SARRAL was South Africa’s only mechanical rights society from 1963 until the late nineties

SARRAL NORM

In 1998, NORM – previously a music publishers’ industry association – began administering mechanical rights for its members (consisting of the majors and big indie publishers), and thus removing these rights from SARRAL’s administrative control.

SAMROIn 2006, SAMRO expanded its business to include mechanical rights administration. Upon SARRAL’s liquidation in 2010, numerous (ex-) SARRAL members joined SAMRO as mechanical rights members.

SAMRO CAPASSO

Following initial discussions between NORM and SAMRO from as early as 2009, and recommendations by DTI’s Copyright Review Commission in 2012, SAMRO and NORM moved completely out of mechanical rights administration in 2014 to support the formation of CAPASSO, which was launched in July 2014 as South Africa’s only operating Mechanical Rights society. NORM now operates as a music publishers’ association (MPA(SA)) and SAMRO’s focus is on performing rights administration.

OK…But what are Mechanical Rights?- Part of the “bundle of rights” that make up copyright

- A Mechanical Right is raised whenever a reproduction (copy) or format transfer takes place

- Relates to the Musical Work (Composition) and not the Sound Recording

Examples of when a mechanical right arises:

*When CDs are pressed**When an MP3 is purchased for download *

*Music video stream*

*When music videos are reformatted for broadcasting*

*When music is uploaded onto broadcaster’s system for broadcast*

Introduction to CAPASSO- Collects and distributes royalties to music publishers, composers,

authors

- Only Mechanical Rights society in South Africa

- Created in line with DTi/Copyright Review Commission recommendations to create one society per right

CAPASSO currently licenses and collects mechanical rights royalties in various sectors, including the following:

- TV broadcasters - Online download and streaming services (music and video),

including mobile networks - Record labels producing physical product (e.g. CDs)- TV production houses- Ad agencies (TV and radio ads)

Why should you get in touch with CAPASSO?

- You should join CAPASSO as a member if you are a composer or music publisher whose music is broadcast on television, sold on digital music services such as iTunes or Simfy, sold on a mobile network service or is reproduced in any other manner.

- You should obtain a licence from CAPASSO if you operate a broadcasting service, use music in the creation of TV shows and adverts, operate an online music service, are a DJ or reproduce music in any other manner in your business.
