EC asks CBDT to follow uniform formatto scrutinise candidates’ poll affidavits

NEW DELHI, July 11:

The Election Commissionhas asked the Central Board ofDirect Taxes to come up with a“uniform format” to reportscrutiny of assets and liabili-ties declared by candidates intheir poll affidavits.

In a letter to the CBDTchairperson yesterday, theElection Commission said theverification report to check formismatch should reflect thefive categories decided by thetwo bodies in 2013, a seniorEC functionary said.

The EC’s letter comes afterthe CBDT cautioned the pollpanel against putting in publicdomain the scrutiny report ofassets and liabilities declaredby candidates in their poll affi-davits.

In November, 2017 andApril this year, the EC hadsought clarification from theCBDT on whether the pollpanel could allow the public toaccess reports on the verifica-tion of election affidavits bythe Director General of IncomeTax (Investigation) under theRight to Information Act.

The EC feels that since averification report is not aninvestigation report, its disclo-sure should not be restricted

under Section 24 of the RTIAct, which exempts certainorganisations from being cov-ered under the information law.

Now, based on the responseof the CBDT, the EC maydecide on whether to putscrutiny reports in the publicdomain.

As of now, no fixed or stan-dard format is followed toshare verification reports withthe EC.

The five categories underwhich the CBDT scrutinisesthe poll affidavits are: specificcases forwarded by the EC tothe CBDT for verification;cases where there has been aphenomenal growth in theassets of a candidate based onaffidavits filed in previouselections; cases of winningcandidates and the veracity ofthe affidavits compared to thereturns of income, if any, filedby them; cases where there wasno PAN details butmovable/immovable assetsdisclosed are in excess of Rs 5crore; and matters where addi-tion of new immovable assetsabove a threshold vis-a-vis lastaffidavit is noticed. India losing tourists due tosheer lethargy, apathy: SC

NEW DELHI, July 11:

"Sheer lethargy and apathy"of the authorities was makingIndia lose tourists and foreignexchange despite having the TajMahal, as the Eiffel Tower ofParis was drawing eight timesmore tourists than the iconicmausoleum in Agra, the SupremeCourt said today.

Comparing the Taj and theEiffel Tower, it said that while only10 million foreign tourists had vis-ited India last year, Paris wasthronged by 80 million of them.

"There is the Eiffel Tower inParis. Perhaps it is nothing com-pared to Taj Mahal. 80 millionpeople come there (Paris). This iseight time more than what wehave. You can destroy the Taj, wedon't want to do it," a bench ofJustices Madan B Lokur andDeepak Gupta said.

During the hearing, the benchasked Additional SolicitorGeneral (ASG) A N S Nadkarni,appearing for the Centre, as tohow many tourists come to Indiain a year.

When Nadkarni said 10 mil-lion tourists visited India in 2017,the bench observed, "we arehappy to have only 10 millionpeople."

"There is sheer lethargy andapathy. People (abroad) are mak-

ing money, but no one is bothered(here)," the Apex Court saidwhile slamming the Governmentand the authorities for their fail-ure to take concrete steps to pro-tect and preserve the Taj.

When the ASG said theUnion Tourism Ministry couldgive more details about thetourists visiting India, the benchobserved, "They will not bother.Why will they bother abouttourists?"

"Do you realise the loss to thecountry due to this sheer lethar-gy? Foreign exchange, infra-structure, everything is lost dueto this. There is a loss to tourism.One monument can do it, butthere is apathy," the bench said.

The Apex Court also askedthe ASG, "Have you seen the Taj?Have you seen Eiffel Tower?"

To this, the ASG said, "Tajobviously is much better".

Referring to the Eiffel Tower,the bench said in India, therewere concerns about security, butin other countries, they havemade towers like "TV towers"from where tourists can have a"bird's eye view" of the entirecity.

"We are obsessed with securi-ty. At every place (in foreigncities), you have towers to havebird's eye view of the city. But inIndia, you have security prob-

lems. There are no towers to lookat the city," the bench said.

The bench also askedNadkarni about the income col-lected from tourists visiting TajMahal and Agra.

When Nadkarni said hewould have to check on it, thebench said, "part of the incomegenerated from this (Taj) monu-ment has to be considered in thisincome".

The bench also dealt with thesubmissions of environmentalistM C Mehta, who has filed thepetition raising the issue of pro-tection and preservation of theTaj Mahal, about giving Agra thestatus of a heritage city.

During the hearing, one of theadvocates told the bench thatsoon there would be time restric-tion and time slot for tourists vis-iting Taj.

The court observed that thetime-slot for visiting the Tajcould be imposed as was done inplaces like United Kingdom.

The Apex Court has beenmonitoring developments in thearea to protect the Taj Mahal,built by Mughal emperor ShahJahan in the memory of his wifeMumtaz Mahal at Agra. Its con-struction was completed in 1643but work continued on otherphases of the project for another10 years. The ivory white marblemausoleum is a UNESCO WorldHeritage Site. (PTI)

ED moves court seeking fugitiveoffender tag against Nirav, Choksi

MUMBAI, July 11: The Enforcement

Directorate (ED) today moved aspecial PMLA court here seek-ing to declare diamond tradersNirav Modi and Mehul Choksias 'fugitive economic offenders'and to confiscate their assetsworth Rs 3,500 crore in the USD2 billion PNB fraud case, offi-cials said.

They said two separate appli-cations, under the recentlypromulgated Fugitive EconomicOffenders Ordinance, were filedagainst the duo before the courtthat hears matters under thePrevention of MoneyLaundering Act (PMLA).

The agency had early this

month moved a similar applica-tion against businessman VijayMallya in the Rs 9,000-crorealleged bank loan fraud case andthe court recently issued sum-mons to him for August 27under the new ordinance.

The fresh application seeksto immediately confiscate assetsworth about Rs 3,500 crore ofNirav Modi and Choksi andtheir companies. The agencyseeks to confiscate assets, bothmovable and immovable,including those located in theUnited Kingdom and the UAE.

The move has been made onthe basis of the two PMLAcharge sheets filed by theagency against the two designer

diamond jewellers on charges ofalleged money laundering.

"Investigations haverevealed that Nirav Modi andMehul Choksi have committedthe offence of cheating againstPunjab National Bank (PNB) inconnivance with certain bankofficials by fraudulently gettingthe LOUs/FLCs issued withoutfollowing prescribed procedureand caused a wrongful loss to tothe bank.

"They have further siphonedoff the proceeds of crime so gen-erated through layering throughmultiple dummy, related, con-nected entities in India andabroad," the agency said in itsapplication. (PTI)
