Cooling-Off PeriodYou have 14 days from the start dateof the policy to write to Us at theaddress shown at the bottom of Yourcover confirmation letter if You want tocancel Your Home Cover Policy. This isknown as a cooling-off period. If You cancel Your Home Cover Policyduring this period of time, providedYou have not made a claim, We willrefund Your premium. However, Youwill be charged with a pro-ratapremium for the period on risk, duringthe cooling-off period.

Your Duty of Disclosure You must advise Us immediately if theuse of Your home changes, such as itbecoming let out to tenants, used as aholiday home, becoming unoccupiedfor more than 35 consecutive days, orbeing used for any business purpose.

You should also tell Us immediately ifthe nature of Your home changes in away that might affect our attitude tothe cover provided – for exampleduring the building of an extension orthe re-roofing of the property withnon-standard materials. If You are inany doubt as to whether a change ismaterial, please notify Us.

Inflation ProtectionTo protect You against the effects ofinflation, Your Buildings and ContentsSum Insured, may be increased in linewith an appropriate index* when Yourpolicy falls due for renewal. If We doincrease Your sums insured at renewaltime, We will inform You.

*For Buildings, We will consult boththe House Rebuilding Cost Indexprepared by the Department of theEnvironment - http://www.environ.ie/and the latest guide to houserebuilding costs issued by the Societyof Chartered Surveyors Ireland -http://www.scsi.ie/. *For Contents, We will consult relevant sections ofthe Consumer Price Index prepared bythe Central Statistics Office -http://www.cso.ie/.

Governing Law This Policy is governed by the laws ofthe Republic of Ireland and anydispute arising from its interpretationwill be subject to the exclusivejurisdiction of the Courts of theRepublic of Ireland.

Insurer The insurer with which Your HomeInsurance contract will be concluded isAIG Europe Limited.

DAS Family Legal ProtectionYour AIG Home Cover Policyautomatically includes Family LegalProtection from DAS Ireland.

DAS Legal Expenses InsuranceCompany Limited is authorised andregulated by the Financial ConductAuthority and the PrudentialRegulation Authority of the UnitedKingdom and regulated by the CentralBank of Ireland for conduct ofBusiness rules.

Insurance Act 1936 (or futureamendments thereto) All monies which become or maybecome payable to Us under thisPolicy shall in accordance with Section93 of the Insurance Act 1936 be

payable and paid in the Republic ofIreland.

Finance Act 1990 (or futureamendments thereto) The appropriate stamp duty has beenor will be paid in accordance with theprovisions of Section 5 of the StampDuties Consolidation Act, 1999, asamended.

Your Family Legal Protection Cover

Your AIG Home Cover Policyincorporates DAS Family LegalProtection. You are now protected byEurope’s leading legal expensesinsurer. To make sure you get the mostfrom your DAS cover, please take timeto read this section which explains thecontract between you and DAS.

How DAS Can HelpTo make a claim under your policy,please write to the DAS ClaimsDepartment at the following address: Claims Department, DAS LegalExpenses Insurance Company Limited,Europa House, Harcourt Centre,Harcourt Street, Dublin 2, D02 WR20.

Please include your AIG HomeCover policy number when you writeto DAS.

Once you have sent DAS details ofyour claim and your dispute needs tobe dealt with as a claim under thispolicy, DAS will give you a claimreference number. At this point DAS

will not be able to tell you whether youare covered but they will pass theinformation you give them to theirclaims-handling teams and explainwhat to do next.

Period of insuranceThe period for which DAS have agreedto cover an insured person. Pleaserefer to Your AIG Home InsuranceSchedule.

Date of occurrence(a) For civil cases, the date of

occurrence is the date of the eventwhich leads to a claim. If there ismore than one event arising atdifferent times from the sameoriginating cause, the date ofoccurrence is the date of the firstof these events.

(b) For criminal cases, the date ofoccurrence is when the insuredperson began, or is alleged tohave begun, to break the criminallaw in question.

(c) For insured incident 7 TAXPROTECTION, the date ofoccurrence is when the RevenueCommissioner first notifies theinsured person in writing of theirintention to make an enquiry.

Identity TheftThe theft or unauthorised use of aninsured person’s personalidentification which has resulted in theunlawful use of their identity.

Revenue AuditAn examination by the RevenueCommissioners of an insured person’sself-assessment return for income taxor capital gains tax.

Costs and Expenses(a) Accountants costs – All reasonable

and necessary costs chargeable bythe representative.

(b) Attendance expenses – Theinsured person’s net salary orwages for the time that the insuredperson is off work. DAS will pay foreach half or whole day that thecourt, tribunal or the insuredperson’s employer will not pay for.The amount DAS will pay is basedon the following:■ The time the insured person is

off work, including the time ittakes to travel to and from thecourt or tribunal. This will becalculated to the nearest halfday assuming that a whole dayis eight hours;

■ If the insured person works fulltime, the salary or wages foreach day equals 1/250th of theinsured person’s yearly salary orwages;

■ If the insured person works part-time, the salary or wages will bea proportion of the insuredperson’s weekly salary or wages;

■ If the insured person is self-employed, DAS will pay netsalary or wages that the insuredperson draws from the businessto cover their own personalcost-of-living expenses.

(c) Communication costs – Costs ofphone calls, faxes, or postageincurred by the insured person tocommunicate with the Gardaí,

credit agencies, financial-serviceproviders, other creditors or debt-collection agencies and the cost ofreplacement documents.

(d) Legal Costs – All reasonable andnecessary costs changed by therepresentative on a party/partybasis. For INSURED INCIDENT 3BODILY INJURY, DAS will initiallypay the application fee required bythe Injuries Board (IB).

(e) Opponents costs – The costsincurred by opponents in civilcases if an insured person hasbeen ordered to pay them, or paysthem with DAS’s agreement.

Countries CoveredFor INSURED INCIDENTS 1CONTRACT DISPUTES and 3 BODILYINJURY – The European Union, theUK, the Isle of man, the ChannelIslands, Albania, Andorra, BosniaHerzegovina, Croatia, Gibraltar,Iceland, Liechtenstein, Macedonia,Monaco, Montenegro, Norway, SanMarino, Serbia, Switzerland andTurkey.

For all other insured incidents – TheRepublic of Ireland.

COVERDAS agrees to provide the insurancein this policy, as long as:

(a) the premium has been paid; and(b) the date of occurrence of the

insured incident is during theperiod of insurance; and

(c) any legal proceedings will be dealt

with by a court, or other bodywhich DAS agree to, in theterritorial limit; and

(d) for civil claims, it is always morelikely than not that an insuredperson will recover damages (orobtain any other legal remedywhich DAS have agreed to) ormake a successful defence.

WHAT DAS WILL PAY1 (a) For all INSURED INCIDENTS

under this policy, DAS will paylegal costs and opponentscosts;

(b) for INSURED INCIDENT 3BODILY INJURY claims, DASwill pay the application feerequired by the Injuries Board (IB);

(c) for INSURED INCIDENT 7TAX PROTECTION, DAS willpay accountants’ costs;

(d) for INSURED INCIDENT 8JURY SERVICE AND COURTATTENDANCE, DAS will payattendance expenses;

(e) for INSURED INCIDENT 2 IDENTITY THEFT, DASwill pay communication costs.

2 For all insured incidents DAS willpay costs and expenses to make ordefend against an appeal as longas the insured person tells DASwithin the statutory time limitsallowed that they want DAS toappeal. Before DAS pay the costsand expenses for appeals, DASmust agree that it is always more

likely than not that the appeal willbe successful.

3 The most DAS will pay for allclaims resulting from one or moreevent arising at the same time orfrom the same originating cause is€65,000.

INSURED INCIDENTS DAS WILLCOVER

1 CONTRACT DISPUTESDAS will negotiate for an insuredperson’s legal rights in a contractualdispute arising from an agreement oran alleged agreement which aninsured has entered into for:

(a) buying or hiring in goods orservices; or

(b) selling goods;

Provided that:

(i) the insured person has enteredinto the agreement or allegedagreement during the period ofinsurance; and

(ii) the amount in dispute is more than€150.

What is not covered underCONTRACT DISPUTES

A claim relating to:

(1) a contract regarding an insuredperson’s trade, profession,employment or any businessventure;

(2) construction work on any land, or

designing, converting or extendingany building where the contractvalue exceeds €7,500 (includingVAT);

(3) the settlement payable under aninsurance policy (DAS willnegotiate if an insured person’sinsurer refuses their claim, but notfor a dispute over the amount ofthe claim);

(4) a dispute arising from any loan,mortgage, pension, investment orborrowing;

(5) a dispute over the terms of a leaseof land or buildings or a licence ortenancy of land or buildings.However, DAS will cover a disputewith a professional adviser inconnection with the drafting of alease, licence or tenancyagreement.

2 IDENTITY THEFTIdentity theft support service

Following a call to the identity thefthelpline, DAS will help restore aninsured person’s identity and creditstatus if they have become a victim ofidentity theft. DAS will assign apersonal case worker who will providephone advice to help regain aninsured person’s identity.

Legal costs

Following an insured person’s identitytheft:

(1) DAS will pay legal costs to

reinstate an insured person’sidentity including costs for thesigning of statutory declarations orsimilar documents;

(2) DAS will negotiate for an insuredperson’s legal rights in a disputewith debt collectors or any partypursuing legal action against aninsured person arising from orrelating to identity theft;

(3) DAS will pay loan rejection feesand any re-applicationadministration fee for a loan whenan insured person’s originalapplication has been rejected.

Provided that;

(i) the insured person files a Gardareport and notifies banks andbuilding societies as soon aspossible; and

(ii) the insured person tells DAS if theyhave previously suffered identitytheft and;

(iii) the insured person takes allreasonable action to preventcontinued unauthorised use oftheir identity.

What is not covered under Identitytheft

(1) Fraud committed by anotherinsured person under this policy.

(2) Losses arising from an insuredperson’s business activities.

3 BODILY INJURYDAS will negotiate for an insuredperson’s legal rights in a claim against

a party who causes the death of, orbodily injury to, an insured person.This includes helping an insuredperson to register their claim with theInjuries Board (IB).

What is not covered under BODILYINJURY

(1) Illness or bodily injury, whichhappens gradually or is notcaused by a specific or suddenaccident.

(2) Psychological injury or mentalillness unless the condition followsa specific or sudden accident thathas caused physical bodily injuryto the insured person.

(3) Clinical negligence.(4) Defending an insured person’s

legal rights, but defending acounter-claim is covered.

(5) The cost of obtaining a medicalreport when registering a claimwith the IB.

4 CLINICAL NEGLIGENCEDAS will negotiate for an insuredperson’s legal rights where it is allegedthat accidental death or bodily injuryto an insured person has resulted froma single negligent act of surgery,clinical or medical.

What is not covered underCLINICAL NEGLIGENCE

(1) The alleged failure to correctlydiagnose the insured person’scondition.

(2) Psychological injury or mental

illness that is not associated withan insured person having sufferedphysical bodily injury.

5 EMPLOYMENT DISPUTESDAS will negotiate for an insuredperson’s legal rights in a disputerelating to their contract ofemployment or future employment.

What is not covered underEMPLOYMENT DISPUTES

(1) Employers disciplinary hearings orinternal grievance procedures;

(2) Any claim relating solely topersonal injury.

6 PROPERTY PROTECTIONDAS will:

(a) Negotiate for an insured person’slegal rights in a civil action;and/or

(b) arrange mediation (if appropriate);

for a dispute relating to materialproperty (including the insuredperson’s principal and holiday home)which is legally owned by an insuredperson, or for which an insured personis responsible, following:

(1) an event which causes physicaldamage to such material property,provided that the amount indispute is more than €150;

(2) a legal nuisance (meaning anyunlawful interference with aninsured person’s use or enjoyment

of their land, or some right over,or in connection with it);

(3) a trespass.

What is not covered underPROPERTY PROTECTION

(1) A claim relating to:(a) a contract entered into by an

insured person;(b) any building or land other

than the insured person’sprincipal or holiday home;

(c) someone legally taking aninsured person’s materialproperty from them, whetherthe insured person is offeredmoney or not, or restrictionsor controls placed on aninsured person’s materialproperty by any governmentor public or local authority;

(d) work done by, or on behalfof, any government or publicor local authority unless theclaim is for accidentaldamage;

(e) mining subsidence.(2) Defending a claim relating to an

event that causes physical damageto material property, but defendinga counter-claim is covered.

(3) The first €350 of any claim forlegal nuisance or trespass. This ispayable as soon as DAS acceptthe claim.

7 TAX PROTECTIONIn the event of a revenuecommissioner’s audit relating to an

insured person’s self-assessment taxreturn, DAS will negotiate for aninsured person, and represent them inany appeal proceedings.

What is not covered under TAXPROTECTION

(1) A claim relating to an off shoreaccount held by an insuredperson.

(2) The tax affairs of a company, orany claim if the insured person isself-employed, or a sole-trader, orin a business partnership.

(3) Any Revenue Commissioner’saudit where the insured personhas not submitted a self-assessment tax return.

(4) Reviews conducted by the RevenueCommissioner’s as part of itsreview programmes.

8 JURY SERVICE AND COURTATTENDANCEAn insured person’s absence fromwork:

(a) to attend any court or tribunal atthe request of the representative ;or

(b) to perform jury service; or(c) to carry out activities specified by

the identity theft support serviceunder INSURED INCIDENT 2IDENTITY THEFT.

9 LEGAL DEFENCE(1) DAS will defend an insured

person’s legal rights if an eventarising from an insured person’s

work as an employee leads to:(a) an insured person being

prosecuted; or(b) civil action being taken

against an insured personunder legislation for unlawfuldiscrimination.

(2) DAS will defend an insuredperson’s legal rights if an eventleads to their prosecution for anoffence connected with the use ordriving of a motor vehicle.

What is not covered under LEGALDEFENCE

(1) Parking or obstruction offences.(2) The driving of a motor vehicle by

an insured person for which theinsured person does not havevalid motor insurance.

WHAT IS NOT COVERED BY THISSECTION OF YOUR HOME COVER1 A claim where the insured person

has failed to notify DAS of theinsured incident within areasonable time of it happeningand where this failure adverselyaffects the prospect of successfullyrecovering damages (or gettingany other legal remedy that DAShave agreed to) or of making asuccessful defence.

6 A legal action that an insuredperson takes which DAS or therepresentative have not agreed to,or where an insured person doesanything that hinders DAS or therepresentative.

7 A claim relating to written orverbal remarks which damage aninsured person’s reputation.

8 A dispute with DAS not otherwisedealt with under Condition 7.

9 Apart from DAS, the insuredperson is the only person who mayenforce all or any part of thispolicy and the rights and interestsarising from or connected with it.

10 Costs and expenses arising from orrelating to Judicial Review,coroner’s inquest or fatal accidentinquiry.

11 A claim which is fraudulent,exaggerated or dishonest or wherean allegation of dishonesty orviolent behaviour has been madeagainst the insured person.

12 A claim caused by, contributed toor arising from:(a) ionising radiation or

contamination by radioactivityfrom any nuclear fuel or fromany nuclear waste fromburning nuclear fuel;

(b) the radioactive, toxic,explosive or other hazardousproperties of any explosivenuclear assembly or nuclearpart of it;

(c) war, invasion, foreign enemyhostilities (whether it wasdeclared or not), civil war,rebellion, revolution, militaryforce or coup; or

(d) pressure waves caused byaircraft or any other airbornedevices travelling at sonic orsupersonic speeds.

CONDITIONS WHICH APPLY TOTHIS SECTION OF YOUR HOMECOVER1 An insured person must:

(a) keep to the terms andconditions of this home coversection;

(b) try to prevent anythinghappening that may cause aclaim;

(c) take reasonable steps to keepany amount DAS have to payas low as possible;

(d) send everything DAS ask forin writing;

(e) give DAS full truthful detailsby phone or in writing of anyclaim as soon as possible andgive DAS any informationDAS need.

2 (a) DAS can take over andconduct in the name of aninsured person, any claim orlegal proceedings at anytime. DAS can negotiate anyclaim on behalf of an insuredperson.

(b) An insured person is free tochoose a representative (bysending DAS a suitablyqualified person’s name andaddress) if:(i) DAS agree to start legal

proceedings and itbecomes necessary for alawyer to represent theinterests of an insuredperson in thoseproceedings; or

(ii) there is a conflict ofinterest.

(c) In all circumstances exceptthose in 2(b) above, DAS arefree to choose arepresentative.

(d) Any representative will beappointed by DAS torepresent an insured personaccording to their standardterms of appointment. Therepresentative must co-operate fully with DAS at alltimes.

(e) DAS will have direct contact

with the representative.(f) An insured person must co-

operate fully with DAS andthe representative and mustkeep DAS up to date with theprogress of the claim.

(g) An insured person must givethe representative anyinstructions that DAS ask for.

3 (a) An insured person must tellDAS if anyone offers to settlea claim.

(b) If an insured person does notaccept a reasonable offer tosettle a claim, DAS mayrefuse to pay further costs andexpenses.

(c) DAS may decide to pay theinsured person the amount of damages that the insuredperson is claiming, or that isbeing claimed against them, instead of starting orcontinuing legal proceedings.

4 (a) An insured person must telltheir representative to havecosts and expenses taxed,assessed or audited, if DASask for this.

(b) An insured person must takeevery step to recover costsand expenses and IBapplication fee(s) that DAShave to pay, and must payDAS any costs and expensesand IB application fee(s) thatare recovered.

continue acting for an insuredperson with good reason, or if aninsured person dismisses therepresentative, the cover DASprovide will end at once and DASwill be entitled to reclaim from youcosts and expenses DAS havepaid.

6 If an insured person settles a claimor withdraws it without DAS'sagreement, or does not givesuitable instructions to arepresentative, the cover DASprovide will end at once and DASwill be entitled to reclaim from youcosts and expenses DAS havepaid.

7 If there is a disagreement aboutthe way DAS handle a claim that isnot resolved through their internalcomplaints procedure, the insuredperson can contact the FinancialService Ombudsman Bureau forhelp.

8 DAS may, at their discretion,require the insured person toobtain, at their expense, anopinion from a lawyer, accountantor other suitably qualified personchosen by the insured person andDAS, on the merits of a claim orproceedings. If the chosenperson’s opinion indicates that it ismore likely than not that aninsured person will recoverdamages (or obtain any otherlegal remedy that DAS haveagreed to) or make a successfuldefence, DAS will pay the cost of

obtaining the opinion.9 DAS will not pay any claim

covered under any other policy, orany claim that would have beencovered by any other policy if thispolicy did not exist.

10 This section of Your Home Coverpolicy will be governed by the lawsof the Republic of Ireland.

Accidental Damage Unexpected and unintended damagecaused by something sudden andexternal.

Buildings The Buildings are made up of twoparts, namely:

1. The Private House (whichincludes garages with direct accessfrom the Private House) includingfixtures and fittings therein andthereon, occupied for residentialpurposes only, built with brick,stone or concrete and roofedsubstantially with slates, tiles, orother incombustible materials;

and

2. Domestic outbuildings, detachedgarages, swimming pools, tenniscourts, including fixtures andfittings therein and thereon, fuelstorage tanks and their contents,

Alternative Accommodation We will pay for: 1. Reasonable additional expenses

Public Authorities RequirementsCosts We will pay the cost of complyingwith any government, local authority,building or other regulation to theextent that these apply to parts of theBuildings damaged by an insuredcause (but not where notice has beenserved on You prior to theoccurrence of the loss or damage or where We were not advised thatthe property to be insured is a listed property or a protectedstructure).

Adaptation of Home Following DisabilityWe will pay the cost of adapting the Buildings for wheelchair access in theevent that a member of the Household suffers disablement as a result of anaccident occurring during the Period of Insurance, which requires them to usea wheelchair for mobility which will in all probability continue for theremainder of their natural life. The maximum amount payable is €10,000.No policy excess applies to this cover benefit.

Damage to Headstones We will pay the cost of repairing and/or replacing headstones on the gravesof Your parent, spouse or child following damage as a result of fire, lightning,storm, flood, malicious damage and/or stealing. Your Buildings Cover also includes Your Legal Liability to Others as Owner of the Buildings

We will cover You against all sums whichYou shall become legally liable to pay as owner of the Buildings foraccidents happening in or about theBuildings which result in: 1. Death, bodily injury or illness to any

person other than:(i) Members of Your Household; (ii) Employees of You or of members

of Your Household;(iii) Paying Guests unless the use has

been declared and the premiumpaid.

2. Accidental damage to property otherthan property belonging to or under thecontrol of: (i) You;(ii) Members of Your Household;(iii) Employees of You or of members

Trace and Access We will pay up to a maximum of €750to remove or replace any part of theBuildings necessary to repair any fixeddomestic water, gas or heatinginstallation from which water hasescaped but only if no payment hasbeen made under the Buildings coverof this or any other policy.

5. Escape or Overflow of Oil fromwithin any Plumbing or HeatingSystem or Fixed DomesticAppliance.

Trace and Access We will pay up to a maximum of €750to remove or replace any part of theBuildings necessary to repair any fixeddomestic water or heating installationfrom which oil has escaped but only ifno payment has been made under theBuildings cover of this or any otherpolicy.

6. Stealing (or Attempted Stealing)

■ While the Private House isUnfurnished,

■ Where the Private House has beenUnoccupied for more than 35consecutive days immediately priorto the loss or damage;

■ Resulting from escape or overflowwater from gutters;

■ Caused by the gradual ingress ofwater from shower units and baths;

Increased Policy Excess (Where H2- Burglar Alarm Clause applies):If at the time of a stealing (or attemptedstealing) loss your burglar alarm is notswitched on and in service the standardpolicy excess is increased to €1,000 for each and every loss incident.

by thieves at the Buildings; 2. Travelling as a passenger by train,

When Buildings Claims Settled on a New for Old basisFor Buildings (Section 1)Any admitted claim (excluding claimsin respect of felt roofs) will be settledon a new for old basis (withoutdeduction for wear, tear ordepreciation), provided:

1. The Buildings have beenmaintained in good repair;

2. The Buildings Sum Insured amountat the time of a loss is not less thanthe full cost of rebuilding the entireBuildings as defined inclusive offees and removal of debris;

3. Repair or replacement is carriedout without undue delay.

Otherwise, claims will be settled withan appropriate deduction for wear,tear and depreciation.

When DeductionAdjustment Made for Wear,Tear and Depreciation

Claims in Respect of Felt RoofsCovered claims will be settled with anappropriate deduction for wear, tearand depreciation.

For Contents (Section 2)Provided that, at the time of a loss, theContents Sum Insured amount isadequate to replace all of theContents as new, any admitted claim(excluding claims for items listed asbelow) will be settled on a new for oldbasis, as follows:

1. Total loss or destruction will besettled without deduction for wear,tear or depreciation,

2. Partial loss will be settled bypayment of the cost of repair (ifrepairs can be made) and subjectto this cost not exceeding thereplacement value of the propertyas new.

Otherwise, claims will be settled withan appropriate deduction for wear,tear and depreciation.

All claims for: 1. Household linen, wearing apparel,

sporting equipment and bicycles; 2. Any of the following if they are over

3 years old: carpets, floor coveringand timber flooring; TV, audio,video, computer or recordingequipment and ancillary materialincluding CDs, tapes, records andsoftware;

will be settled with an appropriatededuction for wear, tear anddepreciation.

Our Limit of Liability – Buildingsand Contents Sum InsuredIn the event of a loss in respect ofBuildings or Contents our maximumliability is limited to the Sum Insuredamounts stated on Your HomeInsurance Schedule or endorsedhereon.

Provided the loss or damage iscovered by Your policy We will settleYour claim as follows subject to theSum Insured being adequate:

1. Where damage can beeconomically repaired, includingfor clothing, We will eitherauthorise or arrange for repair;

2. Where a damaged or lost item canbe replaced with an item of similarquality We will either authorise orarrange for replacement;

3. Where We are unable to either

repair or replace the item, We willmake a cash payment equal to anagreed replacement value;

4. Where We have offered eitherrepair or replacement but Youprefer a cash settlement, We willpay You an amount equal to thecost to Us had the item beenrepaired or replaced.

For Claims Relating to Items ofClothing:We may make a deduction for wear,tear and depreciation for clothing.

For Caravan Cover (Section 5) Our maximum liability for anyadmitted claim will not exceed themarket value of the property at thetime of its loss or damage, or the SumInsured specified on Your HomeInsurance Schedule (whichever is the lesser).

The cost of this service must be borneby You. However, if the cost is coveredby this Home Cover Policy then Wewill reimburse You as part of the claimsettlement.

To Make a Home Insurance ClaimYou May Have to: 1. Complete and return a claim form; 2. Submit estimates with Your claim;3. Wait until the estimate has been

agreed by Us before You canproceed with repairs/redecoration;

4. Retain all damaged property forinspection by Us.

If Your Property is Stolen orDamaged MaliciouslyIf Your property has been stolen ormaliciously damaged, or if You lose avaluable item, You must inform theGardaí or Police as soon as possible.You will receive the Garda report formwith Your claim form which you willneed to have completed by theGardai to evidence that the matterwas reported.

If Someone Else is Injured or TheirProperty is Damaged You Must:1. Send written details to Us as soon

as possible. It is vital that We dealwith such claims on Your behalf.

2. Send to us any letters ordocuments You receiveunanswered and without delay.

Things You Must Not Do:1. Proceed with repairs (other than

If an Event Insured Occurs We areEntitled to:1. Take over and conduct in Your

name, or in the name of any otherperson covered by this Policy, thedefence or settlement of any legalaction;

2. Take proceedings at Our ownexpense and for Our own benefit,but in Your name, or in the nameof any other person covered by thispolicy, to recover any payment Wehave made under this policy;

3. Receive all necessary assistancefrom You or any other personcovered by this policy;

4. Enter any Building where loss ordamage has occurred and dealwith any salvage in a reasonablemanner. However, no property maybe abandoned to Us.

Disagreement Over a Claim –ArbitrationAll differences arising out of this Policyshall be referred to the decision of anarbitrator to be appointed by the

parties or failing agreement by thePresident for the time being of theIncorporated Law Society of Ireland.Where any difference is referred toarbitration, the making of an awardshall be a condition precedent to anyright of action against the Company.Claims not referred to arbitrationwithin 12 calendar months from thedate of the disclaimer of the liabilityshall be deemed to have beenabandoned.

Important This condition does not affectYour right to refer any claim orquery to the office of theFinancial Services OmbudsmanBureau.

Matching Pairs or Sets We treat each separate item of amatching pair or set, or set offurniture, sanitary suite or fittings, softfurnishings or other fixtures andfittings, as a single item. We will onlypay for lost or damaged items. We willnot pay for the cost of replacing,recovering or remodelling undamagedpieces, or pieces which have not beenlost or damaged, just because it formspart of a set, suite or one of a numberof items similar in nature, colour ordesign. If an item in a set is lost ordamaged, the other pieces of the setmay lose some value, even if they

Section 6 – Optional Extra CoversAvailable to You

DEFINITIONS APPLICABLE TO YOUR FAMILY ACCIDENT PROTECTION OPTIONAL EXTRA COVER

We use certain words in this section of the policy which have a specificmeaning. They have this meaning wherever they appear in this section.

Accident A sudden, unexpected and specific event, external to the body, which occurs atan identifiable time and place.

Bodily InjuryIdentifiable physical injury to an insured person’s body which is caused directlyand solely by an accident, is not intentionally self-inflicted and does not resultfrom sickness or disease.

Child or Children A person who is, or persons who are, under 18 years of age.

Hospital An institution which has accommodation for in-patients and facilities fordiagnosis, surgery and treatment. It does not include a long-term nursinghome, a rehabilitation centre, an old people’s or convalescence home or anextended-care facility.

Hospitalisation Admission to a hospital as an in-patient and for at least 24 hours in a row.

InsuredAny person who has purchased this Family Accident Protection Option 1 ExtraCover, when they purchased this home insurance policy.

Insured Person The person who has purchased this home insurance policy and chosen topurchase this Family Accident Protection Option 1 Extra Cover, their partnerand children.

Insured Premises The Buildings as defined within this home insurance policy wording.

LossPermanent, total and irrecoverable loss of use, or the permanent and total lossby physical severance (separation), of a limb being a complete:- foot or leg, or - hand or arm.

Loss of Sight Physical loss of one or both eyes or the loss of a substantial part of the sight ofone or both eyes. A substantial part means that the degree of sight remainingafter the accident is 3/60 or less on the Snellen scale after correction withspectacles or contact lenses. (At 3/60 on the Snellen scale a person can seeat 3 feet something that a person who has not suffered loss of sight should beable to see at 60 feet).

Medical Practitioner A doctor with current full registration whose name appears on the IrishMedical Council’s General Register of Medical Practitioners.

Partner A person who is either an insured person’s husband or wife, civil partner,fiancé or fiancée, boyfriend or girlfriend and who permanently lives at thesame address as the insured.

Permanent Total Disability Disability, other than by loss of limb or loss of sight, which totally andpermanently prevents an insured person from doing any paid work whatsoeverfor the remainder of their life.

Time of Cover Whilst an insured person is on the insured premises.

If death occurs within 13 Weeks ofbodily injury, the benefit under item 1of the table of benefits above will bepaid and not the benefits under items2, 3, 4 or 5 provided death occurredas a result of bodily injury. If aninsured person is a child, We will onlypay €10,000 under item 1 of thetable of benefits above.

When more than one form of disabilityresults from bodily injury from thesame accident the maximum paymentwill be €25,000.

Upon the payment of a claim cover willstop for that insured person for whomsuch payment has been made.

1. We will pay You the sum equivalentto Your monthly mortgage paymentif a covered loss renders Yourprimary residence temporarilyuninhabitable for a periodexceeding 72 hours following theevent. We will make monthlypayments for up to a maximum of6 months until Your primaryresidence is made habitable againby repair, restoration orreconstruction. No payment will bemade until Your premises isuninhabitable and vacated for 72consecutive hours.

2. We will also pay, up to a maximumof €500 per claim, the excess onthis home insurance policy, listed onYour Home Insurance Schedule,when You receive payment for acovered loss if that covered lossrenders Your primary residenceuninhabitable for a periodexceeding 72 hours following theevent. This excess reimbursement islimited to no more than twice perpolicy period.

■ Any residence that is not Yourprimary residence and not occupiedby You;

■ The property if permanentlyuninhabitable, as defined above;

■ Loss or damage caused by anuninsured peril;

■ Any penalties or other charges notnormally included in Your monthlymortgage repayment that areincurred by You prior to the date ofloss;

■ Any amount exceeding €800 permonth or €4,800 any one period ofinsurance.

CONDITIONS APPLICABLE TO THIS SECTION

A. BASIS OF SETTLEMENT (How Claims Will Be Settled)For the first month of a covered loss, payment will be calculated at the rate of1/30th of the monthly mortgage amount for each day of the first month Yourpremises is uninhabitable. After the first month of a covered loss, payment willbe Your monthly mortgage amount for each month or portion of a month Yourpremises is uninhabitable.

If repair, reconstruction or restoration work starts within 60 days of the date ofa covered loss and continues on a regular basis, We will pay Your monthlymortgage amount scheduled for a period of time usually and customarilyrequired to complete the repair, reconstruction or restoration. Under nocircumstances will We pay more than 6 months of monthly mortgageamounts.

If repair reconstruction or restoration work on Your home is commenced within60 days after a loss, but the work is interrupted for a period of 30 days ormore, the payments provided by this policy will be suspended until the monthin which the work is resumed. A work interruption of six months or more willterminate this coverage, and no further monthly mortgage payment will bemade.

B. TERMINATION OF COVER (When Cover Benefit Ceases)Cover provided by this section will terminate on the earliest of the following:

1. Your mortgage loan is paid in full;2. You are no longer legally obligated to repay the loan;3. You no longer have ownership interest in the property which secures the

loan;4. Any premium due from You to Us remains unpaid for more than 31 days.

Material facts are facts that mightinfluence Our decision to insure You,the conditions of the insurance or thepremium We want to charge. If Youare not sure whether a fact is material,You should tell Us about it.

In Particular, You Must Tell Us: 1. If You change Your address;2. If You or Your family receive a

court judgement or conviction, orare prosecuted (except formotoring offences where a prisonsentence has not been served);

3. About any changes to YourBuildings that will increase therebuilding costs;

4. About any increase in the value ofYour Contents or PersonalBelongings;

5. If someone other than a memberof Your family comes to live withYou; and

6. If Your home will be Unoccupiedfor more than 35 days in a row.

Maintenance and Security – WhatYou Need To Do You must keep the Buildings in goodrepair and take all reasonableprecautions to ensure the safety of theproperty insured and to preventaccidents. The external doors of thePrivate House must be securely lockedand the windows securely fastenedwhilst the Private House is leftUnoccupied.

Misdescription – Our Rights if Thereis Non-Disclosure of Material FactsThis policy will be voidable in theevent of misrepresentation,misdescription or non-disclosure ofany material facts i.e. those

circumstances which may influence Usin our acceptance or assessment ofthis home insurance.

If You are in any doubt as to whether afact is material or not please discloseit. This condition applies at inceptionof Your policy and at renewal eachyear.

Mortgagee Clause The interest of a mortgagee in thisinsurance shall not be prejudiced byany act or neglect of the mortgagor(or occupier of the Buildings) wherebythe risk of loss or damage is increasedwithout the authority or knowledge ofthe mortgagee, provided themortgagee shall, immediately onbecoming aware thereof, give noticein writing to Us and on demand, paysuch additional premium as We mayrequire.

No Claims Discount Your policy may be subject to a noclaims discount. If this is the case itwill be included in the premiumbreakdown section of Your HomeInsurance Schedule. In the event of aclaim during the Period of Insurance,Your no claims discount will bewithdrawn at the subsequent renewal.

Other Insurances If at the time of any incident, whichresults in a claim under this policy,

there is any other insurance policycovering the same liability, loss ordamage, We will pay only Ourrateable share.

Your Duty of CareYou must take reasonable care to:

1. Keep Your home in a good state ofrepair; and

2. Avoid or limit any loss, damage orinjury.

War and Terrorism Notwithstanding any provision to thecontrary within this insurance or anyendorsement thereto, We shall not beliable in respect of liability, loss,damage, cost or expense ofwhatsoever nature directly or indirectlycaused by, resulting from or inconnection with any of the followingregardless of any other cause or eventcontributing concurrently or in anyother sequence to the loss:

1. War, invasion, acts of foreignenemies, hostilities or warlikeoperations (whether war bedeclared or not), civil war, mutiny,civil commotion assuming theproportions of or amounting to apopular rising, military rising,insurrection, rebellion, revolution,military or usurped power, martiallaw, confiscation ornationalisation or requisition by orunder the order of anygovernment or public or localauthority

2. Any act of terrorism.

An act of terrorism means an act,including but not limited to the useof force or violence and/or thethreat thereof, of any person orgroup(s) of persons, whether actingalone or on behalf of or inconnection with any organisation(s)or government(s), committed forpolitical, religious, ideological or

other purposes, including theintention to influence anygovernment and/or to put thepublic, or any section of the public,in fear.

This Endorsement also excludesliability, loss, damage, cost or expenseof whatsoever nature directly orindirectly caused by, resulting from orin connection with any action taken incontrolling, preventing, suppressing orin any way relating to 1 and/or 2above.

If We allege that by reason of thisexclusion any liability, loss, damage,cost or expense is not covered by thisinsurance, the burden of proving thecontrary shall be upon You. In theevent any portion of this Endorsementis found to be invalid orunenforceable, the remainder shallremain in full force and effect.

Cyber Risk This policy does not apply to liability,loss, damage, cost or expense ofwhatsoever nature directly or indirectlycaused by, resulting from or inconnection with:

1. The loss of, alteration of ordamage to; or

2. A reduction in the functionality,availability or operation of acomputer system, hardware,

We Shall Not be Liable for:

Radioactive Contamination 1. Loss or destruction of or damage

to any property whatsoever or anyloss or expense whatsoeverresulting or arising therefrom orany consequential loss or;

2. Any legal liability of whatsoevernature directly or indirectly causedby or contributed to by or arisingfrom:

(i) Ionising radiations orcontamination by radioactivityfrom any nuclear fuel or fromany nuclear waste from thecombustion of nuclear fuel;

(ii) The radioactive, toxic, explosiveor other hazardous properties ofany explosive nuclear assemblyor nuclear component thereof.

Sonic Boom Loss or damage caused by pressurewaves from aircraft and other aerialdevices travelling at sonic orsupersonic speeds.

Confiscation Loss of or damage due toconfiscation, requisition or destructionby order of any Government, or Publicor Local Authority.

Consequential Loss Consequential loss or damage of anykind except as set out in this policy.

Fees (incurred in the preparationof any claim)Fees incurred in the preparation of anyclaim including fees of Public LossAssessors and/or fees associated withthe preparation or presentation of anyclaim.

Fungi Any loss, damage or liability directly orindirectly caused by the presence,growth, proliferation, spread or anyactivity of fungi, wet or dry rot orbacteria. Whenever fungi, wet or dryrot or bacteria occur, they and anyresulting loss are always excludedunder this policy, howsoever caused.In addition, there is no cover to testfor, monitor, clean up, remove,remediate, contain, tread, de-toxify,neutralize, or in any way respond to or

Damage caused by Wear, Tear andas Undernoted: 1. Wear, tear, rust or corrosion;2. Gradual deterioration or any

moth, vermin, atmospheric orclimatic conditions;

5. Damage caused by any process ofcleaning, dyeing, repairing orrestoring any article;

6. Mechanical, electrical or electronicdefects, breakdown or malfunction.

Business, Trade or ProfessionalPurposes This policy does not provide cover forany property held in connection withany business, trade or professionalpurpose other than Home OfficeEquipment as referred to within thedefinition of Contents.

H1 - Minimum Security Clause It is a condition of Your policy that:

1. All external doors are fitted withmortice deadlocks or deadlockingrim latches;

2. All French windows and/or patiodoors are fitted with appropriatesecurity locks necessitating keyrelease;

3. All ground floor and otheraccessible opening windows* arefitted with effective lockingmechanisms.

(*excluding windows of rooms thatare used as sleepingaccommodation).

H2 - Burglar Alarm Clause It is a condition of Your policy that aworking approved* burglar alarm isinstalled at the Buildings as describedon Your Statement of Fact ProposalForm. You have agreed to maintainthe burglar alarm as advised to Us, inaccordance with the supplier’srecommendations and to have thealarm switched on and in service whenfamily members are not in the PrivateHouse. Where You have informed Usthat Your burglar alarm is monitoredon a 24 hour basis, this monitoringmust also remain in place.

(*Since 1st August 2006, the PrivateSecurity Authority (PSA) has madethe licensing of intruder alarminstallers mandatory. Seewww.psa.gov.ie for further details).

H3 - Smoke Alarm Clause It is a condition of Your policy that twosmoke detectors/alarms are installedat the Buildings and that You agree tomaintain these in accordance with thesupplier’s recommendations, to havethem switched on and in service on allpractical occasions.

H4 - Voluntary Excess Any voluntary excess shown in YourHome Insurance Schedule is deemedto be in addition to the standard (orcompulsory) policy excess amount(s)also stated in Your Home InsuranceSchedule.

H5 - Paying Guests up to 6 Permission is given for not more than6 short term paying guests at any onetime to be kept in the Private House.

H6 - Home Shared With Room(s)Sublet Permission is given for Your PrivateHouse to be shared with no more thanthree rooms being sublet to not morethan six tenants, co-tenants or lodgersat any one time.

H10 - Single High Value Limit The high value limit of 5%, or €3,000whichever is higher, included withinthe Contents definition, is deleted foritems listed on Your Home InsuranceSchedule and is replaced by themonetary amount shown against eachitem.

H11 - Total High Value Limit The high value total of 33%, includedwithin the Contents definition, isdeleted and replaced by thepercentage amount shown on YourHome Insurance Schedule.

H12 - Buildings Used Partly forBusiness Purposes, Other than aHome Office The Buildings is partly occupied inconnection with Your business asdisclosed to Us - see Your HomeInsurance Schedule or the Buildings ispartly occupied in connection withYour business as disclosed to Us.Within that portion of the Buildings nocover is provided for Money or anyHigh Value Item and AccidentalDamage to Contents is not included.The insurance provided for stealing orattempted stealing of Contents, onlyapplies if accompanied by violent andforcible entry or exit and is subjectotherwise to the terms, limitations andexceptions otherwise specified in thispolicy. The exclusion regarding“profession, trade or business”referred to under Liability to Othersdoes not apply to Your business asdisclosed but, We will not insure Youfor any amount which You mightbecome legally liable to pay for death,injury, illness or loss or damage byremedial, professional or other adviceor treatment - other than medical firstaid treatment - given or administeredor omitted by You, or by any of Yourservants, employees or Agents.

H13 - Jewellery Settings It is a condition of All Risks cover thatthe settings of any item of jewelleryvalued in excess of €10,000 areevidenced in writing as checked by ajeweller at least once every two years.

H15 - Mortgagees Clause The interest of the mortgagee shall notbe prejudiced by an act or negligenceby You, Your Household or any tenantthat increases the danger of damagewithout the authority or knowledge ofthe mortgagee provided that themortgagee as soon as reasonablypossible after becoming aware of thedanger shall give notice to Us and payan additional premium if required.

H16 - Fire and Owner’s LiabilityCover Only Applies The insurance provided by this homeinsurance policy is limited to theevents insured:

1. Fire, explosion, lightning,earthquake and thunderbolt; and

2. Liability to others as owner of theBuildings.

No other insurance cover is providedby this home insurance policy whilethis endorsement applies.

H17 - Satellite Dishes,Television/Radio Aerials and Masts The reference to “30 feet in height” inthis policy wording is substituted by thenumber of feet as advised to Us. Themonetary amount referred to remainsunchanged.

H18 - Increased Excess - Buildingsand Contents The standard policy excess amount of€250 applicable to Sections 1 and 2of this home insurance policy isincreased to that shown on YourHome Insurance Schedule.

H19 - Increased Excess -Accidental Damage The standard policy excess amount of€250 applicable to event insured 12Accidental Damage under Sections 1and 2 of this home insurance policy isincreased to that shown on YourHome Insurance Schedule.

H20 - Increased Excess - WaterPeril It is agreed that the €1,000 PolicyExcess amount stated in this policywording under Sections 1 and 2 isincreased to that shown on YourHome Insurance Schedule only inrespect of Events Insured sub-section 4of Section 1 - Buildings and EventsInsured sub-section 4 of Section 2 -Contents.
