viii Construction spoils, including bituminous materials, must not be allowed to contaminate watercourse and the dumpsites for such materials must be secured so that they should not leach into the ground water.

Construction spoils, including bituminous materials are stored away from the surface water and are stored in a plastic sheeting to prevent leaks and spills and are not allowed to contaminate water courses, also it is secured that they do not leach into ground water.

ix Any hazardous waste generated during construction phase, should be disposed off as per applicable rules and norms with necessary approval of Himachal Pradesh Pollution Control Board.

It shall be done.

x The diesel generator sets to be used during construction phase should be low sulphur diesel type and should conform to Environment (Protection)Rules prescribed for air and noise emission standards.

The DG Sets are used as power backup. The low sulphar diesel is used as fuel in order to reduce the pollution load. The DG Sets are acoustically enclosed and conforms to the rules made under E(P) A, 1986 prescribed for Air and Noise emission standards.

xi The diesel required for operating DG Sets shall be stored in underground tanks if required; clearance from Chief Controller of Explosives shall be taken.

It shall be done.

xii Vehicles hired for bringing construction material to the site should be in good condition and should have a pollution check certificate and should conform to the applicable air and noise emission standards and should be operated only during non-peak hours.

The vehicles hired for bringing construction material to the site are in the good condition. They are pollution under control certified vehicles and are allowed to operate during non-peak hours.

xiii Ambient noise level should conform to residential standards both during day and night. Incremental pollution loads on the ambient air and noise quality should be closely monitored during construction phase. Adequate measures should be made to reduce ambient air and noise level during construction phase, so as to conform to the stipulated standards by CPCB/HPPCB.

xiv Fly ash should be used as building material in the construction as per the provisions of Fly Ash Notification of September,1999 and amended as on 27th August,2003.(The above condition is applicable only if the project site is located within 100 Km of Thermal Power Stations)

Ready mix concrete are used for construction from RMC Plant and cement contains fly ash.

xviii Permission to draw ground water shall be obtained from the competent authority prior to construction / operation of the project.

We have already received the NOC from CGWB for abstraction of ground water and the copy of the same is already sent to you.

xix Separation of black and grey water should be done by the use of dual plumbing line for separation of grey and black water.

It shall be done.

xx Fixtures for showers, toilet flushing and drinking should be of low flow either by the use of aerators or pressure reducing devises or sensor based control.

Fixtures for showers, toilets flushing and drinking will be of low flow and sensor based in order to reduce the wastage of water.

xxi Use of glass may be reduced by up to 40% to reduce the electricity consumption and load on air conditioning. If necessary, use of high quality double glass with special reflective coating in windows.

xxii Roof should meet the prescriptive requirement as per Energy Conservation Building Code by using appropriate thermal insulation material to fulfill the requirement.

Roof designing are as per Energy Conservation Building Code Standards and appropriate thermal insulation material shall be used in order to conserve the energy.

xxiii Opaque wall should meet the prescriptive requirement as per Energy Conservation Building Code which is proposed to be mandatory for all air

xxiv The approval of the competent authority shall be obtained for structural safety of the building due to earthquake , adequacy of fire fighting equipments, etc. as per National Building Code including protection measures from lightening etc.

xxv Regular supervision of the above and other measures for monitoring should be in place all through the construction phase, so as to avoid disturbance to the surroundings.

xxvi Under the provision of Environment (Protection) Act, 1986, legal actions shall be initiated against the project proponent if it was found that the construction of the project has been started without obtaining environmental clearance.

The construction of the project was started after getting the Environmental Clearance from MoEF, Govt. of India.

GENERAL CONDITIONS 1 The environmental safeguards contained in the EIA

Report should be implicated in letter and spirit. It is being done.

2 Provision should be made for supply of Kerosene or cooking gas and pressure cooker to the labourers during construction phase.

Free fuel and utensils are provided to the construction workers at the site by the project proponent

3 Six monthly progress reports should be submitted to the Ministry and its Regional office, Chandigarh.

4 Officials from the Regional office ofd MOEF, Chandigarh who would be monitoring the implementation of environmental safeguards should be given full cooperation, facilities and documents/data by the project proponents during their inspection. A complete set of all the documents submitted to MOEF should be forwarded to the CCF, Regional Office of MOEF, Chandigarh.

Full cooperation, facilities & documents/data will be provided to the officials of Regional Office of MoEF, Chandigarh.

5 In case of any change(s) in the scope of the project, the project would require a fresh appraisal by this Ministry.

A fresh application will be submitted to MoEF, If any change in scope of the project.

6 The Ministry reserves the right to add additional safeguard measures subsequently, if found necessary, and to take action including revoking of the Environmental Clearance under the provisions of the Environmental (Protection) Act,1986 to ensure effective implementation of the suggested safeguard measures in a time bound and satisfactory manner.

The project proponent will abide by all the rules/ regulation and it will also ensure its effective implementation.

7 All others statutory clearances such as the approval for the storage of diesel from the Chief Controller of Explosives, Fire Department, Civil Aviation Department, Forest conservation Act,1980 and Wildlife (Protection) Act,1972 etc. shall be obtained, as applicable by project proponents from the respective competent authorities.

8 These stipulations would be enforced among others under the provisions of Water(Prevention and control of pollution)Act,1974, the Air(Prevention and control of pollution) Act,1981, the Environmental(Protection)Act,1986, the Public

Liability(Insurance)Act,1991 and EIA Notification,2006.

available at the site office.

9 Environmental Clearance is subject to the final order of the Hon’ble Supreme Court of India in the matter of Goa Foundation Vs. Union of India in Writ Petition(Civil)No.460 of 2004 as may be applicable to this project.

This shall be applicable.

10 Any appeal against this Environmental Clearance shall lie with the National Environmental Appellate Authority, if preferred , within a period of 30 Days as prescribed under section 11 of the National Environmental Appellate Act,1997.
