Industrial Deductions cover capital expenditure incurred by a person on the construction of an industrial building to be used in a business carried out by them or their lessee. This allowance is claimed by the person who incurred the capital expenditure i.e. the owner of the building and the building must be used for the purpose of the business only so as to enjoy the industrial building deduction.

1. Duty Exemption

The Government, upon application, exempts import duty on the following items and equipment for hotel construction or refurbishment; Customs duty exception is provided for under the East African Community Customs Management Act, 2004, Fifth Schedule, Part B, Item 21 for the following items:-

GUARANTEE AGAINST EXPROPRIATIONThe Constitution of Kenya provides guarantee against expropriation of private property, which may occur for reasons of security or public interest. In such a case, a fair and prompt compensation is guaranteed.

REPATRIATION OF CAPITAL AND PROFITSCapital repatriation, remittance of dividends and interest are guaranteed to foreign investors under the Foreign Investment Protection Act (FIPA) - Cap 518. Investors can repatriate:

¥ After tax proÞts, including retained proÞts which have not been capitalized;

¥ The proceeds of the investment after payment of the relevant taxes;

It is envisioned that the development will be a mixed use facility that combines a purposebuiltConvention&Exhibitionfacilityofinternationalstandards.Thekeycapacity parameters for the convention facility is a 2,500 seat plenary hall, 15,000 square meter exhibition hall and 105,000 square meter precinct parking lot. It will also include a cultural centre a state of the art 200 room 5 star and 200 room 3 star hotels.

The financial viability assessment has been carried out based on the assumptions that debt to equity ratio remains unchanged at 70:30 at all times; a CAPEX grant of up to 25% of the project cost for the Convention Centre; and a 20 year concession limit.

The proposed project is a sight-seeing tour inanamazingduckvehiclewherevisitorsride through the historic and scenic streets of Nairobianditsneighborhoods.Thecaptainand crew will entertain through a mix of fun, music and history that create interactive

experience for families, adults and seniors.

The County is located on the southernmost part of the Country borderingTanzania

Ukunda town is 6km from the Ukunda airstrip. Access is by good road network from Mombasa mainland to South Coast.

There exists potential in untapped cultural resources, plenty of potential tourist sites that could offer accommodation facilities and a variety of activities. The County has high potential for investment on inland tourism.

MWALUGANJE ECO - TENTED CAMP

The project is located on the Southern part of the County 15km from the Mombasa - Lunga Lunga highway where the tranquility of the country side provides a different scenery from the beach front.

The area has a geyser with hot water throughout the year, a sacred area of high cultural value to the local Mjikenda community and is close to Mrima hill.

The main goal of the project is to create a unique high end hot spring eco-lodge of 20 rooms and a wellness center on 10 acres of land based on high environmental and technological standards.Thesitehasbeenzonedandfenced.

The project will provide a niche market for medicinal tourists, high-end tourists and those seeking to have a different experience from the existing beach front.

ThesiteisownedbytheCountyGovernmentandwillbeofferedtoastrategicpartnerbasedon right to build model or through a lease agreement.

Mwaluganje Elephant sanctuary is located 45 km southwest of Mombasa. The sanctuary has an areaof24.7km²,andit,alongwiththeadjacentShimbaHillsNationalReservecombinetoformthe Shimba Hills Ecosystem.

The ecosystem is known for its waterways such as River Manolo, indigenous trees that wind through unending plains, cliffs and rocky outcrops, as well as Mkongani rain forest Two other notablenaturallandmarksare“God’sBridge”and“TimeRock.”

The site for the project sits along the shoulder of a low hill facing a traditional elephant trail on a 10 acre piece of land.

The project envisages a private eco-friendly tented camp facility or glamping with 20 beds, private verandas, a bar and restaurant where guests can catch the breath taking scenery as well as front row view of the elephants.

The sanctuary is managed by the community in conjunction with Kenya Forest Service.

Transaction model would be on a lease with the community.

MwingiGameReserveisHot,dry,remoteand unspoiled, this reserve is a designated a Wilderness Activity Zone and allows for fly camping, fishing, camel and horseback safaris for the intrepid visitor.

KALUNDU ECO-PARKThe project site is located approximately 2Km from Kitui central business district.

Kalundu Eco-park is a massive recreational project that proposes to have a floating restaurant, water sport activities such as boat rowing, botanical gardens, culture center with exhibition of artefacts; children play area and a swimming pool.

The project aims to target the middle income earners as its niche market comprising 44.9% translating to 19.9 million and growing at 5 % annually.

The project is further supported by;

IKOO VALLEY ZIPLINE TOURIkoo Valley is an extensive scenic site to behold offering a beautiful get away from an otherwise busytownlifeandawindycoolbreezeinanotherwisehotafternoon.Itslocated30kmfromKitui town and 20km from Mwingi town.

Theterrainhasadequatespaceandmakeuptoaccommodateaziplineandthepropertyhasadequateaccessforguests,includingspaceforparking,awelcome/outfittingcenter,androadaccess.

Kitui county has erected a view point at Kaluu and plans are underway to put up a cultural centre that will be used by the local communities to display traditional artefacts. A similar viewpointwillbeerectedatBazaarwhichistwometersfromtheKitui-migwaniroad.Thesitepresents an opportunity for cultural heritage to be promoted as well as sport tourism activities suchaszip-lining.

The project envisages a Zipline canopy tour through the valley of cables nearly 100 feet above the ground. The excursions may include other activities such as learning about local birdlife and flora, inclusive lunch excursion with a pristine restaurant as tourists travel from platform to platform.

The site is owned by the County and will be offered to a strategic partner based on right to build model or through a lease agreement.

KANYONYOO WILDLIFE CONSERVANCYKanyonyoo area covers 23,109 hectares. The area has remnants of plains game that originally used to roam in the area before interference by human activities. A few wildlife species like the Africanbuffalo,zebra,Maasaigiraffe, yellow baboon and lesser kudu are found in the area.

A management plan for the area has already been formulated and a team of community rangers deployed to the site. This area provides a myriad of investment opportunities including but not limited to Eco lodges, tented camps, road side convenience along the Machakos-Kitui highway,

The site is owned by the County and will be offered to a strategic partner based on right to build model through a lease agreement or managing the conservancy privately.

mAKUENI COUNTYMakueni County covers an area of 8,034.7 sq km. It is 125 km from Jomo Kenyatta international airport.

The town can be accessed through road via Mombasa rd and Machakos. There is access to electricity, water and communication network.

Major physical features in the county include the Volcanic Chyulu hills, Mbooni hills, Kilungu hills, History of AIC Church.

Activities in the area include bike riding, hiking exploration of the chyulu hills, paragliding.

MAKONGO VIEW POINT NZAUI FOREST CAMP Makongo valley is located along the long winding Machakos-Makueni-Makindu road, The valley offers a spectacular drive through undulating hills covered by forests and terraces. The Makongo valley which runs for over 40 km, on a good all weather road, is good sporting site that can be used for sport tourism morespecificallytheKenyaBikersclub.Inaddition, the road and the site are suitable for travelers to Mombasa who wish to avoid the chaoticNairobi-Mombasaroad.

The project site is ideal as is easily accessible

The site is located 37.7 km away from Wote Town under management of Kenya Forest Services.

The project seeks to establish Forest Cottagesbrilliantlydesigned&carefully landscaped to compliment the huge, shady indigenous trees that surround the area.

The planned facilities will include the comforts of modern conveniences like, internet, telephone, television and locally made furniture. Selectively planted smaller trees, bushes, shrubs and flowers make Forest Cottages an inspiring destination for nature lovers and eco-tourists alike.

The site offers an unparalleled view of valleys and hills with an ideal launching spot for paragliders. This adventure tourism which will offer an incredible journey to increase a tourists interaction with nature.

The site has an existing restaurant on manicured grounds which is a popular stop over point for motorists.

mACHAKOS COUNTYThecountycoversanareaof6,208SQ.KM.ItbordersNairobiCounty.

The County is accessible via rail, road and air. The town headquarters are located 56 km from Jomo Kenyatta International Airport.

The local climate is semi-arid with a hilly terrain covering most parts of the county. The beautiful hilly scenery is perfect for tourist related activities such as camping, hiking safaris, ecotourism and cultural tourism, dance and music festivals among many more.

Machakos County, is home to industrial cities and residential estates. ItisalsohometotheupcomingKonzaTechnologyCityduetoitsproximitytoNairobi,goodinfrastructureandavailabilityofmassiveacres of land.

IVETI FOREST CABINS

Iveti forest under the management of the Kenya Forestry Services and is 9.7 km&18minutes’drivefromMachakostown and occupies a larger section of the greater scenic Kathiani forest. The proposed site for the forest cabin is a section of the forest that is almost at the peak of the Iveti hill with breathtaking views of the nearby hilly landscapes and the entire Machakos town.

Tourist activities that exist around and within the forest are hiking, camping, organizedcycling,andpicnicking.An8mins drive would take you to Kyamwilu GravitationalCenter,aplaceofwonderwhere tourists flock to witness nature defying the laws of gravity.

The close proximity to Machakos town would enable travellers to enjoy the buzzlingentertainmentandtouristfacilities within the town.

The site inclines providing a landscape character that this is a good site in the area because of its location, south facing, and shallow valley slope with the best local views towards Machakos town.Thissiteshouldminimizethelandscape impact of the proposed development. The project envisions a secluded 20 luxury log cabin in the woods whose design will offer panoramic views out to its respecting landscape or the project may lend itself to a futuristic tree hotel design.

The county covers an area of 17084.1km2 with 10,649.9 km2 being within Tsavo East and Tsavo WestNationalParks,providingamajortourismdestination.

Other areas are occupied by ranches, water bodies and forests that encompass both exotic and indigenous trees. In addition, they form part of a unique Eastern Arch range of forests made up oftheTaitaHillsandEasternTanzaniamountains.

NDOVU GAME LODGE & RESORTTheprojectiswithinIzeraRanchwhichis24 Km from Voi Town. Voi and Miasenyi SGRterminusoffersafastaccess.ThecurrentMombasaNairobiHighwayalsooffers access to the proposed Hotel.

The Ranch is endowed with rich natural resources especially wildlife. Its diverse terraingivesascenicviewofSagalla&Kasigau Hills.

The ranch spans approximately 20,000 acres with the hospitality project taking up 500acres. There are also plans to develop an airport with two runways and an aviation college, 40m wide dualcarriagefortheNairobiMombasaExpressway, solar project, artificial lake, recreational area for motor sports and

ranching. There is adequate land for expansion and development of other complementary facilities.

The project enjoys peace and tranquility fostered by the coexistence of the surrounding communities which perfectly assures true hospitality.

The falls are a scenic attraction and even more impressive in the rainy season. The area is surrounded by open woodland with rich birdlife, indigenous trees, hanging cliffs and scenic views. The morning sunrise gives beautiful rainbows. The site provides the perfect place for recreational activities providing an aesthetic appeal as a major resource within the area.

The County is home to Kenya’s second highest mountain called Mt Elgon that stands at 4,313 meters above sea level.

Attractions in the County include;

The County has an adventure tourist experience like no other at the Kitum Cave famed ‘elephant cave’ due to elephants mining salt from its sodium rich salts. Rivers flow through the rocks into the underground caves resulting in beautiful scenery.

TheTrans-NzoiaHeritagehomesareanhour’sdrive from Kitale town and airport. They were built by European settler farmers around the 1920’s and are set on the forest glades of Cherangani Hills and the scenic slopes of Mt Elgon. The historical aspect of the homes with ties to colonial era is an area of interest to historians and enthusiasts alike.
