10.33 am Australian Citizenship Ceremony
The meeting departed from the Agenda to undertake Australian Citizenship Ceremony
for Ms Eva Noskovicova.
Mayor Wauchope invited Ms Noskovicova to take the pledge to become an Australian
Citizens and thereafter invited Ms Noskovicova and her guests to join Councillors and
Senior Staff for morning tea.

1. Pursuant to Section 246 of the Local Government Act 1999:
1.1. there being at least two-thirds of the members of Council present; and
1.2. having considered the:
- Permits and Penalties By-law 2015;
- Moveable Signs By-law 2015;
- Roads By-law 2015;
- Local Government Land By-law 2015;
- Dogs By-law 2015; and
- Cats By-law 2015
(together, the By-laws)
(reproduced as Attachments to Item 14.1.3 on the agenda for the meeting
of Council held on 15 December 2015) in light of the National
Competition Policy and the Report prepared on the National Competition
Policy with respect to the By-laws (reproduced as Attachments to Item
14.1.3 on the agenda for the meeting of Council held on 15

1.3. having considered all submissions and recommendations made on the
By-laws,
Council makes the By-Laws in exercise of the powers contained in the
Acts Interpretation Act 1915, Dog and Cat Management Act 1995, Local
Government Act 1999 and Local Government Act 1934.
2. The Chief Executive Officer be authorised to sign the By-laws as made by
Council.
3. The Chief Executive Officer be authorised to publish notice of the making of
the By-laws in the Flinders News.
4. The Chief Executive Officer be authorised to arrange for the By-laws to be
published in the Government Gazette.
5. The report to the Legislative Review Committee on the By-laws (reproduced
as Attachments to Item 14.1.3 on the agenda for the meeting of Council
held on 15 December 2015), be adopted and be signed by the Chief
Executive Officer on Council’s behalf.
6. The Chief Executive Officer be authorised to arrange for the By-laws and all
other necessary documentation to be provided to the Legislative Review
Committee.

[219-2015] That Council accepts the recommendation from the working committee and
appoints Mr Ian G Swan FCA of Compass Group SA Pty Ltd as the
Independent Member on the District Council of Mount Remarkable Audit
Committee, from 15 December 2015 for a period of three (3) years.

14.1.5 Citizen of the Year Awards

[220-2015] That pursuant to the provisions of Section 90(2) of the Local Government Act
1999, that the public with the exception of the Chief Executive Officer, Deputy
Chief Executive Officer and Personal Assistant, be excluded from attendance at
the Meeting, it being necessary and appropriate discuss and consider a matter in
confidence, the matter, pursuant to Section 90(3)(a) being information the
disclosure of which would involve the unreasonable disclosure of information
concerning the personal affairs of any person (living or dead).

[224-2015] That the Council, having considered this matter in confidence pursuant to
section 90(2) and (3)(b) of the Local Government Act 1999 (Act), now
resolves, pursuant to Section 91(7) & (9) of the Act, that all documents relating
to Item 14.1.5 remain confidential until such time as the endorsees have been
contacted and indicated that they are willing to accept the award.

[225-2015] That Council agrees ‘in principle’ to the installation of an easy view roller
shutter and an air conditioner in the Swimming Clubrooms by the Booleroo
Centre Amateur Swimming Club Committee at no cost to Council, and
authorises the Chief Executive Officer to approve the final plans and
installation program.

7. QUESTIONS WITH NOTICE The Local Government (Procedures at Meetings) Regulations 2013 provide the following in respect of Questions on Notice:
Regulation 9 - Questions (1) A member may ask a question on notice by giving the chief executive officer written
notice of the question at least five clear days before the date of the meeting at which the question is to be asked.
(2) If notice of a question is given under sub-regulation (1) - (a) the chief executive officer must ensure that the question is placed on the agenda
for the meeting at which the question is to be asked; and (b) the question and the reply must be entered in the minutes of the relevant meeting.
(6) The presiding member may rule that a question with or without notice not be answered if the presiding member considers that the question is vague, irrelevant, insulting or improper.
LGA Meeting Procedures Handbook for Council Members (December 2013 Edition): When a question is asked at a meeting the normal process is that the presiding member will reply to the question. This procedure enables Councillors to obtain information that is relevant to their role as a member of the governing body and the function of that body. The question should relate to functional, strategic or policy issues of the Council. Questions of an operational nature are the domain of the CEO and should be directed to the CEO outside of a meeting and during business hours. (page 23).

9. PETITIONS
The Local Government (Procedures at Meetings) Regulations 2013 (the Regulations) relevantly provides the following in respect of Petitions:
Regulation 10 – Petitions (1) A petition to the council must –
(a) be legibly written or typed or printed; and (b) clearly set out the request or submission of the petitioners; and (c) include the name and address of each person who signed or endorsed the petition;
and (d) be addressed to the council and delivered to the principal office of the council. (my bold)
(2) If a petition is received under subregulation (1), the chief executive officer must ensure
that the petition or, if the council has so determined as a policy of the council, a statement as to the nature of the request or submission and the number of signatures or the number of persons endorsing the petition, is placed on the agenda for the next ordinary meeting of the council or, if so provided by a policy of the council, a committee of the council.

10. DEPUTATIONS
The Local Government (Procedures at Meetings) Regulations 2013 provide the following in respect of Deputations:
Regulation 11 - Deputations (1) A person or persons wishing to appear as a deputation at a meeting must deliver (to
the principal office of the council) a written request to the council. (2) The chief executive officer must transmit a request received under subregulation (1) to
the presiding member. (3) The presiding member may refuse to allow the deputation to appear at a meeting. (4) The chief executive officer must take reasonable steps to ensure that the person or
persons who requested a deputation are informed of the outcome of the request. (5) If the presiding member refuses to allow a deputation to appear at a meeting, the
presiding member must report the decision to the next meeting of the council or council committee (as the case may be).
(6) The council or council committee may resolve to allow a deputation to appear despite a contrary ruling by the presiding member.
(7) A council may refer the hearing of a deputation to a council committee.

11. MOTIONS ON NOTICE
The Local Government (Procedures at Meetings) Regulations 2013 provide the following in respect of Notices of Motion:
Regulation 12 - Motions (1) A member may bring forward any business in the form of a written notice of motion. (2) The notice of motion must be given to the chief executive officer at least 5 clear days
before the date of the meeting at which the motion is to be moved. (3) A motion the effect of which, if carried, would be to revoke or amend a resolution
passed since the last periodic election of the Council must be brought by written notice of motion.
(4) If a motion under sub-regulation (3) is lost, a motion to the same effect cannot be brought - (a) until after the expiration of 12 months; or (b) until after the next periodic election, whichever is the sooner.

04.12.15 Attended the Port Germein Progress Association Christmas celebration. 10.12.15 Radio interview with Sarah Tomlinson ABC radio 8.35 am. Re the roads in
our council area. 15.12.15 Monthly Council Meeting. It was a pleasure to officiate the Citizenship Ceremony for Eva Noskovicova
who was greatly supported by many friends and residents of Weeroona Island and Port Germein, a morning tea was shared by all.

14.1.2 GENERAL REPORT Update: Wirrabara Forest – Expression of Interest Council is awaiting further advice/announcement on the results of the EOI. The Chief Executive Officer will give a verbal update at the meeting should further information be received prior to the meeting. Update: Baroota Reservoir Council is awaiting further advice/announcement on the results of its proposal. The Chief Executive Officer will give a verbal update at the meeting should further information be received prior to the meeting. By-laws 2015 Council is advised that the six (6) By-laws adopted at the December 2015 Meeting were gazetted on Thursday 7 Janaury 2016 and a notice published in the Flinders News on Wednesday 13 Januray 2016. Required originals and copies of the By-laws and associated documents have been forwarded to the Legislative Review Committee have been actioned. The By-laws will come into effect on the 7 May 2016 (being 4 months from the date of gazettal), provided that the Legislative Review Committee raises no objection to the By-laws in their current form.

Subject: Weeroona Causeway - Affix Common Seal Report By: Chief Executive Officer Report Date: 05/01/2016 File Reference: DCMR0233 Action: Yes Attachments: Yes
Council previously sought approval from the Native Vegetation Council to clear 0.4 hectares of native vegetation for future construction works to the Weeroona Island Causeway to counteract seawater damage. In accordance with Regulation 5(1)d – Clearance of native vegetation for infrastructure Council is required to complete the “Understanding of Regulation Advice” sign and affix the Common Seal to confirm with the Native Vegetation Management Unit that Council fully understands the Advice and Conditions detailed in the letter.
Recommendation:
That Council authorises the Mayor and Chief Executive Officer to sign and affix the
Common Seal to the Native Vegetation Council Understanding of Regulation Advice.

14.1 CHIEF EXECUTIVE OFFICER'S REPORT (CONT.): 14.1.4 YORK ROAD – WEEROONA ISLAND
Subject: Public Consultation - Speed Limit Change Report By: Chief Executive Officer Report Date: 12/01/2016 File Reference: DCMR0255 Action: Yes Attachments: No Council received correspondence from the Hon. Minister for Road Safety in response to a request from a resident of Weeroona Island to lower the speed limit on York Road. The Minister requested that Council conduct an investigation of the current speed limit on Weeroona Island and forward the results once concluded. Yorke Road is a small, narrow, unsealed ‘no through’ road that runs behind the shacks on the southern side of Weeroona Island. Council engaged Mace Engineering Services Pty Ltd to conduct an independent review of the Weeroona Island speed limits. It was suggested that Council could give consideration to York Road being classified as a Shared Zone (pedestrians and vehicles) with a 10 km/h speed limit. It was also suggested to install ‘no through road’ signs at the intersection of Casuarina and York Road to warn vehicles. Before consideration of any submission for speed limit changes by the SA Police & DPTI, Council is required to guage community sentiments from the residents affected. Council sought comments/opinions on the possible introduction of a Shared Zone/10km speed limit via individual letters to ratepayers on York Road on 21 October 2015 closing on 6 November 2015. Of the sixteen (16) residents and three (3) government organisations sent letters, five (5) responses were received at the time of closing, 3 for the Shared Zone and and 2 against. A further followup telephone call to those residents who did not respond resulted in a further four (4) responses. In summary:
• 16 letters to residents • 9 responses (5 mail, 4 telephone)
o 4 responses for a Shared Zone o 2 responses against a Shared Zone o 3 responses stating ‘they were not bothered either way’.
Before responding to the Hon. Minister, Council will need to consider if they wish to reduce the speed limit on York Road Weeroona Island to 10km/hour in a Shared Zone, or leave it at the current 30km/h limit that applies to the entire Weeroona Island.

The opportunity is for Council to work with Bike SA and Tourism to showcase the very best of the region, providing a memorable cycling experience and encouraging participants to spread the word and make return, independent visits. Council is invited to partner with Bike SA to host the 2016 Annual Tour, develop the itinerary and programme, initiate links with local business and media and engage the community. Council will need to consider the attached correspondence and advise if if wishes to partner Bike SA and fund the cost to host some of the 2016 Annual Tour.

Bike SA Bike SA is an independent not-for-profit membership association, since 1982 the state’s peak body for recreation and commuter cycling. Run by experienced staff with the support of dedicated volunteers, Bike SA delivers a programme of cycling activities throughout South Australia. Over 70,000 cyclists have ridden with Bike SA this year, injecting hundreds of thousands of dollars directly into metropolitan and regional communities. Our mission is more South Australians cycling in safer, healthier communities.
The event Bike SA’s Annual Tour is a boutique 9-day adventure on two wheels, traversing different South

Each day we ride to different locations, set up camp and explore the town
Typically we ride 60km to 80km on bitumen, occasionally offering B-routes on unsealed roads
The itinerary includes a rest day plus daily extracurricular activities and excursions
Typically we base ourselves at a sports ground, where participants overnight in tents. For many we erect Deluxe Camping for them. Others will buy into hotel/motel accommodation in town
We engage the local community and businesses to provide services, such as catering, accommodation and tourism activities
In recent years, Bike SA has run sold out tours in – o Barossa, Clare, Adelaide Hills and McLaren Vale o Kangaroo Island o Coorong & Fleurieu o Flinders Ranges o Murraylands & Riverland
For 2016 the plan is to tour the Southern Flinders Ranges and Mid North; to journey through spectacular landscapes and indulge in regional food and wine

Capped at 200 riders, the Annual Tour attracts a high percentage of repeat participants from all over Australia

Participant age ranges 18 to 88 years; average age is 55 years

The group is made up of individuals, couples, families and friends
We cap the number at 200 (plus 30-40 support personnel), as this is a manageable size for most regional communities and tourism businesses
The opportunity The opportunity is for Council to work with Bike SA and Tourism to showcase the very best of the region, providing a memorable cycling experience and encouraging participants to spread the word and make return, independent visits. The greatest benefits come from all stakeholders working to a common purpose, delivering unique experiences to visitors who may never before have been to this part of the world. Bike SA’s Annual Tour participants want to –
Ride through beautiful countryside, traversing changing landscapes
Eat lots of local produce, from buns at the bakery to lamb roast on the BBQ
Drink regional wines and micro-brews
Delve into local indigenous and colonial history
Hang out with the locals and maybe even ride with them
Experience special tourist attractions, from scenic flights and river cruises to cave tours and interpretive walks
These are the special elements that make each region stand out; they are the essence of the stories our riders take back home with them and share with friends and family.

The proposal Council is invited to partner with Bike SA to host the 2016 Annual Tour, develop the itinerary and programme, initiate links with local business and media and engage the community. Exactly what route we follow and where we stay depends in part on your interest and the level of your support.
The benefits Tourism figures show that visitors on bikes at the premium end of the market spend over $500
per day
Bike SA anticipates that the 2016 Annual Tour will inject almost $280,000 directly into the regional economy, not factoring in any additional multiplier benefits
In 2015 Bike SA invested $120,000 directly into the regional economy with the purchase of catering, accommodation and other services
Additionally this year, participants spent almost $160,000 extra in local businesses, paying for supplementary food, drink and accommodation (much of it on cellar door take-aways)
Bike SA also generates positive media coverage, typically through radio and press; for example http://www.northernargus.com.au/story/3406759/cycle-tourism-a-money-spinner/
Council will be recognised with logos in the event collateral, promotions and media releases
Council will also be recognised in digital and social media campaigns, including those targeting the interstate audience
The investment A modest hosting fee from Council ensures the community receives the greatest benefits.
$1,900 plus GST is proposed for each overnight stay, with lesser amounts negotiated for locations where significant time is spent but not an overnight stay
Additional in-kind support is requested where possible, such as access to sports ovals and clubrooms as overnight accommodation. Other sites can be used, such as schools or winery grounds; we can be creative
Providing limited time for a Council contact to work with Bike SA and regional tourism to develop the most advantageous itinerary; facilitating local business and community engagement
There is the additional option for Council to host a welcome pre-dinner drinks function for participants during the Annual Tour
As important is Council’s commitment to support cycle tourism as a dynamic niche market. The time and energy that Council commits to the 2016 Annual Tour ultimately will be reflected in the community benefit
The next steps Bike SA is available to discuss options with Council. Meetings can be arranged in Adelaide or in the Mid-North or SFR regions, as appropriate
1. End January – Council is invited to submit an expression of interest to host the Annual Tour, proposing the preferred number of overnight stays and key locations
2. End February – Commitment required to providing commensurate hosting fee and any in-kind support
3. March 2016 – Bike SA finalises route and overnight itinerary 4. This will be followed by at least one additional Bike SA reconnaissance trip, during which
Bike SA’s Events Manager will meet with Council representatives, as well as local business and community leaders
5. 24 September to 2 October – Bike SA runs the 2016 Annual Tour

Subject: Wilmington and Melrose Retransmission of Digital Television Report By: Deputy Chief Executive Officer Report Date: 13/01/2016 File Reference: DCMR0232 Action: Yes Attachments: No At the Ordinary Meeting of Council held 15 December 2015 Council agreed to go to public consultation to gauge support for Digital Video Broadcast Retransmission with Wilmington and Melrose residents. 473 ratepayers of Wilmington and Melrose received a letter providing information and reasoning behind the decision to go to public consultation along with a survey form attached. The Public Consultation concluded on Monday 11 January 2016. The survey results were:
• 473 Letters sent • 277 Non Responses (58.6%) • 196 responses were received (41%) •
On the first question of whether they wanted the introduction of Retransmission of Digital Television:
o 93 responses were ‘Yes’ for digital retransmission (19.7% ) o 103 responses were ‘No’ for digital retransmission (21.8%)
On the second question of the willingness to pay a $500 special levy for the service:
o 137 said ‘No’ (28.9%) o 57 said ‘Yes’ (12%) o 2 did not respond
Council need to consider the results of the survey for the introduction of Retransmission of Digital Television services being neither an ‘absolute’ majority nor an ‘overwhelming’ majority (and in fact being a minority), and decide if it wishes to continue with the project.

There is a leak in the control box and quite a few of the adjustable emitters are missing which means the water sprays in all directions and not on the plants. It would be a pity for the plants to die through lack of water when the garden is looking so good and it's a waste of water. Please can someone attend to this? I would appreciate a quick phonecall 0427 675 062 when the job is underway as I look after the garden there and want to know what the automatic watering schedule is set to so I can keep an eye on things and make sure it's all working ok. The water in one of the ladies toilets is continuously flowing out and when you go to flush there is no water left in the system to get rid of any waste. Re: Nominations to the Board of Regional Development Australia Yorke and Mid North
With the appointment by the Commonwealth, State and Local Government of our new Chair and Deputy Chair Mr Bill Vandepeer and Mr Brenton Vanstone are keen to ask for nominations of local government members who are passionate and have skills which will help the strategic development of the economy of Yorke and Mid North.
By convention we have four local government nominations to the Board who are then appointed as full Board Members by the Commonwealth Minister for Regional Development (currently the Hon Deputy Prime Minister Warren Truss MP) under the Associations Incorporation Act 1985. We have greatly valued the contribution of Mayor Paul Thomas, Dr Andrew Johnson, Cr John Rich and Ms Judy Partington; and a number of our members have expressed the desire to re-nominate which will assist in the transition to a new leadership and board team. Ms Judy Partington, who was a local government nomination is no longer entitled to hold this position and has resigned from the Board. Under the term of appointment our local government nominations will be up for re-appointment as of the 20 February 2016 and a further nomination of two (2) years is proposed.
This convention, and the method of appointment is that which has been approved by Central Local Government Region in the previous two calls for local government nominations.
Any Mayor, Deputy Mayor, Councillor or CEO is encouraged to apply and as a matter of convention there is normally only one nomination from each council. The nominees are then voted on by electronic return by the Mayors of each of our eleven local government partners and any dispute is arbitrated by those councils under the guidance of the Central Local Government Region Chief Executive Officer.
Our new Chair and Deputy Chair are looking to rejuvenate and bring new ideas to the table to drive the Strategic Direction and Operational Output of the RDAYMN Board. This is an opportunity for individuals to be involved in a Board that is uniquely currently funded by Commonwealth, State and Local Government in partnership. We also see this as a critical period for the Board to work towards assisting Central Local Government Region to implement the recommendations of its review and to drive good Regional Outcomes through embracing change.
The new Chair, and the current Board have undertaken a comprehensive skills audit to identify the needs of the organisation and our primary motivation is to build a board which has excellent business and economic development knowledge coupled with the following attributes:

Each board members is entitled to a re-imbursement of travel expenses and a small stipend of $120 per meeting to cover expenses for those Board Members who chose to claim.
To ensure that it is a process which is independent from the RDAYMN board the returning officer is the Chief Executive Officer of the Central Local Government Region- Mr David Stevenson and if all nominations could be sent to him by email on [email protected] by COB Tuesday 2nd February 2016.
