THURSDAY, JULY 12, 2018 (PAGE 14) DAILY EXCELSIOR, JAMMU EC asks CBDT to follow uniform format to scrutinise candidates’ poll affidavits NEW DELHI, July 11: The Election Commission has asked the Central Board of Direct Taxes to come up with a “uniform format” to report scrutiny of assets and liabili- ties declared by candidates in their poll affidavits. In a letter to the CBDT chairperson yesterday, the Election Commission said the verification report to check for mismatch should reflect the five categories decided by the two bodies in 2013, a senior EC functionary said. The EC’s letter comes after the CBDT cautioned the poll panel against putting in public domain the scrutiny report of assets and liabilities declared by candidates in their poll affi- davits. In November, 2017 and April this year, the EC had sought clarification from the CBDT on whether the poll panel could allow the public to access reports on the verifica- tion of election affidavits by the Director General of Income Tax (Investigation) under the Right to Information Act. The EC feels that since a verification report is not an investigation report, its disclo- sure should not be restricted under Section 24 of the RTI Act, which exempts certain organisations from being cov- ered under the information law. Now, based on the response of the CBDT, the EC may decide on whether to put scrutiny reports in the public domain. As of now, no fixed or stan- dard format is followed to share verification reports with the EC. The five categories under which the CBDT scrutinises the poll affidavits are: specific cases forwarded by the EC to the CBDT for verification; cases where there has been a phenomenal growth in the assets of a candidate based on affidavits filed in previous elections; cases of winning candidates and the veracity of the affidavits compared to the returns of income, if any, filed by them; cases where there was no PAN details but movable/immovable assets disclosed are in excess of Rs 5 crore; and matters where addi- tion of new immovable assets above a threshold vis-a-vis last affidavit is noticed. (PTI) India losing tourists due to sheer lethargy, apathy: SC NEW DELHI, July 11: "Sheer lethargy and apathy" of the authorities was making India lose tourists and foreign exchange despite having the Taj Mahal, as the Eiffel Tower of Paris was drawing eight times more tourists than the iconic mausoleum in Agra, the Supreme Court said today. Comparing the Taj and the Eiffel Tower, it said that while only 10 million foreign tourists had vis- ited India last year, Paris was thronged by 80 million of them. "There is the Eiffel Tower in Paris. Perhaps it is nothing com- pared to Taj Mahal. 80 million people come there (Paris). This is eight time more than what we have. You can destroy the Taj, we don't want to do it," a bench of Justices Madan B Lokur and Deepak Gupta said. During the hearing, the bench asked Additional Solicitor General (ASG) A N S Nadkarni, appearing for the Centre, as to how many tourists come to India in a year. When Nadkarni said 10 mil- lion tourists visited India in 2017, the bench observed, "we are happy to have only 10 million people." "There is sheer lethargy and apathy. People (abroad) are mak- ing money, but no one is bothered (here)," the Apex Court said while slamming the Government and the authorities for their fail- ure to take concrete steps to pro- tect and preserve the Taj. When the ASG said the Union Tourism Ministry could give more details about the tourists visiting India, the bench observed, "They will not bother. Why will they bother about tourists?" "Do you realise the loss to the country due to this sheer lethar- gy? Foreign exchange, infra- structure, everything is lost due to this. There is a loss to tourism. One monument can do it, but there is apathy," the bench said. The Apex Court also asked the ASG, "Have you seen the Taj? Have you seen Eiffel Tower?" To this, the ASG said, "Taj obviously is much better". Referring to the Eiffel Tower, the bench said in India, there were concerns about security, but in other countries, they have made towers like "TV towers" from where tourists can have a "bird's eye view" of the entire city. "We are obsessed with securi- ty. At every place (in foreign cities), you have towers to have bird's eye view of the city. But in India, you have security prob- lems. There are no towers to look at the city," the bench said. The bench also asked Nadkarni about the income col- lected from tourists visiting Taj Mahal and Agra. When Nadkarni said he would have to check on it, the bench said, "part of the income generated from this (Taj) monu- ment has to be considered in this income". The bench also dealt with the submissions of environmentalist M C Mehta, who has filed the petition raising the issue of pro- tection and preservation of the Taj Mahal, about giving Agra the status of a heritage city. During the hearing, one of the advocates told the bench that soon there would be time restric- tion and time slot for tourists vis- iting Taj. The court observed that the time-slot for visiting the Taj could be imposed as was done in places like United Kingdom. The Apex Court has been monitoring developments in the area to protect the Taj Mahal, built by Mughal emperor Shah Jahan in the memory of his wife Mumtaz Mahal at Agra. Its con- struction was completed in 1643 but work continued on other phases of the project for another 10 years. The ivory white marble mausoleum is a UNESCO World Heritage Site. (PTI) ED moves court seeking fugitive offender tag against Nirav, Choksi MUMBAI, July 11: The Enforcement Directorate (ED) today moved a special PMLA court here seek- ing to declare diamond traders Nirav Modi and Mehul Choksi as 'fugitive economic offenders' and to confiscate their assets worth Rs 3,500 crore in the USD 2 billion PNB fraud case, offi- cials said. They said two separate appli- cations, under the recently promulgated Fugitive Economic Offenders Ordinance, were filed against the duo before the court that hears matters under the Prevention of Money Laundering Act (PMLA). The agency had early this month moved a similar applica- tion against businessman Vijay Mallya in the Rs 9,000-crore alleged bank loan fraud case and the court recently issued sum- mons to him for August 27 under the new ordinance. The fresh application seeks to immediately confiscate assets worth about Rs 3,500 crore of Nirav Modi and Choksi and their companies. The agency seeks to confiscate assets, both movable and immovable, including those located in the United Kingdom and the UAE. The move has been made on the basis of the two PMLA charge sheets filed by the agency against the two designer diamond jewellers on charges of alleged money laundering. "Investigations have revealed that Nirav Modi and Mehul Choksi have committed the offence of cheating against Punjab National Bank (PNB) in connivance with certain bank officials by fraudulently getting the LOUs/FLCs issued without following prescribed procedure and caused a wrongful loss to to the bank. "They have further siphoned off the proceeds of crime so gen- erated through layering through multiple dummy, related, con- nected entities in India and abroad," the agency said in its application.
