Minutes of 265 th SEAC Meeting Date 11/04/2016 The 265 th meeting of SEAC was held in Directorate of Environment, U.P. on 11/04/2016. Following members were present in the meeting along with Secretary, SEAC: 1. Dr. M. S. Khan, Chairman 2. Dr. S.N. Singh, Member 3. Dr. A. K. Singh, Member 4. Dr. D. C. Gupta, Member 5. Smt. Shruti Shukla Secretary, SEAC / Director (I/C), Environment The Chairman welcomed the members to the 265 th SEAC meeting. General Discussion: The committee discussed that the agenda framed and listed for the SEAC meetings, is based on the sector wise chronological order in continuation to the decision taken in joint meeting of SEIAA/SEAC dated 10/03/2014 and guideline issued by the SEAC in its meeting dated 16/07/2014. Moreover, the priority is also given to various projects of Government/Joint venture/PPP model based on the recommendations made by the Government from time to time, in view of their importance in public interest. Different projects of various sectors such as building construction/area development, Mining, Industrial, Infrastructural, etc. are being submitted to the SEIAA for the Environmental Clearances, where the chronological order is not differentiated sector-wise. The committee also noted that Govt. of India has sector wise committees to dispose the projects received under various sectors, whereas at SEIAA, UP, there is only one committee. Therefore, the SEAC should continue the practice of maintaining the sector wise list in chronological order and to provide the total list and the agenda list to the Chairman, SEAC by the Secretary, SEAC. The decision of the Chairman SEAC be final. The same practice should be followed for online applications also. The Members of SEAC unanimously taken following decisions on the agenda points discussed: 1. Proposed “Revamping of HPCL” Meerut Oil Installation. - Sri Satish Kumar, Sr. Instt. File No. 3196/OSD-T The committee noted that an application dated 01/06/2015 was made by the project proponent for environmental clearance of Proposed “Revamping of HPCL” Meerut Oil Installation, U.P. M/s Hindustan Petroleum Corp. Ltd. The terms of reference were prescribed in SEAC meeting dated 23/07/2015. Final EIA was submitted by the project proponent through letter dated 18/01/2016. A presentation was made by Shri Sonil Khare, Sr. Officer (Maintenance and Safety, HPCL) along with Shri A.K. Singh Sr. Manager, HPCL and their consultant M/s Mantec Consultants Pvt. Ltd., Noida. The proponent, through the documents submitted and the presentation made, informed the committee that:-

SEAC Meeting Date 11/04/2016

The 265th meeting of SEAC was held in Directorate of Environment, U.P. on

11/04/2016. Following members were present in the meeting along with Secretary, SEAC:

The Chairman welcomed the members to the 265th

SEAC meeting.

General Discussion:

The committee discussed that the agenda framed and listed for the SEAC meetings, is based

on the sector wise chronological order in continuation to the decision taken in joint meeting of

SEIAA/SEAC dated 10/03/2014 and guideline issued by the SEAC in its meeting dated 16/07/2014.

Moreover, the priority is also given to various projects of Government/Joint venture/PPP model

based on the recommendations made by the Government from time to time, in view of their

importance in public interest.

Different projects of various sectors such as building construction/area development,

Mining, Industrial, Infrastructural, etc. are being submitted to the SEIAA for the Environmental

Clearances, where the chronological order is not differentiated sector-wise. The committee also

noted that Govt. of India has sector wise committees to dispose the projects received under various

sectors, whereas at SEIAA, UP, there is only one committee. Therefore, the SEAC should continue

the practice of maintaining the sector wise list in chronological order and to provide the total list

and the agenda list to the Chairman, SEAC by the Secretary, SEAC. The decision of the Chairman

SEAC be final. The same practice should be followed for online applications also.

The Members of SEAC unanimously taken following decisions on the agenda points

discussed:

1. Proposed “Revamping of HPCL” Meerut Oil Installation. - Sri Satish Kumar, Sr. Instt.

Manager, HPCL, Meerut IRD. File No. 3196/OSD-T

The committee noted that an application dated 01/06/2015 was made by the project

proponent for environmental clearance of Proposed “Revamping of HPCL” Meerut Oil Installation,

U.P. M/s Hindustan Petroleum Corp. Ltd. The terms of reference were prescribed in SEAC meeting

dated 23/07/2015. Final EIA was submitted by the project proponent through letter dated

18/01/2016.

A presentation was made by Shri Sonil Khare, Sr. Officer (Maintenance and Safety, HPCL)

along with Shri A.K. Singh Sr. Manager, HPCL and their consultant M/s Mantec Consultants Pvt.

Ltd., Noida. The proponent, through the documents submitted and the presentation made, informed

the committee that:-

1. The environmental clearance is sought for Proposed “Revamping of HPCL” Meerut Oil

Installation, U.P. M/s Hindustan Petroleum Corp. Ltd.

2. HPCL Meerut Oil Terminal was constructed in Aug-1994 and supplying Petroleum products

to 8 districts from last 20 years.

3. HPCL is planning to augment and revamp the existing Meerut (UP) Oil terminal to meet the

increasing demand of petroleum products in the National Capital Region (NCR) and UP

west of India.

4. HPCL Meerut Terminal after augmentation and revamp shall be energy efficient,

environment- friendly and shall meet the increasing requirement of MS (Motor Sprit), HSD

(High Speed Diesel) and SKO (Superior Kerosene Oil) of 9 cities in UP west.

5. The company intends to establish storage and distribution facilities for 29625 KL petroleum

product (MS, HSD, SKO and Ethanol) at Village- Vedvyaspuri, Pootha Partapur industrial

area in Meerut district of Uttar-Pradesh.

6. HPCL Meerut terminal spread over an area of 12.54 acres, the Meerut terminal was built in

1994, next to an IOCL terminal at Partapur Industrial Area in Meerut.

7. Existing capacity of 9472 KL.

• RECEIPT: Petroleum Products are received thru Tank wagons from Tank wagon

loading locations Bahadurgarh , HMEL as per monthly distribution plan .

• STORAGE: Petroleum Products are stored in closed storage tanks ( Internal floating

Roof, fixed cone roof, Underground tanks) . All the storage tanks are connected to Tank

wagon decantation Pumps and tank trucks loading pumps through MS pipelines.

• DELIVERY: Delivery to retail outlets are done by tank trucks of capacity

12KL/18KL/20KL which are filled at Automated Tank truck loading gantry thru

centrifugal product pumps.

14. Water requirement details:

15. The project proposals are covered under category 6"b" of EIA notification, 2006, as

amended.

The committee discussed the matter and directed the project proponent to submit

following information:

1. Area details showing proposed uses as facilities area, parks, parking, roads, other services of

the project also in percentage.

2. Submit green belt plan with minimum 33% of plot area also showing the same on layout

plan. Minimum 10 m Peripheral green shall be provided. Details of landscape plan with area

calculation along with plantation of trees @ one tree for every 85.0 sq.metre of area is to be

submitted.

3. As per proponent, a separate ETP will be installed with a cost of 1.5 crore. Plan to be

submitted.

4. Provision of 100% solar lighting along the road side, stair cases, common places.

5. Use of reflecting paints on rooftops and side walls. Plan submitted.

6. Submit the schedule of EIA monitoring/data collection in the months of October-December

to the Office of Directorate of Environment, Member Secretary, UP Pollution Control Board

and District Magistrate. Submit photographs of monitoring period. Study report regarding

Ambient Air Quality to be submitted.

7. NOC from Fire Department shall be taken.

8. Total project cost is 146 Cr. Corporate Social Responsibility (CSR) plan (need based and

phase wise) along with budgetary provision amounting to 2% of project cost shall be

prepared and approved by Board of Directors of the company. A copy of resolution as above

shall be submitted to the authority along with list of beneficiaries with their mobile

nos./address.

9. The project proponent has claimed that they should be exempted from the requirement of

public hearing. Submit necessary provisions/rules/documents as per law in support to this

claim for further consideration by the committee on this point.

10. Vapour recovery system should be installed to prevent evaporational lose.

The matter shall be discussed after submission of information as above.

(Project & Dvelopment), KCFL, 301-308, Apollo Arcade, Old Palasia, Indore -

452018(M.P.) File No. 1313/OSD-T/(DD-D)

The project proponent neither appeared nor he sent any communication in this

regard. The committee discussed and deliberated that project file should be closed and should be opened only after request from the project proponent. The file shall not be treated

as pending with SEIAA/SEAC.

3. Group Housing Project "French Apartment" at Plot No-GH-07B, Sector-16B, Greater

Noida- Sri Shashank, 5th Floor, Sachdeva Corporat Tower, Plot No-17, DDA Commercial

Complex, Karkardooma, New Delhi. File No. 2797/SPO-V

The committee noted that the matter was earlier discussed in SEAC meeting dated

31/10/2015 wherein the committee deliberated as follows:

" The committee discussed the matter, during discussion Shri Sundeep Rustagi, project

proponent/representative along with their consultant M/s Ind Tech House Consult, Delhi. Informed

the committee regarding the construction has been made without achieving Environmental

clearance:

At this the committee discussed the matter and deliberated that Hon'ble NGT in its order

dated 07/07/2015 in the matter of S.P. Muthuraman V/s Union of India and Ors. (Original

Application No. 37 Of 2015 (M.A. No. 291, 293 & 294 Of 2015) and Original Application No. 213

Of 2014 (Ma 755 Of 2014 & M.A. No. 177 Of 2015) has quashed the MoEF OMs dated

12/12/2012 and 27/06/2013 related to provisions for dealing the violation matters.

In reference to Hon'ble NGT decision dated 07/07/2015 the SEIAA has already forwarded a

letter no- 638/Praya/SEIAA-3/GOI-SG/Ptra/14 dated 234-07-2015 to Ministry of Environment,

Forest & Climate change ( MoEF& CC) for providing the valuable suggestion to the SEIAA, U.P.

so that necessary action may be taken in such cases. The SEAC directed the project proponent to

stop the construction work immediately at the site. A reference in this regard should also be made to

District Administration. The SEAC deliberated that the matter shall be considered after receipt for

the information from MoEF&CC regarding Hon'ble NGT decision dated 07/07/2015.The file shall

not be treated as pending at SEIAA/SEAC."

2. The SEIAA, discussed the matter in its meeting dated 26/11/2015 and directed as follows:

" The SEIAA gone through the SEAC recommendations regarding the matter and noted that -

1. The Application has been made by the project proponent for the environmental clearance for

Expansion of Group Housing "French Apartment" at Plot No-GH-07B, Sector-16B, Greater

Noida, U.P., M/s Anthem Infrastructure Pvt. Ltd.

2. Environmental clearance for the earlier proposal was issued through SEIAA, U.P. letter no.

465/Parya/678/SEAC/2011/AAS, dated 04-06-2012 for plot area 25305 sqm, built-up area

1,02,417.37 sqm and 797 dwelling units.

3. The SEAC discussed the matter, during discussion Shri Sundeep Rustagi, representative of the

project proponent along with their consultant M/s Ind Tech House Consult, Delhi. Informed the

committee that the construction has been made without achieving Environmental clearance.

4. The SEAC discussed the matter and deliberated that Hon'ble NGT in its order dated 07/07/2015

The SEIAA noted that in reference to the SEAC meeting minutes dated 31/10/2015

regarding the title projects the project proponent has submitted a representation dated

26/11/2015.The SEIAA discussed the project proponent representation dated 26/11/2015 and

directed the SEAC to consider the same in its meeting.

The SEIAA also directed the SEAC that such cases in which construction has been done

without obtaining the Environmental clearance, i.e. in which the violation of E P Act, 1986 has

been made may be considered in light of Hon’ble Supreme Court Decision dated 14/9/2015 in

Civil Appeal No(s).6896/2015, M/s VIVEKANAND ASHRAM SOCITY & ANOTHER Vs KRISHAN LAL

GERA & OTHERS."

The committee discussed the matter and representation dated 26/11/2015 of project

proponent and directed the project proponent to submit following information:

1. It is case of revised E.C. as the details of presentation shows that the tower no A to J were

initially proposed 14 floor and in every tower, construction has started as well as done

which carries from maximum 12 to minimum 03 floors. Where as in revised proposal as

submitted, it is 19 Floor it means adding +05 floors in each towers except no construction in

tower K and L. The proponent should submit Proof of date of start of construction i.e. copy

of mandatory communication to be made to development authority in this regard alongwith

photographs. 2. Submit structural stability certificate with sign of architect and vetted by competent

agency/institute, regarding expansion proposal. 3. Comparative statement of area with tower wise and floor wise details alongwith no. of units.

4. Comparative statement regarding various uses like population, area, water uses and management, solid waste and management, power uses and backup, parking etc. should be

submitted. 5. Details of green area also on layout plan.

6. Copy of approved layout plan/maps/services plans.

7. Provision of Parking is to be made as per building bye laws only. Rest of the parking to be

deleted from parking plan.

8. Revised NOCs from Fire and AAI are to be submitted.

The committee discussed that it appeared to be a case of violation as additional floors five

no are proposed to be added. So Proponent is directed to stop the construction till EC is issued and

submit the information as above. The matter shall be discussed after submission of information as

above.

4. Group Housing Project at Plot No-A-01/A, Sector-124, Noida. Sri S J Raza, Flat No-G-25,

Bloc-C, Gaur Global Village, Crossing Republic, Ghaziabad. . File No. 3615/DD-Sh.

The committee noted that an application dated 08/02/2016 was made by the project

proponent for environmental clearance of Group Housing Project at Plot No-A-01/A, Sector-124,

Noida, U.P. M/s ATS Heights Pvt. Ltd.

A presentation was made by Shri Varun Juneja, authorized representative of project

proponent along with their consultant M/s J M Enviro Net Pvt. Ltd. The proponent, through the

documents submitted and the presentation made, informed the committee that:-

10. Provision of 100% solar lighting along the road site, stair cases, common places.

11. Plan for EWS / LIG housing provision as per Development Authority bye-laws.

12. Examine in detail the proposed site with reference to impact on infrastructure covering

water supply, storm water drainage, sewerage, power, etc., and the disposal of treated/raw

wastes from the complex on land/water body and into sewerage system. Consider soil

characteristics and permeability for rainwater harvesting proposals, should be made to

prevent ground water contamination. Maximize use of treated water by recycling and

utilization of rainwater.

13. Water requirement and water management plan along with necessary permissions for

discharge.

14. An underground Pucca tank for collection/reuse of rain water may be constructed.

15. Hydro-geological investigations be carried out and obtain permission from Central Ground

Water Authority for withdrawal of ground water.

16. Make provision for safety against failure in the operation of wastewater treatment facilities.

Identify acceptable outfall for treated effluent.

17. Details of green belt as a measure for mitigation of dust and noise and buffer between

habitation and proposed project.

18. Landscape plan, green belts and open spaces may be described separately.

19. Study the existing flora and fauna of the area and the impact of the project on them. There

should be no basement below 15 m setback. Accordingly Plan should be revised and

submitted.

20. Section of all internal roads should be provided. Right of way and carriage way width

should be clearly marked on the map. Avoid entry/exit at point of junction of roads. Traffic

movement plan in and out should be shown.

21. Examine existing crèche, education, health facilities, police, post Office, Banks and other

services and make adequate provisions in the proposal.

22. Assess soil erosion in view of the soil characteristics, topography and rainfall pattern.

23. Application of renewable energy/alternate energy, such as solar and wind energy may be

described including solar water heating in the guidelines for entrepreneurs.

24. Consider solid wastes, including e-waste in addition to other solid wastes and their disposal.

25. Identification of recyclable wastes and waste utilization arrangements may be made.

26. Explore possibility of generating biogas from biodegradable wastes.

27. Arrangements for hazardous waste management may be described as also the common

facilities for waste collection, treatment, recycling and disposal of all effluent, emission and

refuse including MSW, biomedical and hazardous wastes. Special attention should be made

with respect to bird menace.

28. Provisions made for safety in storage of materials, products and wastes may be described.

29. Disaster management plan should be prepared.

30. Traffic management plan including parking and loading/unloading areas may be described.

Traffic survey should be carried out both on weekdays and weekend.

31. Parking provision is to be made for higher ECS worked out either as per state bye-laws or

construction manual of the MoEF. Additional parking more than required nos. as per norms

will not be permitted.

32. Exclusive Parking area in the basement (excluding other facilities) and surface is to be

clearly mentioned.

33. Provide service road for entry and exit to project site.

34. Use of local building materials should be described.

35. Consider provision of DG Flue Gas emissions to be treated in a scrubber. Stack details with

provisos of sampling port for monitoring be described. Power backup should be restricted to

50-60 % of power requirement. Plan should be revised and submitted.

36. Work out MGLC for the combined capacity of DG sets.

37. Provide for conservation of resources, energy efficiency and use of renewable sources of

energy in the light of ECBC code.

38. Application of resettlement and rehabilitation policy may be described. Project affected

persons should be identified and rehabilitation and resettlement plan should be prepared.

39. Examine separately the details for construction and operation phases both for Environmental

Management Plan and Environmental Monitoring Plan.

40. Corporate Social Responsibility (CSR) plan along with budgetary provision amounting to

2% of project cost shall be prepared and approved by Board of Directors of the company. A

copy of resolution as above shall be submitted to the authority along with list of

beneficiaries with their mobile nos./address.

41. Required no of trees should be proposed @ 01 tree/80 sqm, submit plan.

42. Project falling with in 10 Km. area of Wild Life Sanctuary is to obtain a clearance from

National Board Wild Life (NBWL) even if the eco- sensitive zone is not earmarked.

43. Declare/submit the running cost of STP and other environmental management services (e.g.,

Municipal Solid Waste Disposal, Green belt Maintenance, Water Management etc.) in the

proposals which are to be including in the allotment letters. Vendors should be identified for

Municipal Solid Waste Management and submitted.

44. The proponent will submit the schedule of monitoring/data collection programme to the

Office of Directorate, Member Secretary, UP Pollution Control Board and District

Magistrate of related District.

General Guidelines:

a. A legal affidavit by the Project proponent on Rs. 100/- non-judicial Stamp Paper, duly

attested by Public Notary, stating that:

I. “There is no litigation pending against the project and/or land in which the project is

proposed to be set up (please give name & ownership etc. of the project) and that for any

such litigation what so ever, the sole responsibility will be borne by the Project

proponent.”

II. “No activity relating to this project (i.e. name of the project) including civil construction

has been undertaken at site except fencing of the site to protect it from getting

encroached and construction of temporary shed(s) for the guard(s). (if fencing has not

been done, then the same may be deleted).

III. “I/We hereby give undertaking that the data and information given in the application,

enclosures and other documents are true to the best of my knowledge and belief and

I/We am/are aware that if any part of the data and information submitted is found to be

false or misleading at any stage, the project will be rejected and clearance given, if any

to the Project will be revoked at our risk and cost.”

IV. Project does not fall under any buffer zone of no-development as declared /identified

under any law.

b. Another legal affidavit by the consultant stating “(a) that the prescribed TORs have been

complied with (to be deleted if not applicable) & (b) that details and the data presented are

factually correct”, as per MoEF circular dated 04.08.2009 is also to be submitted along with

EIA.

c. Current, site photographs viewing towards the project area from four directions indicating

date of photograph taken, direction from which taken, name of the project, and signature of

Project proponent along with consultant with seal should be submitted, so as to ensure that

no construction has been started before the grant of EC.

d. EIA should strictly follow the guidelines prescribed in annexure-III to the EIA notification

of 2006 and the Methods of Monitoring and analysis (Annexure-IV): Guidance for

assessment of representativeness and reliability of baseline environmental attributes detailed

under EIA manual January, 2001 and other guidelines in the matter.

e. The status of accreditation of the EIA consultant with NABET/QCI shall be specifically

mentioned. The consultant shall certify that his accreditation is for the sector for which this

EIA is prepared.

f. On the front page of EIA/EMP reports, the name of the consultant/consultancy firm along

with their complete details including their accreditation, if any shall be indicated.

g. While submitting the EIA/EMP reports, the name of the experts associated with/involved in

the preparation of these reports and the Name of laboratory through which the samples have

been got analysed should be stated in the report. It shall clearly be indicated whether said

laboratory is accredited by NABL or approved under the Environment (Protection) Act,

1986 (Please refer MoEF office memorandum dated 4th August, 2009). The name project

leader of the EIA study shall also be mentioned.

h. The EIA document shall be printed on both sides, as for as possible.

The Information’s no (a I , II, III & c) asked under the general guidelines is to be

submitted within 15 days from the date of receipt of the letter and remaining of the

information’s is to be submitted along with the EIA.

5. Expansion of Group Housing Project “Sunworld Arista” at Plot No-GH-01/C, Sector-168,

Noida. Sri Anoop Negi, AGM, A-4, Sector-4, Noida. . File No. 3618/AD-Sub.

The committee noted that an application dated 04/02/2016 was made by the project

proponent for environmental clearance of Expansion of Group Housing Project “Sunworld Arista”

at Plot No-GH-01/C, Sector-168, Noida, U.P. M/s Sunworld Residency Pvt. Ltd.

A presentation was made by Shri Anoop Nagi, authorized representative of project

proponent along with their consultant M/s Ind Tech House Consult, Delhi. The proponent, through

the documents submitted and the presentation made, informed the committee that:-

1. The environmental clearance is sought for Expansion of Group Housing Project “Sunworld

Arista” at Plot No-GH-01/C, Sector-168, Noida, U.P. M/s Sunworld Residency Pvt. Ltd.

The committee discussed the matter and observed that as per project report submitted

Construction has started in tower no T1,T2,T3,T4 on 10/02/2016. The tower no T5 2B+G + 26 is

additional 7 no of floors are being added to be proposed to 33 floors. The tower no T-7 and T-8 is

initially was proposed for 17 floors which is revised for 25 floors adding 8 floor extra. Where as the

Tower no 9 is adding from 17 to 31 floors and Tower no 19 adding from 20 to 31 floors. On the

basis of factual status the proponent has to submit Comparative statement showing no of Towers

with no of floors for which EC was issued with date of approval from Competent Authority along

with Structural Design Signed and Vetted by Structural Engineer and Revised approval of map with

additional floors and revised Structural Design with date of Construction started along with

photographs and letter submitted to the Authority for work started. Revised NOC to be submitted

from Fire and Air Port Authority as required. Revised Comparative area statement of existing and

proposed plan to be also submitted.

The committee discussed that it appeared to be a case of violation as additional floors are proposed to be added. So Proponent is directed to stop the construction till EC is issued and submit

information as above. The matter shall be discussed after submission of information as above.

The committee noted that an application dated 16/02/2016 was made by the project

proponent for environmental clearance of Group Housing Project at GH-03C, Sector-144, Noida,

under category 8"a" hence TORs are not to be issued. The committee directed to take up the case

Requirement of HVAC cooling water as per calculation is 135 KLD. However, this is one time requirement. Make

up water required for HVAC Cooling is 34 KLD (11 KLD considering 5% evaporation losses + 23 KLD blow down

considering cycle of concentration (COC) equal to 6)

9. The project proposals are covered under category 8"b" of EIA Notification, 2006, as

amended.

The committee discussed the matter and noted that land, on which expansion of the project is proposed, is not under possession of the project proponent. The committee directed that land

documents should be submitted for further discussion of the matter. The matter should be deferred and should be listed after submission of land documents for issuance of TOR.

8. Expansion of Group Housing Project “Cherry County” at Plot No.GH-5B, Tech Zone-IV,

The committee noted that an application dated 22/02/2016 was made by the project

proponent for environmental clearance of Expansion of Group Housing Project “Cherry County” at

Plot No.GH-5B, Tech Zone-IV, Greater Noida, U.P. M/s County Infrastructure Pvt. Ltd.

A presentation was made by Shri M.K. Vimal, authorized representative of project

proponent along with their consultant M/s Grass Roots Research & Creation India (P) Ltd. The

proponent, through the documents submitted and the presentation made, informed the committee

guidelines for conducting EIA studies:

Additional TORs:

1. Any additional FAR granted by development authority due to green building proposal shall

be applicable only for expansion and not for the earlier proposal. .

2. Proof of date of start of construction i.e. copy of mandatory communication to be made to

development authority in this regard.

3. Specific area statements regarding proposed expansion.

4. Comparative area and other environmental parameter statements showing values earlier and

proposed as expansion.

5. All approved revised drawings/maps alongwith all approved revised services plans. All

original maps should be shown during EIA presentation.

6. Structural design certificate signed by architect and vetting authority for already existing

structure should be submitted. All structural design drawings should be signed by architect

and counter signed by vetting authority.

27. All service plans like sewer drainage water supply rain water harvesting fire fighting

landscape plan is to be submitted.

28. Section of all internal roads as proposed along R/W and C /W as well dimension is to be

to map.

29. Examine in detail the proposed site with reference to impact on infrastructure covering

water supply, storm water drainage, sewerage, power, etc., and the disposal of treated/raw

wastes from the complex on land/water body and into sewerage system.

30. Water requirement and water management plan alongwith necessary permissions for

discharge. STP details.

31. Hydro-geological investigations be carried out and obtain permission from Central Ground

Water Authority for withdrawal of ground water.

32. Consider soil characteristics and permeability for rainwater harvesting proposals, should be

made to prevent ground water contamination. Maximize use of treated water by recycling

and utilization of rainwater.

33. Make provision for safety against failure in the operation of wastewater treatment facilities.

Identify acceptable outfall for treated effluent.

34. Details of green belt as a measure for mitigation of dust and noise and buffer between

habitation and proposed project.

35. Landscape plan, green belts and open spaces may be described separately.

36. Study the existing flora and fauna of the area and the impact of the project on them.

37. Examine existing crèche, education, health facilities, police, post Office, Banks and other

services and make adequate provisions in the proposal.

38. Assess soil erosion in view of the soil characteristics, topography and rainfall pattern.

39. Application of renewable energy/alternate energy, such as solar and wind energy may be

described including solar water heating in the guidelines for entrepreneurs.

40. Consider solid wastes, including e-waste in addition to other solid wastes and their disposal.

41. Identification of recyclable wastes and waste utilization arrangements may be made.

42. Explore possibility of generating biogas from biodegradable wastes.

43. Arrangements for hazardous waste management may be described as also the common

facilities for waste collection, treatment, recycling and disposal of all effluent, emission and

refuse including MSW, biomedical and hazardous wastes. Special attention should be made

with respect to bird menace.

44. All community facilities is to be proposed as per norms and is to be submitted.

45. Provisions made for safety in storage of materials, products and wastes may be described.

46. Disaster management plan should be prepared.

47. Traffic management plan including parking and loading/unloading areas may be described.

Traffic survey should be carried out both on weekdays and weekend.

48. Parking provision is to be made for higher ECS worked out either as per state bye-laws or

construction manual of the MoEF.

49. Exclusive Parking area in the basement (excluding other facilities) and surface is to be

clearly mentioned.

50. Provide service road for entry and exit to project site.

51. Use of local building materials should be described.

52. Consider provision of DG Flue Gas emissions to be treated in a scrubber. Stack details with

provisos of sampling port for monitoring be described.

53. Work out MGLC for the combined capacity of DG sets.

54. Provide for conservation of resources, energy efficiency and use of renewable sources of

energy in the light of ECBC code.

55. Application of resettlement and rehabilitation policy may be described. Project affected

persons should be identified and rehabilitation and resettlement plan should be prepared.

56. Examine separately the details for construction and operation phases both for Environmental Management Plan and Environmental Monitoring Plan.

57. Corporate Social Responsibility (CSR) plan along with budgetary provision amounting to 2% of project cost shall be prepared and approved by Board of Directors of the company. A

copy of resolution as above shall be submitted to the authority alongwith list of beneficiaries with their mobile nos./address.

58. Details of all internal and peripheral roads width. 59. Source and quantity of required water during construction and management of generated

waste water.

60. Project falling with in 10 Km. area of Wild Life Sanctuary is to obtain a clearance from

National Board Wild Life (NBWL) even if the eco- sensitive zone is not earmarked.

61. Declare/submit the running cost of STP and other environmental management services (e.g.,

Municipal Solid Waste Disposal, Green belt Maintenance, Water Management etc.) in the

proposals which are to be including in the allotment letters.

62. The proponent will submit the schedule of monitoring/data collection programme to the

Office of Directorate, Member Secretary, UP Pollution Control Board and District

Magistrate of related District.

General Guidelines:

a. A legal affidavit by the Project proponent on Rs. 100/- non-judicial Stamp Paper, duly attested

by Public Notary, stating that:

I. “There is no litigation pending against the project and/or land in which the project is

proposed to be set up (please give name & ownership etc. of the project) and that for any

such litigation what so ever, the sole responsibility will be borne by the Project proponent.”

II. “No activity relating to this project (i.e. name of the project) including civil construction

has been undertaken at site except fencing of the site to protect it from getting encroached

and construction of temporary shed(s) for the guard(s). (if fencing has not been done, then

the same may be deleted).

III. “I/We hereby give undertaking that the data and information given in the application, enclosures and other documents are true to the best of my knowledge and belief and I/We

am/are aware that if any part of the data and information submitted is found to be false or misleading at any stage, the project will be rejected and clearance given, if any to the

Project will be revoked at our risk and cost.” IV. Project does not fall under any buffer zone of no-development as declared /identified under any

law.

b. Another legal affidavit by the consultant stating “(a) that the prescribed TORs have been

complied with (to be deleted if not applicable) & (b) that details and the data presented are

factually correct”, as per MoEF circular dated 04.08.2009 is also to be submitted along with

EIA.

c. Current, site photographs viewing towards the project area from four directions indicating date

of photograph taken, direction from which taken, name of the project, and signature of Project

proponent along with consultant with seal should be submitted, so as to ensure that no

construction has been started before the grant of EC. d. EIA should strictly follow the guidelines prescribed in annexure-III to the EIA notification of

2006 and the Methods of Monitoring and analysis (Annexure-IV): Guidance for assessment of representativeness and reliability of baseline environmental attributes detailed under EIA

manual January, 2001 and other guidelines in the matter. e. The status of accreditation of the EIA consultant with NABET/QCI shall be specifically

mentioned. The consultant shall certify that his accreditation is for the sector for which this EIA is prepared.

f. On the front page of EIA/EMP reports, the name of the consultant/consultancy firm along with their complete details including their accreditation, if any shall be indicated.

g. While submitting the EIA/EMP reports, the name of the experts associated with/involved in

the preparation of these reports and the Name of laboratory through which the samples have

been got analysed should be stated in the report. It shall clearly be indicated whether said

laboratory is accredited by NABL or approved under the Environment (Protection) Act, 1986

(Please refer MoEF office memorandum dated 4th August, 2009). The name project leader of

the EIA study shall also be mentioned.

h. The EIA document shall be printed on both sides, as for as possible.

The Information’s no (a I , II, III & c) asked under the general guidelines is to be submitted

within 15 days from the date of receipt of the letter and remaining of the information’s is to be

submitted along with the EIA.

The project proponent informed that base line data for the month of March to May, 2015 of

a proposal for which E.C. has already been granted (VVIP Homes, Plot no. GC 03K/GH 03, Sector-

16C, Noida Extension, Greater Noida, M/s Solitaire Infrahome Pvt. Ltd.) has been considered by

the project proponent as no monitoring can be done in monsoon period and have requested to

consider the same baseline study for present project. The committee discussed and directed that

baseline data for one additional month should be undertaken alongwith the data as proposed by

project proponent.

12. The project proposals are covered under category 8"a" of EIA Notification, 2006, as

amended.

The committee discussed the matter and recommended grant of environmental clearance on

the project proposals alongwith general conditions as earlier prescribed by the authority for

construction project and following specific conditions:

A. Construction Phase: 1. "Consent to establish" shall be obtained from UP Pollution Control Board under Air

(Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974.

2. All required sanitary and hygienic measures should be in place before starting construction activities and to be maintained through out t h e construction phase.

3. A first aid room will be provided in the project both during construction and operation phase of the project.

4. All the topsoil excavated during construction activities should be stored for use in horticulture landscape development within the project site.

5. Disposal of muck during construction phase should not create any adverse effect on the neighboring communities and be disposed off after taking the necessary precautions for general safety and health aspects of people with the approval of competent authority.

6. Construction spoils, including bituminous material and other hazardous material, must not be allowed to contaminate watercourses and the dump sites for such material must be secured, so that they should not leach into the ground water.

7. The diesel generator sets to be used during construction phase should be of low sulphur diesel type and should conform to the provisions of Environment (Protection) Act, 1986 prescribed for air and noise emission standards.

8. Vehicles hired for bringing construction material to the site and other machinery to be used during construction should be in good condition and should conform to applicable air and noise emission standards.

9. Ambient nois levels should conform to prescribed standards both during day and night. Incremental pollution loads on the ambient air and noise quality should be closely monitored during construction phase.

10. Fly ash should be used as construction material in the construction as per the provisions of Fly Ash Notification of September, 1999 and as amended on August, 2003 (This condition is applicable only if the project is within 100 Km of Thermal Power Station).

11. Ready mixed concrete should be used in building construction as far as possible.

12. Water demand during construction should be reduced by use of premixed concrete, curing

agents and other best practices.

13. Separation of drinking water supply and treated sewage supply should be done by the use of different colours.

14. Fixtures for showers, toilet flushing and drinking should be of low flow either by use of aerators or pressure reducing devices or sensor based control.

15. Adequate steps shall be taken to conserve energy by limiting the use of glass, provision of proper thermal insulation and taking measures as prescribed under the Energy Conservation Building Code.

16. The approval of competent authority shall be obtained for structural safety of the buildings due to earthquakes, adequacy of fire fighting equipments etc. as per National Building Code including protection measures from lightning.

17. Provision shall be made for the housing of construction labour within the site with all necessary infrastructure and facilities such as fuel for cooking, mobile toilets, mobile STP, disposal of waste water & solid waste in an environmentally sound manner, safe drinking water, medical health care, creche etc. The housing may be in the form of temporary structures to be removed after the completion of the project.

B. Operation Phase:

1. Parking is to be provided as per building bye laws and no additional parking will be

permitted. Rest to be deleted from parking plan. 2. The installation of sewage treatment plant (STP) and adequacy of disposal system should

be certified by UP Pollution Control Board. The discharge of treated sewage shall conform to the norms and standards prescribed by UP Pollution Control Board for such discharges. Necessary permissions shall be taken for any discharge outside the premises.

3. The project proponent shall provide electromagnetic flow meter at the outlet of the water supply, outlet of the STP and any pipeline to be used for re-using the treated wastewater back into the system for flushing I HVAC and for horticulture purpose etc. and shall maintain a record of readings of each such meter on daily basis.

4. Adequate & appropriate pollution control measures should be provided to control fugitive emissions to be emitted within the commercial complex.

5. Adequate treatment facility for drinking water shall be provided, if required. 6. Rainwater harvesting for roof run-off should be implemented. Before recharging the roof

run-off, pretreatment must be done to remove suspended matter, oil and grease. However, no run off from gardens/green area/roads/pavements shall be connected with the ground water recharging system.

7. The solid waste generated should be properly collected and segregated. The recyclable solid waste shall be sold out to the authorized vendors and inerts shall be sent to disposal facility. The Bio-degradable solid waste shall be adequately treated as per the scheme submitted by the project proponent. Prior approval of competent authority should be obtained, if required.

8. Hazardous waste/E-waste should be disposed off as per Rules applicable and with the necessary approval of the UP Pollution Control Board.

9. The green belt design along the periphery of the plot shall achieve attenuation factor conforming to the day and night noise standards prescribed for residential land use. The open spaces inside the plot should be suitably landscaped and covered with vegetation of indigenous species/ variety.

10. The project proponent should take adequate and appropriate measures to contain the ambient air quality within the prescribed standards.

11. Incremental pollution loads on the ambient air quality, noise and water quality should be periodically monitored after commissioning of the project.

12. Application of solar energy should be incorporated for illumination of common areas, lighting for gardens and street lighting in addition to provision for solar water heating.

13. Traffic congestion near the entry and exit points from the roads adjoining the

proposed project site must be avoided. Parking should be fully internalized and no public space should be utilized.

14. Total cost of the project is Rs. 190 Cr. Corporate Social Responsibility (CSR) plan along with budgetary provision amounting to Rs. 3.80 Cr. shall be prepared and approved by Board of Directors of the company. A copy of resolution as above shall be submitted to the authority alongwith list of beneficiaries with their mobile nos./address.

15. Environment Management Cell shall be formed during operation phase which will supervise and monitor the environment related aspects of the project.

13. Proposed Samajwadi Awas Yojna at Sector-118, Noida- Sri H N Singh, Project Engineer,

3. Road width should be shown on maps.

4. Structural design certificate signed by structural engineer and vetting authority should be

submitted. All structural design drawings should be signed by structural engineer and counter

signed by vetting authority.

5. Copy of layout plan/maps/services plans as approved by competent Development Authority.

6. Municipal solid waste management plan alongwith list of identified vendors. Solid Waste will be collected from Municipal Authority. It is to be given in writing and affidavit to be

submitted in this regard. 7. Provision of dual plumbing system should be provided. Plan submitted.

8. At least 30% of total water requirement shall be met from treated water. Plan to be submitted. 9. Required no. of trees should be proposed @ 01 tree/80 sqm, submit plan.

10. Provision of 100% solar lighting along the road side, stair cases, common places. 11. Proposal for rain water harvesting only from the rooftop. Plan for water body with Kachha

base should be submitted for storm water utilization for water recharge.

12. Parking and green area should be specifically mentioned on layout plan. Parking standards for

LIG/EWS for two wheeler should also be provided. Section of all internal roads should be

provided. Right of way and carriage way width should be clearly marked on the map.

13. Dual plumbing System is to be proposed. Plan should be submitted.

14. Total cost of the project is 96 Cr. Corporate Social Responsibility (CSR) plan along with

budgetary provision amounting to Rs. 1.92 Cr. shall be prepared and approved by Board of

Directors of the company. A copy of resolution as above shall be submitted to the authority

alongwith list of beneficiaries with their mobile nos./address.

15. The proponent submitted that it is a Govt. Project as such the works under CSR as being

executed by the Authority its detail to be submitted for record for EWS and LIG projects.

16. All Community facilities and infrastructure services are to be provided as per proposed

population of the project area. 17. A provision for door to door collection of wastes has to be made. Plan should be submitted.

2. The deposit work for above mentioned project is awarded to Unit-28, Construction &

Design Services, U.P. Jal Nigam (A U.P. Government Undertaking) by the Uttar Pradesh

Shashan, Lucknow in the Judgeship of Chairman Infrastructure Committee, Honable High

Court, Allahabad in the year 2012.

3. Previously, the project was proposed for the built-up area 18,107.93m2 and this office

obtained the NOC for “Consent to Establishment” from State Pollution Control Board to

start the construction at the site and subsequently we started the construction. But Later the

area of each floor is revised from 985.35m2 to 1145.90 m2 by U.P. Govt. So the total proposed built-up area for the project gets changed to 20,817.77 m2

4. It has been brought to our notice that when the built-up area of the project is > 20,000 sq. mtrs. it comes under the purview of EIA Notification 2006 of schedule 8(a), Category B.

12. The project proposals are covered under category 8"a" of EIA Notification, 2006, as

amended.

The committee discussed the matter and directed to submit following information:

1. Comparative details of the project as earlier with builtup area 18,107.93 sqm and revised

proposal with builtup area 20817.77 sqm alongiwth present status of construction.

2. Setback details as per building bye-laws.

3. Location of proposed site as per master plan should be submitted.

4. Copy of approved layout plan/maps/services plans. 5. Physical features within 30 m of the project site with their ownership.

6. Details about approach roads to proposed site. Internal roads layout alongwith width of the road, within the project. Section of all internal roads should be provided. Right of way and

carriage way width should be clearly marked on the map. Vehicular movement/circulation plan. Revised parking plan as per bye-laws. It is also to be ensured that the width of the

proposed road as to be admissible as per building bye laws specially 4.5 metre wide road bye laws to be submitted.

7. Area statement with tower wise and floor wise details alongwith no. of units also in

percentage. Details of all block with dimensions set back and area chart details are to be

submitted.

9. Structural design certificate signed by structural engineer and vetting authority should be

submitted. All structural design drawings should be signed by structural engineer and

counter signed by vetting authority.

9. The project proposals are covered under category 8"a" of EIA Notification, 2006, as

amended. The committee discussed the matter and directed the project proponent to submit following

information 1. Letter of approval of FAR.

2. Site photographs to be submitted to proof that no construction work has started at the project site.

3. The details of all community facilities and services are to be proposed as per population projection.

4. Details of area statement showing as per proposed land uses and their percentage wise

distribution. Calculation of green areas along with land scape plan is to be submitted.

5. Minimum 03 m wide peripheral green should be provided. Submit plan.

6. Section of all internal roads should be provided. Right of way and carriage way width

should be clearly marked on the map.

7. Revised layout plan as per building bye-laws should be submitted.

8. Green area and landscape plan should be clearly indicated on layout. Calculation in this

regard should also be submitted. Landscape plan with park furniture to be submitted along

with list of ornamental trees.

9. Structural design certificate signed by structural engineer and vetting authority should be

submitted. All structural design drawings should be signed by structural engineer and

counter signed by vetting authority.

10. The parking plan for only 657 cars will be permissible. Rest will have to be deleted from parking plan. Revised plan should be submitted.

11. Permission from Central Ground Water Board should be obtained for drilling of bore well for Drinking water.

12. Basement area as proposed 17355.0 sqm will have to be reduced may be up to 15000 Sqm. Plan to be submitted.

13. Dual plumbing system is to be proposed and submitted. Modular STP is to be provided with a capacity as per norms and requirements. Plan should be submitted.

14. 100% Solar Energy is to be provided on all roads and common places .At least 15% of solar

energy of total power requirement is to be proposed.

15. Use of reflecting paints on roof top and side walls to be submitted..

16. NOC from Fire and AAI.

17. All maps and layout plan as presented and submitted is not clearly visible so all revised

visible maps to be submitted which should be well presentable.

18. Total cost of the project is Rs. 244.25 Cr. Corporate Social Responsibility (CSR) plan along

with budgetary provision amounting to Rs. 4.88 Cr. shall be prepared and approved by

Board of Directors of the company. A copy of resolution as above shall be submitted to the

authority alongwith list of beneficiaries with their mobile nos./address. The proponent

submitted that it is a Govt. Projects. The Committee asked the proponent to submit the CSR

plan as being executed by the Authority in various sectors like LIG and EWS housing and

for informal sectors projects being executed by the Authority.

8. The project proposals are covered under category 8"b" of EIA Notification, 2006, as

amended.

The committee discussed the matter and recommended following TORs and general

guidelines for conducting EIA studies regarding the proposals:

Additional TORs :

1. Master plan of the area showing proposed project. Permissible uses of the proposed site as

per zoning regulation.

2. Submit DPR of the project as prepared with cost details.

3. Approval and recommendations for issuing EC will be only for Plotted development under

Zonal Development plan. The projects like Group Housings, Institutional and Commercial

etc. will have to apply for Environmental Clearance separately under the provisions of

MoEF guidelines.

4. Details of activities/facilities for which environmental clearance is proposed.

5. Allotment letter from concerned development authority.

6. All approved drawings/maps alongwith all services plans as approved by Development

Authority.

7. All services plan like Water Supply, Drainage, Sewerage, Electrification with transformer or

Substation Landscape plan with list of Ornamental trees, Rain water Harvesting, provision

of 100% Solar Energy, all roads and Common places etc.

8. The green converge will have to be left in High Tension lines passing through the Project

area as per provision in the State Electricity rules and bye laws.

9. Structural design certificate signed by architect and vetting authority should be submitted.

All structural design drawings should be signed by architect and counter signed by vetting

authority.

10. Area details showing proposed uses as residential, commercial, parks, parking, roads, other

services, facilities of the project also in percentage.

11. All community facilities and infrastructures are to be proposed as per projected population

of the area, which is about 1.25 lakhs for the proposed Zonal plan.

12. Green area is to be provided at least 22% at Zonal Plan level and in other project as per building bye

laws and use of the project as to be proposed.

13. Physical features within 30 m of the project sites with their ownership.

14. Complete Details of facilities to be developed by the project proponent i.e. for which

environment clearance is sought.

15. Provision of a water body and water supply from the housing board instead of the tube wells

should be made.

16. Use of reflecting paints on roof top and side walls.

17. Details of rain water harvesting are to be given.

18. Provision of 100% solar lighting along the road site, stair cases, common places.

19. Plan for EWS/LIG housing provision as per Development Authority bye-laws.

20. All existing villages in the project area to be developed.

21. Examine in detail the proposed site with reference to impact on infrastructure covering

water supply, storm water drainage, sewerage, power, etc., and the disposal of treated/raw

wastes from the complex on land/water body and into sewerage system. Consider soil

characteristics and permeability for rainwater harvesting proposals, should be made to

prevent ground water contamination. Maximize use of treated water by recycling and

utilization of rainwater.

22. Water requirement and water management plan along with necessary permissions for

discharge.

23. An underground Pucca tank for collection/reuse of rain water may be constructed.

24. Hydro-geological investigations be carried out and obtain permission from Central Ground

Water Authority for withdrawal of ground water.

25. Make provision for safety against failure in the operation of wastewater treatment facilities.

Identify acceptable outfall for treated effluent.

26. Details of green belt as a measure for mitigation of dust and noise and buffer between

habitation and proposed project.

27. Landscape plan, green belts and open spaces may be described separately.

28. Study the existing flora and fauna of the area and the impact of the project on them.

29. Section of all internal roads should be provided. Right of way and carriage way width

should be clearly marked on the map. Avoid entry/exit at point of junction of roads. Traffic

movement plan in and out should be shown.

30. Examine existing crèche, education, health facilities, police, post Office, Banks and other

services and make adequate provisions in the proposal.

31. Assess soil erosion in view of the soil characteristics, topography and rainfall pattern.

32. Application of renewable energy/alternate energy, such as solar and wind energy may be

described including solar water heating in the guidelines for entrepreneurs.

33. Consider solid wastes, including e-waste in addition to other solid wastes and their disposal.

34. Identification of recyclable wastes and waste utilization arrangements may be made.

35. Explore possibility of generating biogas from biodegradable wastes.

36. Arrangements for hazardous waste management may be described as also the common

facilities for waste collection, treatment, recycling and disposal of all effluent, emission and

refuse including MSW, biomedical and hazardous wastes. Special attention should be made

with respect to bird menace.

37. Provisions made for safety in storage of materials, products and wastes may be described.

38. Disaster management plan should be prepared.

39. Traffic management plan including parking and loading/unloading areas may be described.

Traffic survey should be carried out both on weekdays and weekend.

40. Parking provision is to be made for higher ECS worked out either as per state bye-laws or

construction manual of the MoEF. Additional parking more than required nos. as per norms

will not be permitted.

41. Exclusive Parking area in the basement (excluding other facilities) and surface is to be

clearly mentioned.

42. Provide service road for entry and exit to project site.

43. Use of local building materials should be described.

44. Consider provision of DG Flue Gas emissions to be treated in a scrubber. Stack details with

provisos of sampling port for monitoring be described. Power backup should be restricted to

50-60 % of power requirement.

45. Work out MGLC for the combined capacity of DG sets.

46. Provide for conservation of resources, energy efficiency and use of renewable sources of

energy in the light of ECBC code.

47. Application of resettlement and rehabilitation policy may be described. Project affected

persons should be identified and rehabilitation and resettlement plan should be prepared.

48. Examine separately the details for construction and operation phases both for Environmental

Management Plan and Environmental Monitoring Plan.

49. Corporate Social Responsibility (CSR) plan along with budgetary provision amounting to

2% of project cost shall be prepared and approved by Board of Directors of the company. A

copy of resolution as above shall be submitted to the authority along with list of

beneficiaries with their mobile nos./address.

50. Required no of trees should be proposed @ 01 tree/80 sqm, submit plan.

51. Project falling with in 10 Km. area of Wild Life Sanctuary is to obtain a clearance from

National Board Wild Life (NBWL) even if the eco- sensitive zone is not earmarked.

52. Declare/submit the running cost of STP and other environmental management services (e.g.,

Municipal Solid Waste Disposal, Green belt Maintenance, Water Management etc.) in the

proposals which are to be including in the allotment letters. Vendors should be identified for

Municipal Solid Waste Management and submitted.

53. The base line data to be studied for 15th April to 15th July. The proponent will submit the

schedule of monitoring/data collection programme to the Office of Directorate, Member

Secretary, UP Pollution Control Board and District Magistrate of related District.

General Guidelines:

a. A legal affidavit by the Project proponent on Rs. 100/- non-judicial Stamp Paper, duly

attested by Public Notary, stating that:

I. “There is no litigation pending against the project and/or land in which the project is

proposed to be set up (please give name & ownership etc. of the project) and that for any

such litigation what so ever, the sole responsibility will be borne by the Project

proponent.”

II. “No activity relating to this project (i.e. name of the project) including civil construction

has been undertaken at site except fencing of the site to protect it from getting

encroached and construction of temporary shed(s) for the guard(s). (if fencing has not

been done, then the same may be deleted).

III. “I/We hereby give undertaking that the data and information given in the application,

enclosures and other documents are true to the best of my knowledge and belief and

I/We am/are aware that if any part of the data and information submitted is found to be

false or misleading at any stage, the project will be rejected and clearance given, if any

to the Project will be revoked at our risk and cost.”

IV. Project does not fall under any buffer zone of no-development as declared /identified

under any law.

b. Another legal affidavit by the consultant stating “(a) that the prescribed TORs have been

complied with (to be deleted if not applicable) & (b) that details and the data presented are

factually correct”, as per MoEF circular dated 04.08.2009 is also to be submitted along with

EIA.

c. Current, site photographs viewing towards the project area from four directions indicating

date of photograph taken, direction from which taken, name of the project, and signature of

Project proponent along with consultant with seal should be submitted, so as to ensure that

no construction has been started before the grant of EC.

d. EIA should strictly follow the guidelines prescribed in annexure-III to the EIA notification

of 2006 and the Methods of Monitoring and analysis (Annexure-IV): Guidance for

assessment of representativeness and reliability of baseline environmental attributes detailed

under EIA manual January, 2001 and other guidelines in the matter.

e. The status of accreditation of the EIA consultant with NABET/QCI shall be specifically

mentioned. The consultant shall certify that his accreditation is for the sector for which this

EIA is prepared.

f. On the front page of EIA/EMP reports, the name of the consultant/consultancy firm along

with their complete details including their accreditation, if any shall be indicated.

g. While submitting the EIA/EMP reports, the name of the experts associated with/involved in

the preparation of these reports and the Name of laboratory through which the samples have

been got analysed should be stated in the report. It shall clearly be indicated whether said

laboratory is accredited by NABL or approved under the Environment (Protection) Act,

1986 (Please refer MoEF office memorandum dated 4th August, 2009). The name project

leader of the EIA study shall also be mentioned.

h. The EIA document shall be printed on both sides, as for as possible.

The Information’s no (a I , II, III & c) asked under the general guidelines is to be

submitted within 15 days from the date of receipt of the letter and remaining of the

information’s is to be submitted along with the EIA.
