Minutes of 276 th SEAC Meeting Date 18/06/2016 The 276 th meeting of SEAC was held in Directorate of Environment, U.P. on 18/06/2016. Shri Bhawani Singh Khangarot, Secretary, SEAC & Director, Environment, UP The Chairman welcomed the members to the 276 th SEAC meeting. The Members of SEAC unanimously taken following decisions on the agenda points discussed: 1. Expansion of Group Housing “Urban Village” at Plot No-E-1/GH-1, Amarpali Yojna, Hardoi Road, Lucknow. Sri Mridul Srivastava, Earthcon Construction Pvt. Ltd., B-11, Sector-1, Noida. File N0. 2468/OSD-T The SEAC noted the decision of SEIAA to examine the compliance of previous EC conditions. The Environmental Clearance to the project was issued to the project vide letter 2317/Parya/SEAC/1187/AD(Sub)/2011,Dated 20/11/2012 for the Group Housing Project “The Urban village” at E-1, GH-1, Amarapali Yojna, Hardoi Road Lucknow U.P. The proponent made an application for Expansion of Group Housing “Urban Village” at Plot No-E-1/GH-1, Amarpali Yojna, Hardoi Road, Lucknow on 04/08/2014. The SEAC in its meeting dated 09/01/2016 has directed to grant EC with general and specific conditions, The SEIAA in its meeting dated 23/02/2016 has directed SEAC to go through the compliance report of environmental clearance earlier issued by SEIAA U.P through letter dated 20/11/2012 and give their comments to SEIAA for taking decision. From the project proponent side Mr Suman Banergi appeared before the SEAC. Mr Suman - showed the receiving copy of the compliance report submitted to Directorate of Environment on 01/06/2016, however, he has not produced any annexure report before the SEAC. The SEAC has asked the project proponent to circulate the compliance report of previous EC issued to all SEAC members. The matter will be taken up after receipt of latest compliance report of previous EC issued to the Urban Village project, Lucknow. 2. SEAC Meeting Date 18/06/2016

The 276th

meeting of SEAC was held in Directorate of Environment, U.P. on

18/06/2016. Following members were present in the meeting along with Secretary, SEAC:

The Chairman welcomed the members to the 276th

SEAC meeting.

The Members of SEAC unanimously taken following decisions on the agenda

points discussed:

1. Expansion of Group Housing “Urban Village” at Plot No-E-1/GH-1, Amarpali Yojna,

Hardoi Road, Lucknow. Sri Mridul Srivastava, Earthcon Construction Pvt. Ltd., B-11,

Sector-1, Noida. File N0. 2468/OSD-T

The SEAC noted the decision of SEIAA to examine the compliance of previous EC

conditions. The Environmental Clearance to the project was issued to the project vide letter

2317/Parya/SEAC/1187/AD(Sub)/2011,Dated 20/11/2012 for the Group Housing Project “The Urban village” at E-1, GH-1, Amarapali Yojna, Hardoi Road Lucknow U.P. The proponent made

an application for Expansion of Group Housing “Urban Village” at Plot No-E-1/GH-1, Amarpali Yojna, Hardoi Road, Lucknow on 04/08/2014. The SEAC in its meeting dated 09/01/2016 has

directed to grant EC with general and specific conditions, The SEIAA in its meeting dated 23/02/2016 has directed SEAC to go through the compliance report of environmental clearance

earlier issued by SEIAA U.P through letter dated 20/11/2012 and give their comments to SEIAA for taking decision.

From the project proponent side Mr Suman Banergi appeared before the SEAC. Mr

Suman - showed the receiving copy of the compliance report submitted to Directorate of

Environment on 01/06/2016, however, he has not produced any annexure report before the SEAC.

The SEAC has asked the project proponent to circulate the compliance report of previous EC

issued to all SEAC members.

The matter will be taken up after receipt of latest compliance report of previous EC issued

to the Urban Village project, Lucknow.

2. Group Housing “Eldico Aurum/Mystic Green” at Plot No-GH-03, Sector-Omicron-I,

Greater Noida- Sri Amit Kumar, 201-212, Eldico Station-1, Sec-12, Faizabad Road,

Lucknow. File N0. 2811/DD-Y

The SEAC went through the decision of SEIAA 157th

meeting of SEIAA held on 28/03/2016 in which SEIAA directed the SEAC to reconsider the matter in light of compliance

report of earlier EC issued by SEIAA through letter no. 388/SEAC/128/2008, dated 12/03/2009 and also clarify whether the Environmental Clearance in this matter was recommended for plot

area 76300sqm (Built up area 1,33,525sqm) or 36341.30sqm (Built up area 59402 sqm).

Mr. Amit Kumar from project proponent side and Mr. Arvind N Devikar, from Ind Tech

House Consultants. were present in the meeting and informed the SEAC that:

1. The Environmental Clearance (EC) of the project was earlier issued under category 8(a)

by SEIAA, U.P., vide letter No. 388/SEAC//128/2008, dated March 12, 2009.

2. As per sanctioned EC letter, the plot area was 76300 sq.m. but the 39958.70 sq.m. area

was surrendered to GNIDA which was accepted by GNIDA, vide its letter dated 8th

September, 2010. So, the total plot area of the project was reduced to 36341.3 sq.m. 3. Accordingly, the project area has now been revised and due to decrease in plot area and

built-up area, project is being submitted again for obtaining modified environmental clearance.

4. Total Plot Area and total Built-up Area of the proposed project are 36341 sq. m. and 59402 sq. m respectively.

The Committee noted that Greater Noida Industrial Development Authority has

revalidated the building plan on plot no. GH03 Sec-Omricon-1 for this project on 11/10/2013 which is valid up to 5 years i.e. up to 10/10/2018. The proponent submitted an affidavit dated

16/02/2016 that he has not violated any of the parameters mentioned in the EC issued earlier. The

proponent also informed that he has not completed the construction yet and wants to increase the

validity of the previous EC.

The SEAC therefore, recommended that validity of the earlier EC issued by SEIAA

through letter no. 388/SEAC/128/2008, dated 12/03/2009 may be extended till 10/10/2018 (Date

of validity of Building Plan sanctioned by GNDA).

3. Expansion of Group Housing Project at Plot N0 03, GH-04, Sector-4, Greater Noida- Sri

Hari Bhushan, Surya Kamishk, Tower-26, Sector-4, Vaishali, Ghaziabad. File N0.

2794/OSD-T

The SEAC has examined the contents of latest Compliance report submitted to the

Directorate of Environment for the project. The SEAC has found the compliance report the highlight of the report is higher concentration of PM 10. The project proponent is hereby directed

to maintain the PM 10 as per guide lines and report to the office in the next compliance report. However, the committee recommended the case for grant of environmental clearance with

specific and general conditions as per the decision of SEAC meeting dated 16/02/2016.

4. Expansion of Group Housing Project “Fusion Apartment” at Plot No-GH-05A, Tech

Zone-IV, Noida Ext. Greater Noida- Sri Brijesh Goyal, Director, A-6, Ground Floor,

Yamuna Vihar, Delhi. File N0. 3053/AD-Sub.

The SEAC has examined the contents of Latest Compliance report submitted to the

Directorate of Environment for the project. The SEAC has found the compliance report in order

and recommended the case for grant of environmental clearance with specific and general

conditions as per the decision of SEAC meeting dated 16/02/2016.

4. Expansion of Proposed Group Housing Project '' MRJV Plam Resort '' At Khasra no.

1042, 1043, 1045, 1046, 1047, 1067 & 1068 NH- 58, Noor Nagar, Ghaziabad, U.P. Shri

Vijay Kumar, Partner, B-67, Sector 63 Noida U.P. File N0. 3676

The SEAC noted that application for seeking Environmental Clearance for expansion of

proposed group housing project “MRJV palm resort” at khasra no:1042, 1043, 1045,1046, 1047, 1067, 1068 nh-58, noor nagar, district- Ghaziabad, Uttar Pradesh on 11/05/2016 there by

requesting issue TOR as per requirement of EIA notification 14/09/2006 as category 8(b) project. Shri Arvind N. Devakar from M/s Ind tech house consultant Delhi and R.K. Anand from project

proponent side made the presentation before the SEAC. The committee discussed the matter and

directed the project proponent to submit following information:

1. Submission of all approved building plans and services plan from competent

Authority.

2. Ownership of land/Site plan showing all physical features within 30 m of the project

site.

3. Water demand as per the population must be specified in the tabular form along with

the water balance diagram. 4. In area chart % of land use to total area to be shown.

5. All services plans/maps i.e. sewage, drainage, external electrification, rain water harvesting, parking, uses of solar energy etc.

6. Certificate of Architect regarding all plan and maps are as per building bye laws and master plan.

7. Comparative statement regarding the existing EC and the proposed expansion along with the construction status as on date should be provided.

8. Compliance of earlier EC. 9. Submit the revised project report containing all the desired information’s as discussed

in the meeting.

10. Photographs and proof of no construction on the plot of expansion.

11. Proof of date of start of construction.

12. Circulate the reports to all committee members.

The matter shall be discussed after submission of information as above.

5. Expansion of Group Housing at Plot no- GH-02, Sector- 143, Noida, U.P. Mr. Devendra

Saxena, General Manager, M/s Logix City Developers. File N0. 3681

The SEAC noted that application for seeking Environmental Clearance for Expansion of

Group Housing Project “Blossom Zest” At Plot No.GH-02, Sector-143, Noida, U.P was submitted on

20.5.2016., there by requesting issue TOR as per requirement of EIA notification 14/09/2006 as

category 8(b) project. M/s Yes Enviro Solution and Sandeep Desh Pande from project proponent

side made the presentation before the SEAC. The committee discussed the matter and directed the

project proponent to submit following information:

The SEAC noted that application for seeking Environmental Clearance pintail park city

integrated township project at Villages: Madharmau Kala, Mastemau & Bakkas, Lucknow, Uttar

Pradesh (Plot Area: 200.07 Acres/ 81 Ha was submitted on 25.5.2016 , requesting the committee

to issue TOR as per requirement of EIA notification 14/09/2006 as category 8(b) project. M/s

Epsilon Projects Lucknow and Ashu Bajpai from project proponent side made the presentation

before the SEAC.

The committee discussed the matter and directed the project proponent to submit

following information:

1. The Project details has to be revised as out of 81 Ha land only 41.38 Ha land is under

possession and submit the fresh application of 41.38 Ha land which is under possession.

2. Document regarding Ownership of land & change of land use

3. Submit the lease deed and land documents with regard to 41.38 Ha Land.

4. Submit approved layout Plan duly approved by Competent Authority.

5. Submit details of Infrastructure proposed, with area wise and percentage wise.

6. Google map of entire land and feature of the land 30 meter radius.

7. All approved service plans, Landscape plan be submitted.

8. Specify the permitted uses of the proposed project site as per zoning laws.

9. Map showing approach road with reference to project site.

The matter shall be discussed after submission of information as above.

7. Group Housing Project “Gaur Siddhartham’’ at Plot N0. 8/BS-01, Siddhart Vihar

The committee noted that the application for environmental clearance on above project

was submitted to SEIAA on dated 14/5/2016. A presentation was made by Shri Devendra

Bhandari representative of project proponent. The proponent, through the documents presented

and informed the committee that:-

17. A site plan showing the project site and its surroundings with physical features and

topographical details, such as land use, contours and drainage pattern, along with

information.

18. Sanction of all roads showing all services is to be submitted.

19. All plans and elevation sections/all service plan/landscape plan/standard electrification

plan/drainage/sewerage plan.

20. Examine in detail the proposed site with reference to impact on infrastructure covering

water supply, storm water drainage, sewerage, power, etc., and the disposal of treated/raw

wastes from the complex on land/water body and into sewerage system.

21. Details of activities that is proposed/likely to come up in the project.

22. Water requirement and water management plan alongwith necessary permissions for

discharge.

23. Hydro-geological investigations be carried out and obtain permission from Central

Ground Water Authority for withdrawal of ground water.

24. Consider soil characteristics and permeability for rainwater harvesting proposals, should

be made to prevent ground water contamination. Maximize use of treated water by

recycling and utilization of rainwater.

25. Make provision for safety against failure in the operation of wastewater treatment

facilities. Identify acceptable outfall for treated effluent.

26. Details of green belt as a measure for mitigation of dust and noise and buffer between

habitation and proposed project.

27. Landscape plan, green belts and open spaces may be described separately.

28. Study the existing flora and fauna of the area and the impact of the project on them.

29. Examine existing crèche, education, health facilities, police, post Office, Banks and other

services and make adequate provisions in the proposal.

30. Assess soil erosion in view of the soil characteristics, topography and rainfall pattern.

31. Application of renewable energy/alternate energy, such as solar and wind energy may be

described including solar water heating in the guidelines for entrepreneurs.

32. Consider solid wastes, including e-waste in addition to other solid wastes and their

disposal.

33. Identification of recyclable wastes and waste utilization arrangements may be made.

34. Explore possibility of generating biogas from biodegradable wastes.

35. Arrangements for hazardous waste management may be described as also the common

facilities for waste collection, treatment, recycling and disposal of all effluent, emission

and refuse including MSW, biomedical and hazardous wastes. Special attention should be

made with respect to bird menace.

36. Provisions made for safety in storage of materials, products and wastes may be described.

37. Disaster management plan should be prepared.

38. Traffic management plan including parking and loading/unloading areas may be

described. Traffic survey should be carried out both on weekdays and weekend.

39. Parking provision is to be made for higher ECS worked out either as per state bye-laws or

construction manual of the MoEF

40. Exclusive Parking area in the basement (excluding other facilities) and surface is to be

clearly mentioned

41. Provide service road for entry and exit to project site.

42. Use of local building materials should be described.

43. Consider provision of DG Flue Gas emissions to be treated in a scrubber. Stack details

with provisos of sampling port for monitoring be described.

44. Work out MGLC for the combined capacity of DG sets.

45. Provide for conservation of resources, energy efficiency and use of renewable sources of

energy in the light of ECBC code.

46. Application of resettlement and rehabilitation policy may be described. Project affected

persons should be identified and rehabilitation and resettlement plan should be prepared.

47. Examine separately the details for construction and operation phases both for

Environmental Management Plan and Environmental Monitoring Plan.

48. Total cost of the project is Rs. 819 Cr. Environment Corporate Responsibility (ECR) plan

along with budgetary provision of minimum Rs/ 16.40 Cr. The details of CSR cost with

list of beneficiaries, phase wise details with photographs should be submitted.

49. Details of all internal and peripheral roads width.

50. Source and quantity of required water during construction and management of generated

waste water.

51. Project falling with in 10 Km. area of Wild Life Sanctuary is to obtain a clearance from

National Board Wild Life (NBWL) even if the eco- sensitive zone is not earmarked.

General Guidelines

a. A legal affidavit by the Project proponent on Rs. 100/- non-judicial Stamp Paper, duly

attested by Public Notary, stating that:

I. “There is no litigation pending against the project and/or land in which the project is

proposed to be set up (please give name & ownership etc. of the project) and that for any

such litigation what so ever, the sole responsibility will be borne by the Project

proponent.”

II. “No activity relating to this project (i.e. name of the project) including civil construction

has been undertaken at site except fencing of the site to protect it from getting encroached

and construction of temporary shed(s) for the guard(s). (if fencing has not been done,

then the same may be deleted).

III. “I/We hereby give undertaking that the data and information given in the application,

enclosures and other documents are true to the best of my knowledge and belief and I/We

am/are aware that if any part of the data and information submitted is found to be false or

misleading at any stage, the project will be rejected and clearance given, if any to the

Project will be revoked at our risk and cost.”

IV. Project does not fall under any buffer zone of no-development as declared /identified under

any law.

b. Another legal affidavit by the consultant stating “(a) that the prescribed TORs have been

complied with (to be deleted if not applicable) & (b) that details and the data presented are

factually correct”, as per MoEF circular dated 04.08.2009 is also to be submitted along with

EIA.

c. Current, site photographs viewing towards the project area from four directions indicating

date of photograph taken, direction from which taken, name of the project, and signature of

Project proponent along with consultant with seal should be submitted, so as to ensure that

no construction has been started before the grant of EC.

d. EIA should strictly follow the guidelines prescribed in annexure-III to the EIA notification

of 2006 and the Methods of Monitoring and analysis (Annexure-IV): Guidance for

assessment of representativeness and reliability of baseline environmental attributes detailed

under EIA manual January, 2001 and other guidelines in the matter.

e. The status of accreditation of the EIA consultant with NABET/QCI shall be specifically

mentioned. The consultant shall certify that his accreditation is for the sector for which this

EIA is prepared.

f. On the front page of EIA/EMP reports, the name of the consultant/consultancy firm along

with their complete details including their accreditation, if any shall be indicated.

g. While submitting the EIA/EMP reports, the name of the experts associated with/involved in

the preparation of these reports and the Name of laboratory through which the samples have

been got analysed should be stated in the report. It shall clearly be indicated whether said

laboratory is accredited by NABL or approved under the Environment (Protection) Act,

1986 (Please refer MoEF office memorandum dated 4th August, 2009). The name project

leader of the EIA study shall also be mentioned.

h. The EIA document shall be printed on both sides, as for as possible.

The Information’s no (a I , II, III & c) asked under the general guidelines is to be

submitted within 15 days from the date of receipt of the letter and remaining of the information’s

is to be submitted along with the EIA.

taken up after receipt of request.

9. Biomedical Waste Management Facility at H-55, Site-II, Industrial Area, Unnao. Sri

The TOR has already been issued to the project. Therefore, the project is delisted.

11. Common Biomedical Waste Treatment Facility at Plot No. 672, Village Kumbhi. Shri

Sanjay Grug, General Manager, Medicare Environmental Management Pvt. Ltd. File

N0. 3677/

The SEAC noted that M/s Medicare Environmental management has submitted an

application for TOR for proposed common biomedical waste treatment facility at Kumbhi village

Kanpur Dehat U.P on 12/06/2016. A representative from project proponent Dr B.Chaakradhar , Ramky Enviro Engineers Ltd. made the presentation .

The SEAC discussed the matter and decided to seek following information from the project proponent.

1- Justification for proposed common Biomedical waste treatment facility at Kumbhi,

Kanpur when already 2-3 common Biomedical waste treatment facilities have been installed within 150 km radius.

2- The project proponent to submit the inventory of Hospitals/clinics/Dispensaries/Health care units including the details of beds with in 150km radius.

3- Status of operation of other nearby common biomedical waste treatment facilities with

capacity of incinerator.

4- All the facts submitted should be verified by C.M.O.

The committee also decided to provide objection letter of association of Sangam Medi

Services Pvt. Ltd. dated 14/06/2016 association of Common Bio Medical Waste facility operation

in UP letter dated 21/03/2016 to the proponent to give para wise comments to be considered in

SEAC meeting.

The case will be taken up after submission of above information.

12. Group Housing Project at Plot No-GH-12/A, Sector-Zeta-1, Greater Noida, U.P. Sri S.J.

The case was presented by the consultant M/s J. M. Enviro Net (P) Ltd. along with the

representative of the project proponent. The proponent, through the documents submitted and the

presentation made, informed the committee that:-

Earlier the case was discussed in the SEAC meeting held on 20.6.2014 and the State

Expert Appraisal Committee, after due consideration of the relevant documents submitted by the

project proponent recommended for the grant of Prior Environmental Clearance for the project

mentioned above along with all General and specific conditions. The EC was issued vide letter

1002/Parya/SEAC/2084/2013/JDCA(S).

In the Minutes of 182 SEAC minutes of the meeting at S.NO 27 from page 36-38 in which some dates/details and information has been wrongly mentioned due to typographical

errors/mistakes. The data,information and details mentioned are not matching with as submitted

in Form 1, EIA/EMP report. It was requested to incorporate the following changes and

corrections in the minutes of meeting and environmental clearance letter already issued.

1- In point no. 3, the correct name of person is Mr. S.j.Raza instead of Mr. S. J.Rara and the

correspondence address is 711/92. Deepali, Nehru Place, New Delhi-110019.

2- In point no.4 the correct figures of build up area of the project is 299067.343 sq.m instead of

288464.722sq.m.

3- In point no.5 the correct figures of total no. Of the floors are G+29 instead of 29.

4- In point no.7 the correct figures of FAR achieved is 186859.953sq.m instead of

189385.76sq.m.

5- In point no.8 the correct figures of total no. Of dwelling unit is 1322 instead of 4000.

6- In point no.11 the correct figures of basement parking area is Upper basement 42768.636sq.m

&Lower basement 43521.817sq.m instead of 34909.52 &37620367sq.m respectively. 7- In point no.12 the correct figures of total water requirement is 648 KLD instead 749 KLD.

8- In point no.13 the correct figures of excess water is 269 KLD instead of 169 KLD. 9- In point no.16 the correct figures of Green area of the proposed area is 25079.414sq.m (44.26

The SEAC discussed the matter and verified from the record and decided to incorporate the above changes in the 182nd SEAC minutes of meeting dated 20.6.2014 and environmental

clearance letter no 1002/Parya/SEAC/2084/2013/ JDCA(S), Dated 07-08-2014 has to revised and

reissued.

General Conditions: 1. The project authorities must strictly adhere to the stipulations made by the Uttar Pradesh State

Pollution Control Board and the State Government.

2. No further expansion or modifications in the plant shall be carried out without prior approval

of the SEIAA, UP.

3. The gaseous emissions from various process units shall conform to the load/mass based

standards notified by this Ministry on 19th May, 1993 and standards prescribed from time to

time. The State Pollution Control Board may specify more stringent standards for the relevant parameters keeping in view the nature of the industry and its size and location.

4. At least four ambient air quality monitoring stations should be established in the downward direction as well as where maximum ground level concentration of PM10, PM2.5, SO2 and NOX

are anticipated in consultation with the SPCB. Data on ambient air quality and stack emission shall be regularly submitted to UPPCB/CPCB and Regional Office, of MoEF at Lucknow

once in six months. 5. Industrial wastewater shall be properly collected, treated so as to conform to the standards

prescribed under GSR 422 (E) dated 19th May, 1993 and 31st December, 1993 or as amended form time to time. The treated wastewater shall be recycled in the plant and there shall not be

any discharge of industrial waste water as commited by the project proponent during the

presentation.

6. The overall noise levels in and around the plant area shall be kept well within the standards

(85 dBA) by providing noise control measures including acoustic hoods, silencers, enclosures

etc. on all sources of noise generation. The ambient noise levels shall conform to the standards

prescribed under EPA Rules, 1989 viz. 75 dBA (daytime) and 70 dBA (night times).

7. Occupational health surveillance of the workers should be done on a regular basis and records

maintained as per the Factories Act.

8. The company shall develop surface water harvesting structures to harvest the rain water for

utilization in the lean season besides recharging the ground water table.

9. The project proponent shall also comply with all the environmental protection measures and safeguards recommended in the EIA/EMP report. Further, the company must undertake socio-

economic development activities in the surrounding villages like community development programmes, educational programmes, drinking water supply and health care etc.

10. As proposed, budget shall be earmarked towards capital cost and recurring cost/annum for environment pollution control measures to implement the conditions stipulated by SEIAA as

well as the State Government. An implementation schedule for implementing all the conditions stipulated herein shall be submitted to the Regional Office of MoEF at Lucknow.

The funds so provided shall not be diverted for any other purpose. 11. A copy of clearance letter shall be sent by the proponent to concerned Panchayat, Zila

Parishad/Municipal Corporation, Urban Local Body and the local NGO, if any, from whom

suggestions/representations, if any, were received while processing the proposal. The

clearance letter shall also be put on the web site of the company by the proponent.

12. The project proponent shall upload the status of compliance of the stipulated environment

clearance conditions, including results of monitored data on their website and shall update the

same periodically. It shall simultaneously be sent to the Regional Office of the MoEF at

Lucknow, CPCB and UPPCB. The criteria pollutant levels namely; PM10, PM2.5, SO2, NOx

(ambient levels as well as stack emissions) for the projects shall be monitored and displayed at

a convenient location near the main gate of the company in the public domain.

13. The project proponent shall also submit six monthly reports on the status of the compliance of

the stipulated environmental conditions including results of monitored data (both in hard copies as well as by e-mail) to the Regional Office of MoEF, CPCB and UPPCB. The

Regional Office of MoEF at Lucknow / CPCB / SPCB shall monitor the stipulated conditions. 14. The environmental statement for each financial year ending 31st March in Form-V as is

mandated to be submitted by the project proponent to the concerned State Pollution Control Board as prescribed under the Environment (Protection) Rules, 1986, as amended

subsequently, shall also be put on the website of the company along with the status of

compliance of environmental conditions and shall also be sent to the Regional Office of the

MoEF at Lucknow.

15. The Project Proponent shall inform the public that the project has been accorded

Environmental Clearance by the SEIAAUP and copies of the clearance letter are available

with the SPCB and may also be seen at Website of the SEIAAUP at seiaaup.com. This shall

be advertised within seven days from the date of issue of the clearance letter, at least in two

local newspapers that are widely circulated in the region of which one shall be in the vernacular language of the locality concerned and a copy of the same should be forwarded to

the Regional office at Lucknow. 16. Project authorities shall inform the Regional Office of MoEF, Lucknow as well as the SEIAA

the date of financial closure and final approval of the project by the concerned authorities and the date of commencing the land development work.

Specific Conditions:

1. Approval letter from sanctioning authority alongwith stamped layout maps be submitted within a month. This EC will deem to be cancelled if the project proponents fail to submit the

approved maps. 2. NOC from Fire Department should be submitted within a month, in case of failure this EC

will deem to be cancelled. 3. Solid waste, vermin composting will be done.

4. 02 continuous ambient Air Quality Monitoring Station one in up wind and other in

predominant wind direction shall be installed immediately after the plant is in operation.

5. Flow measurement device should be installed at the outlet of ETP.

6. Minimum 33% of total plot area shall be developed as green belt as per norms of MoEF.

7. Water meter shall be installed at the points of effluent generation.

8. Storage of ash and baggase shall not be left open. Storage places should be on remote sides of

the villages.

9. Authorization for hazardous waste shall be obtained as per law.

10. Corporate Social Responsibility (CSR) plan along with budgetary provision amounting to

minimum 2% of the total project cost shall be prepared and approved by Board of Directors of

the company. A copy of resolution as above shall be submitted to the authority alongwith list

of beneficiaries with their mobile nos./address.

11. SPM level from chimney should be restricted under current norms. 12. No Additional Land, No Additional Water, No Additional Fuel shall be used for the proposed

modernization.

13. No Effluent Discharge shall be made in public domain.

14. Online Monitoring Systems for effluent monitoring shall be installed.

15. To reduce the emission of particulate matter and gasses, Electrostatic Precipitator shall be

installed and connected with Boiler duct.

16. The Solid waste generated from the process will be mainly bagasse, filter cake (press mud)

and boiler ash. 100 % Bagasse shall be reused as fuel in the boiler and excess bagasse, if any,

shall be sent to other sugar plants for power generation. Molasses will be sent to the Distillery

unit. Filter cake shall be sent for bio-composting in the Distillery.

17. Commitments made during the Public Hearing shall be complied with. 18. The company shall provide housing for construction labour within the site with all necessary

infrastructure and facilities such as fuel for cooking, mobile toilets, safe drinking water, medical health care, crèche etc. The housing may be in the form of temporary structures and

to be removed after the completion of the project. 19. Plan for 12 m peripheral grren and plantation in three rows of 4.0 m distance. C/w 5.0 m is to

be submitted and shown on layout plant. 20. All storm water drain and conveyor belt should be covered.

21. Any litigation pending in the Courts of Law it shall be binding on project proponent.

22. Parking facility should be provided within the project premises.

23. Any appeal against this environmental clearance shall lie with the National Green Tribunal, if

preferred, within a period of 30 days as prescribed under Section 11 of the National

Environment Appellate Authority Act, 1997.

14. Cement Grinding Unit of KLK Cement Pvt. Ltd., at Plot N0-E-18,19,20, UPSIDC

Sidhwan, Jaunpur. Sri Pradeep Kumar, Director, Balia Agency, Ram Lila Maidan,

Naya Chowk, Balia, U.P. 2335/OSD-T (DD-D) The Application for grant of TOR for proposed cement grinding unit to KLK cements pvt.

Ltd. at plot no. E-18, 19, 20 UPSIDC Sidhwan Jaunpur was received on 23/05/2014 and case was put up before SEAC on 14/09/2014 and it was decided to issue the TOR and guidelines for

conducting EIA regarding the proposal. The project proponent submitted EIA report on 27/04/2015.The matter was again put up before SEAC meeting held on 08/01/2016 through which

the proponent was asked to submit the following information: 1. Consultant should submit their QCI accreditation status.

2. The minimum and the maximum ground level concentrations of the particulates in the predominant wind directions particularly in the months of winter at low heights should be

detailed. Detailed Landscape plan may also resubmit. Proposal for On Line Monitoring of

the PM10/PM5 should be submitted.

3. Copy of Fire/AAI NOC should be submitted.

4. 10 mt. peripheral strip green belt plan considering 5 m2 /tree dense plantation should be

submitted and also shown of map.

5. Set back details.

6. Traffic study to be submitted on National Highway.

7. Plan for Rain water harvesting as per guide lines.

8. Total cost Rs. 1.70 Cr. of the project and CSR plan of Rs. 10 Lacs, executable work at

phase wise prepared and detail of works to be executed along with the resolution of board

of directors or the concerned with an affidavit is to be submitted along with the name and address of beneficiaries.

The reply was submitted on 15.3.2016. The presentation was made by the representative

of the project proponent and their consultant M/s Prakriti consultant services before SEAC. The

SEAC discussed the matter and decided to seek following information from the project proponent:

1. The details of the minimum and maximum ground level concentration of the particulate in the predominant wind direction particularly in the month of winter at low height to be

3. Details landscape plan be submitted. 4. Proposal for online monitoring of PM 10 and PM 2.5 be submitted.

5. Monitoring stations at Highway should be marked and mentioned in Traffic Study. The

ambient noise level monitoring at all stations be conducted and analysis be submitted in bar

chart form.

6. Details of CSR to be submitted with the name of beneficiaries and phase wise

implementation plan.

7. Rainwater Harvesting Plan for Roof and surface water be submitted separately.

8. Details of water conservation measures along with wastewater treatment plant to be

submitted.

9. The query no. 2 is not well replied and is to be submitted as suggested.

10. 10 m peripheral green is to be submitted duly marked on layout plan. Tree to be planted at a

distance of 5 m, plan in this regard should be submitted.

11. Copy of NOC from UP Pollution Control Board is to be submitted.

15. “Tritech Leather Cluster” Located A-1, A-2 and A-3, Industrial area, Unnao. Mr. K.

Singhal, Chief Operating Officer, Meena Steels Limited, 2098/DD-Y

The committee noted that:

1. The matter was discussed in SEAC meeting dated 29/04/2015 and Environmental

clearance was recommended subject to implementation of conditions.

2. The matter was discussed in SEIAA meeting dated 04/06/2015 and the SEIAA directed

the project proponent to present matter before SEIAA along with their consultant regarding the proposal of zero effluent discharge.

3. In this regard, the project proponent along with the consultant made a presentation before SEIAA on 5/8/2015. During the presentation the project proponent was asked by

the SEIAA to reply the salt recovery plan to reduce the TDS under ZLD technologies, Reject Management, Recycle & Reuse of treated water, Green belt plan, Abstraction of

ground water Plan, Number of hides/skins proposed in individual tanneries in the cluster, SPV Structure and its formation etc. but the project proponent could not reply

satisfactorily.

In the above reference, the SEIAA therefore, directed the project proponent to submit the

following information regarding the proposal of setting up a new cluster of tanneries with ZLD

technology:-

1. Plot area to be allotted to each tannery.

2. Technologies to be used conventional or cleaner technology 3. Provision of dedicated green belt in the proposal as well as in the individual tannery plot

by planting pollution tolerant trees. 4. Detailed Water management plan.

5. Number of hides/skins proposed in the tanneries. 6. Numbers of tanneries doing vegetable tanning process & proposed for chrome tanning

process. 7. Responsible Authority for pollution if caused due to by-pass of any type of effluents or

omission or leakage in primary treatment inside tanneries and the pollution load if found increased in the underground bore water in the vicinity or inside the cluster or in any

tannery. Any defect at CETP/ZLD system if causes any increase in water pollution in the

area due to any omission inside the cluster.

8. The structure of SPV. Agreement among the individual tannery owners and SPV.

9. Plan for hazardous waste management.

10. For operation and maintenance of Zero Liquid Discharge an agreement among the

individual tannery owners and SPV.

The SEIAA has not accepted the recommendation of SEAC meeting dated 29-04-2015 to

grant of prior Environmental Clearance to proposed project and directed the project proponent to

submit the above information. The SEIAA also directed the SEAC that the matter should be

considered in the SEAC meeting after receipt of the information in the chronological order.

4. The project proponent submitted their replies through letter dated 11/09/2015. A presentation was made by Shri B.K. Singhal, Chief Operating Officer, authorized

representative of project proponent along with their consultant M/s GRC India Pvt. Ltd. The proponent informed the committee that:

1. 45 nos. of plots have been planned for the purpose of leather processing units. Minimum

plot size will be 2040 sqm and maximum will be 5700 sqm. Layout plan showing the

dimension of each plot is shown in next slide. All plots will be provided with

facilities/utilities like electricity, effluent discharge connection and treated effluent from

CETP.

3. Cleaner technologies will be used in individual tanneries. Wastewater treatment process

includes:

• Within tanneries: Recycling of soak water, green fleshing process and hair saving

process will be followed which will reduce pollution load on wastewater as well as

solid waste which can be then recycled in a better way.

• Waste Water Treatment Plant – The process has been changed. There will be three

different streams of waste water to segregate the waste water from tanneries.

• Soak water –Under this, after Electro coagulation process which will reduce BOD &

COD, water will pass through RO system, solar evaporation and rest will mix and will

take in Multi Effect Evaporation (MEE) system.

• Chrome water – This will be treated separately where chrome will be precipitated

through MGO process and then the water will mix with normal effluent for further

treatment.

• The waste water stream (other than the above two) will first go into Equalisation tanks

and then will be directed to Biological treatment process where the sludge will be

treated or decomposed to the maximum through biological process rather than

conventional chemical process which is used in primary treatment process. This will

help in reduction of solid waste by 30 to 40%. For this, we have hired a well-

established international company which has adopted this technology/process in Santa

Croce CETP of 25 MLD capacity and is running successfully.

• Finally, the water will be passed through Nitrification & De-nitrification process.

4. Total greenbelt area of the project will measure approx. 39,315 m2 (i.e. 22.40 % of the

total plot area).

• Greenbelt inside the plot =8,163 m2

• Greenbelt outside the plots (along road sides and project periphery) = 31,152 m2

5. The wastewater generated from the project will be fully recycled/reused within the

premises and no effluent will be discharged outside the project boundary.

• Wastewater will be generated from various processes such as soaking, liming,

fleshing, deliming, pickling, chrome tanning, splitting, rechroming, and dying process.

• Total wastewater generated from various processes will be treated in a CETP of

capacity 6 MLD.

• ZLD (Zero liquid discharge) technology has been adopted in designing of CETP. The

ZLD (Zero liquid discharge) system for tanneries will comprise - proper collection of

effluent, primary treatment, secondary treatment; further preparatory treatment for

ZLD system, Reverse Osmosis for reducing effluent quantity for evaporation, reuse of

the recovered RO permeate in tanneries’ process, evaporation of the RO concentrate in

evaporator, reuse of the recovered condensate in tanneries process, recovery of

crystallized salt, recycle of un-crystallized salt for evaporation with RO concentrate,

and storage of the recovered salt in safe impervious covered storage facility.

7. The total process capacity of the cluster will be 240 MT hides per day. The individual

tanneries will be allowed to process 4.0 MT per day per 2000 meters size plot. The

capacity of individual tannery will increase as per size of the plot.

8. All the tanneries will be based on chrome tanning process.

9. The whole system will be monitored by the SPV. Therefore, SPV will be the responsible

for maintenance of all the facilities/infrastructure including waste water treatment.

Moreover, the cluster of individual tanneries will not be doing any primary treatment of waste water. All the waste water will be processed in CETP so chances of any leakage at

tannery level will be minimized. 10. The Department of Industrial Policy & Promotion (DIPP) is implementing a sub-scheme

‘Mega Leather Cluster’ (MLC) under Indian Leather Development Programme under the 12th year plan to boost leather manufacturing & export business in India Under this

scheme, any company of similar trade can make a SPV company under Companies Act for participation in this scheme. Accordingly, the proponents have created a SPV. Each

mega leather cluster will be implemented by this SPV (special purpose vehicle).

11. As regards structure of SPV, the SPV will have Directors on its board with at least one

representative each of the central government, state government, financial institution,

owner of industrials plots, operator, maintainer of common facilities and Regional

Chairman of CLE. Meena Steel Limited has provided its confirmation and commitment to

the Special Purpose Vehicle (SPV)–Tritech Tannery Cluster Private Limited (TTCPL) to transfer all its rights for the development of Leather Park and has accordingly entered into

an Memorandum of Understanding (MoU) with the SPV-TTCPL dated 12th June, 2014. 12. Industrial waste generated from the project will be categorized into hazardous waste and

non-hazardous waste. To reduce the quantity of solid waste, Meena Steel Ltd. will install a

compact filtration and drying system for solid waste which will be transferred to TSDF.

The quantity of hazardous waste is estimated to be50 MT per day. However, 80-100% of

this waste will be water and thus the dry weight will be 24-30 MT per day. Hazardous

waste will be managed through an approved vendor M/s Bharat Oil & Waste Management

Ltd. This vendor has sufficient capacity and infrastructure for storage and neutralization of

hazardous waste.

13. Development Agreement with Tritech Tannery Cluster Private Limited (TTCPL) which

will undertake the responsibility of operation and maintenance of the project. An

agreement will be signed between the SPV and individual tannery when we start allotment

of plots.

The committee discussed the matter and directed the proponent to submit following

information:

1. The maps/layout plans should be approved form UPSIDC.

2. All services like external electrification, sewer, drainage, RWH, CETP, parking, section

of the roads showing all services, water supply line should be submitted on map.

3. Dead ends related to plots shown on maps and as discussed in SEAC meeting should be

open and revised layout should be submitted.

4. Additional Green area (minimum 15%) should be created in form of parks in addition to 22.4% green area given in proposals.

5. Setback details should be submitted. 6. Submit justification of 06 MLD CETP whereas 6000 KLD effluent is being generated.

Capacity of CETP should be higher than proposed waste water generation supposed to be treated in CETP.

The project proponent submitted their replies through letter dated 01/02/2016. A presentation was made by Shri Bijendra Kumar Singhal, authorized representative of project

proponent along with their consultant M/s GRC India Pvt. Limited. The committee noted that layout plan is different from the one which was submitted

earlier as the new one shows a park in the middle of the project and the same is also not approved.

The committee observed that the no. of plots shall be reduced with provisions of this park which

is shown in the new layout plan but the no. of plots in the proposal have remain same. This

anamoly should be clarified. The committee further directed to clarify and submit information as

follows:

1. Layout plan approval from UPSIDC should be submitted.

2. Legends on the map should be duly provided without which maps cannot be interpreted.

3. All the services should be shown on firmed up layout alongwith green area/park.

4. Road section showing all services should be submitted.

5. Peripheral green 10 m should be shown on layout plan.

6. Provision of water supply and overhead tank should be submitted.

7. Provision for solid waste disposal and sewage plan should be submitted.

The project proponent submitted their replies in this regard. A presentation was made by

Shri B.K. Singhal, Chief Operating Officer, M/s Meena Steels Ltd., authorized representative of

project proponent along with their consultant M/s GRC India Pvt. Ltd. The committee discussed

the replies and recommended grant of environmental clearance alongwith following general

and specific conditions: SPECIFIC CONDITIONS:

1- Approval of layout plan alongwith letter from sanctioning authority (UPSIDC) alongwith stamped layout maps be submitted within a month. This EC will deem to be cancelled if the project

proponents fail to submit the approved maps.

2- The project authority shall install the complete treatment plant with zero liquid discharge prior to

start of the project. To achieve the standards prescribed by Uttar Pradesh Pollution Control Board.

3- Provision of Online monitoring before recycling of treated water should be made.

4- Chromium recovery plant shall be installed to recover the Chromium to the maximum extent as per standards and proper disposal of the Chromium bearing sludge should be ensured as per the

Hazardous Waste (Management & Handling ) Rules,1989 and as amended.

5- The site for Hazardous Waste disposal should be identified and earmarked. Information should be

submitted to SEIAA.

6- To reduce the TDS concentration in the primary treated effluent, cleaner technologies as

recommended in the EIA report e.g. dry salting for reduction of TDS in waste water, counter

current soaking to reduce wastewater quantity, enzyme assisted liming process, combined pickling

tanning process, pretreatment and segregation of wastes etc. shall be practiced and soak liquor

shall be segregated and evaporated in the solar evaporation ponds.

7- The spent soak liquor containing high concentration of salt shall be discharged into the Solar

Evaporation Pond (SEP).

8- Adequate number of influent and effluent quality monitoring stations shall be set up in

consultation with the UP State Pollution Control Board. Regular effluent quality monitoring shall

be carried out for relevant parameters and the monitored data along with the statistical analysis and

interpretation shall be submitted to the Regional office of this Ministry at Lucknow once in six

months and to the UP State Pollution Control Board once in three months.

9- The company shall dispose of solid waste in the secured double lined landfill site. The flashings

from the tannery shall be supplied to the manufacturers of dog chew and glue. Manufacturing

approved by UPPCB.

10- Environment Corporate Responsibility (ECR) plan with budgetary provision of minimum 2% of

the project cost as discussed in meeting shall be submitted on need base assessment study in the

study area. Details of CSR activities and list of beneficiaries with their mobile nos. also be

submitted.

11- The tannery unit shall adopt recovery and reuse of chrome/Alutan BCS/closed-loop Alutan-BCS

combined tanning process to ensure maximum chromium recovery and minimum chromium

discharge in the effluent.

12- The project authorities shall develop 33% of the total area as green belt as per the guidelines of

State Govt. to mitigate the effect of odour nuisance from the plant.

13- The project authorities shall undertake environmental auditing on annual basis.

14- An adequate municipal waste treatment and disposal treatment facility shall be installed/identified

for the project.

15- Structural design duly weighted by IIT to be submitted within a month in the office of Directorate.

16- All bases and contender of hazardous chemicals to be used in the possess shall be toughly cleaned

and disposal shall be in the accordance with law.

17- Adequate collection treatment and disposal facility for leachate shall be ensured prior to

commissioning of the project.

18- The common facility must insure proper collection of process waste including metering of waste

generated form tannery unit.

19- 10 m peripheral green and tree plantation at a distance of 5 m is to be submitted and also

shown on layout plan.

B. GENERAL CONDITIONS: 1- The project authorities shall strictly adhere to the stipulations of the SPCB/state government or any

statutory body.

2- All the effluent shall be properly treated and finally treated effluent shall meet the norms stipulated

by the UP Pollution Control Board or under Environment (P) Rules 1986.

3- No further expansion or modifications in the plant shall be carried out without prior approval of the Ministry of Environment and Forests. In case of deviations or alterations in the project

proposal from those submitted to SEIAA for clearance, a fresh reference shall be made to the

Ministry to assess the adequacy of conditions imposed and to add additional environmental

protection measures required, if any.

4- The locations of ambient air quality monitoring stations shall be installed in consultation with the

State Pollution Control Board (SPCB) and in the downwind direction as well as where maximum

ground level concentrations are anticipated.

5- Proper housekeeping shall be maintained within the plant premises. Process machinery, exhaust

and ventilation systems will be laid in accordance with Factories Act.

6- The project authorities shall strictly comply with the rules and guidelines under Manufacture,

Storage and Import of Hazardous Chemicals Rules, 1989 as amended from time to time.

Authorization from the SPCB shall be obtained for collection, treatment, storage, and disposal of

hazardous wastes.

7- The overall noise levels in and around the plant area shall be kept well within the standards by

providing noise control measures including acoustic hoods, silencers, enclosures etc. on all sources

of noise generation. The ambient noise levels shall conform to the standards prescribed under

Environment (Protection) Act, 1986 Rules, 1989 viz. 75 dBA (day time) and 70 dBA (night time).

8- The company shall develop rain water harvesting structures only from roof top to harvest the

runoff water for recharge of ground water.

9- The company shall obtain permission from the State Ground water Authorities to draw the ground

water. Occupational health surveillance of the workers shall be carried out on a regular basis and

records shall be maintained as per the Factories Act.

10- The company shall undertake eco-developmental measures including community welfare measures

in the project area for the overall improvement of the environment.

11- The project proponent shall also comply with all the environmental protection measures and

safeguards proposed in the EIA/EMP report.

12- A separate Environmental Management Cell equipped with full fledged laboratory facilities shall

be set up to carry out the Environmental Management and Monitoring functions.

13- The project authorities shall earmark adequate funds to implement the conditions stipulated by the

Ministry of Environment and Forests as well as the State Government along with the

implementation schedule for all the conditions stipulated herein. The funds so provided shall not

be diverted for any other purpose.

14- The implementation of the project vis-à-vis environmental action plans shall be monitored by the

concerned Regional Office of the Ministry/SPCB / CPCB. A six monthly compliance status report

shall be submitted to monitoring agencies and shall be posted on the website of the Company.

15- The project proponent shall inform the public that the project has been accorded environmental

clearance by the SEIAA and copies of the clearance letter are available with the SPCB/Committee

and may also be seen at Website of the SEIAA. This shall be advertised within seven days from

the date of issue of the clearance letter, at least in two local newspapers that are widely circulated

in the region of which one shall be in the vernacular language of the locality concerned and a copy

of the same shall be forwarded to the concerned Regional Office of the Ministry.

16- The SEIAA/ MoEF may revoke or suspend the clearance, if implementation of any of the above

conditions is not satisfactory.

17- The SEIAA/MoEF reserves the right to stipulate additional conditions, if found necessary. The

company in a time bound manner will implement these conditions.

18- The above conditions will be enforced, inter-alia under the provisions of the Water(Prevention &

Control of Pollution) Act,1974, Air (Prevention & Control of Pollution) Act, 1981, the

Environment (Protection) Act, 1986 Hazardous Wastes (Management and Handling) Rules, 2003

and the Public Liability Insurance Act, 1991 along with their amendments and rules.

16. Tennery of HMA Natural Food Ltd., Plot No-1478-1496, Sheshpur, Nari, Unnao, U.P.

HMA Natural Food Ltd, 1616/OSD-T

After a presentation made by the project proponent in the SEAC meeting on 9.1.2016 the

SEAC directed the project proponent to submit following information:

1. Approved Map/plan from the competent authority should be submitted.

The committee also directed the secretariat to issue a letter to the concerned authority

regarding the approval of the Map/plan of the same so that the Environment Clearance could be

issued.

Mr. Ahmad Quarashi representative of the project proponent and their consultant Perfact

Enviro Solutions pvt ltd consultant presented the reply before SEAC.

The SEAC after discussion decided to ask the following information from the project

proponent.

1. Approved Map/plan from the competent authority should be submitted so as to

ascertain the land-use of the project site.

2. The SEAC can consider the case even if the project proponent can produce a letter

from Lucknow Industrial Development Authority mentioning that Approved Map

/Plan will be issued after obtaining the EC letter from SEIAA.

The case will be considered after submission of above information.

17. Mega Leather Cluster located at Vill-Kuraina Bahadurnagar & Senpuirabpara Near

Ramaipur, Kanpur. Sri Ashraf Rizwan, Sultan Tanners, Jajmau, Kanpur. 2070/OSD-T

The matter was considered in the SEAC meeting dated 15-02-2016. A presentation was

made by Shri Asharf Rizwan, project proponent alongwith their consultant M/s Perfect Enviro

Solution Pvt. Ltd. The Committee noted that the project proponent submitted their replies through

letter dated 06/02/2016 regarding the SEAC queries dated 09/01/2016.

In the above reference, the committee discussed the replies and noted that the project proponent through his letter dated 06-02-2016 informed that the layout approved from competent authority

which is submitted along with this letter. The SEAC gone though the submitted layout plan and found that the layout plan is signed by the Managing director, UPSIDC. The SEAC is of the

opinion that there should be a board or authority that will be responsible for approving the layout plan. In this regard the SEAC wanted to know the Name of Authority /board who approve the

layout plan. The SEAC gone through the submitted layout plan and observed that copy of the Govt Order/

Competent Authority giving the approvals of Proposed Master Plan showing the different Land uses of the declared Industrial Development Area duly incorporating the Lay Out of the proposed

Mega Cluster has not been submitted so far. The committee further desired to provide a

registered agreement between the Project Proponent and the Nagar Nigam Kanpur regarding the

disposal of the treated industrial effluent after mixing with the Domestic Treated Waste. The

committee also desired a time bound programme in this regard. The committee also suggested for

Zero Liquid Discharge Policy.

The proponent will ensure that all the maps/ layout plan are signed by qualified architect/town

planner/engineer along with layout plan, all services plan like, services, water supply, external

electrification, landscape plan, rain water harvesting all cross section of proposed road showing

proposed services with right of way and carriage way to be submitted. The layout plan must be

prepared as per by laws of the Authority with provision of peripheral green area under open space

and green to be marked on the layout plan. They layout plan must have area dully showing all land use proposed in the approved layout plan.

The UPSIDA will also issue a certificate that the 77 Ha of land in proposed in layout plan will be accommodated with total area of UPSIDA as acquired in master plan/zonal plan to be approved

by UPSIDA/competent authority. The estimated cost of all services/ infrastructure will have to be submitted along with details report.

All plan and layout and services plan also must be signed by the proponent with date and name therein.

All the development works like roads and services/Infrastructure will have to be carried out by the proponent for which an agreement will have to be signed with UPSIDA.

The SEAC, therefore, directed to the project proponent to submit the same within 15 days period

matter shall be discussed after submission of information as above.

The project proponents submitted the reply in this regard. A presentation was made by the

project proponent alongwith their consultant M/s Perfact Enviro Solutions Pvt. Ltd. The

proponent, through the documents submitted and the presentation made, informed the committee

that:-

1. The environmental clearance is sought for Mega Leather Cluster located at Vill-Kuraina

Bahadurnagar & Senpuirabpara Near Ramaipur, Kanpur.

2. Proposed Industrial Estate “Mega Leather Cluster” will be developed at Villages Kurauna

Bahadur Nagar & Senpurab Para near Ramaipur District, Kanpur Nagar District, U.P. on

land admeasuring 708202.78 sqm (175 acres) land having 138 tannery units. The units

proposed to be set up would house tanners as well as finished leather product

manufacturers.

3. Some leading Tannery Owners have formed the SPV “Leather Cluster Development

Limited” with an objective of setting up of the Mega Leather Cluster under the “Scheme

for Setting up of Mega Leather Clusters” under the Integrated Leather Development

Programme (ILDP) of Ministry of Commerce and Industry (MoCI), Department of

Industrial Policy and Promotion (DIPP), Government of India (GoI).

4. The land has been allotted by U.P.S.I.D.C. The land will be allotted to SPV “M/s Mega

Leather Cluster Development (U.P.) Ltd.” by UPSIDC for setting up of the Park under the

Mega Leather Cluster scheme of DIPP. The area is in a proposed new industrial estate.

The allotment of land to the SPV by UPSIDC is under progress.

5. The plots shall be of two categories with size ranging from 2000 sqm to 4000 sqm with

total 138 units. Total Proposed capacity for 138 Tannery Units: 73,71,000 Hides/Skins per

annum i.e. 561.6 TPD.

6. The project falls under category B of schedule 7 (c) as per the EIA Notification dated 14th

September 2006.

7. The Terms of Reference (TOR) for the proposed Leather cluster vide Reference No.

337/Parya/2070/SEAC/2013/OSD-T Dated 19 May, 2014 was issued & EIA Report with

compliance of TOR was submitted to the SEAC on 28th May, 2014.

12. The project proposals are covered under category 4(f) of EIA Notification, 2006.

The committee discussed the replies and recommended grant of environmental

clearance alongwith following general and specific conditions:

SPECIFIC CONDITIONS: 1- Approval of layout alongwith letter from sanctioning authority (UPSIDA) with stamped

layout on maps to be submitted within a month. This EC will deemed to be cancelled if the project proponent fail to submit the approved map.

2- The proponent should submit an affidavit to comply all the orders of NGT/Hon'ble

Supreme Court regarding the ZLD as an alternative waste handling technology.

3- All the maps and drawings should be signed by architect.

4- Agreement between Mega leather cluster and UP Ganga Pollution Control Unit as made

on 07/06/2016 has to be submitted with the undertaking that the project proponent comply

with the conditions mentioned.

5- All service plan to be submitted within a month. Under this service plan electrical poles,

water, waste water, sewer, storm water drainage, rain water harvesting, STP, external

electrification be marked.

6- Industrial and storm water drains to be covered.

7- Submit undertaking that all development works will be executed as per UPSIDA bye-laws

within a month.

8- It will be the responsibility of each industrial unit to earmark atleast 2% project cost for CSR activities.

9- The project authority shall install the complete treatment plant with zero liquid discharge prior to start of the project. To achieve the standards prescribed by Uttar Pradesh Pollution

Control Board. 10- Provision of Online monitoring before recycling of treated water should be made.

11- Chromium recovery plant shall be installed to recover the Chromium to the maximum extent as per standards and proper disposal of the Chromium bearing sludge should be

ensured as per the Hazardous Waste (Management & Handling ) Rules,1989 and as

amended.

12- The site for Hazardous Waste disposal should be identified and earmarked. Information

should be submitted to SEIAA.

13- To reduce the TDS concentration in the primary treated effluent, cleaner technologies as

recommended in the EIA report e.g. dry salting for reduction of TDS in waste water,

counter current soaking to reduce wastewater quantity, enzyme assisted liming process,

combined pickling tanning process, pretreatment and segregation of wastes etc. shall be

practiced and soak liquor shall be segregated and evaporated in the solar evaporation

ponds.

14- The spent soak liquor containing high concentration of salt shall be discharged into the

Solar Evaporation Pond (SEP).

15- Adequate number of influent and effluent quality monitoring stations shall be set up in consultation with the UP State Pollution Control Board. Regular effluent quality

monitoring shall be carried out for relevant parameters and the monitored data along with the statistical analysis and interpretation shall be submitted to the Regional office of this

Ministry at Lucknow once in six months and to the UP State Pollution Control Board once in three months.

16- The company shall dispose of solid waste in the secured double lined landfill site. The flashings from the tannery shall be supplied to the manufacturers of dog chew and glue.

Manufacturing approved by UPPCB.

17- Environment Corporate Responsibility (ECR) plan with budgetary provision of minimum

2% of project cost shall be prepared and submitted on need base assessment study in the

study area. Details of CSR activities and list of beneficiaries with their mobile nos. also be

submitted.

18- Location of fire hydrant as per provision in building bye-laws to be mentioned in layout

plan and is to be submitted.

19- Cross section of the roads showing all services is to be submitted.

20- The tannery unit shall adopt recovery and reuse of chrome/Alutan BCS/closed-loop

Alutan-BCS combined tanning process to ensure maximum chromium recovery and

minimum chromium discharge in the effluent. 21- The project authorities shall develop 33% of the total area as green belt as per the

guidelines of State Govt. to mitigate the effect of odour nuisance from the plant with peripheral green and tree plantation in road at 05 m.

22- The project authorities shall undertake environmental auditing on annual basis. 23- An adequate municipal waste treatment and disposal treatment facility shall be

installed/identified for the project. 24- Structural design duly weighted by IIT to be submitted within a month in the office of

Directorate.

25- All bases and contender of hazardous chemicals to be used in the possess shall be toughly

cleaned and disposal shall be in the accordance with law.

26- Adequate collection treatment and disposal facility for leachate shall be ensured prior to

commissioning of the project.

27- The common facility must insure proper collection of process waste including metering of

waste generated form tannery unit.

28- The total cost of the project is Rs. 2717.0 Cr. The CSR cost is Rs. 54.34 Cr. Details of CSR cost with phase wise, project wise development works alongwith list of beneficiaries

and address is to be submitted with photographs.

B. GENERAL CONDITIONS: 1- The project authorities shall strictly adhere to the stipulations of the SPCB/state

government or any statutory body. 2- All the effluent shall be properly treated and finally treated effluent shall meet the norms

stipulated by the UP Pollution Control Board or under Environment (P) Rules 1986.

3- No further expansion or modifications in the plant shall be carried out without prior

approval of the Ministry of Environment and Forests. In case of deviations or alterations

in the project proposal from those submitted to SEIAA for clearance, a fresh reference

shall be made to the Ministry to assess the adequacy of conditions imposed and to add

additional environmental protection measures required, if any.

4- The locations of ambient air quality monitoring stations shall be installed in consultation

with the State Pollution Control Board (SPCB) and in the downwind direction as well as

where maximum ground level concentrations are anticipated.

5- Proper housekeeping shall be maintained within the plant premises. Process machinery,

exhaust and ventilation systems will be laid in accordance with Factories Act.

6- The project authorities shall strictly comply with the rules and guidelines under

Manufacture, Storage and Import of Hazardous Chemicals Rules, 1989 as amended from time to time. Authorization from the SPCB shall be obtained for collection, treatment,

storage, and disposal of hazardous wastes. 7- The overall noise levels in and around the plant area shall be kept well within the

standards by providing noise control measures including acoustic hoods, silencers, enclosures etc. on all sources of noise generation. The ambient noise levels shall conform

to the standards prescribed under Environment (Protection) Act, 1986 Rules, 1989 viz. 75 dBA (day time) and 70 dBA (night time).

8- The company shall develop rain water harvesting structures only from roof top to harvest

the runoff water for recharge of ground water.

9- The company shall obtain permission from the State Ground water Authorities to draw the

ground water. Occupational health surveillance of the workers shall be carried out on a

regular basis and records shall be maintained as per the Factories Act.

10- The company shall undertake eco-developmental measures including community welfare

measures in the project area for the overall improvement of the environment.

11- The project proponent shall also comply with all the environmental protection measures

and safeguards proposed in the EIA/EMP report.

12- A separate Environmental Management Cell equipped with full fledged laboratory facilities shall be set up to carry out the Environmental Management and Monitoring

functions. 13- The project authorities shall earmark adequate funds to implement the conditions

stipulated by the Ministry of Environment and Forests as well as the State Government along with the implementation schedule for all the conditions stipulated herein. The funds

so provided shall not be diverted for any other purpose. 14- The implementation of the project vis-à-vis environmental action plans shall be monitored

by the concerned Regional Office of the Ministry/SPCB / CPCB. A six monthly compliance status report shall be submitted to monitoring agencies and shall be posted on

the website of the Company.

15- The project proponent shall inform the public that the project has been accorded

environmental clearance by the SEIAA and copies of the clearance letter are available

with the SPCB/Committee and may also be seen at Website of the SEIAA. This shall be

advertised within seven days from the date of issue of the clearance letter, at least in two

local newspapers that are widely circulated in the region of which one shall be in the

vernacular language of the locality concerned and a copy of the same shall be forwarded

to the concerned Regional Office of the Ministry.

16- The SEIAA/ MoEF may revoke or suspend the clearance, if implementation of any of the

above conditions is not satisfactory.

17- The SEIAA/MoEF reserves the right to stipulate additional conditions, if found necessary. The company in a time bound manner will implement these conditions.

18- The above conditions will be enforced, inter-alia under the provisions of the Water(Prevention & Control of Pollution) Act,1974, Air (Prevention & Control of

Pollution) Act, 1981, the Environment (Protection) Act, 1986 Hazardous Wastes (Management and Handling) Rules, 2003 and the Public Liability Insurance Act, 1991

along with their amendments and rules.
