RE: South Bergen Joint Insurance Fund

Dear Mr. Curioni:

Please be advised that my office is counsel to the South Bergen Joint Insurance Fund and I have. been advised of several statements that you have made concerning the claims procedures of the. Joint Insurance Fund. Commissioners Anthony Luna and Charles Cuccia are two of ten

members (three alternates) of the Executive Committee and obviously do not control whatparticular claims are paid.

You seem to suggest that bills submitted by the Borough of Lodi are casually considered andpaid for by the Fund. Nothing could be further from the truth. All member municipalities arerequired to submit formal claims which are then considered by a professional claimsmanagement company. The said entity thereafter makes recommendations to the ExecutiveCommittee pertaining to the payment of such claims. You should be aware that there is a veryformal process involved in the submission of claims and the payment of same. No one memberof the Executive Committee has any final authority over the payment of Fund monies.

Be advised that if you continue to make inaccurate and/or false accusations about these twoCommissioner's (i.e. Messrs Luna and Cuccia) legal recourse will be recommended as anappropriate and justifiable remedy. Please be guided accordingly.
