WTS.02.1 WORKS PROGRAM - INFRASTRUCTURE SERVICES

PURPOSE

The purpose of the report is to provide an update on works undertaken over the previous month and those planned for the upcoming month.

RECOMMENDATION

That the Committee receive the report and note the information.

BACKGROUND

The report includes information on Infrastructure Services works including roads, bridges, and parks. The report provides information for Councillors and staff to address ratepayer enquiries regarding construction and maintenance works.

REPORT/PROPOSAL

Some of the major projects currently under construction are:

Moonan Cutting; excavation works on hill side is almost complete works have been delayed due to plant breakdown.

Gundy Road pavement rehabilitation near Scone is complete. Reseal program is complete Willow Tree Road works commenced and delayed due to wet weather Kingdon Street drainage and Main street Kerb and Gutter has commenced.

Works priority has been given to capital works requiring completion. OPTIONS

The report addresses the following objectives as described in the 2015/16 DPOP. Roads and Bridges – Local & Regional To undertake roads and bridge maintenance and construction works to Council’s standards and specifications so as to improve road safety and minimize future expenses.

Implementation of asset management plans. IMPLICATIONS a. Policy and Procedural Implications

Road maintenance guidelines as identified within Asset Plans and Strategic Plans. These guidelines include grading and service frequency based on a variety of factors including vehicle movements, road utilisation etc.

Road and asset inspections are undertaken to mitigate and minimise Council’s risk exposure in these areas.

PURPOSE The purpose of the report is to provide an update on works undertaken over the previous month and those planned for the upcoming month.

RECOMMENDATION That the Committee receive the report and note the information.

BACKGROUND The report provides information for Councillors and staff to address ratepayer enquiries regarding construction, maintenance and other activities in the area of Water & Sewer. REPORT/PROPOSAL Progress of major projects is listed in Attachment 1 along with planned works. The projects currently underway include:

Replacement of old water meters in Aberdeen, Scone, and Murrurundi Trimming and junction sealing of junctions will commence and is expected to end late

March 2016. Hill St, Scone - Replacement of 100mm dia. with 150mm M-PVC main. Scone to Murrurundi Pipeline – At the time of writing this report, it was expected that

Council would receive the concept design from NSW Public Works on 29/01/2016. OPTIONS Nil. CONSULTATION

WTS.02.3 CAPITAL WORKS UPDATE

PURPOSE The purpose of this report is to provide an update on capital works projects within the current budgetary period.

RECOMMENDATION That the Committee receive the report and note the information.

BACKGROUND In association with the 2015/16 Delivery Program and Operational Plan, a schedule of the planned capital works has been prepared. Budget holders have been asked to identify when the project is planned to be delivered. REPORT/PROPOSAL The spreadsheet provided under separate cover shows the expenditure up to the end of January 2016, 58% through the 2015/16 financial year. It shows that YTD actual spend is 92% behind the YTD budget. There are a number of issues to consider relating to the capital works under expenditure:-

At the time of writing this report there were still 2 weeks wages and plant to be added to the general ledger capital costings.

The administration area is showing a $214k variance underspend YTD. Several large plant have recently been ordered and this expenditure will show up on future capital reports and correct the underspend.

Scone waste depot works procurement is being finalized and will be completed by the end of February. Murrurundi transfer station project is awaiting the result of a grant application.

Sewer relining projects scope has been expanded and therefore the cost for 2015/16. At the time of writing this report there is no major January contractor payments in the

system. Key projects being worked on in the coming month are:

Finalising Stage 1 of Moonan Cutting Willow Tree Rd initial seal Sewer relining at various locations being completed for 2015/16 Gundy Road Rehabilitation Starrs Crossing Bridge approach

Fire Services To protect life, property and the environment from the effects of bushfire disasters within the UHSC area.

Stormwater

To provide Stormwater drainage systems to manage flows c. Other Plans

Many projects are identified within Community Plans, Emergency Plans or specific operational plans ie Standards of Fire Cover for Rural Fire Service infrastructure. Council’s Asset Management Plans are also reference documents for the development of the capital works program.

IMPLICATIONS a. Policy and Procedural Implications

Some projects involve grant funds, community donations or use of other funding sources such as R2R funds and s94 contributions. Expenditure of these funds is in accordance with relevant policies and legislative requirements.

b. Financial Implications

All works have been budgeted for in accordance with the Delivery Program and Operational Plan (DPOP) 2015/16.

c. Legislative Implications

PURPOSE The purpose of this report is to provide additional information about the current status of Mountain View Road to Council.

RECOMMENDATION That Council:

1. Acquire the land over the formed road on Mountain View Road from chainage 0 to 1.6km.

2. Council continue to maintain the formed road in accordance with Councils Policies and Procedures from chainage 0 to 1.6km

3. Not accept responsibility for the Right Of Carriageway from chainage 1.6km to 4km and the track in use remain as a Right Of Carriageway and the lots benefiting shall be responsible for the construction, repair and maintenance of the carriageway.

BACKGROUND Council has received a number of enquiries about the status of Mountain View Road and the Right Of Carriageway (ROC) over the existing track. The enquiries are in relation to the ownership of the road, who has access to the road and who is responsible for the ongoing maintenance of the road. This matter was brought to the Works and Technical Services Committee in November 2015 and three land owners spoke to the meeting. Two owners have since sent their questions into Council and reply letter have been sent out. (see attached letters and replies). Mountain View Road is located off Timor Crawney Road at Timor and includes 1.6km of public road and 2.6km of privately owned right of carriageway, a total of 4.2km. Council (both former Murrurundi Council and UHSC) had maintained the entire 4.2km access for many years. The built road is generally not on the road reserve, refer attached Map 1. However, in 1995 Council approved a subdivision (DP863264) which created 4 additional lots. The subdivision also created rights of carriageway over the existing track. The Condition of Consent 3 sets out that the maintenance of the roads to service the proposed lots is the responsibility of the developer (owner). The access to the lots for the proposed subdivision on DP 863264 (chainage 2.6km to 4.2km) is a private right of carriageway and not a public road. The public road which Council is currently maintaining is generally not within the road reserve as the road reserve is over rough terrain and currently does not have a road construction on it, refer attached Map 1.

REPORT/PROPOSAL In November 1994 an application for a 5 lot subdivision of Portion 209, Parish of Crawney was received by Murrurundi Shire Council. Development Consent No.25/1994 was approved by Council on 1 March 1995 for the subdivision. This subdivision resulted in the creation of Lots 1, 2, 3 and 4 DP 863264. DP 863264 was registered on 14 November 1996, and created Lots 1, 2 3 and 4. Two rights of carriageway were created by Section 88B instrument registered with DP 863264. One ROC was created over a track in use, and benefitted each lot and burdened each other lot, and the second ROC was to create a new section where there was no existing track, burdening lot 3 and benefitting the other lots. The terms of the ROCs were the statutory short form in Schedule 8 of the Conveyancing Act 1999unamended. A right of carriageway is created under the Conveyancing Act 1919 and has the following definition. The right of carriageway as defined in part 1 of schedule 8 of the conveyancing Act 1919, provided that: Construction, Repair and Maintenance 1.1 the register proprietor of the lot benefited shall be responsible for the construction, repair and maintenance of the carriageway. Therefore, once the track was changed to a right of carriageway by the applicant of the development the construction, repair and maintenance of the right of carriageway become the responsibility of the registered proprietor of the lots benefiting from the right of carriageway. In this case that is the owners of Lot 1, 2, 3 and 4 DP 863264. Development consent was granted to DA 296/06 on 25 June 2007 to a 3 lot subdivision of Lot 4 DP 863264, to create proposed lots 101, 102 and 103. The approved plan showed a right of carriageway to be created over lot 102 in favour of lot 101 and lot 103. However this subdivision was never registered. DP 1103566 was registered on 16 October 2006, and was a plan of a right of carriageway over lot 2 DP 590486. The Section 88B instrument registered with DP 1103566 created a right of carriageway as shown on the plan over Lot 2 DP 590486 in favour of Lot 4 DP 863264. The terms of this ROC expressly provide that that owner of Lot 4 DP 863264 is required to construct repair and maintain the carriageway. However this new ROC over Lot 2 DP 590486 benefitting Lot 4 DP 863264 is a different physical carriageway at some distance from the ROCs created in 1996 by DP 863264. The two ROCS do not connect. The property owners provided a letter from Sid Moore, a former Mayor of Murrurundi Shire Council, about this maintenance of the ROW created in 1996, however Council has no records of any enforceable agreement stating that Council would maintain the ROC. It is clear from that DP and accompanying Section 88B instrument that the access track in question comprises rights of carriageway and not a public road. If there was some agreement in the 1930s between owners at that time and the then Council for the Council to open the track as a public road, instead of constructing the nearby “paper” road which was not traversable, that has long since ceased to be enforceable, and it was clearly not done. The much more recent registration of DP 863264 in 1996 and of DP 11103566 in 2006 and accompanying s.88B instruments is clear evidence that a public road was not agreed to by the Council as at those dates, at either location, and this was also the position in respect of the proposed subdivision of Lot 4 DP 863264 in 1996.

The right of carriageway from chainage 1.6km to 4km remain as a right of carriageway and the lots benefiting shall be responsible for the construction, repair and maintenance of the carriageway.

2. The property owner’s upgrade the right of carriageway to Councils minimum standard and Council acquire the land over the public road for 1.6km and right of carriageway 2.6km and maintains the entire length in accordance with its policies and procedures.

3. Council take no action on this matter and continue to maintain the public road outside of the road reserve.

PUBLIC ACCESS

Mr Graham Ware and Mr Eric Fernihough both had public access to attend the meeting and address the chair with their views on this issue.

Mr Ware said his main point was that the advice that he received from his solicitor via the then Murrurundi Council prior to the purchase of his property was that Council agreed to maintain Mountain View Road right of carriageway. Mr Fernihough also maintains that prior to his purchase there was verbal confirmation from Murrurundi Council that Council would maintain the road.

It was put to Mr Ware and Mr Fernihough by Chairman Cr Campbell, did they agree that they knew the road was a right of carriageway at the time of purchase? They both agreed that they did. The responsibility of maintenance of a right of carriageway rests with the registered proprietor of the lots benefiting from the right of carriageway.

Councillor Campbell asked Mr Ware and Mr Fernihough would they be prepared to engage Council, or any other works contractor, in private works for annual road maintenance. The response was by Mr Ware, ‘in theory, yes,’.

Both residents were advised that the recommendation put the Committee would be carried, and that if they would like further recourse, they can make application to address the next Council meeting on 22/2/016 at 5.00pm, and the application must be booked by midday the day of the meeting.

PURPOSE The purpose of this report is to advise Council of additional funding allocations of $2.729 million under the Roads to Recovery program (R2R) and to gain approval of the works listed in Attachment 1 for inclusion in the 2016/17 – 2019/20 Delivery Program and Operational Plan.

RECOMMENDATION That Council :

1. Adopt the proposed Roads to Recovery program listed in attachment 1 for inclusion in the 2016/17 – 2019/20 Delivery program and Operational Plan.

BACKGROUND The Roads to Recovery program provides funding for roads in rural, regional and metropolitan areas. The funds are provided in the form of grants directly to local government bodies for expenditure on roads. The focus of the program is the renewal of local roads as an essential element of Australia’s social and economic infrastructure. In addition to the Government’s commitment to maintain Roads to Recovery funding at current levels of $350 million per annum, a further $650 million has been provided in 2015/16 and $805 million in 2016/17 which means Council will receive the equivalent of four extra years of R2R funding over the life of the current five year program. REPORT/PROPOSAL Total funding for the revised program is $3.2 billion over the five years to 2018/19. Allocations to each Council have been determined on the basis of the 2014/15 recommendations of the Local Government Grants Commission for the roads component of the Federal Assistance Grants. This methodology is consistent with the allocation of Roads to Recovery funding for previous programs. Council’s revised life of program allocations for the period 1 July 2014 to 30 June 2019 are as follows.

The program will continue to run under simple administrative arrangements with Council free to decide the projects to be funded under the program. The key conditions attaching to the grants are that:

The program’s focus is on the construction, upgrading and maintenance of the road network servicing farms and properties.

Councils must maintain the level of roads expenditure which it funds other than under the Roads to Recovery program.

Councils are expected to maintain an appropriate funding balance between the outlying rural roads and roads in urban areas.

Signs acknowledging the Commonwealth’s contribution must be displayed at each work site and be maintained for a period of two years.

It is proposed that Council’s annual share of the overall Roads to Recovery grant be generally expended as per Attachment 1. Additions to the current program are outlined below: $68,595 allocated to MR 105 - Gundy Road Rehabilitation (17km -18km) to extend the limit

of works to include road widening and formation works associated with the Regional Roads Repair Program funding 2015/16

$188,000 allocated to match funding to be received under the Regional Roads Repair Program for 2016/17

$300,000 allocated to Moonan Cutting for rock removal in 2015/16 $600,000 allocated to MR62 – Owens Gap realignment increasing the total to $810,000 in

2016/17 to accelerate the proposed works $255,000 allocated to MR 358 (Merriwa/Willow Tree Rd) for pavement rehabilitation and

reseal in 2016/17 $700,000 allocated to Hunter Road (S bends) realignment and bitumen seal (Omadale

Brook) $250,000 allocated to Adelaide St Murrurundi - Stormwater improvements 2016/17 $350,000 allocated to Timor Road – realignment and pavement upgrade at Whaylons Gap $200,000 allocated to Oxford Street – Scone – Stormwater and K&G replacement 201718 OPTIONS 1. All projects listed provide for high usage access to community centres, popular focal points and the Arterial Road network. IMPLICATIONS a. Policy and Procedural Implications Council’s overarching asset management strategy requires that Council follows best practice including the development of a road register and hierarchical clarification to assist in network development. b. Financial Implications The Roads to Recovery Program is fully funded and will have no adverse effect on Council’s financial position. The additional funds for 2015/16 and 2016/17 will have a positive impact to the value of $2.729 million. It will also improve Council’s Asset Renewal Ratio over this period which is a key internal financial indicator. c. Legislative Implications Not applicable. d. Risk Implications Council’s Road Asset Management Plan sets out Council and community expectations in regard to service levels and risk inspections. Higher road hierarchy classification requires more regular risk inspections to satisfy Council’s own policies and procedures. The upgrade and renewal of Council infrastructure through the Roads to Recovery program will reduce Councils risk exposure.
