    10.3 Decision to have a Recovery Plan – some issues

    The Committee noted issues associated with the Recovery Planning Action Commenced and Not Commenced Lists.

    The Committee noted practical outcomes of these lists to date is producing adverse consequences of rushed plans and activities that would probably be best directed to other high priority areas to achieve conservation outcomes.

    The Committee agrees to the proposed actions and approach to rectify these issues.

    The Committee agrees to amended Recovery Planning Action Commenced and Not Commenced Lists for recommendation to the Minister for publication and encourages the Department to review lists to ensure efficient and effective ways to advance conservation.

    The Committee noted that a proposal, including timetable, to effectively manage the passage of outstanding recovery plans on the Commenced List will be presented for the Committee’s consideration at the next TSSC meeting.

    The Committee noted with the amendments of the legislation the avoidance of issues such as this is important in achieving conservation outcomes and therefore recommendsthat the consequences of the transitional arrangements between the Endangered Species Protection Act and original EPBC Act and the amended Act of 2006 be drawn to the

    attention of Dr Hawke with a suggestion that a legislated remedy might be better than relying on the Acts Interpretation Act and traditional transitional arrangements.

    In agreeing to endorse the recommendations, the Committee noted that, while the amendments to the EPBC Act and ensuing processes to implement them were well intended, they were detracting from good conservation outcomes.

    Timing: Within 90 days of receiving this advice - although earlier approval will allow-sonta.> - recovery plans to proceed for adoption under the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act).

    Purpose: To seek your agreement to resolve outstanding administrative matters concerning decisions to have/not have recovery plans for threatened species and ecological communities.

    Background:

    • Previously under the EPBC Act recovery plans were required for all listed threatened species and ecological communities.

    • Following amendments to the Act in 2007, you are now required to make a decision about whether or not a recovery plan is required for each species or community.

    • As provided for by the transitional provisions of the Environment and Heritage Legislation Amendment Act 2006 (EHLA Act), species or communities that did not have a recovery plan in place at the time of the amendments were placed on either the Recovery Planning Action Commenced List (if they had a plan in preparation) or the Recovery Planning Action Not Commenced List. These are referred to here as the Commenced List and the Not Commenced List.

    • Species or communities on the Commenced List were deemed to have had a decision to have a recovery plan.

    • Each species or community on the Not Commenced List was required to have a conservation advice in place by 31 December 2008, with this requirement having been met.

    • In addition, for each species or community on the Not Commenced List, the Threatened Species Scientific Committee (TSSC) was to provide you with a recommendation about whether to have a recovery plan and you need to make this decision within 90 days of receiving the TSSC's recommendations.

    • Section 269AA of the EPBC Act describes your obligations for deciding whether to have recovery plans for listed threatened species or ecological communities and subsection 269AA(3) requires you to have regard to the recommendanons made by the TSSC in making initial recovery plan decisions for such entities.

    • The TSSC has now considered whether recovery plans are needed for all entities with outstanding decisions and agreed to the recommendations below being put to you.

    • Under subsection 269AA(9) of the EPBC Act, you must publish a decision whether to have a recovery plan and the reasons for it. The publication must be made in a way that you consider appropriate.

  • Issuesl Sensitivities:

    There are three administrative matters requiring resolution:

    • Firstly, the statutory deadline by which the TSSC was to provide you with advice about

    whether to have a recovery plan for each entity on the Not Commenced List (31 December 2008) has passed. Background on the reasons for this and the way forward are provided in Attachment A.

    • Secondly, at the time the above lists were published, some species or communities were not included or incorrectly included on a list. Further background and details are provided in Attachments A. Band C.

    • Recommendations for the resolution of these matters were agreed by the TSSC at its meeting of June 2009. Extracts of the relevant agenda item and minutes are provided at Attachment G.

    • These administrative matters requiring resolution relate to the transitional provisions of the EHLA Act and are largely technical in nature. Publication of your decisions on the internet is considered sufficient and appropriate.

    1. Approve publication on the department's internet of amended Recovery Planning Action Commenced and Not Commenced Lists as shown at Attachments Band C.

    2. Under section 269AA of the EPBC Act, agree to not having a recovery plan at this time for species and ecological communities on the Recovery Planning Action Not Commenced List (except for those that have already had a decision) by signing the notice at Attachment D.

    3. Under subsection 269AA(9) of the EPBC Act, agree to publication of the notice at Attachment D on the department's i ntarnat site.

    ATTACHMENT A

    Decision to have a recovery plan – administrative matters requiring resolution

    Background

    1. Previously under the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act), recovery plans were required for all listed threatened species and ecological

    communities (except those that were determined extinct or conservation dependant). The

    2007 amendments to the EPBC Act however removed this mandatory requirement. The

    Environment and Heritage Legislation Amendment Act (No.1) 2006 (EHLA Act) which

    made the amendments, included transitional provisions that established how listed species

    and ecological communities, without recovery plans at the time of commencement of the

    amendments, were dealt with under the amended EPBC Act.

    2. The Threatened Species Scientific Committee (TSSC) was given six months from the commencement time of the EHLA Act to provide the Minister with the following two

    written lists:

    Recovery Planning Action Commenced List – i.e. species/community for which recovery plan not yet made but work on development had started; and

    Recovery Planning Action Not Commenced List – i.e. species/community for which recovery plan not yet made and not yet started.

    3. The above lists were provided to the Minister in August 2007 and, under the provisions of the EHLA Act, have been published on the Internet. As required under subsection 273(1)

    of the EPBC Act a recovery plan must be in force within three years of the decision under

    section 269AA. Those species/ecological communities on the Commenced List are

    required to have a recovery plan in place by August 2010.

    4. Once the Recovery Planning Action Commenced List (the ‘Commenced List’) was published the transitional provisions applied to deem a decision to have a recovery plan to

    have been made under section 269AA of the EPBC Act, for the species and communities on

    the Commenced List. This is a prerequisite to the actual making of a decision to make or

    adopt a recovery plan under EPBC Act section 269A.

    5. The amended EPBC Act requires the TSSC to give the Minister material of the kind referred to in paragraphs 189(1B)(b) (i.e. conservation advices) and (c) (i.e. a

    recommendation on the question whether there should be a recovery plan) for each species

    or community on the Recovery Planning Action Not Commenced List (the ‘Not

    Commenced List’). Also, the transitional provisions of the EHLA Act required the TSSC to

    specify the time (the compliance time) by which it would give the Minister this material.

    This was agreed by the Minister to be 31 December 2008 for all entities on the list.

    6. Advice from the Department’s Legislation Policy Section is that the Commenced and Not Commenced Lists are statutory lists, but are not legislative instruments. They could be

    viewed practically as administrative guidelines for both the TSSC and the Department.

    7. The transitional provisions of the EHLA Act contain no provisions on amending the Commenced and Not Commenced Lists to correct any inaccuracies or mistakes that occurred

    at the time they were made. Despite the uncertainty of whether the lists can be amended,

    the Legislation Policy Section considered it open for the TSSC to amend the lists as the

    preferable way of rectifying the problems at hand. If the amended lists are provided to the

    Minister, and the necessary publication occurs on the Department’s internet, then the

    transitional provisions in the EHLA Act will be able to operate in relation to the amended

    items on each list.

    Matters for resolution

    8. Current recovery plan administrative matters requiring resolution are as follows:

    Decision/s still required by the Minister on whether or not there should be a recovery plan for each species or community on the Not Commenced List.

    Some species/ecological communities not included or incorrectly included on a list.

    Outstanding recovery plan decisions

    9. While conservation advices have been approved for all species and communities requiring a conservation advice on the Not Commenced List, material concerning the decision about

    recovery plans has only been provided for seven of these and the deadline by which the

    TSSC was to provide the Minister with recovery plan recommendations for the others

    (31 December 2008) has passed.

    10. One of the reasons for this relates to the desire to take a more strategic landscape approach to recovery plan decision-making and to factor in the experience gained from the pilot

    program being undertaken on regional recovery plans. It has also taken some time to

    identify all of the EPBC-listed threatened species covered by the various regional recovery

    plans in preparation and which of these species are endemic to the relevant regions. Legal

    advice also had to be sought on issues associated with part-range recovery plans.

    11. The Department’s preferred option for handling the 707 outstanding decisions required was that the TSSC agree to recommend that the Minister decide not to have a recovery plan for

    each of the 707 species/ecological communities at this time. The option for the Minister to

    decide at a later date to have a recovery plan for a listed threatened entity would remain

    available under section 269AA(4) of the EPBC Act (making a subsequent recovery plan

    decision). This could then be based on the best available information, including lessons

    being learned through the regional recovery plan pilot program and ongoing refinement of

    the Department’s decision support tool for deciding on whether or not to have a recovery

    plan. The TSSC agreed to this approach at its 39th meeting in June 2009.

    Species not included or incorrectly included on Commenced/Not Commenced Lists

    12. Of all the listed threatened species or ecological communities that did not have recovery plans in place at the time of the amendments, 17 species did not appear on either the

    Commenced List or the Not Commenced List, and two species appeared on both lists.

    Furthermore, three species that had recovery plans in place (Thelymitra jonesii, Zieria

    parrisiae and Z. prostrata) were mistakenly included on one of the lists and four Western

    Australian species that had individual recovery plans in preparation should have been on the

    original Commenced List (i.e. Calectasia cyanea, Gyrostemon reticulatus, Haloragis

    platycarpa and Frankenia conferta). These oversights occurred as a result of the short time

    available to put the two lists together.

    13. A number of regional recovery plans planned for adoption under the EPBC Act were in preparation when the original Commenced and Not Commenced Lists were being

    developed. It was not clear at the time just which EPBC-listed threatened species were to

    be covered by these plans. Hence some of the species that should have been placed on the

    Commenced List were not. This has been rectified by ensuring that all such species

    endemic to these regions are now on the Commenced List, as they should always have been.

    This includes four species for the Adelaide and Mount Lofty Ranges region, 11 for the

    NSW/Qld Border Ranges Rainforests region, 23 species for the NSW Northern Rivers

    region and nine species for the Fitzgerald Biosphere region in WA.

    14. In line with the above Legislation Policy Section Advice, the TSSC has agreed to the amended Commenced and Not Commenced Lists in accordance with whether recovery plans

    were in place, had commenced or not commenced as at August 2007. Details of all changes

    made to these lists are identified in Table 1.
