Under section 26 of the Financial Administration Act,the Board makes the following Order:

1 This Order may be cited as the Forestry Industry Re-mission Order - Financial Administration Act.

Qualifying forestry business Entreprise forestière admissible

3(1) Subject to subsection (2), a forestry business quali-fies for a remission under this Order if it falls within anyof the following classifications:

(a) hardwood sawmills; a) scieries de bois de feuillus;


(b) wood preservation; b) préservation du bois;

(c) veneer, plywood and engineered wood productmanufacturing;

c) fabrication de placages, de contreplaqués et de pro-duits en bois reconstitué;

(d) millwork; d) menuiseries préfabriquées;

(e) wood container and pallet manufacturing; e) fabrication de contenants et de palettes en bois;

(f) prefabricated wood building manufacturing; f) préfabrication de bâtiments en bois;

(g) other miscellaneous wood product manufactur-ing;

g) fabrication d’autres produits divers en bois;

(h) pulp, paper and paperboard mills; and h) usines de pâte à papier, de papier et de carton;

(i) converted paper product manufacturing. i) fabrication de produits en papier transformé.

3(2) A forestry business does not qualify for a remissionunder this Order if any of its products are included withinthe scope of the Softwood Lumber Agreement 2006 be-tween the Government of Canada and the Government ofthe United States of America.

4 Capital expenditures of a qualifying forestry businessthat are made in manufacturing or processing machineryor equipment during the period commencing on March 17,2009, and ending on December 31, 2009, are eligible ex-penditures for the purposes of this Order.

Remission Remise

5(1) Subject to subsections (2) and (3), remission isgranted to a qualifying forestry business of a portion of thetax paid under subsection 5(1) of the Real Property TaxAct in respect of the calendar year referred to in section 2.

5(2) The portion of the tax that can be remitted is thelesser of

(a) 50% of the tax paid under subsection 5(1) of theReal Property Tax Act for the calendar year on all realproperty owned by the qualifying forestry business, and

(b) 50% of the eligible expenditures made by thequalifying forestry business in the calendar year, ex-cluding the tax paid under subsections 165(1) and (2)of the Excise Tax Act (Canada).

5(3) A remission shall not be granted unless the quali-fying forestry business has paid all taxes, tax arrears andpenalties payable on its real property under the Real Prop-erty Tax Act.

6(1) An application for a remission shall be made on aform provided by the Minister of Finance.

6(2) The application, together with any information re-quired on the form, shall be submitted to the Minister ofBusiness New Brunswick before April 1, 2010.
