D. , President, convened this meeting of theBoard of Medical Examiners of the State of North Carolina at8:45 p. m. , Thursday, August 7, 1986, at the Greenville Sheratonin Greenville, North Carolina. Board members presentincluded: Charles H. Duckett, M. D. , Secretary; Eben Alexander,Jr. , M. D. ; David S. Citron, M. D. ; John T. Daniel, M. D. ; HaroldL. Godwin, M. D. ; and Mrs. Martha Kirkland Walston. Simmons

Martin, ~Jef fre, M. D.
The Board of Medical Examiners of the State of North Carolinaheld a Hearing on charges preferred against Jeffrey Martin,M. D. , at 4:30 p. m. , Friday, August 8, 1986, at the GreenvilleSheraton, Greenville, North Carolina. Neither Dr. Martin norhis counsel appeared at this Hearing. The Board of MedicalExaminers unanimously adopted a motion made by Dr. Citron andseconded by Or. Alexander that the Board finds the chargespreferred against Jeffrey Martin, M. O. , to be true. The Boardunanimously adopted a further motion made by Dr. Koontz andseconded by Dr. Alexander that the Board of Medical Examinersrevokes Dr. Martin's license to practice medicine in the stateof North Carolina.
Coleman, Peter Richard, M. D.
The Board unanimously adopted a motion made by Dr. Citron and
seconded by Dr. Duckett that the Board of Medical Examinersissue Dr. Coleman a resident's training license effectiveAugust 12, 1986; that he comply with the conditions placed on
his licensure in Virginia; that he furnish the North CarolinaBoard with copies of all reports provided to the VirginiaBoard; and that he appear for interviews at the Board'srequest. The Board unanimously adopted a further motion thatthe attorney for the Board of Medical Examiners prepare aletter to the Dean of the Medical School at the University ofNorth Carolina with copies to Board members stating:
Evidence has come to the Board's attention indicating NorthCarolina Memorial Hospital has misinterpreted the MedicalPractice Act by allowing individuals to perform medical actsprior to obtaining residents training licenses and by allowingresidents who do not hold full North Carolina medical licensesto issue prescriptions outside the scope of their training
programs.
Collins, F. Farrell, M. D.
The Board adopted a motion made by Dr. Citron and seconded by
Dr. Alexander that the Board of Medical Examiners secure Dr.Collins' written permission for the Board to notify the Boardof Nursing of the Board of Medical Examiners' action, for theBoard to publicize this action in the Board Bulletin as aformal reprimand without stating the reas~on or tttss action,and for the Board to deem Dr. Collins authorization a publicdocument. Dr. Duckett voted in opposition to the portion ofthe motion concerning publishing the action in the Board
Bulletin.
Manly, James Hollowell, Jr. , M. D.
The Board unanimously adopted a motion to reinstate Dr. Manly'slicense previously suspended for failure to register and tosend all future correspondence to this physician registered,return receipt requested.
Stanley, Karl Harvey, M. D.
The Board of Medical Examiners unanimously adopted a motion
made by Dr. Citron and seconded by Dr. Koontz that the Boardadvise Dr. Stanley both verbally and in writing to sign aConsent Order agreeing:
1. to submit to psychiatric evaluation and follow-up treatmentas the psychiatrist deems necessary from a physician desig-nated by the Board of Medical Examiners;
2. to submit to physical evaluation and follow-up treatmentas the doctor deems necessary from a physician desig-nated by the Board;
3. to permit the Board to make these arrangements forpsychiatric and physical evaluations with Eugene Douglas,M. D. , and David Richardson, M. D. ;
4. to refrain from the use of any controlled substances exceptfor those which may be prescribed by another physician ordentist;
5. to submit to random drug screens at the Board's request;
6. to appear before the Board at its October, 1986, meeting;
7. to surrender his license and receive, contingent upon
his compliance with these six conditions, a temporarylicense for a period of ninety days.
Mrs. ralston commented that she believed North Carolina should
have a better way to help impaired physicians. Dr. Duckettreported that the Executive Council of the Medical Society isaware of this problem and that there are plans to improve thesituation. Dr. Citron stated that Brian Nahey, M. D. , a
psychiatrist who started an impaired physicians program inanother state, is available if the Board wants to ask him
questions regarding methods to improve the existing North
Carolina program. Dr. Koontz directed that Dr. Duckett as theBoard's representative to the Executive Council of the NorthCarolina Medical Society introduce this subject at the nextCouncil meeting and that the Executive Secretary discuss thematter with Mr. Moore.
Recce, Donald Brooks, M. D.
The Board of Medical Examiners of the State of North Carolinaheld a Hearing on charges preferred against Donald BrooksRecce, M. D. , at 3:45 p. m. , Friday, August 8, 1986, at theGreenville Sheraton, Greenville, North Carolina. Dr. Recceattended this Hearing without counsel. At the conclusion ofthe Hearing, the Board of Medical Examiners unanimously adopteda motion made by Dr. Koontz and seconded by Dr. Duckett thatthe Board finds the charges to be true and orders that Dr.Recce receive a severe reprimand admonishing him that, if he
fails to comply with the statutory requirements, rules, and
regulations of this Board, it wi 11 deal severely with such
infractions.
Khatri, Sat Dev, M. D.
The Board of Medical Examiners of the State of North Carolinaheld a Hearing on charges preferred against Sat Dev Khatri,M. D. , on Friday, August 8, 1986, at ll:30 a.m. , at theGreenville Sheraton, Greenville, North Carolina. Dr. Khatriand his counsel attended this Hearing. Dr. Duckett did notparticipate in this Hearing. At the conclusion of the Hearing,the Board unanimously adopted a motion made by Dr. Koontz and
seconded by Dr. Godwin that the Board finds the charges to be
true, revokes Dr. Khatri's license, and suspends the revocationprovided Dr. Khatri complies with the following probationarycond it 1 ons:
l. Obeys all state and federal laws.
2. Is and remains of good moral character.
3. Surrenders Schedule 2 and 2N prescribingprivileges and refrains from prescribing all anorectics.
4. Maintains adequate records including substantive data on
histories, physical examinations, diagnoses, and management.
5. Submits records for monitoring at the Board's request.
6. Notifies the Board prior to moving from the state of NorthCarolina.
7. Takes and passes Component II of FLEX not later than June1987.
The Board indicated that Dr. Khatri may take FLEX prior toJune, 1987, and, if he does not pass the examination, may takeit again in June, 1987. The Board further indicated that acover letter to Dr. Khatri accompanying this order may advisehim concerning the educational rehabilitation program in
Maryland'
Martin, Howard, M. D.
The Board of Medical Examiners of the State of North Carolinaheld a Hearing on charges preferred against Dr. Martin at 9:00a.m. , Friday, August 8, 1986. Dr. Martin and his counselattended this Hearing. At the conclusion of the Hearing, theBoard unanimously adopted a motion made by Dr. Duckett and
seconded by Dr. Citron that the Board of Medical Examinersfinds the charges to be true, revokes Dr. Martin's license, and
stays the revocation provided that for a period of three yearsDr. Martin obeys all laws; is and remains of good moralcharacter; upholds the medical profession's standard of ethics;refrains from consuming any controlled substances notprescribed by another physician or dentist; and appears beforethe Board of Medical Examiners annually during the month ofAugust.
Kej, Gary H. , M. D.
The Board unanimously adopted a motion made by Dr. Koontz and
seconded by Dr. Duckett that the Board of Medical Examinerssummarily suspend Dr. Kej's license immediately as the safetyof his patients is in jeopardy.

Grace, ~Eu ene Vernon, M. D.
The Board unanimously adopted a motion made by Dr. Godwin and
seconded by Dr. Duckett that the Board of Medical Examiners
request Dr. Grace to sign a Consent Order stipulating he will:
1. surrender Schedule 2 and 2N prescribing privileges;
2. issue no further prescriptions outside the scopeof his normal medical practice;
3. issue no further prescriptions at someone else' srequest.
4. examine all patients he treats and maintain records on
these patients;
The Board unanimously adopted a further motion made by Dr.Godwin and seconded by Dr. Duckett that, if Dr. Grace fails tosign this Consent Order, the Board of Medical Examiners willhold a Hearing on charges preferred against this physician atits October, 1986, meeting. The President instructed that theBoard's attorney send Dr. Grace a Consent Order to be signedtogether with a cover letter.

prescriptions after signing a statement indicating she would
not do so. The Board unanimously adopted a motion made by Dr.Koontz and seconded by Dr. Duckett that the Board of MedicalExaminers write Dr. Farias a letter of admonishment stating theBoard has reviewed information indicating she has failed toabide by the terms of her agreement with the Board of MedicalExaminers and further stating the Board will continue tomonitor her prescribing practices.
Examiners accept this report as information. The Board
unanimously adopted a further motion made by Dr. Citron and
seconded by Dr. Duckett that the Board report this matter tothe Federation.
Rigdon, ~Henr Lewis, M. D.
The Board unanimously adopted a motion made by Dr. Citron and
seconded by Dr. Koontz that the Board of Medical Examiners send
Dr. Rigdon a letter stating:
Information has come to the Board's attention thatyou are now residing in South Carolina and no longerwork at the Charlotte Treatment Center.
Should you wish the Board of Medical Examiners toconsider continuing your limited North Carolinalicensure, you should so advise.
Woodward, Robert Warren, M. D.
The Board reviewed information indicating that the GuilfordCounty Medical Society has inquired about this physician' s
problems in Massachussetts. The Board unanimously adopted a
motion made by Dr. Alexander and seconded by Dr. Koontz thatthe Board write a letter to the Guilford County Medical Societystating Dr. Woodward made the Board of Medical Examiners aware
of the matter in Massachusetts at the time it approved thisphysician for licensure; stating Dr. Woodward has met the Boardof Medical Examiners' requirements for licensure; furtherstating Dr. Woodward continues to be licensed by this Board;and also stating the Board of Medical Examiners has taken no
further action concerning this matter.
Dr. Koontz stated that, if the Guilford County Medical Societyrequests a copy of the Consent Order from Massachusetts, theBoard of Medical Examiners provide this information.

October, 1986, ~Meetin
The Board adopted a motion that, if the staff can change
arrangements, the Board of Medical Examiners meet at theRaleigh Hilton for its October, 1986, meeting; that it not plana half-day of optional activities; and that it hold all futuremeetings at the Raleigh Hilton with the exception of the May
meeting. Dr. Citron suggested that, if the Raleigh Hilton isnot available in October, 1986, the staff may wish to contactthe Hotel Europa in Chapel Hill to determine if this hotel canaccommodate the Board during its next meeting.
Ma&gee, Archibald Carter, N. D.
The Board unanimously adopted a motion made by Dr. Citron and
seconded by Dr. Koontz that the Board of Medical Examinerswrite a letter to Dr. Magee advising, prior to approving him totake FLEX, the Board wishes him at his own expense to submit toan evaluation by a forensic psychiatrist, Dr. Halleck. The
Board also unanimously adopted a motion made by Dr. Citron and
seconded by Dr. Koontz that the Board of Medical Examiners
specify it desires answers to the following questions:
1. Does Dr. Magee have a major psychiatric disorder ora serious character disorder?
2. What is Dr. Magee's diagnosis and prognosis?
The Board unanimously adopted a further motion made by Dr.Citron and seconded by Dr. Koontz that the Board of MedicalExaminers allow Dr. Halleck to administer psychological testsat his discretion.

The Board unanimously adopted a motion made by Dr. Godwin and
seconded by Dr. Daniel that the Board of Medical Examinersdefer action on this corporation until the attorney for theBoard studies this matter and reports his findings.
The Board also unanimously adopted a motion made by Dr. Godwin
and seconded by Dr. Daniel that, if there is a conflict of law,the Board of Medical Examiners will refer this matter to theappropriate authority.

The President stated that he wi 11 preside at the clinicalclerkship hearing and at any other administrative hearing, toinclude Bee Sting, which may be scheduled for October. He
instructed that the staff schedule all hearings which arepending, including Dr. Magee, for the October, 1986, meeting ofthe Board of Medical Examiners.
Branly, Louis ~Philli , li.D.
The Board unanimously adopted a motion made by Nrs. Walston and
seconded by Dr. Koontz that the Board of Medical Examinersapprove Dr. Branly's proposed practice activities; that theBoard request Dr. Branly to appear for an informal interviewprior to the expiration of his temporary license; and that, inapproximately six months, an investigator visit the area todetermine that Dr. Branly is limiting his practice to thespecialty of Psychiatry.
Physician Extender Policies
The Board unanimously adopted a motion made by Dr. Citron and
seconded by Dr. Duckett that the staff compile physicianextender policies in a hard bound cover; that the staff make
this bound copy of policies available at each Board meeting;and that, after the staff has compiled these policies, theBoard of Medical Examiners consider sending this material toall primary supervising physicians.
Dr. Citron stated that the countersigning interval for

PA/patient contact should be changed from twenty-four hours toup to three working days.

In accordance with the terms of a Consent Order, Dr. Appiah
appeared for an informal interview with the Board. The
President informed Dr. Appiah that the North Carolina Board ofMedical Examiners licensed him on the basis of endorsement ofhis Pennsylvania license and further informed Dr. Appiah that,if the Pennsylvania Board of Medical Examiners should revokehis license to practice medicine in Pennsylvania, no basiswould exist for licensure in North Carolina. However, thePresident of the Board advised Dr. Appiah that, at the presenttime, he may work in North Carolina under the provisions of theConsent Order.
Watson, Susan Austin, M. D.
The Board unanimously adopted a motion made by Dr. Citron and
seconded by Dr. Koontz that Dr. Watson furnish the Board with a
written statement explaining the difference in her answer tothe controlled substance question; that the Board issue Dr.Watson a two year dated license; that the Board eitherinterview Dr. Watson or obtain reports concerning thisphysician prior to the expiration of this dated license; and
that, if all goes well, the Board of Medical Examiners considerissuing Dr. Watson a full license at the end of this two yearperiod.

Dr. Daniel presented this report to the Board. The Board ofMedical Examiners unanimously adopted a motion made by Dr.Daniel and seconded by Dr. Citron that the Board approve 99EMT-I applications, 23 MICN applications, 15 EMT-P
applications, and 47 EMT-AI applications.
The Board unanimously adopted a motion made by Dr. Daniel and
seconded by Dr. Citron that the Board of Medical Examinersapprove 388 Bee Sting applications.
The Board unanimously adopted a further motion made by Dr.Citron and seconded by Dr. Alexander that the Board of MedicalExaminers authorize the Executive Secretary to screen EMS and
Bee Sting applications, present his recommendations forapproval to the Board, and present any problem applications for

the Board's consideration.
The Board's investigators stated that they would inquire indifferent areas of the state about the use of Bee Sting kits.
The Board unanimously adopted a motion that the Board ofMedical Examiners, at its October, 1986, meeting considerdividing the state into areas and adding one or two
investigators to its staff.
Case, David Lawrence, N. D.
The Board unanimously adopted a motion made by Dr. Duckett and
seconded by Dr. Citron (1) that the Board obtain writtenevaluations on Dr. Case from the physicians in charge of histraining programs; (2) that it obtain statements concerninghis performance from McLaurin General Hospital in Flint,Michigan; (3) that the Board consider requesting Dr. Case tosubmit to psychological evaluation prior to approving him forcontinued licensure; (4) that, at this time, the Board ofMedical Examiners issue Dr. Case a dated license expiringDecember 31, 1987; (5) that the Board of Medical Examinersinstruct Dr. Case to inform the Board of his North Carolinapractice address; (6) that the Board advise Dr. Case, if he
engages in the practice of medicine in this state, the Board ofMedical Examiners will subpoena records for its review; and
(7) that the Board further advise Dr. Case, if he ispracticing in this state, the Board of Medical Examiners of theState of North Carolina will request him to appear for an
interview prior to the expiration of his dated license.

Dr. Roberge's application pending receipt of a properlycertified photograph from his medical school.
Stamler, Arthur Alan, M. D.
The Board unanimously adopted a motion made by Dr. Duckett and
seconded by Dr. Koontz that the Board of Medical Examinersissue Dr. Stamler a dated license expiring December 31, 1988;and that it advise Dr. Stamler, if he wishes licensure in NorthCarolina after this expiration date, he must contact the Boardand furnish additional information.

The Board unanimously adopted a motion made by Dr. Koontz and
seconded by Dr. Duckett that the Board of Medical Examinersdefer action on Dr. Thomas pending further investigation.The Board authorized Dr. Koontz to proceed with charges if he
thinks such further investigation warrants.
Jones, ~Anthon Leland. M. D.
The Board unanimously adopted a motion made by Dr. Koontz and
seconded by Dr. Duckett that an investigator present an
up-dated report concerning this physician to the Board ofMedical Examiners prior to its determining whether to drop thecharges preferred against Dr. Jones.
Weintraub, ~Harve , M. D.
Dr. Koontz informed Dr. Weintraub that the Board hasestablished he engaged in the practice of medicine at the BrynNawr Hospital in North Carolina prior to receiving a medicallicense in this state. Dr. Koontz also informed Dr. Weintraubthat the North Carolina Board of Medical Examiners has a reportfrom the Soldiers and Sailors Hospital in Pennsylvaniaindicating Dr. Weintraub dictated admission histories and
physicals without examining patients. The Board unanimouslyadopted a motion made by Dr. Koontz and seconded by Dr. Duckettthat the Board of Medical Examiners not approve Dr. Weintraubfor licensure.

Fred Glass, N. D. , and Ed Browning, representing the Office ofEmergency Medical Services met with the Board of MedicalExaminers to discuss matters of mutual concern. The Boardunanimously adopted a motion made by Dr. Daniel and seconded by
Dr. Koontz that the Board of Medical Examiners approve theproposed regulation changes providing for air ambulanceservices in North Carolina.
The Board adopted a motion that it not approve the addition ofOpthalmic solution to the ENT-P drug formulary.
The Board adopted a motion that the Board of Medical Examinersapprove the following additions to the ENS Formulary:

The Board unanimously adopted a motion made by Dr. Daniel and
seconded by Dr. Koontz that the Board of Medical Examinersapprove an additional EMS application.
