Corres. 969/63.WHEREAS by section 31 of the Land Act, 1933-1962, the Governor may, by Proclamation and sub-ject to such conditions as may be expressed therein,classify as of Class "A" any lands of the Crownreserved to Her Majesty for any of the purposesspecified in the said section; and whereas it isdeemed expedient that the reserve described inthe schedule hereto should be classified as of Class"A": Now, therefore I, the Governor, with theadvice and consent of the Executive Council, doby this my Proclamation classify as of Class "A"the reserve described hereunder.

IT is hereby notified, for general information, that the areas scheduled hereunder are available for selection under Part Vof the Land Act, 1933-1962, and the regulations appertaining thereto, subject to the provisions of the said Act.

Applications must be lodged at the Department of Lands and Surveys, Perth, not later than the date specified, but . maybe lodged before such date, if so desired.

All applications lodged on or before such date will be treated as having been received on the closing day, and if thereare more applicants than one for any block, the application to be granted will he determined by the Land Board. Shouldany lands remain unelected such will continue available until applied for or otherwise dealt with.

If a Land Board sitting becomes necessary, the applicants for the blocks will be duly notified of the date, time, and placeof the meeting of the Board, and there shall be an interval of at least seven days between the closing date and the sittingof the Board.

following:-21.—Representative Interviewing Workers.(a) On notifying the employer or his repre-

sentative an accredited representative of theUnion shall he permitted to interview a workerduring the recognised meal hour on the busi-ness premises of the employer at the placeat which the meal is taken but this permis-sion shall not be exercised without the con-sent of the employer more than once in anyone (1) week.

(b) In the case of a disagreement existingor anticipated concerning any of the provisionsof this Award, an accredited representative ofthe Union, on notifying the employer or hisrepresentative, shall he permitted to enter thebusiness premises of the employer to view thework the subject of any such disagreement butshall not interfere in any way with the carry-ing out of such work.

(c) Any employer who alleges that anaccredited representative is creating dissatis-faction amongst his workers or is offensivein his methods or is not complying with sub-clauses (a) and (b) hereof or is committinga breach of the Industrial Arbitration Act,1912-1961, may refuse the right of entry ofsuch representative but the representativeshall have the right to bring such refusal be-fore the Board of Reference.

Delete subclause (b) of Clause 28—Liberty toApply and insert in lieu thereof the following:

(b) Liberty is reserved to the applicants toapply to amend to include the classificationof "Tool Making," and liberty is reserved tothe respondents to apply at any time to amend,add to, or delete any or all of the provisionsof Clause 21—Representative InterviewingWorkers, Clause 29—Shop Stewards, or Clause30—Preference.

Add new Clause 29—Shop Stewards:-29.—Shop Stewards.

The employer shall allow shop stewards ap-pointed by the Union the right to discuss onthe site with appropriate representatives ofthe employer matters affecting the workerswhom he represents. Provided however thatany such shop stewards shall not leave hisPlace of work for the purpose of investigatingor discussing with the employer's representa-tive any such matter unless on each occasionhe obtains permission to do so from his fore-man or supervisor or unless, in the absenceof both the foreman and supervisor, he firstnotifies the leading hand.

To facilitate the remedying of any griev-ance or the settlement of any dispute, the fol-lowing procedure shall apply:

(a) The shop stewards on the site shalldiscuss any matter affecting the

workers concerned with the foremanand, failing the matter being thensatisfactorily resolved, he shall ap-proach the Industrial Officer or otherofficer nominated by the employer todeal with such matters on the site,for further discussion.

(b) If the matter is not resolved at thesediscussions, the shop stewards shallnotify the Secretary of the Union ofthe matter and discussions will thenbe carried on by representatives ofthe employer and the Union.

(c) Work shall be carried on during anysuch negotiations or discussions and,failing the matter being satisfactorilysettled, it shall be referred to a Boardof Reference or in cases where aBoard of Reference would not havejurisdiction to determine the matter,to the President of the Court or theConciliation Commissioner if thePresident delegates authority to himfor the purpose of calling a compul-sory conference under the Act.

(d) The management shall be notified inwriting by the Union of the stewardsappointed.

Add new Clause 30—Preference:—30.—Pref erence.

(a) In this clause the term "Unionist" meansa worker who is a financial member of theindustrial union of workers party to this Award.

(b) In engaging or dismissing labour (otherthan apprentices) preference of employmentshall be given to Unionists, provided thatsuch Unionists are adequately experienced inthe class of work to be performed and areotherwise competent to perform the work:Provided further that it shall be a defence onthe part of the employer charged with en-gaging a worker other than a "Unionist" whena "Unionist" was available for such engage-ment, that the employer having made en-quiries from the appropriate Union did notknow that any "Unionist" competent to per-form the class of work involved was available.

(c) Any worker whose application for mem-bership of the Union has been refused shallhave the right of appeal to the IndustrialRegistrar whose decision on such matter shallbe final. Such worker who has exercised hisright of appeal shall pending the decision ofthe Industrial Registrar have the same rightsunder this clause as a "Unionist."

(d) Subject to subclause (e) hereof workers(other than apprentices) who are not "Union-ists" shall within seven days of being suppliedwith the necessary application form for mem-bership, and a copy of this clause by anaccredited representative of the applicantunion, apply in the prescribed manner formembership and if accepted as a membermaintain financial membership whilst em-ployed by the respondent to this Award.Workers who are unfinancial or financialmembers of the Industrial Union of workersparty to this Award shall become and/ormaintain financial membership whilst em-ployed by any respondent to the Award.

(e) Exemptions:—(i) Any worker may apply in writing to

the Industrial Registrar, Court ofArbitration, Perth (whose decisionshall he final) for exemption from thisclause.

(ii) An applicant for exemption shall de-tail in the application to the Indus-trial Registrar his reasons for desiringexemption and such application shallonly be valid and considered by theIndustrial Registrar if it is forwardedby registered post within seven daysof the applicant's receipt of the appli-cation for membership as prescribed insubclause (d).


(iii) The Industrial Registrar in the exer-cise of his discretion may grant ex-emption with such conditions as hedeems desirable

(a) if the applicant is a financialmember of any other registeredindustrial union;

(b) if the employee objects on thegrounds of conscientious reli-gious belief to becoming a mem-ber of any industrial union;and

(c) for any other reason which theIndustrial Registrar deems suf-ficient.

(iv) A worker refused exemption by theIndustrial Registrar shall within sevendays of the decision make applicationfor membership of the applicantUnion and if accepted as a membermaintain financial membership whilstemployed by a respondent to thisAward.

(f) The employer shall, not while to hisknowledge adequately experienced "Unionists"competent to perform the class of work re-quired are available, retain in his employmentany worker for a period of more than sevendays after being advised by the Union con-cerned that such worker has not compliedwith either subclause (d) of paragraph (iv) ofsubclause (e) of this clause or for a period ofmore than seven days after a conviction fora breach of this clause in reference to theemployment of such worker.

Clause 9.—Hours:After subclause (c) add the following new sub-

clause:(d) When a worker is requil ed to work

overtime for half an hour or more immedi-ately following his ordinary finishing time arest period of seven minutes under similarconditions to those provided in subclause (c)hereof shall be allowed to such worker. Wherepractical such rest period shall be allowed be-tween the end of the second and third hour'swork after the meal break and where it isnot practical so to do as soon as possiblethereafter.

Clause 20.—Preference:After subclause (e) add the following new sub-

THE Court of Arbitration of Western Australiadoth hereby make the following Award in connec-tion with the industrial dispute between the above-named partes:—

This Award shall be known as the "Meat Indus-try (Broome Abattoirs) Award, 1962" and replacesIndustrial Agreement No. 31 of 1960.

3.—Scope.This Award shall apply to the workers classified

in Clause 22 hereof employed by the applicant.

4.—Area.This Award shall operate over that area occupied

by the works of the applicant at Broome.

5.—Term.The term of this Award shall be for a period of

three (3) years from the date hereof.

6.—Definitions.In this Award, unless the context otherwise

indicates, the words(a) "mutually agreed" or "mutual arrange-

ment" means agreed in writing betweenthe employer and the union, or its re-presentative;

(b) "seasonal operatives" mean those workerswho customarily reach Broome by theplane or boat immediately preceding thecommencement of operations.

7.—General Conditions.(a) Any worker carrying out work classified at a

higher rate than the rate pertaining to his recog-nised task, shall be paid for that day at thehighest rate for such tasks.

(b) Wages shall be paid on the first Friday nextsucceeding the commencement of the employmentand thereafter on the regular fortnightly pay dayduring a smoko period, on each alternate Friday.Provided that the employer shall, if required to doso by any worker-

(i) arrange for weekly allotments to be for-warded to any person nominated in writ-ing by a worker; and

(ii) pay to the worker on each Friday on whichpayment of wages is not made an amountnominated in writing by such worker as anadvance against the moneys to be paid onthe succeeding pay day.

Provided that the aggregate amount of any suchallotment and any such advance shall not exceedthe sum of fifteen pounds (£15) in any one week.No more than two days' pay shall be kept in hand.

(c) (1) The employer shall give the union dele-gate concerned reasonable notice of the necessityto work overtime. Sufficient competent men shallbe made available for any overtime to be workedand the union or its representative shall be respon-sible for the supply of such workers.

(ii) Subject as hereinafter provided overtimeshall be distributed on a roster system betweenworkers competent to do the work but a workershall not be entitled to claim overtime on workoutside his normal classification unless required soto work by the employer. Provided that a workershall have the right to forfeit his place on theroster if he obtains a replacement suitable to theemployer to perform any work required, but anysuch replacement shall maintain his own place onthe roster.

(iii) Where overtime is worked outside a worker'snormal classification, he shall be paid at the rateprescribed for the actual work performed.

(iv) Should the employer require workers forovertime in excess of the number employed in aclassification then fertiliser workers shall be givenfirst preference for such overtime work.

(d) (i) Workers shall be provided with accom-modation in the quarters erected for that purposeincluding stretcher, mattress, pillow, wardrobe,cupboard and chair. No charge or deduction fromwages shall be made for such accommodation.

(ii) A worker shall be liable for any loss ordamage to such accommodation including stretcher,mattress, pillow, wardrobe, cupboard and chair, fairwear and tear attributable to ordinary use exceptedand in the event of any loss or damage, theemployer may recover an amount as mutuallyagreed with the union representative to compen-sate therefor, from any wages due to such workeror otherwise legally recover such compensation orbalance thereof.

(e) Each worker who boards at the workscanteen shall have an amount equivalent to twenty-seven per cent. (27%) of the basic wage for theGoldfields Areas and all other portions of theState, exclusive of the South-West Land Division,deducted from his wages weekly.

(f) Subject to clause 19 hereof, notwithstandingthat the rates of pay are set forth on a weeklybasis, there shall be no obligation on the part ofthe employer or the workers to give a week'snotice or any other notice to determine the employ-ment, the position being in this respect the sameas if the worker was employed at a daily wage.

(g) (i) All delegates shall be officially recognisedby the employer.

(ii) The union representative shall be solely re-sponsible for negotiating with the employer thoughhe may be accompanied by other delegates. In hisabsence by reason of illness or other just causethe deputy union representative shall be so respon-sible.

(h) Waterproof overboots, gloves and overallsshall be supplied by the employer to all workerswho require them by the nature of their work, thesame shall be replaced when required. The workershall be responsible for any loss or damage to anyof such articles, fair wear and tear attributableto ordinary use excepted, and in the event of anyloss or damage the employer may recover anamount as mutually agreed with the union repre-sentative to compensate therefor from any wagesdue to such worker or otherwise legally recoversuch compensation or balance thereof.

8.—Preference.(a) Preference of employment in respect of tasks

for which rates of wages are specified in thisaward shall be given to members of the union whoare parties to this award, provided they are com-petent workmen for the task for which they areselected and do their work to the satisfaction ofthe employer.

(b) Subject to preference to members of theunion who are a party to this award, the employershall have the right

(1) to select workers with due regard to theirqualifications for their respective tasks;

(ii) to allot to workers their respective tasks;to dispense with the services of any workerfor incompetence, drunkenness, miscon-duct;

(iii) in the event of a member of the union netbeing available at Broome, and withoutlimiting the rights of the employer con-tained elsewhere in this clause; to employa. non-member of the union, but anyworker so employed shall within seven (7)days of commencing employment makeapplication to join the union, provided heis supplied with the prescribed form bythe union representative, and if acceptedshall then maintain financial membershipwith the union to be eligible to claimpreference of employment in the nextsucceeding year. For the purposes of thisparagraph, a non member of the unionshall include an unfinancial member whoshall, within fourteen (14) days of com-mencing employment become financial.

(c) In the event of the work of a worker beingunsatisfactory at the task to which he had beentransferred, the employer shall have the right toplace such worker on waiting time in accordancewith clause 20 (b).

(d) Workers engaged as seasonal operatives shallbe selected from lists supplied by the union. Pro-vided that the union includes on the list allcompetent financial members of the union whogive written notice to the union that they desireto be so included.

9.—Transfer.The employer may transfer workers from one

classification to. another and in such cases therates paid shall be that for the actual work per-formed. In the case of alleged unreasonable actionunder this clause the matter shall be discussedbetween the employer's manager and the uniondelegates with the senior works delegate and fail-ing agreement being reached shall then be referredto a Board of Reference.

10.—Hours.(a) Except where otherwise provided, forty (40)

hours shall constitute an ordinary week's work,divided into five (5) working days, Monday toFriday inclusive, of eight (8) hours in each daywhich shall be exclusive of the meal interval.

(b) Except in the case of slaughter floor workers,or as otherwise mutually agreed upon, ordinarystarting time shall be 7.30 a.m. and ordinary ceas-ing time 4.30 p.m.

11.—Meal Times.Except in the case of slaughter floor workers or

as otherwise mutually agreed, meals shall be avail-able between the times of 6 a.m. to 7.15 a.m.;11 a.m. to 12.15 p.m. and 4.30 p.m. to 5.30 p.m.Provided that when loading out the times shall bein accordance with the schedule of the vessel'smeal times, but may be given within one houreither before or after such meal times.

12,—Smokos.(a) Except as provided in subclause (c) hereof,

smokos of fifteen (15) minutes each shall beallowed and paid for as working time between thetimes of 9.30 a.m. to 9.45 a.m. and 2.30 p.m. to2.45 p.m., and one smoko after every two hours'continuous work done outside ordinary hours if itis intended that after such smoko work is to con-tinue for at least another hour.

Provided that a worker in the cold storagedepartment who is working in a temperature notabove 20 degrees Fahrenheit shall be allowed fouradditional periods of not more than ten (10)minutes each day at times approved by the leadinghand. Provided however that if any such worker

absents himself from his work at any other time,such other time shall be in lieu of the next succeed-ing break period.

(b) Except as provided in subclause (c) hereof,for workers loading out, smokos shall, unlessotherwise mutually agreed, be-

9 a.m. to 9.15 a.m.; 2 p.m. to 2.15 p.m.; 7 p.m.to 7.15 p.m.; 9 p.m. to 9.20 p.m.; 2 a,m to2.15 a.m.; 4 a.m. to 4.20 a.m.

(c) When reasonably required by the employerowing to exigencies of work, workers shall foregotheir smoke until a convenient time.

13.—Cribs.Workers engaged unloading and discharging

ships will be supplied with cribs, as followsOne crib at second smoko after commencing

work after tea.One crib at second smoke after commencing

work at 12 midnight.

14.—Overtime.(a) Overtime rates shall be paid-

(i) for all work commencing within one anda half (1,',) hours before the usual start-ing time until such starting time—timeand one half;

(ii) for all time worked after the usual ceasingtime and before midnight—time and onehalf for the first four (4) hours andthereafter double time;

(iii) for all time worked between midnight andthe usual starting time—double ordinaryrates. Provided that if work commenceswithin one and a half (1,1) hours of theusual starting time, payment shall be madein accordance with subclause (i) hereof.

(iv) for all time worked on Saturdays—timeand one half for the first four (4) hoursand thereafter double time.

(b) For all time worked during meal hours andsmokes except as provided in clause 12—doubleordinary rates.

(c) Subject to any mutual arrangement andsubject also to the provisions of subclause (d) ofthis clause, any worker who is required to workany overtime other than that referred to in para-graph (i) of subclause (a) of this clause shall bepaid for a minimum period of at least two (2) hoursof such overtme.

(d) All work performed on Sundays and theholidays prescribed in clause 15 hereof shall bepaid for at the rate of double time and workersshall be provided with a minimum of four hours'work or payment therefor on such days.

15.—Holidays and Holiday Rates.(a) (i) The following days, or the days observed

in lieu shall, subject as hereinafter provided, beallowed as holidays without deduction of paynamely:—

New Year's Day, Australia Day, Good Friday,Easter Monday, Anzac Day, Labour Day,Broome Cup Day, Sovereign's Birthday, Christ-mas Day and Boxing Day. Provided thatanother day may be taken as a holiday byarrangement between the parties, in lieu ofany of the days named in the subclause.

(ii) Where Christmas Day or New Year's Dayfalls on a Saturday or a Sunday, such holiday shallbe observed on the next succeeding Monday andwhere Boxing Day falls on a Sunday or a Mondaysuch holiday shall be observed on the next suc-ceeding Tuesday; in each such case the substitutedday shall be deemed a holiday without deductionof pay in lieu of the day for which it is substituted.

(b) Whenever any holiday falls on a worker'sordinary working day and the worker is not re-quired to work on such day, he shall be paid forthe ordinary hours he would have worked on suchday if it had not been a holiday.

(c) Payment for holidays shall be at the ratepertaining to each worker's task.

(d) When a worker is off duty owing to leavewithout pay or sickness, including accidents on oroff duty, except time for which he is entitled toclaim sick pay, any holiday falling during suchabsence shall not be treated as a paid holiday.Where the worker is on duty or available on theworking day immediately preceding a holiday, orresumes duty or is available on the working dayimmediately following a holiday, as prescribed inthis clause, the worker shall be entitled to a paidholiday on all such holidays.

16.—Annual Leave.(a) Except as hereinafter provided, a period of

two (2) consecutive weeks' leave with payment ofordinary wages as prescribed shall be allowedannually to a worker by his employer, after a periodof twelve (12) months' continuous service with suchemployer.

(b) If any award holiday falls within a worker'speriod of annual leave and is observed on a daywhich in the case of that worker would have beenan ordinary working day there shall be added tothat period one day being an ordinary working dayfor each such day observed as aforesaid.

(c) (i) Subject to paragraph (ii) when comput-ing the annual leave due under this clause no de-duction shall be made from such leave in respectof the period that the worker is on annual leaveand/or holidays.

Provided that no deduction shall be made for anyapproved period a worker is absent from dutythrough sickness with or without pay unless theabsence exceeds three (3) calendar months, inwhich case deduction may be made for such excessonly.

(ii) Approved periods of absence from workcaused through accidents sustained in the courseof employment shall not be considered breaks incontinuity of service but the first six (6) monthsonly of any such period shall count as service forthe purpose of computing annual leave.

(d) In the event of a worker being employed byan employer for portion only of a year he shallonly be entitled to such holidays on full pay as areproportionate to his length of service during thatperiod with such employer.

(e) (i) A worker who is justifiably dismissed formisconduct shall not be entitled to the benefit ofthe provisions of this clause.

(ii) In special circumstances and by mutualconsent of the employer, the worker and the unionconcerned, annual leave may be taken in not morethan two periods.

(f) When work is closed down for the purposeof allowing annual leave to be taken, workers withless than a full year's service shall only be entitledto payment during such period for the numberof days' leave due to them. Provided that nothingherein contained shall deprive the employer of hisright to retain such worker at work during theclose-down period as may be essential.

(g) Workers regularly working for the worksnorth of South Latitude 26 shall be allowed toaccumulate annual leave for two years, subject tothe convenience of the employer. Such workerswho proceed to Fremantle and Geraldton duringthe period of such leave shall be allowed once ineach two years reasonable travelling time on theforward and return journeys between the place oftheir employment and either of the said ports.

(h) "Ordinary wages" for the purpose of sub-clause (a) hereof shall mean the average rate ofwage the worker has received over the period ofhis employment in respect of his ordinary hours ofwork.

(i) This clause shall not apply to any worker,who without reasonable cause and without the con-sent of the employer, leaves his employment beforethe end of the guaranteed period.

17 —Sick Leave.(a) A worker shall be entitled to payment for

non-attendance on the ground of personal ill-health for one-twelfth (1/12th) of a week for each

completed month of service. Provided that, sub-ject to subclause (d) hereof, payment for absencethrough such ill-health shall be limited to one (1)week in each calendar year in respect to eachworker. Payment hereunder may be adjusted atthe end of each calendar year, or at the time theworker leaves the service of the employer, in theevent of the worker being entitled by service sub-sequent to the sickness to a greater allowance thanthat made at the time the sickness occurred. Thisclause shall not apply where the worker is entitledto compensation under the Workers' CompensationAct.

(b) A worker shall not be entitled to receive anywages from his employer for any time lost throughthe result of any accident not arising out of or inthe course of his employment or for any accident,wherever sustained, arising out of his own wilfuldefault or for sickness arising out of his own wilfuldefault.

(c) No worker shall be entitled to the benefits ofthis clause unless he produces proof satisfactoryto his employer of sickness, but the employer shallnot be entitled to a medical certificate unless theabsence is for three (3) days or more.

(d) (i) In the case of a regular worker sick leaveshall accumulate from year to year while he remainsa regular worker so that any balance of the periodspecified in subclause (a) of this clause whichhas in any year not been allowed to any worker byhis employer as paid sick leave may be claimedby the worker and, subject to the conditions herein-before prescribed, shall be allowed by his employerin any subsequent year without diminution of thesick leave prescribed in respect of that year.

(ii) For the purposes of this subclause a regularworker shall be deemed to be a worker who con-tinues work for such period as the employer feelsis necessary to complete the season's operationsand who recommences work in the next ensuingseason.

18.—Travelling.(a) (i) Subject as hereinafter provided each

worker (except those engaged at Broome) shall beentitled to passage from place of engagement toBroome and travelling time allowance.

(ii) Any seasonal operative who leaves of his ownaccord or is dismissed for misconduct before theend of the guaranteed period or who leaves of hisown accord before the end of a twelve (12) weeksperiod (if the employer is satisfied that an opera-tive has just cause to so leave), from arrival atBroome and any worker other than a seasonaloperative who leaves of his own accord or is dis-missed for misconduct before the end of theseason's operations as defined in Clause 19 shallbe liable to refund the cost of his fare to Broomeand any wages due to him shall be retained aspart payment, and the balance will be legallyrecoverable.

(1)) Subject as hereinafter provided each workershall be entitled to passage from Broome to placeof engagement, and travelling time allowanceafter termination of work in his department orwhen his services are not further required by theemployer provided that his duties have been per-formed to the satisfaction of the employer.

(c) When required by the employer to travel byplane the travelling time allowance referred toherein shall be at the task rate applicable but ifthe travelling time exceeds one day subsequentdays shall be at half rate, but otherwise suchallowance shall be at the rate of seventeen shill-ings and sixpence (17s. 6d.) per day.

(d) Passage may be either by ship or plane atthe discretion of the employer.

19.—Guarantee.(a) There shall be a guarantee of work for six-

teen (16) weeks (or such longer period as may befixed by the employer prior to the engagement ofseasonal workers) from the date of commencementof slaughtering in respect of workers engaged inPerth or Fremantle, provided that this guaranteeshall not apply in respect to any worker who is

dismissed for misconduct or who is unable satis-factorily to perform the work for which he isengaged.

(b) Each such worker shall be engaged on theexpress condition that he will perform any workrequired by the employer during the guaranteedperiod and during such additional period notexceeding four (4) weeks after the last day ofkilling, as may be necessary in the opinion of theemployer to complete the season's operations.

20.—Waiting Time.(a) When no work is available for a worker at

his usual task, such worker shall if so requiredby the employer do any other work available andbe paid whichever rate shall be the highest for thetask performed or the worker's recognised usualtask. Provided that a member of the slaughteringgang or a boner may decline to do such work sub-ject to agreement by the employer, and in such acase no payment shall be made.

(b) If no work is available to a worker, a waitingtime allowance of half his recognised task rateshall be paid for such waiting time, in which casethe minimum rate shall not apply to the periodof such waiting time, provided that the first thirty(30) minutes of such waiting time shall not becounted but any delays in excess of thirty (30)minutes shall be calculated from the commence-ment of the initial delay.

(c) (i) The date of commencement of slaughter-ing shall be determined by the employer but oneclear day (not including the day of arrival) shallelapse between the date of arrival of seasonaloperatives and the date of commencement ofslaughtering operations.

(ii) Waiting time allowance shall not be payableon the day of arrival or the day after arrival ofseasonal operatives.

(iii) In the event of seasonal operatives arrivingbefore 2 p.m. on any day that day shall be deemedto be the one clear day after arrival of seasonaloperatives.

(d) All workers including seasonal operativesshall, if so required by the employer, do any workother than slaughtering available between the dateof arrival of seasonal operatives and the date fixedfor the commencement of slaughtering under thisclause. Work performed shall be paid for at therate pertaining to the task performed.

(e) No payment shall be made under this clauseif work is not available by reason only of a strikeof workers bound by this award.

21.—Board of Reference.(a) The Court hereby appoints for the purpose

of this Award, a Board of Reference.(b) The Board shall consist of a chairman, to be

appointed by the Court and two (2) other repre-sentatives, one to be nominated by each of theparties.

(c) The Board is hereby assigned the followingfunctions in the event of a disagreement betweenthe parties bound by this Award:-

(i) Adjusting any matters of difference whichmay arise between the parties from timeto time, except such as involve interpreta-tion of the provisions of this Award orany of them.

(ii) Deciding any other matter that the Courtmay refer to the Board from time to time.

(d) The provisions of regulation 106 of the In-dustrial Arbitration Act, 1912-1961, shall bedeemed to apply to any Board of Reference ap-pointed hereunder.

22.—Rates and Conditions.The minimum rates of wages payable to workers

(c) The management may deduct from nibwages of any such worker, as it may in itsdiscretion deem prudent so to do, the cost ofthe passage from place of engagement toWyndham of such worker and any travellingallowance paid to such worker in respect tosuch journey, such deductions to be in in-stalments not exceeding, in the case of maleworkers, eight pounds (£8) per week and inthe case of female workers, six pounds (£6)Per week, but the amount of all such deduc-tions shall be paid to any such worker at thetermination of his employment provided thathe has then fulfilled the condition of his en-titlement referred to in subclause (b) hereofor has satisfied the management that for un-foreseen reasons it is urgently necessary forhim to terminate his employment prior to thefulfilment of that condition.

(d) The travelling time allowance referredto in subclause (a) hereof shall be at therate of seventeen shillings and sixpence (17s.6d.) per day and shall accrue from day ofembarkation to day of landing, both inclusive.

Order.THE Tribunal hereby awards, orders, and prescribesthat Award No. 1 of 1953 of the W.A. Coal IndustryTribunal, as amended, be further amended in thefollowing manner:-

1. Add the following new clause:-10A. Hours of Duty (continued).

(1) Notwithstanding any provisions containedelsewhere in this Award it shall not be neces-sary for workers to attend for work on a

(2) The base tonnage output for each mineshall be that existing at the date of this amend-ment.

(4) In arriving at the amount of coal pro-duced in any fortnightly pediod, allowancesshall be made for holidays and such contin-gencies as are agreed upon between the partiesto this Award.

(5) Where attendance for work on a BackSaturday is excused pursuant to the provisionof this clause no penalty or forfeiture shallbe incurred by any worker for non-attendance,and such Back Saturday shall be counted as ashift worked for all purposes including longservice leave; provided that where, in anyfortnightly period, a mine is not required towork ten shifts on account of a breakdown ofmachinery, fire, flood, or slackness of trade,Back Saturday shall not be counted as a shiftof entitlement for long service leave.

(6) Where a Saturday shift is worked forthe purpose of making up production losses dueto any of the causes referred to in subelause (4)hereof, or caused by abnormal breakdowns,fire, flood and like emergencies, or whereworkers are called back on a Saturday forspecial duties, the ordinary provisions of theAward relating to work on Saturdays shallapply.

(7) The provisions of the extra-award agree-ments annexed hereto as appendices "A" and"B", as already varied by mutual agreementbetween the parties, shall prevail where thisclause is silent; provided that such agreementsmay be further varied from time to time bymutual agreement.

(8) Failing agreement between the parties tothis Award upon any matter arising out ofthis clause, the matter in dispute may bedetermined by the W.A. Coal IndustryTribunal.

(9) If at any time a party to the Award feelsaggrieved by the operation of this clause thatparty may submit the matter, the subject ofthe grievance, to the W.A. Coal IndustryTribunal which may make any order it seesfit in relation thereto.

2. This amendment shall be deemed to havetaken effect on and from 27th day of February,1963.

The Griffin Coal Mining Company Limited.

Back Saturday: Bonus Holiday Scheme.1. This proposal is submitted by the management

on the strict understanding that it is without pre-judice to the future rights of the Company or itsemployees.

In the event of the proposal being accepted itis not to be construed as forming part of oraffecting any Industrial Award in any way.

2. All employees, other than pumpers at theHebe Colliery, Open Cut and Centaur Siding, shallhe eligible to participate in this scheme subject tothe conditions laid down herein.

3. Workshop, central office and store employeeswill be eligible to participate in the scheme for theHebe Colliery and Open Cut on a Company basis.Until such time as separate screening facilities areprovided for handling the Hebe Colliery and OpenCut coal, it will be necessary for the screen hands

at Centaur Siding to be rostered for duty in theevent of either the Hebe Colliery or Open Cutbeing required to produce coal on a Back Saturday.

4. The Manager will arrange for tally sheets to beposted up on the notice board at the HebeColliery and Open Cut each period, showing thedaily production, progressive total, balance re-quired for the period and what tonnage, if any, isin credit.

5. The estimated tonnages for the Hebe Collieryand Open Cut will be reconciled daily and at theend of each week with the W.A.G.R. weighbridgenotes, allowances will be made for sundry workers'coal and town sales, coal in part loaded wagons andsurface bins at the beginning and end of eachperiod.

6. In assessing the qualifying base tonnages, theCompany has taken into account all normal inter-ferences with production, includin g machinerybreakdowns. Provision has been made for lostproduction days due to statutory holidays andannual leave close downs.

7. Any employee required by the management towork "overtime" on either Saturday, who fails toreport for work without good and sufficient reason,will be put at the back of the overtime roster.

8. The Company is prepared to create a "pool"for the Hebe Colliery and Open Cut into whichany excess tonnage in any period will be transferredand held in credit against any future shortages ateither the Hebe Colliery or Open Cut. To inauguratethe scheme it is suggested that it would be in thebest interests of all concerned to work two normal11-day fortni ghts with the object of building up areasonable reserve tonnage in either pool.

9. The success of the scheme depends on theregular production of the base tonnage set out inSchedule "A" each period, with a minimum ofovertime. It is expected that all employees willco-operate with each other and work as a team.Practices such as unnecessary absenteeism andknocking off early will prejudice the chance ofsuccess, as well as imposing an unfair burden onthe men who are pulling their weight, thereforeany such breaches will be viewed most seriously,the Award conditions must be complied with.

General Application of Bonus for Pay Purposes.10. For the purpose of this scheme the base

tonnage for the Hebe Colliery and the Open Cut willbe calculated on a two-weeks' period ending at10 p.m. each Pay Friday.

Whenever the stipulated base tonnage has beenproduced in any such two-weeks' period, the HebeColliery or the Open Cut will not be required towork for the production of coal on the followingBack Saturday. Notification to this effect or other-wise will be posted on each notice hoard not laterthan 3 p.m. on the Monday after the close -of eachperiod.

In any two weeks' period that the Hebe Collieryor the Open Cut qualifies for the bonus, eachemployee, excluding pumpmen, will receive an ad-ditional shift at his appropriate rate for the BackSaturday that he is not so required to work. Anyemployee who is absent on the Back Friday forany reason whatsoever will be treated as if hewould have been absent also on the Back Saturday,if the Mine had been required to produce coaland in this case payment for the Back Saturdaywill be made in accordance with the followingsubclauses. (Puropmen to receive half shift addi-tional payment.)

Any employees, other than pumpers, required towork on a non-productive Back Saturday will bepaid at the rates prescribed in the relevant Awardsfor work performed on a Pay Saturday.

The following conditions will apply to men whowork less than the time the Hebe Colliery orthe Open Cut has worked for the production ofcoal in any period in which the bonus operates:

(a) Any employee absent for the whole of thisperiod, whatever the reason, will be re-garded as having been absent for 11 work-ing days


(b) Any employee absent for a portion of aperiod on annual leave and long serviceleave, will have the leave granted and paidfor on the normal 11-shift basis.

(c) Any employee absent for a portion of theperiod on sick leave will be charged sickleave against his credit at the rate of oneshift for each day of absence includingBack Saturday and payment will he madeon the same basis.

(€1) Any employee absent on workers' com-pensation for a portion of the periodwhose absence extends to the Back Saturdaywill have a deduction made from his payequal to the sum received in workers'compensation for the Back Saturday.

(e) Any employee who works less than thenumber of shifts that his mine has workedfor the production of coal in any payperiod will have his attendance allowancereduced by one-eleventh of a shift for eachdays absence including Back Saturday.

11. Annual leave and long service credits willhe assessed on the normal 11-shift basis, any manat work on the second Friday will he credited asif he in fact had worked the eleventh shift, whilstany man absent on the second Friday will be re-garded as having also been absent on the BackSaturday.

12. If either the Hebe Colliery or Open Cut has towork on a Back Saturday for the production of coalbecause it has failed to reach the base tonnagein that period, then the normal Award provisionsfor an 11-day fortnight will apply to all employees.

Hebe Colliery.1. Due to pressure brought to bear by the

State Electricity Commission and Western Aus-tralian Government Railways in the month ofJune regarding coal supplies, our work force atthe Hebe Colliery was greatly increased to meettheir requirements. Both Departments have nowissued instructions to the Company to reduce sup-plies and we now find that a reduction in outputis necessary, causing surplus labour.

2. Qualifying Base Tonnage: 10,000 tons per fort-night of 11 working days made up of 10 days of950 tons per day Monday to Friday and 500 tonsfor Back Saturdays.

Where less than 11 days would have been workedin a period because of statutory holidays and/orannual leave close downs, the fortnightly baseof 10,000 tons will be reduced by 1,000 tons foreach week day so lost, no allowance will be madefor any Back Saturday so lost, e.g., if a statutoryholiday fell on a Monday in the fortnight, thebase would then be 10,000 tons less 1,000 tons or atotal of 9,000 tons.

3. The total number of scraper loader units to beused for this base tonnage is 16.

4. These tonnages have been assessed on thepresent method of mining at the Hebe Colliery, i.e.,using scraper loader units. Should the methodbe changed, additional equipment installed, thebasic tonnage for calculation as to whether themine will be required to produce coal on a BackSaturday or not, as already fixed, would be reviewedand adjusted in proportion to the new capacityavailable because of such changes.

5. In effect the Mine must work for the produc-tion of coal on a Back Saturday in any period inwhich the Mine has failed to produce the qualifyingbase tonnage for that particular period by 10 p.m.on the Pay Friday of the period. However, if theMine has coal in credit sufficient to cover anyshortage of production in the period under review,then such shortage may be made up from thiscredit pool and the mine need not work for theproduction of coal on the Back Saturday.

Muja Open Cut.1. Qualifying Base Tonnage: 14,000 tons per fort-

night of 11 working days made up of 10 days of1,320 tons per day, Monday to Friday, and 800tons for Back Saturday.

Where less than 11 days would have been workedin a period because of statutory holidays and/orannual leave close downs, the fortnightly base of14,000 tons will be reduced by 1,400 tons for eachweek day so lost, no allowance will be made forany Back Saturday so lost, e.g., if a statutoryholiday fell on a Monday in tile fortnight, thebase would then be 14,000 tons less 1,400 tons ora total of 12,600 tons.

2. In the preparation of the above for the OpenCut, our base tonnage had been prepared on presentday trade requirements. Due to the unused capacityof the equipment operating at present, and asthe number of men employed are in excess of ourbasic trade requirements, the base mentioned inClause 1 will have to fluctuate to cater for fort-nightly trade.

3. These tonnages have been assessed on thepresent method of mining and equipment used atthe Open Cut. Should the method be changed,additional equipment installed, the basic tonnagefor calculation as to whether the Open Cut will berequired to produce coal on a Back Saturday ornot, as already fixed by clause 2, would be reviewedand adjusted in proportion to the new capacityavailable because of such changes.

4. In effect the Open Cut must work for theproduction of coal on a Back Saturday in anyperiod in which the Open Cut has failed to pro-duce the qualifying base as stated in clause 2 forthat particular period by 10 p.m. on the Pay Fridayof the period. However, if the Open Cut has anycoal in credit sufficient to cover any shortageof production in the period under review, thensuch shortage may be made up from this creditpool and the Open Cut need not work for theproduction of coal on the Back Saturday.

Appendix "B."

Western Collieries Ltd.Back Saturday Bonus Holiday Scheme.

Operative as from 16th October, 1961.

1. This proposal is submitted by the managementon the strict understanding that it is withoutprejudice to the future rights of the Company or itsemployees.

In the event of the proposal being accepted it isnot to be construed as forming part of or affectingany Industrial Award in any way.

2. All employees, other than pumpers, at eachMine shall be eligible to participate in this schemesubject to the conditions laid down herein.

3. Workshop, central office and store employeeswill be eligible to participate in the scheme foreach mine, on a Company basis. Until such timeas separate screening facilities are provided forhandling Western No. 4 coal, it will be necessaryfor the screen hands at Western No. 2 to be rosteredfor duty in the event of either Mine being requiredto produce coal on a Back Saturday.

4. The Manager will arrange for tally sheets tobe posted up on the notice board at each Mineeach period, showing the daily production pro-gressive total, balance required for the periodand what tonnage, if any, is in credit.

5. The estimated tonnage for each Mine will bereconciled daily and at the end of each week withthe W.A.G.R. weighbridge notes, allowances will

be made for sundry workers' coal and town sales,coal in part loaded wagons and surface bins atthe beginning and end of each period.

6. In assessing the qualifying base tonnages theCompany has taken into account all normal inter-ferences with production, including machinerybreakdowns. Provision has been made for lostproduction days due to statutory holidays andannual leave close downs.

7. Any employee required by the managementto work "overtime" on either Saturday, who failsto report for work without good and sufficientreason, will be put at the back of the overtimeroster.

8. The Company is prepared to create a "pool" foreach Mine, into which any excess tonnage in anyperiod will be transferred, and held in credit againstany future shortages at either Mine. Ta inauguratethe scheme it is suggested that it would be in thebest interests of all concerned to work two normal11-day fortnights with the object of building up areasonable reserve tonnage in each Mine pool.

9. The success of the scheme depends on theregular production of the base tonnage set out inSchedule "A," each period, with a minimum ofovertime. It is expected that all employees willco-operate with each other and work as a team.Practices such as unnecessary absenteeism andknocking off early will prejudice the chance ofsuccess, as well as imposing an unfair burden onthe men who are pulling their weight, thereforeany such breaches will be viewed most seriously,the Award conditions must be complied with.

General Application of Bonus for Pay Purposes.10. For the purpose of this scheme the base ton-

nage for Western No. 2 and 4 Mines, will be cal-culated on a two-weeks' period ending at 10 p.m.each Pay Friday.

When over the stipulated base tonnage has beenproduced in any such two-weeks' period, the Minewill not be required to work for the production ofcoal on the following Back Saturday. Notificationto this effect or otherwise will be posted on eachnotice board not later than 3 p.m. on the Mondayafter the close of each period.

In any two-weeks' period that the Mine qualifiesfor the bonus, each employee, excluding pumpmen,will receive an additional shift at his appropriaterate for the Back Saturday that he is not sorequired to work. (Pumpmen to receive half shiftadditional payment.) Any employee who is absenton the Back Friday for any reason whatsoeverwill be treated as if he would have been absentalso on the Back Saturday if the Mine had beenrequired to produce coal and in this case paymentfor the Back Saturday will be made in accordancewith the following subclauses.

Any employees, other than pumpers, required towork on a non-productive Back Saturday, will bepaid at the rates prescribed in the relevant Awards,for work performed on a Pay Saturday.

The following conditions will apply to men whowork less than the time the Mine has workedfor the production of coal in any period in whichthe bonus operates:

(a) Any employee absent for the whole ofthis period, whatever the reason, will beregarded as having been absent for 11working days.


(c) Any employee absent for a portion of theperiod on sick leave, will be charged sickleave against his credit at the rate of oneshift for each day of absence, includingBack Saturday and payment will be madeon the same basis.

(d) Any employee absent on workers' com-pensation for a portion of the period whoseabsence extends to the Back Saturday

will have a deduction made from his payequal to the sum received in workers'compensation for the Back Saturday.

(e) Any employee who works less than thenumber of shifts that his Mine has workedfor the production of coal in any pay periodwill have his attendance allowance reducedby one-eleventh of a shift for each day'sabsence, including Back Saturday.

11. Annual leave and long service credits will beassessed on the normal 11-shift basis, any man atwork on the second Friday will be credited as ifhe in fact had worked the eleventh shift, whilstany man absent on the second Friday will be re-garded as having also been absent on the BackSaturday.

12. If a Mine has to work on a Back Saturdayfor the production of coal because it has failed toreach the base tonnage in that period then thenormal Award provisions for an 11-day fortnightwill apply to all employees.

Western No. 2 Mine.1. Qualifying Base Tonnage: 12,750 tons per fort-

night of 11 working days, made up of 10 days of1,215 tons per day, Monday to Friday, and 600 tonsfor Back Saturday.

Where less than 11 days would have been workedin a period because of statutory holidays and/orannual leave close downs, the fortnightly base of12.750 tons will he reduced by 1,275 tons for eachweek day so lost, no allowance will be made forany Back Saturday so lost, e.g., if a statutory holi-day fell on a Monday in the fortnight, the basewould then be 12,750 tons less 1,275 tons or a totalof 11,475 tons.

2. The total number of men to be engaged for thisbase tonnage being 281, of whom 143 will becomposite miners, 101 other Miners' Union, 8 depu-ties, 20 Engineering Union, two F.E.D. and F.U. andseven Colliery staffs.

3. These tonnages have been assessed on thepresent method of mining at each Colliery, i.e.,using composite miners hand filling on to scraperchain conveyors. Should the method be changed,additional equipment installed, or other minersengaged, the basic tonnage for calculation as towhether the Mine will be required to produce coalon a Back Saturday or not, as already fixed wouldhe reviewed and adjusted in proportion to the newcapacity available because of such changes.

4. In effect the Mine must work for the produc-tion of coal on a Back Saturday in any periodin which the Mine has failed to produce thequalifying base tonnage for that particular periodby 10 p.m. on the Pay Friday of the period. How-ever, if the Mine has coal in credit sufficient tocover any shortage of production in the periodunder review, then such shortage may be made upfrom this credit pool and the Mine need not workfor the production of coal on the Back Saturday.

Western No. 4 Mine.1. Qualifying Base Tonnage. 3,500 tons per fort-

night of 11 working days, made up of 10 days of335 tons per day, Monday to Friday, and 150 tonsfor Back Saturday.

Where less than 11 days would have been workedin a period because of statutory holidays and/orannual leave close downs, the fortnightly base of3,500 tons will be reduced by 350 tons for each weekday so lost, no allowance will be made for any BackSaturday so lost, e.g., if Good Friday and EasterSaturday fell at the end of a period, the basetonnage would become 3,500 tons less 350 tonsequals 3,150 tons.

2. The total number of men to be engaged forthis base tonnage being 87, of whom 40 will becomposite miners, 33 other Miners' Union, 2 depu-ties, seven A.E.U. and A.S.E., two F.E.D. and F.U.and three Colliery staffs.


3. These tonnages have been assessed on thepresent method of mining at each Colliery, i.e.,using composite miners hand filling on to scraperchain conveyors. Should the method be changedadditional equipment installed, or more minersengaged, the basic tonnage for calculation as towhether the Mine win be required to producecoal on a Back Saturday or not, as already fixedwould be reviewed and adjusted in proportion tothe new capacity available because of such changes.

How-ever, if the Mine has coal in credit sufficient tocover any shortage of production in the periodunder review, then such shortage may be made upfrom this credit pool and the Mine need not workfor the production of coal on the Back Saturday.

5. Due to the fact that a certain amount ofexploration work is being carried out at this Minenecessitating the employment at times of com-posite miners on stone drivage work, it will benecessary to adjust the base tonnage in eachperiod in relation to the number of places andminers producing coal in each period. For in-stance, in the fortnight ending the 14th October,1961, four miners will be engaged on stone driveagethrough a fault and 36 miners employed on coalgetting, the base tonnage for such a fortnightwould then be reduced on a pro rata basis of eightand three-quarter tons per man Der shift, for eachman engaged on stone drive work, the daily outputrequired would then be 350 less 35 equals 315 tonsor 3,150 per fortnight. Any such allowance is tobe calculated on the average number of men onstone drive work in each week, not on a per day orshift basis.

Order.THE Tribunal hereby awards, orders and prescribesthat Award No. 4 of 1953 of the W.A. Coal IndustryTribunal, as amended, be further amended in thefollowing manner

1. Add the following new clause:-8A. Hours of Work (continued).

(1) Notwithstanding any provisions contain-ed elsewhere in this Award it shall not benecessary for workers. to attend for work on aBack Saturday where the base tonnage outputfor the mine has been produced in the 10shifts preceding Pay Saturday.

(2) The base tonnage output for each mineshall be that existing at the date of this amend-ment.

(3) The number of workers comprising thework force for each mine as well as the basetonnage output may be varied from time totime by mutual agreement.

(4) In arriving at the amount of coal pro-duced in any fortnightly period, allowancesshall be made for holidays and such contin-gencies as are agreed upon between the partiesto this Award.

(5) Where attendance for work on a BackSaturday is excused pursuant to the provisionsof this clause no penalty or forfeiture shallbe incurred by any worker for non-attendance,and such Back Saturday shall be counted asa shift worked for all purposes including longservice leave; provided that where, in anyfortnightly period, a mine is not required towork 10 shifts on account of a breakdown ofmachinery, fire, flood or slackness of trade,Back Saturday shall not be counted as a shiftentitlement for long service leave.

(6) Where a Saturday shift is worked for thepurpose of making up production losses due toany of the causes referred to in subclause (4)hereof, or caused by abnormal breakdowns,fire, flood, and like emergencies, or whereworkers are called back on a Saturday forspecial duties, the ordinary provisions of theAward relating to work on Saturdays shallapply.

(7) Where a worker fails to make a reason-able effort to maintain production, or is afrequent absentee from work without lawfulexcuse, he may be reduced by the managementto a lower classification at the lower rate ofpay, provided that such worker has been pre-viously warned in the presence of the Branchofficials that continued default on his partwill lead to a reduction in classification, andprovided also that the Union may appealagainst any such reduction to the W.A. CoalIndustry Tribunal, which may make any orderit sees fit in relation to such reduction.

(8) The provisions of the extra-award agree-ments annexed hereto as appendices "A" and"B", as already varied by mutual agreementbetween the parties, shall prevail where thisclause is silent; provided that such agreementsmay be further varied from time to time bymutual agreement.

(9) Failing agreement between the parties tothis Award upon any matter arising out of thisclause, the matter in dispute may be determinedby the W.A. Coal Industry Tribunal.

(10) If at any time a party to the Awardfeels aggrieved by the operation of this clause,that party may submit the matter, the subjectof the aggrievance, to the W.A. Coal IndustryTribunal which may make any order it seesfit in relation thereto.

2. This amendment shall be deemed to havetaken effect on and from 27th day of February,1963.

(e) Any employee who works less than thenumber of shifts that his mine has worked forthe production of coal in any pay period willhave his attendance allowance reduced by oneeleventh of a shift for each day's absenceincluding Back Saturday.

Hebe Colliery.

1. Due to pressure brought to bear by the StateElectricity Commission and Western AustralianGovernment Railways in the month of June re-garding coal supplies, our work force at the HebeColliery was greatly increased to meet their re-quirements. Both Departments have now issuedinstructions to the Company to reduce suppliesand we now find that a reduction in output isnecessary, causing surplus labour.

6. In assessing the qualifying base tonnages theCompany has taken into account all normal inter-ferences with production, including machinerybreakdowns. Provision has been made for lostproduction days due to statutory holidays and an-nual leave close downs.

7. Any employee required by the Managementto work "overtime" on either Saturday, who failsto report for work without good and sufficientreason, will be put at the back of the overtimeroster.

8. The Company is prepared to create a "pool"for each Mine, into which any excess tonnage inany period will be transferred, and held in creditagainst any future shortages at either Mine. Toinaugurate the scheme it is suggested that it wouldbe in the best interests of all concerned to worktwo normal 11-day fortnights with the object ofbuilding up a reasonable reserve tonnage in eachMine pool.

9. The success of the scheme depends on theregular production of the base tonnage set outin Schedule "A" each period, with a minimum ofovertime. It is expected that all employees will co-operate with each other and work as a team. Prac-tices such as unnecessary absenteeism and knock-ing off early will prejudice the chance of success,as well as imposing an unfair burden on the menwho are pulling their weight, therefore any suchbreaches will be viewed most seriously, the Awardconditions must be complied with.

General Applications of Bonus for Pay Purposes.

10. For the purpose of this scheme the base ton-nage for Western No. 2 and 4 Mines, will be cal-culated on a two-weeks' period ending at 10 p.m.each Pay Friday.

When over the stipulated base tonnage has beenproduced in any such two-weeks' period, the Minewill not be required to work for the production ofcoal on the following Back Saturday. Notificationto this effect or otherwise will be posted on eachnotice board not later than 3 p.m. on the Mondayafter the close of each period.

In any two-weeks' period that the Mine qualifiesfor the Bonus, each employee, excluding pumpmen,will receive an additional shift at his appropriaterate for the Back Saturday that he is not so re-quired to work. (Pumpmen to receive half shiftadditional payment.) Any employee who is absenton the Back Friday for any reason whatsoever willbe treated as if he would have been absent also onthe Back Saturday if the Mine had been required toproduce coal and in this case payment for theBack Saturday will be made in accordance with thefollowing subclauses.


The following conditions will apply to men whowork less than the time the Mine has worked forthe production of coal in any period in which thebonus operates:

(a) Any employee absent for the whole ofthis period, whatever the reason, will beregarded as having been absent for 11working days.



(c) Any employee absent for a portion of theperiod on sick leave, will be charged sickleave against his credit at the rate of oneshift for each day of absence, includingBack Saturday and payment will be madeon the same basis.

(d) Any employee absent on workers' com-pensation for a portion of the period whoseabsence extends to the Back Saturdaywill have a deduction made from his payequal to the sum received in workers' com-pensation for the Back Saturday.

(e) .Any employee who works less than thenumber of shifts that his Mine has workedfor the production of coal in any payperiod will have his attendance allowancereduced by one-eleventh of a shift for eachday's absence, including Back Saturday.

11. Annual leave and long service credits willbe assessed on the normal 11-shift basis, any manat work on the second Friday will be credited asif he in fact had worked the eleventh shift, whilstany man absent on the second Friday will be re-garded as having also been absent on the BackSaturday.

12. If a Mine has to work on a Back Saturdayfor the production of coal because it has failedto reach the base tonnage in that period, then thenormal Award provisions for an 11-day fortnightwill apply to all employees.

5. Due to the fact that a certain amount of ex-ploration work is being carried out at this Minenecessitating the employment at times of compositeminers on stone drivage work, it will be necessaryto adjust the base tonnage in each period in rela-tion to the number of places and miners producingcoal in each period. For instance in the fortnightending the 14th October, 1961, four miners will beengaged on stone drivage through a fault and 36miners employed on coal getting, the base tonnagefor such a fortnight would then be reduced on apro rata basis of eight and three quarters tons perman per shift, for each man engaged on stone drivework, the daily output required would then be 350less 35 equals 315 tons or 3,150 per fortnight. Anysuch allowance is to be calculated on the averagenumber of men on stone drive work in each week,not on a per day or shift basis.
