I, Andr Murray, of the City of Fredericton, County of York, in the Province of NewBrunswick, Artist, MAKE OATH AND SAY AS FOLLOWS:

1. I Andr Murray as above indicated am making a Special Appearance tochallenge jurisdiction in this matter, without attorning to the Courts jurisdiction, I havebeen tentatively the named Defendant, as such have personal knowledge of the mattersherein deposed to except where otherwise stated;

2. I Andr Murray, am currently a Residential Leasehold Tenant residing at 31Marshall Street, Fredericton New Brunswick;

3. I Andr Murray, have no warrant(s) for my arrest, have never had an arrestwarrant for my arrest, never had a criminal record and am a productive member of society.

4. I Andr Murray while maintaining the peace, was at approximately 4:20 p.m.arrested Friday, October 7, 2011, at or near 525 Aberdeen Street Fredericton N.B. bymembers of the Fredericton Police Force. I did immediately inform the arresting policeofficers that I Andr Murray, I do not consent and I waive all the benefits . I AndrMurray understand to be fact and I verily believe to be true, the subject members of theFredericton Police Force cannot assume or presume jurisdiction, over an individual,namely myself Andr Murray once they are informed otherwise.

5. I Andr Murray was provided a document which was referred to as a ticket, Iwas informed that I would have to pay $50 for riding on the sidewalk with a bicycle,FREDERICTON MUNICIPALITY BY-LAW INFRACTIONS/G 219324. I Andr

Murray, in due diligence and in good faith conditionally accepted the ticket, upon proof of claim that the ticket applied to me and that I Andr Murray was obligated to acceptthe benefits offered and furthermore, I was obligated to accept the ticket. I AndrMurray was never asked to endorser the document with a signature and I did not at anytime provide my signature to the subject document.

6. The arresting Fredericton Police Force members were Constable David Beck and Constable L. Comuzzi.

7. Tuesday Oct 11, 2011 at 2:00PM, I Andr Murray did telephone ConstableDavid Beck regarding inquiring into the ADMINISTRATIVE TICKET REVIEWprocess which was available to me, pursuant to information found on the alleged ticket,FREDERICTON MUNICIPALITY BY-LAW INFRACTIONS/G 219324.

18. I Andr Murray verily believe No agent for THE CITY OF FREDRICTON hasyet provide the requested definitions of any relevant words, nor have they provided proof of claim that the alleged claims apply to the myself Andr Murray, nor that myself Andr Murray am obligated to accept the benefits offered.

19. I Andr Murray verily believe THE CITY OF FREDRICTON has failed toprovide proof of claim to myself, therefore there is no dispute between the parties, simplyput, an offer was made and an offer was in good faith conditionally accepted, there thematter stands.

20. I Andr Murray verily believe, since THE CITY OF FREDRICTON has failedto substantiate their claims against the Andr Murray through negotiation and discussion,further, there since it is a fact there lacks an injured party, THE CITY OF FREDRICTONhas no locus standi in this matter before the Court.

21. I Andr Murray verily believe, that jurisprudence has established, that aProvincial Court has no jurisdiction unless jurisdiction can be proven to exist, as opposedto a superior Court, where jurisprudence has established that jurisdiction is assumed toexist unless the contrary is shown.

22. I Andr Murray verily believe, that if there is not dispute between Parties, theCourt lacks a lis inter partes to judge, therefore the Court has no jurisdiction to act.

20. Upon proof of claim that the ticket was the result of a lawful investigationunmarred by prejudice;

21. Upon proof of claim that you were offered proof of contract which bound mecontractually to perform according to MUNICIPAL BY-LAW INFRACTIONS.

22. Upon proof of claim that the only three ways to lawfully discharge this ticket isby doing one of the three things on the back of the ticket;

23. Upon proof of claim of your Peace Officer status;

26. Upon proof of claim that you can act with dishonour and ticket me as well.It is not my intent to be difficult, but I exercise and protect my rights and it seems to me

not being hoodwinked into accepting a debt or unwillingly granting authority is afundamental one.

Since the MUNICIPAL BY-LAW INFRACTIONS which deal with the allegedinfraction you were investigating do not inflict a punishment greater then allegedly a fine,threatening incarceration or detainment in the course of that investigation cannot belawful. The investigation cannot be a greater imposition then the punishment for aconviction. Also, the term DEFENDANT implies one engaged in a conflict. If we are in

conflict does not honour and the rule of law both demand we sit down and discuss andnegotiate before going to court in an adversarial fashion? I certainly feel that is the caseand would like to re-issue my previous offer to discuss this matter prior to using upvaluable court resources. Also, if in the exercise of my rights and my lawful quest for amore compassionate society I have harmed anyone, I would like the opportunity toapologize and make amends immediately. Who exactly did I harm?

so as to compel me to act according to their will, use of these words to justify their interference with my lawful activities, I am very interested in knowing the "hows" and "whys" of this situation we find our selves in.

Does The City of Fredericton act on some implied contract, or is there another mechanism that the City utilizes, to claim jurisdiction over men and women?

from where does the City of Fredericton claim to draw its consent to govern?

Seeing as how boots are on the ground doing the "application of force" as we speak, and you have been City Solicitor since 2009, then i hope that 48 hours will be sufficient time within which to prepare a response for me.

Since those who would be and or are currently employed as Agents (City Agents) by The City of Fredericton, furthermore, those subject City Agents who in performance of their job description will use the herewithin, above listed words, either verbalized and or in written form, therefore to extract a revenue moreover to further establish as something to be obeyed or complied with that which is otherwise commonly worded, and must consequentially be recognized as threat, consequently non compliance accompanied with inter alia the ultimatum as is delivered to subject inhabitants promising to result in punitive measures that which reasonable must follow considering the wording as that may be.

To thereby compel inhabitants of the land area incorporated as The City of Fredericton, further, to manipulate said inhabitants of the subject area to behave according to the City Agents understanding of these herewithin,above listed subject words. Words manipulated threatening to apply Force,so as to compel me to act according to their will, use of these words to justify their interference with my lawful activities, I am very interested in knowing

the "hows" and "whys" of this situation we find our selves in.Does The City of Fredericton act on some implied contract, or is there another mechanism that the City utilizes, to claim jurisdiction over men and women?

from where does the City of Fredericton claim to draw its consent to govern?

Seeing as how boots are on the ground doing the "application of force" as we speak, then I hope that 48 hours will be sufficient time within which to prepare a response for me.
