International Maritime Organization (IMO) sulphur emissions limits – just around the corner2020 is almost here and the long-awaited sulphur emissions cap is about to become a reality. However, substantial questions remain as to whether fuel suppliers and vessel owners are ready for the calendar to turn: will there be sufficient quantities of 0.5 per cent fuel to adequately supply the industry? Will it be affordable? Are there any workable/economically feasible alternatives? How will port states enforce the emissions limit and what penalties are likely to be imposed for non-compliance? How will the responsibilities and liabilities for non-compliance be allocated between owners and charterers? This session will explore these questions and more.

Vessel scrapping – may she rest in peace (or pieces)Like everything, a ship’s life eventually ends and with it comes the inevitable efforts to extract her remaining value. The spectre still looms of the master driving the vessel at high tide up onto the beach at Chittagong and abandoning her there for scrappers forced to work in dangerous and environmentally unsafe conditions, and without regard to environmental safeguards. This panel will discuss the alternatives, including the status of The Hong Kong International Convention for the Safe and Environmentally Sound Recycling of Ships 2009 and the laws of various jurisdictions relating to the scrapping of vessels.

The new era of compliance in the shipping industry – anti-corruption and sanctionsThe shipping industry is in a new age of compliance. Gratuities in the industry have been a way of life, expediting port entry and the provision of necessary services throughout the world. However, when does a ‘gratuity’ cross the line and become a bribe or an illegal conspiracy under the various anti-corruption statutes in force? What are defences to prosecutions under such laws? Various United Nations and United States sanctions present additional challenges to vessel owners and operators requiring careful vetting of potential business to avoid crossing the ‘line’ – a line that is not always clear. The panellists in this session will discuss the anti-corruption and compliance issues facing the shipping industry and provide guidance for avoiding problems.

Maritime claims against governmentsA navy submarine surfaces from beneath a fishing vessel. A vessel grounds on a reef because a government-placed buoy is off-station. A naval vessel unexpectedly turns hard to port, colliding with a merchant ship. A vessel runs aground while navigating with a government-issued chart that indicated there was more than sufficient water in the vessel’s area of navigation. The government collects fairway dues which are discriminatory. Consider further that each of these incidents resulted in significant losses, property damage, loss of life and/or pollution. What happens next? The panel will address under what circumstances a government can be held liable for maritime torts and other claims, the defences that may be available to the government, including sovereign immunity, and other restrictions, limitations, and challenges to recovery.

ArbitrationThe resolution of contractual disputes through arbitration is well established in shipping matters, but the procedures and practices prevailing in the main arbitration venues are not so well known. The session will focus on a comparative discussion of the key issues in arbitration practice and procedure, as addressed in London, New York, the Nordics (Nordic Offshore and Maritime Arbitration Association rules) and Singapore.

The format will be a ‘shark tank’ approach, where advocates for each system will present their case to a panel of ‘sharks’, who will question and probe the presenter.

Conference sell-outsThe IBA places its conferences in venues of a suitable size for each event; however, there are times when our conferences may sell out. Should this happen, prospective delegates will be informed and a waiting list will operate. The waiting list will function on a ‘first come, first served’ basis, subject to receiving registered delegate cancellations. The IBA will not be liable for any travel or accommodation expenses incurred by an individual who travels to a conference without a confirmed place at the event.

Cancellation of registration or social functionsIf cancellation is received in writing at the IBA office by 18 April 2019, fees will be refunded less a 25 per cent administration charge. Refunds will be made minus any monies owed to the IBA.

We regret that no refunds can be made after this date. Registrations or social function bookings received after 18 April will not be eligible for any refund of fees. Please note that NO exception will be made to this policy. Should you have difficulties in obtaining your visa and are not able to attend the Conference this cancellation policy will still apply.

Upon submission of your completed Conference registration form to the IBA, you are considered ‘registered’ pending payment. Please note that the cancellation terms and conditions as indicated will apply as soon as your registration is received.

Provided you have cancelled your registration to attend an IBA conference in accordance with the terms of the ‘cancellation of registration’ clause included in the ‘Information’ section of the relevant conference programme, you must then confirm to us in writing at the IBA office as soon as possible, but in no event later than one year (12 calendar months) from the date of any such conference, all necessary details to enable any reimbursement owed to you to be paid. IBA Maritime and Transport Law CommitteeThe Maritime and Transport Law Committee is one of the oldest and most established committees of the IBA. Formerly known as Committee A, it has more than 650 members worldwide.

The Committee has a tradition of being the platform where leading maritime law professionals meet, create connections and discuss the most current legal issues in the field of maritime and transport law.

The Committee arranges a number of sessions on developments in maritime and transport law at the annual conferences of the IBA. Frequent mid-year seminars are held in the world’s maritime centres, and the Committee is also active in cooperating with other organisations in the maritime law area, such as Comite Maritime International, International Maritime Organization and maritime law societies in jurisdictions around the world.

The Committee works for and supports the unification of maritime and transport law on a worldwide basis.

The Committee enables members to: increase knowledge of maritime and transport issues throughout the world; improve client advice; meet fellow practitioners face-to-face; and become known to other competent specialists. The Committee works with the Aviation Law Committee to form the Maritime and Aviation Law Section.
