PRELIMINARIES

PRE-CONSTRUCTION HEALTH & SAFETY INFORMATION

The project of repairs and rebuilding to stone walling will fall within the requirements of the Construction Design & Managements Regulations 2007. The project will be notified to the Health & Safety Executive. The following appointments are recognised.

COMPETENCE. It is a responsibility of the Client to ensure the competence of all those involved with the project. The Principal Contractor will be requested to provide evidence of their experience, training and level of competence in the area of work proposed. This is required to be provided at the time of tender.

RISKS & HAZARDS ASSOCIATED WITH THE WORKS.

The contractor tendering for the works will be required to submit a programme of works and their proposed methodology for reducing the risks associated with the works as identified below to an acceptable level, or eliminated completely. The contractor is to allow within their tender for all necessary health and safety measures to create a safe working environment.

THINK ABOUT SAFETY NOW. THE PURPOSE FOR THE PRE-TENDER SAFTY PLAN IS TO ALLOW THE CONTRACTOR TO IDENTIFY AND COST IN ALL APPROPRIATE SAFETY MEASURES SO TO ENSURE THAT SAFETY IS NOT COMPROMISED DUE TO LACK OF FUNDING OR OVERSIGHT.

YOU ARE REQUIRED TO GIVE A METHODOLOGY FOR :-

• Site Safety / Traffic management

Almost all of the works are completed on the highway. Ensure the safety of workers, pedestrians and vehicle users during the course of the repairs and rebuilding works. Detail what precautions you intend to provide to comply with road traffic regulations and the Health & Safety at work Act.

• Welfare

Ensure that your operatives have access to all necessary welfare facilities. The Principal Contractor will be required to comply with there obligations under the Health & Safety at Work Act. Provide details with your tender.

• Security of the site

All works will need to be left in a secure manner both during and after working hours. Materials stocks should also be protected or held off site.

• Manual Handling

A number of coping stones and stones within the construction are of considerable weight, the Principal Contractor shall identify how they intend to remove / relay these in consideration of the Manual Handling Regulations.It is essential that effective communication is maintained between all members of the project team. Regular meetings and project updates will be held. The Principal Contractors management structure for Health & Safety within their organisation is requested to be supplied at the time of tender.

Changes to the duration, extent or type of work shall be discussed with the project team and all methodology and risk assessments shall be updated to reflect such changes.

The works as defined herein have been reviewed and the existence of hidden / underground services and the like cannot be determined. The Principal Contractor is to review utility records and determine the existence of any such services prior to commencement. A “Dial before you dig” type service should be undertaken by the principal contractor and the findings of such a report contained within the Construction Phase Health & Safety Plan.

CONSTRUCTION PHASE HEALTH & SAFETY PLAN

The principal contractor shall take this document and develop it into a full working construction phase health and safety file. The works as completed and any necessary specifications and details of construction shall be recorded and provided to the client at the completion (Practical Completion) of the works. This document will be retained by the client as the Health & Safety File.

• Dates for the commencement and completion of the works have not yet been established. The Principal Contractor shall determine a suitable programme and this shall be used to define the overall works programme. The Client has no overriding time scale, therefore a safe system of work can be employed without the need for accelerated work programmes.

• A Minimum of six weeks will be allowed between appointment of the Principal Contractor and instructions to commence work on site

• The completed structure will not be used as a workplace.

• The information contained herein relates to all records that the client has regarding the works proposed.

8 THE SITE/ EXISTING BUILDING(S):Various stone walls as defined on maps and shown within this document.

9 EXISTING BUILDINGS ADJACENT TO THE SITE:The principal Contractor is to visit the site and make themselves aware of all adjacent structures, lamp posts, street furniture etc that is present along the route of the walling.

10 EXISTING MAINS/SERVICES: Identify, protect, uphold and maintain any existing services, live drainage, ducts, water, electric and other mains services found during the carrying out of the Works. If any are damaged. reinstate them before leaving site. Be liable for and indemnify The client against any expense, liability, loss, claim or proceedings provided always that the damage is due to any

negligence, omission or default of the Contractor's work people or sub-contractors.

11 HEALTH AND SAFETY FILE – the pre commencement information contained herein shall be deemed to be the existing H&S File.

12 RESTRICTION OF WORKING HOURS: works are restricted to 9am to 5pm weekdays. Unless agreed with the contractor prior.

13 ACCESS TO THE SITE FOR TENDERING: The site is “open” to the public so it is not necessary to be accompanied / arrange times etc.

14 ACCESS TO THE SITE FOR THE WORKS: Agree details of routes and times for access and any restrictions, with the CA prior to commencement.

15 PARKING: CONTRACTOR'S AND EMPLOYEES' VEHICLES: agree arrangements with the CA prior to commencement

16 SITE VISIT: Before tendering, ascertain the nature of the site, access and all local conditions and restrictions

SECTION D JCT MINOR WORKS AGREEMENT

17 The works shall be controlled under the terms of the MINOR WORKS AGREEMENT: JCT Agreement for Minor Building Works 2005 Edition [JCT MW 05]

SECTION E TENDERING

18 ACCEPTANCE OF TENDER: The Client (North Tawton Town Council):

• Do not guarantee that the lowest or any tender will be accepted.

• Will not be responsible for any cost preparing tenders

19 PERIOD OF VALIDITY: Tenders must remain open for for not less than thirteen weeks from the date of submission (unless previously withdrawn)

20 THE PRICED SPECIFICATION: Submit within five working days of request

21 SPECIFICATION WITHOUT QUANTITIES: tenders must include for all work shown or described in the tender documents as a whole or clearly apparent as being necessary for the complete and proper execution of the Works.

22 PRICING OF SPECIFICATION: Alterations and qualifications must not be made without CA’s the written consent. Tenders containing unauthorised alterations or qualifications may be rejected. Costs relating to items in the specification which are not priced will be deemed as included in the tender.

23 A SCHEDULE OF RATES must be submitted with the TenderThe Schedule must include rates for all significant items of work.

24 THE FORM OF TENDER: must be submitted with the Tender

25 PROGRAMME:As soon as possible and before starting work on site prepare in an approved form a master bar chart programme for the Works.

26 SUBMISSION of programmes will not relieve the Contractor of his responsibility to advise the CA of the need for further drawings or details or instructions in accordance with the Conditions of Contract.

SECTION F PROVISION, CONTENT AND USE OF DOCUMENTS

27 REFERENCED DOCUMENTS:Where this specification conflicts with referenced documents, this Specification prevails.

28 EQUIVALENT PRODUCTS: Wherever products are specified by proprietary name alternative products shall may be used by prior consent with client.

29 COPIES OF THE DOCUMENTS: Two copies of all documents will be issued free of charge. Additional copies will be charged to the Contractor.

30 COPIES OF SPECIFICATION: After execution of the Contract, two copies of the

Specification will be issued to the Contractor

31 DIMENSIONS: The accuracy of dimensions scaled from the drawings is not guaranteed. Obtain from the CA any dimensions required but not given in figures on the drawings or measurable on site.

SECTION G MANAGEMENT OF THE WORKS

32 SUPERVISION: Accept responsibility for co-ordination, supervision and administration of the Works. Notwithstanding the foregoing, The client reserves the right to instruct the Contractor, or any person working for the Contractor, to suspend their work if it poses an imminent risk of serious injury to anyone or damage to property

33 COMPLIANCE WITH STATUTORY PROVISIONS: Notwithstanding clause 32, The Client reserves the right to require the Contractor to produce evidence that he is complying with relevant statutory provisions. In particular, the client is likely to require the Contractor to demonstrate that he has properly assessed the risks to his own employees and others arising from the nature of his work

34 INSURANCES: Before starting work on site submit documentary evidence of the insurances required by the Contract.

35 INSURANCE CLAIMS: If any event occurs which may give rise to any claim for loss or damage give notice in writing to the CA and the Insurers.

36 OWNERSHIP: Where scheduled or specified to be removed, all materials arising from the alteration work are to be disposed of by the Contractor.

37 PROVISIONAL SUMS: All provisional sums and allowances shall only be expended at the direction of the CA: if not expended, no claim for loss of profit and attendance shall be deemed to be included in such sums.

38 DAYWORK SHEETS: Give reasonable notice to the CA of the commencement of any work for which daywork sheets are to be submitted.

39 INTERIM VALUATIONS: At least four days before the end of each period for interim valuations submit to the CA details of amounts due together with all necessary supporting information.

40 CONDUCT: The conduct of all personnel on the site under the contractor's direction shall be appropriate. The client reserves the right to instruct the contractor to expel from site any person whose conduct is prejudicial to the image and representation of the Town Council.

41 NOISE: The use of radio transmitters or the like, will not be permitted where they would cause nuisance or offence to the public.

SECTION H QUALITY STANDARDS/CONTROL

42 GOOD PRACTICE: Where and to the extent that materials, products and workmanship are not fully detailed or specified they are to be of an appropriate

standard for the functions stated and good building practice.

43 SAMPLES: Where specified, submit samples to the CA. Do not carry out workor install until samples has been approved.

44 SETTING OUT: Inform the CA when setting out is complete and before commencing construction.

45 SERVICES REGULATIONS: Any work carried out to or which affects new or existing services must be in accordance with the Bye Laws or Regulations of the relevant Statutory Authority.

46 CONTRACTOR’S PERSON-IN-CHARGE: Give maximum possible notice to CA before changing the person-in-charge

47 OVERTIME WORKING: Whenever overtime is to be worked, give the CA not less than two days notice, specifying the time and type of work to be done. Concealed work executed during overtime for which no notice was given may be required to be opened up for inspection and reinstated at the Contractor's expense.

48 DEFECTS IN EXISTING CONSTRUCTION: Report to the CA without delay. Obtain instructions before proceeding with work which may cover up or hinder access to the defective construction, or be rendered abortive by the carrying out of subsequent remedial work.

49 PROPOSALS FOR RECTIFICATION OF DEFECTIVE WORK/PRODUCTS: As soon as possible after any part(s) of the work or any products are known to be not in accordance with the Contract, agree proposals with the CA for opening up, inspection, testing, making good, adjustment of the Contract Sum, or removal and re-execution.

50 SECURITY AT COMPLETION: Leave the Works secure with all accesses locked.

51 MAKING GOOD DEFECTS: Agree the CA reasonable notice and dates for access for making good defects. Inform the CA when remedial works are completed.

SECTION I SECURITY/SAFETY/PROTECTION

52 ASBESTOS BASED MATERIALS: Report immediately to the CA any suspected asbestos based materials discovered. Avoid disturbing such materials. Agree with the CA methods for safe removal or encapsulation.

53 THE CONSTRUCTION PHASE HEALTH AND SAFETY PLAN, developed from the Outline Construction Phase Health and Safety Plan must be submitted to the CA not less than seven days before the proposed date for start of construction work. Do not start work until the Planning Supervisor has confirmed in writing that the Construction Phase Health and Safety Plan includes the procedures and arrangements required by CDM Regulation 15(4).

54 HSE APPROVED CODES OF PRACTICE: Comply with the following:

• Management of health and safety at work.

55 SUSPENSION OF WORK: The Client reserves the right to instruct the Contractor, or any person working for the Contractor, to suspend work if their work poses an imminent risk of serious injury to any person

56 SECURITY: Safeguard the Works, products, materials, plant, and any existing buildings affected by the Works, from damage and theft. Take all reasonable precautions to prevent unauthorised access to the site, the Works and adjoining property.

57 OCCUPIED PREMISES / DWELLING ADJACENT TO WORKS:

Carry out the Works without undue inconvenience and nuisance and without danger to occupants, users or the public

58 PLANTING AND VEGETATION:

• Unless stated otherwise, existing trees and plants are to remain on completion

• Take all care to avoid damaging roots and above ground parts of trees, and plants that are to remain on completion

• Take all care to protect trees and plants that may be damaged by the Works: agree protection methods with the CA.

• Agree with the CA any tying back of vegetation from elevations if necessary for the Works and reinstate upon completion

• Agree with the CA any cutting back necessary for the work

• Do not dump spoil or rubbish, excavate or disturb topsoil, park vehicles or plant, store materials or place temporary accommodation within the branch spread of trees without the CA’s express approval

• Do not sever tree roots exceeding 25 mm in diameter without the CA’s approval

• Provide with approved replacements, any trees or plants damaged or removed without approval.

59 NOISE:

• Comply generally with the recommendations of BS 5228-1, clause 9.3 for minimising noise levels during the execution of the Works.

• Fit all compressors, percussion tools and vehicles with silencers recommended by manufacturers of the compressors, tools or vehicles.

• Agree times for use pneumatic drills and other noisy appliances with the CA.

• Do not use or permit employees to use radios or other audio equipment.

60 NUISANCE: Take all necessary precautions to prevent nuisance from dust, rubbish, vermin and other causes.

61 ELECTRICAL SAFETY:

• The Contractor shall comply at all times with the Electricity at Work Regulations 1989 [Electricity At Work Regulations (NI) 1991]

• All portable electric tools shall, as far as practicable, be supplied from a reduced voltage, (i.e. 110v or less) system.

• All portable electric equipment shall be properly maintained, and shall be subject to a regime of inspection and periodic testing.

• All electrical connections shall be through correctly fused plugs, sockets and extension leads. All such equipment shall be unplugged at the end of each working day.

• The Contractor shall take appropriate precautions when working in the vicinity of overhead power lines: Reference HSE Guidance Note GS6 - Avoidance of Danger from Overhead Electric Lines.

62 WASTE:

• Remove rubbish, debris, surplus material and spoil regularly and keep the site and Works clean and tidy.

• Remove all rubbish, dirt and residues from voids and cavities in the construction before closing in.

• Ensure that non-hazardous material is disposed of at a tip approved by a Waste Regulation Authority.

• Remove all surplus hazardous materials and their containers regularly for disposal off site in a safe and competent manner, as approved by a Waste Regulation Authority and in accordance with relevant regulations.

• Retain waste transfer documentation on site.

63 ARCHAEOLOGICAL DISCOVERIES: may be encountered during Works, and any structures, foundations, fossils and other objects of interest or value, which may be found on site or during excavations are the property of The Client. On discovery of such objects cease work immediately, advise the CA and await further instructions.

64 PROTECTION: Adequately protect all parts of the Works, throughout the Contract. Wherever work is of a vulnerable nature or exposed to abnormal risks provide special protection to ensure that damage does not occur.

65 ROADS AND FOOTPATHS: Adequately maintain roads and footpaths within and adjacent to the site and keep clear of mud and debris. Any damage to roads and footpaths caused by carrying out the Works must be made good to the satisfaction of the CA at the Contractor’s expenseDo not use aerosol spray marking-out without the approval of the CA

66 EXISTING TOPSOIL/SUBSOIL:

• Protect existing topsoil and subsoil from over-compaction in those areas which may be damaged by construction traffic, parking of vehicles, temporary site accommodation or storage of materials and which will require reinstatement prior to completion of the Works. Agree the extent of reinstatement with the CA and bear any costs arising.

• Keep excavated topsoil and subsoil separate

67 EXISTING WORK AND FEATURES:

• Remove existing work the minimum necessary and with care to reduce the amount of making good to a minimum

• Prevent damage to existing fences, gates, walls, roads, paved areas and other site features which are to remain in position during the Works.

68 ADJOINING PROPERTY: Access to/use of adjoining property has not been agreed with adjacent owners :

69 EXISTING STRUCTURES:

• Check proposed methods of work for effects on adjacent structures inside and outside the site boundary.

• Provide and maintain during the execution of the Works all incidental shoring, strutting, needling and other supports as may be necessary to preserve the stability of existing structures on the site or adjoining that may be endangered or affected by the Works.

• Support existing structure as necessary during replacement of structural parts.

• Monitor adjacent structures and immediately report any movement to the CA.

• Do not remove supports until new work is strong enough to support the existing structure. Prevent over stressing of completed work when removing supports.

SECTION J FACILITIES/TEMPORARY WORK/SERVICES

70 CONTRACTOR’S WORKING AREA: The contractor is to confine his activities to the smallest possible area of the site for the execution of the Works and storage of materials, unless otherwise defined.

71 TEMPORARY FENCE(S): The principal contractor shall allow for all temporary fencing necessary to secure the works from unwanted acces.

72 NAME BOARDS/ADVERTISEMENTS: Contractor's name boards or advertisements will not be permitted except with the approval of the CA

73 LIGHTING AND POWER: The clients mains may not be used for the Works: no electricity will be provided for the Contractors use. Contractor to ascertain and

negotiation any temporary supplies needed or alternatively used self supported systems of work.

74 WATER: The Clients mains may not be used for the Works: no water will be provided for the Contractors use. Contractor to ascertain and negotiation there own supplies.

75 SCAFFOLDING: It is not envisaged that any scaffolding is required. The Principal contractor shall inform the CA if they believe that any part of the works shall require scaffold.

76 LADDERS AND OTHER ITEMS OF EQUIPMENT must not be left unattended when accessible to the public.

77 OUT OF HOURS SECURITY: When the site is not being worked all ladders shall have the first lift ladder removed and placed under lock and key. All loose ladders shall be similarly chained and locked or removed from the site.

THE WORKS

SECTION K - Church Yard – Market Street Stone Walling

The length of wall facing Market Street consists of traditional solid stone walling, built as a retaining structure, with large granite coping stones. The wall is traditionally pointed in a raised pattern joint. The walling has been unsympathetically re-pointed in the past in modern cement based materials which have not allowed the wall to “breath” and thus allow a build up of water behind, this has resulted in the blowing of mortar joints and a certain amount of movement within the wall. The wall is also being overgrown with Ivy.

A section of the wall to the right of the linch gate has suffered more extensive movement and the copping has shifted in place. This area has been identified for rebuilding. The remaining length of the stone wall facing market Street is proposed to undergo the following remedial works.

1. The works will involve the closing of the public footpath and working within the highway. The Contractor shall allow for all necessary precautions and safety measures as required by Law to work within the highway. The contractors proposal shall identify the extent and allowance for all necessary traffic management and pedestrian management. The accesses into the Church are to remain open unless formally agreed with the employer as part of the project programme.

2. Removal of vegetation. Carefully remove ivy and other vegetation that is attached to or growing from the walling, cut back as necessary and dispose of all arising

3. Remove old jointing mortar, do not use angle grinders or other equipment that is likely to damage the stonework. Remove mortar to a depth of a minimum 25mm all around the stonework. Ensure all old cement based mortar is removed. Cart all arising off site.

4. Thoroughly brush through gaps in stonework to remove loose dust and debris, clean all areas and cart all arising off site.

5. Keeping colour of mortar consistent throughout the works the contractor shall re-point walls in lime mortar, allowing the wall to “breath” is essential to the stability and longevity of this wall. The contractor shall view the site and state the mix that they feel most appropriate for this stretch of wall. It is recommended that a pre-mixed lime mortar be used such as that available from “mikewye” in an unhaired 3.5/1 mix with a Argical additive. Sample “biscuits” will be required to provide mix colour to agree with client.

6. Wire brush all walling to complete.

7. Section of wall to be rebuilt. (Red spot on image). Approximately 4m length of wall adjacent to the Lynch gate is suffering from movement. This is thought to be ground / water pressure from behind. Remove coping stones as necessary. Carefully remove stonework to lower levels – generally around 1.3m from coping. Clean off all stonework and set aside. Remove turfs adjacent to wall (approx 300mm) and set aside. Excavate as walling is removed to relieve back pressure. Rebuild wall in lime mortar (as before) and reset coping stones and point all work. Reinstate earth and turfs behind wall.

Tender Costs

SECTION K - Church Yard – Market Street Stone Walling

Each section of the works identified within this tender shall be costed as separate projects. As the client may wish to instigate one or more of the projects at a time. It is understood that each section has mobilisation and preliminary / preamble costs associated with them (road closues etc). Therefore each section as indentified within this document shall be costs as independent projects. Complete the following schedule so that the works can be recognised accordingly.

Preliminaries The contractor shall allow for all necessary site protection, site storage, site safety signage, road closure works, safety barriers, cones and the like. The contractor shall review the Pre-Tender Health & Saftey Plan and account for all required works to comply with legislation.

RepointingComplete repointing works as defined above. Allow for 1m2 cost (this can then be expanded or reduced to suit budget available)

RebuildingAllow to rebuild section of wall. Allow for 1m2 cost (this can then be expanded or reduced to suit budget available)

SECTION L – Church Yard – West Wall

There exists a low level section of wall along the West Elevation of the Church Yard, immediately adjacent to a footpath serving the properties behind. This walling consists of loose laid stonework racked back to retain the earthwork behind.

8. The works will involve the closing of the footpath. The Contractor shall allow for all

necessary precautions and safety measures as required by Law to secure this area from unauthorised access. The contractors proposal shall identify the extent and allowance for all pedestrian management. The accesses into the Church are to remain open unless formally agreed with the employer as part of the project programme.

9. Protect the site and working area. Remove Stonework and stack adjacent. Clean up site and remove vegetation from the working area. Cut a line of turf and stack to one side. Excavate earth behind position of stone wall to provide secure banked surface ready to receive new stonework. The ideal being to create a clean and level graded surface to receive the new stonework. Whilst it is not thought that any footing will exist if they are found they will be the oldest undisturbed section of the wall, some may be mediaeval or older. For this reason, when rebuilding the original footings should always be retained if they are of good quality. However, old footings should be carefully checked and replaced if they are insecure, out of line, tilted or if the stone has decayed. Dispose of all arising.

10.Rebuild stone wall using stonework set aside. Using excavated earth pack out joints where necessary to secure wall in a canted retaining structure. Reduce level of retaining structure wherever possible.

11. Relay turf and provide new turf to cover / protect top edge of stone walling.

SECTION M – Church Yard – East Wall & South Wall

The walling along the east and West boundaries of the Churchyard has been largely obstructed by headstones laid along the length, preventing proper maintenance. The East side of the boundary has a retaining structure as investigation shows the ground level in the adjacent Court Green property substantially lower. Where access to the stone wall is available it is to be re-pointed. The removal of ivy is anticipated where it can be seen to be “free standing” and not interlocked with any structure. The importance of ivy on structure is debatable. Due to the location and context of this particular ivy growth it is appropriate to cut back and manage the growth.

12.The works will require protection from unauthorised access and will require protection throughout the repair process. The Contractor shall allow for all necessary precautions and safety measures as required by Law. The contractors proposal shall identify the extent and allowance for all necessary pedestrian management. The accesses into the Church are to remain open unless formally agreed with the employer as part of the project programme.

The stone wall facing Exeter Street is suffering from movement and localised collapse in pockets along its length. The wall to the right of the main entrance gates (as viewed from Exeter Street) is pre-dominantly in good order. The exclusion of hedging and planting to the top of the wall has retained its structure. A pocket of walling has been replaced and this has been completed in cement mortar.

The dry stone nature of the wall is to be retained in the remaining areas, allowing the wall to naturally drain any water pressure forming behind. The remaining walling – to the left of the entrance gates when viewed from the road is to be refurbished.

Rebuilding shall consist of the careful removal of stonework a section at a time (and at no time to be greater than 2m2 in one place. The soil behind the wall shall be made good as far as practical, cutting back any roots of the hedges above. The stonework shall then be replaced and secured with earth between joints to provide a secure and level surface. Remove all arising from site.

The length of wall facing Barton Street consists of traditional solid stone walling, built as a retaining structure, with cast in-situ concrete coping stones. The walling has been unsympathetically re-pointed in the past in modern cement based materials which have not allowed the wall to “breath” and thus allow a build up of water behind, this has resulted in the blowing of mortar joints and a certain amount of movement within the wall.

A section of the wall opposite the fire station is leaning and is proposed to be rebuilt.

The cast coping stone along the whole length of the wall is failing, allowing water to penetrate and damage the structure of the wall.

17.The works will involve the closing of the public footpath and working within thehighway. The Contractor shall allow for all necessary precautions and safety measures as required by Law to work within the highway. The contractors proposal shall identify the extent and allowance for all necessary traffic management and pedestrian management. The accesses into the Church are to remain open unless formally agreed with the employer as part of the project programme.

23.Section of wall to be rebuilt. Approximately 4m length of wall opposite Fire Satation. This is thought to be ground / water pressure from behind. Remove coping as necessary. Carefully remove stonework to lower levels – generally around 1.6m from coping. Clean off all stonework and set aside. Remove turfs adjacent to wall (approx 300mm) and set aside. Excavate as walling is removed to relieve back pressure. Rebuild wall in lime mortar (as before) and allow to form coping stones and point all work. Reinstate earth and turfs behind wall.

24.Allow to bed new “saddleback” concrete coping stones along the length of the wall filling joints in sand cement mortar (cement). Allow for sufficient overhang and drip. An allowance shall be made for each linear meter run of new coping.
