    Statement on the ceasefire agreement between Burmese government and RCSS/SSA

    10 December 2011

    1. President U Thein Sein governments olive branch offer (announcement No. 1/2011) was officially announced on 18

    August 2011. Restoration Council of the Shan State (RCSS)/Shan State Army (SSA) also has the policy to solve the

    political issues through political and peaceful means. Therefore, RCSS/SSA sent a letter to the government for

    negotiation while the latter opens the opportunity for every ethnic to join in solving the longstanding political problems

    and build peace in the country.

    2. As arranged by Sao Harn Yawnghwe, the meeting took place for the first time betweenRCSS/SSA peace committee led

    by Lt. Gen. Yawd Serk and Burmese government peacemaking delegations led by Union Minister for Rail Transportation

    U Aung Min as a special representative of President U Thein Sein, at a Shan-Thai border on 19 November 2011.

    3. At the first meeting, Minister U Aung Min presented a 4 point proposition:

    a. Cessation of hostilities

    b. Opening liaison offices

    c. To roam freely if without arms

    d. To discuss politics at Union level

    RCSS/SSA presented a 4 point proposition for peace process:

    a. Cessation of hostilities

    b. To solve political issue through political dialogue

    c. Setting up of a RCSS/SSA headquarters area to improve the living standard of the people and the families of its troops

    d. Cooperation in the drug eradication

    4. After the meeting, the two sides made an appointment to officially meet again in Taunggyi, the capital of Shan State on

    2 December 2011. The State level peace group from Shan State Government led by Minister U Aung Min and Minister

    U Khin Maung Soe consists of the following members:

    5. The two sides officially signed ceasefire agreement on the basis of the 8 point proposition at the second meeting held at

    Taunggyi Hotel in Taunggyi on 2 December 2011.

    6. As the main point of the signing of the agreement at this meeting is only ceasefire, the points that could not be decided upon

    will further be discussed through political negotiation at Union level for peace building. In order to build and achieve true peace,

    we need to wait and see the actions and attitude of President U Thein Sein government towards the country and ethnic

    nationalities.

    7. If the actions of President U Thein Sein government do not correspond to the announcement of peace building made and there

    are still violations of human rights and the rights of ethnic people, RCSS/SSA is always ready to go to war by taking up arms to

    protect ourselves, our people and our country.

    8. Ceasefire is meant the starting point for peace building and the development of the living standard of our people so that one can

    make progress and taste the sweetness of democratic rights as one of the people in the world. Therefore, as a citizen of the Union,

    we all share the same responsibility to build a peaceful and developed nation.

    For a person who has been campaign-

    ing for honour, truth, justice and free-

    dom, and watching closely all the

    events that is enfolding between the

    Burmese military regimes and the

    Tai/Shan and other ethnic nationals,

    I sometimes feel so helpless and dev-

    astated. There is always an obstacle to

    stop every forward step made by the

    Tai/Shan and other ethnic nationals;

    most of the obstacles are caused by the

    enemy, but some of the obstacles are

    their own making.

    Now is a very crucial time for all non-

    Burman ethnic nationals. It is a time

    to hit or miss the opportunity of being

    free from the bullying and aggressive

    rule of the dictators. The dictatorial

    Government is calling for peace, and

    all the resistant groups will be meet-

    ing with Thein Sein's Government to

    negotiate terms.

    Please be reminded by this advice of

    F J Kennedy Let us never negotiate

    out of fear-but let us never fear to ne-

    gotiate

    I feel that some of the leaders have

    not thought far ahead of what criteria

    will bring real peace to their country

    and people. Every time some of them

    meet up with the dictators they accept

    rewards and give in to the terms im-

    posed on them, but afraid to negotiate

    for the terms that will bring real peace

    to their homeland and people.

    Although all the ethnic groups say that

    they are allies, and in reality want the

    same things, they do not work together

    as one body, and tend to give in to the

    terms the dictators throw at them. They

    shout for unity but do not know how

    to promote unity and fight together for

    what they want.

    As long as the dictatorial armed forces

    are in their territory peace cannot be

    achieved, and their people will never

    be free from human rights violations.

    In order to achieve peace all the dic-

    tatorial armed forces will have to be

    withdrawn from the ethnic homelands.

    Some ethnic nationals are afraid, hesi-

    tating and wasting time.

    Unless the dictators change their men-

    tality and believe that all human beings

    are born equal, there can never be good

    relationship between them and other

    ethnic nationals, so peace is unachiev-

    able.

    Unless the people have a say in the de-

    velopment and welfare of their home-

    land, there is no hopes for democracy,

    and the dictators will forever rule over

    them and their homeland.. Without de-

    mocracy there can be no peace

    The dictators have embraced Daw

    Aung San Suu Kyi to increase their

    weight against the other ethnic nation-

    als, and use her to gain legitimacy from

    the UN and the Super Power, such as

    America.

    Time is critical, and once the dictators

    are accepted b y the UN as a legitimate

    government of Burma there is very

    little the other ethnic groups can do

    about it, except remain under the same

    old government and hope for change to

    come in another half a century. So far,

    there is little or no sign of the UN or

    powerful Governments to consider the

    voice of non-Burman ethnic nationals,

    or take their legal rights and grievances

    into consideration.

    The present government under Thein

    Sein is desperate to be recognised as

    a legitimate Government and is try-

    ing every means to get it. He has the

    world's most respected Icon on his

    side, and will demonstrate to the in-

    ternational communities that the re-

    gime has changed, and he might even

    release all prisoners, but for certain,

    the regime will never release the eth-

    nic states out of their control. To have

    other ethnic states under their control

    has been the obsession of the hard-line

    Burmese politicians since the British

    and the Japanese Occupation. They

    thought that Bogyoke Aung San made

    a grave mistake by agreeing with other

    ethnic nationals, the principles of the

    Panglong Agreement: freedom, equal-

    ity and self-determination. He was as-

    sassinated.

    RCSS and Burmese Government

    agree for ceasefireThe Burmese government officially of-

    fers peace negotiation to ethnic armed

    groups (announcement No. 1/2011) on

    August 2011. As RCSS/SSA always

    welcomes to peacefully solve the po-

    litical issues through politics, RCSS/

    SSA and a Burmese government del-

    egation met at an undisclosed venue

    on the Thai-Shan border yesterday, to

    solve the long-standing political prob-

    lems.

    At the meeting on 19 November 2011,

    both parties agreed for a ceasefire

    but to officially sign the agreement

    through the discussion at a later date.

    Burmese government delegation was

    led by U Aung Min Union Minister of

    Rail Transportation and it included Dr.

    Nay Win Maung, Dr. Kyaw Yin Hlaing

    and U Tin Maung Than. RCSS was led

    by the RCSS Chairman Lt. Gen. Yawd

    Serk and the RCSS Peace Committee,

    Sao Khuen Sai a RCSS Consultative

    Committee member, participated in the

    discussion. The MC (Master of Cere-

    mony) was Sao HarnYawngHwe who

    made this bilateral dialogue happen.

    Points for the first step of peace pro-

    cess between the two parties which

    were presented by U Aung Min are,

    1.To make ceasefire

    2.To form delegation and set up offices

    for communication

    3.To allow each party without arms to

    pass through each partys area of con-

    trol

    4.To set up the date and venue for

    political negotiation with Naypyidaw

    level

    4.To cooperate in the drug eradication

    After the ceasefire agreement is offi-

    cially signed, the second step of peace

    process for the development area will

    be discussed by both parties. Then

    Naypyidaw level discussion will be

    held.

    When asked by the Chairman of RCSS

    of what the Burmese government

    would do for the roles of ethnic poli-

    tics in the countrys political process,

    U Aung Min said:

    After the ethnic armed groups

    reached ceasefire with the government,

    it will call for Naypyidaw Conference

    (Similar to that of Panglong). The con-

    ference will be held in front of all the

    members of parliament at the parlia-

    ment. Every party concerned will be

    invited for the discussion to be able to

    find the political solution.

    With regard to this peace process,

    KNU, KNPP, CNF and KIO also sent

    their delegations to meet with U Aung

    Min in the same day and at the same

    Ceasefire Agreement Held in Loi Tai Leng

    RCSS/SSA held public meeting and press conference on ceasefire agreement with Burmese Government on10 December at

    Loi Tai Leng where monks, RCSS/SSA senior leaders, local people, SSA fighters and the journalists attended.

    The Statements on ceasefire agreement in Shan, English and Burmese were read out to the audiences.

    Next, Lt. Gen Yawd Serk, Chairman of RCSS made clarification over ceasefire agreement with Burmese Government tothe participants.

    He then answered the questions of journalist and group documentary photos were taken.

    64 Members of Ai Toy Militia Unit Desert

    to RCSS /SSAOn 22 December, 64 men of Ai Toy

    militia unit based in Wan Pan village,

    Laikha Township, Southern Shan

    State, bringing 64 assorted rifles along

    with them, deserted to and unified with

    RCSS/SSA.

    As Ai Toy commands his militia unit

    with injustice and he killed 13 in-

    nocent civilians including his mens

    family members recently, his men

    could not tolerant his oppression and

    they decided to desert to and join with

    RCSS/SSA. They handed over their 64

    assorted rifles and mortars with 12865

    cartridges and mortar shells as well as

    16 hand-held communication devices.

    RCSS/SSA presented cash assistance

    each K 200,000 to them.

    After joining with RCSS/SSA, Ai Toys men disclosed about Ai Toy links with

    drug trade and they led RCSS/SSA troops to the narcotic drug store at their base

    with opium, amphetamines, massive precursor chemicals and equipments for

    making amphetamine and heroin.

    Moreover, RCSS/SSA fighters captured a drug trafficker, Mr. Ar Lao living in (5)

    Initial Peace Agreement Inked between State Level Peace Group

    and RCSS/SSA

    NAY PYI TAW, 3 Dec A ceremony to sign an initial agreement between the state level peace group from the Shan State

    Government and RCSS/SSA in order to build peace at the invitation of the Government of the Republic of the Union ofMyanmar took place at Taunggyi Hotel in Shan State yesterday.

    Present at the ceremony were leader of Union level peace group Union Minister for Rail Transportation U Aung Min,

    Union Minister for Electric Power No.2 U Khin Maung Soe, Shan State Chief Minister U Sao Aung Myat, State Minister

    for Security and Border Affairs Col Aung Thu, General Staff Officer (Grade-1) of Triangle Region Command Lt-Col Zaw

    Tun Myint, State Advocate General U Maung Maung and officials and U Sai Lu of RCSS/SSA peace group and leading

    members of the Shan State Army. First, the initial agreement was signed in the presence of Union Ministers U Aung Min

    and U Khin Maung Soe and Lt-Col Zaw Tun Myint and they exchanged gifts.

    On 1 October, Capt. Yata Oo and his 20

    Burmese soldiers from LIB 332 stationing

    in Wan Yeung base forced the villagers of

    Wan Yeung village tract Laikha Town-

    ship to provide them bamboos and posts

    Ethnic Shan forces who signed a truce

    with the Burmese government early

    this month have vowed to take up arms

    against Naypyidaw again if the group's

    basic rights are not respected and pro-

    tected.

    "The cease-fire is meant [to be] the start-

    ing point for peace-building and the

    development of living standard of our

    people so that one can make progress and

    the test of sweetness of democratic right

    as one of people in the world," the Resto-

    ration Council of the Shan State (RCSS)

    and Shan State Army (SSA) said in a

    statement.

    The SSA, which has carried on an armed

    struggle for autonomy for decades,

    reached a peace agreement with the gov-

    ernment on December 2 after rounds of

    quiet negotiation.

    However, the pact is simply a cease-fireagreement and many different points

    needed further discussion, the statement

    said.

    SSA leader Lt-General Yawd Serk led his

    Shan delegation to kick off peace talks

    with Rail Transport Minister U Aung Min

    near the Thai border in November.

    At the first meeting, the government pro-

    posed four talking points: cessation of

    hostilities, opening a liaison office, roam-

    ing freely without arms and discussion of

    politics at Union level.

    The Shan countered with its own four key

    points: cessation of hostilities, solving po-

    litical issues through dialogue, setting up

    RCSS and SSA headquarters, and coop-

    eration on drug eradication.

    The sides reached a cease-fire in Taung-

    gyi, the capital city of Shan State, but

    could did not make any decision on the

    remaining points.

    Thein Sein's government announced a

    peace talk with all armed ethnic groups

    in August this year after its initial plan to

    force ethnic insurgents to serve as border

    guard forces under the military complete-

    ly failed.

    Before the Shan group, the government

    reached peace agreements with many

    other armed ethnic groups, including the

    United Wa State Army.

    The Shan group established contact with

    the authorities in late October to begin

    peace negotiations.

    As some points proposed by both sides

    had yet to be agreed upon, the Shan group

    said it has to wait and see what actions aretaken by the government toward minori-

    ties before it proceeds.

    ordered to compete the construction of

    fence within that day.

    On 7 September, 48 Burmese soldiersfrom LIB 515 based in Laikha Town-

    ship demanded 1.5 baskets of rice worth

    42500 kyat, 9 meat-cans worth 9000 kyat

    from the villagers of Nwang Len village,

    Panglong Township. They also looted 4

    viss of fresh fish worth 4000 kyat and 1.5

    baskets of rice worth 42500 kyat from the

    villagers of Nam Nwang village, Nwang

    village tract too.

    On 10 September, 30 Burmese soldiers

    from LIB 513 demanded 100,000 kyat in

    cash from Nwang Len village tract to pay

    them by 11 September.

    On 11 October, 40 Burmese soldiers from

    LIB 510 led by Lt. Col. Tin Oo entered

    Nam Aw village, Pansat village tract,

    Murng Kerng Twonshp and took a rest

    there. At 9 pm, one of Burmese soldiers

    raped a 18 year old girl, daughter of Loon

    Kya and Pa Nang.

    On 12 September, Burmese soldiers from

    Kho Mai base under LIB 578 based in

    Larng Khur Township ordered local vil-

    lagers of Wan Zit village tract to provide

    them 100 bamboos and 500 wooden posts

    with 5 feet long. The bamboos and theposts had to bring to the base by 13 Sep-

    tember or the villagers would be faced the

    fierce punishment.
