DRAFT EXPLANATORY REPORT

Who is the planning authority?

This amendment has been prepared by the Yarra Ranges Council, which is the planning authority for this amendment.

The Amendment has been made at the request of Victoriawide planning consultants, on behalf of the property owner.

Land affected by the Amendment

The Amendment applies to 29 and 31 Victoria Road, Chirnside Park.

What the amendment does

The Amendment removes the restrictive covenant currently applying to the land which prevents more than one dwelling being constructed on each lot.

The Amendment replaces the existing Schedule to Clause 52.02 (Easements, Restrictions and Reserves) with a new Schedule containing a provision applying to 29 and 31 Victoria Road, Chirnside Park which states that the existing covenant is removed.

Strategic assessment of the Amendment

Why is the Amendment required?

The amendment is required because the existing covenant prevents the proposed planning permit application for medium density housing from being assessed in accordance with the planning scheme.

How does the Amendment implement the objectives of planning in Victoria?

The amendment will provide for the fair and orderly planning of the area by allowing consideration of an application to develop and use the land for medium density housing in accordance with the planning scheme.

How does the Amendment address any environmental, social and economic effects?

The amendment will allow the planning scheme and planning permit application process to address the environmental, social and economic effects of the proposed development.

Does the Amendment address relevant bushfire risk?

The subject site is not with a bushfire prone area.

Does the Amendment comply with the requirements of any Minister’s Direction applicable to the amendment?

The amendment complies with the Ministerial Direction on the form and content of planning schemes. It complies with Direction 11 on strategic assessment of amendments.

How does the Amendment support or implement the State Planning Policy Framework and any adopted State policy?

The amendment supports State Planning Policy for residential development by allowing an application for medium density housing to be determined by the planning scheme. Clause 16 - Housing identifies relevant objectives and strategies including Clause 16.01-4 which states - To provide for a range of housing types to meet increasingly diverse needs. One of the strategies to implement this objective includes –

Ensure housing stock matches changing demand by widening housing choice, particularly in the middle and outer suburbs.

Encourage the development of well-designed medium density housing which respects neighbourhood character, improves housing choice…..

How does the Amendment support or implement the Local Planning Policy Framework, and specifically the Municipal Strategic Statement?

The amendment supports Local Planning Policy for residential development by allowing an application for medium density housing to be determined by the planning scheme. Local policy supports a range of different housing development outcomes in different locations within the municipality, and there is specific policy for housing development in the Chirnside Park area (Incremental change Area). The amendment will allow consideration of a permit application in accordance with this policy. Of relevance is Clause 21.04-1 Residential, which provides a series of strategies to ensure appropriate infill development in incremental change areas.

Does the Amendment make proper use of the Victoria Planning Provisions?

The amendment makes proper use of the schedule to Clause 52.02.

How does the Amendment address the views of any relevant agency?

The views of relevant agencies can be obtained through the notification process

Does the Amendment address relevant requirements of the Transport Integration Act 2010?

The Transport Integration Act does not have any bearing on this amendment.

Resource and administrative costs

What impact will the new planning provisions have on the resource and administrative costs of the responsible authority?

The amendment will allow consideration of a planning permit application, which can be managed within existing resources.
