Process for Reconsideration – The Board may reconsider and amend actions listed on the agenda if that reconsideration takes place immediately following the original action or at the next regular meeting. The Board, on either of these two days, shall: 1) make a Motion to Reconsider and, if approved, 2) hear the matter and take an action. If the Motion to Reconsider is to be scheduled at the next meeting following the original action, then two items shall be placed on the agenda for that meeting: 1) a Motion to Reconsider on the described matter and, 2) a [Proposed] Action should the Motion to Reconsider be approved. A Motion to Reconsider can only be made by a Board Member who has previously voted on the prevailing side of the original action. If a Motion to Reconsider is not made on the date the action was taken, then a Board Member on the prevailing side of the action must submit a memorandum to the Secretary identifying the matter to be reconsidered and a brief description of the reason(s) for requesting reconsideration at the next regular meeting. 4. Public Comment on Non-Agenda Items a. Charles Renn – Represents Los Angeles Arts & Athletics Alliance. Provides

introduction. Two day art and community event on May 26th & 27th. Works with local schools. Will return in March 2012 to present more formal plan. Passed out a document, which also contains his contact information.

b. Derek Fuchs – public comment c. Barbara Ringuette/Cynthia Burn/Steve Robinson/Nadine Trujillo – Earthquake

demonstration/skit. Steve thanks all for participation. Nadine informed she has copies of earthquake plan and educates attendees on what to do in event of earthquake. LAFD emergency plan & list of resources for community. Team passed out over 150 copies of plan at the Farmers Market. People were very receptive to plan. Nadine presents a “Go bag” (pain ointment, glow lights, etc)

and earthquake kit (contact lenses, band aids, flash light, sanitary napkins, copies of emergency docs, etc). Attend sub-committee meeting on 2nd Tuesdays at 7pm at living room furniture store. All that show up will be a part of the committee. Will email copy of plans to everyone. CERT members present.

i. Charles – Wants to think of a model to keep school kids and neighbors safe in event of earthquake.

ii. Clint Lukens – Will provide copy of plan to tenants at work as well clients and customers.

d. Alfredo Hernandez – East Hollywood Neighborhood Council. Announces he’s running for candidacy for California assembly district 43. Would potentially cover large portion of Silver Lake; areas around lake and Atwater village, and some of Los Feliz. Requests support and petition signatures. Democratic Party.

e. Kriste Dragon – Works with charter school. Flagship school in Hollywood on Bronson Street. Started as school teacher in south center LA, went to UCLA, previously an Executive Director. Long history of public and charter school. Stopped by to say hello and thank SLNC for their work.

f. Gale Jaffe – Superintendent proposed closing entire adult education division. Requests support against closure of adult education, ESL, and training classes/programs due to budget cuts. Please send emails to the board of education. Proposal going before board on February 14, 2012.

i. Michelle Aregon – Many students need adult education to make-up credits in order to graduate from high school.

g. Genelle Le Vin – Gateway Silver Lake project. Introduces Juan Adolgule. SLNC’s monies pay for clean-up Silver Lake boulevard underpass on Sunset blvd. Thanks Anthony Crump for including SLIA in the ‘streets for people’ project. Ribbon cutting March 31, 2012. Juan is both gardener and handy-man. Juan also trying to fix arrogation system. Juan was referred by Gale Jaffe.

h. Paul Neuman – Announces two upcoming Governmental Affairs committee meetings at Russian Orthodox Church. (1) Will discuss a recent demolition and road structures. Eric Garcetti staff, developer, and café Estella owner will be present. (2) Alliance of Neighborhood Council Supervisor meeting in support of Tom LaBonge. Thinks it’s great to bring government closer to community. Mark Lewis will be present. Invites all to attend and requests RSVP’s for catering food purposes.

Eric Menjivar- Happy New Year all. Office working on budget reforms and initiative reforms; specifically ACA12. Due to a text typos on initiative, will have to wait two years to resubmit initiative. Will make the changes and then resubmit. Changes will not be retroactive. ACA constitutional amendments require 2/3rd votes to pass. Will keep SLNC posted. Lost large piece of Silver Lake due to redistricting. Will check if Mr. Gatto is opposing Styrofoam bill and why, then report back, per Rusty Millar’s request. Write [email protected] regarding Styrofoam concerns.

i. Nadine – Need more available and inexpensive non-Styrofoam options.

ii. Audience Member – combustible plates and cuts accessible and inexpensive online. Ground Word Coffee shop has the same cups. Will get the web link and provide information to the SLNC.

d. Assemblyman Cedillo – Representative – Not present e. Catherine Bator - Metro's Westside/CentralServiceCouncil

Silver Lake resident for 19 years. Served on this council past 3 years. Represents more than 60% of transit riders. North/South transportation is difficult. Recent improvement to bus application via smart phones. Need input to improve application. Red Line night service every 10 minutes. Handouts provided. Encourages community to restart the push for DASH services in Silver Lake. Fought to move location of meetings from Beverly Hills to more accessible location on Wilshire and Vermont. Moving away from Los Angeles and wants someone from Silver Lake to replace her position. Need recommendation from councilman. Fossil fuels damage the planet. Will pass on key information/suggestions to anyone interested. Please email [email protected].

f. Susana Furfari – Principal Micheltorena Elementary School Greets everyone. At this school for 5 years. Has been focusing on brining awareness back to this historical school and representing the diversity of the neighborhood. On Cusp of realizing the potential of school and the 21st century. Concerned about the Citizen of the World Charter School Community has worked hard to nurture and grow this Micheltorena. Doesn’t want the work undermined. Similarities between the schools. Working with local non-profit (Blue Palm) to create sustainable systematic art plan. Community gardening. Working with Silver Lake conservatory music to send kids to summer program and sustain each other. Schools going for similar demographic and can be divisive. Doesn’t want enrollment to drop or Micheltorena to close down. Working with district to have a town hall meeting and will invite the charter school, community and alumni’s. Needs support from SLNC. Now is not the time to share similar students. Decision of Charter School to accept or decline the district offer.

Board Comments/Questions:

i. Clint Lukens – Suggests both schools speak/brainstorm offline. It’s really the district, prop 39 and laws.

ii. Paul Neuman - Thanks Susana for the schools generosity for hosting the SLNC meeting space. Also, happy to host the meeting Clint suggested.

iii. Gale Jaffe – What’s the status? iv. Susanna Furfari – District offer went out February 1, 2012.

Charter can visit the site in Feb. March charter school may counter-offer. Final decision to decline or accept district offer May 2012.

Public Comment

i. Tamir Halaban – Parent trying to bring people to this

community. Parents collaborate together to make improvements. Citizens of the World school is exciting. Offers academically rigorous curriculum. Not traditional school. Should be available as public school option. Urges board to support CWC.

ii. Jose Sigala- President, Greater Echo Park Council wants to share experiences with relocation. Be mindful of potential parking and traffic issues. Be careful of the districts sneakiness of timeline with non-public input. Suggests asking for more transparency in process. Requests support to follow – ask Kaiser and Garcia to amend district community and media relations process to create co-location process. There should be a community town hall meeting to inform everyone. Ensure that the co-location is for one year only with annual review. Also, establish a co-location agreement and shared-use agreement.

iii. Cheryl Ortega - Retired teacher. Has experience with this process. Important to understand definition of a charter school. Charter school is publicly funded and privately operated; not an authentic public school. Charter’s promotes a two-tier system on one site. Encourages SLNC to oppose the charter school. Disservice to public education.

iv. Catherine Borek – Teacher of American Alumni and in her 16th year. Have two kids at Micheltorena school. Believes in public

school system. Doesn’t want parents to be afraid of what’s best for all kids at Micheltorena School. Provided a letter to SLNC.

Follow up Questions/Comments from Board Members

i. Johnson – Are charter schools unionized? Salaries for charter

comparable to public school? Pension plan for charter teachers? ii. Clint – Reiterates the need for both schools to talk. No union but

teachers can unionize if they want. Salary varies for each different charter.

iii. When do you need a decision from SLNC to have an impact?

g. Anthony Crump-Sunset Blvd/Griffith Park Blvd Project -

Has a projector presentation. SLIA (Silver Lake Improvement Association) has partnered with SLNC. Provides update on what’s coming up in few weeks. Concept is community facing obesity and cardio-vascular epidemic due to lack of exercise opposed to driving. Department of Public Health providing funds to encourage biking and walking. Streets for people demonstration program is a pilot project. Reversible project, if community hates the program. Traffic lanes will be turned into a pedestrian plaza. Painting will take a couple weeks. LADOT suggests closing entire street off. Businesses in the area love the idea or pedestrian plaza. Area would maintain accessible for all except cars with the exception of the fire department. Will have regular professional maintenance bi-weekly. CD13 funding the liability insurance for one year. Farmers Market will remain as is. LADPH providing bulk of funding. Needs volunteers to fill planter boxes with soil. Needs donations for plant boxes. March 4th 2012 is the scheduled grand opening celebration. Invites the community. Feel free to email Anthony for any questions.

Questions/Comments from Board Members Masterson – What about the palm trees from Genelle Le Vin? Bougart-Sharkov – Well thought design. You soil from a place off Riverside drive. It’s a huge compost pile and it’s free. Rusty Millar – Who will pay for the tables and chairs? Anthony Crump – paid with installation funds. Has an agreement with business owners to take care of the chairs and tables.

Paul Neuman – Are you willing to present this idea if other parts of Los Angeles are interested?

Anthony Crump – Yes, this is one of three demonstration sites. Hoping to expand substantially throughout entire city. A motion was passed to give authorization to Department of Transportation to move forward with this. Charles Herman-Wurmfeld – Garden can be a drop-off place for the plants/soil. Action area should be developed on website. Anne-Marie Johnson – Any conversation with LAPD regarding crime and increased patrol? Crump – No, not at this time. Trujillo – SLIA concerns re liability insurance.

Crump – City is liable for the public street. Only our events fall under our liability insurance. Public comment - East Hollywood doing similar project. SLNC may be able to retrieve free plants from the theater of pain foundation.

7. Report of Officers

a. Co-Chairs (Renee Nahum & Clint Lukens) Clint - Thanks Charles for great Issues, Visions, and Goals Meeting. Great turn-out. Renee – American Cancer Society awarded a plaque to SLNC for participation.

b. Vice-Chair (Charles Herman-Wurmfeld) –Thanks everyone for participating in meeting. Thanks Encie and Joe for website efforts. I May 2012 wants all sub-committees to agendize for the June Issues, Visions, and Goals Meeting. Not sure how to move forward re DOTs removal of “No Cruising” signs. Perhaps, Rusty Millar can consult.

c. Treasurer (Anthony Crump) –Budget and Finance meeting within next 10 days to reallocate unspent monies for current year. Will bring those motions before the board in March 2012. Board Comments:

Michael Masterson – Please ensure Reservoir Complex is included for upcoming year. Paul Nueman –Perhaps, leftover monies from this year can be used for next year elections. Clint Lukens – Keep us posted on the three schools who presented in 1-4-2012?

Not many opt-outs since we started sending newsletters. Every newsletter includes SLNC’s Face Book and Twitter icons; both accounts growing in numbers. There’s no mechanism to automatically delete expired documents/information.

Clint Lukens provides brief refresher/background, and then reads the motion. Calls the question to discuss with possible action.

Summary of Board Questions/Comments:

Nahum– We’d need 100 stakeholders to change the by-laws. Suggests Charles’ Vision meeting as possible avenue for acquiring 100 stakeholder votes. Perhaps use Laguna community room.

Charles - Participation of GGPNC? Perhaps, combine Bylaw topic with elections?

Crump – Perhaps, review all questions re by-laws in effort to slay two birds with one stone.

Nueman – Difficult to get 100 stakeholders and hopes board is not verbally attacked again. Mark can you neighborhood council bring people to this potential meeting?

Jaffe - If we adopt, will SLNC have 2 more reps on board?

Summary of Responses:

Mark xx: There’s mischaracterization his neighborhood council want to dump this particular area in Silver Lake. Has his own personal issue with neighborhood council name. 90039 areas present difficulty/challenges from operationally stand point. Small swatch of land (approx 7 blocks). Didn’t take ballot decision due to budget restraint and time burden. Wants the map redrawn before next election. Last year went through series of Bylaw changes. Bylaws must comply with City and State. If SLNC Bylaws don’t comport to DONE table of contents, DONE will change them for you. Thanks all for their consideration. Important to send representative to DONE to sit with Gracey Lue to review Bylaws. 90 out of 95 councils Bylaws don’t comport with DONE’s table of contents. Most changes are really good and based on best practices. Reach out to local businesses in that area as they’re best resource to reach residents.

From the UD&PAC Minutes of February 8, 2012: New Business: 1. 2106 Hyperion Avenue/ Theater Restaurant Café ZA 2012-0069-CUB Requesting a conditional use to permit license for on-site sales and dispensing of beer and wine, in conjunction with an existing restaurant, having 2,611 sq.ft. with 73 seats and hours of operation from 7:00 am to 2:00 am daily, and alcohol service from 10:00 am to 2:00 am, daily.

Bougart-Sharkov – Provides background and location info re application. There is an existing restaurant inside with outdoor patio. Application is for beer and wine in addition to the food being served for a couple of years. No applications for hard liqour license now. Asking for operation hours of 7am – 2am daily. The open patio is facing the street and isn’t covered.

Alan Becker – There since 1970’s (previously the Frog Pond). Took over establishment in 2003. Café Theater with European feel. Wants to rejuvenate restaurant. Allows community to have recitals, school plays, comedy shows, and commercial plays. Wants to serve and rejuvenate the community. No incidents in past 3 years. Neighborhood seems to like this place. Wants to add fine wines and beers. Current hours are 7am - 8:30pm weekdays and 8:30am – 8:30 pm weekends unless there’s a show. Nettler – Expresses concerns re noise and uncovered patio in this residential area. Potential issues. Becker – Built a sound but transperent fence along the street. Rachel Finfer – Represents the Elizabeth Peterson Group (the consulting firm for this application case) here for technical support for Alan Becker. Function not to serve as a bar but a theater. No current change in use re parking. Bougart-Sharkov – similar issue with Café Stella on Sunset. Appreciates that the wall around patio is less than 42 inches; open pedestrian interaction and transparency. The area is not commercial only, but heavily residential, and this makes the case diferent and the responsibility to keep noise levels down. Millar – What about parking without negative impact on community? Becker – We’re within parking rules (grandfathered old parking requirements for the site). Also utilizes parking lot next door when there’s events going on. Bougart-Sharkov – Would you consider an arrangement to use their parking lot on regular basis since they’re not opening during evening? However, we would need proof of arrangement in writing. Johnson – What time does dining end? Theatrical events end? What time does kitchen close? When did initial establishment stop service wine/beer? Density in area has changed dramatically in past 20 years. Business is trying to increase revenue/profit by serving alcohol. Doesn’t support the application. Concerned about surrounding neighbors. Completely different attitude/culture from Europe. Becker – There would always be food around the clock. Has letters from local residents in support of the business. Dining throughout the evening. Building stopped providing alcohol around early 1990’s. Bougart-Sharkov – 2a.m. is too late to close in heavy residential area. Suggests closing between 10:30pm & midnight. Requests feedback from community. Is this an expedited application? Rachel Finfer – Yes, hearing is in early April, 2012. Bougart-Sharkov – Suggests coming back for March 14 UP&PAC meeting or submit the docs at the Board meeting on March 7. Wants to see parking agreement in writing, prefers hours of operations to close by 11:00 p.m. weekdays (Sun. – Th.) & midnight on weekends (F. & Sat), and review letters of support from adjacent neighbors. Then a motion can be presented to the SLNC Gov. Board before the SLNC will send the oficial SLNC Gov. Board position to the DCP/ZA Office. Committee is open to revisiting business hours after one year of operation with the new beer & wine license. Becker – Elaborates and clarifies on other type of plays and comedy’s and one woman shows that occur. Sometimes there’s a 2nd show ending around 12:15am. Rachel Finfer – Concerned about the agreement with parking lot. Instead would committee consider 12:00 a.m. on weekdays and 1:00 a.m. on weekends? Millar – On nights when there’s an event, extend hours to 12:00 a.m. Otherwise, 10:00 pm on weekdays. Alcohol brings in more people and more money. Becker – there is a misunderstanding. Not anticipating flocks of people just to drink. Trying to sustain the theater. Herman-Wumfeld – Expresses concerns re tone of the committee and shows support to Alan Becker. This is not a bar or tavern. Outrageous to ‘require’ parking. There’s a fear of alcohol. Nettler – Still concerned about noise being generated. Patio doesn’t have noise control. Open to discuss consumption on the inside only. Dorit – Lives near Sunset Junction. Compliments this place. Must mediate the noise. Suggests support of neighbors’ night time peace and quiet directly adjacent to business. Would support this as long as you get parking next door. Tim Andreas – Liability issues. Are there any policies or recommendations re parking. Perhaps, valet parking to offset parking cost. Nettler – Not to setting precedence, once a license is in place, the license can be sold to any future owner. Neuman – Seconds what Charles said earlier. It’s not just a theater for arts community but great feature to have in community.

Bougart-Sharkov – No one is bashing the establishment as a theater. Just trying to represent the interest of the most effected stakeholders – the nearby living working people, who get up early in the morning to go to work, and to reach an agreement for it with the applicant. Dorit – Not fair for neighbors to suffer. This could be a nuisance. Bougart-Sharkov – We do support the theater, but have to be considerate of those who have to get up early for work and commute away from home. Much of the neighborhood is residential and will be affected by noise. Jaffe – Perhaps, the UD&PAC can revisit hours of operation in one year. Ringguette – Hours of operations should definitely be revisited in one year in case there are complaints.

Con: Relocation of picnic tables to adjacent area,; removal and relocation or replanting of trees in vicinity. Potentiality of need to address two protected tree species (Sycamore and Oak). WHEREAS, Los Angeles’ Griffith Park was gifted to the City with the specific intent it be “a place of rest and relaxation for the masses, a resort for the rank and file, for the plain people” and it currently contains an abundance of golf courses, tennis courts, equestrian and hiking trails, as well as popular attractions such as a merry-go-round, pony rides, a miniature railroad, etcetera; and WHEREAS, the majority of youth ball fields that once served the entire City as well as the communities abutting Griffith Park were torn out by the construction of the ‘Golden State (#5) Freeway’ and never subsequently replaced; and WHEREAS, the neighborhood of Silver Lake has experienced marked growth in the number of families with children over the past ten years; and WHEREAS, Silver Lake’s city administrated recreation center sports programs, specifically youth baseball, are routinely filled to capacity where parents are turned away because of lack of facility space; and WHEREAS, physical education programs have been eliminated from our public grammar schools and lack of exercise has been scientifically linked to the growing problem of childhood obesity; and WHEREAS, a Los Angeles Department of Recreation and Parks (RAP) Citywide parks needs assessment report (2008) specified a goal of providing one (1) baseball field per 12,000 persons by 2013 requiring the addition of seventy three (73) new ball field installations; and WHEREAS, a Proposition K (“K for Kids”) funded project to restore two (2) youth ball fields in Griffith Park’s Crystal Springs area is currently being contemplated by the Bureau of Engineering and the Department of Recreation and Parks; and WHEREAS, 2009 census data projections indicate 25% of the population within a 3.0 mile radius of the project site are categorized in the 15- 34-year age range; and WHEREAS, many Silver Lake stakeholders included in these population projections will directly benefit from the creation of additional recreational facilities; and WHEREAS, Griffith Park, as a Los Angeles Historical-Cultural monument, enjoys the benefit and protection of having significant projects undergo a thorough review/approval process by the City’s Office of Historic Resources and Cultural Heritage Commission to ensure their appropriateness within the confines of the park; NOW, THEREFORE, BE IT RESOLVED, The Silver Lake Neighborhood Council (SLNC) supports the project (BOE - K277) to restore youth ball fields in Griffith Park so sorely missed by our community’s children and the City of Los Angeles as a whole.

RESOLUTION JANUARY 17, 2012 WHEREAS, Los Angeles’ Griffith Park was gifted to the City with the specific intent it be “a place of rest and relaxation for the masses, a resort for the rank and file, for the plain people” and it currently contains an abundance of golf courses, tennis courts, equestrian and hiking trails, as well as popular attractions such as a merry-go-round, pony rides, a miniature railroad, etcetera; and WHEREAS, the youth ball fields that once served the entire City as well as the communities abutting Griffith Park were torn out by the construction of the ‘Golden State (#5) Freeway’ and never subsequently replaced; and WHEREAS, the entire neighborhood of Los Feliz has no publicly funded and administered recreational facilities or organized sports programs offering instruction in the more conventional and widely played sports of Baseball, Basketball, Football and Soccer; and WHEREAS, the neighborhood of Los Feliz has experienced tremendous growth in the number of families with children over the past ten years; and WHEREAS, Los Feliz’s nearest public recreation center in Silver Lake has reached maximum capacity in the programs it can offer, so much so, parents and their children are now, and will continually be for the foreseeable future, routinely turned away due to the lack of adequate recreational facility space; and WHEREAS, physical education programs have been eliminated from our public grammar schools and lack of exercise has been scientifically linked to the growing problem of childhood obesity; and WHEREAS, a Proposition K (“K for Kids”) funded project to restore youth ball fields in Griffith Park is currently being contemplated by the Bureau of Engineering and the Department of Recreation and Parks; and WHEREAS, Griffith Park, as a Los Angeles Historical-Cultural monument, enjoys the benefit and protection of having significant projects undergo a thorough review/approval process by the City’s Office of Historic Resources and Cultural Heritage Commission to ensure their appropriateness within the confines of the park; NOW, THEREFORE, BE IT RESOLVED, The Greater Griffith Park Neighborhood Council (GGPNC) wholeheartedly supports the project (BOE - K277) to restore the youth ball fields in Griffith Park so sorely missed by our community’s children and the City of Los Angeles as a whole.

Text of Motion on the Agenda*: The SLNC moves to support the efforts of the Micheltorena Elementary School administrators, teachers, parents and children to stop the co-location of CWC charter onto Micheltorena’s campus. SLNC support of Micheltorena Community efforts to stop co-location does not reflect an opinion on charter schools in general, but applies to this case in particular. Describe the event/project in detail. Include as much supplemental information as possible (background information; supporting and opposing viewpoints, if available, etc.) Attach additional sheets as necessary Proposition 39, Supermajority of 55% for School Bond Votes, passed by 54% of voters in 2000 (An amendment to the California Constitution passed by voter initiative in November 2000. It added the option of a lower voter-approval threshold (55% vs. two-thirds) for local school district general obligation (G.O.) bonds. If districts choose to seek 55% instead of two-thirds approval, they have added requirements involving financial and performance accountability). Also included guarantees to charter schools, ensuring that students who attend a charter school in their district of residence have facilities that are “sufficient” and “reasonably equivalent” to the other buildings or classrooms in the district. The buildings also need to be “furnished and equipped” and reasonably close to where the charter school wishes to locate. However, to get this support, the charter school must serve a minimum of 80 students who live within the district’s boundaries. The California Charter School Association filed a lawsuit against the Los Angeles Unified School District in 2010, claiming that LAUSD was improperly denying charter school operators in the district the campus space that they are entitled to under Proposition 39.

Charter school operators characterized a December 2010 ruling by a Los Angeles Superior Court judge on their lawsuit as a victory. According to a report in the Los Angeles Daily News: They also characterized the court decision as a victory because they said in the past LAUSD officials have failed to even respond to requests from charter operators for school space. The association said dozens of members received no response from the district last year when 81 charter operators applied for space. Of those who received space many were given offers that simply did not meet their needs. Local charter operators who have been requesting facilities from the district hope this decision will finally get them the classroom space they need. In an effort to fulfill it’s mandated obligation and avoid future lawsuits LAUSD created a protocol to identify empty classrooms in it’s Public Schools (PS) and offer them to the petitioning Charter Schools (CS). As evidenced by the LAUSD organized information and Q&A community meeting on 2/22/2010 held at Micheltorena ES, this process is done in a impersonal an automatic way; it does not give a voice to the local community nor the hosting school’s population in the decision making, nor takes into account the additional ways in which a school utilizes the “empty” classrooms. In the case of Micheltorena ES in particular assigning the rooms to the CS, will take away rooms used for Adult ESL, before and after school programs, Special Education Itinerant teachers such as speech therapist and occupational therapist, Art and Music Program Education, plus will not allow for sufficient space needed to grow a Dual Language program. Micheltorena ES is at a tipping point in enrollment and the take away of classrooms will hurt the school’s efforts to improve enrollment. One of these efforts is the addition of the SLNC supported Edible and Native Garden. Micheltorena ES is for protecting the right of every citizen to get a free education and enroll without lottery, tuition, preferential treatment. If Micheltorena were to close and be replaced by a charter, community parents would have no guaranteed spot in their local school. Communities across the country are in the process of fighting co-location, communities that are, like the Micheltorena Community, involved in bettering our public schools. What is the perceived/potential impact on the community if we adopt the motion (pro and con)? Pro: Allows the PS to continue with its community led effort to increase enrollment and make up for LAUSD education deficiencies by bringing Art, Music, Dance, and Dual Language programs to the campus. Currently city codes forbid urban beekeeping outside of agricultural zones. Many cities around the globe, including Santa Monica, New York, Denver and London have recently legalized beekeeping in recognition of the important role urban beekeepers can play in both providing food security and the health of honeybees and other pollinators. (see attached material) The Mar Vista, Del Rey, Greater Griffith Park and South Robertson Neighborhood Councils have already endorsed the legalization of beekeeping in the city of Los Angeles. Dear City of Los Angeles Council Members: The Silver Lake Neighborhood Council supports efforts to legalize beekeeping in the City of Los Angeles. To that end, the SLNC requests that the City Council directs the Planning Department to begin efforts to revise the municipal code to permit beekeeping in all zones. An urban beekeeping feasibility study recently conducted by the The Mar Vista Community Council concluded that there is a “strong community interest in supporting beekeeping efforts and that doing so would result in positive changes that permit the healthy growth of honey bee colonies and increase the production and quality of fruits, vegetables and flowers in Mar Vista’s organic home gardens while providing a community service as a resource for the removal of feral (wild) hives.” Their research also concludes that beekeeping would be cost neutral to the city of Los Angeles. Date: February 27, 2012 Name/Committee: Governmental Affairs Text of Motion on the Agenda*:The SIlver Lake Neighborhood Council shall ask Frost/Chaddock to commit, formally and immediately, to including, as part of the 4000 Sunset project, a 1,000 square foot community exhibition space (the “Space”). This should be agreed upon by Frost/Chaddock in consideration of the willful destruction of a significant cultural resource, the former A Different Light bookstore building, at that site. The Space should be located on the ground floor level of the new building. If the transit plaza is created as planned on the current Jiffy Lube site, the Space should front on and be visible from the plaza. If the transit plaza falls through and the street configuration remains as is, the Space should front on and be visible from Santa Monica Boulevard. The SLNC furthermore asks that the Space be made available rent free for a period of no fewer than 5 years, and proposes that it be operated by a non-profit organization that would partner with other organizations and groups to host various community events, exhibitions, and cultural activities that reflect the history, culture and diversity of the Silver Lake community. In many ways, the Space would rekindle the original spirit of A Different Light. A potential non-profit sponsor for the Space is ONE National Gay & Lesbian Archives. ONE is the world's largest LGBT archive and is housed at USC. ONE currently creates several gallery exhibitions each year at a satellite site in West Hollywood in partnership with community stakeholders, and is interested in securing such an exhibition space.

The degree of credibility and integrity of anyone doing business with the city is always a relevant concern to the people, neighborhoods and communities of Los Angeles, especially when any lack of forthrightness has a dire and irreversible impact on the issues of impact to the public, and therefore this motion, if approved, will be transmitted to every neighborhood council, the city's department of neighborhood empowerment, the mayor of Los Angeles, the city attorney, the city controller, all Los Angeles city council offices, the city's planning department and other potentially relevant city entities, the Los Angeles Conservancy and other pertinent civic and trade organizations, and members of the media. The Governmental Affairs Committee, through an amendment made to this motion in committee, also moves that Frost/Chaddock be given a grace period of 15 days, starting upon approval of this motion. During that 15 day period, IF Frost/Chaddock commits incontrovertibly, formally and publicly to including, as part of the 4000 Sunset project, a 1,000 square foot community exhibition space ("the Space" as described and detailed in attachments to this motion), then the communications described above to various city and communities entities, and the media, will not be undertaken. Documentation of any such commitment shall be provided,

Representatives of the SLNC and also the 13th Council District Office stated without anyone voicing contradiction, that the developer representative had stated on the record that no demolishing would occur without further meetings/discussion, but that demolishing had occurred without any such meeting/discussion and without any advance notification. Matthew Levy of Frost/Chaddock was invited to attend the committee meeting, or send any other Frost/Chaddock representation, but declined, and was invited to submit a statement or any other other information, but declined. However, he did talk at some length with governmental affairs co-chair Paul Michael Neuman, who recorded as best and as faithfully as he could notes as to what Mr. Levy stated, and read those notes to the committee: Here is what Mr. Neuman read: "I talked with Matt Levy of Frost/Chaddock. These are my notes from that conversation. He said that they wouldn't be coming to the committee meetings (I also invited him to send a written statement, or bring one with him if he came. As of 3pm the day of the meeting, no such statement has been emailed to me; hence my reliance on fragments of notes). He noted that since the demolishing occurred, they have met again with reps of the NC and community: they 'not

hidden under a shell or a rock.' He said they have dialogued and talked with people, and welcome dialog. "He said that he has no problem with this particular meeting: in so far as our meeting is concerned, it is perfectly appropriate to be looking to review policies and procedures regarding things of this nature regarding demolition. (In other words, to look at processes in the abstract.) He said that what was done in this instance met the level of the law, the firm hides behind nothing, they went through a (lawful) process, he is confident they followed the law and that's the barrier and the threshold. "He said that they're open to meeting about the project status. He said something about how the process will take better than a year. "He said that from their point of view, they don't see what happened as being anything deceptive or otherwise: 'the timing, take it for what it's worth, was coincidental.' He continued by stating that the whole process starts quite early and takes some time, at that time it was clearly and forthrightly stated that there was no pending time for demolition, but a lot of things were very clear. These were the same plans as around as 2007. The building was costing more to operate than it was generating to rent, and they were asking tenants to vacate because the buildings were unsafe (I think he said). Then there were concerns about whether there was any illegal removal of tenants, and so the more recent meetings addressed were at least partly to address that. "He talked about how many official steps they had met to enable the demolishing: involving not just issues related to the tenants, but clearance from an inspector/inspectors, gas lines cleared and terminated, Building and Safety coming out, site inspection, review improvements, Department of Water and Power, asbestos abatement/standards, etc. And there were meetings with the community, including at the Hollywood CD 13 office. He said (I think) that this started in 2007. So he was suggesting that from start to finish (and also after demolishing) there was plenty of conversation with government and community. "I allowed that all this obviously may have occurred, and that one could stipulate that, at least as far as I knew, legal considerations were satisfied. That said, I asked one very basic question -- was anyone with the city (including, the neighborhood council) EVER told, in advance, exactly when the demolishing would occur. Was the city ever given a date, a day, when this was going to happen? He was silent for several seconds and then said, 'I don't know.' This was regarding whether anyone from the city was told the date of demolishing. I invited him to find out the answer to that question and to share it with me before the meeting, if he doesn't choose to show. As of 3pm the day of the meeting, no

such information has come my way. "He said that Elizabeth was shown plans, Elizabeth was given first look. He said that his firm had always recognized 'A Different Light' and that it has historical resonance (he didn't use that term), he said they don't disagree with that, which is why they're willing to find some way to memorialize it with pictures, a plaque. He said there's an exciting future and mentioned such possibilities as a transit plaza, street scape improvements, and that they've been quite willing, and continue to be quite willing, to work with the community (and the SLNC) on such endeavors." That's the statement that the governmental affairs committee co-chair read, conveying in good faith what Mr. Levy had said over the phone, and given that Frost/Chaddock chose to go unrepresented at this meeting. Such representations from Mr. Levy not withstanding, the committee wholeheartedly supported this motion. Later, Mr. Levy was emailed about this motion going to the the SLNC governing board, and was invited to provide a response for inclusion. No response has been received.

What is the perceived/potential impact on the community if we adopt the motion (pro and con)?

Pro: This motion is intended to send a motion that it is important for trust and credibility to be established by those who come before a neighborhood council. The amending 2nd paragraph/amending part of this motion is intended to earn some concession from the developer in question.

Con: Only time can tell if this kind of condemnatory motion, if approved, will have an impact. As far as the 2nd paragraph/amending part of this motion, it can be asked whether trying to gain a concession from the developer. at this stage, detracts from what would either be a simple statement of condemnation for those who are determined not to have acted in good faith when discussing issues of importance to a community.

The initial grant of $2,500 would be used on the Micheltorena Steps, to clean them, repair the landscape, and document them for electrical purposes. Total budget would be determined by the amount of work done. Estimated costs would be lighting, construction of gateways, and wall repair.

Work would commence late spring or early summer 2012, depending on Board action.

Silver Lake Gateways

The historical steps and freeway overpasses of Silver Lake are the forgotten, pass-through zones of urban space. Often marked by trash and poor maintenance, these forgotten spaces were meant to speed transit and were unpretentious in their design.

We would propose to revitalize these spaces and make them a more visble, engaging part of the community.

New LED, colored lighting and ‘entrance gateways’ would make these steps more visible in the neighborhood. Improved landscaping and maintenance would make the steps inviting and more participatory spaces, rather than sidewalks that people pass through. Connections would be enhanced between cross streets, and the installations would reduce loitering and litter.

The steps in Silver Lake predate the now-common automobile as a form of transportation. Still used, they are in need of repair to make them more pedestrian-friendly, especially at night.

The freeway passes were similar in nature to the Silver Lake Steps: places you pass through quickly, and not very pedestrian friendly.

Issue: Barrier and Poor Maintenance

The freeway is an everyday part of life in Los Angeles, and several bridges and freeway overpasses dot our neighborhood. By installing a similar lighting plan used at the steps, the area is made more inviting, more interesting, the perceived barrier is reduced. and Silver Lake has gained a series of unique, iconic gateways.

Expanding on the Silver Lake Neighborhood Council’s support for the Streets for People Sunset/Griffith Park Boulevard Triangle Project, that will create a more pedestrian and bike friendly environment, a sense of place and community the Silver Lake Neighborhood Council hereby partners with the Silver Lake Improvement Association and agrees to grant the $2,000 to the Hollywood Beautification Team for 1 year of site maintenance, plant watering and cleaning at the Sunset Triangle Pedestrian Plaza.

Please see attached conceptual drawing. The project is the result of years of discussions within the neighborhood. A 2005 master plan for the area included many of the features contained in the project. Modeled after similar successful projects in New York and San Francisco, this project is a derivative of the 2007 master plan and will increase pedestrian space by temporarily repurposing excess streetscape at the intersection of Griffith Park Boulevard and Sunset Boulevard. The Silver Lake site is one of three pilot project sites that are being explored in the City of Los Angeles. The project will be implemented on a temporary basis using paint, bollards and other mechanisms approved by the Los Angeles Department of Transportation. Surrounding the plaza will be approximately 30 planters filled with live plants including succulents and edibles. The plaza area itself will contained 9 tables and umbrellas with chairs for stakeholders to use during business hours. The Silver Lake Improvement Association is the designated Community Partner with the Los Angeles Department of Transportation and has secured funding, with the support of Council District 13, to hire the Hollywood Beatification Team for site maintenance, cleaning and water of the plants. This funding would support and augment this maintenance plan.

What is the perceived/potential impact on the community if we adopt the motion (pro and con)?

Pro: Additional maintenance for Sunset Triangle Park; partnership with a local community organization. Support of a new pedestrian and bicycle friendly area adjacent to Triangle Park; informal extension of the Sunset Junction Streetscape project; encourages a physical activity and a sense of community along a busy thoroughfare; additional seating/lounge area for residents and customers of nearby businesses.

Con: Additional cost to the SLNC

Total budget is estimated to be between $4,000. Installation, materials and additional costs are being paid for by the Los Angeles County Department of Public Health, the Los Angeles Department of Transportation and the office of Councilman Eric Garcetti.
