SAPAGKA'T, isinulit ni Kgg. Punong-Jungsod Arlene B. Arcillas sa kapulungan ang sipi ng Executive Order No. 05-2011 na kanyang nilagdaan nonng Abril 20, 2011 na nagsasaad ng - ADOP71NG AND INST/TlJTING THE SANTA ROSA PUBUC TRANSPORT ASSISTANCE PROGRAM (SRPTAP} - PANTAWID PASADA PURSUANT TO PRESIDENTIAL EXECUTIVE ORDER NO. 32, DA TED APRIL 1, 2011;

SAPAGKA'T, kinikilala ng Sangguniang Panlungsod ang kahalagahan ng pagbibigay ng tulong sa sektor ng transportasyon na malubhang naa-apektuhan ng pandaigdigang pagtaas ng halaga ng Jangis at krudo;

SAPAGKA'T, kinikilala rin ng Sangguniang Panlungsod ang pagpapatibay ng pagbibigay-tulong mula sa Kaban ng Lungsod para sa sektor ng transportasyon na kinabibilangan ng sektor ng operator at may-ari ng mga tricycle na may prangkisa at legal na namamasada sa Lungsod ng Santa Rosa, Laguna.

KAYA'T, sa pamamagitan ng isang mungkahing pinangalawahan ay:

IPINASISISYA, tulad ng dito't ginagawang PAGPAPASIYA at ngayon nga ay IPINASIYA ang pagpapatibay at pagkilala sa Executive Order No. 05-2011, nilagdaan ni Punong-lungsod Arlene B. Ardllas na may petsa Abril 20, 2011 at pagbibigay pahintulot na lumagda sa anumang kasulatan ng pagkakasundo kasama ang DILG para sa pagpapatupad ng programa.

EXECUTIVE ORDER NO. 05, S-2011

ADOPTING AND INSTITUTING THE SANTA ROSA PUBLIC TRANSPORT ASSISTANCE PROGRAM (SRPTAP) - PANTAWID PASADA PURSUANT TO PRESIDENTIAL EXECUTIVE ORDER NO. 32, DATED APRIL 1, 2011

WHEREAS, the Office of the President pursuant to Administrative Order No. 6, Series of 2011 established the inter-Agency Energy Contingency Committee (IECC) ·to undertake a comprehensive audit of the available resources of the National Government, evaluate contingency plans for approval of the President;

WHEREAS, the present situation in oil producing countries triggered the high fuel prices and the IECC has determined that the public transport sector has been hardest hit by said oil prices hike, given that oil is one of the major operating costs;

WHEREAS, THE IECC unanimously recommended to provide assistance to public transport sector to relief them in their vulnerable situation, thereby the issuance of EXECUTIVE ORDER NO. 32, dated April 1, 2011 by the Office of the President of the Republic of the Philippines; ·

WHEREAS, the City of Santa Rosa, Laguna firmly believes that the same recommendation of the IECC to provide assistance to public transport sector, particularly the Tricycle Operators/Owners, is the most equitable and efficient form of intervention to adopt as targeted relief to the sector;

WHEREAS, the City of Santa Rosa, Laguna has substantial funds to finance programs and projects of the city government, and for such other purposes as may be deemed approved, subject to the existing accounting and auditing procedures.

NOW, THEREFORE, I, ARLENE B. ARCILLAS, City Mayor of the City of Santa Rosa, Lagun·a, by virtue of the powers vested in me by law, do hereby order: ·

SECTION 1. The Santa Rosa Transport Assistance Program (SRT AP)- Pantawid Pasada is hereby established which will provide targeted relief to the public transport sector to cushion the impact of high fuel prices on the riding and consuming public.

SECTION 2. Disbursement of SRTAP Funds. The SRPTAP shall be implemented pursuant to the Presidential Executive Order No. 32 to partially subsidize the average consumption of the identified public transport group; Provided, That the disbursement shall be made per franchisee and the number of franchised units based on the records of the City Government.

SECTION 3. Funding Source of the SRPTAP. The funding requirements of the program shall be sourced from whatever funds available in approved budget of the Office of the Mayor.

SECTION 4. This Executive Order shall take effect immediately.

WITNESSETH, That: .

WHEREAS, in fulfillment of the mandates of Section 447 (a)(3)(vi) and Section 458 (a)(3)(vi) of the Local Government Code, municipal and city government authorities have granted, and continue to grant, franchises relative to the operation of tricycles within their jurisdictions;

WHEREAS, it is an acknowledged fact that the public transport sector is one among those most vulnerable to the economic aftermath of oil price increases;

WHEREAS, in keeping with the principle of compassionate government, the Office of the President issued Executive Order No. 32, s. 2011, creating the Public Transport Assistance Program as an urgent intervention aimed at cushioning the impact of high fuel prices on the marginalized sectors of society;

~ WHEREAS, in the language of the said Order, in the case of the tricycles, the PTAP shall

WHEREAS, pursuant to the above-mentioned Executive Order, and its Implementing Rules and Regulations, the Department of the Interior and local Government, in consideration of its mandate and organiza_tional reach, is tasked to coordinate with municipal and city

governments the implementation of the PTAP;

WHEREAS, the implementation of PTAP grants a one-time tricycle transport financial subsidy to the qualified beneficiary-tricycle franchisees;

NOW THEREFORE, for and in consideration of the foregoing premises, the DILG IV-A (CALABARZON) and the Municipal [City] Government of SNM:k (0.),q.,, \ffiu.NI:\:

.. r- -A. The DILG Region IV-A (CALABARZON) shall: ·

1. Upon receipt of the sub-allotment and NTA, immediately effect the release of the: ·i tricycle transport financial subsidy in the form of a funding check to, through the Municipal (or City] Treasurer, the Municipal [ or City] Government of

2. Direct the concerned Municipal Local Government Operations Officer and City Local Government Operations Officer, through the Provincial Director or City Director, to call for a coordination meeting with concerned municipal [or city] authorities, at least three [3] calendar days prior to the scheduled financial subsidy distribution to firm up administrative preparations for such event;

3. Within five (S) calendar days prior to the distribution of the subsidy, in coordination with the LGU, take the lead in the conduct a local government-wide information drive informing t ricycle franchisees and other interest groups on the dates of, and venue in, the distribution of such funds, including the required and reasonable documentary requirements such as Proof of Franchise;

4. Upon the release of funds, require the submission by LGU, within fifteen (15) days, through the Provincial [City] DILG Office, of

a. Report of Disbursements duly verified by the Local Auditor; and b. Distribution List containing t he List of Franchisees, Franchise Numbers, Plate

Numbers of Tricycles, the Amounts and Date Received, and Signatures of Franchisees, duly certified correct by the Head of the Tric;ycle Franchising Board [or Task Force, Committee, Office or Unit and Municipal [or City] Treasurer

5. Regional Office shall issue corresponding official receipt for any unclaimed/excess amount refunded;

In addition, it may call upon the Philippine National Police to ensure the expedient and orderly release of the tricycle transport financial subsidy to the beneficiaries.

B. The LGU shall :

1. Cause the preparation and certification of a complete List of Tricycle Franchisees, Addresses and Number of Operating Tricycles, as of March 28, 2011, 11:30 AM;

---;_;g--==}· Cause the posting of the Certified List of Tricycle Franchisees, Addresses, Franchise Numbers and Number of Operating Tricycles in publicly accessible and conspicuous

~ laces within local government-owned buildings;

3.· Transmit to the DILG Regional Office, through the Municipal [City] Local Government Operations Officer, a copy of the Certified List of Tricycle Franchisees, Addresses and Number of Operating Tricycles as basis in the computation of the tricycle transport

financial subsidy;

4 . Upon receipt of the funding check, cause the immediate issuance of an Official Receipt to DILG Regional Office of IV-A (CALABARZON), acknowledging the tricycle transport financial subsidy;

5. Direct the concerned municipal [city] officials or employees to attend the coordination meeting with the DILG Municipal Local Government Operations Officer, Cit y Local Government Operations Officer or City Director to firm up administrative preparations for the scheduled financial subsidy distribution;

6. Within five (5.) calendar days prior to the distribution of the tricycle tra·nsport financial / ,. subsidy, cause, in collaboration with the Municipal · Local Government Operations Officer, City Local Government Operations Officer or City Director, the conduct of a local government-wide information drive informing tricycle franchisees and other interest groups on the date of, and venue in, the distribution of such funds, including the required and reasonable documentary requ irements such as Proof of Franchise and Identification Card {ID} or any other proof of identity;

7. Devise a system to ensure the integrity of fund disbursements to tricycle franchisees, as well as to effect an organized and orderly distribution of tricycle transport financial subsidy to the beneficiary-tricycle franchisees, based on the Certified List of Tricycle Franchisees;

8. Within five (5) days upon receipt of the funding check, the LGU shall effect the distribution of the tricycle transport financial subsidy;

9. Within five (5) days after the full distribution of the tricycle transport financial subsidy, submit to the DILG Regional Office, through the Provincial [City] DILG Office,

a. Report of Disbursements duly verified by the Local Auditor; and b. Distribution List containing the List of Franchisees, Franchise Numbers, Plate

Numbers of Tricycles, the Amounts and Date Received, and Signatures of Franchisees, duly certified correct by the Head of the Tricycle Franchising Board [or Task Force, Committee, Office or Unit and Municipal [or City] Treasurer

10. The LGU shall refund any unclaimed/excess amount to the Regional Office;

11. Provide counterpart resources t hrough staff time, office space, necessary supplies, and other incidental fees (e.g. notarial fee), in support of the implementation of the Public

Transport Assistance Program.
