BRUNSWICK AND MARKETED IN INTERPROVINCIAL AND EXPORT TRADE

SHORT TITLE1. This Order may be cited as the South East New BrunswickForest Products Marketing Board Levy (Interprovincial and Ex-port Trade) Order.

INTERPRETATION2. In this order, unless the context otherwise requires terms de-fined in Section 2 of the plan shall have the same meaningsherein, and without restricting the generality of the foregoing,the term:

“board” means the South East New Brunswick Forest Prod-ucts Marketing Board.

“buyer” means any person engaged in marketing primaryforest products or who purchases primary forest products to sellto processors, or contracts to purchase primary forest productsto sell to processors, or operates a collection yard for the pur-pose of accumulating primary forest products and or to sort andsell primary forest products.

“marketing” means buying, selling or offering for sale andincludes advertising, financing, assembling, storing, packing,shipping and transporting in any manner by any person.

“owner” means a producer who owns a private woodlot of10 hectares or more that is located in the regulated area.

“person” means an individual, an association, a corporation,a firm, a partnership or society and the heirs, executors, admin-istrators or other legal representatives of a person.

“plan” means the Plan as defined in the South East NewBrunswick Forest Products Marketing Plan Regulations - Nat-ural Products Act.

“primary forest product” means primary forest products asdefined in the Forest Products Act.

“private woodlot” means a private woodlot as defined in theForest Products Act.

“processor” means any person who utilizes primary forestproducts in a manufacturing process or changes the form of pri-mary forest products by mechanical means and markets the for-est products so utilized.

“producer” means a person who markets or produces andmarkets the regulated product.

“regulated area” means the regulated area as defined in theSouth East New Brunswick Forest Products Marketing PlanRegulation - Natural Products Act.

PRODUITS FORESTIERS DU SUD-EST DU NOUVEAU-BRUNSWICK

TITRE ABRÉGÉ1. Le présent arrêté peut être cité sous le titre Arrêté de l’Officede commercialisation des produits forestiers du Sud-Est duNouveau-Brunswick relatif à la redevance de commerce inter-provincial et international.

DÉFINITIONS2. Dans le présent arrêté, à moins que le contexte ne s’y op-pose, les termes définis à l’article 2 du Plan ont le même sensdans les présentes et, sans restreindre la portée générale de cequi précède, les définitions ci-après s’appliquent.

« Acheteur » désigne une personne qui se livre à la commer-cialisation de produits forestiers de base ou qui achète des pro-duits forestiers de base pour les vendre à des transformateurs,négocie des contrats d’achat de produits forestiers de base pourles vendre à des transformateurs, ou exploite une cour à boisdans le but d’y accumuler des produits forestiers de base et oules trier et de les vendre.

« Commercialisation » désigne l’achat, la vente ou la miseen vente et comprend également la publicité, le financement,l’assemblage, l’entreposage, l’emballage, l’expédition et letransport effectués par qui que ce soit, de quelque manière quece soit.

« Office » désigne l’Office de commercialisation des pro-duits forestiers du Sud-Est du Nouveau-Brunswick.

« Personne » désigne un particulier, une association, unecorporation, une société, une firme ou une société en nom col-lectif ainsi que des héritiers, des exécuteurs testamentaires, desadministrateurs successoraux ou d’autres représentants légauxd’une personne.

« Plan » désigne le Plan selon la définition qu’en donne leRéglement établissant le Plan de commercialisation des pro-duits forestiers du Sud-Est du Nouveau-Brunswick - Loi sur lesproduits naturels.

« Producteur » désigne une personne qui se livre à la com-mercialisation ou à la production et la commercialisation duproduit réglementé.

« Produit réglementé » désigne les produits réglementés se-lon la définition qu’en donne le Règlement établissant le Plande commercialisation des produits forestiers du Sud-Est duNouveau-Brunswick - Loi sur les produits naturels.

« Produit forestier de base » désigne les produits forestiersde base au sens de la définition à la Loi sur les produits fores-tiers.


“regulated product” means the regulated products as definedin the South East New Brunswick Forest Products MarketingPlan Regulations - Natural Products Act.

LEVIES3. Every producer shall pay to the Board the applicable leviesfixed or imposed in the following sections:

(a) Administration Levy: All producers marketing a regu-lated product shall pay a levy, of 1.8% of the delivered priceof all regulated product marketed from the regulated area.

(b) Forest Management Levy: All producers marketing aregulated product shall pay a levy to be known as the forestmanagement levy of $0.345 per cubic meter (m3st) orequivalent measure for all regulated product marketed fromthe regulated area.

METHOD OF PAYMENT AND COLLECTION4. Every producer marketing a regulated product in interpro-vincial and export trade shall remit the levies to the board within15 days of the month end in which the regulated product wassold, with a copy of the scale slip indicating the quantities, spe-cies and form of regulated product, and the private woodlotfrom where the regulated product was produced, along with acopy of an accurately completed transportation certificate as de-fined by regulation 2002-37 - Transportation of Primary ForestProducts Act.

5. Every buyer or processor from New Brunswick who mar-kets the regulated product in interprovincial and export tradeand makes payments directly to a producer shall deduct the lev-ies from the monies payable for the regulated product and shallremit the levies to the board within 15 days of the month-end inwhich the regulated product was received, with a copy of thescale slip indicating the quantities, species and form of the reg-ulated products purchased, and the private woodlot from wherethe regulated product was produced, along with a copy of an ac-curately completed transportation certificate as defined by reg-ulation 2002-37 - Transportation of Primary Forest ProductsAct.

6. Any levies owing that are not remitted pursuant to para-graph 4 and 5 will accrue interest at the rate of 16.5% perannum.7. (a) The levy collected pursuant to paragraph 3(a) of this or-der shall be used for the purposes of the board including

(i) the creation of reserves,(ii) the payment of expenses and losses resulting fromthe sale or disposal of the regulated products, and

« propriétaire » désigne un producteur qui possède un ter-rain boisé privé de dix hectares ou plus à l’intérieur de la zoneréglementée.

« Terrain boisé privé » désigne un terrain boisé privé au sensde la définition à la Loi sur les produits forestiers.

« Transformateur » désigne une personne qui utilise des pro-duits forestiers de base dans un processus de fabrication ou quimodifie la forme des produits forestiers de base par des procé-dés mécaniques et qui fait ensuite la commercialisation des pro-duits forestiers ainsi utilisés.

« Zone réglementée » désigne la zone réglementée définiedans le Règlement établissant le Plan de commercialisation desproduits forestiers du Sud-Est du Nouveau-Brunswick - Loi surles produits naturels.

REDEVANCES3. Chaque producteur doit payer à l’Office les redevances ap-plicables fixées ou imposées selon les sections suivants :

a) Redevance d’administration : Tous les producteurs quicommercialisent un produit réglementé doivent payer uneredevance de 1.8 % du prix livré de tout produit réglementécommercialisé provenant de la zone réglementée.b) Redevance d’aménagement forestier : Tous les produc-teurs qui commercialisent un produit réglementé doiventpayer une redevance, appelée redevance d’aménagement fo-restier, de 0.345 $ le mètre cube apparent m3(app) ou unemesure équivalente pour tout produit réglementé commer-cialisé provenant de la zone réglementée.

MÉTHODE DE PAIEMENT ET PERCEPTION4. Tous les producteurs qui commercialisent le produit régle-menté dans le commerce interprovincial et international doiventfaire parvenir les redevances à l’Office dans les quinze jourssuivant la fin du mois au cours duquel le produit réglementé aété vendu, accompagnées d’une copie du rapport de mesurageindiquant les quantités, les espèces et la forme du produit régle-menté et le terrain boisé privé d’ou provient le produit régle-menté et une copie correctement remplit d’un certificat de trans-port comme défini par règlement 2002-37 Loi sur le transportdes produits forestiers de base.5. Tous acheteurs ou transformateurs du Nouveau-Brunswickqui commercialisent le produit réglementé dans le commerceinterprovincial et international et qui effectue des paiements di-rectement à un producteur doivent déduire les redevances dessommes payables pour le produit réglementé et faire parvenirles redevances à l’Office dans les quinze jours suivant la fin dumois au cours duquel le produit réglementé a été reçu, accom-pagnées d’une copie du rapport de mesurage indiquant les quan-tités, les espèces et la forme du produit réglementé, et le terrainboisé privé d’ou provient le produit réglementé, et une copiecorrectement remplit d’un certificat de transport comme définipar le règlement 2002-37 Loi sur le transport des produits fo-restiers de base.6. Toutes redevances dû conformément à l’alinéa 4 et 5 accu-mulera de l’intérêt au taux de 16.5% par an.

7 a) La redevance perçue conformément à l’alinéa 3 a) duprésent arrêté doit être utilisée pour les fins prévues par l’Of-fice, notamment :

(i) pour la création de réserves;(ii) pour le paiement de frais ou de pertes résultant de lavente ou de la disposition des produits réglementés;


(iii) the equalization or adjustment among producers ofthe regulated product of moneys realized from the saleof the regulated product during such period or periods oftime as the board may determine.

(b) The levy collected pursuant to paragraph 3(b) of this or-der shall be used for the purposes of implementing and ad-ministering forest management programs on private wood-lots within the regulated area.

8. The levies collected pursuant to this order are in addition toany other service charges, license fees or levies that have beenestablished by the board.9. Order No. 2006-109 is repealed upon the coming into forceof this order.

COMING INTO FORCE10. This Order comes into force on the 2nd day of May, 2008.

8. Les redevances perçues en application du présent arrêtés’ajoute à tous les autres frais de service, droits, taxes et prélè-vements établis par l’Office.9. L’arrêté no 2006-109 est abrogé par l’entrée en vigueur duprésent arrêté.

ENTRÉE EN VIGUEUR10. Le présent arrêté entre en vigueur le 2 mai 2008.
