Poll reveals workers just can’t switch owhen supposed to be on summer breakAS THOUSANDS of employees set out forsummer holiday destinations, how many willactually be able to take a real break fromwork? Technological advances in hand-helddevices and logging in to the office remotelyhave made it widely acceptable in someindustries that employees will check and re-spond to e-mails on holiday, creating a culturein which employees are unable to ‘switch off ’during annual leave.

A Harris Poll of 2,000 UK employees con-ducted for jobs review site Glassdoor lastyear found that 44 per cent of participantsworking in London, and 51 per cent of allparticipants, admitted to doing some workwhile on holiday.

Of those employees who worked on holiday,11 per cent said they were worried about

getting behind on their workload; 10 per centsaid were hoping for a pay rise; and six percent were concerned they would lose their job.

All UK workers are entitled to 28 days’ paidholiday a year (although organisations canprovide additional holiday) including bankholidays under the Working Time Regula-tions 1998. This legal entitlement is intendedto provide workers with a period of rest from

work, to safeguard their health and well-being.

Employees may choose to work on holi-day, and for executives and small companyowners this may be essential for the smoothrunning of the business. But an employerexpecting employees to work on holiday risksbreaching a general duty to ensure, as faras is reasonably practicable, the welfare atwork of all its employees under the Healthand Safety at Work Act 1974. And while somemanagers may encourage employees to beavailable on holiday, this mentality of alwaysbeing ‘switched on’ to work could be contrib-uting to the increase of stress-related illnessamong UK employees.

Employers have a duty to undertake risk as-sessments and manage employee activities to

reduce stress levels at work. An employee suf-fering from work-related stress could bring apersonal injury claim against their employeror, if the stress leads to an illness which canbe classified as a ‘disability’ under the Equal-ity Act 2010, a disability discrimination claimif the employer fails to make reasonableadjustments.

Employers can require employees to takeholidays at certain times of the year and

can reject holiday request under the work-ing time regulations, for example, if theleave falls during a particularly busy period.Organisations could have a policy whichapplied when they do approve holiday, settingout clear working expectations for employeeswhile they are on leave.

The policy could, for example, encourage:
