IntroductIon

1. Background

In Uganda, clan leaders play an important role in influencingcommunityperspectives,attitudesandresponsestochanges,aswellasinitiativesintheirimmediatevicinity.

The roles of clan leaders vary from one region of the countryto another but generally range from the ‘cultural’ (performingculturalrites,reinforcingormodifyingculturalpractices,upholdingculturalvalues-e.g.integrityandaccountability,beingcustodiansoftradition,amongothers)todevelopment-relatedandpoliticalroles(which involvecommunitymobilisation,resolvingconflicts,andpromotinggovernmentprogrammes).

Inspiteofthis,clansarerarelyrecognisedasavalidinstitutiontoaddressthechallengesournationandourcommunitiescurrentlyface.

Andneither are the roles clans play clearly definedor codified.Thislackofclaritysometimesresultsinambiguousboundariesofauthority,manipulationbypoliticians,andmayrenderclanleaders’otherwise positive intervention in cultural and developmentalmatters,ineffective.

It was therefore felt important to start developing a set ofguidelines–orcharters–forclanleaders.Thiswasdonebyclanleadersthemselves,infiveregionsofthecountry.Itprovidedanopportunity forclan leaders to reflecton theirpastandcurrentroles;ontheiraspirationsandonthevaluesandprinciplestheyseektoadhereto.

Giventheenthusiasticresponseaccordedtothisinitiativebytheclanleadersthemselves,itappearsthatthischarterhasfallenonfertilegroundandreflectsastrongdesireforrecognition.

2. DrawingupaClanLeaders’Charter

The texts that follow are based on submissions obtained from355 clan leaders and cultural resource persons in 5 regions ofUganda (Tooro, Lango,Busoga,NebbiandPokot). Inaddition toclan leaders, focus group discussionswere held separatelywithwomenculturalleadersinthreeoftheseregions.

This consultative process was facilitated by the Cross-CulturalFoundation of Uganda in the course of 2011. It involved twostages:wideconsultativemeetingswithalargergroupofleaders,followedbyadraftingmeeting,whereasmallergroupofleadersdistilledtheircolleagues’thoughtsintoproposedcharters.

Thisdocumentpresentsthefruitofthesedeliberations:first(inthemainsection),byoutliningthecommon,overarchingconclusionsreachedinall5regions(basedonanecessarilysomewhatarbitraryselection of key points), then by presenting the clan charterdeveloped individually in each of the regions, in both the locallanguageandwithanEnglishtranslation.

The financial assistance of the Uganda National NGO Forumand of Development Research and Training (DRT - MwananchiProgramme)forthisprocessisgratefullyacknowledged.

3. Useofthecharters

Thisdocumenthasbeenpreparedasaguideforallclanandothercultural leaders in the country. It may be used as a referencedocumentinavarietyofcircumstancesandsituations,suchasatclanmeetings,whenofficiatingatpublicfunctions,whensettlingdisputes,whenseekingcollaborationwithotherleaders,etc.

Themainsectionsofthisdocumenthavebeendrawnfromthe5regionalconsultations.TheymaythereforeneitherbeconsideredentirelyappropriatenorrelevantinallotherpartsofUganda.Thereader is therefore encouraged to consider this document as astartingpoint,liabletorevisionsandimprovements,alsokeeping

4. Theclanleaders’charters-Commonvaluesandprinciples

a. Whoisaclanleader?

A clan leader is often (butnotnecessarily) amarriedmanfrom theethnic group, he is recognised and/or electedbyhiscommunitybecauseofhisimpeccableconduct,aswellasthefactthatcultural leadership isagiftfromGod.Womenmayholdleadershippositionsintheclaninstitutionbutarenotheadsofclans.

Althoughtheculturesinthefiveregionsarediverse,therearecross-cuttingprinciplesandvaluesthatclanleadersupholdingeneral.Onebecomesaclanleaderifoneisknowledgeableabout traditions and culture, but one is also designated,trusted and respected by the community one leads, hardworkingandwithasenseofvisionfortheclan.Thisimpliesthataclanleaderwillactasarolemodelandadheretothefollowingcodeofconduct.

b. Codeofconduct

1. A cultural leader should be a tolerant, democratic,patient,discreet,respectfulandgendersensitiveperson,drivenbyasenseofduty.

2. He will therefore be well groomed and dressed inaccordance with local tradition and norms, avoiddrunkennessandotherformsofunbecomingbehaviour,includingsexualimmorality.

3. A clan leader should also be scrupulously honest,generous,lawabidingandavoidanyformofcorruptionandviolence.

4. Hewillalsofollowtraditionalnormsandvaluesastohispersonalconduct;becourageousandwillingtosacrificefor others; at the same time, he will be adaptable topositivechanges,capableofcriticalthinkinganddecision-making.

c. Keyvaluesandprinciples

Aneffectiveand respectedclan leaderalsoadheres to thefollowingprinciplesandvaluesinhiswork:

1. Truth and justice: A cultural leader discharges hisresponsibilities according to the principle of truth andjustice

2. Team work, participation and involvement: A clanleader works hand in hand with his council/membersandseekstheparticipationandcooperationofallinhisdeliberations,decisionsandactions,whether from theclanorotherclans

3. Unity:Aclanleaderpromotesunity,avoidsusingreligionorpoliticstodividetheclan

4. Peace promotion and non-violence: A clan leaderpromotespeaceandrejectsallformsofviolence

5. Equityand inclusiveness:A clan leaderensuresequityand inclusiveness amongst his subjects; he does notdiscriminateagainstanyone,listenstoadviceandshowsrespecttoallwomenandmen.

6. Concern for thevulnerable:Aclan leaderhasconcernforthevulnerableandthedisadvantagedinsociety.

7. Transparencyandaccountability:Aclanleadertreasurestransparency and accountability to his people; this iswhatassureshislegitimacy.

5. Theclanleaders’charters–rolesandresponsibilities

a. Upholding and promotion of cultural norms: all ourcommunitiesaredrivenbyancestralvalues,manyofwhichneedtobeprotected,upheldandpromoted,suchasthoseofequity,honestyandunityandotherslistedabove.

b. Performance of cultural rituals and ceremonies: clanleadersareresponsibleforensuringthatculturalceremoniesand meetings are regularly and appropriately held, andmembership updated, in accordance with people’s rights.Theyarealso the repositoriesof theclan’shistoryandareresponsible for its documentation (including the recordingof its rules and regulations); they protect clan assets andheritagesites.Theyarealsoresponsibleforcondemningandtakingappropriateaction topreventanyabuseof citizens’rightsbyculturalpractitioners.

c. Conflictresolution:clanleadershaveanimportantroletoplayin building consensus,mediating and resolving communityandfamilyconflicts.ThisisdoneintotalrespectofthelawsofUganda,butfostersreconciliationwheneverpossible.Wherea conflict goesbeyond their capacity tomediateorwherethelawofthelandhasbeenbreached,clanleaderswillreferconflictstothePoliceorotherappropriateauthorities.

d. Arbitrating over land disputes: clan leaders have thisparticular responsibility, in areas of the country wherecustomarylandtenureprevails.Theyalsosupportkinsmen,help mediate between them, and interprete governmentlandlawsandcustomarylandlaws.

e. Mobilisingfordevelopment:wheredevelopmentinitiatives- fromgovernment,oracultural institutionor fromwithinthe local community - demandpeople’s participation, clanleadersmobilisethisparticipation,inaccordancewithculturalvalues,whetherintermsoflabour,financialcontributionormoralsupport.

f. Promoting peace and unity: even though many Ugandancommunities have become ethnically mixed, and oftengeographically dispersed - sometimes across the world -clanleadersshouldensurethatpeace,unityandacollectiveconsciousnessprevailatalltimesandthattheythereforetakeappropriateactiontodefuseanyconflictbeforeitbecomesviolent.Hospitalityandequity, includingwelcomingvisitorstothecommunity,willguidetheiractionsinthisrespect.

g. Socialprotection:clanleadershaveaspecialresponsibilitytoensurethatallinthecommunity,includingtheverypoorestandleastable,haveadequateaccesstofoodandshelter.

h. Liaisingwithotherinstitutions:inundertakingtheabove,clanleadersliaisewithotherauthorities,whethergovernmentalor otherwise, whether local or beyond, to ensure theireffectiveandsafeimplementation.

6. The clan leaders’ charters – aspirations, commitmentsandexpectations

1. Clan leaderswill strive to have awrittendevelopmentplan; development activities will be undertaken inpartnership with Government and other developmentactors,andcommunityworkwillbepromoted.

2. Clan leaders are especially concerned to supportvulnerableanddisadvantagedpeople;tosupportaccessto quality education for all, through bursaries wherenecessary, and to re-instate traditional communitydevelopment initiatives, such as those fostering foodsecurityandgranariesathouseholdlevel.

3. Clanleadersexpecttoenforcedisciplineinvariousways,includingcursinggrossoffenders,forinstancewithregardtoenvironmentalprotectionandfoodsecuritymeasures.They support laws against earlymarriages, defilementand those which promote girl child education. Issuesrelatedtothesaleoflandandrelateddisputesshouldbe

4. The important role played by clan leaders needs to berecognisedandsupportedbyother institutions, includingGovernment

5. ClanleadersexpecttomonitorGovernmentdevelopmentinitiativesandwillhelpwithcommunitymobilisationinthisrespect

6. Clanleadersadheringtothepresentcodeofconductwillexpectrespectfromothercitizens.

G. DIFFErEnCE BETWEEn CLAn LEADErS AnD OThErCULTUrALLEADErS

TheculturalterritoryofBusogaalsohas11chiefdoms.TheheadofthechiefdomiscalledaSazachief.TheKyabazingaisinfactoneoftheSazachiefswhoiselectedtoassumetheofficeofKyabazinga.The 11 Saza chiefs have only limited cultural authority andcontactwithlocalcitizens.Thisisbecause,whereastheclansandconsciousnessaroundtheclanisfairlystrong,thesamecannotbesaidaboutSazachiefs.Thekingdomanditsculturalleaderswereonlycreatedin1906whereasclanspredatecolonialrule.Whereas

h.OThErISSUES

1. TheclansysteminBusogaisnotethnic.TheBasogaarenotprimarilydefinedbytheirtraditionalclanship(sincetheexact clans arenot accurately known).Anypersonwhohas lived longenough inoneofthe11chiefdomscanbecomeanaturalmemberofBusogaclans’territory,irrespectiveofhis/herearlierancestry.This,accordingtoclanleaders,isprogressive.

2. AlthoughthecurrentBusogakingdomconstitutiondoesnotexplicitly state it, the clanshavebeen traditionallythemostimportantsocialbondsthroughwhichpeople‘naturally’bindthemselvesinapatrilinealsystem.Whileclanmembershipisacquiredbybirth,thecharterseeksto promote both voluntary personal participation andmembershipbybirthwhichwillbeaninitialbasisforoneto voluntarily participate in the clan affairs in order tobecomeanactualmember.

3. Currently, thereare twoviewsonhowtoorganise theBusoga clans. One view is that clans in Busoga shouldofferabaseforthosewhowanttomakedifferentkindsof clan associations. The second view is that all theBusoga clans should confederate themselves on equalterms,notundertheBusogakingdomwhichiscurrentlyledbyaconstitutionwhichmakesoneclantheprivilegedroyalAbaisengobiclan.

• In the past, elders used to instruct the community,especially men, to undergo initiation called “sapana”beforemarriage,buttodaymendonotpracticeit.Theelders also identified women for their sons and theydressed ina specialway - in leopardskin,banglesandsomefeathersonhishead.

• Afatherwoulddisciplinethechildwithoutthemotherreactingbuttodaywomentendtoprotecttheirchildrenwhen the father attempts to discipline them. Elderswere socially responsible for the youth in general. Forinstance,ifanelderapproachedshepherdswhodidnotknowhim,butwerenotcautiousordidnothideaway,theelderwouldstriketheindividualswithastickfornot

Aclanleaderissomeonefromthatparticularclan,whounderstandsthehistory,normsandvaluesofthatclanandhasbeenacceptedbytheclanmembersastheirleader.Heshouldbeamanatbirth,agedat least35years. Heshouldbeapersonofgoodconduct,cultured(“obuntu”),whohasbeenwellguidedinculturalnormsandvalues,anddisciplined.Heshouldbehardworking,withsomevisiblewealth-suchasland-andshouldbesocial,abletorelatewith other people and posses natural wisdom. He should haveself-esteem,beadecisionmakerandcapableofcriticalthinking.Heshouldbecreative,capableofempathyandpromoteasenseofunity.
