Minutes of 204 th SEAC Meeting Dated 21/02/2015 The 204 th meeting of SEAC was held in Directorate of Environment, U.P. on 21/02/2015. The minutes of 203 rd SEAC meeting dated 20/02/2015 were confirmed. The Members of SEAC unanimously taken following decisions on the agenda points discussed: 1- Group Housing Project “Cosmic Corporate Park-3” at Plot No-1, Sector-154, Noida, U.P. M/s Surya Jyoti Software Pvt. Ltd. Sri Sandeep Pahwa, Director, 281, Azad Mandi, Delhi, File No. 2082/ AD-H. The committee noted that Mr. Sandeep Pahwa, Director, M/s Surya Jyoti Software Pvt. Ltd. submitted an application dated 01/10/2013 in the Directorate for environmental clearance for Expansion of Group Housing Project “Cosmic Corporate Park-3” at Plot No-1, Sector-154, Noida, U.P. The matter was earlier discussed in SEAC meeting dated 07/06/2014 wherein the project proponent did not appear. The committee also observed that the project reports have also not been circulated to Members. The matter was deferred. The matter was again scheduled for appraisal in SEAC meeting dated 21/02/2015. A presentation was made by Shri Lakhvendar Singh, authorized representative alongwith their consultant M/s Development Consultants Pvt. Ltd., Kolkata. The committee observed that plot area of the project is mentioned as 20,002.40 sqm however the possession on the site has only been provided for plot area 15,000 sqm by the Noida Authority. The committee also observed that the whole proposal is calculated for plot area 20,002.40 sqm which should be revised as per actual availability of land. The committee also found that some constructed areas like parking, basement etc. have not been included in built-up area. The committee directed the project proponent to revise and submit the matter for appraisal. The matter is deferred till submission of revised proposals. The matter shall discussed by committee after submission of information as above.

The 204th meeting of SEAC was held in Directorate of Environment, U.P. on

21/02/2015. Following members were present in the meeting along with Secretary,

The Chairman welcomed the members to the 204th SEAC meeting.

The minutes of 203rd SEAC meeting dated 20/02/2015 were confirmed.

The Members of SEAC unanimously taken following decisions on the agenda points

discussed:

1- Group Housing Project “Cosmic Corporate Park-3” at Plot No-1, Sector-154, Noida,

U.P. M/s Surya Jyoti Software Pvt. Ltd. Sri Sandeep Pahwa, Director, 281, Azad

Mandi, Delhi, File No. 2082/ AD-H.

The committee noted that Mr. Sandeep Pahwa, Director, M/s Surya Jyoti Software

Pvt. Ltd. submitted an application dated 01/10/2013 in the Directorate for environmental

clearance for Expansion of Group Housing Project “Cosmic Corporate Park-3” at Plot No-1,

Sector-154, Noida, U.P. The matter was earlier discussed in SEAC meeting dated 07/06/2014

wherein the project proponent did not appear. The committee also observed that the project

reports have also not been circulated to Members. The matter was deferred. The matter was

again scheduled for appraisal in SEAC meeting dated 21/02/2015.

A presentation was made by Shri Lakhvendar Singh, authorized representative

alongwith their consultant M/s Development Consultants Pvt. Ltd., Kolkata. The committee

observed that plot area of the project is mentioned as 20,002.40 sqm however the possession

on the site has only been provided for plot area 15,000 sqm by the Noida Authority. The

committee also observed that the whole proposal is calculated for plot area 20,002.40 sqm

which should be revised as per actual availability of land. The committee also found that

some constructed areas like parking, basement etc. have not been included in built-up area.

The committee directed the project proponent to revise and submit the matter for appraisal.

The matter is deferred till submission of revised proposals. The matter shall discussed by

committee after submission of information as above.

2- Expansion of Group Housing Project "Galaxy North Avenue" at plot no. GC-3,

Gaur City-1, Sector-4, Noida, U.P. Ms. Manju Sharma, G.M. Project, D-255, Vivek

Vihar, New Delhi File No. 2277/ DD-Sh.

The committee noted that M/s Galaxy International Realtech (P) Ltd. submitted an

application dated 05/05/2014 in the Directorate for environmental clearance of Expansion of

Group Housing Project "Galaxy North Avenue", GC-3, Gaur City, Sector-4, Noida, U.P. The

mater was earlier discussed in SEAC meeting dated 10/01/2015 wherein the project

proponent did not appear. Later, though their letter dated 12/01/2015 the proponent informed

that he could not attend the meeting dated 10/01/2015 due to health reasons and requested to

include the matter in SEAC agenda for consideration. The matter was again scheduled for

appraisal in SEAC meeting dated 21/02/2015.

A presentation was made by Shri Rajesh Jodhani, project proponent along with their

consultant M/s EQMS India Pvt. Ltd. The proponent, through the documents submitted and

the presentation made, informed the committee that:-

1. The environmental clearance is sought for Expansion of Group Housing Project

"Galaxy North Avenue" at plot no. GC-3, Gaur City-1, Sector-4, Noida, U.P. M/s

Galaxy International Realtech (P) Ltd.

2. M/s Gaursons Hi-tech Infrastructure (P) Ltd. has taken environment clearance for

development of the Project Integrated Township “Gaur City” at GH-01, Sector-4,

Greater Noida, G.B.Nagar, U.P vide letter no. 470/SEAC/531/2010/AA(S)/ dated

11th January, 2011. M/s Gaursons has also obtained Consent to Establish from

UPPCB for construction of the project vide letter no. F78749 C-1/N/N.O.C-

686/2010/5 dated 12th January, 2011.

• M/s Gaursons Hi-tech Infrastructure (P) Ltd. has allotted plot no GC-03 (part of

plot GH-01) to M/s Galaxy International Realtech (P) Ltd. for development of

Group Housing Project “North Avenue-I”.

• M/s Galaxy International Realtech (P) Ltd. has developed group housing “North

Avenue-I” at Plot No. GC-3, Gaur City-1, Plot No.GH-01, Sector-4, Greater

Noida, Uttar Pradesh. Plot area of this project is 20000 sq.m (4.942 acres). Project

comprises of development of living facility (Block A-F) and allied facilities like

community building, rain water harvesting facility, power supply, landscaping,

roads, water supply system and waste management system. Built-up area of

72846.836 sqm is constructed at the project site till date.

• M/s Galaxy International Realtech (P) Ltd. has planned to expand the project by

developing an additional Block G comprising of 225 dwelling units within the plot

GC-03 to avail additional purchasable FAR of 75% with permission of GNIDA.

Built-up area of the project after expansion will be 96852.071 sqm.

7. The project proposals are covered under category 8"a" of EIA Notification, 2006, as

amended.

The committee noted that the proponent has submitted revised sanctioned Greater

Noida Industrial Development Authority, Structural design approval from Jamia Millia Islamiya, Fie NOC, Airport Authority of India NOC, Site plan, Plumbing plan, parking plan,

rain water harvesting plan, electrical layout, fire fighting plan, landscape plan, storm water management plan, basement plan. The committee discussed the matter and recommended

grant of environmental clearance to the proposals for Expansion of Group Housing Project

"Galaxy North Avenue" at plot no. GC-3, Gaur City-1, Sector-4, Noida, U.P. alongwith

general conditions as prescribed by the authority for construction project and following

specific conditions:

1. All necessary regulatory approvals regarding expansion of the proposed project shall be

obtained after approval of expansion in FAR by GNIDA.

2. Adequate green cover not less than 33% of the plotted area should be provided within

the premises. 3. For the treatment for total sewage, a full-fledged STP is to be provided with 20% more

capacity than waste water generated during operation phase.100% waste water is to be treated in captive STP conforming to prescribed standards of receiving body for

designated use. Monitoring of STP to be done daily till its stabilization. 4. Recycling of water as proposed shall be undertaken with regular testing and monitoring

of treated water. 5. Dedicated power supply for STPs is to be ensured during operation. Sludge of STP is to

be used in-house as manure and surplus manure should be managed by giving it to end

users.

6. Environmental Corporate Responsibility (ECR) plan along with budgetary provision

amounting to Rs. 1.0 crore of total project cost shall be prepared and approved by Board

of Directors of the company. A copy of resolution as above shall be submitted to the

authority.

7. Isolated place for Municipal Solid Waste handling and the disposal shall be provided in

accordance with Municipal Solid Waste (Management and Handling Rules), 2000 (as

amended).

8. Organic waste converter for solid waste management shall be installed and plan

submitted.

9. LEDs should be used in all common areas and corridors. 100% Solar lighting is to be

provided in the common areas/common stairs. 10. Parking guideline as per Greater Noida Development Authority should be followed.

Parking for disabled persons should be explored. 11. All entry/exit point should be bell mouth shaped.

12. To discharge excess treated waste water into public drainage system, permission from the competent authority to be taken prior to any discharge.

13. 100 % provision of Rain Water Harvesting is to be made. RWH shall be initially done only from the roof top. RWH from green and other open areas shall be done only after

permission from CGWB.

14. Height of the stack should be provided as discussed based on combined DG sets

capacity and be 6mt higher than the tallest building.

15. Post project monitoring for air, water (surface+ ground), Stack noise of D.G. sets, STP

to be carried out as CPCB Guidelines.

16. Crèche to be provided during the construction/operation phase.

17. Provision of separate room for senior citizen with proper amenities shall be made.

18. Protection shall be provided on the windows of the high rise flats for security of

residents.

19. Criteria/ norms provided by competent Authority regarding the seismic zone be

followed for construction work.

20. Dual plumbing should be adopted.

21. Unless and until all the environmental issues are sorted out the occupancy will be restricted and would be only allowed after achieving the Permission from the competent

authority. 22. The project proponent shall ensure that the project site does not attract/infringe any

buffer zone of no activity identified/declared under law.

23. Ground water should not be extracted for the purpose of construction or otherwise. In

case of default the Environmental Clearance will deem to be cancelled.

24. Sprinkler to be used for curing and quenching and ready mix concrete may be used for

construction.

25. Possibilities of use of treated waste water for irrigation purposes should be explored.

26. No fresh water will be used for irrigation purpose.

27. Mobile toilets, safe drinking water facility, sanitation facility and eco friendly fuels etc. Shall be made available to the temporary residents/workers at the project site including

the proper treatment and the disposal of the wastes.

3- Group Housing Project at Khasra No-962 M, Vill-Noor Nagar, Ghaziabad, U.P. M/s

Bankey Bihari Infrahome (P) Ltd. Sri Rajeev Agrawal, Director, R-8/54, Raj

Nagar, Ghaziabad U.P. File No. 2332/AD-Sub

The committee noted that M/s Bankey Bihari Infrahome (P) Ltd. submitted an

application dated 19/05/2014 in the Directorate for environmental clearance for Group

Housing Project at Khasra No-962 M, Vill-Noor Nagar, Ghaziabad, U.P. M/s Bankey Bihari

Infrahome (P) Ltd. The matter was earlier discussed in SEAC meeting dated 31/01/2015

wherein the committee observed that the project report has not been received by the

committee members yet and the matter was deferred till next meeting with a instruction to

proponent to communicate the reports to all members. The matter was again schedule for

SEAC meeting dated 21/02/2015.

A presentation was made by Shri Soumen Joarder, authorized representative of the

project proponent along with their consultant M/s Ascenso Management And Consulting

Services Pvt. Ltd. The proponent, through the documents submitted and the presentation

made, informed the committee that:-

The committee discussed the matter and directed the proponent to submit following

information:

1- Physical features within 30 m of the project site alongwith corresponding ownership.

2- Block wise/floor wise area details.

3- Permission of municipal authority for discharge of waste water into municipal sewer/drain.

4- Running cost of operation and maintenance of STP and other environmental management facilities should be submitted. The same should be mentioned in

customer brochure also. 5- A 03 m peripheral green belt shall be left all along the periphery and shall not be

7. 2% Environmental Corporate Responsibility (ECR) plan along with budgetary

provision amounting of total project cost shall be prepared and submitted.

8. 100% solar energy shall be used for open spaces and common stair case. Plan

for the same should be submitted.

ownership.

10. Permission of municipal authority for discharge of waste water into municipal

The committee noted that approved FAR for the project is 2.75 whereas a purchasable

FAR of 0.75 is applied to GNIDA which is not yet approved. However, the project proposals have been prepared on the basis of 3.5 FAR. The committee discussed the matter and

deliberated that appraisal shall be made only on the approved FAR. The project proponents were directed to submit the proposals on the basis of approved FAR. Shri Bhati, authorized

representative of project proponent submitted that it is already 08 months since the submission of the application and requested for early disposal of the matter, the committee

deliberated that the matter may be included in the agenda of next meeting if the revised proposals as above be submitted.

10. Mirza International Ltd. (Tannery Division) at Village- Magarwara, Unnao. Sri

The committee noted that the matter was discussed in joint meeting of SEIAA and

SEAC held on 12/01/2015 wherein following decision was taken:

"It was decided that such projects should be considered as category ‘A’ project and

the exemption should only be considered for projects proposed in Industrial estates

approved by concerned authorities as prescribed in the E.I.A. notification which

clarifies through OM no. J-11013/36/2014-IA-I dated 16-05-2014 that:-

"The expression ‘concerned authorities’ as stated in the aforesaid para of EIA

notification 2006, implies the competent authorities in the State Government/Central

Government, which approve setting up of such Industrial estates or parks. All other

cases as category A should be referred to the Government of India."

The issue of inclusion of industrial land use demarcated in the master plan as eligible

for exemption was also discussed and it was decided that master plan regulations are

for demarcating land uses with or without development as an industrial area/estate and

therefore merely being an Industrial zone in the master plan will not qualify it for

exemption unless it is also an industrial estate as in the EIA notification as above."

The project proponent submitted a letter dated 12/01/2015 received in the Directorate

on 15/01/2015 regarding the matter through which they have submitted certificate from

Public Information Officer, Unnao Shuklaganj Development Authority and letter dated

03/06/1989 of Joint Secretary, Awas Anubhag-3, Govt. of Uttar Pradesh. Alongwith the

same, map of Unnao Shuklaganj Mahayojna have also been submitted wherein land use of

location of Mirza International Ltd., Unnao has been indicated as "Light Industry".

The committee discussed the matter in the light of EIA Notification, 2006 wherein it

has been provisioned that tannery projects outside the notified industrial area shall be treated

as category-A and environmental clearance for them shall be granted by MoEF, Govt. of

India. The committee also discussed the documents submitted by the project proponent and

deliberated that a communication should be made to Industrial Development Department,

Govt. of U.P. to confirm that whether Unnao Shuklaganj Development Authority is

competent to declare Magarwara Unnao as notified industrial area (where M/s Mirza

International Ltd. is situated.). The communication should also include the related documents

submitted by proponent to get comment of Industrial Development Department regarding its

location. A copy of this communication should be endorsed to project proponent also.

The matter shall be discussed after receipt of information from Industrial

Development Department in this regards.

15. Study the existing flora and fauna of the area and the impact of the project on them.

from National Board Wild Life (NBWL) even if the eco- sensitive zone is not

39. Declare/submit the running cost of STP and other environmental management

services (e.g., Municipal Solid Waste Disposal, Green belt Maintenance, Water

Management etc.) in the proposals which are to be including in the allotment letters.

40. The proponent will submit the schedule of monitoring/data collection programme to

the Office of Directorate, Member Secretary, UP Pollution Control Board and District

Magistrate of related District.

General Guidelines

a. A legal affidavit by the Project proponent on Rs. 100/- non-judicial Stamp Paper, duly

attested by Public Notary, stating that:

I. “There is no litigation pending against the project and/or land in which the project is

proposed to be set up (please give name & ownership etc. of the project) and that for

any such litigation what so ever, the sole responsibility will be borne by the Project

proponent.”

II. “No activity relating to this project (i.e. name of the project) including civil

construction has been undertaken at site except fencing of the site to protect it from

getting encroached and construction of temporary shed(s) for the guard(s). (if fencing

has not been done, then the same may be deleted).

III. “I/We hereby give undertaking that the data and information given in the application,

enclosures and other documents are true to the best of my knowledge and belief and

I/We am/are aware that if any part of the data and information submitted is found to

be false or misleading at any stage, the project will be rejected and clearance given,

if any to the Project will be revoked at our risk and cost.”

IV. Project does not fall under any buffer zone of no-development as declared /identified

under any law.

b. Another legal affidavit by the consultant stating “(a) that the prescribed TORs have been

complied with (to be deleted if not applicable) & (b) that details and the data presented

are factually correct”, as per MoEF circular dated 04.08.2009 is also to be submitted

along with EIA.

c. Current, site photographs viewing towards the project area from four directions

indicating date of photograph taken, direction from which taken, name of the project,

and signature of Project proponent along with consultant with seal should be submitted,

so as to ensure that no construction has been started before the grant of EC.

d. EIA should strictly follow the guidelines prescribed in annexure-III to the EIA

notification of 2006 and the Methods of Monitoring and analysis (Annexure-IV):

Guidance for assessment of representativeness and reliability of baseline environmental

attributes detailed under EIA manual January, 2001 and other guidelines in the matter.

e. The status of accreditation of the EIA consultant with NABET/QCI shall be specifically

mentioned. The consultant shall certify that his accreditation is for the sector for which

this EIA is prepared.

f. On the front page of EIA/EMP reports, the name of the consultant/consultancy firm

along with their complete details including their accreditation, if any shall be indicated.

g. While submitting the EIA/EMP reports, the name of the experts associated

with/involved in the preparation of these reports and the Name of laboratory through

which the samples have been got analysed should be stated in the report. It shall clearly

be indicated whether said laboratory is accredited by NABL or approved under the

Environment (Protection) Act, 1986 (Please refer MoEF office memorandum dated 4th

August, 2009). The name project leader of the EIA study shall also be mentioned.

h. The EIA document shall be printed on both sides, as for as possible.

The Information’s no (a I , II, III & c) asked under the general guidelines is to be

submitted within 15 days from the date of receipt of the letter and remaining of the

information’s is to be submitted along with the EIA.

3. The project proposals are covered under category 8"a" of EIA Notification, 2006, as

amended.

The committee discussed the replies and recommended grant of environmental

clearance on the project proposals alongwith general conditions as prescribed by the authority earlier and following specific conditions:

1. Off street parking shall be provided within the proponent land to be used for the

purpose of school vans and guardian/teacher vehicles. 2. 2% of total cost of project should be earmarked for CSR activities. A regular

compliance in this regards shall be submitted. The cost of CSR shall not be transferred on students and should be mentioned explicitly in the school brochure.

3. Provision of 100% solar lighting along the roads, parks and common places. 4. Use of reflecting paints on roof top and all side walls shall be undertaken.

5. This environmental clearance issued with respect to the environmental consideration

and it does not mean that State Level Impact Assessment Authority (SEIAA)

approved the proposed land use.

6. The height, Construction built up area of proposed construction shall be in accordance

with the existing FSI/FAR norms of the urban local body & it should ensure the same

along with survey number before approving layout plan & before according

commencement certificate to proposed work. Plan approving authority should also

ensure the zoning permissibility for the proposed project as per the approved

development plan of the area.

7. All required sanitary and hygienic measures should be in place before starting

construction activities and to be maintained throughout the construction phase.

8. Project proponent shall ensure completion of STP, MSW disposal facility. green belt

development prior to occupation of the buildings. No physical occupation or allotment will be given unless all above said environmental infrastructure is installed and made

functional including water requirement.

9. Provision shall be made for the housing of construction labour within the site with all

necessary infrastructure and facilities such as fuel for cooking, mobile toilets, mobile

STP, safe drinking water, medical health care, crèche and First Aid Room etc.

10. Adequate drinking water and sanitary facilities should be provided for construction

workers at the site. Provision should be made for mobile toilets. The safe disposal of

wastewater and solid wastes generated during the construction phase should he

ensured. 11. The solid waste generated should be properly collected and segregated. dry/inert solid

waste should be disposed off to the approved sites for land filling after recovering recyclable material.

12. Wet garbage should be treated by Organic Waste Converter and treated waste (manure) should be utilized in the existing premises for gardening. And, no wet

garbage will be disposed outside the premises. Local authority should ensure this. 13. Arrangement shall be made that waste water and storm water do not get mixed.

14. All the topsoil excavated during construction activities should be stored for use in

horticulture / landscape development within the project site.

15. Additional soil for leveling of the proposed site shall be generated within the sites (to

the extent possible) so that natural drainage system of the area is protected and

improved.

16. Green Belt Development shall be carried out considering CPCB guidelines including

selection of plant species and in consultation with the local DFO/ Agriculture Dept.

17. Alstonia tree to be added in list of trees.

18. Effluents from laboratories shall be pre treated before STP upto STPs intake

standards. 19. Disposal of muck during construction phase should not create any adverse effect on

the neighboring communities and be disposed taking the necessary precautions for general safety and health aspects of people, only in approved sites with the approval

of competent authority. 20. Any hazardous waste generated during construction phase should be disposed off as

per applicable rules and norms with necessary approvals of the Maharashtra Pollution

Control Board.

21. The diesel generator sets to be used during construction phase should be low sulphur

diesel type and should conform to Environments (Protection) Rules prescribed for air

and noise emission standards.

22. Vehicles hired for bringing construction material to the site should be in good

condition and should have a pollution check certificate and should conform to

applicable air and noise emission standards and should be operated only during

nonpeak hours.

23. Ready mixed concrete must be used in building construction.

24. The approval of competent authority shall be obtained for structural safety of the buildings due to any possible earthquake, adequacy of fire fighting equipments etc. as

per National Building Code including measures from lighting. 25. The ground water level and its quality should be monitored regularly in consultation

with Ground Water Authority. 26. Traffic congestion near the entry and exit points from the roads adjoining the

proposed project site must be avoided. Parking should be fully internalized and no public space should be utilized.

27. The building should have adequate distance between them to allow movement of fresh air and passage of natural light, air and ventilation.

28. In the case of any change (s) in the scope of the project, the project would require a

fresh appraisal by this Department.

implementation of the stipulated environmental safeguards.

30. Separate funds shall be allocated for implementation of environmental protection

measures/EMP along with item-wise breaks-up. These cost shall be included as part

of the project cost.

The committee noted that the matter was earlier discussed in SEAC meeting dated 13/12/2014 for grant of Terms of Reference, wherein the project proponents were directed

to submit information. The project proponent submitted their information through letter dated 20/01/2015 received in the Directorate on 30/01/2015.

A presentation was made by Shri Arun Kumar Arya, authorized representative along

with their consultant M/s Enkay Enviro Services Pvt. Ltd. The proponent, through the

documents submitted and the presentation made, informed the committee that:-

44. Corporate Environmental Responsibility

a) Does the company have a well laid down Environment Policy approved by its Board

of Directors? If so, it may be detailed in the EIA report.

b) Does the Environmental Policy prescribe for standard operating process/procedures to

bring into focus any infringement/ deviation/violation of the environmental or forest norms/conditions? If so, it may be detailed in the EIA report.

45. What is the hierarchical system or Administrative order of the company to deal with the environmental issues and for ensuring compliance with the EC conditions. Details

of this system may be given. 46. Does the company have a system of reporting of noncompliance / violations of

environmental norms to the Board of Directors of the company and /or shareholders or stakeholders at large? The reporting mechanism should be detailed in the EIA

The project proponent informed the committee that:

1. Recommendations for environmental clearance of the project were made by the

committee in its meeting dated 16/07/2014.

2. The Authority in its meeting dated 12/08/2014 made following observations:

"

The SEIAA gone through the recommendations of the SEAC regarding the matter and

examined the respective project file. The SEIAA directed the project proponent to-

1. Submit plan for LIG and EWS housing as per Local Development Authority bye-

laws.

2. As under the heading of "Environmental Sensitivity" of from-1 it is mentioned

that there is a natural lake within 15 K.M. of the proposed project boundary.

Submit exact location of the lake on the map with reference to project site with

estimated impacts with proper drainage plan mentioning its final disposal.

3. As the project proponent has submitted that revised layout plan with increased

green belt up to 21% from of 15% map/plan showing 21% green belt should be

submitted.

4. Explain whether the project is submitted for infrastructure development only or it

includes development of all facilities i.e. residential/commercial/facility areas etc.

5. Submit a copy of Land allotment letter in the name of owner of land.

"

3. The project proponent submitted their reply through his letter dated 18-09-214. The

project proponent letter dated 18-09-2014 was put up and discussed in the SEIAA meeting dated 03/12/2014. The SEIAA observed that the information submitted by

the project proponent is very short and not clear. The SEIAA also observed that there

is a natural lake (waster body) adjacent to the project as informed by project

proponent however, no specific details have been submitted by the project proponent.

Hence, the authority directed to refer the matter back to the committee to appraised

the matter in view of issues raised by the authority and to considered sensitivity

around the project.

The committee discussed the matter in light of issues raised by SEIAA and directed the proponent to make a presentation on the queries raised by the SEIAA.

The proponent requested to appear alongwith presentation in next meeting. The committee agreed to include the matter in next SEAC meeting. Copy of reply to be

submitted also to all members of the committee.

15/11/2014 wherein the project proponents were directed to submit information. The project

proponent submitted their information through letter dated 10/12/2014.

A presentation was made by Shri K.C. Tripathi, authorized representative of project

proponent along with their consultant M/s Ascenso Management And Consulting Services

Pvt. Ltd. The proponent, through the documents submitted and the presentation made,

The committee discussed the replies and recommended grant of environmental

clearance on the project proposals alongwith general conditions as prescribed by the authority

earlier and following specific conditions:

1. Adequate green cover not less than 33% of the plotted area should be provided within

the premises. 2. For the treatment for total sewage, a full-fledged STP is to be provided with 20% more

capacity than waste water generated during operation phase.100% waste water is to be treated in captive STP conforming to prescribed standards of receiving body for

designated use. Monitoring of STP to be done daily till its stabilization.

3. Recycling of water as proposed shall be undertaken with regular testing and monitoring

of treated water.

4. Dedicated power supply for STPs is to be ensured during operation. Sludge of STP is to

be used in-house as manure and surplus manure should be managed by giving it to end

users.

5. Copy of Green building Certificate to be submitted regarding extra FAR.

6. Environmental Corporate Responsibility (ECR) plan along with budgetary provision amounting to 2% of total project cost shall be prepared and approved by Board of

Directors of the company. A copy of resolution as above shall be submitted to the authority.

7. Isolated place for Municipal Solid Waste handling and the disposal shall be provided in accordance with Municipal Solid Waste (Management and Handling Rules), 2000 (as

amended). 8. Organic waste converter for solid waste management shall be installed and plan

submitted.

9. LEDs should be used in all common areas and corridors. 100% Solar lighting is to be

provided in the common areas/common stairs.

10. Parking guideline as per Greater Noida Development Authority should be followed.

Parking for disabled persons should be explored.

11. All entry/exit point should be bell mouth shaped.

12. To discharge excess treated waste water into public drainage system, permission from

the competent authority to be taken prior to any discharge.

13. 100 % provision of Rain Water Harvesting is to be made. RWH shall be initially done

only from the roof top. RWH from green and other open areas shall be done only after

permission from CGWB.

14. Height of the stack should be provided as discussed based on combined DG sets

capacity and be 6mt higher than the tallest building. 15. Post project monitoring for air, water (surface+ ground), Stack noise of D.G. sets, STP

to be carried out as CPCB Guidelines. 16. Crèche to be provided during the construction/operation phase.

17. Provision of separate room for senior citizen with proper amenities shall be made. 18. Protection shall be provided on the windows of the high rise flats for security of

residents. 19. Criteria/ norms provided by competent Authority regarding the seismic zone be

followed for construction work.

20. Dual plumbing should be adopted.

21. Unless and until all the environmental issues are sorted out the occupancy will be

restricted and would be only allowed after achieving the Permission from the competent

authority.

22. The project proponent shall ensure that the project site does not attract/infringe any

buffer zone of no activity identified/declared under law.

23. Ground water should not be extracted for the purpose of construction or otherwise. In

case of default the Environmental Clearance will deem to be cancelled.

24. Sprinkler to be used for curing and quenching and ready mix concrete may be used for

construction.

25. Possibilities of use of treated waste water for irrigation purposes should be explored.

26. No fresh water will be used for irrigation purpose.

27. Mobile toilets, safe drinking water facility, sanitation facility and eco friendly fuels etc. Shall be made available to the temporary residents/workers at the project site including

the proper treatment and the disposal of the wastes.

"The committee noted that the project is covered under category 8 "b" with plot area

572.961 ha. The committee after going though the document submitted by the project

proponent deliberated that the project involves a large area and may include sensitivities

which should be explained through DPR of the project. The project proponent should be

directed to submit the detailed project report of the project so that the terms of reference may

be issued in view of details of the project. "

8- The project proposals are covered under category 8"b" of EIA Notification, 2006.

The committee discussed the replies submitted by project proponent and

recommended following TORs and general guidelines for conducting EIA studies regarding

the proposals:

Additional TORs

1. No. of trees to be felled, if any. Status of permission of Forest Department in this

regard.

2. Land use approved by the competent authority.

3. Complete Details of facilities to be developed by the project proponent i.e. for which

environment clearance is sought.

4. A site plan showing the project site and its surroundings with physical features and

topographical details, such as land use, contours and drainage pattern, along with

photographs of the site from all four sides, should be included in the background

information.

5. Sanctioned plans/maps regarding the project with all services plans.

6. All plans and elevation sections/all service plan/landscape plan/standard

electrification plan/drainage/sewerage plan.

7. Structural plan is to be submitted signed by qualified structural designer.

8. All service plans like sewer drainage water supply rain water harvesting fire fighting

landscape plan is to be submitted.

9. Examine in detail the proposed site with reference to impact on infrastructure

covering water supply, storm water drainage, sewerage, power, etc., and the disposal

of treated/raw wastes from the complex on land/water body and into sewerage system.

10. Water requirement and water management plan alongwith necessary permissions for

discharge.

11. Hydro-geological investigations be carried out and obtain permission from Central

Ground Water Authority for withdrawal of ground water.

12. Consider soil characteristics and permeability for rainwater harvesting proposals,

should be made to prevent ground water contamination. Maximize use of treated

water by recycling and utilization of rainwater.

13. Make provision for safety against failure in the operation of wastewater treatment

facilities. Identify acceptable outfall for treated effluent.

14. Details of green belt as a measure for mitigation of dust and noise and buffer between

habitation and proposed project.

15. Landscape plan, green belts and open spaces may be described separately.

16. Study the existing flora and fauna of the area and the impact of the project on them.

17. Examine existing crèche, education, health facilities, police, post Office, Banks and

other services and make adequate provisions in the proposal.

18. Assess soil erosion in view of the soil characteristics, topography and rainfall pattern.

19. Application of renewable energy/alternate energy, such as solar and wind energy may

be described including solar water heating in the guidelines for entrepreneurs.

20. Consider solid wastes, including e-waste in addition to other solid wastes and their

disposal.

21. Identification of recyclable wastes and waste utilization arrangements may be made.

22. Explore possibility of generating biogas from biodegradable wastes.

23. Arrangements for hazardous waste management may be described as also the

common facilities for waste collection, treatment, recycling and disposal of all

effluent, emission and refuse including MSW, biomedical and hazardous wastes.

Special attention should be made with respect to bird menace.

24. Provisions made for safety in storage of materials, products and wastes may be

described.

25. Disaster management plan should be prepared.

26. Traffic management plan including parking and loading/unloading areas may be

described. Traffic survey should be carried out both on weekdays and weekend.

27. Parking provision is to be made for higher ECS worked out either as per state bye-

laws or construction manual of the MoEF

28. Exclusive Parking area in the basement (excluding other facilities) and surface is to be

clearly mentioned

29. Provide service road for entry and exit to project site.

30. Use of local building materials should be described.

31. Consider provision of DG Flue Gas emissions to be treated in a scrubber. Stack

details with provisos of sampling port for monitoring be described.

32. Work out MGLC for the combined capacity of DG sets.

33. Provide for conservation of resources, energy efficiency and use of renewable sources

of energy in the light of ECBC code.

34. Application of resettlement and rehabilitation policy may be described. Project

affected persons should be identified and rehabilitation and resettlement plan should

be prepared.

35. Examine separately the details for construction and operation phases both for

Environmental Management Plan and Environmental Monitoring Plan.

36. Environment Corporate Responsibility (ECR) plan along with budgetary provision of

minimum 2% of the project cost as discussed in meeting shall be submitted on need

base assessment study in the study area.

37. Details of all internal and peripheral roads width.

38. Source and quantity of required water during construction and management of

generated waste water.

39. Project falling with in 05 Km. area of Wild Life Sanctuary is to obtain a clearance

from National Board Wild Life (NBWL) even if the eco- sensitive zone is not

earmarked.

40. Declare/submit the running cost of STP and other environmental management

services (e.g., Municipal Solid Waste Disposal, Green belt Maintenance, Water

Management etc.) in the proposals which are to be including in the allotment letters.

41. The proponent will submit the schedule of monitoring/data collection programme to

the Office of Directorate, Member Secretary, UP Pollution Control Board and District

Magistrate of related District.

General Guidelines

a. A legal affidavit by the Project proponent on Rs. 100/- non-judicial Stamp Paper, duly

attested by Public Notary, stating that:

I. “There is no litigation pending against the project and/or land in which the project is

proposed to be set up (please give name & ownership etc. of the project) and that for

any such litigation what so ever, the sole responsibility will be borne by the Project

proponent.”

II. “No activity relating to this project (i.e. name of the project) including civil

construction has been undertaken at site except fencing of the site to protect it from

getting encroached and construction of temporary shed(s) for the guard(s). (if fencing

has not been done, then the same may be deleted).

III. “I/We hereby give undertaking that the data and information given in the application,

enclosures and other documents are true to the best of my knowledge and belief and

I/We am/are aware that if any part of the data and information submitted is found to

be false or misleading at any stage, the project will be rejected and clearance given,

if any to the Project will be revoked at our risk and cost.”

IV. Project does not fall under any buffer zone of no-development as declared /identified

under any law.

b. Another legal affidavit by the consultant stating “(a) that the prescribed TORs have been

complied with (to be deleted if not applicable) & (b) that details and the data presented

are factually correct”, as per MoEF circular dated 04.08.2009 is also to be submitted

along with EIA.

c. Current, site photographs viewing towards the project area from four directions

indicating date of photograph taken, direction from which taken, name of the project,

and signature of Project proponent along with consultant with seal should be submitted,

so as to ensure that no construction has been started before the grant of EC.

d. EIA should strictly follow the guidelines prescribed in annexure-III to the EIA

notification of 2006 and the Methods of Monitoring and analysis (Annexure-IV):

Guidance for assessment of representativeness and reliability of baseline environmental

attributes detailed under EIA manual January, 2001 and other guidelines in the matter.

e. The status of accreditation of the EIA consultant with NABET/QCI shall be specifically

mentioned. The consultant shall certify that his accreditation is for the sector for which

this EIA is prepared.

f. On the front page of EIA/EMP reports, the name of the consultant/consultancy firm

along with their complete details including their accreditation, if any shall be indicated.

g. While submitting the EIA/EMP reports, the name of the experts associated

with/involved in the preparation of these reports and the Name of laboratory through

which the samples have been got analysed should be stated in the report. It shall clearly

be indicated whether said laboratory is accredited by NABL or approved under the

Environment (Protection) Act, 1986 (Please refer MoEF office memorandum dated 4th

August, 2009). The name project leader of the EIA study shall also be mentioned.

h. The EIA document shall be printed on both sides, as for as possible.

The Information’s no (a I , II, III & c) asked under the general guidelines is to be

submitted within 15 days from the date of receipt of the letter and remaining of the

information’s is to be submitted along with the EIA.

The committee was informed that M/s Indian Oil Corporation Ltd, Lucknow has submitted a letter dated 23/01/2015 through which they have informed that:

1. M/s Indian Oil Corporation Ltd, is proposing to set up a new Lube Blending

cum filling plant at Plot no.: 491, 492 495, 496, 497, 498, 499, 500,

501,502,503,504,505Kha, 506,507,508 & 510 Village: Amousi Distt:

Lucknow. In this plant they will prepare different grades of Lubricants by

mixing of base oil with additives.

2. M/s Indian Oil Corporation Ltd want to inform SEIAA that all the products

i.e. Base oil, Additives and Lubricants are non- Hazardous in nature. They

have attached project report with detailed products specifications & operation

design basis and communication from our Quality Control Department

regarding nature of the products proposed to be handled at Lube plant. They

have also received NOC for the project from State Pollution Control Board

(UPPCB) copy of the same.

3. As per point 6(b) of schedule attached notification issued by Ministry of Environment & Forests dated 14.09.2006, hazardous petroleum products fall

under Category B . Since the product which M/s Indian Oil Corporation Ltd are proposing to handle is non-hazardous in nature so they need SEIAA

guidance whether Environmental Clearance for the project is applicable for their project.

4. M/s Indian Oil Corporation Ltd has attached the details of the project with process flow diagram Environment management plan for your kind reference.

The committee discussed the matter and deliberated that project proponent

should go through the provisions of EIA Notification, 2006 and should decide whether they require a clearance this activity. It is necessary to submit a project in

prescribed form-1 and other documents to SEIAA for making any decision in this regards which has not been submitted by the project proponent. However, the

committee directed that Secretariat examine the matter on the basis of provisions of

EIA Notification and put up a note for Authority.

The committee noted that M/s SKV Infotech through their letter dated 20/01/2014 has submitted that they have applied for environmental clearance of Institutional Complex

"Wisten Park" at plot no. 17, knowledge park-V, Greater Noida on 13/10/2014 and has

not been appraised till date. They have also submitted that the project has also been

submitted for green building certification of IGBC hence, they should be given priority in

appraisal as per MoEF OM dated 10/05/2011.

The committee discussed the matter and deliberated that matters at SEAC are being

considered in chronological order and the said matter shall also be taken up

chronologically. However, the committee is trying its level best to increase the frequency

of meetings so that the pendency can be disposed at the earliest. The committee also

deliberated that priority shall be given to only those project which have applied alongwith

precertification of Green Building. In present matter no precertification has been

submitted hence, the project proponent can not claim for priority on the basis of mere

submission of application to IGBC.

The committee was informed that Shri Sanjay Srivastava, Advocate, High Court

through his letter dated 29/01/2015 has legally advised that project proposal "Arsha

Sumangalam", 14/GH-13-C, Sector-14, Vrindavan Yojna, Lucknow is pending at SEIAA

since 17/07/2014 for environmental clearance and has not cleared it in statutory period.

meeting, failure to which will lead appropriate actions against SEAC.

The committee noted that M/s Gaursons Hi-tech Infrastructure Pvt. Ltd. submitted an

application dated 10/05/2014 in the Directorate for environmental clearance for Expansion &

Modification of Township “Gaur City” at Plot no. GH-01, Sector-4, Noida.

A presentation was made by Shri Devendra Bhandari, representative of project

proponent. The proponent, through the documents submitted and the presentation made,

14. Permission of municipal authority for water supply and discharge of waste

water into municipal sewer/drain.

15. Width of internal roads should be according to length of junction to junction.

It should be corrected accordingly.

16. Land use of the proposed site should be as per proposed activity. Submit the

related papers.

17. A definite proposal the treatment and recycling of a portion of the domestic

effluents in order to reduce the fresh water load should be incorporated and

detailed submitted.

The matter shall be discussed after submission of information as above.

12/10/204.

A presentation was made by Shri Rahul Mittal along with their consultant M/s Prakriti

Consultant Services. The proponent, through the documents submitted and the presentation

made, informed the committee that:-

3. The project is covered under category 3"b" of EIA notification, 2006.

The committee discussed the matter and recommended following TORs and general

guidelines for conducting EIA studies regarding the proposals:

Additional TORs:

1. Approved plan/layout plan from Bulandshahar Industrial Development Authority. 2. Details of total area, covered area, open area, factory area, lab area, raw material store

yard.

3. Environment Impact study must be done (by a consultant registered/certified as per QCI

notification/MoEF directives) in an area of 15 km radius with inclusion of following

aspects:

4. Present land use based on satellite imagery should be included. Study area should be 10

Km radius. 5. Details of location of wildlife sanctuary and national parks within 10 km radius of the

plant and plan for conservation and protection of the same should be included. 6. Manufacturing process details for the cement plant should be included.

7. Mass balance for the raw material and products should be included. 8. Energy balance data for all the components should be incorporated.

9. Site-specific micro-meteorological data for temperature, relative humidity, hourly wind speed and direction and rainfall including inversion height and mixing height should be

included. 10. Collection of baseline data on air, water (surface and ground water), soil, noise,

demography etc. for one season other than monsoon should be included and the Methods

of Monitoring and analysis (Annexure-IV): Guidance for assessment of

representativeness and reliability of baseline environmental attributes detailed under EIA

manual January, 2001 and other guidelines in the matter.

11. Ambient air quality at 8 locations within the study area of 10 km., aerial coverage from

project site with one AAQMS in downwind direction should be carried out.

12. The suspended particulate matter present in the ambient air must be analyzed for the

presence of poly-aromatic hydrocarbons (PAH), i.e. Benzene soluble fraction. Chemical

characterization of RSPM and incorporating of RSPM data.

13. Ambient air quality modeling for cement plant should be included. Air quality modeling

for all the plants proposed for specific pollutants needs to be done. APCS for the control of emissions from the kiln and WHRB should also be included.

14. Ambient air quality monitoring modeling along with cumulative impact should be included for the day (24 hrs) for maximum GLC along with following:

i. Emissions (g/second) with and without the air pollution control measures. ii. Meteorological inputs (wind speed, m/s), wind direction, ambient air temperature,

cloud cover, relative humidity & mixing height) on hourly basis. iii. Model input options for terrain, plume rise, deposition etc.

iv. Print-out of model input and output on hourly and daily average basis. v. A graph of daily averaged concentration (MGLC scenario) with downwind distance

at every 500 m interval covering the exact location of GLC.

vi. Details of air pollution control methods used with percentage efficiency that are

used for emission rate estimation with respect to each pollutant.

vii. Applicable air quality standards as per LULC covered in the study area and %

contribution of the proposed plant to the applicable Air quality standard. In case of

expansion project, the contribution should be inclusive of both existing and

expanded capacity.

viii. No. I-VII is to be repeated for fugitive emissions and any other source type relevant and used for industry.

ix. Graphs of monthly average daily concentration with down-wind distance. x. Specify when and where the ambient air quality standards are exceeded either due to

the proposed plant alone or when the plant contribution is added to the background air quality.

xi. Fugitive dust protection or dust reduction technology for workers within 30 m of the plant active areas.

15. Sources of secondary emissions, its control and monitoring as per the CPCB guidelines

should be included.

16. Details of fugitive emissions and control technologies should be provided.

17. Action plan for solid/hazardous waste generation, storage, utilization and disposal

particularly slag from any sources.

18. Chemical characterization of RSPM and incorporation of RSPM data should be

included. Location of one AAQM station should be in downwind direction.

19. Presence of an aquifer(s) within 1 km of the project boundaries and management plan for

recharging the aquifer should be included.

20. Source of surface/ground water level, site (GPS), cation, anion (Ion Chromatograph),

metal trace element (as above) chemical analysis for water to be used. If surface water is

used from river, rainfall, discharge rate, quantity, drainage and distance from project site

should also be included. 21. Ground water analysis with bore well data, litho-logs, drawdown and recovery tests to

quantify the area and volume of aquifer and its management. 22. Ground water modeling showing the pathways of the pollutants should be included.

23. Column leachate study for all types of stockpiles or waste disposal sites, at 20oC-50

as per the latest permissible limits issued by the Ministry vide G.S.R. 414(E) dated 30th

May, 2008.

33. Detailed description of the flora and fauna (terrestrial and aquatic) should be given with

special reference to rare, endemic and endangered species.

34. Risk assessment and damage control should be included.

35. If the site is within 10 km radius of any major river, A note on the impact of drawl of

ground water on recharge potential. 36. If the site is within 10 km radius of any major river, Surface water quality of nearby River

(60 m upstream and downstream) and other surface drains at eight locations must be ascertained.

37. If the site is within 10 km radius of any major river, Flood Hazard Zone Mapping is required at 1:5000 to 1:10,000 scale indicating the peak and lean river discharge as well

as flood occurrence frequency. 38. A note on treatment of wastewater from different plants, recycle and reuse for different

purposes should be included.

39. Provision of traps and treatment plants are to be made, if water is getting mixed with oil,

grease and cleaning agents.

40. If the water is mixed with solid particulates, proposal for sediment pond before further

transport should be included. The sediment pond capacity should be 100 times the

transport capacity.

41. The pathways for pollution via seepages, evaporation, residual remains are to be studied

for surface water (drainage, rivers, ponds, lakes), sub-surface and ground water with a

monitoring and management plans.

42. Ground water monitoring minimum at 8 locations and near solid waste dump zone,

Geological features and Geo-hydrological status of the study area are essential as also

Ecological status (Terrestrial and Aquatic) is vital.

43. Geo-technical data by a bore hole of up to 40 mts. in every One sq. km area such as ground water level, SPTN values, soil fineness, geology, shear wave velocity etc. for

liquefaction studies and to assess future Seismic Hazard and Earthquake Risk Management in the area.

44. End use of solid waste and its composition should be covered. 45. All stock piles will have to be on top of a stable liner to avoid leaching of materials to

ground water. 46. Studies on amount of CO2 emission (daily monitoring), Hydrocarbons, other

contamination, if any, and their management.

47. Occupational health of the workers needs elaboration including evaluation of noise, heat,

illumination, dust, any other chemicals, metals being suspected in environment and

going into body of workers either through inhalation, ingestion or through skin

absorption and steps taken to avoid Musculo-Skeletal Disorders (MSD), backache, pain in

minor and major joints, fatigue etc. Occupational hazards specific pre-placement and

periodical monitoring and periodical monitoring should be carried out. The detailed plan

to carry out above mentioned activity should be mentioned.

48. Action plan for the green belt development plan in 33% area should be included. The

green belt should be around the project boundary and a scheme for greening of the

traveling roads should also be incorporated. All rooftops/terraces should have some green

cover.

49. Demography of the area and socio-economic development activities need to be elaborated upon.

50. Scheme for compliance to the recommendations mentioned in the CREP guidelines for cement plants should be included.

51. A note on identification and implementation of Carbon Credit project should be

included.

52. Detailed Environment management Plan (EMP) with specific reference to details of air

pollution control system, water & wastewater management, monitoring frequency and

implementation plan for mitigation measure should be provided.

53. EMP should include the concept of waste-minimization, recycle/reuse/recover techniques,

energy conservation and natural resource conservation.

54. Total capital cost & recurring cost/annum for environmental pollution control measures. 55. Any litigation/court case pending against the proposal or land should also be included.

56. A tabular chart of the TORs and compliance index should be incorporated in EIA/EMP. 57. Project falling with in 10 km. area of Wild Life Sanctuary is to obtain a clearance from

National Board Wild Life (NBWL) even if the eco-sensitive zone is not earmarked. 58. The proposal is exempted form public hearing by categorizing in B-2 category due to use

of energy efficient technology, on clinker manufacturing at the proposed site, no sensitive area within 10 km. radius, "zero" effluent discharge, utilization of all the solid waste in

the process itself including utilization of fly ash etc.

59. Besides the above, the general points mentioned below should also to be followed during

preparation of EIA/EMP:

• All documents to be properly referenced with index, page numbers and continuous

page numbering.

• Where data are presented in the report especially in tables, the period in which the

data were collected and the sources should be indicated.

As decided by the State Expert Appraisal Committee the above TORs should be

considered for preparation of EIA/EMP report for the Cement Plant; in addition to all

the relevant information as per the Generic Structure of EIA given in Appendix III and IIIA

in the EIA Notification, 2006.

The committee directed the proponent to take further necessary action with regards to

public hearing and the preparation of final EIA. The matter shall be discussed after

submission of final EIA.

29- Mega Leather Cluster located at Vill-Kuraina Bahadurnagar & Senpuirabpara

Near Ramaipur, Distt-Kanpur, U.P. Sri Ashraf Rizwan, Director, C/o Sultan

The committee noted that the matter was earlier discussed in SEIAA meeting dated

30/10/2014 wherein the Authority taken a decision as follows:

"The SEIAA agreed with the recommendations of the SEAC that the Gram Samaj land is

being proposed for the development of Mega Leather Cluster. Therefore, as per the EIA

notification 14 Sep 2006 the matter falls under category-A i.e. the procedure of

Environmental Clearance to the project proposal does not come under the ambit of SEIAA,

U.P. The project proponent is directed to proceed to the MoEF for the Environmental

Clearance of the proposed proposal and the Proposal is therefore, Closed."

A letter dated 20/11/2014 was communicated to project proponent regarding decision

of SEIAA. The project proponent submitted a representation dated 29/01/2015 regarding the

project proposal. The matter was put up to committee in its meeting dated 21/02/2015. The

committee noted the decision of SEIAA meeting dated 30/10/2014 and deliberated that any

representation with reference to decision taken by SEIAA should be put up to SEIAA itself.

Accordingly, the committee directed to put up the representation of project proponent to the

Authority.

1. The committee noted that the matter was earlier discussed in SEAC meeting dated

15/11/2014 wherein the following request from the project proponent were discussed

in compliance to Hon'ble NGT order dated 05/09/2014 in the application M.A. no.

455/2013.

1. To reinstate the Environmental Clearance granted vide letter no. 692/ SEAC/

148/2011/TA(J) dated 30.03.2012 in light of NGT order M.A. No.455 of 2013

vide dated 05.09.2014

2. Since the controversial solid waste dumping yard area can now become

available to the developer hence, TOR for additional 14 acres land may be

issued.

2. In meeting dated 15/11/2014 , the SEAC directed as follows:

" committee discussed and deliberated that request regarding reinstating of environmental clearance dated 30/03/2012 can be decided only after the reasons for

cancelation of the E.C. letter dated 30/03/2012 be complied/fulfilled.

Also, the status/land use of the site of proposed project “Sushant Aquapolis Doondaherra, Ghaziabad" may be conformed from Ghaziabad Development

Authority. Further, the status of solid waste dumping yard as submitted by M/s Ansal Properties and Infrastructure Ltd. through their letter dated 30/09/2014 and

15/11/2014 should be conformed from Ghaziabad Development Authority, Nagar

Nigam, Ghaziabad and UP Jal Nigam as on date.

A copy of above communications should also be made to M/s Ansal Properties

and Infrastructure Ltd.

The committee also directed the project proponent to submit copy of writ

petitions and related orders/judgments made by Hon'ble Courts in the related matter,

in any. "

The SEIAA in its meeting dated 21/11/2014 agreed with the decision of

SEAC.

3. A communication was made by Member Secretary, SEIAA to Ghaziabad

Development Authority, Ghaziabad, Municipal Corporation Ghaziabad, Construction

and Design Services and Member Secretary, UPPCB for providing their comments

with respect to directions of SEAC made in meeting dated 15/11/2014.

4. Secretary, Ghaziabad Development Authority, Ghaziabad (through his letter dated

16/12/2014), project manager C&DS, UP Jal Nigam (through his letter dated

06/12/2014) and Municipal Commissioner, Ghaziabad Nagar Nigam (through his

letter dated 21/01/2015) communicated their replies to SEIAA. In all these

communications, these agencies have denied the following claim /version of M/s

Ansal Properties and Infrastructures Ltd. regarding 14 acres land in Village-

Doondahera, Ghaziabad that:

"…….The Ghaziabad Development Authority has allocated alternate plot for the

Solid Waste Scheme in Galland and Pipalhera Villages."

5. The SEAC noted that land use of the said 14 acre land is "Dumping Yard" as notified

by Housing and Urban Planning Department, Govt. of U.P. order no. 4582/8-3-2009-

502 writ/2006 dated 21/10/2009. The additional land for Dumping Yard in Village-

Galland and Pipalhera which has been made available by GDA to Nagar Nigam

Ghaziabad is not an alternate for 14 acres Dumping Yard land at Village-Doondahera.

The committee directed the project proponent that correctness of statements should be

duly verified by the project proponent before making any submissions/claims at

SEIAA.

6. The committee also noted that UP Pollution Control Board has not yet submitted their

replies in the matter.

7. The committee deliberated that in view of information received from Ghaziabad

Development Authority, Nagar Nigam, Ghaziabad and C&DS, UP Jal Nigam,

Ghaziabad the request made by M/s Ansal Properties and Infrastructures Ltd. can not

be entertained by the committee as land use of said 14 acre land in Village-

Doondahera is "Dumping Yard" and Ghaziabad Development Authority has not

allocated any alternate land which would make this 14 acre land in Village-

Doondahera available to M/s Ansal Properties and Infrastructures Ltd. Hence, the

submissions/claim made by M/s Ansal Properties and Infrastructures Ltd. in their

petition to SEIAA are not correct and here by rejected.

8. The committee also noted that there is a Court Case pending at Hon'ble Supreme

Court related to said 14 acre land at Village-Doondahera Ghaziabad as also informed

by project proponent. Hence, no decision can be taken by SEAC in a subjudice matter

at Hon'ble Supreme Court.

9. Further, the committee also observed that the project details as submitted in form-1

alongwith the letter dated 30/09/2014 of M/s Ansal Properties and Infrastructures Ltd.

are not same as proposals on which environmental clearance dated 30/03/2012 was

earlier granted by SEIAA, which was later cancelled by SEIAA on dated 01/04/2013.

hence, the above observations/situation may be forwarded to SEIAA for taking

decision. The SEIAA may also ask Members Secretary, UPPCB to submit their reply

with reference to letter dated 1974/parya/SEAC/2582/2014 dated 26/11/2014 in the

matter.

6. The Project proposal falls under Category –8(b) of EIA Notification, 2006 (as

amended).

The committee discussed the matter and recommended grant of environmental clearance

to the project proposals alongwith general conditions as prescribed by the authority for construction project and following specific conditions:

1. 5% land of total plot area should be allocated to pond.

2. Internal road should be as per Development Authority bye-laws.

3. Adequate green cover not less than 33% of the plotted area should be provided within

the premises.

4. For the treatment for total sewage, a full-fledged STP is to be provided with 20% more

capacity than waste water generated during operation phase.100% waste water is to be

treated in captive STP conforming to prescribed standards of receiving body for

designated use. Monitoring of STP to be done daily till its stabilization.

5. Recycling of water as proposed shall be undertaken with regular testing and monitoring

of treated water.

6. Dedicated power supply for STPs is to be ensured during operation. Sludge of STP is to

be used in-house as manure and surplus manure should be managed by giving it to end

users. 7. Environmental Corporate Responsibility (ECR) plan along with budgetary provision

amounting to 2% of total project cost /4.0 crore in the matter, shall be prepared and approved by Board of Directors of the company. A copy of resolution as above shall be

submitted to the authority. 8. Isolated place for Municipal Solid Waste handling and the disposal shall be provided in

accordance with Municipal Solid Waste (Management and Handling Rules), 2000 (as amended).

9. Organic waste converter for solid waste management shall be installed and plan

submitted.

10. LEDs should be used in all common areas and corridors. 100% solar lighting is to be

provided in the common areas/common stairs.

11. Parking guideline as per Ghaziabad Development Authority should be followed.

Parking for disabled persons should be explored.

12. All entry/exit point should be bell mouth shaped.

13. To discharge excess treated waste water into public drainage system, permission from

the competent authority to be taken prior to any discharge.

14. 100 % provision of Rain Water Harvesting is to be made. RWH shall be initially done

only from the roof top. RWH from green and other open areas shall be done only after

permission from CGWB.

15. Height of the stack should be provided as discussed based on combined DG sets capacity and be 6mt higher than the tallest building.

16. Post project monitoring for air, water (surface+ ground), Stack noise of D.G. sets, STP to be carried out as CPCB Guidelines.

17. Crèche to be provided during the construction/operation phase. 18. Provision of separate room for senior citizen with proper amenities shall be made.

19. Protection shall be provided on the windows of the high rise flats for security of residents.

20. Criteria/ norms provided by competent Authority regarding the seismic zone to be

followed for construction work.

21. Dual plumbing should be adopted.

22. Unless and until all the environmental issues are sorted out the occupancy will be

restricted and would be only allowed after achieving the Permission from the competent

authority.

23. The project proponent shall ensure that the project site does not attract/infringe any

buffer zone of no activity identified/declared under law.

24. Land scape plan with list of trees is to be submitted.

25. Ground water should not be extracted for the purpose of construction or otherwise. In

case of default the Environmental Clearance will deem to be cancelled.

26. Sprinkler to be used for curing and quenching and ready mix concrete may be used for

construction.

27. Possibilities of use of treated waste water for irrigation purposes should be explored.

28. No fresh water will be used for irrigation purpose.

29. Mobile toilets, safe drinking water facility, sanitation facility and eco friendly fuels etc.

Shall be made available to the temporary residents/workers at the project site including

the proper treatment and the disposal of the wastes.

30. Running/maintenance cost of STP and other environmental facilities should be

computed and included into customer brochure.
