TRADE NOTICE

REGISTRATION OF CONTRACTS FOR EXPORT OF ORGANIC WHEAT

Vide Notification No 19/2009-2014 dated December 07, 2009, issued by Director General of Foreign Trade, Govt. of India, New Delhi (DGFT) the export of Organic Wheat is allowed subject to the following conditions:

1. Organic Wheat duly certified by Certification Bodies (CB) accredited by APEDA. Currently, there are 18 Accredited Certification Bodies list of which is given in Annexure 1

2. Export shall be allowed only from Customs, EDI ports 3. Export allowed is also subject to registration of contracts with APEDA, New Delhi upto a limit of 5,000 MT per annum

The quantity of organic wheat to be exported shall be monitored on a monthly basis both by the Customs Department as well as by DGCIS, through monthly reports to be sent to the Department of Commerce/DGFT, as well as to the Department of Food & Public Distribution

All other provisions of the Notification no. 33 (RE-2007)/2004-09 dated 8th October, 2007 as amended from time to time, shall remain unchanged, and shall continue to apply.

APEDA accordingly has laid down the following procedure for the Registration of the Contracts and issuance of Registration-cum-Allocation Certificate (RCAC) for the export of Organic Wheat. PROCEDURE Application for Registration of Contracts for

export of Organic Wheat, in the prescribed format as at Annexure I, will have to be sent by post by the exporters to the Cereal Division, Agricultural and Processed Food Products Export Development Authority (APEDA), 3rd Floor, NCUI Building, 3 Siri Institutional Area, August Kranti Marg (Opp.Asiad Village), New Delhi – 110016

CERTIFICATION It would be mandatory for the exporters to

furnish, along with their application a copy each of the Scope Certificate &Transaction Certificate obtained from one of the Certification Bodies accredited by APEDA under National Programme for Organic Production (as listed in Annexure II) The guidelines issued by APEDA to the Certification Bodies in this respect may also be seen at Annexure III

PROCESSING CHARGES

Processing charges of Rs. 25 per MT of the contracted quantity shall be paid by the applicants. This amount shall be paid by Demand Draft/pay Order drawn in favour of APEDA. All applications for registration of contracts should be accompanied by Demand Draft/Pay Order of requisite amount.

REGISTRATION The applications shall be scrutinized in the office of APEDA and a Registration-Cum-Allocation Certificate (RCAC) shall be issued to the applicants for quantity contracted.

DESPATCH DETAILS

While registering a new contract online exporters are required to provide details of actual shipments made against RCACs issued in past for export of Organic Wheat. RCACs in original with copies of shipping documents are required to be submitted after completion of dispatches against each RCAC

VALIDITY

The RCAC shall be valid for such period as may be specified in the LC/Contract.

AMENDMENT RCAC once issued will not be amended in respect of the particulars of the buyer and FOB price. The validity of an RCAC will be extended, only once, for a maximum period of 45 days.

To, All Certification Bodies, Accredited by APEDA under the NPOP Subject: Guidelines for Certifications of Organic Non-Basmati Rice and Wheat for Exports

This is to inform you that Govt. of India, vide DGFT Notifications No.19/2009-2014 and No.20/2009-2014 both dated December 07, 2009 has now permitted the export of 5000 MT of Organic Wheat (HS Code - 1001) and 10000 MT Organic Non-Basmati Rice (HS Code - 10061090, 10062000, 10063010, 10063090, 10064000) per annum (a copy of both the DGFT Notifications is enclosed for reference).

As per the procedure, placed on the APEDA website (http://203.196.130.19/apedawebsite/miscellaneous/Trade_Notice_Organic_NBR.pdf and http://203.196.130.19/apedawebsite/miscellaneous/Trade_Notice_Organic_Wheat.pdf), the exporters are required to submit an application to APEDA for issue of registration-cum-allocation-certificate (RCAC). In respect of export of organic wheat and organic non-basmati rice covered by HS codes referred to above, the applications are required to be accompanied by a Transaction Certificate. These documents can be issued by accredited certification bodies authorized for specific markets as per the scope of accreditation. In case of certain markets, in-conversion organic products are not allowed to be imported. Therefore, to verify this aspect the application also needs to be accompanied by the Scope Certificate indicating the organic status of the produce. The exporters have been advised to provide these documents while submitting their application for issue of RCAC.

You are requested to please comply with the requirements stated above. For the sake of convenience, we are enclosing the formats of the scope and transaction certificates for different markets. You are also requested to advise the exporters on the above lines while certifying their products referred to above.

Notes for completing the certificate of inspection Box 1: Authority or body in the third country entered in the list of countries in Annex 4, or authority or body entered in the individual authorisation. This body completes boxes 1-3 and 5-15.

Box 2: This box indicates the legal bases which are relevant for the issue and use of this

certificate; indicate the relevant provision, namely Article 23 (list of countries) or Article 24 (individual authorisation) of the Organic Farming Ordinance.

authority referred to in box 1. Box 4: The authorisation number in case of import under Article 24 (individual authorisation). in Switzerland who presents the consignment to Swiss customs for release, on its own or through a representative (for meat imports), or to its certification body for checking of customs documents.

Box 15: Declaration of body or authority issuing the certificate. The signature and the stamp

must be in a colour different to that of the printing. Box 16: Only for imports under the procedure laid down in Article 24 of the Organic Farming

Ordinance with an underlying valid individual authorisation at the moment of the import.. To be completed by the certification body of the importer on the occasion of the inspection.
