1. IntroductionThe Oaks (Merridale Road) Conservation Area wasdesignated by Wolverhampton City Council on 6thOctober 2004.

This document defines and records the specialarchitectural and historic interest of The Oaks(Merridale Road) Conservation Area and identifiesopportunities for enhancement. The omission of aparticular building, feature or space should not betaken to imply that it is of no interest.

Conservation areas are designated under theprovisions of Section 69 of the Planning (ListedBuildings and Conservation Areas) Act 1990. A conservation area is defined as “an area of specialarchitectural or historic interest the character orappearance of which it is desirable to preserve or enhance”.

Section 71 of the same Act requires local planningauthorities to formulate and publish proposals for thepreservation and enhancement of any parts of theirarea which are conservation areas.

Section 72 specifies that, in making a decision on anapplication for development in a conservation area,special attention shall be paid to the desirability ofpreserving or enhancing the character or appearanceof that area.

This appraisal satisfies the requirements of thelegislation and provides a firm basis on whichapplications for development within The Oaks(Merridale Road) Conservation Area can be assessed.

2. Location and setting

The Oaks (Merridale Road) Conservation Area islocated approximately one kilometre to the west ofWolverhampton City Centre. The conservationarea comprises three distinct groups of buildingswhich developed between the early 19th and mid20th centuries; the most significant of these is thetriangular site containing the Wolverhampton EyeInfirmary and Nurses’ Home.

The conservation area has a suburban location, on level ground, surrounded by mainly residentialdevelopment and close to a small secondaryshopping centre at Chapel Ash.

The northern half of the conservation area lieswithin Park Ward and the southern half lies withinGraiseley Ward.

3. History

The 1842 Tithe Map shows that the two principalroads that traverse the area, Compton Road andMerridale Road, had already been built but OaksCrescent had not been laid out. The north side ofCompton Road had started to be developed(including the present nos. 12-34 (even)) butotherwise the only significant buildings in the areawere The Oaks and a large house marked asChapel Ash House (now demolished) frontingCompton Road immediately to the west of thepresent Eye Infirmary.

Drainage maps of 1854 show that Oaks Crescenthad by then been formed and the present nos. 7,17-22 (consecutive), 28 and 34 had been built.Development on the north side of Compton Roadincluded the present nos. 42-44 and a public houseknown as The Royal Oak (but not the presentbuilding) on the site of the current public house ofthe same name on the corner of Compton Roadand Clarendon Street.

By 1871, development on the north side ofCompton Road, including the present nos. 2-6(even) and around Oaks Crescent, including thepresent number 15, was continuing. However,apart from a collection of very small buildingsinside the junction of the Compton and MerridaleRoads, the land now occupied by the EyeInfirmary was still entirely undeveloped. The nextsignificant development in the area was theInfirmary itself.

In the second half of the 19th century, industryand rail travel were steadily growing and theresultant air pollution coupled with poor socialconditions generally resulted in increasingnumbers of eye ailments in the population at large.It soon became apparent that The Royal Hospital,

which had opened its doors in 1845, would not beable to cope in this growing and specialised area.As a result, in 1881 the philanthropists ofWolverhampton gathered to rent a house in StMark’s Road at its junction with Salop Street to provide eye care facilities.Within the first year 2,264 cases had been treated and a larger facility was required. Localbenefactor, Philip Horsman, who had alreadygiven the Art Gallery to the town, offered £5,000on condition that a further £8,000 was raisedlocally. The necessary funds were secured and landin Chapel Ash was acquired from the Duke ofCleveland. Local architect T. H. Fleeming wascommissioned to prepare plans for the buildingand it was opened by the Earl of Dartmouth on 23 October 1888.

In the early years of the 20th century, further landwas acquired for the construction of the Nurses’Home. Designed by architect Arthur W Worrall,this opened in 1927 and by the start of the SecondWorld War 142,000 patients were being treatedannually. As demand for the services continued to grow, a fund was set up to provide a newoutpatients’ pharmacy and an accident andemergency facility and these were built by localarchitects Lavender and Twentyman, and opened in 1937.

The Infirmary was absorbed into the NationalHealth Service in 1948 and became recognised as acentre of excellence, both locally and nationally. Inthe latter years of the 20th century, improvementsin the effectiveness of Health and Safety legislationsaw a significant reduction in the numbers of eyeinjuries and the advent of day case surgery formore minor conditions saw bed numbers sharplydiminish. By 2004 the local health care trust madethe decision close the old eye infirmary and inMarch 2007 all eye services were transferred toNew Cross Hospital.

Summary of special interestThe conservation area is notable for the following:

• Architectural and historic interest of the area’sbuildings most of which date from the 19thcentury expansion of the city including twoentries in the Government’s Statutory List ofBuildings of Special Architectural or HistoricInterest (‘listed buildings’), four locally listedbuildings and a large number of ‘buildings oftownscape merit’;

• Wolverhampton Eye Infirmary which, as well asbeing of considerable architectural interest, hasplayed a pivotal role in the development andprovision of health care facilities inWolverhampton for almost 120 years;

• The ensemble of the original Eye Infirmary of1888, the Nurses’ Home of 1927 and theOutpatients’/Accident and EmergencyExtension of 1937 all three of which are locallylisted buildings;

• Two listed buildings: The Oaks, a large stuccohouse c.1830, and nos. 12 – 34 (even) ComptonRoad, a terrace of 12 houses c.1830;

• The range of 19th century house types (detached, semi-detached and terraced);

• Well treed open space (private) to the rear ofThe Oaks;

• Mature roadside and garden trees particularlyalong Merridale Road and within the historiccurtilage of The Oaks, many of which wereplanted as part of the original 19th centurydevelopment of the area;

• Public open space at the ComptonRoad/Merridale Road junction;

• Quiet suburban atmosphere of Oaks Crescent.

Present character: activities and usesUntil the opening of the Eye Infirmary in the late 1880s, the area was primarily residential. Itdeveloped as part of the western expansion ofWolverhampton serviced by shops and services inChapel Ash, then linked by tram to the city centre.Excluding the site of the Eye Hospital, the area stillremains primarily residential although other uses arepresent in Compton Road. There is a service andrepair garage at number 38/40 Compton Road andoffices in premises (formerly dwellings) between

nos. 2-10 (even) Compton Road. The Royal OakPublic House (1905) in Compton Road replaces anearlier pub of the same name.

Oaks Crescent is exclusively residential althoughnumber 7 and number 28 have been converted fromfamily dwellings into a residential nursing home(‘The Squirrels’) and flats (‘Withymoor Court’)respectively. The Oaks, a large private house of the1830s, has been converted into flats and newresidential blocks have been built within its curtilage.

Today, Compton Road and Merridale Road continueto be two of the three principal approach roads tothe City from the west, meeting the third (TettenhallRoad) towards the eastern boundary of theconservation area. All three routes carry significantvolumes of traffic, particularly during peak periods,and this clearly has an effect on the environmenthere. However, the constituent parts of theconservation area have sufficient integrity andintrinsic quality and the townscape and extensivetree cover in general are sufficiently robust towithstand these adverse impacts.

Development of street patternWilliam Yates’ 1775 map of the County of Staffordillustrates Compton Road as one of the two mostprominent routes from Wales and the west leading tothe south-west of the city – the other route beingTettenhall Road. Fifty years later, Smart’s TradeDirectory for 1827 shows, at the western limit of thecity, ‘CHAPEL ASH GATES’ written acrossTettenhall Road and Compton Road (marked ‘FromShrewsbury’ and ‘From Bridgnorth’ respectively)and, written along the course of today’s MerridaleRoad, ‘From Merridale’. The layout of the conservation area’s streets was thussubstantially in place at the start of the 19th century.

Architectural and historic characterThe architectural and historic character of theconservation area is assessed first with regard to the Infirmary site, the focus of the conservationarea, followed by a general overview:

1. The Infirmary siteThe Wolverhampton and Midland Counties Eye Infirmary of 1888 stands in a self-contained site bounded by Compton Road and MerridaleRoad. Together with its 20th century modernistextension and the Nurses’ Home, it is the dominant architectural composition within the conservation area.

The original Eye infirmary was designed by thearchitect T.H. Fleeming (1849-1935) whose works in Wolverhampton also include Barclays Bank,Lichfield Street (1876), the College of AdultEducation, Old Hall Street (1899) and the late 19thcentury spire of St Jude’s Church, Tettenhall Road(itself built in 1867-9), all of which are grade II listed buildings, and the former Higher GradeSchool, Newhampton Road which is on the Council’s Local List.

The Infirmary was built by Wolverhampton buildersHenry Willcock & Co. at a cost of £13,000 (see photoon page 23). It opened in 1888 providing three men’sand three women’s wards with thirty beds and fivechildren’s cots. A significant part of the cost was metby local philanthropist, Philip Horsman, whosebenefaction is commemorated in the Fountain in StPeter’s Gardens. The Infirmary is constructed of redbrick with elaborate brick details and stonedressings. It is built to an irregular plan in a simpleGothic style under a plain clay tiled roof with crestedridge tiles and two spired turrets, one of which hasan inscribed stone plaque bearing the legend: ‘EYEINFIRMARY AD 1887’. Some of the original sashwindows have been replaced and late 20th centuryextensions to the original west front have detractedfrom the character and appearance of the original building.

The architect for the Nurses’ Home was Arthur W.Worrall who was born in Heath Town in 1868. Hisother works include the Nurses’ Home of 1907 atthe Royal Hospital and, also at the Royal Hospital,the Edward VII Memorial Wing that was designedin 1911 and is now statutorily listed (grade II) asan integral part of the principal WolverhamptonRoyal Hospital building.

The Nurses’ Home is of three storeys, built of brickwith stone dressings under steeply pitched, plainclay tiled roofs. The principal (south) elevation isof nine bays and the two bays at either end projectforward under gabled roofs, with splayed baywindows at ground floor level. The centralentrance door has leaded-light stained glass upperpanels with an elaborate stone doorcasesurmounted by a stone panel incised with the date1928. Original six pane vertically sliding sashwindows survive throughout the building. The rear(north) elevation of the building is of a moreutilitarian, but entirely complementary, style but ithas been disfigured by an unsightly array of pipework and other service installations. There is aninappropriate flat roofed, single-storey extensionattached to the northwest corner of the buildingbut otherwise it survives externally in its originalcondition.

The Outpatients’/Accident and EmergencyExtension was built in 1937, just ten years after theNurses’ Home, but it belongs to an entirelydifferent architectural world. The architect wasRichard Twentyman (1903-79) of Lavender andTwentyman which was probably the mostimportant architectural practice working inWolverhampton in the middle of the 20th century.Other important buildings by Twentyman includeSt Martin’s Church, Dixon Street that, despite itsrecent date (1938-39), is statutorily listed (grade II)and St Andrew’s Church, St Andrew’s Close andBushbury Crematorium, Bushbury Lane, both ofwhich are included in the Council’s Local List.

His building followed the principles of theInternational Modern Movement that rejectedhistoric precedent as a source of architecturalinspiration and considered function as the primegenerator of form, using materials and technologyin an entirely honest way. It is made up of a seriesof one and two-storey red brick boxes surmountedby flat roofs with projecting concrete parapets. The north and south elevations are parallel withthe Compton and Merridale Roads respectivelyand these are connected at their east ends by atwo-storey, concave brick wall facing towardsChapel Ash. Windows are square or rectangularand set into deep concrete reveals, some withconcrete mullions. Internally, an interveningmezzanine level provides impressive, light and airy double height spaces for the waiting hall and consulting room.

2. General overviewMost development within the conservation areawas part of the 19th century expansion ofWolverhampton and, broadly speaking, containsthree distinct phases of development: early, midand late 19th century. Oaks Crescent contains anumber of detached and semi-detached dwellingsfrom the 1920s but these, though typical ofsuburban domestic house building of the period,do not contribute greatly to the specialarchitectural interest of the conservation area.

Early 19th centuryNumbers 12-34 (even) Compton Road and TheOaks in Merridale Road (both grade II listedbuildings) are the principal buildings from theearly 19th century. They were probably built totake advantage of the construction of DarlingtonStreet, completed in 1823, which greatly improvedaccess from Chapel Ash to the city centre therebystimulating the development of the westernapproaches to Wolverhampton.

These buildings have unadorned stucco facades, atypical early 19th century treatment (red brickbecomes the more prevalent material after c.1850),and a rigorous symmetry. All windows are sashes,second floor windows are less tall than first andground floor windows. Numbers 12-34 (even)Compton Road is a terrace of twelve three-storeyhouses built c.1830 consisting of a 14-windowrange, the central four of which project forwardand are slightly higher. The first floor cast ironbalconies to nos. 12-20 and 26-34 complement theplain cast iron railings and gates that run the fulllength of the terrace on the back edge of thefootway and are another characteristic early 19thcentury architectural feature.

The Oaks was built as a private house in c.1830.The building is of three storeys and the elevationsare stuccoed under a hipped slate roof. The frontelevation (to Merridale Road) comprises asymmetrical three-window range with a central,first floor Venetian window over a projecting 20thcentury principal entrance porch (see photo onpage 2).

Mid 19th CenturyOf particular note are nos. 7, 17-22 (consecutive),28 and 34 Oaks Crescent which date from c.1850,and number 15 Oaks Crescent, which dates fromc.1865.

Numbers 7 and 15 Oaks Crescent are both largedetached houses. Number 7 has renderedelevations under steeply pitched roofs (nowcovered in inappropriate concrete tiles) andelaborate shaped gables with stone copings andball finials (see photo on page 8). Number 15 is of brick under a natural Welsh slate roof withsubstantial brick chimneys. Much original external joinery survives on both properties.

Numbers 17-22 (consecutive) comprise three pairsof substantial semi-detached houses, constructedof red brick with buff brick quoins. They havesteeply pitched roofs with elaborate piercedbargeboards, although original roofing materialshave been replaced in a mixture of concrete tilesand synthetic slate. Much original external joinery(which comprises a mixture of sashes andcasements) still survives.

Number 34 Oaks Crescent dates from c.1850 andis in Tudor Revival style. It has rendered elevationsunder steeply pitched clay tiled roofs. Threecourses in plain tiles alternate with three courses offish-scale tiles, running the full height of the roofslopes and there are crested ridge tiles (somemissing). The front elevation incorporates a two-storey projecting gabled porch and the porch, endgables and dormer windows have mock timberframing and elaborate, pierced bargeboards. A contemporary, two-storey coach-house inmatching materials and details adjoins to the north(see photo on page 15).Above:

Late 19th centuryOn the south side of Compton Road, to the west of the Eye Infirmary, is a small group of fiveproperties dating from c.1905. Numbers 21-29(odd) are of two storeys and constructed of redbrick under slate roofs, although that to number 21has been replaced in concrete tiles. The casementwindows retain original leaded-light stained glassas do the panels in the main entrance doors andside screens, which are set back in open porches.

20th centuryWith the exception of Twentyman’s Modernistextension to the Eye Infirmary, the 20th century is not well represented in the conservation area.The Royal Oak (c.1905) is an exuberant red brickpublic house that has been designed to takeadvantage of its location on the corner ofClarendon Street and Compton Road. Number 31 Compton Road (c.1930) is constructed of brick,with the first floor elevations rendered, also undera slate roof with leaded light casement windowsand fine quality Art Nouveau wall tiling in theopen porch.

Building types, prevalent building form and plot sizesThe most significant buildings in the conservationarea are the purpose-built Infirmary buildingsincluding an adjacent Nurses’ Home. Elsewhere,the most prevalent building form is the detachedand semi-detached house and a single example of aterrace (nos. 12-34 Compton Road).

Also of note are an early 20th century public house,The Royal Oak (see photo on page 24) and a 1930sshowroom (nos. 38/40 Compton Road).

There is a mix of house types, sizes and designs,reflecting the 100 year period of development of the area. Two storeys is the norm but someproperties, particularly in Compton Road, rise to three storeys.

Oaks Crescent’s 19th century houses are well setback in long linear plots whilst early 20th centuryhouses, notably nos. 1 to 5 Oaks Crescent are laidout less spaciously, squeezed into a formerly vacantplot. Development along Compton Road holds to

a well defined back-of-pavement line with smallfront ‘gardens’ enclosed with railings or wall –although means of enclosure around many frontareas has now been removed.

Building materialsThe conservation area’s early 19th centurybuildings are built of stuccoed brick, acharacteristic of that period. Red brick is the mostcommon building material of the late 19th centurybuildings, sometimes with stucco dressings forwindows and doors.

Welsh slate or plain clay tile is the prevalentroofing material although many slate and tile roofshave unfortunately been replaced with concretetiles to the detriment of the historic building.There is a wide variety of window openings andglazing patterns. Vertical sliding sashes arecommon but large late 19th century brick villasoften have a multi-paned upper sash above asingle-paned lower sash. Windows would havebeen almost exclusively timber but many havebeen replaced with uPVC or aluminium.

Listed buildingsA listed building is one that is included on theGovernment’s Statutory List of Buildings of SpecialArchitectural or Historic Interest. These buildingsare protected by law and consent is required fromthe City Council before any works of alteration,extension or demolition can be carried out.

The Statutory List includes the following twoentries within The Oaks (Merridale Road)Conservation Area, both grade II:

• Nos. 13-34 (even) Compton Road and attachedgates and railings

• The Oaks, Merridale Road

Locally listed buildingsAs well as listed buildings, Government guidanceon the protection of the historic environment(Planning Policy Guidance 15) makes provision forplanning authorities “to draw up lists of locallyimportant buildings, and to formulate local planpolicies for their protection, through normaldevelopment control procedures”. Works thatrequire planning permission to a building includedin the City of Wolverhampton Local List will beexpected to take into account the specialarchitectural and historic interest of the property.

The following four buildings are included inWolverhampton’s local list:

• The Wolverhampton and Midland Counties EyeInfirmary, Compton Road (the original buildingof 1888);

• The Nurses’ Home to the Eye Infirmary,Merridale Road;

• The Outpatients’/Accident and EmergencyExtension to the Eye Infirmary, Compton Road(1937 Extension);

• Number 34 Oaks Crescent and adjoining coach house.

Buildings of Townscape MeritIn addition to listed and locally buildings there are a number of unlisted buildings which havebeen judged as making a positive contribution to the character and appearance of theconservation area. This follows advice provided in the English Heritage guidance on conservation area character appraisals, and within PlanningPolicy Guidance Note 15 (PPG15), both of whichstress the importance of identifying and protectingsuch buildings.

The buildings, which are shown on the TownscapeAppraisal map (see page 11), are considered to begood, relatively unaltered examples, of their typewhere some original materials and details, and thebasic, historic form of the building, has survived.Where a building has been adversely affected bymodern changes and restoration is eitherimpractical or indeed, not possible, they areexcluded. There is a general presumption infavour of retaining all Buildings of TownscapeMerit, as set out in PPG15.

Focal points, vistas and viewsThe conservation area is flat and views arerestricted by trees, high walls and roadsidedevelopment. Within the conservation area, the two turrets of the Infirmary (one on its westelevation and one on its north elevation) are tall landmarks best viewed from the immediatevicinity of the Infirmary or from the east alongCompton Road.

Looking out from the conservation area, views areunremarkable but the spire of St. Mark’s in ChapelAsh can be glimpsed from Merridale Road and thetall brick chimney of the brewery in Chapel Ashcan be spied from Compton Road. Thoughneither view is distinguished, each helps to locatethe conservation area within its wider context.

Open spaces, green areas and treesThe conservation area lies within the tightly-kniturban landscape of western Wolverhampton andthe only public open space is a triangle of land inthe angle of the junction of Compton Road andMerridale Road. The area is paved and contains acentral flower bed and Ginkgo trees but theconstant sound of passing traffic spoils theatmosphere of the area and counteracts well-meaning attempts to enhance it.

Parking and modern extensions have encroachedupon former open space around the Infirmary buta small grassed area with trees remains betweenthe hospital and the Nurses’ Home. This spaceaids the setting of such a large institutionalbuilding and once served as a welcome greengarden for patients and visitors.

The largest open space in the area lies within thesemi-circular loop of Oaks Crescent and wasformerly the garden of The Oaks. Though muchof the former garden, especially close to MerridaleRoad, now contains late 20th century residentialbuildings, the southern half remains undevelopedand contains a fine collection of mature trees,many dating from the 19th century (see aerialphoto on page 3).

Despite it’s urban location, trees make a significantand positive contribution to the conservation area.In particular, there is a line of mature trees alongthe north side of Merridale Road and along thewestern boundary of the Eye Infirmary. Asmentioned above, trees to the south of The Oaksare also important and enhance the tranquillity of

Oaks Crescent. This area contains a wide varietyof attractive mature trees including sycamore, oak,yew, lime, beech and holly. The maintenance ofthis open, well treed area is essential to the settingof the statutorily listed building and to thecharacter and appearance of the conservation area.Together with mature trees on the south side ofMerridale Road, in the grounds of The Oaks, thesetrees also help to soften the impact of the traffic onthe environment of Merridale Road itself.

Significant trees or tree groups are marked on theTownscape Appraisal map. Many of these treeslocated on private land are covered by TreePreservation Orders. Lack of a specific referencedoes not imply that a tree or group is not of value.

Public realmThe public realm is modern. There are noinstances of historic floorscape and, with theexception of some 19th century boundary walls,railings and gate piers, few items of historicinterest.

Iron railings, bollards and young trees in front ofnos. 12-34 Compton Road add some grandeur tothe well-restored grade II listed terrace.

An awkwardly shaped and traffic-dominated openspace at the junction of Compton Road andMerridale Road, in front of a disused and vacantpublic convenience, has been carefully landscapedin recent years.

Area 1: The Oaks and Oaks Crescent

General character and townscapeThe Oaks is a small mansion whose presence onthe street is restricted by trees and walls – andparked cars. It was the family home of JohnMarston J.P. (1836-1918), founder of theSunbeam Company, Mayor and Freeman and hisson, Sir Charles Marston (1867-1946), industrialistand author, but has now been converted to flats. There are substantial late 20th century blocks tothe east and west of The Oaks. The forecourtdirectly to the north of The Oaks is enclosed tothe east and west by curved walls which springfrom the north-east and north-west corners of theprincipal building and terminate on the back edgeof the footway in substantial rendered piers withstone copings. To the rear of The Oaks is anotable copse of trees.

Much of the Merridale Road frontage within theconservation area is marked by tall, red brickwalls, which help to soften the impact of themodern blocks and screen parking areas most ofwhich are generally well integrated into the finelandscaped setting of the house.

The full length of the boundary to Oaks Crescentwas once marked by a brick wall with stonecopings approximately one metre high,surmounted by railings. The vast majority of thiswall survives, although some of the copings havebeen replaced in concrete and all of the originalrailings have been lost. Nevertheless the wall stillprovides an important sense of enclosure of therear gardens.

The front gardens of properties in Oaks Crescentcontain a large number of important mature treesincluding beech, chestnut, lime, silver birch, yew,mountain ash, holly and flowering cherry. Thesetrees enhance the settings of the propertiesconcerned and the character and appearance of thecrescent generally, but they also complement theextensive tree cover in the grounds of The Oaksand, therefore, help to preserve and enhance thispart of the conservation area.

General character and townscapeThere are three principal buildings on the site: theoriginal Infirmary of 1888; the Nurses’ Home of1927; and the Outpatients’/Accident andEmergency Extension of 1937. These buildings arequite different in style but all are of definitearchitectural and historic interest and all weredesigned by significant local architects.

On the Merridale Road frontage, an original redbrick wall with heavy stone copings, set betweensubstantial stone piers survives although the twopiers at the entrance to the west of the Nurses’Home have been rebuilt in brick (with the originalstone pier caps reinstated). The full length of thewall was originally surmounted by railings, thoughonly around half remains and much of that is inpoor condition.

A line of substantial and mature lime trees, runsclose to and parallel with Merridale Road (withinthe curtilage of the Infirmary). The row forms avery important element in the landscaped settingof the site, providing a very strong definition of thesouthern boundary of the site and screening thebuildings and their grounds very effectively fromthe activity and traffic noise outside.

Immediately to the east of the Infirmary site is asingle-storey public convenience that also containsan electricity substation block. Like the 1937Twentyman building, but on a much smaller scale,the building comprises a series of flat-roofedblocks in a complementary brick. There is aconcave, timber canopy covering an externalseating area which echoes the two-storey, concaveeast elevation of the 1937 building. The building is currently disused.

Local features• Brick wall bounding the site of the Infirmary;• Pleasant garden to west of main Infirmary

(now enclosed with hoarding);• Bollards with Wolverhampton crest at junction

of Merridale Road and Compton Road;• Trees and circular flower bed in front of former

public convenience.

Negative features• Western extensions to the Infirmary, especially

the three-storey external staircase, have spoiledthe setting of the building and upset thecomposition of its western façade;

• Much of the curtilage of the Infirmary site hasbeen enclosed by hoardings since the sitebecame surplus to requirements but there is stillinformal car parking on the Compton Road side both of which detract from the settings of theprincipal buildings and from the character andappearance of the conservation area.

• The Nurses’ Home is also currently vacant;• The public convenience is boarded up

and vacant;• Loss of original railings;• Traffic noise and fumes.

General character and townscapeThe most notable building in Compton Road is nos. 12-34, an early 19th century terrace of houses.Numbers 4-10 Compton Road (even) date from the late 19th century. They have stuccoed elevationsunder slate roofs (some artificial) and are of threestoreys, largely complementing the listed terrace in terms of scale, proportion and materials.To the west of the listed terrace, number 36 and nos. 42-44 are again of three storeys and are entirelycomplementary to adjoining buildings, although both have brick elevations (with nos. 42-44 painted).Numbers 38-40 comprise a two-storey garage, datingfrom the 1930s. It has rendered elevations with largedisplay windows.

To the west of number 44 the former site of CoopersHotel has been redeveloped to provide 24 apartmentsin a Regency style three storey development withparking areas to the rear.

To the west of this new development, andpunctuating the corner of Compton Road andClarendon Street, is the Royal Oak Public House. It is of two storeys, constructed of brick withelaborate brick details under a plain clay tiled roof with crested ridges.

On the opposite (south) side is a small group of fiveproperties dating from c.1905 (nos. 21-29 (odd)) andsingle detached house of c.1930 (no 31).

6. Management Proposals

Conservation area review 2010The Oaks (Merridale Road) Conservation Areawas reviewed in 2010 and a new appraisal andmanagement proposals went out to publicconsultation between 22nd February and 2nd Aprilthat year. The results of the consultation werereported back to members in February 2011 andapproval was given to the management proposals.No changes were made to the boundary of theconservation area and no further additions weremade to the Local List.

Use of Article 4 directions The incremental loss of original building materials,boundary walls and architectural detailing and thereplacement of painted timber windows and doorswith uPVC has been noted as a ‘negative’ inrelation to The Oaks (Merridale Road)Conservation Area. For family houses, suchchanges are called “permitted development” as setout in the Town and Country Planning (GeneralPermitted Development) Order 1995 (amended2008), and owners do not need permission fromWolverhampton City Council as the local planningauthority. However, powers exist to the Council,known as an Article 4 (1) Direction to whichArticle 6 applies 1, to withdraw some of thesepermitted development rights in the interests ofpreserving and enhancing the special characterand appearance of the Conservation Area.

An Article 4(1) Direction was made in theconservation area on 15th December 2010 andlater confirmed following consultation since noobjections were received for properties affected.This direction withdraws permitted developmentrights for the unlisted dwelling houses identified asbuildings of townscape merit in the conservationarea. This means that potentially harmfulalterations to houses are given due considerationthrough the planning process to help ensure thepreservation of unique architectural features andtraditional materials.

The following properties are covered by the TheOaks (Merridale Road) Conservation Area Article4(1) Direction:

• Compton Road – Nos 27,31 and 44

• Oaks Crescent – Nos 1,2,3,4,5,15,17,20,21,22,23, 24, 26 and 34

In detail, the Article 4 (1) Direction requires thathouse owners or tenants obtain planningpermission for a prescribed range of developmentwhich materially affects aspects of the externalappearance of dwelling houses in the conservationarea. This includes various kinds of developmentfronting the highway such as the enlargement,improvement, or other alteration of a dwellinghouse; alterations to the roof, the construction ofan external porch; and the painting of a dwellinghouse, or of a building or enclosure within itscurtilage. The Article 4 (1) Direction also bringsunder planning control the demolition of gates,fences, walls or other means of enclosure, if it iswithin the curtilage of a dwelling house and frontsa highway.

Commercial properties or buildings that aredivided into flats (i.e. in “multiple occupation”),are already controlled more rigorously as they havefar fewer “permitted development” rights thandwelling houses.

Opportunities for enhancement

The council should also:• Encourage restoration of architectural

detail/reversal of unsympathetic alterationswhere there is sound evidence of the originals,which is essential to the design and character of key historic buildings, especially timberwindows, chimney stacks and original roofcovering;

• Promote awareness of the value and importanceof the conservation area amongst residents witha view to highlighting the importance ofcarefully considering any alteration ordemolition (particularly that which does notrequire planning permission) and encouraginghigh standards of maintenance;

• Produce advisory guidance and ‘best practice’notes which would assist in retaining the area’sprevalent historic character and appearance e.g.written advice regarding (a) alterations tohistoric buildings, (b) development withinconservation areas, (c) the use of materials, (d) tree management and (e) residential parking in front gardens;

• Promote, in association with the relevantproperty owners, tree management and re-planting programmes in relation to the EyeInfirmary and The Oaks respectively, in orderto protect and enhance the significantcontribution made by the trees to the characterand appearance of the Conservation Area;

• Seek to promote the removal of car parkingfrom the area immediately to the north of The Oaks;

• Encourage retention, reinstatement and repairof historic boundary treatments where there isdocumentary or physical evidence to determineoriginal form or detailing, in particular thereplacement of missing railings to the MerridaleRoad frontage of the Eye Infirmary andreinstatement of the front boundary wall and railings at The Oaks;

• Seek to restore and bring back into use the Eye Infirmary and Nurses’ Home buildings onMerridale Road and the public convenienceblock at the junction of Compton and MerridaleRoads;

• In the context of development proposals seek to secure the removal of the late 20th centuryextensions from the west front of the originalEye Infirmary and the north-west corner of theNurses’ Home and the re-instatement of theelevations to their original form (see photos onpage 23).

Monitoring and reviewThis document should be reviewed every five years in the light of the Local Development Framework and emerging government policy. A review should include the following:

• A survey of the conservation area;• Photographic record of the conservation area;• An assessment of whether the various

recommendations detailed in this documenthave been acted upon, including proposedenhancements;

• A building condition survey;• The production of a short report detailing the

Statutory provisionsDesignation as a conservation area brings a number of specific statutory provisions aimed at assisting the “preservation and enhancement” of the area. These are as follows:

• The local authority is under a general duty toensure the preservation and enhancement of theconservation area, and has a particular duty toprepare proposals (such as conservation areaappraisals or grant schemes) to that end;

• In the exercise of any powers under thePlanning Acts with respect to any buildings orother land in a conservation area, the Councilmust take into consideration the desirability ofpreserving or enhancing the character orappearance of that area;

• Extra publicity is given to planning applicationsaffecting conservation areas. This is usuallyachieved through the use of advertising in thelocal newspaper;

• Conservation Area Consent is required for thedemolition of most unlisted buildings andboundary walls in a conservation area and thelocal authority or the Secretary of State maytake enforcement action or institute a criminalprosecution if consent is not obtained.

• Written notice must be given to the Councilbefore works are carried out to any tree in the area;

• The display of advertisements may be somewhatmore restricted than elsewhere;

• The Council or the Secretary of State may be able to take steps to ensure that a building in aconservation area is kept in good repair (similar to the powers which protect listed buildings);

• Limited financial assistance may be available forthe upkeep of a building in the conservationarea through grant schemes with EnglishHeritage or the Heritage Lottery Fund, (thoughthese are usually targeted to areas of economicdeprivation).

The requirements for planning permission in a conservation area:

Dwelling housesCertain works to family houses within aconservation area, which are normally consideredto be “permitted development”, require planningapproval from the Council. The overall effect ofthese additional controls is that the amount ofbuilding works which can be carried out to afamily house or within its grounds withoutneeding to submit a planning application is morerestricted in a conservation area than elsewhere.

It is difficult to summarise all of the rules so it isalways best to check in advance with a planningofficer at the Council to find out if permission isrequired for any of the following:• Building any kind of extension or out building;• Verandas, balconies or raised platforms of any

kind;• Any change to the roof including inserting

new windows;• External cladding;• Installation of satellite dishes and

microgeneration equipment.

Commercial properties and buildings dividedinto flatsIt should be noted that that commercial properties(such as shops and public houses), houses whichare in multiple occupation (flats) and apartmentblocks have far fewer permitted developmentrights than individual houses. Planning permissionis required for many alterations to these buildingsincluding replacement windows and installing newshop fronts.

It is recommended that any proposals for newdevelopment or alterations of existing buildingsin a conservation area should be discussed with a planning officer at the Council beforecommencing work on site. Telephone enquiriesshould be made to City Direct (01902) 551155.Wolverhampton City Council will consider themerits of individual planning applications andtheir impact on the character and appearance ofthe conservation area. Where there is adetrimental impact on the character andappearance of a conservation area, it is unlikelythat planning permission would be given.

Works to treesWithin conservation areas, anyone intendinglopping or felling a tree greater than 75 mm.diameter at 1.5 metres above the ground must givethe Council six weeks written notice beforestarting the work. This provides the Council withan opportunity of assessing the tree to see if itmakes a positive contribution to the character orappearance of the conservation area, in which casea Tree Preservation Order may be served. Thisprotects the tree from felling or inappropriatelopping. Fruit trees are no longer exempt.

AdvertisementsAdvertisement controls are tighter in aconservation area. Certain categories of ‘deemedconsent’ advertisements which may have asignificant visual impact are not permitted fordisplay without the Council’s specific consent.

The Unitary Development PlanThe Wolverhampton Unitary Development Plan(UDP) 2001-2011 is a planning document whichcontains policies and proposals for the physicaldevelopment and use of land, including measuresfor the protection and improvement of theenvironment. The UDP is used by the Council inreaching decisions on planning applications andproposals, which should be in accordance with thedevelopment plan unless material considerationsindicate otherwise. Chapter 6 of the UDP containspolicies for the historic environment includingconservation areas.

Sustainability Statement

The Wolverhampton Revised Unitary Development Plan (UDP) sets out theCouncil’s policies which are used for development control purposes. This plan willeventually be replaced by a new kind of policy document called a LocalDevelopment Framework (LDF) comprising a number of documents includingSupplementary Planning Documents (SPD) which will provide detailed policies onspecific issues. These documents will require sustainability appraisal.

Recent guidance from the (Office of the Deputy Prime Minister) ODPM andEnglish Heritage (2005) indicates that Conservation Area Appraisals (CAAs) shouldnot be adopted by local authorities as SPD and therefore do not requiresustainability appraisal. CAAs will however be used to support forthcoming SPD onthe Historic Environment which will require sustainability appraisal.

By their very nature, conservation area appraisals focus on the environmentalaspects of a historic area but can also acknowledge social or economic problemswhich have links to environmental conditions. CAAs can highlight issues butcannot guarantee the timing or implementation of solutions. For example highwayissues may depend upon programmes within the West Midlands Transport Plan orthe identification of need for significant investment in buildings may rely onsecuring funding from external sources, the availability of which may be restricted.The identification of the need for investment in the context of a CAA can howeverbe beneficial when bidding for resources or reviewing programmes.

Preparing CAAs can have social and economic benefits. They can renew the interestof local people in heritage and local history and raise awareness of conservationissues. In turn this can help to enhance community identity and encourageparticipation in the planning process.

Designation or extension of a conservation area can provide an impetus forenvironmental improvements which in turn can improve the satisfaction of localpeople with their neighbourhood as a place to live. However, a potentially negativeaspect may be the upward influence on house prices in conservation areas whichcould affect affordability of houses in an area. Economic benefits are likely to accruein particular where the image of an area is improved as a business location or as avisitor destination, generating local income and employment.

Appraisals help focus attention on the need to maintain and enhance the quality oflocal landscapes and townscapes and conserve and protect the local historicenvironment. Protection of trees and green landscapes may protect or providebiodiversity habitats and provide opportunities for people to appreciate wildlife,which is of particular value in metropolitan areas.
