- Clyde & Co - Expert Witness for Lead Design Engineer Insurance – Morwell River Diversion (MRD) Failure at the Yallourn Open Pit Mine (Vic). $250 million litigation for direct implication of design errors. Wouter Hartman retained by Lawyers for SMEC. Review of Dr Phillip Pells and Mr Keith Seddon expert witness reports which indicates “Lead Design Engineer (SMEC) and Proof Engineer (GHD)” failed to apply appropriate geotechnical engineering design. Review and preparation of expert witness report from background data which culminate a period of 14 years: 1998-2000 (Investigation and Design Phase); 2000-2005 (Construction / QA / Final Design and Proof Engineering); 2005-2006 (Commissioning Phase) and 2006 – 2012 (Operational Management; Performance and Ground Control Management).
