T h eproject will includeland acquisition andconstruction of a new,72,448 square feet mul-tifamily housing com-plex on approximately6-acres of an overall20-acre undeveloped,herbaceous, property.The proposed complexwill consist of 20 resid-ential buildings with 80total units and 1 com-munity clubhouse. Ap-proximately 90% (72units) will be reservedfor low to moderaterenters and 10% (8units) will be marketrate households. Thecomplex will consist offorty-eight (48) one-bed room/one -ba th -room units and thirty-two (32) two-bath-room/two-bathroomunits. The develop-ment will be a seniorl iving developmentwith amenities and ser-vices to support thecommunity’s seniorpopulation. Residentialamenities will includeenergy star appliances,ceiling fans, laundryconnections, coveredparking, balconies andentries. The project willinclude a communitypavilion with a picnicand grilling area. Thecommunity buildingwill include the follow-ing amenit ies: fur-n i shed commun i ty

Legalroom, office, and com-munity laundry room.The total acreages ofwetlands on the projectsite is 3.623 acres. Theproject has been de-signed, with an addi-tional minimum 50-foot setback to avoidany impacts to wet-lands.

The project will re-quire site clearing andgrading, including theremoval of all site ve-getation, of the entiresite and connecting toexisting electric utilit-ies and connection tomunicipal sewer andwater services that isproposed for construc-tion along RattlesnakePoint Road. A newgrinder station will beconstructed on theproperty to connect tothe municipal sewerutility. The total fund-ing for the project is es-timated at $12,102,151,of which $9,000,000wou l d b e f u n d e dthrough the Texas Gen-eral Land Office (GLO)Af fo rdab l e Ren t a lHousing Program for

EXPLANATION OFA PROPOSEDACTIVITY IN AWETLAND

This is to give noticethat the GLO has con-ducted an evaluation asrequired by ExecutiveOrder 11990, in ac-cordance with HUDregulations at 24 CFR55.20 Subpart C Pro-cedures for Making De-terminations on Wet-land Management.

The GLO has con-sidered the followingalternatives and mitiga-tion measures to betaken to minimize ad-verse impacts and to re-store and preserve nat-ural and beneficial val-ues: (i) Alternativesconsidered: The NoAct ion Al terna t ivewould not allow for theconstruction of the Sil-verLeaf at RockportMultifamily New Con-struction Project, res-

Legalulting in a loss of af-fordable, high-quality,energy efficient resid-ential housing in Aran-sas County that couldprovide housing for in-dividuals and familiesthat were displaced as aresult of HurricaneHarvey. Under the NoAction Alternative, af-fected residents wouldcontinue to be dis-placed or potentiallylive in damaged, un-safe, and unsanitaryhousing. The No Ac-tion Alternative fails toaddress the unmethousing needs of low-to moderate-incomehouseholds in the stormdamaged areas. The di-minished structural in-tegrity of existing hur-ricane-damaged homeswould put residents atgreater risk should an-other disaster occur.SilverLeaf at Rockport,LP used the limitingfactors of avoiding thefloodplain, communityneeds, availability toaccommodate 80 seni-or/multifamily units,and proximity to amen-ities and resources. Ul-

(ii)Mitigation measures: Areview of the prelimin-ary site plan based onthe delineated wetlanddata identified approx-imately 3.623 acres ofPEM wetlands wouldbe directly impacted bythe project. Utilizingthe wetland delineation,the project was re-designed to avoid dir-ect impacts to all of thedelineated wetlandsonsite, and implement aGLO-prescribed 50-foot setback from allwetlands to mitigate forpotential indirect im-

Addition-al mitigation measuresinclude the implementof appropriate erosionand sediment controlmeasures and otherconstruction stormwa-ter best managementpractices (includingproper site manage-ment and soil stabiliza-tion) during construc-tion activities to fur-ther mitigate any indir-ect impacts to onsitewetlands during con-struction. Based on therevised site plan, noimpacts to wetlands areanticipated.

The GLO has reevalu-ated the alternatives to

TheGLO has performed anenvironmental reviewof the project in ac-cordance with HUD’sregulations at 24 CFR58, and determined thatthe project will have nosignificant impact onthe environment; thatthe proposed projectwill not aggravate cur-rent hazards to wet-lands, or disrupt wet-land values.; and rees-tab l i sh ing hous ingsolutions that were im-
