Application Process and Terms & Conditions ‘Beautiful Marks’ 16 December 2017 – 12 February 2018 An exhibition by Taupo Art Connection at Taupo Museum Closing date for registration is 15th September 2017

The signed registration form warrants that the Terms & Conditions have been read and accepted.

Artwork 1. All artwork must be original and must be for sale. All artworks must be handmade (all components of the artwork to be 100%

made by the artist’s hand) 2. The exhibition committee has the discretion to not hang artworks, which are inappropriate for the Taupo Museum or are poorly

presented. 3. All 2D artwork to be supplied ready to hang with D-rings attached and stringed. 4. The media which will be accepted to the exhibition are: painting, mixed media, pastel, pencil, photography, sculpture, textiles

and other media in 2D & 3D 5. All artwork can only have a maximum length of 1m x 1m at any given side. 6. A maximum of two (2) artworks per artist will be accepted. 7. No reproductions of any sort will be accepted. 8. All artworks must be priced to include commission of 35% 9. Limited edition prints may be accepted. Prints must record the number of prints produced from the original (ie 3/20). 10. Each individual work must have the artist’s name, address, medium and the title of the work on the back of each artwork. 11. Works in 2 or more parts (diptychs etc), which are intended to be sold as one work must be clearly marked on the back with

number 1, 2 etc. to indicate the hanging order, from left to right. 12. Artworks may not necessarily be hung together by the same artist (unless the artwork is known as a diptych or triptych) 13. There is no limit to size of sculptures.

Delivery of Artwork 1. Delivery of artwork must be made in person to Taupo Museum. (Dates of delivery will be emailed later) 2. All artwork (other than sculpture) must be ready to hang. No crafts will be accepted. 3. Please deliver Artist’s Profiles with art work.

Sale of artwork 1. Lake Taupo Museum is only acting as an agent. The applicant will receive payment for all art sold for or on behalf of that

applicant (less 35% commission inclusive of GST). 2. All prices are inclusive of GST (15%). Taupo Museum is acting only as an agent for the applicant and accepts no responsibility

or any liability for any GST or income tax payable on the sale price of artwork as paid to the applicant. Such liability for the same shall be the sole responsibility of the individual artist/applicant.

3. You will be notified if your work sells. Unsold art works must be collected from the Museum at the end of the exhibition. The Museum has limited room for storing work.

Liability 1. Taupo Art Connection and Taupo Museum will handle the artworks with the best possible care. However, they are not

responsible for any loss or damage to the artworks.

Catalogue & Artist Information 1. A current one page A4 bio/artist statement for a shared folder to be delivered the same time as artworks. 2. There will be a catalogue. Details of art works will be needed one month prior to the exhibition.

Please Note – APPLICANT’S WARRANTIES & OBLIGATIONS: 1. The applicant warrants Taupo Art Connection and any purchaser of the art that:

a. The applicant is the artist or artist’s gallery representative and sole owner of the artwork and has power to pass title to the purchaser free of any security interest or encumbrances.

b. The artwork is the work of the stated artist and is original. c. The applicant has no reason to believe that there is any possible claim relating to the artwork, which would affect or prevent its sale.

2. The applicant agrees Taupo Museum can charge the applicant a commission based on 35% (inclusive of GST) of the purchase price (inclusive of GST if any) for the artwork sold on behalf of the applicant and such commission can be retained or deducted from the purchase price paid for the artwork.

OBLIGATIONS AND LIABILITY OF Taupo Art Connection (“the Company”) 1. The Company will not be liable to the purchaser for:

a. any statement or warranty made either by the company or the artist/applicant b. any warranty of title or freedom from encumbrances c. any missed description or errors in condition, state or quality of the artwork

2. The Company will not be liable to the applicant / artist: a. directly or by indemnity for any of the matters referred to in 1 except where the breach, or other wrong, was deliberate and without authority or

assistance by the applicant / artist. b. For any failure to collect the purchase price for the artwork, if the work remains unsold
