PROCEEDINGS:

Based on the 12(3) Settlement entered into

with the Unions before the Commissioner of

Labour on 15-11-2009, orders have been issued for

Revision of Work allocation and staff pattern for

the areas already covered by Settlement. Among

other things, Revision of work allocation and staff

pattern in respect of Assessment and Collection

staff were also been issued in which it has been

ordered that 30 days Assessment and 30 days

Collection in respect of Low Tension Services will

be introduced in a phased manner. The modalities

for implementation have been discussed with the

Unions. The Unions have unilaterally represented

to sanction additional number of Assessment staff

for smooth functioning of the system.

2. After careful consideration, it is hereby ordered

to sanction one more additional Assessor per

section for attending the Collection work

wherever the system of 30 days Assessment and

Collection is introduced.

I (a) Classification of Board Employees under the revised Pay Structure for the purpose of Travelling Allowance & Daily Allowance:

The revised classification of the employees of the Board under the new Pay Structure for determining the Travelling Allowance shall be as shown below:

I (b) Entitlement of Board employees to travel by Air or Rail on Official Duty:-

NOTE :

1. In case of rail journey performed on official tour or Leave Travel Concession, wherever First Class is not available, travel in Third Class A/c Sleeper may be allowed in respect of those employees who are eligible for First Class.

2. The Chairman, Members, Additional Director General of Police/Vigilance, Secretary, Chief Engineers and the Chief Financial Controllers shall be allowed to travel by air in Executive Class.

PROCEEDINGS:

Consequent on the revision of scales of Pay and Allowances to the employees of the Board with effect from 01.12.2007 ordered in the B.Ps. third and fourth read above, classification of employees into various grades for the purpose of allowing Travelling Allowance requires revision. While considering the above, the question of revision of the rates of Daily Allowance, Boarding and Lodging charges, Lumpsum grant payable under Transfer Travelling Allowance, Fixed Travelling Allowance, Mileage Allowance and Leave Travel Concession will have to be considered taking into account the orders issued by the Government in Government Orders first, second and sixth read above and also the pay structures of the employees of the Board.

vIn case of stay at New Delhi, officers should

prefer to stay in Tamil Nadu House/TNEB

Guest House. In case of non-availability of

accommodation in Tamil Nadu House/TNEB

Guest House, they shall be permitted to stay

outside and the bills may be settled on

production of Non-availability Certificate

from Tamil Nadu House/TNEB Guest House.

III. Terminal Charges:

For the journey between residence, place of

halt or work and Railway Station or Bus Terminal

or Air Port, the existing rates shall be continued in

the revised pay structure.

IV. Incidental Charges :

The incidental charges for journeys within and

outside the state including Union Territories shall

be regulated with reference to the Daily

Allowance applicable for stay in Government

Guest House/Private and not with reference to

the rates of Daily Allowance applicable for stay in

Hotel at the respective places.

V. Lumpsum Grant payable under Transfer

Travelling Allowance:

Shall be increased by 50% as shown below:—Grade-I (a) - T h e C h a i r m a n , M e m b e r s ,

ADGP/Vigilance, Secretary/TNEB,

Chief Engineers and Chief Financial

Controllers.

Rs.7,000/- and above.

VI. Fixed Travelling Allowance:

The existing monthly ceiling on drawal of

Travelling Allowance (excluding Bus fare/Train

fare) in respect of certain categories of employees

shall be enhanced as mentioned below:

VII. Mileage Allowance: The existing rate of

Rs.5/- per k.m. for journey performed by Car and

Rs.2.25/- per k.m. for journeys performed by

Motor Cycle / Scooter / Moped shall be revised

as Rs.8/- per k.m. and Rs.4/- per k.m.

respectively.

VIII. Leave Travel Concession: The employees

shall be allowed to travel outside the State by

availing Leave Travel Concession subject to the

condition that the reimbursement of travel cost

should be limited to a maximum distance of 800

kms. from place of their work. The eligibility of the

officers to travel by air while on official tour shall

also be applicable for availing Leave Travel

Concession. However, the officers permitted to

travel by air on Leave Travel Concession in the

existing pay scales shall also be permitted to avail

Leave Travel Concession by air in the revised pay

structure also.

3. The above orders shall take effect from the

date of issue of these Board’s Proceedings.

4. Necessary amendments to Tamil Nadu

Electricity Board Employees’ Travelling

Allowance Regulations will be issued separately.

5. The receipt of these Board’s Proceedings

shall be acknowledged in the slip enclosed.

Since, the State Government modify the

method of allowing Selection Grade /Special

Grade the same has been implemented in

Board. If and when the Government modify

the method of Selection Grade/Special

Grade, the same will be examined in Board

also. However it may be pointed out that the

Board is giving Selection Grade for nine years

service whereas the Government gives only

10 years service.

4. Grand of Special Allowance to Audit Staff and the feasibility of increase of lodging expenses to Audit Staff.

5. To extent the benefit of 50% merger of Dearness Allowance to the pensioners with effect from 1.1.2006.

The demand of grant of Special Allowance to

Audit staff has been examined and the

request is not accepted.

With regard to the increase of loading

expenses the Board approved to enhance the

T.A. & D.A. in the revised pay band, Orders

issued.

The 50% Dearness Allowance merger effected

from 1.8.2006 to the Pensioners of the Board is

based on the policy of the Board. The same

could not be modified. Further, Writ Petitions

filed in this regard are also pending before the

Hon'ble High Court.

PROCEEDINGS :

In the Board's Proceedings first read above,

orders were issued permitting the Engineers of the

Board to start industries in Tamil Nadu by

availing 5 years of Extra Ordinary Leave without

pay and allowances and subsequently, certain

guidelines were also issued in the Memorandum

second to fifth read above.

2. The above orders have been reviewed by the

Board and it has been decided to rescind the orders

issued in the B.P. first read above. Accordingly, it

is hereby ordered that the orders issued in the B.P.

first read above and the subsequent guidelines

issued in the Memorandum second to fifth read

above, be withdrawn with effect from the date of

issue of these Board's Proceedings.

Sub: Proposal to downgrade the post of

operators in 230 KV Sub-Stations from

Assistant Execut ive Engineer/

Electrical to Assistant Engineer/

Electrical – Request to dispense with –

It is learnt that there is a proposal to

downgrade the post of operators in the 230 KV

Sub-stations from the level of Assistant Executive

Engineers/ Electrical to the level of Assistant

Engineers/ Electrical.

2. In this connection, the Association desires to

point out the following facts/ points for kind

consideration.

ØInitially only Assistant Engineers/ Electrical

were posted for shift duties in the 230 KV Sub-

Stations, since their commissioning.

ØThese posts were upgraded as Assistant

Executive Engineers/ Electrical during 1979

vide B.P.Ms.No.59 (Adm) dated 08.09.1979,

realizing the need for posting experienced

personnel to manage these important posts.

ØThe proposal for upgrading the post of Shift

Operators in 230 KV Sub-Stations from

Assistant Engineers/ Electrical to Assistant

Executive Engineers/ Electrical was mooted

out for posting senior engineers with rich

experience so as to avail their field experience

to tide over all emergent situations smartly

without any time lag/ delay. In view of the rich

experience, the Assistant Executive Engineers

would be capable of taking prompt decisions

in the event of tripping / breakdown. Any

delay in taking appropriate decision or

defective decision by the operators in the 230

KV Sub-Stations may lead to cascade tripping

of generators in the Power Houses and

associated EHT lines causing undesirable grid

disturbance.

Ø230 KV Sub-stations are vital links in the grid.

Any mal-operation may be dangerous and

disastrous to the power system stability and

our prime goal of extending and ensuring

reliable and quality power would be defeated.

ØRich experience is an indicator of reliability

and a seal of perfection.

ØAny delay in resumption of supply after

outage/ breakdown would cost heavily, as

there is scope for revenue loss to the Board.

ØThe importance of the operator posts in 230KV

Sub-Stations has to be, therefore, viewed from

the angle of tackling the emergencies only and

not from the routine assignment of shift duty.

ØRealizing the above advantages, the Board

preferred to upgrade the post of operators in

the shift duties in the 230 KV Sub-stations from

Assistant Engineers to Assistant Executive

Engineers during 1979, around 31 years back.

ØIt is quite incomprehensible to note the present

need for rethinking on this issue after 31 years.

3. The Association desires to add that such an

exercise for downgrading the operator posts is

quite unwarranted at this juncture after 31 years,

since the input to the respected Chairman is not

based on facts but on erroneous presumption as if

the operator posts were upgraded for the sake of

rendering relief from stagnation.

4. During the year 1979, the Assistant Engineers/

Electrical were able to get their first promotion as

Assistant Executive Engineers/ Electrical after

8/9 years. The above period badly increased to

13/14 years subsequently and now it is around

9/10 years. While so, any proposal to downgrade

the operator posts in 230 KV Sub-Stations would

aggravate the situation, causing dejection and

demoralization among the engineering cadre.

5. It may not be out of context to recall the

pleasant days of the past. During 1960s, the

Assistant Engineers were able to get their

promotion after 3 years of service. In fact, there

were also many cases where certain incumbents

were detained in the cadre of Assistant Engineers

till completion of 3 years service to meet the

requirement of service regulations, even though

vacancies were then available in the cadre of

Assistant Executive Engineers.

6. It is expected that any reasonable management

has to necessarily aim for furthering the

promotion prospects or opportunities of the

employees, in stead of cutting down their wings

under the guise of cost cutting in order to motivate

them for perfect involvement on the job and

thereby fetching better returns.

7. The Association is constrained to point out that

overall morale of the engineers is at the lowest ebb

at present in view of abnormal delay in filling up

the existing vacancies in the cadre of Executive

Engineers/ Superintending Engineers /

Chief Engineers under the guise of manpower

assessment . The present proposal for

downgrading would add fuel to the fire.

8. The Association, therefore, requests that the

respected Chairman may be pleased to dispense

with the proposal for downgrading the operator

posts in 230 KV Sub-Stations, which has been

initiated based on wrong inputs.

The Association desires to record its thanks for

the opportunity extended to the Association to

ventilate the grievances related to the deficiencies

in respect of constitution of TANTRANSCO.

1.0. Tamil Nadu Electricity Board ranks third,

following Maharashtra and Gujarat. Andhra

Pradesh is witnessing rapid growth in recent days

and tries to reach third. To surpass the level of

Maharashtra and Gujarat, the model adopted for

Human Resource, technology implementation,

customer care practices, etc in these States has to

be followed and tuned further for our State.

Hence, the present organization structure of staff

with their responsibilities are compared and

analyzed in line with these States.

2.0. Present Organizational structure and its

functioning of Transmission wing:

The top level management consists of the

following Officials:-

1. Chairman

2. MD/TRANSCO

3. Director/Transmission - Project

4. Director /Operation

5. Director /Finance

2.1. Presently, the Transmission wing consists

of 2 SEs at Transmission - Project wing, 6 SEs at

General Construction Circles, 2 SEs at Chennai

Development Circles, one SE at LD&GO, 9 SEs at

Operation Circles, 1 CE and 4 SEs at P&C wing and

the officers are carrying out the functions as

follows:

a. Transmission wing :

1. Planning, design, development, procurement

of engineering materials and erection of new

transmission lines of about 800 Circuit Km per

year at the voltage level of 66 kV and above.

2. Planning, design, development, procurement

of engineering materials and erection and

upgrading of about 70 Sub-Stations per year at the

voltage level of 66KV and above.

3. Cable laying and maintenance at 230KV and

110KV voltage levels.

b. Operation wing :

4. Operation and maintenance of TNEB grid

through one Main Load Despatch Centre (MLDC)

and three Sub Load Despatch Centres (SLDC) in

coordination with Southern Power Grid. This will

be merged with the National Grid in the next

couple of years.

5. P r o c u r e m e n t o f C G S p o w e r , A B T

management , Load Management , Grid

Management, Frequency Management, R&C

implementation, Scheduling of Annual

overhauling of machines in power stations, Long

Term Open Access, preparatory work for

development of transmission systems in

coordinat ion wi th SRPC, Te lephones ,

Government of Tamil Nadu etc.

6. Operation & Maintenance of 79 EHT Sub-

Stations and allied EHT lines covering all nature of

preventive and breakdown maintenance.

7. One of the most efficient wings of TNEB, Hot

Line maintenance crew for attending to all works

“ON-LINE” in respect of EHT lines with voltage

rating 110 KV and above.

c. Protection and Communication Wing :

8. Planning, design, development, procurement

of engineering materials and Erection, Operation

and maintenance of protection systems for about

79 Sub-Stations.

9. Planning, design, development, procurement

of engineering materials and Erection, Operation

and maintenance of communication systems for

about 79 Sub-Stations.

10. Operation and maintenance of about 79 Sub-

Stations and its associated transmission lines.

d. Transmission Works undertaken by the CEs/Distribution Regions :

All Maintenance works as per schedule of

maintenance in respect of around 1200 Sub-

Stations at 110 KV level and below, the associated

transmission networks with voltage level at 33KV

and below are handled and supervised by the 9

Chief Engineers of Distribution Regions in

addition to their technical and administrative

works.

3.0. Certain challenges faced by the Transmission wing :

a. At present, TNEB is doing well in planning and

development of transmission network. However,

there is no monitoring mechanism, which is highly

focused in the other States. Further, there is no

exclusive wing for addressing the issues such as

transmission charges, tariff petitions, Regulatory

matters, etc.

b. Since, there is no exclusive transmission

monitoring wing, it leads to various technical and

financial hurdles like power evacuation

difficulties, low voltage, frequent line faults, over

loading, unbalance in line voltage, etc.

c. Inadequate inventory with lack of proper

follow up action on the preventive maintenance

leads to frequent breakdowns and consumes more

time for restoration / resumption of power

supply.

d. TNEB is contemplating for adequate

generation capacity addition for 11th plan, which

would be more than 50% of existing State capacity.

But, there is no proper plan on hand to develop

power evacuation infrastructure to meet the

anticipated capacity addition. There is an

imperative need to think of adequate transmission

plan, development and monitoring for

transmitting the anticipated additional power to

the load centres / consumers.

e. Most of our technical functioning in the

various Power Houses and Sub-Stations are based

on the “manual” mode; they were not fully

automated as in Power Grid Corporation.

4.0. Keeping this in mind and in line with the

leading States, the following key areas are to be

focused by the top level management.

· Power System Studies which includes

coordination with SRPC, Power Grid, CEA, etc.

• Transmission Planning and Monitoring

• Transmission - Material Procurement

• Transmission- Projects

• Transmission - Regulatory Cell

• Transmission - Structure (Civil)

4.1. The above areas are dealt with at the level

of Chief Engineers and they are monitored by the

Directors concerned respect of other STUs.

4.2. Apart from the targeted generation

capacity addition from State and Central sectors,

Tamil Nadu is also encouraging the development

of private power promoters including wind

developers, in order to purchase power through

competitive bidding process from private players

and from pit head power stations at Orissa. To

evacuate this additional power, necessarily the

STU has to develop more number of 400 KV and

765 KV systems. Therefore, exclusive Chief

Engineers for 400 KV and 765 KV systems are also

essential.

5.0. Certain challenges faced by the Operation wing :

a. TNEB is forced to pay the highest penalty for

UI charges in view of delicate power requirement.

b. ABT and LTOA have to be implemented

effectively and efficiently.

c. Hydro, Thermal and Wind mix management.

d. Lack of coordination among grid substations.

5.1. Keeping this in mind and in line with the

leading States, the following key areas are to be

focused by the top level management.

• Grid operation

• Load Management

• Six Zonal Sub-Station Maintenance ( to take

over from the 9 Regional Chief Engineers in

TNEB)

• EHT lines special maintenance including Hot

lines, Multi Circuits Tower Maintenance.

• Commercial

5.2. The above areas are dealt with at the level of

Chief Engineer and they are monitored by the

Directors concerned in respect of other STUs.

6.0. Certain challenges faced by the Protection & Communication wing :

a. The tripping of EHT lines and associated faults

are to be analyzed effectively, so that such events

are averted in future ensuring improvement in the

system reliability, which would, in turn, improve

the financial status of the Transmission Company.

b. Implementing the “Frequency” based tripping

at 110 KV level in order to avoid UI penalty.

c. Implementation of SCADA, Ring fencing,

Relay coordination and Handling of consultancy

work for private power developers in trip setting,

etc. As a whole, the successful implementation of

Sub-Station automation leads to effective

utilization of man power.

6.1. Keeping this in mind and in line with the

leading States, the following key areas are to be

focused by the top level managements.

· Power System Protection

· Power System communication

· Relay testing & consultancy

· Training and Safety

6.2. The above areas are dealt with at the level of

Chief Engineers and they are monitored by the

Directors concerned in respect of other STUs.

7.0. In the present scenario, lack of adequate

skilled man power leads to delay in erection and

commissioning of all projects on hand, mal-

operations, frequent tripping etc. Moreover, on

one side TNEB is implementing new technologies

and on other side skilled man power is getting

reduced. It implies that highly invested

equipments are operated by unskilled man-

power, which affects the system reliability.

8.0. It is learnt that the organizational structure

with AE in place of AEE/Shift, AEE in place of EE

is under active examination under the guise of cost

cutting measures. It is emphasized that such

thinking would affect the life of hugely invested

equipments in the Sub-Stations, transmission

lines, etc in the long term. As a result, our vision

“To make TNEB synonymous with availability of

quality and reliable power at competitive rates”

will be departed and deviated. The present work-

force in the Sub-Stations is based on the necessity

to handle the emergency situations and to

maintain reliable supply, which would certainly

reflect in terms revenue of the organization. The

skills acquired through rich experience cannot be

replaced by theoretical knowledge at one instant.

Hence this should be viewed seriously.

12.0. The Association would like to lay stress on the vital point that the success of the State Transmission Utility depends upon the team members comprising of policy makers viz. Board of Directors, Team leaders viz. Chief Engineers for proper implementation and other technically qualified Engineers for execution. In line with the States of Maharastra, Andhra Pradesh and Gujarat , the fol lowing organizational structure for the top level management of TANTRANSCO is proposed for kind consideration and favorable follow up action thereon.

12.1.Correspondingly, the structure in respect other officers in the cadre of SEs, EEs, AEEs and AEs need to be revamped. It is stressed that there shall not be any thinking for downgrading the existing posts, as it would lead to frustration and demoralization among the engineers.

12.2.Therefore, the Association requests that an organizational structure on par with other State Transmission Utilities which are similar in size to TNEB in respect of generation capacity, number of Sub-Stations, number of consumers etc should be evolved as suggested above so that the Tamil Nadu Transmission Corporation Ltd would function efficiently and effectively.

12.3 It is further emphasized that the development of HR shall be for the benefit of organization rather than curtailing / downgrading the Engineering work-force which may cause demoralization and de-motivation among the engineering work-force blocking the development of the new Organization viz. TANTRANSCO

13.0.The Association, therefore, requests that the respected Chairman may be pleased to call for the models of top level Management from the States of Maharastra, Gujarat and Andhra Pradesh and study all of them in depth and arrange to sanction additional posts which are quite essential to project TANTRANSCO as the Number One State Transmission Utility in the Nation.

Sub: Excess strength of Junior Engineers

Grade I (Electrical) - Promotion panel

for the post of Junior Engineers Grade I

(Electrical) to be deferred - Reg.

Vanakkam,

It appears that TNEB Engineers Sangam is

pressing for further preparation of promotion

panel for the post of Junior Engineers Grade I,

despite the fact that the promotion panel for the

last year itself is the subject matter under

W.P.No.18012 of 2008 pending on the file of

Hon'ble High Court. The Association would like

to caution that any further promotion would tilt

the imbalance very badly and it would be very

difficult to rectify such situation in the event of

concurrent judgment from the Hon'ble Court.

2. In this connection, the Association desires

to state the following for kind consideration of the

respected Chairman and appropriate further

action.

a. The Board was adopting the ratio 3:1

among the Assistant Engineers and Junior

Engineers I Grade for both recruitment and

promotion since its inception in the year

1957, as available in the service rules of the

Government departments like PWD,

Highways Department etc. It was also

similarly practiced in the “Government

Electricity Department”, prior to formation

of TNEB.

b. The TNEB Engineers Sangam, representing

the diploma holders, filed Writ Petition

challenging the ratio 3:1 for promotion

initially during the year 1968. The above

Writ Petition was dismissed. The Sangam

went on appeal and it was also dismissed

by the Hon'ble Division Bench during the

year 1969. The Sangam further went on

appeal by filing Special Leave Petition

before the Hon'ble Supreme Court and it

was also dismissed during the year 1994.

Now ratio 3:1 for promotion between

Assistant Engineers and Junior Engineers

Grade I has become a settled one, in view of

the remarkable judgment dated 13.09.1994

by Hon'ble Apex Court.

c. TNEB Engineers Sangam was now

engaging in the second round of legal battle

challenging the ratio 3:1 for recruitment,

taking shelter under the Workload

Settlements. The Board introduced certain

ratios like 2:1:2, 2:2:1 & 2:3 for the

distributions areas. The settlements made

with workmen under the provisions of

Industrial Act, 1947 are for the purpose of

prescribing workload and staff pattern for

the distribution circles only. Hence the

ratios cannot be enlarged to all areas of

TNEB. It must be noted that the ratios were

not introduced in the place of 3:1 meant for

recruitment. While so, TNEB Engineers

Sangam filed W.P. Nos. 4748 of 1990 & 5238

of 1995, with an illegal ambition to extend

these ratios to whole areas of TNEB. These

Writ Petitions were also dismissed.

d. The Hon'ble Court, by order dated

05.06.2000 in W.P.No.1307 of 1997 filed by

the forum of unemployed graduate

engineers, was pleased to quash the ratios

2:1:2, 2:2:1 & 2:3 which were introduced

through various workload settlements

declaring them as null and void and

directed the Board to adopt the ratio 3:1

only for filling up the vacancies. As usual,

the diploma holders have gone on appeal

before the Hon'ble Division Bench and got

a stay for operation of the above

judgement. These appeals are still pending

adjudication by the Hon'ble Division

Bench.

e. It is to be pointed out that the above

judgment was not reversed or rewritten in

view of the above stay. While so, their

request to consider promotion from Junior

Engineers Grade II to Junior Engineers

Grade I based on the ratios dismissed by

the Hon'ble High Court is quite unfair,

unjust and also illegal.

Taking advantage of the above stay, the

diploma holders are going on representing

for preparation and approval of promotion

panel for Junior Engineers Grade I every

year and hence their strength is getting

inflated exceeding their legitimate share.

f. The Chairman has been kind enough to

appoint a committee comprising the

Secretary, Legal Advisor and Director/

Finance/ TANTRANSCO to find a

permanent solution to the above vexed

issue vide (Per) B.P. (Ch) No.112 dated

30.12.2009. The committee is expected to

complete its assignment within 6 months. It

is therefore reasonably expected that the

committee may commence the hearing of

all parties concerned, as 5 months are

already over. Here, it is to be noted that

TNEB Engineers Sangam, instead of

extending its cooperation to find an early

solution, objected to the formation of

committee citing one reason or other. This

is the trick that they adopted during the

year 1994, to subvert similar committee

constituted by the then Chairman on this

vital issue.

g. Speedy disposal of Writ Appeals is one way

left open to settle the matter permanently.

Otherwise, the committee constituted by

the Chairman may immediately commence

the hearing of all parties concerned and

suggest remedial measures to get rid of the

vexed issue and it is yet another option. The

Association promises to extend its

wholehearted cooperation to find a

permanent solution under any of the above

two options.

3. The Association, therefore, requests that the

respected Chairman may be pleased to defer

further promotion of diploma holders from Junior

Engineers Grade II to Junior Engineers Grade I so

as to avoid further tilting of imbalance among the

Assistant Engineers and Junior Engineers Grade I,

as it would be very difficult to set right such worst

situation at future.

AAOs of Theni EDC without any regard for

decency and politeness which is very much

warranted from the officers.

• The SE was therefore constrained to initiate

Disciplinary Proceedings against him for his gross

indiscipline.

• Further there were lots of complaints from

many aggrieved consumers because of his biased

deal and disposal of issues related to extension of

supply and maintenance of distribution network

in person before the former Chairman.

• The former Chairman therefore ordered

transfers posting him as Asst. Exe. Engineer / Shift

/ 230 KV Sub-Station, Kayathar in Tirunelveli

EDC.

• Thiru.C.Karuppaiah filed a Writ Petition

before Madurai Bench of Honorable High Court

and sought relief. The Hon'ble Court was pleased

to direct the Board to consider his representation

for modification ON MERIT.

• Based on his representation, his transfer order

was modified posting him at AEE/ Shift / 230 KV

Sub-Station, Sembatti in Dindigul EDC.

• While finalizing the D.P., the SE/Theni EDC

imposed a penalty to withhold the next increment

for a period of 2 years. But on his appeal, the Chief

Engineer/ Distribution/ Madurai modified the

said punishment to withhold increment for a

period of 3 months. It was learnt that the Chief

Engineer was forced to pass a very minor

punishment, which does not commensurate with

the gravity of misconduct, due to the fear of facing

unanimous or pseudonymous petitions at the time

of his retirement.

• Even this minor punishment was set aside by

the Chairman on his memorial, presumably due to

lack of all relevant materials at the time of

considering his memorial.

It appears that one Thiru.C.Karuppaiah, the

representing for transfer back to Theni EDC. In

this connection, the Association is constrained to

point out that favourable consideration of his

request to Theni EDC would be detrimental to the

smooth functioning of the administatration in

Theni EDC.

2. In the interest of effective and efficient

management, the Association desires to present

the following pertinent points on this issue to the

kind notice of the respected Chairman for

appropriate consideration and further course of

action.

• Thiru.C.Karuppaiah, EE/Operation/

Tuticorin was formerly AEE/O&M/Cumbum in

Theni EDC. He is well known for his adamant

attitude towards the senior officers and he uses to

behave unbecomingly towards the senior officers

and colleagues taking shelter under trade union

activities.

• During a review meeting held in the chambers

of the SE/ Theni EDC, Thiru.C.Karuppaiah, the

then AEE/Distribution/Cumbum, shouted at the

SE & EE/General in the midst of all EEs, AEEs &

• Actually he was not included in the promotion

panel for the post of Executive Engineers/

Electrical in view of the punishment. As he was

absolved of the above D.P., he was included in the

promotion panel. On promotion, he sought for

posting in Theni EDC itself. When all relevant

issues behind the D.P. were brought to the kind

notice of the Chairman thorough our letter cited,

he was not accommodated in Theni EDC and he

w a s p o s t e d a s E x e c u t i v e E n g i n e e r /

Operation/Tuticorin.

• There cannot be any second opinion that

indiscipline should not be tolerated to any extent

and that too at the level of officers category, as

officers are supposed to be role model for other

sub-ordinate staff. Any tolerance of indiscipline at

the level of officers would surely bring disrepute

to any effective management and impair the

image of the Board before the general public.

3. The Association is duty bound to point out

that any compromise with enforcement of

discipline would be suicidal in the interest of fair

management and it is not desirable to extend such

lenience to an officer, who has recklessly

misbehaved with the SE & EE and exhibited gross

indiscipline in the midst of many officers.

4. The Association, therefore, requests that the

respected Chairman may be pleased not to post

him back to Theni EDC, as such move would send

wrong signals among all employees in the

enforcement of discipline.

During the past in respect of appointment to

the wards of deceased employees who expired

while in service on compassionate grounds, the

Board uses to appoint the graduate engineers in

Electrical / Mechanical / Civil Engineering with

FIRST CLASS as Assistant Engineers (Electrical /

Mechanical / Civil) and the candidates with

SECOND CLASS as Helpers. Such Helpers are

subsequently considered for appointment as

Assistant Engineers (Electrical / Mechanical /

Civil) under the mode of internal selection after

completion of one year service.

2. Subsequently, the Board was constrained to

modify the above procedure of compassionate

appointment, in view of the Supreme Court

judgment prohibi t ing appointment on

compassionate grounds to the posts under Class I

& Class II Service. The wards with First Class in

Technical Assistant (Electrical) under Class III

Mechanical during the month of 05/2006, after a

service of 11 years and 1 month, while the last

candidate, who joined in the month of 10/1995,

4. In respect of Civil discipline, 138

candidates joined the service of the Board as

Assistant Engineers/ Civil. The first candidate in

the batch, who joined in the month of 04/1995, got

first promotion as Assistant Executive Engineer/

Civil during the month of 03/2007, after a service

of 11 years and 11 months. So far 48 candidates

from the above batch were fortunate to get their

first promotion. Around 90 Assistant Engineers/

Civil are still awaiting for their first promotion,

after a service of 14 years. The promotion

prospects of the Civil Engineers have narrowed

down to zero, as TNEB has avoided taking up any

new power project on its own. With the present

trend in promotion based on vacancies, these

Assistant Engineers/ Civil are likely to get their

first promotion only after 19 years of service. It is

indeed a pitiable situation warranting an

immediate solution.

5. It is needless to point out that these

Assistant Engineers/ Civil stand demoralized and

dejected, as no other category of employees are

subjected to such unceremonious treatment under

the crude clutches of stagnation. This Association

is quite confident that the respected Chairman

would certainly appreciate their hardships and

arrange for appropriate remedial measures

rendering expeditious relief. The only option open

for immediate relief is to consider upgrading their

posts as Assistant Executive Engineers / Civil

( N o n - I n d e p e n d e n t ) w i t h d u t i e s a n d

responsibilities attached to the Assistant

Engineers/ Civil, till they are considered for

regular vacancy based promotion in their turn.

This would be similar to the relief granted to the

transferred belong to the batch of direct recruits of

Nov' 2008. Along with the batch of direct recruits

of Nov' 2008, around 150 internal candidates were

appointed as Assistant Engineers/ Electrical by

internal selection during the last week of Nov'

2008. During the month of April' 2010, around 67

internal candidates have been appointed as

Assistant Engineers/ Electrical by internal

selection vide Memo.No.030721/G.13/ G.132/

2010-1 dated 23.04.2010. These internally

appointed Assistant Engineers are the actual

juniors in the cadre of Assistant Engineers/

Electrical but they were not considered for such

transfers. Only the direct recruits of Nov' 2008

batch are singled out and they are subjected to

arbitrary transfers to the Generation Circles. The

Association is duty bound to point out that there is

blatant error in the exercise of identification of

junior most Assistant Engineers/ Electrical and it

is to be rectified.

4. The Association would therefore requests

that the respected Chairman may be pleased to

reconsider the issue and arrange for cancellation

of the transfer orders issued to the direct recruits of

Nov' 2008 batch.

It is learnt that the Chairman has recently

ordered transfer of 6 Assistant Engineers/

Electrical, now working in the Distribution Circles

like Tuticorin EDC/ Dindigul EDC/ Nagai EDC/

Trichy EDC (Metro) etc. to fill up the vacancies in

the Kadamparai Hydro Generation Circle vide

Memo cited.

2. In this connection, the Association desires

to bring the following points to the kind

consideration of the respected Chairman and

favorable orders thereon.

• During the month of Aug' 2009, the

Chairman ordered transfer of 24 Assistant

Engineers/ Electrical to the Generation

Circles.

• The Association represented that resorting

to direct recruitment and posting such

direct recruits to hydro power stations

would be the right solution and workable

remedy to tackle the situation. It was

further represented that the transfer orders

issued on administrative grounds by way

of identification of junior most officers

working in the plains may not be fair play to

get rid of the situation, when the

innumerable hardships faced by the

candidates under orders of transfer are

accounted for.

• Based on the representation of the

Association, the Chairman had been kind

enough to cancel such transfer orders, duly

appreciating their hardships and their

family conditions.

• During the month of Mar' 2010, the

Chairman ordered transfer of 25 Assistant

Engineers/ Electrical posting them to the

Kundah Generation Circle.

· At present, the Chairman has ordered transfer

clause in the agreement made in the State of

Himachal Predesh, categorically stating

that there will not be any form of

privatization after the process of

restructuring. It is also pertinent to note

that Our Hon'ble Minister for Electricity

has repeatedly assured in many forums to

this effect.

• There shall be a tri-partite agreement

among the Government of Tamil Nadu,

TNEB and its successor entities and all

recognized Trade Unions/ Associations,

ensuring solemn guarantee by the

Government of Tamil Nadu to protect the

service conditions of the existing

employees and payment of pension and

other allied terminal benefits on par with

the Government pensioners. No time limit

shall be prescribed on the currency and

validity of such tri-partite agreement and it

shall be in force for ever.

• The service conditions shall not be allowed

to go inferior at any point of time in any of

the subsidiary companies. Discrimination

in respect of promotion to the engineers

and employees from one entity to another

cannot be ruled out. There is large scale

discrimination in respect of promotions in

many unbundled states and it is therefore

needless to emphasize that such

discrimination would ultimately lead to

dejection and demoralization among the

engineers and employees, defeating the

very purpose of restructuring. To get rid of

the imminent threat, implementation of

“ A s s u r e d C a r e e r P r o g r e s s i o n

Programme”, ensuring a minimum of three

promotions would be the right and just

solution to keep up the morale of the

engineers and employees in order to

At the outset, this Association records its

sincere thanks for the opportunity extended to us

to highlight our views on the vital issues of

executing tri-partite agreement ensuring

protection of existing service conditions, transfer

of personnel and payment of pension etc in the

context of restructuring of TNEB.

2. The following points may kindly be taken into

consideration.

• The assets of TNEB like lands, buildings,

dams, power houses, EHT sub-stations and

associated EHT lines, transformers and

associated HT & LT lines etc. are to be

valued to commensurate with the market

value and not to the book value. It is

imperative that deviation from the present

and proposed status of Government

Undertaking / Government owned

Companies cannot be ruled out in the

future. It is also desirable to associate

representation from the recognized Trade

Unions/ Associations in the exercise of

valuation of all assets of the Board.

Otherwise, there shall be a guarantee from

the Government of Tamil Nadu, TNEB and

its successors to the effect that there will not

any form of deviation from the proposed

pattern of Government owned Companies

and such clause should be incorporated in

the proposed tri-partite settlement. It may

be proper to mention here that there is such

respect of all engineers and employees

retiring from the service after the effective

date of transfer.

• A “Master Pension Trust” may be

constituted and controlled by TNEB Ltd,

with separate “Board of Directors” for

monitoring the payment of pension and

other allied terminal benefits. There shall

be due representation from the Recognized

Trade Unions/ Associations/ Pensioners'

Associations in the proposed “Board of

Directors” for the management of the

above trust.

• In respect of existing pensioners, TNEB Ltd

shall deposit pension amount every month

well in advance into the “Master Pension

Trust”. In the event of default, the

Government of Tamil Nadu shall deposit

such liability into the trust ensuring

trouble-free payment of pension to all

existing pensioners without slippage every

month.

• In respect of existing employees / officers

in service, TNEB Ltd shall arrange to

recover the anticipated pension liability

due to the employees / officers in the rolls

of TANTRANSCO Ltd and TANGEDCO

Ltd on monthly basis from the respective

successor companies and deposit such

amount into the “Master Pension Trust”,

ensuring smooth payment of pension and

other allied terminal benefits on the

retirement of such employees / officers.

• It may also be guaranteed that all

Government Orders related to the payment

of pension and other allied terminal

benefits shall be faithfully adopted at the

earliest without any delay and deviation.

• It may please be ensured that all benefits

achieve the mission. It is therefore

requested that the Government of Tamil

Nadu and TNEB may earnestly come

forward to consider implementation of

“ A s s u r e d C a r r i e r P r o g r e s s i o n

Programme” on the similar lines of relief

granted to the Government Doctors to tide

over the stagnation in promotion, before

the personnel are allotted to the subsidiary

companies. It is desirable to implement

such scheme before the effective date of

transfer from TNEB to TANGEDCO/

TANTRANSCO.

• It is desirable to maintain common

seniority for the entire engineering cadre as

at present and the engineers utilized in the

different successor entities shall be

considered as on deputation basis.

• Otherwise, there shall be a transition

period for a minimum of “FIVE YEARS”

and the engineers shall be asked to indicate

their choice for permanent absorption only

after completion of such transition period

of 5 years.

• The following are the key points in respect

of payment of pension and other terminal

benefits to the existing pensioners as on

date and future pensioners from the band

of engineers and employees in the service

of the Board who are likely to retire on

superannuation after the effective date of

transfer.

· It is requested that the existing pensioners may

be declared as “Government Pensioners”,

deemed to have retired from the

Government Service and the Government

of Tamil Nadu may shoulder the

responsibility of ensuring payment of

pension to all existing TNEB pensioners.

This phenomenon may also be followed in

and concessions likely to be extended by

which were not so far adopted like (a) G.O.

Board, Transfer and promotion after bifurcation,

seniority cases and activities at Chennai head quarters.

gave lot of suggestions for the welfare of TNEBEA. Thiru

S. Pitchumani, Vice APresident delivered Vote of

Thanks. The following resolutions were passed and

communicated to the Head Quarters.

Resolutions

1. The seniority of Class I and II officers in TNEB Ltd.

should be maintained in the same way as in the

Trnsport Corporations. i.e. Common seniority

throughout state and transfer within the

corporations. This is simply possible as all our

bifurcated companies are going to be controlled by

one entity TNEB Ltd.

2. The Pay scale of Executive Engineers should be

elancated similar to central Government Executive

Engineers.

The branch meeting was held on 23.07.2010 at Hotel

Savana Garden, Railway Station Road, Erode.

The meeting was provided over by our Chairman the

Chief Engineer / Distribution / Erode the V.P.I

Administration Er.P.Arunachalam and the former G.S.Er.

G. Balakrishnan graced the meeting. The welcome

address was given by the Joint Secretary

Er.s.Palanivelan appraised the branch activities and

named the following resolution.

RESOLUTION - I

The branch wholeheartedly passed the resolution

thanking Er. N. Shankar, Chief Engineer / Distribution /

Erode and Er. K.P. Shanmugam, Superintending

Engineer / Erode Electricity Distribution Circle / Erode for

their effort in allotting an office building to the Erode

Branch TNEB-EA, which is a long self need for the past

30 years.

RESOLUTION - II

The branch passed the resolution for the formation of a 3

Member Library Committee helded by Er.Duraisamy to

State and maintain a branch Library to en heighten the

Engineer's know ledged. The Library got 20 Books on

the first day itself through donation from the Member

Engineers. The Committee also who given Rs.500/-

every month for the purchase of Engineering periodical.

ERODE BRANCH08.07.2010

3. Time bound promotion to all Engineers of TNEB Ltd.

4. General Secretary to TNEBEA is to be shifted to

Chennai HQ.

5. AE scale should be Elevated on par with Central

Government.

6. More than 15 years AE/Civil should be designated as

AEE (NI)

7. Thiru. G. Balakrishnan, the Ex. General Secretary

should be given a Honourary post in TNEBEA.

8. The request transfer applications in format should be

considered for the transfers of all category of

Engineers (Even by conducting counselling).

RESOLUTION - III

The branch passed the resolution pressing the parent

body to set assurance from the 50 mtrs after bifurcation

regarding

(a) that the service condition and benefits of the

Engineers should not be inferior than the present

condition.

(b) the continuation of the present pension should be

guaranteed.

(c) As it is the right time to press for time bound

promotion the Association should impress upon the

Board for immediate implementation of time bound

promotion.

The Branch Treasuree Er. Indirani appraised the branch

accounts and thanked for the generous contribution of

the Engineers towards branch fund and for parent body.

Then the EC Member addressed the meeting & gave the

activities of the parent body. The former GS Er. G.

Balakrishnan narrated his experience and gave the

broader views of the neighboring S.E.Bs and their

experience. All the EC Member and branch Chairman

praised the service of the retiring Superintending

Engineer / Erode Electricity Distribution Cirlce / Erode Er.

K.P. Shanmugam.

Finally Er. K.P.Shanmugam thanked the gathering for
