l. Additional data from our records show that the property legal description is Rp7R2599 PART 3. This infonnation is provided only for the applicant and yourinformation purposes only. No changes are required to the application form.

2. Our by-law requires a minimum side yard of 20m for parcels greater tttan 8 ha in therural and agricultural areas for attached ga¡ages. Detached garages are permitted to besignificantly closer, and the side yald requirement is deterrnined by the size ofthebuilding (in section 3.2.6 ofthe zoning by-law), For example, a detached garage of 120

sq m floor area would require a 3.0m setback whereas a 50 sq nr would r.equire l.Ornsetback. However, we understand the complexity of siting the buildirrg and thetopography constraints. We believe thatthe O.órn setback will provide a nrinimum spacefor construction and maintenance, but would caution that duling construction the ownershould identify and mark the property line to ensure that construction and activity onlyoccurs on the subject lands, without trespass.

3. It is our understanding that the addition is for a single detached dwelling use and nocommercial or multiple lesidential use is proposed.

At the regular meeting of Council held March 4,20t5, the following resolution was set forth.

Whereas the Province of Ontario has requested comments on the¡r climatechange discussion paper released on the EBR, No. 0t23452, with the clear intedtof imposing some form of carbon pricing on the taxpayers of Ontario; and

Whereas the contribution of Greenhouse Gases, including Carbon, is recognizedthrough computer modeling to be the principal driver in long-term climatechange; and

Whereas Canada (àOtZ) contributes L.5% of global carbon emissions to theatmosphere with countries like China 122%); US (13%); EU (L0or6l; lndia (5.4%);

Brazil 13.2%); Congo .2.2o/ol far exceeding Canada's emissions; and

Whereas Ontario (O.48%l is a small part of Global Carbon emissions; and

Whereas the Transportation sector in Ontario contributes approx. O.t9o/o of Globalcarbon emissions; and

Whereas Ontario's emissions have been significantly decreasing since 1990 and

are expected to exceed Ontario's defined target for 20L4 oI6%below 1990 tevels;

and

Whereas Ontarlo has immense carbon sinks in their forested areas plus newplantings yearly that are not taken Into account; and

Whereas any form of prlcing carbon, especially Ontar¡o's proposed carbon tax atthe gas pumÞ, will not be effectíve at reducing or even slowing global emissiontrends in the atmosphere - today, the cumulative carbon loadings in theatmosphere from foreign countries continue to escalate and climate change willcontinue thereby forcing Canadians to seek new opportunÍties and/or try to copewith the intensities of the changing climate; and

Whereas. the lack of clarity on "promoting" climate resilience and riskmanagement and the lack of clarity on science and technology makes thiíameaningless discussion paper at a t¡me when we need concrete actions in

Ontario's already changed climate;

Now therefore be it resolved that the Council of the Township of Amaranth isstrongly opposed to the proposals in thls dlscussion paper and formally asks theMinistry of Environment and Climate Change to w¡thdraw such a primitiveattempt to simply grab more taxes or trade carbon at a price - neither scheme

addresses the problem of reducing the rate of global emissions in the atmosphere.But more importantly, the Ontario taxpayër needs greater investments to help

Municipalities adapt to the alúeady changed climates, to support new sustainableopportunities and to protect people and property from today's and tomorrow'sdisasters.

Greenhouse Gas Emission Reduction

The greenhouse effect is real and changes in the climate system are driven by changes in

greenhouse gases - principally carbon and methane in the atmosphere

Global atmospheric models (now more than 40) present a number of scenarios (not forecasts)

given the different rates of change of global greenhouse gas loadings in the atmosphere

Current monitoring of carbon dioxide levels in the atmosphere have continued to escalate and

to date the carbon curve has neither slowed down or even leveled off

China, US, and many other countries (eg. EU, lndia, Brazil, Congo) are responsible forthe

majority of the rate of increase of Greenhouse gases in the atmosphere - Canada's total global

contribution is negligible atL5% with Ontario atO.5% and decreasing.

More than 5O% ol Ontario is covered in forests and their contribution as a sink for carbon has

not been taken into account in the inventory process. This is a significant error since the forests

are able to sequester significant levels of carbon and hence off-set human based emissions'

Ontario has already exceeded the targets set under the Kyoto Protocol - 6% below 1990 levels

by 2OI4 and Ontario is now proposing a carbon prlcing system to further reduce human-based

carbon emissions (eg. at the gas pump). Transportation in Ontario contributes 0.15% of global

emissions and a further proposed reduction by 2020 would reduce Ontario's global contribution

by a further 0.!-O.2%. Costs are unknown!

A proposed cap and trade system continues to allow polluters to buy carbon off-sets from other

sources and the end result is no reduction in emissions. Will a proposed carbon tax at the gas

pump, for example, make any difference? - no, carbon taxes are simply more taxes with no

measureable effect on reducing emissions loadings in the atmosphere.

! Taxpayers need

greater protection and preparation to cope with the changed and changing climate. Change has

two sides - new opportunities and new disasters. Greater investment to protect people and

property is already needed and greater social, economic and environmental opportunities need

to be discovered and supported -the gains far outweigh the proposed carbon tax solutions!

Please be advised that at its meeting held on February 23,2015, the council of The

corporation of the Town of orangeville approved the following resolution:

That the council of the Town of orangeville support the resolution

approved by the Town of Mono relating to neonicotinoid pesticides;

And that the Town of Orangeville review the current plantings and

landscaping products used on municipal lands with a view to

discontinuing any neonicotinoid products by the end of 2015;

And that the Town of Orangeville request the Province of Ontario

and the Government of Ganada to phase out the use of all

neonicotinoids in agriculture and ornamental use, and through

working with the agricultural community provide an orderly

transition to an alternate pesticide;

And that this resolution be forwarded to the Minister of Health

Government Introduces Changes to Land Use Planning andDevelopment Charges Legislation

AMO will be reviewing the Bill in detail once it is posted. In the meantime, the following are the highlights of the changes as weunderstand them.

Streamlining Land Use Planning and Appeals in Ontario

The legislative amendments to the Planning Act are aimed at increased public participation, improved municipal control overdecisions, and better dispute resolution.

HIGHLIGHTS:

¡ The amendments would revise the development approvals system to a "community planning permit system" which wouldenhance input from residents, municipal staff and developers. This system would coordinate zoning, site plan, and other

development applications so a proposed development would be considered and approved as a whole than in pieces.

. Bill would require official plan policies to explain how and when the public is consulted. In addition, municipalities wouldhave to provide an explanation of how public input has influenced planning decisions. Planning Advisory Committees wouldbe required to include citizen representatives.

¡ Official Plan reviews would be extended to ten years from the current five-year review period. It is anticipated that thiswould reduce appeals. In addition, there would be no amendments to the Plan in the first two years except those initiated bythe municipality. Likewise, once the community planning permit system is established, it would not be subject to private

appeals for five years.e The Province will introduce a process to define "minor" for minor variances.¡ Dispute resolution will be promoted through limiting what is appealable and by introducing a 90 day "pause" to allow. resolution ofofficial plan issues.

There was considerable, in-depth consultation with AMO's Planning Task Force on the planning process challenges and we

look forward to confirming what advice was taken.

Development Charges Act Proposals

Changes to the Development Charses Act are intended to help municipalities cover costs while increasing transparency and support

higher density development.

HIGHLIGHTS:

Capital costs for transit would be recoverable at l00o/o and waste diversion capital costs would become an eligible service

area but not landfills.Adds greater onus for oversight and reporting on funds and charges on development that fall outside of what is allowed inlegislation.

Reporting practices for how devv^opment charges are collected and spent, including those charges under Section 37 ofthePlanning Act (bonus, parkland dedication) will be devised. It is expected that there will be more stringent oversight ofdevelopment charges funds and how these funds fit into long term planning and asset management.A significant proposal is that "development charges would be payable at the time the fnst building permit was issued for abuilding".A Development Charges V/orking Group is proposed to be created to provide additional advice on outstanding complexissues.

While some of these changes to the DCA reflect AMO advice given during consultations, a more detailed review will be required toconsider the impacts of these proposed changes to municipal operations. The inclusion of transit and waste costs represents a step inthe right direction but other services remain either discounted or not included at all which does not allow us to say growth is trulypaying for growth.

Since our meeting on February 24 at the ROMA/OGRA conference, I have had an opportunity to follow up with severalMPAC colleagues including Colleen Vercouteren, Director, Valuation & Customer Relations and Keith Schultz, Manager,Valuation & Customer Relations - both of whom are very familiar with your township and the concern you explained re.buildings being constructed without building permits. Jon Hebden has also been part of our discussions and, as youknow, Jon, too, is familiar with the township's concerns.

As discussed on February 24, MPAC's process for data collection of new construction, improvements to existingbuildings, etc., is driven by the electronic receipt of building permit files from municipalities throughout Ontario and, inparticular, the 'occupancy code/date' is of utmost importance as this is the trigger to send assessors to the respectiveproperties and collect the structure/property information changes. Jon advises that Mulmur Township does send itsbuilding permit files to MPAC electronically and, for this, we thank you - it's an effective way (as we discussed) toensure that your assessment growth can be prioritized and turned around in a more timely way.

With regard to those homes that have been constructed without an authorized building permit - as you may appreciate,it would not be appropriate for MPAC to offer advice around the issue of property owners not taking out buildingpermits, however, there is a potential risk for liability against your township in the absence of enforcement by theCBO. And, respectfully, I will leave this to you for advancing discussions with your CBO/County colleagues.

Having said this, I understand that there was a meeting in 2014 to discuss an alternative means to capture thosestructures, in Mulmur Township, which have been constructed without building permits - I am advised that thearrangement is as follows:

the municipality identifies the anomaly situations, by roll number, description, etc., and does so on a regularbasis (vs. in bulk at end of year)

MPAC treats this as an enquiry, logs and prioritizes the subject propertíes into its internal inventory system inreadiness to be prioritized for field inspection.

Since 201.4, a total of 18 permit enquiries have been provided to the local MPAC office:- 9 of the enquiries did not have a permit issued

o 2 of these have been assessed

o The remaining 7 permits are in the queue awaiting field inspection (They are a variety of barns and

Quonset huts, not houses)- 9 of the enquiries did have a permit issued

o 6 ofthese have been assessed

o 3 of these have not been assessed, 2 of which are houses received in in the late fall of 2OL4 with the oneremainder being a secondary building

From conversations with my colleague', t believe the 'alternative means' is working reasonably well between thetowçship's administration and MPAC's local field office - it is an interim solution that enables assessment growth to becaptured and provided to the township under unusual circumstances that are under the carr¡age of the County andMulmur Township.

Schedule "A"

The following words used in Schedule "4" shall have thefollowing meanings:

"Fill" means: "any type of fill material deposited or placed onlands and includes soil, earth, topsoil, loam, subsoil, clay,sand, gravel, stone, concrete, peat, sod or turf either singlyor in combination;"

"Respondents' Property" means: "the lands tegally describedas the East Half of Lot 21, Concession 3 in the Township ofAmaranth, and as are more particularly described in theParcel Register for PIN 34052-0024 (LT) in the LandRegistry Otfice No. 7 for the County of Dufferin, and with amunicipaladdress of 475056 County Road 11;"

"Burnsides" means: "R.J. Burnsides and Associates Limited,being the Township of Amaranth Engineers, and for thepurposes of Schedule "4" are acting as agents of. theTownship of Amaranth and the County of Dufferin and aretherefore authorized to provide express written permissionfor any Fill activities or grading required to fulfill the termsand obligations of Schedule "4" and the Court Order."

The Respondents shall meet with Burnsides to review aWork Plan including a Construction Schedule in order toensure that the required obligations are completed as quicklyand as cost effectively as possible,

The Respondents agree to work cooperatively withBurnsídes and the Respondents further agree that they shallcarry out their obligations under Schedule "4" in a diligentmanner, including having the appropriate equipment andmanpower on site as per the Work Plan including meetingthe Construction Schedule.

The Respondents shall make best efforts to obtain copies ofall way bills and produce same to Burnsides for Fill alreadydeposited on the Respondents' Property. Such copies shallbe produced on or before March 31,2015.

Burnsides shall carry out a visual inspection of theRespondents' Property to determine the amount of suffacedebris (asphalt, plastics). The Respondents shall removesuch debris to Burnsides' satisfaction.

Burnsides shall take such Fill samples, as it deems in itssole professional judgement are necessary, from theRespondents' Property and have such Fill tested to make anassessment as to whether or not the Fill is clean. Thestandard for determining whether or not the Fill is clean iswhether or not the Fill meets the standards as set out inTable 1 of the Ministry of Environment Guideline entitled"Soil, Ground Water and Sediment Standards for Use UnderPart XV.1 of the Environmental Protection Act." lf it isdetermined in the professional engineering judgement ofBurnsides that the Fill is clean, then all or the majority of theFill may remain on the Respondents' Property, subject toany grading difficulties. lf, instead, it is determined byBurnsides in its professional engineering judgement that theFill is not clean, then the Respondents shall be required toremove parts or all of the Fill as may be directed byBurnsides and to dispose of such Fill legally elsewhere atthe Respondents' cost. ln these circumstances, such furthersampling and testing shall then be carried out by Burnsidesto confirm in Burnsides' professional judgement that theRespondents' Property now meet the standards as set out inthe applicable Table 1.

Burnsides shall determine the appropriate grading of theRespondents' Lands to ensure that stormwater is handledproperly and that any nuisance impacts on the neighbouringlands are eliminated. Should there be excess Fill that cannotbe appropriately graded, then the Respondents shall berequired to remove the excess Fill as may be directed byBurnsides and to dispose of such Fill legally elsewhere atthe Respondents' cost. Grading shall be carried out by theRespondents and/or agents of the Respondents only asdirected by Burnsides. No grading activities shall occur onthe Respondents' Lands without Burnsides authorizing thegrading and without Burnsides being available to be on sitefor such grading activities, should Burnsides deem it

necessary for it to attend to supervise such gradingactivities. Burnsides shall make such inspections of thegrading as Burnsides sees fit and the Respondents shallfollow any directives issued by Burnsides throughout. Anyadditional topsoil required to finish the grading shall be asdetermined by Burnsides, and shall be brought onto theRespondents' Property and graded by the Respondents atthe Respondents' cost, and as directed and supervised byBurnsides. All seeding as needed shall be determined byBurnsides and shall be carried out by the Respondents

under Burnsides' direction and supervision at theRespondents' cost.

The Respondents shall pay for the costs of Burnsides'engineering services, which services are as described inSchedule "A'. The Respondents shall deposit the amount of$15,000.00 with the Township of Amaranth on or beforeMarch 7, 2015. The deposit shall be applied againstBurnsides' invoices for the engineering services, with anyremainder of the deposit to be returned to the Respondentsupon the completion of the obligations contained withinSchedule "4". lt is acknowledged, that subject to theRespondents complying with their obligations underparagraphs 2 and 3 of Schedule "4", that the cost of theBurnsides engineering services as described herein that theRespondents are liable for is limited to $15,000.00. TheTownship of Amaranth and/or County of Dufferin shallprovide to the Respondents copies of all Burnsides accountspaid from the $15,000.00 deposit when received. lt is notedthat the amounts payable in the Court Order underparagraph 5 of said Order are an additional amount ofmonies to be paid by the Respondents to the Township ofAmaranth.

The Respondents, at their own cost, will fix, regrade andrestore any portions of the County of Dufferin Lands thatwere damaged or othenuise altered by the Fill activitiesand/or grading carried out by the Respondents, as theCounty of Dufferin directs, through Burnsides as the agentsfor the County of Dufferin. lf there is a dispute as to theextent of the restoration required owing to boundary lineissues, then the Respondents shall be required to pay 50%of the cost of any survey carried out to resolve such dispute.Should a survey be so required, the Respondents shall payits share of the costs within 30 days of the County of Dufferinproviding a copy of the survey invoice. lt is acknowledgedthe cost of the portion of the survey that the Respondentsshall be required to pay for is limited to $950.00 togetherwith 50% of disbursements and applicable HST.

ln satistying their obligations under this Schedule, theRespondents are not permitted to engage the services ofany agent, operator, company or other legal entity who had

been involved in the illegal Fill activities and/or gradinggiving rise to this Court Application (File No. 210114). Toensure compliance with this restriction, any agent, operator,company or other legal entity engaged by the Respondents

for the purposes of satisfying any obligation under thisSchedule is subject to approval by the Township ofAmaranth and the County of Dufferin,

The obligations and works set out in Schedule "4" shall becarried out in a timely manner by the Respondents and shallbe completed by no later than June 30, 2015. Thank you very much for the letter and certificate of recognition of Sincere and

Dedicated Service on the Mansfield Recreation Committee. lfind great pride in

this genuine acknowledgment received from peers whom I fully respect. lt was

with great ambition and honour that I served on the Mansfield Recreation

Committee with upstanding members of Mulmur Township. This gesture ofgratitude is appreciated.

My desire to be actively engaged in community topics of interest is elevated due

to my positive motivation around the many diverse aspects of sustainability in

Mulmur (Social, Economic, and Environmental).

The purpose of my on-going learning, analysis and offering opinion on Mulmurmatters is solely focused on constructive progress, and informativeoutreach/extension. My intentions are not meant to discredit nor undermine thededicated work that Mulmur Council and Staff have contributed up to date.

As discussed this morning, the closest gas main to the Town of Mansfield ís just west of the Town of Everett. A main ofextension of over 7 km would be required to bring gas just to the outskirts of the town. This does not include the mainrequired to seruice the various streets within the Town.At this time Enbridge does not have any plans to extend the gas main along County Road 5 westwards towardsMansfield.

Purpose of the Amendment

The proposed Zoning By-law Amendment would change the zoning on the subject lands from the "Rural Residential(RR)" zone and the "Agriculture (A)" to the "Agriculture (A)", and Rural Commercial-Exception (RC-*)" zones.

Effect of the AmendmentThe approximate 4 acre developed parcel oflands is currently zoned Rural Residential (RR) and the larger parcel is zonedAgricultural (A). The approximate 96 acre agricultural parcel does not contain site specific zoning, and therefore a housecould be constructed on the now vacant agricultural parcel.

Rezoning a portion of the developed lands to a Rural Commercial (RC*) zone would reflect the existing uses, including8!!-thermal as well as agricultural, as the¡e is some overlap of building use. The majority of the larger agricultural parce-ishould be zoned Agricultural (A).

Lands Affected

TheZoningByJaw Amendment affects lands in the Vy'est Half of Lot 5, Concession 6 EHS. These lands are shown on theKey Map on tle back of this notice.
