Box 9195 Garden City, New York 11530-9195 Dear Dr. Langlois: As you are aware, there have been reports in the press that the Hempstead Union Free School District, in the current school year, has delayed the enrollment of approximately 34 Hispanic students who are currently living within the school district. That number purportedly includes students who are recent immigrants from Central America. In September 2014, the State Education Department issued a field memo to school districts advising them of their obligations relating to enrollment of unaccompanied immigrant children, which can be accessed on our website. 1 Some or all of those students may be homeless students entitled to the protections of the federal McKinney-Vento Homeless Education Assistance Improvements Act, 42 U.S.C. § 11431, et. seq., and State law relating to the education of homeless children. At this point, all of these children must be enrolled in the school district unless and until the district makes a final determination, in accordance with 8 NYCRR §100.2(x)(7), that such students are not homeless pursuant to McKinney-Vento or a final determination that they are not district residents, in accordance with 8 NYCRR §100.2(y). Department staff has confirmed with Hempstead school officials that a number of Hispanic students were not enrolled in the district and provided educational services commencing in September, though the district indicates they are now arranging to provide instruction. Pursuant to Education Law §2215(14), I hereby direct you as Interim District Superintendent to immediately investigate the enrollment status of these students and the enrollment procedures employed by the Hempstead Union Free School for them.
