CONTRACT NO.: ALL CONTRACTOR: ALL The Office of General Services has developed this overview of the filed requirements process for Road Salt, Treated Salt & Emergency Standby Road Salt in order to provide additional guidance to contract authorized users when submitting filed requirements for the upcoming contract year.

General:

The centralized contract for Road Salt, Treated Salt & Emergency Standby Road Salt is a filed requirement participation contract that runs annually from September 1st through August 31st. Under the filed requirements process, contract authorized users provide an estimate of what they believe their need would be for the upcoming Winter season, i.e. upcoming contract year. This represents their filed requirement for the Winter season of that contract year. Filed requirements provide OGS with important information used in the bidding and/or renewal of existing contracts, as they allow OGS to assess the estimated tonnage needed on a county by county basis. Filed Requirements Process:

During the filing process authorized users agree to purchase at least 70% of their filed requirement, while the contractors guarantee to supply the authorized user up to 150% of their filed requirement amount. If an authorized user exceeds their filed requirement in a given year, pricing remains constant up to 120% of the filed amount. Price escalation rates are built into the contract if an authorized user purchases over 120% and 130% respectively of their filed requirement amount. Authorized users have until August 31st to purchase the required 70% minimum of their filed requirement. If the authorized user does not have the necessary storage space to hold any remaining product needed to meet the 70% minimum, the contractor will provide storage at a flat rate per ton from September 1st until December 31st. Price per ton storage fees then begin to accrue monthly beginning January 1st.

Filed Requirements Determination:

Each authorized user should consider the following before submitting filed requirements for the upcoming contract year:

• Whether they’ve met their current 70% minimum obligation for the current contract year, and if not, how much additional road salt must be obtained by August 31st in order to meet this obligation.

• The amount of road salt used in the current contract year.

• The amount of road salt not utilized in the current contract year that will be applied to the upcoming contract year.

• In an AVERAGE Winter, the estimated quantity of Road Salt generally used.

Note: Past purchase history and the record of previous filed requirements will assist in making this determination.

Any non-state agency authorized user that fails to submit filed requirements shall be eligible to be added to the delivery schedule at the Contractor’s option only. If an authorized user fails to submit filed requirements, but later determines it is necessary, they must follow the procedure to request to be added to the contract in accordance with the contract terms and conditions. • The base rate used for calculating adjustments shall be the rate shown in the referenced EIA on the date of the bid opening and adjustments will be permitted monthly. The monthly average will be arrived at by using the Monday prices for a given month as displayed in the EIA Retail On-Highway Diesel Prices and determining an average for that month. The previous month's prices shall be used to determine the monthly average (i.e. – August’s prices will be used to determine September’s adjustment). All prices will be rounded to two decimal places.

• The fuel price adjustment shall be applied for the date of delivery.

Ex.: If a purchase order for salt is received on January 30, and the salt is delivered on February 2, the fuel price adjustment used will be that for the month of February.
