1. ExecutiveSummaryPT Swadaya Mukti Prakarsa, a subsidiary of First Resources Group is developing approximately21,019haof oil palmplantationwhich12,384.28ha is non‐planted anddividedon to threenewdevelopmentareas.TheplantationarealocatedatSub‐DistrictSimpangHilir,Sub‐DistrictSeiLaurandSub‐DistrictSimpangDuawithinKetapangDistrictandKayongUtaradistrict.

A comprehensive and participatory independent Social and Environmental Impact Assessment(SEIA) and High Conservation Value (HCV) assessment which include internal and externalstakeholderswereconductedbyRSPOregisteredassessorfromBogorAgricultureUniversity.Theresults are incorporated into the operationalmanagement planning to develop the newplanting.TheIndependentassessmentbyRSPOapproved/registeredassessorsresultsare:

- TheconditionoflandcoverovernewplantingareaisnolongerPrimaryForest- Theareaiscategorizedassecondaryforest,mixplantation,drylandagriculturaland

bare land, andmost of them fall in Other PurposeUseArea (APL) andConvertibleProductionForest.

- AllareasrequiredtomaintainorenhancewhichwereidentifiedasHCV- All local people’s land were recognized and involved in SEIA, SIA and HCV field

surveysactivities

Thepreviousmanagementhadplanted8274,3Haforoilpalmandbuiltapalmoilmill,whereas<2010 covered 7961.7 Ha, and in 2010‐2013 planted 312.6 Ha. PT SMP is planning to develop11.086,03ha(excludingHCVarea)until2018.TheFPICprocessisoptimallyconductedandfollowedby land compensation program. Thesurveyedlocationis locatedwithinPT.SwadayaMuktiPrakarsaworkingareaanditssurroundingvillage. The village including in the permitted company area is located in Kabupaten Ketapang andKayongUtaracosistedofSimpangHilirSubDistrict,SimpangDuaandSungaiLaurSubDistrict,and6(six)villages,covering:MatanJayaVillage(SimpangHilirSubDistrict),SempurnaVillage(SungaiLaurSubDistrict),MekarRaya(SimpangDuaSubDistrict),MekarHarapan(SungaiLaurSubDistrict),Gema(SimpangDuaSubDistrict),BatuDaya(SimpangDuaSubDistrict)

The SEIA studying activity inPT. SwadayaMuktiPrakarsa areawas conductedonNovemberof 2013.ThegrounddatacollectingactivitywasconductedforsevendaysdatedfromNovember28th–December4th2013.

ConductedMethod

Ingeneral it canbe said that thebasic thoughtof this review is a conservation effortbyPT. SwadayaMuktiPrakarsacouldonlybeachievedifthesocialconservationwithinandaroundPT.SwadayaMuktiPrakarsa could be earned. Hence, the closure frame on arranging the Social Environmental ImpactAssessment (SEIA) document is by knowing the existing condition in PT. Swadaya Mukti Prakarsa,


specificallytheonesinvolvedwiththeeco‐socioconditon,theeco‐socioimpactfromPT.SwadayaMuktiPrakarsaagaintsthelocalsociety,thesocietyperceptiontothecompany,alsothepositiveandnegativeimpact being predicted to happen due to the company existence to the society and its surroundingvillage. Based on the existing condition happened, a SEIA document would be arranged about thesurroundingsocietycharacteristicsdata,strategicalissue/problem,problemsolvingeffort,thecompanypositive and negative impact againts the society and surrounding village also the company socialmanagementplan.

The company social environment on general is consisted of four factors, goverment, society, laborworker,andthecompanyitself.Thebusinesscommitmentandcaretobuildmentisreallyexpectedsincetheyhaveamoralandsocialresponsibilitytoitsenvronment.Businesscouldnotpossiblyholdontoitsexistancewithoutthesocietyanditsenvironmentsupport.Thesustainingcouldbedefinedintermsofits relationshipwith theexistanceandbenefits to thecompany, thesocietyandgovermentwhichalsocoversvariousgrowth,social, andenvironmentaspect.Oneof the formsofcompanycommitmentandresponsibilitytoitsthrivingenvironmentiscurrentlyCorporateSocialResponsibility(CSR).

HCV

HCV Assessment was held in 30 November 2013 – 3 December 2013. Data sources as Toolkit forIdentification of High Conservation Values in Indonesia by Consortium to Revise the HCV Toolkit forIndonesiaJAKARTA‐June2008aresatelliteimagery;topographyandslopemaps;mapofForestLandUseConsensusPlan; Land Systemmap; river networkmap, FieldGiudeBooks ((FieldGuideBook forbirdsinSumatera,Kalimantan,JawaandBali‐BirdLife,MammalsandReptilesinSumatera,Kalimantan,JawaandBali);SocialandCulturalQuestionnaires,andfieldbook.

ThesuccessoftheHCVstudywilldependontwofactors,namely:(1)theavailabilityofadequateandthelatestdataof,bothsecondaryandprimarydataand(2)properandsystematicactivitysteps.Availability of adequate and latestdata/informationwill dependon the systematic, adequateandwell‐plannedoffieldsurveyscarriedout.Inordertoconductanexpectedfieldsurveyplan,thenthereviewontheexistingdocuments/reports/mapsandinitialHCVsidentificationneedtobeconducted.Whiletheproperandsystematicactivitysteps,includefieldsurveys,dataprocessing,analysisandsynthesisofdata,identificationandanalysisoftheHCVpresenceandmapping.

PhysicalConditionsLandcoverconditionsintheareaofPT.SMPcanbedividedintosix(6)types,namelysecondaryforests,gardenmix,oilpalmarea,drylandfarming , landopen andwaterbodies .AroundtheareaofPT.SMPthere are some conservation areas directly adjacent to the concession area. The area of which is theGunungpalungNationalParkandTheBatuDayaForestPreserve.

BiologicalConditionsFloraTotally species found in the area is 371 species grouped into 91 families, and the highest family isDipterocarpaceae (36 species).Habitus flora in the area shouldbediffered into eight type i.e. bamboo;epiphyte;herbs;lianes;palm;pole;treeandrattan.Treesisthehighesthabitusdistributionthatcontain251 species or 67,65%. Based on flora class, the species in the area can be grouped into two type i.ePteridophytais12speciesandSpermatophyta is355species(45speciesisMonocotyledonaeand310isDicotyledonae)andalso3speciesunidentified.There are two species protected by government regulation No. 7, 1999, there are found two speciesincludeAppendixIICITES;31(thirtyone)speciesRedList IUCN,withdetails:1speciesisCR/CriticallyEndangered, 3 species areEN/Endangered, 3 species areVU/Vulnerable, 19 species include LR/Lower


Riskand2speciesareDD/DataDeficient.WildlifeWildlifespeciesfoundintheareaPT.SMPare47speciesconsistsofsixmammal,39speciesofbirdsand2speciesofreptile.ThehighestpopulationspeciesfoundintheareaBatangBayahRiveri.e.37species(5mammal, 30 birds and 2 reptiles). Total wildlife family are 33 containsmammal (6 family), birds (25family) and reptile (2 family).Mammal and reptile family arenot found thehighest polpulation. Everyfamilyhasonespecies.atthebirdsfamilyhasoneofthehighestfamilywhichisCapitonidaewith5(five)species.TotallyprotectedspeciesofwildlifebaseonNo.7,1999is9species(2speciesofmammaland7speciesofbirds).WildlifeincludetheCITESAppendixare9speciesconsist1ofmammalincludeAppendixIand8species(2ofmammal,5speciesofbirdsand1speciesofreptile)includeAppendixII.TherearewildlifethreatenedbasedonIUCNcriteriawithcategoriesonespeciesisEN/Endangered(Genting),2speciesareVU/VulnerableandtwoofbirdsincludeNT/NearThreatened.EnvironmentalServicesAspectsSoilErosionBasedoncalculationtheerosionhazardrateintheareanotplantingifhavelandclearingoperationalfornewplantingorreplantingislowtoveryweight(8,38–4527,61ton/ha/years).StakeholderconsultationWhilehavingHCVandSEIAssessmentsontheground,theprocesshadbeenthroughconsultationprocesswithvariousstakeholders,suchaslocalgovernment,thelocalcommunity,customaryrepresentatives,thegovernmentofficialsoflocalvillagesandsub‐district,andthelocalNGOs.However,thereisnoevidencethat public consultation (post HCV assessment on the ground) has been conducted.While verificationaudit,PTSMPisscheduledtohavepublicconsultationsoon.

4. Summary

a.Summaryofassessmentfindings(forSEIassessments)Summary of key findings in respect of socio‐economic impacts to country, region and localcommunities.LegalEnvironmentImpactAssessmentfindings PTSMPisenvironmentallyandsociallyfeasible. PTSMPneedtoconservesomeareafromitslocationpermit. PTSPMneedtofollowenvironmentmanagementandmonitoringplansoeffluentandemissionofitactivitieswillnotagainstgovernment’senvironmentalqualitystandards.

PTSMPneedtofollowsocialmanagementplantoavoidsocialdisturbance.

SEIAfindingsThe information on the SEIA document contain about positive and negative impacts from PT SMPactivities. Some identified positive impacts from company’s operational such as: road maintenanceprogram, smallholder scheme programs, job vacancy, increase land values, increase ofmigrants fromother villages. However information regarding distribution of company’s positive impact to affectedpartiesstilllimitedinMatanJayavillage.TheothervillagesstillnotaffectandhasnoenoughinformationaboutPTSMP.Several identified negative impacts are: land tenure issue, farming areas, plantation ,and Non TimberForestProductswere reduceddueto limitedarea.Apartofnegative impact fromcompany’sactivitiesaccordingtothestakeholderview,suchasunsolvedlandcaseinBatuDayavillagecovering1088.31halandclaimed(thisisrelatedtothepreviousmanagement)anddelayingofsmallholderschemeplantationdevelopmentplan.


MajorityofGemavillagershadnegativeperceptiononthepresenceofPTSMP,whereasthemaincauseiscustom violation by PT SMP’s staff (while still under previous management) who did pioneering /measuring land without asking permission and violated the tomb of indigenous people / ancestors.FollowingofPTSwadayaMuktiPrakarsaplaning to increaseoilpalmplantationareawith total2,900hectareinfourvillagesi.e.Sampurnavillage,Laurvillage,andBatuDayaVillage,SimpangDuavillage,onTuesday,September17,2013,thecompany'smanagementteamconducteddiscusionatKetapangregentofficeand. thepublicandcommunity leaders fromtwocommunitiesgroupshadexpressedtheirviews,amongothercommunitiesaboutlandacquisition,inter‐villageboundarywhichisnotyetclearandclean.Relatedtothelandissues,thecommunityrequestedtobeinvolvedduringresolutionconflictprocess.b. Summary ofassessmentfindings(ForHCVassessments)

TheidentificationandanalysisofHCVwascarriedoutintheareaPT.SMP,KetapangandKayongUtaraRegency,WestKalimantanProvince.Assessmentcoveredboth in12,387.72hawithinnonplantedareaand8,634.37ha thathasbeencleared/planted.LandcoverconditionoverPT.SwadayaMuktiPrakarsaconcession consistof six type i.e. secondary forest (4.631,84ha),mixplantation (5921,53ha),palmoil(9.376,22ha),dry landagricultural (240,73),bare land (826,71ha) andriver (22,06ha).Basedonsoilmap and RePPRoT land system map there is no peat land exist, soil type dominated by ultisol andinceptisolorderwhichrecognizedasmineralsoil.AroundtheSMPareacouldbefoundprotectionareaatthesouthborderwithGunungPalungNationalPark,andprotectionforestnamelyBatuDayaandBukitJuring.ForeststatusisveryimportantinformationtodetermineeHCV1andHCV2.Regardingforeststatus,theHCVassessorswerestilluse the MoFDecreeNoNo.529/2012 thathasexpiredandreplacedwiththenewoneDecreeNo.936/2013which iseffective from30December2013. TotalHCVareaboth innon‐plantedandplantedareas, is1069.46Ha,whichconsistsof1012.95Hafromareasthathavenotbeenplanted,and56.51HaarefromplantedareasdevelopedbypreviousGroupowner,and52.79Hashouldbecountedinremediationmechanism.ThepresentofHCV1,HCV4,HCV5andHCV6isfoundatPT.SMPconcession.Figure3belowshowsthedistributionofHCVareainPT.SwadayaMuktiPrakarsa.TheimportantelementofHCV1isHCV1.2andHCV1.3regardingtoexistenceofCriticallyEndangeredSpecies according to IUCN, CITES and Indonesian government regulation PPNo. 7/1999. There are 9wildlife species (2 species ofmammal and 7 species of birds) categorized as protected species in PPNo.7/1999,while 1mammal species is listed in the CITES Apendix I and 8 species (2 ofmammal, 5speciesofbirdsand1speciesofreptile)arelistedinApendixII.AccordingtoRedListIUCNcriteria,onespecies is listed as EN/Endangered species, 2 species are VU/Vulnerable and two of birds included inNT/Near Threatened list. There are two flora species are categorized as protected species bygovernmentregulationPPNo.7,1999,andtwofloraspeciesare listed inAppendixIICITES.BasedonRedListIUCN,thereare31(thirtyone)floraspecieswithdetails:1speciesisCR/CriticallyEndangered,3speciesareEN/Endangered,3speciesareVU/Vulnerable,19speciesareLR/LowerRiskand2speciesareDD/DataDeficient.ThehighestconcentrationoffaunaspeciesarefoundaroundtheriversandscatteredhillsoverPT.SMPconcession.

SpecificallyintheareasthathavenotbeenplantedtherearetwoprotectedfloraspeciesaccordingtoPPNo.7/1999,namelyTengkawang(Shoreastenoptera)andKantungSemar(Nepenthesgracilis),twofloraspeciesarelistedinAppendixIICITESnamelyKantungSemar(Nepenthesgracilis)andAnggrekTanah(Spathoglottisplicata),and10floraspeciesarelistedinRedListIUCN.

In wildlife category, there are 9 protected according to PP No. 7 /1999 namely: Kelampiau/owa(Hylobates agilis), Kucing Hutan (Prionailurus bengalensis) Elang Brontok (Spizaetus cirrhatus), ElangCapung(Microhieraxfringilarius),Haruai/Kuwau(Argusianusargus)PekakaEmas(Pelargopsiscapensi),Rangkong (Buceros rhinoceros) Burung Madu Kelapa (Anthreptes malacensis) and Burung Pijantung(Arachnotheralongirostra).TheeightspeciesarelistedinCITESAppendix,andbasedonIUCNRedList


therearesomewildlifespeciesnamely:Hylobatesagilis(Endangered),Macacanemestrina(Vulnerable),Sus barbatus (Vulnerable), Buceros rhinoceros (Near Threatened) and Argusianus argus (NearThreatened).AllthefloraandfaunaspecieslistedaboveareidentifiedasHCV1.2andHCV1.3.

HCV1.1identifiedbasedonforeststatus,andsincethisHCVassessmentusedtheoldforeststatusthenthereispossiblyfewotherareastobeconsideredasHCVareasand .Duringtheaudit,theverifierhasfoundthenewforeststatusissuedbyMinistryofForestDecreeNo.962/2013regardingtoforeststatusdesignationofWestKalimantanProvince,andoverlaidwiththeconcessionareaasshowninFigure2.Toresponsethisissue,themanagementofSMPhasconstructedmanagementplanbasedonthenewforeststatustoensurethattheprotectedareaswillnotbeopened.

BasedonthisdatacanbedescribedthattheforeststatusofPT.SMPisdominatedbyOtherPurposeArea(APL) and Convertible Production Forest (HPK) and small portion of Bukit Juring protected forest(149.2Ha)locatedonnewdevelopmentarea,andatthesouthpartoftheconcessionisborderedwithGunungPalungNationalPark.

FindingsonHCV4consistofHCV4.1and4.2.HCV4.1relatedtotheexistenceofecosystemorareathatimportant for water supply and flood controlling to the downstream area. Based on hydrologymapknownthatPT.SMPwasinLaurwatershedandMatanwatershed.Somerivers foundaroundthenon‐cleared/planted area, and the existence of these rivers are source for water supply and could beconsideredasHCV4.1.TotalofHCV4.1includingthebufferis195.12Hawithdetails:Sungai28(8,14ha),S.Ampak(10,17ha),S.BatangBayah(128,24ha),S.Bayah(4,04ha),S.Kamra(10,10ha),S.Kranji(11,36ha),S.Linggan(6,94ha),S.Merambang(1,44ha),S.S‐O60(3,88ha),S.Pambat(7,41ha)andS.Pinangkanak(3,40ha).The important elements forHCV4.2are related to thepotential erosionandsedimentationcausedbytopographic condition. There are three parameters used to predict erosion level/rate namely:topographic/slope,soiltypeandrainintensity.Intersectionoftheseparameterswouldpopulateerosionhazardousleveldistributionovertheconcession.Areahasslope>40%isclassifiedasHCV4.2withtotalarea1217.28Haandlocatedonlyonnon‐planted/clearedareaincludedBukit05(204,97ha),Bukit06(72,17ha),Bukit07(30,89ha),Bukit08(136,75ha),BukitBatuDaya(125,43ha),BukitBulobala(31,10ha),BukitNibung (7,20ha),BukitPakit (10,41ha),BukitPenyaronang (12,45ha),BukitSarangElang(183,41ha),BukitSihombung(14,91ha)andBukitTemiang(19,64ha).The existence of HCV 5 is based on interviews/discussions with local communities distributed in 6villagesnamelyDesaMatanJaya,Sempurna,MekarHarapan,MekarRaya,BatuDaya,andGema.TherearenaturalecosystemprovidesbasiccommunityneedsinMekarJayavillageandGemavillage.Bulobalahills, Sihombun hill and Pakit hill inDesaMekar Raya, andwater spring in Gema village classified asHCV5.CommunityofMekarRayavillagesusedtoutilizehillsforsubsistencefoods,medicinesource,andfuelwood,meanwhilecommunityofGemavillageusedwaterspringfordailywatersupply.


TheexistenceofHCV6foundasarcheologysitethathasstronghistoryrelationtothecommunity,inthiscaseancientcemetery is identifiedasHCV6,coveredKuburanBatangBaya,KuburanKomangKamba,Kuburan Pasaringgit, and there is one scared place for worshipping in Bukit Penyaronang and BukitPakit.
