyqësor; 3. Transparenca e Gjykatave.

Në fazën e parë të projektit u bënë vlerësime të kuadrit ligjor dhe standarteve bashkohore demokratike. ISPL angazhoi nje ekip pune të përbërë nga ekspertë të jashtëm me përvojë të gjatë juridike në lidhje me gjyqësorin shqiptar. Ekspertët e angazhuar përzgjodhën dhe shqyrtuan dokumentacionin bazë të gjyqësorit shqiptar si :

-Kushtetuta e Republikës së Shqipërisë -Konventa Europiane për të Drejtat e Njeriut -Kodi i Procedurës Civile i Republikës së Shqipërisë -Kodi i Procedurës Penale i Republikës së Shqipërisë -Ligji për të Drejtën e Informimit, etj.

Vrojtimet dhe analizat e tyre mundësuan vlerësimin e kuadrit ligjor dhe standarteve bashkëkohore demokratike; monitorimin e gjendjes përmes sondazheve të opinionit të përdoruesve të katër gjykatave pilote dhe vrojtimit të drejtpërdrejtë të tyre; si dhe avokati për eleminimin e shkeljeve të vërejtura.

Kështu, gjatë zbatimit të projektit u zhvilluan tre produkte konkrete për zhvillimin e një avokatie në shërbim të respektimit të të drejtave të njeriut në gjykatë: 1. U botua dhe u shpërnda një studim prej rreth 100 faqesh, që parashtroi të gjitha gjetjet, problemet dhe konkluzionet. Ai shërbeu për informimin dhe tërheqjen e vëmendjes së aktorëve vendimmarrës (ekzekutivi, KLD) ose ndikues (shoqeria civile) në mirëfunksionimin e gjyqësorit në Shqipëri; 2. U përgatitën dhe u shpërndanë fletëpalosje për palët në gjykatë. Me një gjuhë të lehtë e të qartë, fletëpalosjet e vëna në dispozicion do të orientojnë dhe ndihmojnë palët, duke i bërë ato të ndërgjegjshme për të drejtat e tyre dhe detyrimet e gjykatës; 3. U organizua një tryezë e rrumbullakët institucionale ku u diskutuan të dhënat e studimit përmbledhës mes aktorëve të ndryshëm.

Fair Trial and Human Rights

The Institute for Public and Legal Studies (IPLS), as part of the NOSA arrangements, implemented the project on Fair Trial and Human Rights. The project falls under the Rule of Law program area and has three main pillars: 1.Access to justice; 2. Fair trial proceedings; and 3. Court transparency.

The first phase of the project conducted assessments of the legal framework and actual standards in the court proceedings. IPLS engaged a group of some of the best experts in the country and with long-time experience in the Albanian judiciary to review the present state of the art of Albanian Courts in relation to the implementation of such basic documents as:

-The Constitution of the Republic of Albania, -The European Human Rights Convention, -The Code of Civil Procedure of the Republic of Albania, -The Code of Penal Procedure of the Republic of Albania, -The Freedom of Information Act, etc.

Their assessments and analysis enabled an objective evaluation of the legal framework vis-à-vis democratic standards. Other activities in the project include the monitoring of the situation through public opinion surveys in the four pilot courts; direct observation of proceedings in these courts, as well as the launching of advocacy and pressure to eliminate the evidenced violations.

The project yielded three main outputs to be used in advocacy action for increased human rights in court proceedings: 1. a one-hundred page study which presents the problems, findings and concussions. The study serves to inform and increase awareness of the decision makers (the High Council of Justice and the Government) and the civil society on the need to improve court proceedings in Albania; 2. Informational leaflets which were produced and distributed to parties in legal suits. With an easy and clear language, the leaflets inform and orient the sides to demand the implementation of their rights in court proceedings; 3. The round table which was organized to discuss the findings of the study among the various concerned actors succeeded in generating awareness and consensus on the necessary measures.

Studim për praktikat më të mira të politikëbërjes

Ky projekt, i ndërmarrë nga Instituti i Studimeve Bashkëkohore (ISB) në kuadër të NOSA-s pati si qëllim të shqyrtonte praktikat më të mira të politikëbërjes në vende të ndryshme dhe të lobonte përdorimin e tyre në Shqipëri.Këto praktika do të përdoren më pas për përshtatjen, adoptimin dhe zbatim e ligjeve në vend. Ekspertët punuan në tri objektiva kryesore:

- studimi i detajuar i përvojës ndërkombëtare; - analiza e procesit politikëbërës dhe ligjbërës në Shqipëri; - analiza e kapaciteteve për aktorë shoqërorë dhe për institucione publike.

Në studimin e përvojës ndërkombëtare iu është kushtuar vëmendje e madhe «Vlerësimit të Pasojave të Ligjit» (Regulatory Impact Assessment) ose RIA-s. Ky është një instrument dhe një proces që shërben për të nxjerrë në dukje pasojat e pritshme të projektakteve apo pasojat e prodhuara të një akti normativ ekzistues, me qëllim përmirësimin e politikëbërjes në procesin e hartimit të akteve normative. Në këtë kuadër u studiuan disa nga përvojat e demokracive të përparuara dhe të demokracive të reja të Europës Lindore, të Rajonit të Ballkanit. Të dhënat janë botuar tashmë në formë elektronike.

Fusha tjetër e projektit, «Analiza e procesit politikëbërës në Shqipëri», synoi të ndikonte në përmirësimin e politikëbërjes. Ky përmirësim do të jetë për një kohë të gjatë në qendër të masave reformuese qeveritare. Ai është një nga aspektet më të rëndësishme të qeverisjes së mirë me të dy elementët bazë: qeverisja demokratike dhe qeverisja produktive. Analiza e kryer nga bashkëpunëtorët e ISB-së shqyrtoi procedurat, standartet dhe kapacitetet aktuale, mundësinë ose pamundësinë për të siguruar një proces vendimarrje të përshtatshëm. U vëzhgua gjithashtu përgjegjshmëria e politikëbërësve në marrjen e vendimeve si dhe pjesëmarrja e komunitetit në këtë proces.

Kjo analizë solli gjithashtu parimet mbi të cilat duhet ngritur ky proces dhe vështirësitë e tij në vend. Ligji duhet të kërkojë zgjidhjen më të qëndrueshme

Study of Best Practice in Policy Making

Undertaken by the Institute for Contemporary Studies (a NOSA member organization) this project was aimed at bringing to Albania the best practices of policy making from various countries. These practices will serve to guide the process of improving law making as one of the preconditions for improved law enforcement in the country. The project envisages three main stages:

-Knowledge of international best practice; -Analysis of the Albanian policy and law making process; and -Assessment of the policy/law making capacities both in the public administration and in the civil society sector.

As part of exploring international best practice, great attention was paid to the Regulatory Impact Assessment - RIA. This is an instrument which is used to determine the impact of the new policies and laws in an effort to adopt the best option. In this context, the experiences of some of the new democracies in Eastern Europe and Western Balkans were analyzed, alongside the practice of some of the advanced democracies in the world. Information has been made available on line.

The second direction, the study of the Albanian policy and law making practice, looked specifically at opportunities for improvements. The improvement of policy/law making will for a long time be at the epicenter of the Government’s reformation efforts. It is one of the most important aspects of good governance in both dimensions: democratic governance and efficient governance. The analysis carried out by the ICS experts has reviewed the existing procedures, standards and capacities in order to arrive at solid conclusions about the possibility/impossibility of putting in place an adequate decision making process. The focus of review has also been on the accountability of policy and decision makers and the participation of civil society and stakeholder groups in these processes.

The analysis of the law making process in Albania presents the principles on which the process should stand. It also identifies the difficulties and obstacles on the way to improvements. The adopted policies and laws should guarantee sustainable and cost effective solutions which reduce negative side effects to the

dhe të përballueshme për sa më pak efekte të padëshirueshme anësore dhe me kosto sa më të ulët për arritjen e synimit. Raporti i ISB analizon kuadrin kushtetues dhe ligjor përmes të cilit mundësohet procesi i hartimit të akteve normative në Shqipëri. Vazhdimësia e Fellowship-it

Gjatë vitit OSFA iu bashkëngjit nismës së UNDP-së dhe IOM-it për krijim kapacitetesh duke u mbështetur te diaspora dhe veçanërisht te të rinjtë që kryejnë studimet universitare dhe pasuniversitare jashtë vendit.

Ndër tre kompontentët e veçantë që përmban kjo nismë si mbështetja e sektorit privat, ndërtimi i kapaciteteve dhe mbështetja për krijimin e kapitalit social në vend, OSFA vazhdoi të mbështesë nismën për krijimin e kapitalit social në vend kryesisht duke mbështetur të rinjtë që kanë studiuar jashtë dhe janë kthyer e punojnë në administratën publike.

Në kuadër të këtij projekti OSFA asistoi disa ministri të rëndësishme dhe Bashkinë e Tiranës. Shumë nga fellow-t e mbështetur më parë nga OSFA dhe të organizuar tashmë në bërthama, u nxitën për të kontribuar në procesin e reformave nëpërmjet stimujve për zhvillim profesional. U ofrua asistencë teknike për fushat kryesore të reformës me ekspertizë dhe këshillime në lidhje me privatizimin e sektorëve strategjikë, hartimin e marrëveshjeve konçesionare, sigurimin e konkurrencës së ndershme, etj. Po në interes të vazhdimësisë së Fellowship-it u punua për krijimin e një kuadri të favorshëm ligjor për kthimin e të diplomuarve jashtë vendit. Programi dha asistencë për thjeshtimin e procedurave ligjore dhe lehtësimin e integrimin e të sapokthyerve.

Following up on the Fellowship Programs

In 2006, OSFA joined UNDP and IOM in their efforts to build capacity by drawing on the Albanian Diaspora and especially by trying to attract to the country Albanian alumni of universities abroad.

Of the three components contained in this initiatives: supporting the private sector; building capacity; and creating social capital in the country, OSFA focused on strengthening social capital in the country, mainly by supporting the members of the civil service who represent young Albanian alumni of foreign universities.

In the framework of this project, OSFA provided assistance to some of the important line ministries and the Municipality of Tirana. Many of the previously supported fellows of the OSFA Fellowship Programs, now forming nucleuses in their relevant institutions, through professional development incentives, were encouraged to contribute to the integration and reform processes. Assistance was made available in the main reform areas through provision of expertise and advisory services for privatization of strategic sectors, the design of concessionary agreements, fair competition, etc. As part of the efforts to maintain and enhance the results of previous fellowship programs, OSFA work focused on the creation of an enabling legal and institutional framework for the returnees of foreign universities. The Program granted support to the simplification of regulations and the facilitation of returnees from studies abroad.

Main beneficiaries of this program during the year 2006 were the Ministry of Economy, the Ministry of Integration, the Ministry of Foreign Affairs, the Ministry of Finance, and the Municipality of Tirana.

Politikat antikorrupsion dhe respektimi i të drejtave të njeriut

Në muajt e parë të vitit 2006, qeveria shqiptare ndërmori disa iniciativa ligjore me synim luftën ndaj dukurisë së korrupsionit. Këto politika u konsideruan edhe nga shoqëria civile si inisiativa të domosdoshme, të rëndësishme për zhvillimin e vendit, për konsolidimin e demokracisë dhe për përmbushjen e aspiratave të Shqipërisë për integrimin në Bashkimin Europian. Por shoqëria civile nuk mund të heshtte as kësaj radhe ndaj rrezikut të cënimit të të drejtave dhe lirive themelore të njeriut. Respektimi i të drejtave të njeriut në përputhje me Kushtetutën përbën në thelb një parakusht për suksesin e këtyre inisiativave.

Pikërisht mbi këtë çështje u mbajt në muajin mars një tryezë e rrumbullakët me temë «Politikat antikorrupsion dhe respektimi i të drejtave të njeriut». Organizatorë të tryezës ishin Komiteti Shqiptar i Helsinkit, Grupi i të Drejtave të Njeriut, Qendra Shqiptare e të Drejtave të Njeriut, Qendra e Studimeve Parlamentare dhe Qendra për Nisma Ligjore Qytetare. Aktiviteti ishte në bashkëpunim dhe i mbështetur nga Fondacioni i Shoqërisë së Hapur për Shqipërinë - Soros. Në të u shqyrtua konkretisht projektiligji «Për bashkëpunimin e publikut në luftën kundër korrupsionit»; Vendimet e Këshillit të Ministrave për shmangien e nepotizmit në administratën publike, tatimore dhe doganore si VKM «Për shmangien e nepotizmit dhe ndikimit të pushtetit në rekrutimin dhe karrierën e personelit të administratës tatimore» dhe ai «Për shmangien e nepotizmit në administratën publike»; projektligji «Për informacionin e klasifikuar sekret shtetëror»; dhe së fundi «Moratoriumi mbi mjetet e lundrimit».

Organizatorët e tryezës, të cilët prej disa muajsh vëzhguan dhe shqyrtuan me vëmendje nismat ligjore qeveritare të ndërmarra në kuadrin e politikave antikorrupsion, i dërguan disa relacione dhe raporte Kryetares së Kuvendit, Komisionit të Ligjeve, etj. Pjesëmarrësit në diskutim, përfaqësues të shoqërisë civile, medias dhe qarqeve akademike – univesitare, tërhoqën vëmendje për rrezikshmërinë e disa formulimeve ligjore të cilat linin shteg për interpretime subjektive ose abuzive. Anticorruption Policies and Respect for Human Rights

In the first months of 2006, the Albanian government launched a number of legal initiatives aimed at fighting corruption. The civil society considered these initiatives as necessary and useful for the country’s development, the consolidation of democracy and the fulfillment of conditions for Albania’s integration with the European Union. However, the civil society could not remain indifferent to the risk of curbing basic rights and civic liberties. Indeed, the implementation of these rights in accordance with the Constitution of Albania is a precondition for the success of anti-corruption policies.

In March 2006, civil society gathered in a round table to discuss Anticorruption Policies and the Implementation of Human Rights. The Albanian Helsinki Committee, the Albanian Human Rights Group, the Albanian Center for Human Rights, the Center for Parliamentary Studies and the Center for Civic and Legal Initiatives were among the initiators of the round table. OSFA joined the initiative and provided financial support to its implementation. The round table discussed specifically about the draft law concerning Public Cooperation in the Fight against Corruption; the decisions of the Council of Ministers to avoid nepotism and traffic of influence in the recruitment and career of civil servants, tax officers and customs personnel; the draft law on Information classified as state secret as well as the more recent Moratorium on sea vessels.

The organizers of this round table had been monitoring the government’s move in the framework of anticorruption measures from the very initiation of the new cabinet. The round table sent reports to the President of the Parliament, the Law Commission of the Albanian Parliament, etc. The participants at the round table, representatives of the civil society, the media and academic and university circles drew attention on certain points in the draft laws and decisions that created premises for subjective and abusive interpretations. The round table produced a memorandum underlying that although anticorruption is a priority for the

Debat i shoqërisë civile mbi projekt-ligjin e Policisë së Shtetit

OSFA bashkëveproi me aktorë të tjerë të shoqërsië civile edhe lidhje me projektligjin mbi Policinë e shtetit. Me pjesëmarrje të gjerë të organizatave të mbrojtjes së të drejtave të njeriut me mbështetjen e Fondacionit të Shoqërisë së Hapur- Soros, u zhvillua tryeza e rrumbullaktë me tematikë «Decentralizimi & Policimi në Komunitet». Kjo tryezë debatoi mbi projekt-ligjin e ri duke e krahasuar atë me ligjin aktual të Policisë së Shtetit si dhe duke shprehur shqetësimin për mungesën e bashkëpunimit dhe të mospjesemarrjes së grupeve qytetare dhe ato të të drejtave të njeriut. Ndër fokuset kryesore të tryezës veçojmë:

As a result of action taken by civil society and other actors, the Constitutional Court of Albania knocked down the law concerning Avoidance of Nepotism in the Public Administration,» while the law on Information Classified as State Secret was returned for reconsideration to the government.

Civil Society taking action on the draft law concerning State Police

OSFA cooperated with other civil society actors to take a stand on the new draft law concerning State Police. With the broad based participation of human rights organizations and the support of the Open Society –Soros- Foundation for Albania, a round table entitled Decentralization and Community Policing was held to discuss the draft law. The participants discussed the new draft law and compared it to the existing law on State Police. Participants expressed concern over the lack of cooperation and lack of consultations with civil society and human rights groups in the process of making the new draft. The following arguments stood out:

Organizatorë të tryezës ishin: Instituti për Demokraci dhe Ndërmjetësim, Shoqata e Bashkive të Shqipërisë, Komiteti Shqiptar i Helsinkit, Grupi Shqiptar i të Drejtave të Njeriut, Qendra Shqiptare për të Drejtat e Njeriut, Qendra për Studime Parlamentare, Forumi i Mendimit të Lirë, Shoqata e Komunave të Shqipërisë. Morën pjesë gjithashtu ekspertë të fushës, përfaqësues të misioneve PAMECA dhe ICITAP, OSBE, të Delegacionit të Komisionit Evropian, Këshillit të Evropës, ish-drejtues dhe ekpertë të lartë të Policisë së Shtetit, përfaqësues të medias, etj.

Organizatorët shpërndanë një letër të hapur drejtuar komisioneve parlamentare të ligjeve dhe të sigurisë kombëtare duke kërkuar shtyrjen e afatit të votimit të këtij projekt-ligji në mënyrë që grupet e ekspertëve të shpreheshin në lidhje për projektligj. Përfaqsues të organiztave të mësipërme morën pjesë në diskutimin që u organizua në Komisionin Parlamentar të Sigurisë Kombëtare. Aktualisht ky ligj është kthyer për t’u rishikuar.

The draft law did not undergo professional broad-•based discussions with the various levels of police leaders. Neither was it discussed with stakeholders, especially civic and human rights groups.

The abolition of some articles in the new draft •which were considered to be the strong points of the existing version of the law such as articles 58 (public relations), 58 (relations with the public administration), 59 (relations with local government units) which may potentially alienate State Police from direct relations with communities and community representatives at the local government structures.

The new draft has serious mistakes as regards •legal discourse which may become the basis for ambiguities and subjective interpretations.

The round table was initiated by the Institute for Mediation and Democracy, the Association of Communes, the Albanian Helsinki Committee, the Albanian Human Rights Group, the Albanian Center for Human Rights, the Center for Parliamentary Studies, the Forum of Free Thought, and the Association of Municipalities. The round table was also attended by experts in the field, representatives of the PAMECA and ICITAP missions, OSCE, the Delegation of the European Commission, the Council of Europe, formers leaders and senior experts of State Police, media representatives, etc.

Organizers addressed an open letter to the parliamentary commissions of law and national security asking them to defer the passing of the new draft until experts and interest groups had been consulted. Representatives of the above mentioned organizations participated in hearings by the Parliamentary Commission of National Security. The draft was returned for improvements.

Tryezë e rrumbullaktë mbi KKRT dhe RTSH

Gjatë muajit shkurt OSFA mbështeti Lëvizjen MJAFT dhe shumë personalitete të medias, gazetarë dhe pjesëtarë të tjerë të shoqërisë civile në Shqipëri, të organizonin një tryezë të rrumbullakët mbi Këshillin Kombëtar të Radio-Televizionit, KKRT dhe Radio-Televizionin Shqiptar, RTSH. Aty u shprehën shqetësimet mbi ndryshimet që do të sillte projekt-ligji për ndryshimin e ligjit «Për Radion dhe Televizionin Publik e Privat në Republikën e Shqipërisë» në funksionimin e KKRT dhe RTSH. Projekt-ligji, i hartuar pa përfshirjen e grupeve të interesit dhe aktorëve në fushën e medias dhe shoqërisë civile, rezultoi se rrezikonte krijimin e një KKRT-je dhe një Këshill Drejtues të RTSH-së të pabalancuar dhe politikisht të varur.

Për këto arsye, OSFA, MJAFT, së bashku me institucionet mediatike, gazetarë dhe shoqërinë civile në Shqipëri i bëri thirrje Qeverisë, Kuvendit të Shqipërisë dhe Komisioneve Parlamentare që aprovimi i këtij projekt-ligji të pezullohej. Ata kërkuan që ndërkohë të fillonte procesi i konsultimit me grupet e interesit dhe shqyrtimi i alternativave të funksionimit të këtyre institucioneve të rëndësishme për demokracinë në Shqipëri.

Round table on the new National Council of Albanian Radio and Television and the new Leading Council of the Public Radio and TV Station

In the month of February OSFA supported the Movement MJAFT and a number of media personalities, journalists and civil society representatives in Albania to convene a round table on the new draft law on the National Council of Radio and Television and the Leading Council of the Public Radio and TV Station. The round table expressed concern over the negative effects that would ensue from changes to the law Concerning Public and Private Television in the Republic of Albania. The negative effects would be seen in the functioning of the Radio and Television National Council and of the Leading Council of the Public Radio-Television Station. Designed without the participation of interest groups and actors of the media and civil society, the proposed changes risked the creation of unbalanced and politically dependent structures.

For these reasons, OSFA-MJAFT together with journalists, media and civil society representatives called on the Government, the Parliament, and Parliamentary Commissions to suspend the law. They demanded that consultations with interest groups and the review of alternative options precede the making of the law concerning the operations of these important institutions for democracy in Albania.

Takimi rajonal për «Zgjedhje të lira e të ndershme»

Përvojat e ndryshme të vendeve të rajonit, angazhimet e përbashkëta në lidhje me proceset zgjedhore u sollën në Tiranë me mbështetjen e OSFA dhe Institutit Shqiptar për Zhvillimin e Sistemit të Zgjedhjeve në seminarin «Zgjedhjet e lira dhe të ndershme». Morën pjesë organizata vëzhguese të zgjedhjeve nga vende të ndryshme të Europës Juglindore si Maqedonia, Mali i Zi, Moldavia, Kosova dhe Rumania. Në këtë takim, i cili zhvillohej në kuadër të programit Lindje-Lindje, u përfaqësuan disa organizata lokale, aktive në monitorimin e proceseve zgjedhore dhe u sollën përvojat e vendeve pjesëmarrëse në lidhje me organizimin e fushatave zgjedhore, transparencën e financimeve, kodet elektorale, nivelin e pjesëmarrjes së publikut në zgjedhje, etj.

Te pranishmit në takim folën edhe për angazhimin e shoqërisë civile në reformën elektorale dhe u bënë thirrje partive politike shqiptare të uleshin në bisedime për të ndryshuar Kodin Zgjedhor. Takimi bëri publik shqetësimin se realizimi i ndryshimeve në këtë kod ishte emergjent dhe se vonesat në kryerjen e kësaj reforme po krijonin pikëpyetje për zhvillimin e zgjedhjeve të ardhshme administrative.

Regional Meeting: Domestic Observers and Follow up Reports for Free and Fair Election Processes

The various experiences of the regional countries and the common commitment to improvement of election processes were brought to Tirana with the support of OSFA and the Albanian Institute for the Development of Election Systems to focus on Conducting Free and Fair Elections. The Seminar was attended by organizations committed to free elections from the various countries of Southeastern Europe such as Macedonia, Montenegro, Moldova, Kosova and Romania. This meeting supported under the East East Program was attended by a number of local organizations engaged in the monitoring of election processes. The participants discussed their experiences in the organization of election campaigns, the transparency of political party financing, the electoral codes, voter turnout, etc.

The participants in the meeting discussed about the involvement of civil society in electoral reforms and called on Albanian political parties to sit in negotiations to improve the election code. The meeting drew attention to the fact that improvements in the code should be undertaken urgently and that delays in reform steps would create insecurities for the development of the upcoming administrative elections in Albania.

Workshop për strehimin publik

Takimi i tretë rajonal për rishikimin e Deklaratës së Vjenës

OSFA, nëpërmjet programit Lindje – Lindje, mbështeti zhvillimin e workshopit «Strehimi publik» që u zhvillua në Tiranë më 4 dhe 5 maj në kuadër të takimit të tretë Rajonal të Paktit të Stabilitetit, për rishikimin e deklaratës së Vjenës.

Gjatë workshopit u bënë përpjekje për të njohur ecurinë e çdo vendi në zbatimin e angazhimeve të marra në kuadër të Deklaratës së Vjenës për vendbanimet informale, politikat e strehimit dhe menaxhimit urban. Gjithashtu u aprovua një propozim i përbashkët për forcimin e kapaciteteve në menaxhimin urban dhe strehim në rajon.

Morën pjesë përfaqësues të Shoqërisë Civile dhe Universiteteve nga Maqedonia, Kosova, Mali i Zi, Serbia, Bosnja dhe Hercegovina, përfaqësues nga Banka për Zhvillim e Këshillit të Europës, Banka Europiane e Investimeve, Agjencia Austriake për Zhvillim, Agjencia Sviceriane për Zhvillim, UN-Habitat, Pakti i Stabilitetit dhe ekspertë nga Hollanda dhe Italia. Nga pala shqiptare ishin të pranishëm përfaqësues nga Ministria e Punëve Publike, e Telekomunikacionit dhe Transportit, nga Universitetet, Shoqata e Bashkive, Shoqëria Civile, etj.

Gjatë takimit u nxorrën në pah problematikat e vendbanimeve informale, të zhvillimit urban dhe strehimit me të cilat përballen vendet e rajonit, u krahasuan përvojat dhe specifikat tradicionale të çdo vendi.

Workshop on Public Housing

Third Regional Workshop on the Review of the Vienna Declaration

Through the East East Program, OSFA supported the development of the Workshop «Public Housing» which took place in Tirana on 4-5 May 2006 in the framework of the Third Regional Meeting of the Stability Pact for the Review of the Vienna Declaration.

The participants at the Workshop attempted to learn about the progress made by countries towards the implementation of commitments made under the Vienna Declaration concerning informal settlements, housing policies and urban management. The workshop adopted a joint proposal on the strengthening of capacities in the field of urban management and housing in the region.

The meeting was attended by representatives of civil society and universities from Macedonia, Kosova, Montenegro, Serbia, Bosnia and Herzegovina and employees of the Council of Europe Bank for Development, the European Investment Bank, the Austrian Agency for development, the Swiss Development Cooperation, UN Habitat, Stability Pact and experts from the Netherlands and Italy. The Albanian side was represented by the Ministry of Public Works, Transports and Telecommunications, the Universities, the Association of Municipalities, the civil society, etc.

The meeting brought to the fore issues related to informal settlements, urban developments and housing which face the countries of the region. It also provided for exchanges and the traditional specificities of each country.

European IntegrationIntegration processes represent one the greatest challenges faced by the Albanian society and government. Although citizens are overwhelmingly in favor of integration, the progress of the process shows that achievements have been made mainly at the technical level. At the level of reforms, achievements are less remarkable. Public perception of the process, of the real costs and benefits is based on myths and simplistic expectations.

Nënshkrimi i Marrëveshjes së Stabilizim Asocimit dhe aktivizimi i Marrëveshjes së Ndërmjetme Ekonomike me BE-në, gjatë vitit 2006, theksuan edhe më tepër nevojën për ta konsideruar procesin e Integrimit Europian si një nga përparësitë e OSFA-s. Në këtë kontekst OSFA dhe partnerët e saj hartuan një strategji tre vjeçare, 2006 – 2008, që synon të rrisë ndërgjegjësimin qytetar për proceset integruese, duke bërë të mundur pjesëmarrjen e shoqërisë civile dhe të grupeve të interesit në monitorimin e reformave. Objektivat kryesorë në këtë trevjeçar janë:

Qartësimi i përfitimeve dhe kostove të integrimit •duke synuar që ai të shndërrohet nga një retorikë politike në një realitet të prekshëm për të gjithë;

Nxitja e përfshirjes të shoqërisë civile, •komuniteteve të biznesit, autoriteteve vendore, mediave qendrore etj;

Rritja e kapaciteteve negociuese përmes •aktivizimit të ekspertëve shqiptarë dhe të huaj.

Një varg produktesh u bënë publike gjatë vitit 2006. Kështu nisi botimi i Gazetës EUROPA, e cila sjell më pranë qytetarit shqiptar BE-në dhe procesin e Integrimit. Ajo informon në lidhje me shtetet anëtare të BE-së dhe stategjitë që zbatohen sot në vend si dhe nxit debatin intelektual e akademik në lidhje me sfidat e këtij procesi. Një botim tjetër interesant ishte Pasaporta e Stabilizim Asocimit, një libërth simpatik, i dizenjuar këndshëm dhe me ligjërim të thjeshtë që shërbeu për të publikuar të dhëna konkrete nga kjo marrëveshje.

Rëndësi e veçantë iu kushtua monitorimit të këtij procesi. Një seri debatesh, anketimesh, botime raportesh dhe konferencash vijuan përgjatë gjithë vitit 2006 duke synuar angazhimin e shoqërisë civile në proces, rritjen e informacionit për qytetarët, nxitjen e pjesëmarrjes së tyre dhe të grupeve të interesit, rritjen e trysnisë ndaj qeverisë për mbrojtje në shkallë më të gjerë të interesave të qytetarëve dhe kryesisht të biznesit vendas.

Një pjesë e këtyre projekteve janë mbështetur dhe aktivizuar nëpërmjet Programit Lindje-Lindje. Në këtë program rrjeti, OSFA ka mbështetur projekte që synojnë forcimin e bashkëpunimit ndër-rajonal mes aktorëve të ndryshëm të shoqërisë civile, me qellim sjelljen në rajon të përvojës së vendeve anëtare të BE-së.

The signature of the Stabilization and Association Agreement and the entering into force of the Interim Agreement with the EU during 2006, further underlined the need to consider the process of European integration as one of the significant priorities for OSFA work. In this context, OSFA and its partners designed a three-year strategy 2006-2008 aimed at increasing public awareness on the integration processes by enabling the participation of civil society and interest groups in the monitoring of reforms. The main objectives of the three-year strategy are:

Clarification of integration costs and benefits •aiming at moving integration away from political rhetoric into a tangible reality for all;

Enhancement of the involvement of civil society, •business communities, local authorities, the media, etc;

Increase of negotiating capacities through the •expertise of Albanian and foreign specialists.

A number of outputs were made available to the public in 2006. Thus, the journal EUROPA started to be published. It brings the EU and integration processes closer to the Albanian citizens. The journal provides information on the EU member countries and the country strategies, thus encouraging intellectual discussions and academic debates on the challenges of integration. Another interesting publication in 2006 was the Stabilization and Association Passport, an attractive handbook, pleasantly designed and written in simple language to disseminate concrete elements of the Agreement..

Special importance was paid to the monitoring of this process. A series of debates, surveys, reports and conferences were held in the year 2006 aimed at increasing civil society involvement in the integration processes, the increase of information flow for the public, increase of the role of interest groups, increases of pressure on the government to scale up protection for citizen interests and the local businesses in particular.

A part of these projects were supported and activated through the East East Program. Through this network program, OSFA supported projects designed to further inter-regional cooperation among the civil society actors and enabled access to experiences of EU member countries.

Monitorim i procesit të Stabilizim Asocimit në Shqipëri

Monitorimi i procesit të Stabilizim Asocimit është një nga mënyrat efikase për të kontribuar në procesin e integrimit europian të vendit. Falë sondazheve, vëzhgimeve, anketimeve dhe raportimeve të vazhdueshme, do të ndikohet drejtpërsëdrejti në qartësimin e situatës për këtë proces. Ky projekt ka nisur tashmë të nxisë debatin e shoqërisë civile në lidhje me procesin e Stabilizim-Asocimit në vend. Nëpërmjet tij synohet gjithashtu:

Sqarimi i opinionit publik për përfitimet dhe •kostot e integrimit;

Ndërveprimi mes shoqërisë civile dhe •institucioneve shtetërore;

Krijim kapacitetesh në institucionet shtetërore; •

Zhvillim i mendimit shqiptar shkencor për •procesin e integrimit europian të vendit.

Gjatë vitit 2006 u bënë publike dy raporte simestrale të hartuara nga Instituti i Studimeve Ndërkombëtare (AIIS).

Raporti i parë

përfundoi dhe u bë i njohur në fund të muajit qershor. Ai u shpërnda në institucionet qendrore e vendore si dhe në grupet e interesit të lidhura ngushtë me procesin.

In broad lines, the results of European Integration are: increase of information on the European Integration, reviews/support for national and international institutions though studies, surveys and lobbying activities; improvement of the capacities of public administration/judiciary/civil society through provision of training programs and other activities, various publications on emerging issues of the Albanian reality, but also of the European and regional reality.

OSFA has implemented this strategic priority of NOSA by working closely with very important partner organizations such as the Albanian Institute for International Studies, the European Center, the Albanian Helsinki Committee, etc.

Monitoring the Stabilization and Association Process in Albania

Monitoring the association and stabilization process is one of the most efficient ways to contribute to the European Integration of the country. Through surveys, observations, questionnaires and continuous reporting efforts are made to directly influence the process and clarify the situation with regard to measures taken. The project has already succeeded in encouraging the civil society debate related to the process of stabilization and association in the country. The project also aims at:

Clarifying the real costs and benefits of European •Integration;

Establishing interaction between civil society and •governmental institutions;

Creating capacity in the government institutions;•

Promoting the development of Albanian scientific •thought on the country’s European Integration steps.

During 2006, two biannual reports were produced by the Albanian Institute for International Studies (AIIS).

First report

Was concluded and made public at the end of the month of June. It was distributed among the central and local institutions in the country and among interest groups with a stake in the European Integration of the country.

Sondazhi u realizua me mbështejen e OSFA-së nga AIIS.

Gjatë takimit u prezantuan rezultatet e sondazhit, pjesë e një studimi shumë vjeçar të AIIS-së, në të cilin është ndjekur evoluimi i qendrimit të qytetarëve shqiptarë ndaj procesit të integrimit. Ky ishte sonadazhi i katërt dhe parashikohet të ndiqet nga të tjerë në vitet e ardhshme.

Punimet e konferencës u zhvilluan në formën e një forumi të hapur rreth të dhënave të sondazhit dhe u fokusuan kryesisht tek qendrimi i grupeve të ndryshme ndaj procesit të integrimit, si ka ndikuar nënshkrimi I MSA-së në perceptimin qytetar, cilat janë pasojat e mundshme në rast zgjatje kohore të procesit të integrimit etj.

Përfundimet e këtyre raporteve shërbejnë edhe si mbështetje e mëtejshme për Forumin Shqiptar të Integrimit Europian (i cili është ngritur në sajë të po këtij projekti vitin e shkuar).

Në fund të vitit 2006 nisi puna për një projekt që synon monitorimin e Marrëveshjes së Stabilizim Asocimit dhe që do të realizohet nga OSFA, Qendra Europiane, Komiteti Shqiptar i Helsinikit dhe AIIS.

Gazeta Europa

Në kuadër të propagandimit të vlerave dhe specifikave të Bashkimit Europian, si dhe duke synuar nxitjen e një debati cilësor rreth procesit integrues të Shqipërisë, OSFA ka financuar këtë vit botimin e gazetës Europa. Ajo është një gazetë e përmuajshme, e shtypshkruar

The report treated of the perspective of membership as reflected in the SAA progress; Albania-EU relations; the challenges and results of integration; political dialogue and regional cooperation; access to markets; circulation of goods; labor movement; Interim Agreement; legislation approximation; rule of law and fair competition; justice and domestic issues; financial cooperation, etc.

Second Report

Was launched at the end of the year under the title of Albania and the EU, perceptions and realities. The perception of the Albanian society on the country’s integration with the EU brought together once again ministers, parliamentarians, politicians, ambassadors and journalists. The perceptions were captured by AIIS with the financial support of OSFA.

The meeting served to present the results of the survey, which is a multi year exercise of the AIIS to track the evolution of Albanian attitudes to the integration process. This was the fourth survey to be followed by subsequent surveys in the coming years.

The meeting was conducted as an open forum on the findings of the survey and was focused mainly on the attitude of the various groups with regard to the integration process, the impact of the SAA signature on the public perception, possible effects should integration processes be procrastinated, etc.

The conclusions made by these reports served as additional support for the Albanian Forum on European Integration(which was established last year as part of this project).

At the end of 2006, efforts were launched to initiate a project on the monitoring of the implementation of the SAA by OSFA, the AIIS, the European Center and the Albanian Helsinki Committee.

Europa Newspaper

In the framework of dissemination of information on integration processes and the European Union development and in support of a quality discussion about relevant topics, OSFA funded the publication of the journal Europa. It is a monthly journal both in print and electronic format aimed at bringing closer to the Albanian

dhe elektronike, që solli më pranë qytetarit shqiptar Europën e Bashkuar, parimet themeluese, ligjet, dhe diversitetitin kulturor të saj.

Ajo botohet nga Instituti Shqiptar i Studimeve Ndërkombëtare (AIIS), në kuadër të fushës prioritare të «Integrimi Europian». Gazeta informon në lidhje me vendet anëtare të BE-së dhe strategjitë që zbatohen sot në gjirin e shoqërisë shqiptare për të ardhmen europiane të saj. Duke informuar dhe nxitur debatin, ajo i drejtohet gazetarëve, shoqërisë civile, rretheve akademike, komunitetit të biznesit si dhe publikut të gjerë të përfshirë në sfidat e integrimit europian. Struktura e gazetës është e ndërtuar në disa rubrika: kryeartikulli, lajme nga BE, zhvillimet në rajonin e Ballkanit, integrimi europian, perceptime dhe realitete, komente dhe opinione, intervista, analiza dhe kuriozitete nga BE.

Gazeta Europa del ditën e fundit të çdo muaji, ka 16 faqe të formatit A3 prej të cilave 4 janë me ngjyra dhe tirazh prej 10-15 mijë kopje. Shpërndahet falas në institucione qendrore e vendore në Tiranë e në rrethe, në shkolla të larta e të mesme, në media dhe shoqërinë civile, në pikat e shpërndarjes së shtypit si dhe në formë elektronike.

Pasaporta e Stabilizim Asocimit

Strategjia afatmesme (2006-2008) mbi «Integrimin Europian» synon, mes të tjerash, të qartësojë për publikun objektivat themelore të procesit të integrimit. Një mjet për kryerjen e këtij misioni ka qenë gjatë vitit 2006 edhe botimi i Qendrës Europiane, anëtare e NOSA-s, me titullin kuptimplotë «Pasaporta e Stabilizim Asocimit».

Ky projekt, i mbështëtur gjerësisht nga OSFA, u koncepua në formën e një botimi të shtypshkruar dhe elektronik në trajtën simbolike të një pasaporte

citizen the European Union, the uniting principles, the European laws and European cultural diversity.

The journal is produced by the Albanian Institute for International Studies in the context of the NOSA priority field of European Integration. The journal provides information on events happening in the EU countries; it also enlightens the public on Albania’s strategies to achieve its integration with the EU and build its European future. In its attempts to provide information and stimulate discussion, the journal targets the journalists, civil society, academic circles, business community, and the public at large as regards the challenges of European integration especially as it relates to Albania. The structure of the journal consists of a number of sections: editorial; news from the EU; developments in the Balkan region; European Integration issues; perceptions and realities; comments and opinions; interviews; analysis and curiosities from the EU.

The journal EUROPA appears on the last day of every month. With 16 A3 pages of which one in color, the journal has a print run of 10-15 thousand copies and is distributed free of charge in the central and local level institutions, in the capital city and in the provinces, in the higher schools and secondary educations institutions, in the media and civil society organizations. It is available at all the points of press distribution and electronically on the Internet.

The Stabilization and Association Passport

The OSFA/NOSA mid term strategy on Albania’s European Integration aims, among other things, to provide the public with a clear understanding of the essential objectives of the integration process. One of the tools towards achieving this mission is the latest publication by the European Center (a NOSA member organization) of the Stabilization and Association Passport.

Në kuadër të përmbushjes së standarteve të MSA-së u zhvillua në muajin prill konferenca rajonale mbi zhvillimin ekonomik rajonal dhe progresin e ndërmarrjeve të mesme dhe të vogla (SME-ve).

Konferenca organizohej në mbyllje të fazës së dytë të projktit për SME-të, të ndërmarrë nga Instituti Shqiptar i Studimeve Ndërkombëtare (AIIS) në bashkëpunim me partnerët e tij rajonalë. Kjo iniciativë synonte identifikimin, analizën dhe këshillimin e praktikave të dobishme në fushën e zhvillimit rajonal dhe progresit të SME-ve.

Në konferencë u paraqitën tre studime kombëtare të shoqëruara me rekomandimet përkatëse në fushën e SME-ve. Këto studime ishin mbështetur financiarisht nga OSFA-ja, nëpërmjet programit Lindje-Lindje (East East Program – Partnership Beyond Borders). This project supported by OSFA, was conceived in the format of a small publication both in electronic and hard copy in the symbolic shape of a travel passport. It personifies the journey towards European integration of the country, the costs and benefits expected to accompany the process, etc. It provides broad line information for the public on the platform of the stabilization and association process, the entirety of agreements to be concluded among institutions, etc. Tuned up to its broad target group, the pleasant mini book contains simple and humorous pictures, which complement the clear and adequate information. Among the main important areas presented in this symbolic passport are:

Regional Economic Development and SME Progress towards Meeting Stability and Association Requirements

As part of the efforts to fulfill conditions under the Stability and Associations Agreement, in April 2006, a regional conference was held to discuss on regional economic development and the progress of small and medium size enterprises.

The Conference was part of the second phase activities of the SME project implemented by the Albanian Institute for International Studies (AIIS) in collaboration with its regional partners. The goal of the initiative was to identify, provide analysis and advice regarding best practice in the field of regional cooperation and SME progress.

Three national studies were presented at the Conference. The studies contained relevant recommendations in the field of SME development and were made possible thanks to funding supported by OSFA under the East East Partnership beyond Borders Program. Together with representatives from Croatia and Macedonia, the Albanian

Seminar mbi sfidat e integrimit europian

Gjatë javës së dytë të nëntorit, Qendra Europiane organizoi në Tiranë seminarin «Sfidat e integrimit europian». Ky seminar ishte pjesë e një vargu aktivitetesh të zhvilluara në kuadrin e inciativave në mbështetje të procesit të integrimit të Shqipërisë, mbështetur nga NOSA.

Seminari mblodhi sëbashku kryesisht përfaqësues të administratës publike, të cilët lidhen drejtpërsëdrejti me mekanizmat e procesit të integrimit. Nënpunës të ministrive të Bujqësisë, Drejtësisë, Transportit, Integrimit, etj, punuan rreth tematikave të veçanta që u trajtuan gjatë orëve akademike si : çështje të aspektit ekonomik dhe ligjor të integrimit, përshtatja e bujqësisë ndaj standardeve europiane, etj.

Në fund të seminarit, Qendra Europiane ftoi ambsadorin spanjoll Z.Manuel Montobbio, i cili prezantoi procesin integrues të Barcelonës si një shembull të sukseshëm të bashkëpunimit rajonal. Gjithashtu Z. Carlo Natale, zëvendës-ambasador i Delegacionit të Komisionit Europian, foli për rolin e administratës publike në thithjen efektive të fondeve të Bashkimit Europian për vendet që janë kandidate të mundshme.

The Conference took special note of the urgent need to improve the legal framework, the funding mechanisms and the dialogue between the public and private sector. Special attention was paid to the Croatian and Macedonian experience with the SAA implementation what stimulated the debate on challenges and opportunities for Albania’s European integration.

Seminar on the Challenges of European Integration

In the second week of November, the European Center organized in Tirana the seminar called European Integration Challenges. This initiative was part of series of activities supported by NOSA in the context of Albania’s integration efforts.

The seminar brought together mainly the representatives of public administration in Albania. Employees of the Ministry of Agriculture, the Ministry of Justice, the Ministry of Transports, the Ministry of Integration, etc., centered on special topics during the academic sessions of the seminar such as economic and legal aspects of integration, the adaptation of Albania’s agro-cultural economies to the European standards, etc.

At the end of the seminar, the European Center invited the Spanish Ambassador Manuel Montobbio to present the Spanish integration process as a successful example of regional cooperation. Also, Mr. Carlo Natale, Deputy Ambassador of the Delegation of European Commissions in Tirana made a speech on the role of public administration in the absorption of EU funds in potential candidate countries.

Workshopi: «Marrëveshja e Ndërmjetme me BE-në dhe biznesi shqiptar»

Shqetësimi mbi sfidat e reja të biznesit shqiptar, u bë objekt i një tryeze të rrumbullakët në muajin dhjetor, me tematikë «Marrëveshja e Ndërmjetme me BE-në dhe biznesi shqiptar». Tryeza u organizua nga Instituti i Studimeve Ndërkombëtare, me mbështetjen financiare të Fondacionit Soros. Për herë të parë ajo vuri përballë njeri-tjetrit subjekte private

dhe publike që përfaqësojnë biznesin në vend, si dhe përfaqësues të qeverisë e të institucioneve shtetërore.

Që prej 1 dhjetorit 2006, në Shqipëri ka hyrë në fuqi Marrëveshja Tregtare e Ndërmjetme si pjesë e rëndësishme e MSA-së mes saj dhe BE-së. Kjo nënkupton që shkëmbimet tregtare mes dy hapësirave do të kenë më shumë lehtësira në aspektin fiskal, por edhe një rivlerësim të standardeve të kërkuara.

Workshop: The Interim Agreement with the EU and Albanian Business Sector

The Workshop on the new challenges of the Albanian business was the object of a round table in the month of December called The Interim Agreement with the EU and the Albanian Business. The workshop was organized by the Albanian Institute for International Studies with the financial support of the Soros Foundation. For the first time the workshop brought together face to face representatives of public and

private businesses in the country and representatives of the public administration and government.

From 1 December 2006, the Interim Trade Agreement enters into force as an important part of the SAA between Albania and the European Union. The significance of this new development is that there will be fiscal facilities for trade exchanges between Albanian and EU countries, but at the same time there will be strong requirements on businesses to fulfill EU quality standards.

Përfaqësuesit e biznesit shprehën shqetësimin për pasojat e drejtpërdrejta të marrëveshjes, kufizimet e shumta dhe humbjet financiare të saj. Sipas tyre, vetëm nxitja e një dialogu sa më funksional mes tyre dhe pushtetit qendror, dialog deri tani i munguar, do të sillte njohjen reciproke të vështirësive dhe gjetjen e zgjidhjeve të duhura.

Një vështirësi tjetër e denoncuar nga biznesmenët shqiptarë ka qenë edhe indiferenca shtetërore në lidhje me qarkullimin e informacionit. Paqartësia dhe dyshimi janë aktualisht karakteristika të përgjithshme të perceptimit të kësaj marrëveshjeje në gjirin e biznesit shqiptar.

Gjatë punimeve të kësaj konference, u përvijua së fundi vendosja e një dialogu të ri «privat-publik», si kusht i domosdoshëm për një marrëveshje të vlefshme për të gjitha palët. Gjithashtu, intstitucioneve shtetërore iu kërkua më tepër përgjegjësi ndaj interesave të biznesit vendas dhe përshtatjes së tij të re në kushtet e Marrëveshjes së Ndërmjetme.

Kthesat historike dhe rikthimi i kujtesës

Nën kujdesin e Fondacionit Soros dhe të Amdasadës Spanjolle, Instituti i Dialogut Publik& Komunikimit, Instituti Shqiptar i Medias dhe Qendra e Kulturës Bashkëkohore në Barcelonë, organizuan gjatë muajit shtator debatin me temë: Kthesat historike dhe rikthimi i kujtesës. Në këtë debat, ishin ftuar të diskutonin rreth sfidave dhe përvojave moderne të shoqërive post-traumatike personalitete të mirënjohura si Josep Ramoneda, Prof. Paul Garde, Kepa Aulestia, Veton Surroi, etj. Të ftuarit dhe organizatorët e debatit, zotërinjtë Piro Misha, Remzi Lani dhe Bashkim Shehu, diskutuan nga këndvështrime të ndryshme rreth mundësisë ose pamundësisë së harresës historike, raportin e shumësisë së të vërtetave historike, kujtesës kolektive dhe modifikimit të vazhdueshëm të saj, mundësitë reale të procesit të faljes kolektive, procesin e katarsisit dhe të mea culpa-s.

Në debat, pati një pjesëmarrje të larmishme nga bota politike, akademike dhe mediatike mbarëshqiptare.

Representatives of business expressed their concern over the direct consequences of the Agreement, the numerous limitations and the financial looses that may ensue. According to the business sector, only a functional dialogue between them and central authorities, which has been lacking up until now, will bring about the much needed recognition of objectively existing difficulties and the common determination of solutions.

Another difficulty expressed by the Albanian businessmen was government indifference to dissemination of information. Lack of clarity and lack of trust are presently two main characteristics of the way businesses conceive of the SAA.

The conference participants concluded that it was important to establish a new private-public partnership characterized by two-way communication in order for the SAA to be useful to all sides. In addition, the government was called upon to demonstrate greater responsibility to the protection of the interests of domestic business and the conditions necessary for the business to adapt to the newly created conditions under the SAA.

Historical Turns and the Return of Memory

With support from the Soros Foundation and the Spanish Embassy, the Institute for Dialogue and Communication, the Albanian Media Institute and the Center for Contemporary Culture in Barcelona, held in Tirana in the month of September 2006, the debate entitled Historical Turns and the Return of Memory. To discuss about the challenges and modern experiences of the posttraumatic societies, renowned personalities like Josep Ramoneda, Prof. Paul Farde, Kepa Auletia, Veton Surroi etc., were invited to participate. The invitees and the hosts, Mr. Pirro Misha, Remzi Lani and Bashkim Shehu discussed from different perspectives about the possibility or impossibility of historical forgetfulness, the entirety of historical truths, collective memory ad its constant modification, the real chances for collective forgiveness, the process of catharsis and mea culpa.

The debate was attended by a number of representatives from the Albanian political, academic and media circles.

Konferenca «Shqipëria dhe Greqia: perceptime të ndërsjellta»

Me inciativë të Institutit të Dialogut & Komunikimit dhe të Ambasadës Greke, mbështetur nga Fondacioni i Shoqërisë së Hapur për Shqipërinë-Soros (OSFA), u zhvillua në Tiranë gjatë muajit nëntor, konferenca shqiptaro-greke mbi çështjet e perceptimit të ndërsjelltë bashkëkohor mes dy popujve.

Për një varg arsyesh historike e bashkëkohore janë krijuar stereotipi, paragjykime dhe keqkuptime në mënyrën se si shqiptarët dhe grekët perceptojnë njeri-tjetrin. Një rol të veçantë në zbehjen ose forcimin e tyre e luan media. Konferenca, e para e këtij lloji, pati si sfond kryesor, evidentimin e rolit të fuqishëm të medias në këtë proces. Analiza të rasteve konkrete gjatë viteve të fundit, por edhe mundësitë për një ndërgjegjësim më të mirë në të ardhmen, përbënë shumën e argumenteve të parashtruara gjatë debatit.

Në konferencë morën pjesë personalitete të mirënjohura të botës akademike, universitare dhe mediatike të të dy vendeve. Ishin të pranishëm dhe kontribuan me ligjerimet e tyre edhe Ministri i Punëve të Jashtme të Shqipërisë, zoti Besnik Mustafaj si dhe Ambasadori i Greqisë në Tiranë, zoti Costantinos Kokossis.

Debati për librin në Ballkanin Perëndimor

Sfidat e zhvillimit aktual të librit në rajon, raporti i tij me lexuesin gjithnjë e më të diversifikuar, rreziku i piraterisë dhe nevoja e bashkëpunimit rajonal mes botuesve shqiptarë dhe atyre të Ballkanit Perëndimor, mblodhi në një debat për librin botues të rëndësishëm nga Shqipëria, Kosova e Maqedonia, përfaqësues institucionesh kulturore të Malit të Zi, Maqedonisë, Kosovës, intelektualë dhe shkrimtarë. Debati «Kushtet e librit shqip dhe libri në Ballkanin Perëndimor» u organizua nga Instituti i Dialogut dhe Komunikimit në bashkëpunim me Shoqatën e Botuesve Shqiptarë dhe me mbështetje financiare të Fondacionit të Shoqërisë së Hapur për Shqipërinë – Soros (OSFA), në kuadër të programit Lindje-Lindje.

The Conference, Albania and Greece: Mutual Perceptions

Upon the initiative of the Institute for Dialogue and Communication and the Greek Embassy and with the support of the Open Society Foundation for Albanian (OSFA), the Albanian-Greek Conference was held in Tirana in the month of November to discuss mutual perceptions between the two peoples.

Due to both historical and recent conditions, a series of stereotypes, prejudice and misperceptions are created in the manner in which the Albanians and the Greeks view one another. Media has a special role in the creation and/or weakening of these biased perceptions. The first of its kind, the conference focused on the powerful role of the media in the process of shaping attitudes. Analysis of the recent cases/incidents, but also review of possibilities for increased and better awareness in the future occupied the majority of the space in the arguments brought forth in the debate.

The conference was attended by renowned personalities of the academic, university and media world of both countries. It was also attended by the Foreign Minister of Albania, Mr. Besnik Mustafaj and the Ambassador of Greece in Tirana, Mr. Costantinos Kokossis who contributed with their speeches to the Conference.

Debate on Publishing Policies in Western Balkan Countries

The actual challenges of development of the book industry in the region, its relationship with increasingly diversifying categories of readers, the risk of piracy and the need for regional cooperation among the Albanian publishers and publishers in the other countries of Western Balkans, brought together in a debate important publishers from Albania, Kosova and Macedonia, representatives of cultural institutions in Montenegro, Macedonia, Kosova as well as intellectuals and writers from all four countries. The debate on Publishing Cultures and Publishing Conditions in Western Balkans was organized by the Institute for Dialogue and Communication in cooperation with the Association of Albanian Publishers and with financial support from the Open Society Foundation for Albania under the East East program.

Krahas analizës së evoluimit të kushteve botuese në Shqipëri dhe në rajon, si psh: heqja e TVSH-së, liberalizimi i librit shkollor, miratimi i ligjit për librin, etj., botuesit dhe specialistët e librit sollën përvojat dhe propozimet e tyre për përmirësimin e situatës botuese dhe bashkëpunimin rajonal në këtë fushë. U propozua krijimi i një strukture informative të përbashkët, përkrahja e bibliotekave publike në mbështetje të apelit të lëvizjes MJAFT, qarkullimi i librit pa pengesa kufijsh, lufta kundër piraterisë, forcimi i infrastrukturës shpërndarëse të librit, etj. Pjesëmarrësit dolën me një Memorandum drejtuar instancave shtetërore në lidhje me perspektivat e botimit.

Statusi ndërkombëtar i Kosovës dhe siguria në Ballkan

Në mbështetje të Procesit të statusit final të Kosovës, OSFA, mundësoi nëpërmjet programit Lindje-Lindje, mbajtjen e një konference ndërkombëtare më 21 tetor në Tiranë. Konferenca «Statuti final i Kosovës dhe Siguria në Ballkan», e organizuar në bashkëpunim me Institutin e Studimeve Ndërkombëtare (ISN), mblodhi studiues, politikanë, akademikë nga Ballkani, Shtetet e Bashkuara, Këshilli i Sigurimit të OKB-së, Bashkimi Europian, Grupi i Kontaktit dhe homologët e tyre shqiptarë. I ftuar ishte edhe Ministri Shqiptar i Punëve të Jashtme, Zoti Besnik Mustafaj. Ai theksoi veçanërisht thellimin e negociatave për statusin përfundimtar të Kosovës dhe rëndësinë e një procesi aktiv negocimi.

Të vetëdijshëm se progresi i negociatave dhe modalitetet e statusit final do të ndikojnë në të ardhmen e Kosovës dhe sigurinë në rajon, pjesëmarrësit diskutuan rreth disa prej sfidave të ardhshme në këtë proces. Diskutimet u përqëndruan në tri këndvështrime: a) pikëpamjet e aktorëve ballkanikë për statusin final të Kosovës; b) pikëpamjet e komunitetit ndërkombëtar për statusin final të Kosovës; c) Problematikat e qeverisjes demokratike dhe ekonomisë së tregut pas zgjidhjes së statusit final të Kosovës.

Along with the analysis and evaluation of publishing conditions in Albania and in the region due to initiatives such as the removal of the VAT, liberation of textbook production, the adoption of the Publishing Law, the publishers and book specialists brought forth their experiences and proposals for the improvement of the book situation and the need to strengthen region cooperation in this respect. Among the proposals made was the creation of common information networks, support for public libraries, the free circulation of the book across borders, fight against piracy, creation of efficient structures of book distribution, etc. Notice was taken of the action taken by the MJAFT Movement to call on the authorities for increased attention to public libraries. The participants came up with a Memorandum addressed to the governmental structures to pay due attention to publishing issues.

Kosova International Status and Security in the Balkans

In support of the process of the definition of the Kosova final status, through the East East Program, OSFA enabled the holding in Tirana of an International Conference on 21 October 2006. The Conference was called The Final Status of Kosova and Security in the Balkans and was organized by the Albanian Institute for International Studies. It brought together scholars, politicians, academicians from the Balkans, the United States, and the UN Security Council, the European Union, the Contact Group and many Albanian personalities. The Conference was attended by Besnik Mustafaj, Albanian Minister of Foreign Affairs, who underlined the need for deepening negotiations on the resolution of the final status for Kosova and the importance of an efficient negotiating process.

Aware that the process of negotiations and the modalities of the final status will impact Kosova’s future and security in the region, the participants discussed about some of the future challenges of the process. Discussions were focused on three pillars: a) the views of Balkan actors related to Kosova’s final status; b) the views of the international community on Kosova’s status; c) the challenges of democratic governance and free market economy following the resolution of status in Kosova.

Shoqëria CivileShoqëria civile shqiptare ka shënuar arritje në mbrojtjen e të drejtave të njeriut, në rritjen e pjesëmarrjes qytetare, në forcimin e komuniteteve dhe ndihmën për shtresat e margjinalizuara. Ajo ofron lobime, avokati, monitorime për përmirësimin e qeverisjes, zbutjen e çështjeve gjinore, luftën kundër trafiqeve dhe korrupsionit etj. Përparime janë shënuar edhe në krijimin e një kuadri ligjor institucional për sektorin jofitimprurës, marrëdhëniet me shtetin etj.

Civil SocietyThe Albanian civil society has made important achievements in the protection of human rights, the increase of civic participation, the strengthening of communities and its assistance to marginalized groups. The civil society organizations are committed to lobbying, advocacy monitoring towards good governance, anticorruption, fight against trafficking, the mitigation of gender issues, etc. Remarkable progress has been noted in the creation of an adequate legal and institutional framework for the non-profit sector, the improvement of relations with the government, etc.

Për të përmirësuar cilësinë e demokracisë së re shqiptare, shoqërisë civile i duhet të forcojë strukturat vepruese të saj, në mënyrë që të realizojë me dinjitet rolin e saj parësor: plotësimin e hapësirës mes shtetit dhe qytetarëve, duke synuar zbutjen e prirjes tjetërsuese të shtetit ndaj individit.

Nisur nga ky kontekst, OSFA dhe partneret e saj gjatë vitit 2006 u përqëndrua në disa objektiva si zhvillimi i kapaciteteve të shoqërisë civile, rritja e angazhimit qytetar dhe e përgjegjshmërisë sociale, promovimi i aksionit qytetar, vendosja e marrëdhënieve efektive me shtetin dhe politikën etj. Më konkretisht përpjekjet u fokusuan në: përmirësimin e kuadrit ligjor për sektorin; rritjen e pjesëmarrjes qytetare në politikëbërje dhe në vendim-marrje; arritjen e qëndrueshmërisë së sektorit nëpërmjet forcimit te kapaciteteve të brendshme në nivel organizativ, advokues, monitorues dhe lobues; rritjen e pavarësisë nga politika dhe forcimin e besueshmërisë në publik; zhvillimin e standarteve vetë-rregulluese të ojf-ve me një efekt pozitiv në imazhin e tyre publik etj.

Gjatë vitit 2006 nisi diskutimi i ligjit për OJF-të nga ekspertë dhe nga shoqëria civile. Gjatë këtij procesi u evidentuan problemet që paraqet ky ligj përballë ndryshimeve në realitet. Thekse të veçanta u vunë për për përcaktimin e barazisë ligjore të OJF-ve, për procesin e rregjistrimit, për detajime ligjore mbi aktivitetin ekonomik e fiskal të sektorit etj

Përmirësimi i gjendjes së grupeve të mënjanuara të shoqërisë përbënte një tjetër objektiv të OSFA-s gjatë vitit 2006. Monitorimi i Stategjisë Kombëtare për Romët solli sensibilizimin e opinionit publik për ekzistencën, afatet dhe ecurinë e kësaj strategjie. OSFA ndihmoi gjithashtu edhe në organizimin e disa takimeve me përfaqësues të bashkësive rome në të gjithë vendin duke rritur kapacitetin e tyre bashkëveprues dhe lobues.

Një ndër aktivitet e vitit 2006 ishte edhe monitorimi i premtimeve elektorale me synim ndërgjegjsimin e publikut për cilësinë e përfaqësimit të tyre në parlamentin shqiptar dhe pushtetin lokal. Për këtë OSFA mbështeti Lëvizjen Mjaft për faqen e Internetit unevotoj.com e cila jep informacion nga monitorimi premtimeve elektorale. Botimi i një raportit

To improve the quality of the young Albanian democracy, the civil society needs to strengthen its organizations in order to be able to play with dignity its priority role: fill the space between the state and the citizens and curb the coercive power of the state on the individual.

Starting from this context, in 2006 OSFA and its partners concentrated in a number of objectives such as the development of civil society capacities, the increase of civic involvement and social responsibility, the promotion of civic action, the establishment of effective relations with the politics and state, etc. More specifically, efforts were focused on: improvement of the legal framework for the sector, increase of civic participation in policy and decision making, increase the sustainability of the sector through the strengthening of organizational capacities, the creation of advocacy, lobbying and monitoring capacity, increased independence from politics and enhanced public credibility, the development of self regulating standards for the non profit organizations as a way to improve the sector’s public image, etc.

In 2006, civil society and experts in the field subjected the law on the non-profit organizations to discussions and reviews. The process brought to the fore a number of problems that the law is displaying in the newly created conditions. Special emphasis was placed on the definition of equality before law of the non-profit organizations with regard to the registration, legal provisions regulating the economic and fiscal activity of the sector, etc.

The improvement of the status of the marginalized groups of the society was another objective of OSFA in 2006. The monitoring the National Roma Strategy increased awareness on the existence, the progress, time-line and objectives of this strategy. OSFA also helped the representatives of various Roma communities throughout the country to come together, thus increasing the strength of their lobbying action to pressure for improvements in their status.

One of the activities in the year 2006 was the monitoring of election promises, which aimed at increasing citizens’ awareness on the importance of their representation in the Parliament and at the local level. To achieve this objective, OSFA supported the MJAFT Movement to continue the on-line project unevotoj.com, which publishes data collected during the monitoring of election promises. The

statistikor çdo gjashtë muaj ka rritur ndjeshëm vëmendjen e publikut dhe të medias për aktivitetin e parlamentit shqiptar dhe në vijim edhe të pushtetit vendor.

Objektivat e vitit 2006 në fushën e shoqërisë civile OSFA i realizoi në bashkëpunim me Partnerët-Shqipëri dhe MJAFT, në kuadër të NOSA-s si dhe në bashkëpunim me disa nga aktorët më të njohur në vend si Qendra e Studimeve Parlamentare, Fondacioni Shqiptar i Shoqërisë Civile, Forumi Shqiptar Social Ekonomik, Forumi i Mendimit të Lirë, Qendra për Popullsinë dhe Zhvillimin, etj.

Përmirësimi i kuadrit ligjor për sektorin jofitimprurës

Në vitin 2001 hyri në fuqi ligji për sektorin jofitimprurës. Pesë vjet aplikim të tij kanë nxjerrë në pah disa mungesa. Në të njëjtën kohë u ndje nevoja e përcaktimit të një serie aktesh nënligjore për ta bërë tërësisht efektiv këtë ligj. Në këtë kontekst OSFA ndërmori gjatë vitit 2006 projektin «Përmirësimi i kuadrit ligjor për sektorin jofitimprurës».

Qëllimi parësor i projektit ishte të ndihmonte në zhvillimin dhe fuqizimin e sektorit të shoqërisë civile në Shqipëri, duke krijuar një mjedis ligjor dhe financiar të përshtatshëm për krijimin dhe funksionimin e organizatave joqeveritare, grupeve të lobimit, shoqatave profesionale dhe mekanizave që nxisin ose sigurojnë rritjen e transparencës, përmirësimin e imazhit publik të sektorit, etj.

Në këtë kuadër, OSFA dhe Partnerët-Shqipëri, në kuadër të NOSA-s, ndërmorën shqyrtimin e ligjit dhe amendimeve të tij prej një grupi ekspertësh. Ato organizuan disa tryezave të rrumbullakta që synuan debatimin dhe evidentimin e problemeve aktuale të OJF-ve në aspektin ligjor. Raporti u shqyrtua në përfundim të fazes së parë të punës me një grup të madh ekspertësh të fushës në një tryezë të rrumbullakët të organizuar më 6 prill 2006 në Tiranë.

Gjithashtu në periudhën prill-maj 2006 u organizuan 4 seminare të tjera në Tiranë, Vlorë, Shkodër dhe Pogradec me përfaqësues të OJF-ve dhe organizatave donatore që punojnë në fushën e shoqërisë civile. Në

OSFA worked to attain the 2006 objectives in the civil society field in cooperation with Partners Albania and MJAFT, two NOSA member organizations, and a number of other actors with countrywide reputation such as the Center for Parliamentary Studies, the Albanian Foundation for Civil Society, the Albanian Socio Economic Think Tank, the Forum of Free Thought, the Center for Population and Development, etc.

Improving Legal Framework for the Non-Profit Sector

In the year 2001, the Law on the non-profit sector became effective. Five years of implementation evidenced a number of shortages. At the same time, the need was felt to adopt a series of by-laws to make the law fully implementable. In this context, in 2006 the project Improving Legal Framework for the Non Profit Sector was launched.

The priority purpose of the project was to help with the development and strengthening of civil society in Albania by creating an enabling legal and financial environment for the establishment and operation of non governmental organizations, lobbying groups, professional associations. On the other side, the law should define the mechanisms which encourage and guarantee the increase of transparency, the improvement of the sector’s image, etc.

In this framework, OSFA and Partners-Albania, as part of their NOSA work, launched the review of the law by a group of experts. They organized a number of round tables which aimed to discuss and identify problems and issues that NGOs face in legal terms. The report was reviewed at the end of first phase of the project by an extended group of experts in the field in a workshop held in Tirana on 6 April 2006.

Over April-May 2006, four additional seminars were held in Tirana, Vlora, Shkodra and Pogradeci with representatives of non-profit and donor organizations engaged in the field. These activities were attended

këto aktivitete kanë marrë pjesë përfaqësues të 110 OJF-ve nga qytetet Tiranë, Durrës, Elbasan, Librazhd, Pogradec, Korçë, Shkodër dhe Vlorë.

Mbështetur në të dhënat e këtyre diskutimeve një grup ekspertësh dolën me propozime konkrete për ndryshimet/amendimet që duhet të bëhen në ligj dhe në disa akte të tjera nënligjore.

Në fazën e vijuese projekti do të vazhdojë me draftimin e amendimeve/rregullimeve ligjore si dhe me përgatitjen e rregulloreve dhe procedurave që do të lehtësojnë zbatimin e legjislacionit për sektorin jofimprurës. Pas kësaj parashikohet një diskutim me sektorin dhe lobim me ligjvënësit.

Forcim i kapaciteteve për OJF-të

Forcimi i shoqërisë civile shqiptare, rritja e kapacitetit të saj për bashkëveprim, advokasi dhe lobim, prej vitesh përbëjnë një nga përparësitë e OSFA-së. Gjithashtu janë shtuar kërkesat për forcimin menaxherial dhe financiar të tyre, rritjen e transparencës dhe të njohurive ligjore. Në përputhje me këto nevoja, OSFA në kuadër të NOSA-s mbështeti Partnerët-Shqipëri për forcimin e kapaciteteve të OJF-ve shqiptare.

Në kuadër të këtij projektit u organizuan në disa qytete të vendit si Pogradec, Elbasan dhe Vlorë, programe trainimi. Kështu OSFA në qytetin e Pogradecit organizoi një Program Trainimi në «Advokasi dhe Lobim», me pjesëmarrjen e dymbëdhjetë OJF-ve lokale. Gjatë trainimit u studiuan modelet më të sukseshme të aksionit qytetar dhe marrëdhënieve efektive me shtetin dhe politikën. Përfaqësuesit e OJF-ve lokale u njohën më në thellësi me konceptin e advokasisë dhe lobimit si dhe me disa nga teknikat që mund të përdoren për të ndërmarrë inisiativa në advokasim dhe në vendim-marrjen lokale dhe qendrore. Në të njëjtën mënyrë u punua me dy programe të tjera trainimi, në maj-qershor, në «Manaxhim Financiar» dhe «Procedurat e Regjistrimit të OJF-ve në Përputhje me Legjislacionin Shqiptar», përkatësisht në Elbasan dhe Vlorë. Duke trajtuar çështje të tilla u synua të forcoheshin aftësitë menaxheriale të OJF-ve, të përsoseshin raportet e

by 110 representatives of NGO-s in the towns of Tirana, Durresi, Elbasani, Librazhdi, Pogradeci, Korca, Shkodra and Vlora.

Based on input from these discussions experts came up with concrete proposals for changes/amendments that should be made in the law and in some of the related by-laws.

In the subsequent stage, the project will continue with the drafting of amendments/changes to the law and the design of rules and regulations which will facilitate the implementation of the non-profit legislation. Sector wide discussions and lobbying actions with law and decision makers will follow at a later stage in project implementation.

Strengthening NGO Capacity

The strengthening of Albanian civil society, of its capacity for action, advocacy and lobbying have been in the focus of OSFA work for many years now. In the meantime, requirements for better organizational and financial management of NGOs, increased transparency of the sector and better law implementation by the civil society organizations have constantly been on the rise. In accordance with these needs, as part of the NOSA strategy, OSFA supported Partners-Albania to take action to strengthen NGO capacity in the country.

In the framework of this project, training programs were conducted in the towns of Pogradeci, Elbasani and Vlore. Specifically, in the town of Pogradec, a training program on Advocacy and Lobbying was held with the participation of 12 local NGO-s. During the training, the most successful models of civic action were analyzed, particularly those initiatives focusing on effective relations with the government and politics. The representatives of local NGO-s were exposed to deep knowledge on advocacy and lobbying. They were made familiar with some of the techniques which are most efficient in influencing policy and decision-making at local level. Two additional training programs were implemented during the months of May and June 2006. The focus this time was on financial management and the procedures of NGO registration in accordance with the Albanian legislation, respectively in Elbasan and Vlora. In determining these topics for the

Gjatë gjashtëmujorit të dytë të vitit vazhdoi faza përfundimtare e projektit. Nga tërësia e OJF-ve të trajnuara u përzgjidhën rreth 10 më premtueset në rrethe përkatëse. Këtij grupi iu dha asistencë e plotë dhe individuale për krijimin e një sistemi financiar të nivelit të lartë. Kjo gjë lehtësoi jo vetëm mbajtjen e shpenzimeve financiare të ekipit por do të ndikojë drejtpërsëdrejti në rritjen e vazhdueshme të transparencës financiare të këtyre OJF-ve ndaj donatorëve dhe ndaj shtetit.

Monitorimi i strategjisë kombëtare për romët

OSFA e nisi projektin për të monitoruar strategjinë kombëtare «Për përmirësimin e kushteve të jetesës së minoritetit Rom» në pranverë të vitit 2005.

Monitorimi synonte të ndiqte nga afër procesin e realizimit të strategjisë në mënyrë që t’i bëhej krah pakicës rome në përballimin e prirjeve margjinalizuese. Në këtë kuadër ekspertë të OSFA-s,

training programs, the purpose was to strengthen managerial capacities of non profit organizations (NPOs), to improve their financial capacities towards increased transparency and to improve knowledge and understanding about legal procedures which apply in the case of NPO activity.

In the second half of the year, the project carried out its conclusive stage. Of the NGO-s trained in the first stage, the most promising ten were chosen in each town. This group was provided with full individual assistance for establishing financial systems of high reliability. This facilitates not just the management of expenses, but also increases the financial transparency of these organizations vis-à-vis the donors and the government.

Monitoring the National Roma Strategy

OSFA launched the project on the Monitoring of the National Strategy «Improving the living conditions of the Roma Minority» in spring 2005.

Monitoring was designed to follow closely the process of the implementation of the strategy in order to empower Roma to cope with marginalization trends. In this context, OSFA, the Albanian Helsinki Committee

Komitetit të Helsinkit dhe të Qendrës për Mbrojtjen e Fëmijëve, në bashkëpunim me përfaqësues të komunitetit rom, vëzhguan koordinimin e politikave dhe veprimeve në kuadër të strategjisë në disa nivele: mes drejtorive të ndryshme të pushtetit qendror në vetvete, mes pushtetit qendror dhe atij vendor, alokimin e fondeve financiare, masat e ndërmarra, etj. Në korrik 2006, OSFA publikoi rezultatet e monitorimit.

Strategjia rezultoi me pasaktësi të mëdha që në hartimin e saj. E hartuar me nxitim, pa u koordinuar me strategji të tjera kombëtare, ajo nuk parashikon si duhet as buxhetin e saj. Edhe gjatë zbatimit, strategjia rezulton e pjesshme dhe me mungesa të shumta. Nuk është punuar mirë për rregjistrimin e popullsisë rome, sensibilizimin në çështje të arsimit, shëndetësisë dhe të drejtave të tyre. Fondet nuk janë shpërndarë ose përdorur si duhet. Koordinimi ndërdikasterial, bashkëpunimi mes OJF-ve rome e të tjera ka qenë i pasuksesshëm dhe përjashues.

Përballë kësaj gjendjeje, ekspertët paraqitën rekomandimet e tyre. Në raportin e tyre ata këshillojnë strukturat shtetërore për një rishikim të plotë të strategjisë dhe infrastukturës së zbatimit të saj. Ndaj pushtetit vendor kërkohet një bashkëveprim më efikas si me pushtetin qendror ashtu edhe me OJF-të dhe komunitetin rom.

Pas publikimit të raportit OSFA nisi organizimin e një fushate informuese për shkallën e zbatimit të objektivave të strategjisë kombëtare për Romët. Në zona të ndryshme të vendit po zhvillohen takime me tematikë të specializuar me grupet e interesuara. Këto grupe do të nxiten që të rrisin kapacitetet e bashkëpunimit mes tyre për të ndjekur në vazhdimësi zbatimin e strategjisë në të gjitha fushat.

and the Center for Children’s Protection, in cooperation with representatives of the Roma community, monitored the coordination of policies and actions in the framework of the Strategy at various levels: among the various departments of the central government, between the central and local governments in terms of allocations, measures instituted, deadlines met, etc. In July 2006 OSFA published the monitoring results.

The strategy implementation showed to be problematic due to the way it was designed. Hastily formulated, without taking count of and with no coordination whatsoever with other strategies in the country, the Roma strategy does not even contain an estimate of costs. The strategy implementation displays numerous shortfalls and is only partially applicable. No serious efforts have been made to accomplish the registration of the Roma population, to build awareness on Roma rights to education, healthcare and other basic services. Funds have either not been allocated or not used adequately. Inter-departmental coordination, cooperation among/between Roma and other NGOs has been unsuccessful and not inclusive.

Faced with this situation, the experts submitted their recommendations. In their reports they advice the governmental structures to undertake a full review of the strategy and arrangements for its implementation. The local authorities are asked to cooperate more efficiently with both the central government and the Roma NGOs and Roma community.

Following the publication of the report, OSFA launched an information campaign on the degree of implementation of objectives under the National Roma Strategy. In various parts of the country round tables are being held on specific topics with various interest groups and stakeholders. These groups will be encouraged to increase their implementation capacities and inter (intra) cooperation to continue the monitoring of the strategy implementation in all of its component parts.

Fletë të Verdha të OJF-ve Shqiptare

OSFA e konceptoi projektin si databaze e tipit «Fletë të Verdha» dhe mbështeti për realizimin e tij Fondacionin Shqiptar të Shoqërisë Civile, i specializuar në përpunimin e të dhënave të tilla dhe me një rrjet pertnerësh edhe në rrethe të tjera të vendit.

Kjo faqe Interneti, e emërtuar Fletë të Verdha të OJF-ve Shqiptare, lehtëson komunikimin dhe shkëmbimin e Informacionit ndërmjet OJF-ve të niveleve të ndryshme në Shqipëri. Ai krijon mundësinë për të vendosur lidhje ndërmjet OJF-ve shqiptare dhe atyre të rajonit e më gjerë. Lehtëson ndërtimin e rrjeteve, shkëmbimin e informacioneve, duke nxitur hartuar projekte të përbashkëta. Fletë të Verdha të OJF-ve Shqiptare pritet të rrisë ndërgjegjsimin dhe mirëkuptimin ndërmjet OJF-ve në qarqe të ndryshme të Shqipërisë për një pjesëmarrje sa më aktive qytetare në politikat zhvilluese.

Lobim për shoqërinë civile në Parlamentin Europian

Me ndihmesën e OSFA-së, Qendra Europiane, anëtare e NOSA-s në Shqipëri, realizoi me sukses një lobim pranë Parlamentit Europian për rritjen e ndikimit të shoqërisë civile shqiptare në hartimin dhe zbatimin e politikave të ndryshme në vend. Falë këtij lobimi, çështja dhe rëndësia e shoqërisë civile u përfshi në apelin që Parlamenti Europian i bëri në tetor Qeverisë Shqiptare nëpërmjet raportit të fundit dhe pëlqimit që i jep Marrëveshjes së Stabilizim-Asocimit me Shqipërinë.

Yellow Pages of Albanian NGOs

Having conceived the project to be a database of the type of «yellows pages», OSFA provided funding to implement it to the Albanian Civil Society Foundation, with expertise in processing data on civil society organizations and with a network of partner organizations in the main regions of the country.

This website called Yellow Pages of Albanian NGO-s facilitates communication and exchange of information between the NGOs of various levels in Albania. This creates the possibility for establishing contacts among the Albanian NGOs in the country and the NGOs in the region and beyond. It serves as a resource for building networks, exchange information and stimulate the formulation of joint projects. Yellow pages of Albanian NGOs are expected to increase awareness and understanding among the various NGO-s in different regions of Albania towards enhanced levels of active participation in the development of the country.

The website serves as a database of local expertise. This is particularly important in view of the priorities of local expertise in relation to foreign expertise (less costly and familiar with country specific issues). Foreign expertise may be required especially in the fields where local expertise is either missing or is not of the necessary standards. The site is available at www.albanianngo.org

Lobbying the European Parliament on Civil Society Involvement in Integration Processes

With OSFA support the European Center, a NOSA member organization, successfully implemented an initiative to lobby the European Parliament to provide for greater civil society input into the formulation and implementation of strategies in the country. Thanks to this lobbying effort, the issue and importance of civil society involvement was one of the points contained into the call by the European Parliament on the Government of Albania in October 2006 in the biannual report ratifying the EU Stabilization and Association Agreement with Albania.

Promovimi i debatit politik

Promovimi i debatit politik është konsideruar nga OSFA si një mjet i rëndësishëm për rritjen e pjesëmarrjes së shoqërisë civile dhe të qytetarëve në jetën e vendit. Duke nxitur debatin politik në të gjitha nivelet e shoqërisë përftohet njëkohësisht një trysni e vazhdueshme ndaj qeverisjes qendrore e vendore, rritet transparenca në proceset politike dhe ndërgjegjësohen qytetarët për këtë proces. Në këtë kuadër, me mbështetjen e OSFA-s u ndërmor në periudhën janar-qershor organizimi i një rrjeti debatesh në Tiranë dhe rrethet kryesore të Shqipërisë. Si bazë për gjithë këto aktivitete shërbeu përvoja shumëvjeçare e Programit të Debatit, themeluar para shume vitesh nga OSFA dhe aktualisht e afiluar me Lëvizjen MJAFT.

Ky aktivitet kulmoi me realizimin e Turneut Kombëtar të Debatit në Tiranë,

In the meeting, it was agreed to include in the report significant and important messages on the role of civil society as a principal actor in Albania’s integration and development efforts. The following paragraph is taken from the Report of the European Parliament and was also included in the press release following the meeting:

«The Parliament encourages the Albanian Government to enable civil society to take part in the formulation of policies, the monitoring of implementation and effectiveness of these policies at all levels of government as a way to improve the quality and credibility of reforms. This will also contribute to increased transparency and accountability.

Promoting Public Debate

NOSA considers public debates and discussions to be an important tool for increasing civic participation in providing alternative solutions to the country’s problems. Political debate at all levels of society generates at the same time constant pressure on central and local level government to perform according to standards. As a result, transparency is increased and so is public awareness on the development path taken by the country. In this context, with OSFA support, a number of debates were launched in Tirana and the main towns of the country in the period of January-June 2006. The basis for these debates was the long time experience of the Debate Program, founded many years ago by OSFA and presently continued by MJAFT. Activities were focused on the attainment of two main objectives:

Educating the public with the spirit and culture of •debate, and

Holding public debates between the citizens and •decision makers.

During the period of April-May 2006, debate tours were held with hundreds of young people from the high schools of Tirana, Shkodra, Puka, Gramshi, Korca, Elbasani, Gjirokastra, Saranda, Vlora, Berati, Fieri, Permeti, Kucova, Lushnja and Durresi. The activity culminated with the holding of the National Debate

ngushtimin e hendekut mes qeveritarëve dhe të •qeverisurve.

Monitorimi i premtimeve elektorale

Monitorimi i premtimeve elektorale është një proces i rëndësishëm për ndërgjegjesimin e votuesve dhe për rritjen e përgjegjshmërisë së të votuarve. OSFA dha ndihmesën e saj duke inicuar dhe mbështetur së bashku me Lëvizjen MJAFT projektin monitorues: unevotoj. Monitorues të përhershëm ndoqën nga afër dhe monitoruan punën e pushteti qëndror për monitorimin e

The topics of the debates included:

Economic development versus environmental •protection,

Women participation in politics,•

The state Matura,•

Legalization of extra legal buildings.•

To hold the public debates between the citizens and decision makers a forum was created to allow the exchange of ideas between the various stakeholders all across the various strata of the Albanian population. The discussions strived to achieve the following objectives:

Build awareness of and provide information to the •citizens,

Increase civic participation in the deliberation of •issues concerning communities,

Narrowing the gap between the government and •the citizens.

Monitoring Election Promises

The monitoring of election promises is an important process to achieve building awareness of voters and increase responsibility of the voted. OSFA made its contribution to these processes by launching jointly with the Movement MJAFT a monitoring project called I vote. Permanent monitors followed closely the work of central government with regard to implementing promises made in the last general elections. The results

Gjatë muajve të parë të zbatimit të projektit u mblodh një informacion i rëndësishëm, si platforma zgjedhore e partive kryesore, premtimet zgjedhore të kandidatëve për deputet, jetëshkrimet e tyre, financat e fushatës, etj. Ky projekt i shërbeu publikut të gjerë, sidomos nëpërmjet medias, e cila e përdori gjerësisht informacionin e mbledhur.

Aktualisht faqja është bazë të dhënash dhe mbledh informacion për punën e deputetëve shqiptarë brenda në Kuvendin e Shqipërisë. Ajo funksionon si një bazë të dhënash që mbulon aktivitetin e të gjithë anëtarëve të parlamentit shqiptar në tri kategori bazë: informacion biografik, financa dhe aktiviteti parlamentar. Në fund të çdo sesioni parlamentar unevotoj.com publikon një raport.

Gjatë kësaj periudhe është punuar gjithashtu për ndërtimin e një seksioni të ri tek kjo faqe kushtuar pushtetit lokal, punë e cila është në fazën e finalizimit. Ndërkohë janë rekrutuar 12 reporterë lokalë, të cilët po mbledhin informacionin e nevojshëm në 12 bashkitë e Durrësit, Tiranës, Shkodrës, Korçës, Kukësit, Beratit, Gjirokastrës, Elbasanit, Peshkopisë, Fierit, Vlorës dhe Lezhës.

Në protestë: Shqipëria ka etje!

Përballë krizës së ujit të pishëm që u thellua këtë vit në qytetet e mëdha të vendit dhe mospërmushjes së premtimeve elektorale në lidhje me të nga ana e qeverisë. OSFA dhe Lëvizja Mjaft organizuan në muajin shtator një fushatë protestash nën slloganin «Shqipëria ka etje». Në një nga ditët e protestave, në bulevardin «Dëshmorët e Kombit» u ndërtua një «akuadot» antik me 1200 bidona uji të boshatisur, simbol i etjes së Shqipërisë në fillimshekullin XXI.

Të vendosur në mesditë, përpara Ministrisë së Punëve Publike, Transportit dhe Telekomunikacioneve, qytetarët

Through the provision of information, this website educates and builds awareness among the Albanians on the way the Albanian Parliament functions. This in turn, improves the image of the Parliament and increases civic participation in public policy making. In the first months of the project, important information was collected: platforms of the main political parties, election promises of the candidates, their CVs, campaign financing, etc. The project enhanced informational opportunities especially through the media, which made extensive use of the online information.

Presently, the site www.unevotoj.com is a database of stored information on the work of deputies in Albania’s Assembly. Now Unevotoj.com has come to be a national library of information based on real life facts. It represents a database providing information on the activity of all members of the Albanian parliament according to three main headings: biographic information, financial data and parliamentary activity. At the end of every parliamentary session Unevotoj.com will publish a report containing all three categories of information which will be submitted for discussion and review in a series of public debates.

In the recent months, MJAFT has worked to build a new section of the website dedicated to the local government. The construction work is close to being finalized. In the meantime, 12 local reporters have been recruited who are collecting the necessary information from the 12 municipalities of Durresi, Tirana, Shkodra, Korca, Kukesi, Berati, Gjirokastra, Elbasani, Peshkopia, Fieri, Vlora and Lezha.

Protesting: Albania Is Thirsty!

Contrary to the government’s election promise to increase water supply, in 2006 the water crisis was even worse than in the previous years. Faced with this situation, the Movement Mjaft, with support from OSFA, started in the month of September a protest campaign under the motto: «Albania is thirsty!» In one of the days of the protest, the activists of the Movement MJAFT built on Tirana’s main boulevard an

kryeqytetas dhe aktivistët e MJAFT i kujtuan opinionit publik premtimet e pambajtura të qeveritarëve dhe denoncuan me statistika të sakta pasojat e kësaj situate.

Po në kuadër të kësaj fushate, u shpall e njëjta protestë «Shqipëria ka etje» edhe në qytetin e Fierit, tashmë në formën e një procesi votimi. Ata vendosën në sheshin mes Bashkisë dhe Prefekturës së qytetit dy bidona 5 kg që përdoren për ujin e pijshëm dhe i shndërruan në kuti votimi për këtë votim original. Komuniteti i votuesve, i gjendur para dy alternativave : «Unë pi ujë të blerë» dhe «Unë pi ujë çezme», votoi mbi 90 përqind në alternativën domethënëse «Unë pi ujë të blerë».

Debat publik mbi përmirësimin e situatës mjedisore në Shqipëri

Mjedisi dhe hartimi i politikave afatgjata në lidhje me mbrojtjen e tij ka patur edhe gjatë vitit 2006 vëmendjen e dukur nga OSFA. Duke gjykuar se mbrojtja e mjedisit i përket të gjithë qytetarëve njëheri, u vendos të nxitej sensibilizimi masiv duke rritur kështu përgjegjshmërinë e publikut për përmirësimin e situatës mjedisore në vend. Në bashkëpunim me Lëvizjen MJAFT u organizua një debat publik me pjesëmarrjen e aktorëve më të spikatur të shoqërisë

Stationed in front of the building of the Ministry of Public Works on the boulevard, the MJAFT activists reminded the public of the government’s failure to keep its promise to improve the water supply situation. The protestors used hard data to substantiate the emergency of the situation.

As part of this same campaign, the Movement MJAFT launched the protest «Albania is thirsty!» in the town of Fier, too. Here, they improvised a voting station. In the square between the Municipality and the Prefecture buildings, protestors placed two six litter water gallons, normally used to sell drinking water, and turned them into ballot boxes. In this original way of voting the citizens were asked to cast their ballot either in the «I buy my water» gallon or in the «I drink from the tap» gallon. Ninety per cent of the citizens cast their ballot in the gallon: «I buy my water.»

Public Debate on Ways to Improve Environmental Conditions in Albania

Environment and the formulation of long term policies dedicated to environmental protection has been treated with due attention by OSFA. Considering that environmental protection should be the concern of all citizens, OSFA followed the approach of building public awareness as a way to bring about increased responsibility for improving environmental conditions in the country. In cooperation with the Movement MJAFT, a public debate was organized with the participation of the most outspoken civil society activists in the field of environmental protection. This particular debate is part of the series of public debates planned by MJAFT as

civile në mbrojtje të mjedisit. Ky debat ishte pjesë e serisë së debateve publike të ndërmarra nga MJAFT në kuadër të strategjisë së NOSA-s për shoqërinë civile. Debatet publike siguruan një forum ku u diskutuan çështje të rëndësishme për komunitetet dhe grupe të ndryshme interesi. Në këto forume, pjesëmarrësit prezantuan këndvështrimet e tyre duke ndikuar kështu në: ndërgjegjësimin dhe informimin e qytetarëve; pjesëmarrjen aktive të qytetarëve në çështjet komunitare dhe ngushtimin e hendekut mes qeveritarëve dhe të qeverisurve.

Në debatin e muajit shkurt, mbi përmirësimin e situatës mjedisore në Shqipëri u diskutua rreth problemeve ekzistuese dhe veprimeve që mund të ndërmerreshin me bashkëpunimin e palëve në përmirësimin e situatës mjedisore në Shqipëri. Përveç angazhimit për bashkëpunim dhe aksione të përbashkëta, një nga rezultatet e menjëhershme të këtij debati ishte një letër e hapur e përbashkët drejtuar institucioneve kryesore shqiptare.

Në këtë letër u shprehën tre kërkesa kryesore:

Ndalimi i qindra ndërtimeve pa leje nisur kohët •e fundit me shpresën e përfshirjes në klauzolën e ligjit «Për legalizimin, urbanizimin dhe integrimin e ndërtimeve pa leje»;

Rishikimi i projekt-ligjit të ri «Për disa ndryshime •në ligjin për kthimin kompensimin e pronave« i cili parashikon heqjen apo ngushtimin drastik të pengesave në kthimin tek ish-pronarët të pronave që gjenden në zona të mbrojtura dhe në zona që janë pasuri e veçantë kulturore dhe historike për vendin tonë.

Sigurimi i pjesëmarrjes së ytetarëve dhe gjithë •shoqërisë civile në procesin e vendim-marrjes për çështje që kanë lidhje me mjedisin dhe zonat e mbrojtura, detyrim që rrjedh edhe nga Konventa e Aarhusit, ratifikuar nga vendi ynë në vitin 2000.

a component of its NOSA civil society involvement. The public debates offer a forum where communities and interest groups may discuss issues of priority importance in their lives. In these forums, the participants introduce their points of view and argue in favor or against a certain issue. The project is aimed at making an impact on educating and informing citizens; encouraging the individual’s active participation in community problem solving discussions; narrowing the gap between the government and the governed.

The discussions of the month of February focused on the existing problems and possible agreements that may be reached among the concerned actors to improve environmental situation in Albania. In addition to the expression of commitment to cooperate and launch joint action, the participants in the debate sent an open letter to the main Albanian institutions responsible for environmental issues calling for greater attention to environmental protection in Albania.

The letter contained three main demands:

To stop the hundreds of extra legal constructions •that are springing up lately based on their owner’s expectations that they may be able to legalize them under the recent law «Concerning legalization, urbanization and integration of extra legal constructions»;

To revisit the recent draft law «Concerning •some changes in the law for the restitutions and compensation of property» which proposes the lifting or drastical reduction of criteria for the restitution of property located inside protected sites and in areas harboring special cultural and historical values for Albania.

To ensure the participation of the public and •interest groups in the process of decision-making in issues that have to do with protection of the environment and conservation of protected sites in accordance with the provisions of the Aarhus Convention ratified by our Country in the year 2000.

Gjatë vitit 2006 OSFA vazhdoi një varg projektesh të ndërmarra në vitet e mëparshme për reformimin e sistemit arsimor si Kodi i Etikës së universiteteve; Fuqizimi i Agjensisë së Akreditimi; mbështetje për Qendrat e Informimit Studentor etj. OSFA u tregua e vëmendshme edhe ndaj debatit të gjerë që përfshiu botën universitare gjatë këtij viti në lidhje me projekt-ligjin për arsimin e lartë, duke ndihmuar në shqyrtimin e përvojave të vendeve të tjera, në përmirësimin e dialogut mes palëve etj. Po kështu OSFA vazhdoi disa projekte për reformimin e arsimit parauniversitar të cilat synojnë vendosjen e standarteve të reja mbarëkombëtare, në komunikimin mes komunitetit dhe autoriteteve shkollore si dhe në harmonizimin e politikave arsimore me ato sociale. Për realizimin e këtyre projekteve OSFA bashkëpunoi me Konferencën e Rektorëve, Forumin Universitar Shqiptar, Ministrinë e Arsimit dhe të Shkencës, Universitetin e Elbasanit etj.

Reformimi i Arsimit të Lartë Shqiptar

Në kushtet e sotme, arsimi i lartë ka shfaqur shenjat e një krize që ka përfshirë të gjitha nivelet e tij, studentë, proces mësimdhënieje, staf akademik dhe manaxhim financiar. Për këto arsye, në vitin 2004 qeveria ndërmori disa amendime me karakter reformues. Këto amendime, pavarësisht idesë së tyre fillestare, nuk i përgjigjen si duhet parimeve të autonomisë universitare. Prej disa kohësh OSFA ka ndërmarrë një studim në lidhje me reformimin e arsimit të lartë shqiptar. Ky studim, bashkëpunim mes OSFA-së dhe ISB-së, fokusoi kryesisht çështje të menaxhimit të arsimit të lartë. Në të u parashtrua koncepti i ri i autonomisë financiare të universiteteve si një barazpeshim mes lirisë për të administruar të ardhurat financiare dhe përgjegjshmërisë në raport me këtë liri. Ngritja e këshillave financiare ose e një bordi thjesht financiar janë dy prej propoziomeve të studimit.

Një pjesë e këtij studimi është botuar tashmë dhe u është shpërndarë aktorëve të jetës universitare. Gjithashtu, propozimet e dala prej tij janë parashtruar në një nga workshopet e organizuara në kuadër të debatit për autonominë universitare. Shumica e grupeve të interesit e kanë përshëndetur studimin dhe kanë shprehur keqardhjen për indiferencën që pati treguar Ministria e Arsimit ndaj tij.

In 2006, OSFA continued to implement a number of projects undertaken in the previous years to assist the reformation of the education system in Albania. Such projects were, the University Code of Ethics, the Strengthening of Capacities of the Higher Education Accreditation Agency, Support to the Student Advising and Information Centers, etc. OSFA was attentive to the debate on the Law of Higher Education which swept the university world last year. It contributed to relevant developments by making available the experiences of other countries and by facilitating dialogue between/among stakeholders. In addition OSFA continued its projects for the reformation of pre-university education which were aimed at the creation of new national education standards, the improvement of communication between school authorities and communities, and the harmonization of social assistance programs/policies with educational strategies. To implement these projects, OSFA collaborated with the Rector’s Conference, the Forum for the Autonomy of Universities, the Ministry of Education, the University of Elbasan, etc.

Reformation of Albania’s Higher Education

Albania’s Higher Education is displaying the signs of a crisis affecting all of its constituents: faculty, students, the teaching process as well as the leadership and managements levels. To relieve the crisis, the government planned on instituting certain measures of a reforming nature. However, despite their positive intention, the amendments do not appropriately conform to the principles of university autonomy. For quite some time now, OSFA has been involved in efforts to identify options for the reformation of higher education in Albania. One of these efforts is a joint project between OSFA and the Institute for Contemporary Studies (ISC) focusing on higher education management. The study introduces the new concept of financial autonomy based on the need to strike a balance between freedom to administrate financial resources and the rendering of accounts to the government and the public. The establishment of a financial council or simple management board at every university is the core proposal in the study.

Parts of the study have now been published and have been distributed to the relevant actors of university life. In addition, the findings and recommendations in the study have been presented in one of the workshops organized in the framework of debates surrounding issues of university reformation. Interest groups have welcomed the study and expressed their regret over the Ministry’s indifference.

Workshop mbi autonominë universitare

Në pranverën e këtij viti Ministria e Arsimit dhe Shkencës ngriti një grup pune për hartimin e një projektligji të ri për Arsimin e Lartë. Ai do të reflektonte të gjitha nevojat e botës universitare shqiptare për një thellim të procesit të autonomisë akademike dhe financiare, si dhe llogaridhënies financiare ndaj shtetit. Por, projketligji rezultoi përjashtues ndaj grupeve të interesit dhe shpërfillës ndaj automisë universitare. Kjo gjë nxiti zhillimin e një debati të gjerë në mbarë botën universitare. Në këtë kuadër OSFA dha ndihmesën e saj duke organizuar dhe mbështetur disa prej debateve mes përfaqësuesve të universiteteve dhe shtetit. Një prej tyre ishte dhe takimi me temë «Autonomia institucionale dhe financiare e shkollave të larta». Duke vlerësuar nevojën për ekspertizë në çështje të tilla OSFA mundësoi edhe praninë e Drejtorit të Programit «Mbështetja e arsimit të lartë» të Institutit të Shoqërisë së Hapur në Budapest, zoti Rhett Bowlin.

Takimi synonte të krijonte hapësirën e nevojshme për grupet e ndryshme të interesit në këtë debat, si dhe të siguronte mundësinë e shprehjes dhe përqasjes së mendimit. Gjatë tij u identifikuan nevojat për ekspertizë që kishin komunitetet brenda universiteteve. Çështjet kryesore të parashtruara u lidhen në mënyrë të drejtpërdrejtë me autonominë e universiteteve. Ato prekën:

aspekte të strukturave vendim-marrëse të •shkollave të larta,

aspekte të strukturave zgjedhore përkundrejt •atyre mikste ose të emëruara,

çështjen e autonomisë financiare si një e drejtë •thelbësore e shkollës së lartë,

çështjen e shpërndarjes së kompetencave. •

Në rend të ditës ishin ligjëratat e zotërinjve Artan Fuga dhe Hysen Çela. Pjesëmarrës të tjerë në diskutim qenë përfaqësues të debatit të sotëm universitar, akademik dhe mediatik për autonominë universitare. Gjatë takimit pati diskutime që niseshin nga këndvështrime të ndryshme për vlefshmërinë e modelit qeverisës dhe financiar të universitetit. Debatuesit sollën gjithashtu edhe përvojat e tyre në këto çështje.

Workshop on University Autonomy

In spring 2006, The Ministry of Education and Science established a working group to formulate a new draft law on higher education in Albania. The draft law was expected to reflect the needs of the university world and its desire for the deepening of the financial and academic autonomy countervailed by accountability and openness to the society. However, the draft law appeared to have excluded the consultation of interest groups and minimized the input of the university communities. In this context, OSFA was committed to providing its assistance to facilitate communication. It provided support to the debates between the university representatives and the government. One of these events was the holding of the workshop «Financial and Institutional Autonomy of Higher Education Institutions in Albania.» Aware of the need for international expertise on such issues, OSFA invited Mr. Rhett, Bowlin, Director of the Network Program for Higher Education Support, to participate in the Workshop.

The goal of the round table was to create space for the various interest groups to have their voice heard, as well as to provide the opportunities for the various contending opinions to converge based on the discussion of concrete evidence. Note was taken of the needs of university communities for expertise and capacity building assistance. The main points of the discussion related directly to the autonomy of universities. Specifically discussions centered on:

Aspects of decision making structures of higher •education institutions,

Advantages/disadvantages of elected structures •versus appointed or mixed bodies

Financial autonomy of higher education and•

Issues of power distribution in the higher •education system.

The participants listened to presentations by Mr. Artan Fuga and Hysen Cela, respectively about university governance structures and financial models in higher education. Other participants contributed to the discussion by highlighting the present trends in higher education internationally. All those who contributed to the workshop presented their own point of view over the validity of governance and funding models in the present circumstances of the country. Most speakers referred to their knowledge and experience with universities abroad gained while on training and visiting periods.

Kodi i Etikës i universiteteve

Projekti «Kodi i Etikës» është një iniciativë e ndërmarrë në Universitetin «Aleksandër Xhuvani» në Elbasan, me përkrahjen profesionale dhe financimin e Fondacionit të Shoqërisë së Hapur – Soros (OSFA), që synon forcimin e karakterit demokratik të universiteteve dhe shkollave të larta në vendin tonë. Puna për këtë projekt filloi gjatë vitit 2005 dhe përfundoi me hatimin dhe miratimin përfundimtar të Kodit të Etikës gjatë vitit 2006. Kodi është pjesë përbërëse e tërësisë së rregullave që zbatohen sot në çdo institucion. Në të përcaktohen në mënyrë të posaçme standardet e sjelljes së punonjësve, të cilat mbështeten mbi një bazë ligjore dhe morale.

Në detyrimet që duhet të përmbushë çdo institucion i arsimit të lartë krahas përmbushjes të standardeve të sigurimit të cilësisë, duhet të sigurohen edhe standardet e etikës. Realizimi i këtyre standardeve kërkon të rrisë përgjegjshmërinë e stafit akademik,

University Code of Ethics

The project on drafting a University Code of Ethics came as an initiative from the University of Elbasan. Its implementation drew the professional support and funding of the Open Society Foundation – Soros – Albania. The objective of the project is to strengthen democracy in the universities and higher education institutions in Albania. The work on this project started in 2005 and concluded with the drafting and endorsement of the Code of Ethics in 2006. The Code of Ethics is an integral part of the entirety of rules to be implemented in every institution and in the case of universities it particularly defines the standards of conduct of higher education staff in accordance with legal and moral requirements in a democratic society.

Along with quality and professional standards, the academic communities should show the highest of regard for institutional ethical standards. The implementation of such standards is needed to increase the levels of responsibility on the part of academic and administrative

të administratës dhe të të zgjedhurve të tyre në universitete dhe shkollat e larta për uljen e veprimeve abuzive, përmirësimit të komunikimit të brendshëm, rritjen e kënaqësisë për punën dhe të besimit te drejtuesit kryesorë. Ndryshimet e vrullshme aktuale në botën universitare në vend, masivizimi i arsimit të lartë dhe përfshirja e metodologjive dhe koncepteve të reja të mësimdhënies duhej domosdoshmërisht të shoqëroheshin me një kod të etikës, i cili do të shërbente si një rregullator i ri që do t’i përgjigjej fytyrës së re të arsimit të lartë shqiptar duke shmangur rreziqet e abuzimeve të mundshme.

Duke e vlerësuar së tepërmi, OSFA e mbështeti këtë iniciativë dhe siguroi konsulencë dhe financim. Ajo mundësoi edhe praninë dhe ndihmesën e rëndësishme të specialistes amerikane Marilyn Uyatt e kontaktuar për këtë çështje po nga OSFA. Realizimi i Kodit të Etikës u mbështet në një literaturë të gjerë dhe në modelet e disa universiteteve amerikane dhe europiane.

Fuqizimi i kapaciteteve të Agjencisë së Akreditimit

Agjensia e Akreditimit të Arsimit të Lartë në Shqipëri, (e ngritur me vendim të Këshillit të Ministrave në vitin 1999) është institucioni që vlerëson cilësinë e institucioneve dhe programeve të arsimit të lartë shqiptar dhe mban përgjegjësi për këtë proces. Cilësia është një ndër kushtet parësore të procesit të reformimit të arsimit të lartë sipas standarteve të Bolonjës. OSFA e ka konsideruar shumë të rëndësishëm këtë proces. Ajo ideoi dhe ndërmori realizimin e këtij projekti për mbështetjen institucionale të Agjensisë.

Projekti ka një shtrirje dy vjeçare (2005-2007) dhe parashikon fuqizimin e kapaciteteve të Agjensisë në mënyrë që ajo të jetë në gjendje të kryejë funksionin për të cilin është krijuar. Nëpërmjet këtij projekti sigurohet ekspertizë e huaj, shkëmbim përvojash me vende më të përparuara në këtë drejtim, pjesëmarrje në konferenca ndërkombëtare, trainim i stafit dhe lobim për njohjen dhe pranimin e Agjensisë në qarqet akademike, si edhe garantimin e një pavarësie më të madhe institucionale e ligjore të saj .

staff as well as the elected forums in higher education institutions with regard to reduced abusive practices, improved internal communication, increased work satisfaction and strengthened trust of university communities in the leaders of their institutions. The rapid and often tumultuous developments in the country’s universities, the massivisation of higher education and the introduction of new methodologies and concepts of teaching created the need for a Code of Ethics which would serve as a regulatory mechanism in the contest of transformation of the Albanian higher education by avoiding risks and possible abuses.

In view of its importance, OSFA supported the initiative and provided funding and consultancy. It enabled the valuable input and feedback of Mrs. Marilyn Wyatt from the International Center for Non Profit Law (ICNL) specializing in such issues. The drafting of the Code of Ethics benefited from the research of a wide range of models taken from European and American universities.

Strengthening the Capacities of the Higher Education Accreditation Agency

The Agency for the Accreditation of Higher Education in Albania (established in the year 1999 by Decision of the Council of Ministers) is responsible for the evaluation of the quality of higher education programs and higher education institutions in Albania. Quality assurance is one of the important conditions in the transformation of higher education to meet the Bologna standards. From the very beginning, OSFA considered the process to be of priority importance for Albanian higher education. Therefore, OSFA launched the efforts to design and carry out the project to assist the Agency with building its institutional capacities.

Spanning over a two-year period, the project is dedicated to creating the necessary conditions for the Agency to strengthen the capacities towards fulfilling its functional duties. Some of the main activities in the project include the provision of foreign expertise, exchange of experience with more advanced counterpart institutions, participation in international conferences, staff training and lobbying activities to improve the standing of the Agency with academic circles and the society at large, as well as to increase the Agency’s independence by expanding its institutional and legal powers.

Ndër aktivitetet e para të realizuara të Agjensisë mund të përmendim ngritjen e Grupit të Miqve të Agjensisë, (një organ informal me pjesëtarë nga universitetet dhe ekzekutivi që vepron si mbështetës i agjensisë në këto nivele), një vizitë e kryetarit të Këshillit Austriak të Akreditimit në Tiranë , përgatitjen e faqes së internetit të Agjensisë dhe fillimin e procedurave për antarësim në Rrjetin Europian të Agjensive te Sigurimit të Cilësisë, ENQA.

Mbështetje për Shkollën e Studimeve Europiane

Duke synuar fuqizimin e kapaciteteve të Shkollës së Studimeve Europiane, OSFA ftoi pranë kësaj shkolle ekspertin e Programit të ndërhyrjeve të Posaçme të CEU-t, Zotin Oliver Schuet. Ai shqyrtoi tërësinë e dokumentacionit të shkollës si: Curricula, CV të pedagogëve, cilësinë e studentëve. Në bazë të këshillimeve të tij, u ngrit një grup pune i cili, pas një vizite pune në CEU, u ngarkua të hartonte një plan strategjik pesëvjeçar.

Në këtë kuadër, OSFA-ja financoi në disa nivele njëherësh, për një periudhë tre vjeçare:

Trajnim pedagogësh dhe intership;1.

Shkëmbime përvojash me shkolla të ngjashme;2.

Sjellje lektorësh nga CEU;3.

Workshop për metodologjinë e mësimdhënies në 4. sistemin pasuniversitar;

Ndërtimin e faqes së internetit të shkollës. 5.

Ky projekt, nuk ndikoi vetëm në rritjen e cilësisë së Shkollës së Studimeve Europiane. Duke qenë një strukturë ndërdepartamentale, ajo ndikoi ndjeshëm edhe në strukturat e tjera universitare prej nga vinin pedagogët e shkollës. Përvoja e krijuar shërben edhe sot si një orientim i mirë për të gjithë.

Among the first activities of the Agency, mention can be made of the establishment of the Group of Friends of the Agency (an informal body with members from the academia and the Government to act as supporter and promoter of the Agency at these levels); a visit by the Chair of the Austrian Accreditation Council in Tirana, the design of an internet website for the Agency; and the undertaking of steps to make the Agency a member of the European Network for Quality Assurance (ENQA).

Support to the European Studies School

With a view to assisting the Graduate School of European Studies in Albania to improve curricular content and teaching capacities, OSFA invited the expert of Special and Extension Programs at the Central European University to help design a cooperation strategy. Having researched into detail the school’s program, its teaching capacities, admission requirements and its medium and short term plans for future development, Mr. Schuet proposed that the school faculty visit the CEU. In addition to exchange activities, the Albanian guests would be assisted to design a five year strategic plan for their school.

Under this framework, OSFA funded a number of parallel activities over a three-year period:

Faculty development schemes;1.

Exchanges with schools of similar standing;2.

Visiting lecturers from CEU3.

A Workshop on teaching methodologies at the 4. graduate level

Constructing a website for the school.5.

The project will benefit not just the School of European Studies. Given the cross departmental character of the School, the project will improve teaching at many departments at the Universities in which the same professors teach at the undergraduate level. The experience collected in the process of implementing this project is serving as positive guide in similar interventions.

Qendrat e Informimit dhe Këshillimit Studentor

Këshillimi studentor është një shërbim i ri ende në hapat e para në Shqipëri. Nxënësit shqiptarë, pas përfundimit të shkollës së mesme, i jepet shumë pak informacion në lidhje me profilin e shkollës që ai dëshiron të ndjekë. Shpesh herë ata ndjekin universitete, fakultete apo degë, të shtyrë nga trysnia e prindërve, shoqërisë dhe ngasjet e çastit. Vështirësi të ngjashme hasen edhe nga nxënësit që dëshirojnë të studiojnë jashtë shtetit. Ata nuk e kanë të lehtë të orientohen në zgjedhjet, aplikimiet dhe ndihmën financiare që mund të përfitojnë, testimeve të shumta dhe shpesh, kur nuk gjejnë askënd që t’i udhëzojë mirë, ndodh të heqin dorë apo të dështojnë në sipërmarrjen e tyre.

OSFA, në bashkëpunim me universitetet e vendit kanë nënshkruar një marrëveshje mirëkuptimi që mundëson funksionimin e Qendrave të Këshillimit dhe Informimit Studentor, në ndihmë të studentëve dhe të rinjve shqiptarë. Këto qendra synojnë të lehtësojnë këto probleme duke ofruar disa shërbime të thjeshta, por të dobishme për nxënësit dhe studentët shqiptarë. Këto qendra janë krijuar si njësi autonome, pjesë e strukturës së universiteteve dhe mundësojnë kurse të ndryshme, këshillime studentore dhe, së shpejti do të mundësojnë edhe përgatitjen dhe dhënien e provimit të Toefl-it në të gjitha qytetet universitare.

Gjatë vitit 2006 kanë funksionuar qendrat studentore në Universitetin e Tiranës, Universitetin e Shkodrës, Universitetin e Vlorës, Universitetin e Elbasanit, Universititin e Korçës, Universitetin e Gjirokastrës.

Student Advising and Information Centers

Student advising is a new service in its first steps in Albania’s universities. Upon completion of secondary education, Albanian adolescents have little opportunities of obtaining information with regard to possible choices for college studies. Often they make their educational choices under pressure from parents, based on information or influence from peers or they simply decide in the absence of any solid and adequate information. The same odds face the candidates wishing to pursue studies in foreign universities. They have difficulty in orienting themselves in the choices available, in applying for financial aid, fulfilling application requirements, go through with the various tests. Often, unable to receive qualified assistance, they give up or stray in the choices they make.

OSFA has concluded Memorandums of Understanding with the Universities in the country to make the services of Student Advising and Information Centers available to young people who wish to pursue college studies either in Albania or abroad. These centers have been established by OSFA to help Albanian youngsters make informed choices about their educational paths. The centers are now operating as autonomous entities inside the Universities. They offer various courses, educational and informational services and will soon start to serve as authorized TOEFL centers.

In 2006, OSFA maintained the Student Advising and Information Centers at the Universities of Tirana, Shkodra, Vlora, Elbasan, Korca and Gjirokastra.

Communication between Communities and Educational Authorities

The Open Society Foundation for Albania has paid undivided attention to the important changes in the pre-university education system in Albania. Decentralization of governance has placed in the hands of public professional communities the making of important decisions in the elementary and secondary levels of education. To contribute to these developments, OSFA designed the project «Communication between communities and

vendimeve të rëndësishme edhe për ciklin e ulët dhe të mesëm të arsimit. Për këtë arsye u konceptua edhe projekti me temë «Komunikimi mes komunitetit dhe autoriteteve arsimore», me një shtrirje dy vjeçare, 2006-2007, i mbështetur nga OSFA dhe Balkan Trust Fund for Democracy, me qendër në Beograd.

Ky projekt synoi nxitjen e pjesëmarrjes së aktorëve të interesuar në arsim dhe përmirësimin e qeverisjes në nivel shkolle. Ai thekson bashkëpunimin e ngushtë mes institucioneve arsimore shkollore, përfaqësuesve nga komuniteti i prindërve dhe institucioneve arsimore në nivel vendor. The project aims to encourage the participation of stakeholders in educational issues as a means to improve education governance at school level. It places great emphasis on the need for closer cooperation between the school authorities, the representatives from the parent community and the teachers at school level. In the course of project implementation in 2006, a number of meetings were held with educational authorities in some regions of Albania, awareness activities in the media were conducted and exchanges of experience and expertise at the level

U punua gjithashtu edhe me shoqatat dhe Komitetin Kombëtar të Prindërve, për të përcaktuar mënyrat e ndërhyrjes dhe marrjes së vendimeve në interes të rritjes së cilësisë së arsimimit dhe përgatitjes për një autonomi të sistemit parauniversitar. Në fazën përfundimtare po punohet për botimin e një studim përmbledhës i cili do të shpërndahet në institucionet arsimore përgjegjëse në ndihmë të reformës arsimore.

Standardet e arsimit parauniversitar

Përshtatja e arsimit parauniversitar me ritmet dhe parimet e reja të shoqërisë së hapur dhe të ekonomisë së tregut u identifikua nga OSFA si një proces i rëndësishëm që kishte nevojë për mbështetje të vazhdueshme. Përcaktimi dhe vendosja e standarteve të reja u panë si garantuesit e cilësisë mbarëkombëtare të arsimimit të brezave të rinj. Prandaj edhe gjatë vitit 2006 OSFA dha ndihmesën e saj në këtë proces standardizimi. Kështu në muajin tetor, standardet e arsimit shqiptar u diskutuan gjatë një seminari të organizuar nga OSFA në bashkëpunim me Qendrën e Trajnimit dhe të Kualifikimit të Mësuesve (QTKA). Në seminarin me temë «Standartet e Trajnimit dhe te Kualifikimit te Mesuesve» morën pjesë përfaqësues të drejtorive arsimore në rrethe, anëtarë të QTKA-së, specialistë dhe Dekania e Fakultetit të Edukimit në Universitetin e Ljubjanës, zonja Cveta Pucko. Ajo komentoi modelin aktual të standardeve, hartuar nga QTKA gjatë zbatimit të projektit. Nga diskutimet rezultoi se standardet duhen kombinuar me elemente të vetëvlerësimit dhe të kualifikimit. Gjithashtu u rekomandua një përzgjedhje më e mirë e kontigjentit të studenteve për degët e mësuesisë; forcimi i cilësisë së fakulteteve të mësuesisë sidomos në disiplinat pedagogjike; krijimi i dosjes së mësuesit, e cila do të dokumentojë përpjekjet vetiake për kualifikim gjatë gjithë karrierës.

Ky seminari përmbylli një seri veprimtarish të realizuara me mbështetjen e Programit të Arsimit Parauniversitar dhe atij Lindje-Lindje të OSFA-s, nga mund të veçojmë : një seminar trajnues me stafin e

Work also involved the parent associations and the National Parent Committee to determine the manner of administration and decision making so as to serve the interest of quality upgrade and the preparation of the grounds for the autonomy of pre-university education. In the last phase of the project, efforts have centered on the publishing of a study of findings and recommendations to be distributed among the authorities responsible for educational reform in Albania.

Standards in Pre-university Education

Adaptation of the Albanian education with the newly created conditions to keep up with the new pace and principles of development of an open society and market economy were identified by OSFA as an important process which needs to be guided and fostered constantly in order to achieve the desired results. The identification and setting of new standards are important instruments for quality assurance at national level for the education of new generations. Therefore in 2006, the Foundation provided supported to the process of standard setting and quality assurance in education. In October, in cooperation with the Centre for Teacher Training and Qualifications a seminar was held to discuss the Albanian education standards. It was attended by representatives of educational directorates at the regions. A special invitee and contributor to the seminar was the Dean of the Teacher Training Faculty at the University of Ljubljana, Mrs. Cveta Pucko, who commented on and provided input to the actual document of standards drafted by the Centre as an important output of the program. During the discussions the need was stressed to combine standard implementation with strong elements of self-assessment and continuous qualification of teachers. Recommendations produced by the project involved upgrading selection criteria for students enrolling in teacher training programs, strengthening the quality of teaching at teacher training faculties, introducing the teacher’s portfolio as a tool to allow teachers to document their efforts and results achieved as part of their professional development during the entire career course.

Harmonizimi i politikave sociale me ato arsimore

Një nga pasojat afatgjata të tranzicionit të shoqërisë shqiptare është dhe dukuria e braktisjes së shkollës nga fëmijët. Për të kuptuar më mirë shkaqet e e përgjithshme të kësaj dukurie dhe për të përcaktuar rrugët më të sigurta të zgjidhjes, OSFA mbështeti studimin me temë «Harmonizimi i politikave sociale me politikat arsimore» dhe prezantimin e tij nga Forumi Shqiptar Social Ekonomik dhe Shoqata «Zhvillimi i Edukimit». Varfëria ekonomike e familjejve në nevojë u identifikua në studim si një nga shkaqet kryesore të braktisjes së shkollës. Pjesëmarrësit në takim u shprehën njëzëri dhe miratuan nevojën e një lobingu për modifikime në legjislacionin aktual. Duke iu referuar edhe përvojave të vendeve të tjera të rajonit, u mendua se modifikime do t’i motivojnë më mirë familjet në nevojë për t’i dërguar fëmijët në shkollë. Takimi hartoi gjithashtu edhe një varg rekomandimesh të cilat u publikuan menjeherë nga OSFA në formë të shtypur dhe elektronike.

The Seminar was the last in a series of activities realized with the support of the Pre-university Education Support Program and the East East Program of OSFA of which the most important were a training seminar with the Center’s staff on European and Slovenian standards on teacher training and a visit to Slovenia to observe the implementation of standards in actual classroom conditions.

Using Social Assistance Programs to achieve Education Policy Objectives

One of the long-term consequences of the transition is the phenomenon of school drop out by children. In order to better understand the causes and to determine the most effective solution, OSFA supported the carrying out of the study Using Social Assistance Programs to Achieve Education Policy Objectives. OSFA also supported the dissemination of the project’s outputs by the Albanian Social and Economic Think Tank and the Association for the Development of Education. Poor economic situation of families was identified as the main cause of school drop out. Participants in the round table expressed the need for lobbying actions to make changes in the actual legislation on social assistance. Drawing on the experience of other countries in the region, it was considered necessary to make changes towards achieving education policy objectives including through social assistance programs. The project proposed a number of legal and regulatory amendments to better serve the purpose of motivating families in need to send their children to school and where possible to encourage increased learning achievements. The meeting came up with a number of proposals on ways that can be used. The study was published by OSFA on line and in hard copy.

Edhe gjatë vitit 2006 OSFA bashkëpunoi me këtë program për të mbështetur shkëmbime ndërkombëtare mes aktorëve të shoqërisë civile, sidomos nga rajoni, për të shkëmbyer ide, përvojë dhe ekspertizë si dhe për të mbështetur aksione praktike të ndërmarra nga ky lloj rrjetëzimi.

East East Program is an initiative run by OSI London. In 2006, as in previous years, OSFA cooperated with the Program to support international exchange among the actors of civil society, mainly from the region, to exchange ideas, experience and expertise and to support practical action in the context of networking.

Programi Lindje-Lindje ofroi ndihmë në burime financiare dhe njerëzore për të nxitur veprimtari në ndërtim kapacitetesh dhe krijim ekspertize; për të përgjithësuar rastet e suksesit në transformimin social; për gjallërimin e debatit intelektual etj. Edhe këtë vit, aktivitetet e mbështetura nga programi Lindje-Lindje patën si kusht kryesor partneritetin ndërkufitar të organazitave, shoqatave dhe institucioneve, që ndërmorën konceptimin dhe realizimin e një serie të sukseshme projektesh.

Disa prej projekteve më të rëndësishme u realizuan në bashkëpunim me anëtarë të NOSA-s, por u mbështetën edhe një varg projektesh të ndërmarra edhe nga struktura të tjera si Instituti i Dialogut Publik& Komunikimit, Forumi Shqiptar Social Ekonomik, Shoqata «Zhvillimi i Edukimit», Komiteti Kombëtar i Prindërve etj. Duke bashkëpunuar më këto të fundit, OSFA vijoi punën edhe në disa projekte për reformimin e arsimit parauniversitar të cilat synuan vendosjen e standarteve të reja mbarëkombëtare, në komunikimin mes komunitetit dhe autoriteteve shkollore si dhe në harmonizimin e politikave arsimore me ato sociale.

Tërësia e projekte iu përgjigj njëkohësisht frymës së programit dhe përparësive të OSFA-s e partnerëve të saj për 2006. Për këtë arsye ato janë prezantuar në këtë raport krahas projekteve të tjera, organizuar sipas përparësive përkatëse.

Ndër projektet e zhvilluara në kuadër të këtij programi rrjeti përmendim: Takimi rajonal për «Zgjedhje të lira e të ndershme», Workshop për strehimin publik, Statusi ndërkombëtar i Kosovës dhe siguria në Ballkan, Konferenca «Shqipëria dhe Greqia : perceptime të ndërsjellta», Debati për librin në Ballkanin Perëndimor, Debati «Kthesat historike dhe rikthimi i kujtesës, Komunikimi mes komunitetit dhe autoriteteve arsimore, Standardet e arsimit parauniversitar, «Harmonizimi i politikave sociale me ato arsimore».

The East East Program offered financial and human resources to encourage activities contributing to capacity building, dissemination of success stories of social transformation, stimulating of intellectual debate, etc. In 2006, too, the activities supported by East East fulfilled the requirement that organizations, associations and institutions proposing the project should be involved in cross border action and exchanges contributing substantially to the achievement of project’s objectives.

Some of the important projects were implemented in cooperation with NOSA members. However, a number of additional projects were undertaken by such other structures as the Institute of Dialogue and Communication, the Albanian Social and Economic Think Tank, the Association for Education Development, the Albanian Parent Committee, etc. Thanks to cooperation with the latter organizations, OSFA continued its efforts for the reformation of pre-university education which aimed at establishing new national educational standards, establishing dialogue between the school authorities and communities and harmonization of social assistance programs with educational policies.

The entirety of projects under this Program corresponded with the program’s philosophy and the priorities of OSFA and its partners for 2006. For this reason, they have been described in this report along with other projects undertaken in line with respective priorities.

Among projects developed in the context of this network program mention can be made of, the regional meeting on conducting free and fair elections, workshop on public housing, Kosova final status and security in the Balkans, the conference about the mutual perceptions of Albanians and Greeks, the debate on publishing issues in Western Balkans, the debate on historical turns and the return of memory, communication between communities and educational authorities, standards of pre-university education, using social assistance programs to achieve educational policy objectives.

Programi i bursaveScholarship Program

Programi i Bursave është pjesë e Programit Rajonal të Bursave të Institutit të Shoqërisë së Hapur (OSI), që nga viti 1993. Edhe gjatë vitit 2006 synimi kryesor i programit ka qenë përgatitja e një brezi të kualifikuar specialistësh të fushave të ndryshme për të përballuar sfidat e reja të shoqërisë shqiptare. Dhjetra të rinj shqiptarë janë nxitur dhe mbështetur për të marrë pjesë në procesin e konkurrimit dhe të përzgjedhjes si fitues të bursave universitare ose pasuniversitare gjatë vitit akademik 2006-2007.

The scholarship program is part of the Network Scholarship Program of the Open Society Institute (OSI) since 1993. In 2006 as in previous years, the purpose of the program was the preparation of trained specialists in various fields with knowledge and skills to cope with the challenges of Albanian society. A great number of Albanian young people were encouraged to compete for undergraduate and graduate scholarships in the academic year 2006-2007.

OSFA has had a coordinating role among the applicants, OSI and the various universities by advising the applicants, facilitating the application process and channeling procedural steps. Another contribution by OSFA was the arrangement of interviews for short listed candidates with the representatives of funders and the concerned universities. In the majority of cases, OSFA covers the travel expenses of scholarship beneficiaries.

The study fields for 2006, as traditionally, were of a large variety. They included social fields such as Political and European Studies, Cultural Anthropology, Philosophy and Sociology as well as the fields of applied technology and management. A special type of scholarships under the Salzburg Seminars was the one dedicated to training of young medical staff.

In 2006, the Scholarship program offered specifically:

1 full scholarship and 12 partial scholarships •for the American University in Bulgaria, which were given to young people wich completed secondary education. Due to a dedicated multi-year commitment of OSFA staff, the community of Albanian students enrolled at AUBG is the second largest one.

1 scholarship for Master’s study at the University •of Oxford

1 scholarship for Master’s study at the University •of Sussex

2 research scholarships at the University of •Oxford destined for employees of public and governmental structures.

10 scholarships for the Salzburg Medical Seminars.•

OSFA ka vepruar si koordinuese ndërmjet aplikuesve, OSI-t dheuniversiteteve të ndryshme, duke këshilluar të rinjtë, lehtësuar procedurat dhe aplikimet, si dhe duke organizuar komisionet përzgjedhëse me përfaqësues të OSI-t dhe të universiteteve përkatëse. Në shumë raste OSFA ka ofruar edhe shpenzime udhëtimi
