    I. INTRODUCTION

    1. TheTrialChamberhasscheduledapre-trial StatusConferencetobeheldon14February 2013 at 14:30.1 The Chamber has ordered for the defence to submit

    observationsonthefollowing,2bynolaterthan6February2013:

    (i) whethertheconditionslistedinthesummonstoappearissuedbythePre-TrialChamberaresufficientandadequateforthepurposesofthetrial;

    and

    (ii) whetherthereareanypractical,financialand/orlegalmatterstobedealt

    with for the accused to be able to attend trial at the seat of theCourt,

    includingthemodalitiesoftheAccusedsstayontheterritoryoftheHost

    Stateduringthetrial.3

    2. TheChamberalsostatedthatthedefencemaysubmitanyotherurgentissuethatrequirestheimmediateattentionoftheChamber.4

    3. Inresponse,thedefenceforMrJoshuaArapSang(thedefence)makethebelowobservationsandsubmissions.

    II.OBSERVATIONSONSUMMONSANDHOSTSTATECONSIDERATIONS

    4. Mr Sang has no comments on the conditions listed in the summons to appearissued by the Pre-Trial Chamber as they currently obtain. He will continue to

    complywiththeconditionstherein.

    5. Therearehoweverafewissues,whichthedefencewouldliketoraisesonbehalfofMrSangwithrespecttopracticalandfinancialmattersrelevanttohisattendance

    attrial,andthemodalitiesofhisstayontheterritoryoftheHostStateduringtrial.

    6. TheCourtwouldbeawarethatMrSang isonLegalAid.Furthermore, theCourtshouldalsobeawarethattheLegalAidbudget,includingthesalariesofcounsel,

    legalassistantandcasemanagers,hasbeendrasticallyreducedbyapproximatelya

    thirdsinceJune2012.Additionally,theCounselSupportSectionhasmadeitclear

    thatthecostsoftravelingtoandfromTheHague(wherethetrialistotakeplace)

    andNairobi(wheretheclientisbasedandwhereinvestigationsareongoing)will

    onlybecoveredforCounselandAssociateCounsel.

    7. Given this substantial reduction in the defence budget and the income of teammembers,someofwhomhavebeenforcedtobuytheirownairticketstoNairobi,

    thetheatreoftheallegedcrimes,andwhereclientandmostoftheteammembers

    arebased,thisissuewilllikelyprovedetrimentaltotheeffectivenessofMrSangs

    defenceteam.ThedefencewillcontinueengagetheCSSonthematterandhopesto

    arriveatasuitablearrangement.ThedefencehoweverwouldliketheChamberto

    beawareofthepotentialimpactthatthesebudgetcuts,andCSSsrestrictionson

    howteamfundsareused,couldhaveonthefairtrialrightsoftheaccusedinthe

    future.

    8. Furthermore,withrespecttoMrSangwhoisonLegalAid,andoutofcustody,thedefencesubmitsthattheCourthasanobligationtocoveralllegitimateexpenses

    associated with his court attendances, in particular, round-trip travel fares for

    courtsessions,accommodationandbasiclivingexpensesinTheHaguewhilethe

    trialis insession.In thepast,MrSanghascoveredtheseexpenseshimself,with

    assurancesfromtheImmediateOfficeoftheRegistrythatallreasonableexpenses

    wouldbereimbursed.However,todate,hehasnotbeenrefundedtheexpenseshe

    incurred in relation to his attendance at the June 2012 Status Conference. The

    ImmediateOfficeoftheRegistryhasnotgiventhedefenceanyexplanationforthis

    delay. Lastweek, the defencewrote to the Immediate Office of the Registry to

    inquireastowhetheramoresuitableandlong-termarrangementcouldbeputin

    placeandstillawaitstheRegistrysproposal.

    9. Additionally,MrSang,throughtheTrialChamber,wouldliketheRegistrytoliaisewith the Host State to modify his usual Visa conditions, which restrict his

    movementswithinTheNetherlandstoTheHaguearea.Thedefencesubmitsthat

    whenthetrialisinsession,andMrSangisexpectedtoremaininthecountryforan

    extended period of time, this restriction on his movement would be unduly

    burdensome.Therefore,thedefencerequeststheRegistrytoarrangeforMrSang

    to be able to travel freely within a 60km radius of TheHague, and that he be

    allowedtotravelelsewhereinTheNetherlandsuponnotificationtotheHostState.

    These proposed conditions, the defence submits, strike a balance between any

    securityconcernstheHostStatemighthaveandMrSangsinterests.

    III.OTHERURGENTISSUESREQUIRINGTHEATTENTIONOFTHECHAMBER

    10.

    Thedefencehasidentified severalother issues,which in itssubmission, requireresolutionbytheChamberpriortothestartoftrial.

    11. TheChamberwillbeawareofaconfidentialnotificationfiledbythedefencetoday.ThedefencewishestomakeitselfavailabletotheChamberduringaclosedsession

    todealwithanyissuesarisingfromthatnotification,ifnecessary.

    12.

    ThedefencealsoalertstheChambertotwounresolvedissuesthatithasraisedonaninter-partesbasiswiththeprosecution.Theseissuesrelateto:

    (i) the impact of the withdrawal of prosecution witnesses on theprosecutionsPre-TrialBrief;and

    (ii) theprosecutionsinsistenceonalleginginitsPre-TrialBriefthatMrSangwas present at a 30 December 2006 planning meeting of theNetwork,

    whenthePre-TrialChamberdidnotconfirmthatMrSangwaspresentat

    thatmeeting.

    Ifcontinuingdiscussionswiththeprosecutioninrelationtotheseissuesarenot

    fruitful, then the defencewill have tomake formal filings for resolution by the

    Chamber.

    13. Additionally, the defence is concerned about the volume of evidence that theprosecutionintendstolead,whichfarpre-datesthetemporalscopeofthecharges.

    Forinstance,basedonthesummariesofanticipatedvivavoceevidenceprovided

    by the prosecution, it is clear that they intend to call no less than fourteen

    witnesses who will testify about the 2005 referendum period, including the

    conduct of the accused during that period. This significantly broadens the

    background of the allegations against the accused and places an onerous

    investigativeburden on the defencevery close tothe startof trial. The defence

    intends toask theChamberto restrictthe introductionofthisevidence into the

    record.

    14. Furthermore, the defence intends to seek an order to the effect that once theprosecutionhasdisclosedtheidentityofawitnesstothedefence,theprosecution

    must disclose all information pertaining to assistance provided to thatwitness,

    including protective measures, from either the prosecution or the VWU. The

    defencesubmitsthatsuchassistancemayhaveabearingonthecredibilityofsuch

    witnesses,andthusisdisclosableaspotentiallyexculpatorymaterial.

    15. ThedefencewillalsobeaskingtheChambertoordertheprosecutiontogivetherunning order of its first five witnesses. Given the piecemeal nature of the

    disclosuresmadebytheprosecution,thedefencewillneedtoprioritizeitsefforts

    onthefirstfewwitnessesthattheprosecutionintendstocall.

    16. Lastly,forlogisticalandplanningpurposes,thedefencewouldlikeanindicationfromtheChamberastohowitintendstoalternatebetweenhearingtheKenya1

    andKenya2cases.
