1. STAFFING MATTERS

Interviews were held for the vacant position of Apprentice Mechanic based atCrookwell on Monday 10 January 2011. Mr Daniel Kadwell was offered and hasaccepted the position as Apprentice Mechanic and commenced duties on Monday, 24January 2011.

Interviews were held for the readvertised vacant position of Works Manager based atCrookwell on Wednesday, 22 December 2010. Mr Carry Anable was offered and hasaccepted the position as Works Manager and commenced duties on Monday, 14February 2011.

The vacant position of Plant Operator/Truck Driver based at Gunning was advertisedinternally with applications closing on Friday, 18 February 2011. Council will beadvised of the results of the applications and interviews in due course.

The vacant position of Plant Operator/Backhoe based at Gunning was advertisedinternally with applications closing on Friday, 18 February 2011. Council will beadvised of the results of the applications and interviews in due course.

Mrs Narlissa Cooper, Council's Environmental Services Officer, has resigned fromCouncil after 8 years of service, effective from Monday, 14 February 2011. Councilwill utilise the opportunity of the vacant position to adjust the position fromEnvironmental Services Officer to Development Assessment Officer, a role whichbetter fits the needs of the Environment and Planning Division.

The vacant position of Development Assessment Officer, based at Gunning, wasadvertised internally with applications closing on Friday, 25 February 2011. Councilwill be advised of the results of the applications and interviews in due course.

Precis: Providing details in relation to a request for Council to makethe Youth Council (YA'MAD) Section 355 Committee ofCouncil.

2. YOUTH COUNCIL FVA'MAm

Council received correspondence on 1 February 2011 from the Youth Council. Nowthat the Youth Council CyAIMAD) has been fanned (with an executive and 13teenage members), they believe that they need to formalize the position of thecommittee within Council.

They have requested that Council consider making YA'MAD a Section 355Committee of Council and that Clr. Sandra Bill be appointed the councilrepresentative on the committee and that Mrs Brenda Proudman be appointed as thestaff representative on the committee.

They have also requested that the YA'MAD be given the responsibility of organizingthe annual Youth Week functions.

Youth Week has previously been organized by the Visitor Information Centre overthe past few years, however, now that a Youth Group has been formed there exists theopportunity for the Youth Council and its members to organize and coordinate anevent(s) for their peers. Youth Week runs from 1-10 April 2011.

Recommendation: That:

1. Council adopts the Youth Council (YA'MAD) as a Section 355 Committee ofCouncil;

2. Council appoints the Youth Council Q^A'MAD) in accordance with Clause260 of the Local Government (General) Regulation 2005; and

3. Council adopts the following Committee stmcture, membership andappointment of representations/delegates as being appropriate for the YouthCouncil (YA'MAD):

We were met by a group o'f excitedyoung people between the ages of 13-18 yrs who had been invited bytheCoundl to'attendthisworkshop to canvas their views. The ULS Council had done a lot of background work to get'such agreat attendance!

3. LGSA ELECTION PRIORITIES 2011

The Local Government and Shires Associations of NSW (LGSA) have issued awarning to all political parties with the launch of their NSW Election Priorities 2011,that councils and the communities they represent can no longer be ignored, and urgentaction is required.

The LGSA's NSW Election Priorities 2011 outlines the major issues of significanceand the LGSA's proposed solutions under six key themes:

1. Improved Local Government financial viability;2. Restore the balance to land use planning;3. Stronger support for communities;4. Greater natural environment protection;5. Enhanced infrastructure provision and maintenance; and6. Better local governance.

President of the Local Government Association, Cr Keith Rhoades has noted thatcommunities deserve better and urged voters to "support candidates who support yourcouncil."

Cr Keith Rhoades commented that Local Government offers the vital services andfacilities that are the building blocks of local communities - from roads to libraries towaste, and youth and senior services.

Cost-shifting, rate pegging, lack of infrastructure funding and the erosion of planningpowers are some of the recent problems created by the State Government that iscrippling councils. Councillor Rhodes stated that ultimately it is the people of NSWwho suffer from these actions.

President of the Shires Association of NSW, Cr Bmce Miller, noted that the LGSAhave requested a response in writing from all NSW political parties by Monday, 28February 2011.

Cr Miller stated that the LGSA have outlined very clearly to both the Premier and theLeader of the Opposition the solutions to a range of unresolved issues that the LGSAbelieve will help put NSW back on its feet.

Local Government issues such as returning planning powers to councils and ensuringadequate infrastructure provision are critical, and the LGSA will be lobbying hard toensure they remain a top priority.

b Cease the practice of cost shifting and enact legislation that requires Local Government's agreement to take onadditional responsibilities. If taken on, provide corresponding funding or allow adequate revenue raising capacity.

c Provide $6 million to improve Local Government's capacity to undertake financial planning andasset management to support Community Strategic Planning.

d Implement a broad based property levy for funding emergency services. If a broad based property levy is rejected,allow councils to recover their contribution through a corresponding increase in their council rates.

e Introduce competition, transparency and accountability, in providing and costing energy for general electricity andstreet lighting.

Allocate a share of mining royalties to Local Government through a system that provides funding to all councils, withadditional funding for councils impacted by the mining industry.

2. Restore the balance to land use planningTo restore the balance to land use planning, the LGSA request that the incoming NSW Government:

a Undertake a major review and rewrite of the Environmental Planning and Assessment Act (NSW) 1979 torestore the balance in the NSW planning system, and recognise that councils and the NSW Government eachhave a role to play in planning for and managing the sustainable development of local communities.

b Repeal Part 3A and similar provisions such as the Major Projects SEPP, and in close consultation with LocalGovernment devise and implement a genuine test for matters of state significance.

c Abolish Joint Regional Planning Panels (JRPPs).

d Revise the Affordable Rental Housing SEPP to include additional assessment provisions relating toconsultation, council involvement, access to public transport, residential character, density, sitesuitability,accessibility and payment of appropriate development contributions.

e Treat Local Government as a partner in future reviews of the Metropolitan Plan for Sydney (2036), RegionalStrategies and the State Plan.

3. Stronger support for communities

To provide stronger support to communities, the LGSA request the incoming NSW Government:

a Guarantee continuing Local Government management of Home and Community Care (for those councilspresently involved) in the transfer of control from the NSW Government to the Australian Government. Aguarantee of improved local service levels in all areas is also sought.

b Provide a $20 million enhancement to NSW recurrent funding for those councils presently involved inprevention and early intervention services for children.

c Increase funding for publUibraries by $5.2 million each year for five years to reach a new recurrent target of$51.5 million per year by 2015/16.

d Create a Local Government arts and cultural development fund, with a key objective being to improve artsinfrastructure outside the Sydney CBD.

e Scale down the size of the Central West and Murrumbidgee Local Health Networks and give local councils aseat on the governing councils of all country Local Health Networks,

Provide a $10 million increase to NSW recurrent funding for those councils presently involved in preventativehealth initiatives.

g Work in collaboration with Local Government to ensure the Australian Government carries out proper socio-ec^o-micjln_alys_ishdevd<?ping the Murray-Dal1in9Basin pian'and Provides early, well-targeted mitigationand transition measures to help communities adapt to the final Murray-Darling Basin Plan.

h Strengthen programs to support population growth and economic development in regional and rural NSW(including programs such as, or similar to, Evocities and PORTS).

Set new requirements for Government strategic planning to address social justice or social inclusion..

Introduce new restrictions on the sale of alcohol at pubs and clubs across NSW as proposed in theLast Drinks campaign.

k Give due consideration to the five issues for future NSW Government action to reduce the impact of cancer onall NSW communities (as outlined in the Cancer Council of NSW "Saving Life" Campaign).Provide additional recurrent funding to NGOs offering mental health services in rural areas.

m Work in collaboration with Local Government to ensure the Australian Government provides more funding forresidential aged care and for ageing in regional and rural NSW.

n Reform NSW Police recruitment, transfer and sick leave policies to ensure all regional, rural and remotestations are always staffed at authorised operational levels.

6. Better local governanceTo provide better local governance, the LGSA request the incoming NSW Government:

a Further develop and implement the NSW and Local Government Intergovernmental Agreement to establisha mechanism that will determine which sphere of government should deliver a particular service in agiven scenario. Also ensure that the sphere of government which is given the responsibility is also givencorresponding adequate funding or revenue raising capacity.

b Support the national Local Government campaign to recognise Local Government in the AustralianConstitution, to ensure the Australian Government can directly fund Local Government nationwide.

c Create the option for councils to run their elections locally, with an independent returning officer, to save moneyand restore local confidence.

d Set up an Intergovernmental Commission for Future Local Government involving representatives from all levelsof Government, the LGSA and independents. The aim of the Commission would be to guide a comprehensiveprogram to strengthen Local Government for the coming term and future 40 years, as outlined in the outcomesof LGSA' Modernising Local Government Initiative.

e Provide legislation or Premier's directive for NSW Government agencies to incorporate local Community StrategicPlans in state planning processes.

Provide funding for a significant long-term mentoring program aimed at improving the diversity of councillors($600,000 per year for eight years).

g Remove the concept of a 'body politic' from the Local Government Act (NSW) 1993.

POLICY STATEMENT

In the Upper Lachlan Shire Council, as in all Councils, there is a complex web ofrelationships between Councillors and Council employees. These contacts arenecessary and essential to the smooth functioning of Council, as they allowCouncillors access to information and employees.

The policy is designed to provide clear guidelines that help Councillors andemployees to understand fully their respective roles and how they should operate, inorder to perform their job effectively and maintain a respectful and harmoniousrelationship.

This policy will:(a) provide a clear definition of the respective roles of elected members and

1. APPLICATION

This policy applies to Councillors and Council employees. It complementsCouncil's Code of Conduct.

This policy covers interaction between Councillors and Council employees informal and workplace situations. Where relevant, it should be considered inconjunction with Council's Harassment Policy.

The complaints section of this policy does not cover fraud or corruptioncomplaints, which are covered under Council's Fraud and CorruptionPrevention Policy and Internal Reporting - Protected Disclosures Policy.

2. ROLES AND RESPONSIBILITIES

Chapters 9 and 11 of the Local Government Act 1993 set out the statutory rolesand duties of Councillors and the General Manager. The Councillors are thegoverning body of the corporation and they have the responsibility of directingand controlling the affairs of the Council in accordance with the Act. Chapter 9includes the following provisions:

2.1 The Governing Body (s.222)The elected rqn-esentatives, called "councillors", comprise the governingbody of the Council.

2.2 The Role of the Governing Body (s.223)The role of the governing body is to direct and control the affairs of theCouncil in accordance with this Act.

2.3 The Role of the Mayor (s.226)The role of the Mayor is:(a) to exercise, in case of necessity, the policy-making functions of the

governing body of the Council between meetings of the Council(e.g. urgent demolition orders, authority to financially assist thecommunity by the allocation of resources during natural disasters,commencement of urgent legal action);

(b) to exercise such other functions of the Council as the Councildetermines (e.g. determining the appropriateness of holding aspecial event such as a fun run, approval of the General Manager'sleave, etc.)

(c) to preside at meetings of the Council; and(d) to carry out the civic and ceremonial functions of the Mayoral

office.

2.4 The Role of a Councillor as a Member of Council (s.232(l))The role of a Councillor is:(a) to provide a civic leadership role in the development of the

Community Strategic Plan and to be responsible for monitoring theimplementation of Council's Delivery Program;

(b) to direct and control the affairs of the Council in accordance withthe Act;

(e) to review the performance of Council and its delivery of services,the delivery program and revenue policies.

2.5 The Role of a Councillor as an Elected Person (s.232(2))The role of a Councillor as an elected person is:(a) to represent the interests offhe residents and ratepayers;(b) to provide leadership and guidance to the community; and(c) to facilitate communication between the community and Council.

2.6 The Role of the General Manager (s.335(l))The General Manager is generally responsible for the efficient and theeffective operation of the Council's organisation and for ensuring theimplementation, without undue delay, of decisions of the Council.

2.7 The Functions of the General Manager (s.335(2))The General Manager has the following particular functions:(a) to assist Council with the development and implementation of the

Community Strategic Plan and the resourcing strategy. DeliveryProgram and Operational Plan and the preparation of the AnnualReport and State of the Environment Report:

(b) to manage the Council on a day-to-day basis;(c) to exercise such of the functions of the Council as are delegated by

Council to the General Manager;(d) to appoint staff in accordance with an organisational structure and

resources approved by Council;(e) to direct and dismiss staff; and(f) to implement Council's equal employment opportunity management

plan.

3. PROTOCOLS FOR INTERACTIONS

All participants in Local Government are encouraged to facilitate a respectfuland harmonious relationship between Councillors and Council employees. Inparticular, the following protocols must be observed:

3.1 Councillors

(a) Councillors should bear in mind the spirit and letter of the LocalGovernment Act 1993 as to their roles and also observe establishedprotocols.

(b) Councillors are encouraged to respect the functions andresponsibilities of employees and the proper workings of theCouncil organisation.

(b) Councillors must not direct employees as to the performance of theirwork duties.

(c) Requests from Councillors involving significant staff time should bemade to the General Manager, or in his absence, the Acting GeneralManager.

(d) Councillors have a right to access to Council employees and toinformation for civic purposes under the circumstances set out inthis policy.

(e) Should a Councillor have a complaint about an employee, thecomplaint must be directed to the General Manager as set out inClause 6 of this policy.

3.2 Employees(a) Employees must be polite at all times, treat Councillors with the

respect due to their office and avoid political comment.(b) In all formal settings, employees will address Councillors as

Councillor (last name) and the Mayor as either Mayor (last name) orMr (Madam) Mayor.

(c) Employees should seek the advice and approval of the GeneralManager, or in his absence, the Acting General Manager, prior toresponding to a direct request from a Councillor, except where therequest is minor or of a day-to-day operational nature.

(d) Employees must ensure that information provided to Councillors isfactually correct, complete and relevant.

(e) In making recommendations or providing advice to Council,employees are not required to follow any directions given byCouncillors or Council as to the nahu-e of that advice or thoserecommendations.

(0 Employees must not, unless a senior manager of the Council,approach Councillors directly on staffing or political issues.

4. INTERACTIONS DURING MEETINGS

4.1 Councillors

(a) Must not make statements or imputations or disclose informationconcerning the personal affairs of any Councillor or Councilemployee without the consent of that Councillor or employee.

(b) May, through the Chairperson, put a question to another Councillor,and may, through the General Manager, put a question to a Councilemployee. However, the Councillor or Council employee to whomthe question is put is entitled to be given reasonable notice of thequestion and, in particular, sufficient notice to enable reference to bemade to other persons or documents.

(c) Must always be mindful of the relevance of questions that are put toother Councillors and Council employees during meetings orconferences of the Council.

(d) Must permit a Council employee a reasonable time to research andprovide answers to questions.

(e) Must not interrupt, harass or unreasonably criticise a Councilemployee who is speaking at a conference or meeting of theCouncil.

4.2 Employees(a) Must only speak when requested. Such requests must be directed

through the General Manager.(b) Must provide an answer to questions put through the General

Manager if the information is readily available to them.

(c) May take questions on notice if information is not readily available.However, taking questions on notice should not be used as anexcuse to avoid answering questions.

5. INTERACTIONS OUTSIDE MEETINGS

5.1 Councillors

Councillors, in their dealings with employees, and the Council. .

organisation, must:(a) have regard to the provisions of the Local Government Act, 1993,

and the roles and responsibilities set out therein and reproduced inClause 2 of this policy.

(b) respect the functions, responsibilities and workload of individualemployees.

(c) respect and comply with the proper and reasonable practices andprocedures of the organisation.

(d) only direct a question or request information through the GeneralManager or Senior Managers. The Councillor may decide thequestion is to be asked or the request is to be made orally or inwriting, but must not unreasonably ignore a request from the staffmember concerned for it to be put in writing.

5.2 Employees /

Employees, in their dealings with Councillors, must:(a) respect the role and responsibilities of all Councillors, and their right

to obtain relevant information.(b) on receipt of a question or request under subclause 5.1 (d) of this

policy, answer the Councillor's question or provide to theCouncillor the information sought orally or in writing as theCouncillor prefers.If the employee is unable or unwilling to answer the Councillor'squestion or provide the information sought, the employee must givereasons to the Councillor and advise the General Manager.

6. INAPPROPRIATE INTERACTIONS

Council's policy is that the following interactions are inappropriate:(a) Councillors approaching junior members of staff for information on

sensitive or controversial matters.(b) Members of staff approaching Councillors directly (rather than

through the General Manager) on staffing or political issues.(c) Councillors approaching staff outside Council workplaces or outside

work hours to discuss Council business.(d) Staff refusing to give information which is available to other

Councillors to a particular Councillor because of the staff member'sor Councillor's political views.

(e) Councillors who have a development application (DA) beforeCouncil discussing the matter with junior staff.

(f) Junior staff being asked to answer questions or provide documentsto Councillors who are overbearing or threatening.

(g) Councillors directing or pressuring staff in the performance of theirwork, or the recommendations they should make.

(h) Staff providing advice to Councillors without recording or

documenting the interaction as they would if the advice wasprovided to a member of the community

7. ACCESS TO DOCUMENTS

(a) A Councillor may request the General Manager or a Senior Managerto provide them with access to a document or other record of theCouncil relating to a matter which is, or is to be, or has been, underconsideration of the Council or a delegate of the Council or inpursuance of any other common law right of the Councillor to suchaccess.

(b) If a Councillor desires access to a document or record of the Councilother than those referred to in Clause 7(a) above, the request foraccess must be made and determined under and in accordance withthe Government Information (Public Access} Act, 2009, or suchother lawful procedure that applies to the Councillor's request foraccess.

(c) The General Manager must give access to the document or record tothe Councillor unless the General Manager is of the opinion thatthere are good reasons for referring the Councillor's request foraccess to the Council. The General Manager must consider whetheror not the Councillor has a pecuniary interest in the matterrequested.

(d) Access to a document or record of the Council must be provided inconformity with Council's Records Management Policy and PrivacyManagement Plan. In particular, Council documents must not beremoved from the Administration Centre.

(e) If, under Clause 7(b), the General Manager does not grant access toa document or record of the Council, the General Manager must,without delay, cause the Councillor's request to be detennined bythe Council.

8. COMPLAINTS PROCEDURES

By a Councillor Against an Employee(a) A complaint by a Councillor against an employee other than the

General Manager must be made in writing addressed to the GeneralManager.

(b) A complaint by a Councillor other than the Mayor against theGeneral Manager must be in writing addressed to the Mayor.

(c) A complaint by the Mayor against the General Manager must be setout in a confidential report to the Council meeting. The GeneralManager may be excluded by resolution of Council from the closedsection of the meeting at which the rqwrt is considered.

(d) On receipt of a complaint made under this Section, the GeneralManager, the Mayor or the Council, as the case requires, must if ofthe opinion that the complaint has substance and seriousness,investigate the complaint and may take or recommend such action asconsidered appropriate.

(e) If the complaint concerns a Senior Manager (as defined in the LocalGovernment Act, 1993) fhe Council must without delay, beinformed of the complaint by the General Manager or the Mayor (asthe case requires) and must be consulted with respect to the findings

and recommendations arising from any investigation of thecomplaint before any action is taken. However, nothing in thisprovision authorises the Council to direct what action is to be takenin relation to the complaint.

By a Councillor Against a Councillor(a) A complaint by a Councillor against a Councillor other than the

(b) A complaint by a Councillor against the Mayor must be in writingaddressed to the General Manager;

must, if of the opinion that the complaint has substance, investigatethe complaint and report the findings to the Mayor. The Mayor maytake such action as considered appropriate;

(c) If the complaint concerns the Mayor, the General Manager must, ifof the opinion that the complaint has substance and seriousness,investigate the complaint and report the findings to Council withoutrecommendation for the Council's decision.

9. NONCOMPLIANCE WITH THIS POLICYCouncillors

(a) An alleged breach of this policy by a Councillor other than theMayor may be reported to the Council by the Mayor;

(b) An alleged breach by the Mayor may be reported to the Council bythe General Manager;

(c) The Council may investigate an alleged breach of this policy in sucha manner as it thinks appropriate;

(d) If the Council finds the breach substantiated, it may, in itsdiscretion, take such action in relation to the Councillor concernedas is permitted by law. Without limiting this provision, the Councilmay require the Councillor to apologise to the elected member,employee or to the organisation as a whole in such a manner as itdirects.

Employees(a) An alleged breach of this policy by an employee may result in

disciplinary procedures and/or dismissal.

10. REVIEW

This policy shall be regularly reviewed to ensure that it meets the requirementsof legislation and the needs of Council.
