New research suggestsunion law reforms couldcounteract the plan toincrease productivityREFORMS to union laws, as outlinedin the Trade Union Bill, could bedetrimental to the government’s aim toimprove business productivity, researchhas found.Proposals in the bill will see restric-

tive new turnout thresholds for unionballots, the end of the ban on usingagency workers to replace strikers, andtighter controls on how public money isused to subsidise trade union “facilitytime”, where union representatives arepaid to carry out trade union duties.However, joint research from profes-

sors of HR Management, Nick Bacon,from Cass Business School, and KimHoque, fromWarwick Business School,found that public sector workforces per-formed better when a union representa-tive was present in the workplace.The research, based on the govern-

ment-sponsored Workplace Employ-ment Relations Survey data (WERS2011), suggests that reducing tradeunion facility time is likely to have adetrimental effect on UK workforces,especially in the public sector, whereunions still have significant member-ship and support.According to the research, 38 per cent

of public sector workplaces have an

on-site union representative, comparedto 26 per cent in the private sector, how-ever, the vast majority of on-site repsare not engaged in union activities on afull-time basis.“Restricting facility time for union

representatives in the public sectorwould be counterproductive and maydamage levels of trust between employ-ers and employees, reduce co-operationwhen introducing change to improvepublic services, increase labour turno-ver, increase the number of industrialtribunal cases, and result in lowerlevels of labour productivity, servicequality and financial performance,”said Hoque.Bacon said: “As such, the proposed

legislation to limit the amount of timeunion representatives can spend ontheir representative duties appearsunnecessary and may reduce workplaceperformance in the public sector.”According to the research, 66 per cent

of union representatives in the publicsector state that they work closely withmanagement when changes are beingintroduced; a figure that rises to 82 percent among full-time worker repre-sentatives.When focusing on NHS workplaces

in particular, the researchshowed that labour turno-ver was almost three timeshigher and the indus-trial tribunal rate 14 timeshigher in NHS workplaceswithout union representa-tives compared to work-places where representa-tives were present.And managers in NHS

workplaces with unionrepresentatives presentwere more likely to reporthigher productivity,greater quality of servicesand “better” financialperformance.Bacon said: “The steps

laid out by the governmentdo not appear to take intoaccount evidence, usingdata the government itself has spon-sored, pointing to the positive effectsthat workplace trade union representa-tives have in the public sector.“Both full and part-time workplace

union representatives help improveperformance in the public sector andmanagers widely recognise this to bethe case,” he said.
