• Remember purpose and potential of BIM: Increased productivity throughout the lifecycle of a construction. Reduce costs and risks by enabling new ways of collaboration and communication. Help manage complexity.
• Consequence for Contracts: Keep it simple, don’t overspecify, ensure BIM organization spans all phases!

BIM in Contracts
Some Important Aspects
• Procurement policy (type of contract)
• Roles and responsibilities re BIM
• Allocation of risks
• Ownership of the BIM model / IP rights
• Standard of care / purpose of the model
• Data exchange and model management
• Scope definition
• Specification Documents

BIM Roles and Responsibilities
in Contracts
• Increasing awareness of BIM Roles
• Differing definitions of designations (BIM Champion, BIM Leader, BIM Manager, BIM Coordinator, …)
• Unfortunately still tendency to see BIM Manager as “the new designation for our Design Managers”
9 Christoph H. Weber
Example:
BIM personnel roles
„The Contractor shall provide personnel that will perform the BIM Services on the Project.
No 1 BIM Coordinator
10 years experience
BIM Implementation track record in multiple companies
Proven track record of establishing BIM Standards
…“
Is this a „Coordinator“ or a „BIM Manager“?
Definitions vary…
There is probably 10 people in MENA with this profile. 7 of them sit in the audience. None of them is free for another project.

BIM in the project organization
Architect
MEP Engineer
Others
Structural Des.
Client
BIM Advisor
Main Contractor Facility Manager
Steel Fabricator
MEP Subcontra.
Suppliers
All these „stars“ may call themselves BIM Manager. All work
on BIM. Who is high enough in the org
chart to coordinate their work?

12 Christoph H. Weber
Scope Definition
in current contracts
• Increasingly specific requirements in contracts
• 5 out of 5 recent drafts list BIM uses, deliverables
• Often very broad scope even for small projects
13 Christoph H. Weber
Example:
BIM use definition
„The Model shall be developed to LOD 500. During the Project, it shall be shared with the Client and used for
Design review and approvals
Virtual walkthrough
Clash mitigation
Building trade coordination
Cost estimation
…“
This is good!
Better would be a definition (or reference to
a guideline) specifying what exactly e. g. a virtaul walkthrough is – or what you want to achieve with
it.
14 Christoph H. Weber
Example:
BIM capabilities definition
„The Models shall have the capabilities:
3D Models: use in clash detection between buildings and trades
4D Models Use in Construction Scheduling, Site Logistics, Phasing, Constructability Review and Sequencing
…“
Capabilities definition – even better: What is supposed to be done with the
model.
15 Christoph H. Weber
LOD
• 4 out of 5 contracts require „LODs“ for models
• „Level of Detail“ vs. „Level of Development“
• Often unnecessarily general requirements
• „All model elements shall be maintained at a Level of Detail 400 throughout…“
LOD is defined differently – over 40 standards!
Reference the standard, be precise and don‘t rely too heavily on LOD as a spec.
You do NOT want (to pay!) „all“ model elements down to
the doorknob at the same level of detail!

19 Christoph H. Weber
Three things to remember when
drafting a contract
• Never forget: BIM is to improve productivity. Transparency and detail are not ends in themselves.
• Install a „BIM Leader“ in the project organization and
facilitate integrated teams if possible
• Be as specific as you can. Provide samples and adapt specification documents to your needs
