On Friday. December 15, the communi- ty menorah will be lighted in ceremonies conducted by Rabbi Robert Judd and coor- dinated by chamber member Howard Gainsburs. Mr. Martinez replaces Trustee Donald Mauersberger on the ticket, who decided not to run for a third term. "Trustee Mauersberger has been a public official that the Home Rule Party and the com- munity can be proud of," said Connor Kirwan, president of the Home Rule Party. "He has worked tirelessly on behalf of this village and embodies hard work and-practicality in public service. We wish him well and congratulate him on a job well done." Bill White, a lifelong Freeport resident, was appoint- ed to fill a vacancy on the Board of Trustees in 1998 and was elected to the position in 1999 and re-elected in 2003. He has been an integral part of the administration's ongoing revi- talization in the Village of Freeport. Freeport^r indictee! in 'connection with Coney

A grand jury has indicted TyrelCason, 24, of Roosevelt, on charges ofMurder in connection with the death ofHykiem Coney, an anti-gang activistfrom Hemsptead, Nassau CountyDistrict Attorney Kathleen Rice hasannounced.

The grand jury also returned anindictment of Erik Corse, 22, ofFreeport, on charges of HinderingProsecution. Both men were indictedon charges of Criminal Possession of aWeapon.

Hykiem Coney was shot and killed atapproximately 4 a.m., October 21, outsideImage Bar in Uniondale. The chargesallege Mr. Cason fired a semi-automatic.380 seven times at a group standing out-side of the bar, striking the victim in boththe back of the head and the torso. Thecharges also allege Mr. Corse provided

Mr. Cason with the weapon immediatelyprior to the shooting.

Approximately a week and a half afterthe shooting, Mr. Cason fled toHarrisburg, Pennsylvania, where he wasapprehended without incidentNovember 17 by United States marshalsand extradited that night by Nassaupolice detectives. Mr. Corse was arrest-ed by detectives the same day inFreeport. The following morning, onNovember 18, Mr. Cason was arraignedon the murder charge and Mr. Corse wasarraigned on the charge of HinderingProsecution. Both men are being heldwithout bail.

Mr. Cason faces a maximum of 25-years-to-life in prison if convicted of thecharges. Mr. Corse faces a maximum of15 years in prison if convicted of thecharges.

Rezoning hearing for Hess station on Sunrise to be continued era

Plans to rezone the 28,000 square-foot property at 395 Sunrise Highwayto allow construction of a Hess gas sta-tion hit a snag Monday at the VillageBoard meeting in'the face of publicopposition and several questions bytrustees.

An attorney for Hess asked for acontinuance of the public hearing socompany officials can have more timeto present their case and also to answerquestions raised at Monday's publichearing.

The property considered for rezon-ing is occupied by the Village Nursery,whose owner, the 395 SunriseHighway Corp.. apparently signed alease with Hess for the eventual con-struction of a gas station if village offi-cials change the property designationfrom Business B and Residence A toService Business SB District zoning.

In his opening presentation for thepublic hearing, Assistant VillageAttorney Howard Colton noted that, inthe initial application for the rezoning,the Village Planning Board ruled inOctober that it did not favor approvalfor the request. The Nassau CountyPlanning Board called for certain mod-

ifications to the Hess application,including the elimination of proposedcurb cuts on Centre Street.

Kevin J. O'Brien, an attorney repre-senting Hess, said the proposed stationwould include a convenience store in a2,480-square-foot building. Therewould also be a 3,276-square-footcanopy over six pump islands thatcould accommodate as many as 12 carsat a time.

The building would be of a"Hampton-style" design that wouldgive the facility "a more residentialtype of character" similar to Hess sta-tions in the Hamptons, Mr. O'Briensaid. He said the company was "notafraid to spend the amount to make thesite a model facility."

Mayor William F. Glacken and theother village board members posedseveral questions and concerns aboutthe Hess plan, including why the com-pany did not consider locating at oneof the former gas stations nearby thathad closed down, and about its plans tooperate on a 24-hour basis.

"A 24-hour operation will affect theresidents," said trustee DonaldMauersberger.

Later, several of the more than 50residents of the Centre Street neighbor-hood the proposed station would abutalso spoke to voice their opposition tothe rezoning and the presence of theHess station.

About three years ago, they success-fully opposed plans for a KentuckyFried Chicken outlet at the site.

Village officials also expressed con-cern about traffic flow in the area andasked for a traffic survey and market-ing analysis.

Mr. O'Brien said that would beaccomplished in time for the follow-uphearing, which trustees agreed to hold,but no official date had been set atMonday's meeting.

Mayor Glacken also recommendedthat Hess officials meet with neighbor-hood residents to discuss their con-cerns.

Several residents at the meetingnoted the proximity of Freeport HighSchool about 1,000 feet away onBrookside Avenue and expressed fearsthe station would become a hangoutfor students, who might be tempted bythe availability of beer sold in thestore.

In response to a question fromtrustee Don Miller about the station'sfuel capacity, Mr. O'Brien said theunderground tanks would hold "about40,000 gallons" that, would requiredeliveries of "two to three truckloads aweek."

Nassau County Comptroller Howard Weitzman hasbeen • making the rounds locally, speaking in NorthBellmore to the Knights of Pythias and Merrick Chamberof Commerce, among other venues.

He says he's-found that people who have moved outhere take pictures of their new hometown and keepthem, saying they want the pictures to be the same whenthey move out.

Many moved out to the suburbs to escape graffiti andovercrowding and embrace trees, green lawns and localcontrol of schools.

But we are running out of land here, which is whyMr. Weitzman is trying to promote "smart deyelop-

? ment" 1'n which existing downtowns are used for inulti-i family housing so juniors, and young people can afford

to live here.; Property taxes are one thing most residents don't mind

seeing changed, as long as they are lowered, not raised.Mr. Weitzman is lobbying for changes in the state aidformula that now seems to penalize Nassau County forbeing "affluent," yet Westchester County's homeownerswith similar income and property values pay much less,he points out.

Responding to concerns about how high propertytaxes affect small local businesses, either through taxesor the rents they pay, Mr. Weitzman said he would con-sult with County Assessor Harvey Levinson. Accordingto the assessment office's specialists, New York Cityhas a special category for "Mom and Pop" businesses,assessing their properties at a different rate than the bigbox stores and malls that enjoy more foot traffic.

Bellmore Chamber of Commerce President TomValenti also has gone on record protesting the way theburden of utility costs is distributed and how that affectssmall businesses.

The theory behind property taxes, Mr. Weitzmanpointed out, is that they are based on ability to pay, withthose owning more valuable properties being assumed tobe able to pay more taxes. However, he added that 70percent of Nassau County homeowners could not affordto buy their own homes.

Business owners who do not live in their taxing dis-tricts have no vote, but they can have a voice, Mr.Weitzman noted, adding, "Sometimes having a voice isbetter than having a vote."

THE FIFTH ANNUAL "HOMELESS VETERANS STAND DOWN" was hosted by the Nassau CountyVeterans Service Agency on Monday, November 20, at the New York Guard Armory in Freeport.Finding jobs and securing veterans benefits was the theme of this year's event. Homeless vet-erans were able to get showers, haircuts, clothing donations and hot meals during the event.More than 25 private and government agencies participated, including the Red Cross, theSalvation Army and Beacon House. BECOME A LIFEGUARD: The AmericanRed Cross in Nassau County (ARC/Nassau)provides Heath and Safety training to thousandsof people each year. State Senator Charles J.Fuschillo, Jr. has provided state funding for a

new program, Project Guard, that offers life-guard training to teenagers at no cost.

On Saturday, December 16, at 10 a.m. theFreeport Recreation Center, located at 130 EastMerrick Road in Freeport, is to host the 2006class of Project Guard. This meeting will pro-vide students with a strong understanding of theprogram and the importance of becoming a cer-tified lifeguard.

The training and certification will be providedby ARC/Nassau. Any teenager who successfullycompletes the course and becomes certified isguaranteed a lifeguarding job for next summerat local pools, beaches and summer camps.

The prerequisites for Project Guard are: Beable to swim, be 16 years old by June 30, 2007and"demonstrate financial need.

A FEW IDEAS.-.During theThanksgiving holidays, my husband andI joined our daughters and their spousesfor a tour of Winterthur in Delaware, themagnificent property owned by variousgenerations of the du Pont family butbrought to its height under the directionof Henry Francis du Pont who liveduntil 1969.

Intent on bequeathing a mansion andmuseum which reflected American liv-ing and culture, Mr. du Pont spared noexpense in following his passions offarming, horticulture, and collecting.The result is a home and garden of beau-ty and learning, never more impressivethan when decorated for Christmas.

The tour we took was called theYuletide Tour and focused on the origi-nal family rooms and the customs anddecorations that were an intrinsic part oflife for the du Fonts.

As we walked with a wonderfullytrained and knowledgeable docent, weviewed enormous Christmas trees, lav-ish floral arrangements and artisticpackages and wrappings - all amid thesplendid furnishings collected by awealthy man who appreciated quality.One mahogany highboy was said tohave cost $44,000 back in the 1920s.Strolling through such elegance, with

some rooms specifically decorated by

the professional designer Thomas Jayne,the docent suggested that we "take homesome ideas for our own decorating."

At first, my daughters and I smiled atwhat seemed to be an incongruity. Howcould we ever hope to replicate suchmagnificence? If the cost of such deco-rating were not a deterrent, certainly themanpower needed to implement suchbeauty would be.

The docent told us that he and threeother volunteers had spent two days dec-orating just one of the rooms, concen-trating especially on the 20-footChristmas tree which was filled withmyriad lights and antique ornaments.

As we continued, however, thethought of using this magnificent homeas an inspiration was less daunting.What we began to discover was thatunlike some of the rich and famous,Henry Francis du Pont was a ratherbenevolent multi-millionaire whowatched out for his hundreds of employ-ees and who fostered close family rela-tionships and customs.

He personally purchased gifts for allhis help. Christmas Day had endearingcustoms. Each member of the familyopened his own stocking, filled withsuch gifts as tangerines, and then, afterbreakfast, left for church services. Onlyin the afternoon were gifts, beautifully

were the main concerns of residents.Speeding and illegal parking at specif-

He stressed that the crux of the problemis the "historic low levels" of police. "Ithink that they are barely keeping upwith keeping a lid on violent crime."

Responding to the question, "Why dowe have so much trouble getting theFirst Precinct to do their job?" MrSantino noted that quality of life issuesmust take a back seat to more pressingissues. "When there is an accident and an

On January 1, the du Fonts visited,from household to household, all aroundthe lovely Brandywine countrysidewhere various siblings and cousinslived. On one wall, a painting by JaimeWyeth, the third generation of the well-known Wyeth family of artists and a rel-ative by marriage to the du Fonts,depicts a parade-of expensive blacksedans making their way up a hill in thepristine white snow.

How can we duplicate these imagesand this style? The first is that our dec-orating should contain objects that wetreasure. The designer Thomas Jayneused magnificent antique toys from thedu Pont collection as part of his diningroom centerpiece.

Another tree contained dried flowersfrom the du Pont estate. While the deco-rating of a mansion certainly does notreflect a "less is more" philosophy, itdoes show how using what you alreadyhave can be elevated when somethingspecial is highlighted and placed in asomewhat different context.

It is not just the decorations, the fur-nishings, the antiques, and the acces-sories that impress. The entire du Pontexperience is one of quality. At the endof the tour, each person receives a deli-cious, foil-wrapped chocolate truffle.And when our family sat down for lunchin the light-filled cafeteria which over-looks the undulating countryside, I com-mented that even the plastic knives andforks were of a higher quality than

usual.Maybe instead of "less is more," we

could concentrate on "quality is more."And instead of "Let's buy more," wecould look at our own collections andsee which of them might make appropri-ate holiday decorations.

And, perhaps, like the du Fonts, wecan arrange .some holiday visits thatreflect that these days are about relation-ships — family and friends — and not sim-ply the occasion to rush out the day afterChristmas for post-Christmas sales.

Certainly, docents are always ratherprotective of the people they aredescribing. But even knowing that, andeven with the understanding that theoriginal du Pont fortune came from.developing and manufacturing dyna-mite, Henry du Pont certainly seems tohave created a lovely and loving havenfor his family and employees, especiallyduring the Christmas season.

That is what I will take from ourYuletide tour, for I certainly cannotreplicate the estate's magnificence. And,perhaps, that is why Henry Francis duPont, in his foresight, left future genera-tions not just his home, but a wonderfulmuseum as well. It's always fun to seehow the rich live and to view the bestartifacts of the past. And it certainlymotivates us to think. Amid all of ourstuff, which are our treasures and whatdo we really love?

p.m., Cecelia Brauer will present a con-cert and lecture on the glass harmonica(also called the armonica, invented byBen Franklin in 1761). This instrumentconsists of 37 glass hemispheres, eacha different size and thickness, thus pro-ducing a different pitch.

These glass bowls are connectedwith an iron rod running through eachone. Franklin used a treadle to turn therod and make the glasses spin whileholding moistened fingers against therims of the hemispheres. The modernarmonica is run 'by electricity insteadof the pedal.

Cecelia Brauer is now one of only 14musicians in the world activelyinvolved in performing on the instru-ment.

Some residents expressed doubtsabout the delivery figure and concernsabout the trucks using Centre Street toenter the station.

In his comments, Centre Street resi-dent Russ Fehrenbacher reflected thefeelings of most of the audience, say-ing he was concerned about "theregard for safety, the volume of traf-fic, noise and fumes" the presence ofthe station would mean, and that itcould become "a hangout for teens."

"All that adversely affects theneighborhood," he added.

Kenneth Bagatelle, president of theNorthwest Civic Association, notedthat in the plans Mr. O'Brien present-ed at the hearing, there was no men-tion of access for the physically handi-capped.

He also expressed concern about adecrease in property values in the areanear the station and the impact of themore than 2,000 students, faculty andstaff of the high school who couldpatronize the station.

The hearing, which lasted nearlytwo hours, adjourned at about 10:20p.m. and trustees went into executivesession.

The proposed revitalization at theintersection of Grand Avenue andMerrick Road, along with the largerissue of attracting higher level business-es to the community, also interested res-idents. Mr. Santino and Charles Theofan,the commissioner of planning and devel-opment, outlined the history of the revi-talization project.

After a study which identified the fiveacres as officially blighted, the town hasproceeded with the process of determin-ing the appraisal value of the variousparcels. On November 21. developerstoured the area in preparation to theirresponding to the town's Request forQualifications and preliminary plans byDecember 15.

After reviewing the plans (which willinclude plans both with and withoutNunley's carousel) the town will narrowthe search for a developer to approxi-mately three candidates from which afinal selection will be made. There willbe public notice in February as part ofthe intended "visioning process" toinvite residents to attend an input meet-ing at which planning consultants willlisten to community views on the proj-ect.

Mr. Theofan also stressed the legalprocess by which residents in the areawil l be relocated to "anywhere theywish" with increased housing costs sub-sidized for a period of time in accordwith federal regulations. He called it "amyth" that the project was intended to"drive certain individuals out of the com-

munity.In concluding his remarks, Mr.

Theofan described the Baldwin projectas "the most important project my officeis now working on." He stressed thatthey are working "as fast as we possiblycan. We know owners are suffering''because they must still pay taxes untilthe properties are officially purchased bythe town.

Mr. Santino noted that "the primarygoal is economic development, whichwill act as the economic engine to helpthe rest of the community percolate." Hesaid that the intention is to attract somequality national chains - the Gap, OldNavy. Barnes and Noble - which will actas a magnet and attract shoppers fromother towns. Once that happens, he-says,other retailers will see Baldwin as aplace in which to do business.

Another goal is that the entire cost foracquisition of land and construction,estimated at S20 million, is to be borneby the developers. For that reason, it isunlikely that the carousel will eventuallybe included since the space neededwould impede sufficient retail footagefor developers to recoup their costs. Mr.Theofan said that the project has "attract-ed some of the biggest real estate devel-opers in the area."

One resident, noting facetiously thathe was "happy that we've upgraded the99 cent store to a dollar store," askedwhy so many stores remain vacant in themid-Baldwin shopping center. Mr.Santino. as well as Doug Diana, a mem-ber of the town Board of Zoning and adirector of the Baldwin Chamber ofCommerce, outlined the long history ofcommunity attempts to bring qualitybusinesses to that landlord. incredible landlord issue," Mr. Santinosaid, adding, ''We could write a bookabout it." Responding to "Why would alandlord keep stores empty?" Mr.Santino said "We can't figure it."

Mr. Diana described past attempts tobring an Applebee's to that shoppingcenter, but indicated that the landlordwould not reconfigure space to accom-modate the client. "It was basically,Take it or leave it,'" he said.

Perennial issues were also discussedincluding lengthy debate on the lack ofrestricted parking for Baldwinites at theLIRR station. Mr. Santino explained theeconomics, noting that the cost for suchrestricted parking would have to be taxedto Baldwin residents. Purchasing thegeneral parking from the MTA, a sug-gestion of one resident, would be prohib-itive and "a big 'if anyway." However,the commuter posing the questionspushed for the town to "think outside thebox."

Other issues included requests toupgrade the tennis courts at BaldwinPark, improve roads, particularly VerityLane, eliminate Gentlemen's Quarters,("We cannot use the process of eminentdomain to get rid of a legal business"),regulate storage Pods on private proper-ty (Pods can only be placed on privateproperty for three months in conjunctionwith permitted construction projects),and the status of the First Precinct ("Thelatest I heard is that they are staving inBaldwin and are looking at the buildingnext door - that's not official, just thescuttlebutt)

Also suggested was the need for alonger "storage" lane (left-hand turn) atGrand Avenue for cars driving eastwardand then north, a Nunley's update (possi-

ble at the revitalization site, but not like-ly), and the problem of illegal apartments(Some professional absentee landlords"play the system," engaging the town indrawn out courtroom legalities). Notedwas the condition of the former Eckhardtproperty on Verity Lane, with Mr.Santino directing the building depart-ment to "go down there tomorrow andlook at it and ticket violations."

Also explained was the status of therenovations to Waldbaum's on AtlanticAvenue. Mr. Santino noted, "every gov-ernment aspect is resolved" (permits,zoning changes), but there is now a stale-mate in negotiations .between A&P (theowners of Waldbaum's) and the landlord.Mr. Diana explained that the Chamber ofCommerce has been attempting to facili-tate dialogue but may need residents tocontact Waldbaum's to encourage move-ment.

Other issues pertained to either NassauCounty or federal jurisdictions, includ-ing the status of Silver Lake and LoftPond restorations and the impact of ille-gal immigration.

With almost one dozen commissionersor deputy commissioners present, Mr.Santino directed specific follow-up to sev-eral concerns, although he acknowledgedthat some issues, like speeding, policeresponse for quality of life issues and insuf-ficient LIRR parking would remain as"issues that are never going to go away."

Absent was any crisis issue and mostobvious from the appearance, demeanorand comments of residents was the factthat both diversity and prosperity co-exist in Baldwin, with residents cordialto and supportive of each other andeager to upgrade the community thatthey share.
