Corres. No. 776/43.WHEREAS it is provided by section 18 of the BushFires Act, 1937-1942, that whenever, in the opinion ofthe Minister, it is desirable that any' plant, or therefuse thereof, should be burnt during the prohibitedmice in order to prevent or eradicate disease arising

or likely to arise from such plant, or the refuse thereof,the Governor -may, on the recommendation of theMinister, by proclamation, authorise the burning of

any plant and the refuse thereof during the prohibitedtimes or during any period of the prohibited timesand declare that such proclamation shall take effecteither generally or in the particular road districtsspecified hi the proclamation; and whereas the Min-ister is of opinion that it is desirable that the plantsspecified hereunder and the refuse thereof should heburnt, in order to prevent or eradicate disease arisingor likely to arise from such plants or the refuse thereofduring the period of the prohibited time and in theparticular road districts specified hereunder; Now,therefore I, the said Lieutenant-Governor, actingby and with the advice and consent of the ExecutiveCouncil, do hereby authorise the burning, subject tothe regulations, of the undermentioned plants and therefuse thereof during the periods and in the par-ticular road districts set out in the Schedule hereto.

[L.8.] wealth of Australia.WHEREAS it is enacted by section 4 of the VerminAct, 1918-1942, that "Vermin" means and includesally animal, bird or insect mentioned in the ThirdSchedule to the said Act and such other animals, birdsor insects the names of which the Governor may by

proclamation add to the said Schedule and that anyproclamation whereby the names of other animals,birds or insects are added to the said Schedule may berestricted in its operation to any portion of the Stateto be defined by the proclamation; and whereas it isdeemed desirable and expedient that the bird of the parrotor cockatoo species "Kokatoe Rosiecapilla" commonlyknown as " Galah" shall be Vermin for the purposesof the said Act within the boundaries of the UpperChapman Vermin district: Now therefore I, the saidLieutenant-Governor acting with the advice and con-sent of the Executive Council and in exercise of thepowers conferred by the said Act do by this proc-lamation add to the Third Schedule to the Vermin Act,1918-1942, the name of the bird of the parrot orcockatoo species "Kokatoe Rosiecapilla" commonlyknown as "Galah," and declare that this proclamationshall apply and have effect only in that portion ofthe State which is comprised within the boundaries ofthe Upper Chapman Vermin district as constitutedunder the said Act.

P.W. 1337/37.WHEREAS section 74 of the Constitution Act, 1889,provides that the Governor in Council may vest inheads of departments, or other officers or persons with-in the State, power to make minor appointments; andwhereas it is desirable that power of appointment offoremen and other persons employed at a daily rate ofwage on works under the control of the Departmentsof Public Works, and of Water Supply, Sewerage andDrainage (exclusive of the Metropolitan Water Sup-ply, Sewerage and Drainage Department) should bevested in John Lawrence O'Neill, and that the powervested in Reginald George Heath should be revoked:Now therefore, His Excellency the Lieutenant-Governorby and with the advice and consent of the ExecutiveCouncil hereby vests in John Lawrence O'Neill andany person appointed to act temporarily in his placethe appointment of foremen and all other persons em-ployed on such works at a daily rate of wages; andcloth hereby revoke the power vested in ReginaldGeorge Heath.

M.W.S. 869/25.WHEREAS the enactment contained in section 74 ofthe Constitution Act, 1889, whereby the appointmentof all public officers under the Government of theState is vested in the Governor-in-Council does notapply to minor appointments which by Order-in-Councilare vested in the heads of departments or otherofficers or persons within the State; and whereas itis desirable that the appointment of foremen and allother persons employed at a daily wage on watersupply, sewerage and drainage works under the controlof the Metropolitan Water Supply, Sewerage andDrainage Department should be vested in variousofficers: Now therefore His Excellency the Lieutenant-Governor, by and with the advice of the ExecutiveCouncil, hereby further amends Schedule appendedto the Order-in-Council gazetted on the 6th April, 1939,by the addition of the name of A. R. Driver and ofany person or persons appointed temporarily to act inthe place of such officer, and the cancellation of theappointments of C. H. Hickson and A. Young.

The Land Act, 1933-1939.

ORDER IN COUNCIL.

Corr. No. 55/44.WHEREAS by section 34 of the Land Act 1933-1939,it is made lawful for the Lieutenant-Governor, byOrder in Council, without issuing any deed of grant,to place any reserve under the control of any muni-cipality, road board, or other person or persons, as aboard of management, and to empower such board tomake, repeal, and alter by-laws for the control andmanagement of such reserves, and prescribe fees fordepasturing thereon, and for other purposes, such by-laws to be approved by the Lieutenant-Governor andpublished in the Goveramept Gazette; and whereas itis deemed expedient that reserve t 22500 for Stock andSale Yards at Gnowangerup should be placed underthe control of the Gnowangerup Road Board as aBoard of Management: Now, therefore, His Excellency,the Lieutenant-Governor by and with the advice andconsent of the Executive Council, cloth hereby placethe before-mentioned reserve under the control ofGnowangerup Road Board as a board of management,and. cloth empower such board to make, repeal, oralter bylaws for the control and management of thesaid reserve; for prescribing fees for depasturingthereon; for directing the manner in Which such feesshall be imposed, paid, collected, and disposed of, andto impose penalties not exceeding in any case £5 forany breach thereof, and £2 a day for a continuingbreach, but not more than £20 in the aggregate.

The Land Act, 1933-1939.

WHEREAS by section 33 of the Land. Act, 1933-1939,it is made lawful for the Governor to direct that anyreserve shall vest in and be held by any municipality,road board, or other person or persons to be namedin the order in trust for the like or other public pur-poses to be specified in such order; and whereas it isdeemed expedient that reserve No. 22505 should vestin and be held by State Hotels in trust fur the pur-pose of "State Hotel Purposes": Now, therefore, HisExcellency the Lieutenant-Governor, by and with theadvice and consent of the Executive Council, clothhereby direct that the before-mentioned Reserve shallvest in and be held by State Hotels in trust for thepurpose aforesaid, subject nevertheless to the powersreserved to him by section 37 of the said Act.


The Forests Act, 1918.

P.W. 786/26.THE Pingelly Road Board, pursuant to an Order inCouncil made under section 48 of the Traffic Act, 1919-1941, and in exercise of the power thereby conferred,Both hereby make the following by-laws to have effectin the Pingelly Road Board District.

1. Motor trucks and cars with trailers in Paradestreet.-No person hn charge of any motor truck or carwith trailer attached shall cause or permit any suchvehicle or vehicles, within the hours of 8 a.m. and 6 p.m.,to park north of the south side of Hall street and southof the north side of Park street. (Except mail truckson the west side of Parade street whilst receiving anddelivering mails and goods at the Post Office.)

2. Cars in Parade street.-No person in charge ofany car shall cause or permit such car to be parked inParade street, north of the south side of Hall streetand south of the north side of Park street, unless parkedit an angle.

3. No person in charge of any motor truck, motorear and motor car with trailer attached shall cause orpermit any such vehicle to be parked other than parallelto the kerb and as close as practicable thereto in allstreets other than that nortion of Parade street as speci-fied above.

4. Corners.-No person in charge of any descrip-tion of vehicle shall cause or permit any such vehicleto be parked within 30 feet of any corner.

ing in lieu thereof a paragraph as follows:

(a) Full-time schools shall be classified as follows:

Class Ia.—Class I. schools containing at least SO children above StandardVI., and at least 30 above Standard VII., calculated on the average attendancefor the year ending on the 30th September.

Class I.—Average attendance of over 500.

Class II—Average attendance of over 300.

Class HI—Average attendance of over 150.

Class IV.—Average attendance of over 75.

INDUSTRIAL AGREEMENT.No. 1 of 1946. (Registered 2/1/46.)

THIS Agreement made in pursuance of the IndustrialArbitration Act, 1912-1941, this 24th day of November,1945, between the Australian Workers Union WestralianBranch Industrial Union of Workers (hereinafter called"the Union") of the one Rail, and Harry Chalmers(Firewood Contractor to the Sons of Gwalia Limited),hereinafter called "the employer" of the other part:Whereby it is mutually agreed as follows:-

1. All and every one of the terms and conditionshereinafter set forth, so far as applicable to themrespectively, shall be observed and carried out by thecontractor himself and also by the workers; anythingherein which may lie read to the contrary nothwith-Standing.

2.—Area.This Agreement shall operate over the lands and

premises owned or used by Harry Chalmers (FirewoodContractor to the Sons of Gwalia Limited) under Per-mit Numbered 1200 issued by the Forestry Department.

3.—Term.The currency of this Agreement shall be for two years

from the date hereof : and thereafter until terminatedby thirty days' notice by either party of its intentionto do so.

4.—Wages.All workers employed on day wages shall be paid

the rates applicable to the class of work performedas set out in the Schedule of the current Award applic-abe to surface workers in gold mines in the GwaliaDistrict.

A worker working under any system of payment byresults shall be paid at least the total rate of pa i•he would have been entitled to under a contract ofdaily service.

5.—Hours.Forty-four (44) hours exclusive of meal time shall

constitute a week's work, to be worked in five days ofeight hours Monday to Friday between the hours of7 am. to 4 p.m., and four hours on Saturday betweenthe hours of 7 a.m. to 11 a.m.

6.—Overtime and Holidays.Payment and conditions relating to overtime, Sunday

and holiday work; holiday pay, and, annual holidays,shall be as prescribed by the current gold mining Awardapplicable to surface workers on mines in the Gwaliadistrict.

7.—District Allowance.All workers employed under this Agreement shall be

entitled to a District Allowance of seven (7) shillingsper week payable for each day upon which the workeris employed, or is available and willing to work. Thisallowance shall apply to pieceworkers.

8.—Tool Allowance.Where a worker (including a pieceworker) is required

to supply his own tools and files, a tool allowance atthe rate of seven shillings (7s.) per week, shall bepaid.

9.—Shifting Camps.(a) All workers (other than cutters) shall be paid

at schedule rates when shifting camp.(b) Cutters shall be paid one-half day for shifting

their own camps.(c) They shall, in addition, if called upon by the

employers, assist in shifting the employers' camp andeffects; and for so doing, shall be paid at schedule ratesfor the time so employed.

10.—Leading Loader.In addition to the rates prescribed herein the lead-

ing loader shall receive £1 per week as payment forplacing and checking trucks, and allocating the cut-ters' wood.

11.—Carters (Horse Drivers).Notwithstanding anything contained herein to the

contrary, the following rates shall apply to carters(horse drivers) : Three drays—X1 5s. 9d. per day.

12.—Burnt Wood.(a) Wood burnt after being carted to the tramway

tip, shall be paid at the current cutting rate per ton.For the purpose of estimating the amount of woodburnt, measurements shall be taken, and wood shall beestimated at 35 cwt. to the cord, by the company's sur-veyor, in the presence of the men's representative.

(b) Wood burnt on trucks shall be paid for at ton-nage rates based on the average weight of the rake:provided that any wood burnt is not the result ofincendiarism.

13.—Pay Day.The workers shall be paid at the bush camp at least

once a month. Payment shall be made not later thanten (10) clear days from the close of the pay period.

All statements shall be supplied three clear daysbefore pay day.

A statement of deductions made from each employee'searnings shall be rendered by the employer to theemployee each pay day.

14.—Plate-laying.When pieceworkers are required to assist with plate-

laying the employer shall so arrange the work that itshall be completed on one full day, and not in twohalf days on different dates.

15.—,Plodding Time.When a worker is employed on day rates, he shall

be responsible for plodding his time and securing thesignature of the employer on the time sheet.

16.—Schedule of Piecework Rates.Woodcutters— s. d.

Five (5) feet wood .. .. 9 3 per tonWood cut following a bush fire.

Within six months follow-ing the fire, which affectedthe wood .. 9 6 per ton

A penalty rate of one shilling (Is.) a ton shallbe paid for wood which is not shifted by the em-ployer within four weeks. Provided that thispenalty rate shall not apply if the employer isprevented by flood or fire from shifting the wood.Truck Loaders: Truck loaders shall be paid one

shilling and two pence (1s. 2d.) per ton.

The above rates are based upon a Basic Wage of £5 7s.5d. per week. Notwithstanding any alteration in theBasic Wage, the piecework rates herein prescribed shallremain constant. Provided, however, that with everyrise or fall in the Basic Wage above or below £5 7s. 5d.per week, the daily earnings of the pieceworker shallbe increased or decreased respectively to the extent ofone-sixth in the case of a six day week, or one-fifth,in the ease of a five day week; of such rise or fall.

17.—Piecework Conditions.(a) The minimum frontage for blocks shall be three

chains. The maximum frontage shall be six chains, nomutter how many men are in a party.

(b) If two or more parties of cutters require blocksat the same time, they shall draw lots for preference.

(c) The contractor shall conduct the drawing, mea-sure out the blocks and distribute them between thecutters, subject to the order of the drawing.

(d) If the contractor desires a block or blocks cutout more quickly to facilitate shifting of the tramlinehe shall have the right to place other cutters on thefront or hack of such block or blocks.

(e) In order to regulate the carting and preventconfusion among cutters, all cu'i i e g shall be done ina face either from the back of blocks towards thetramline or from the tramline outward as required, allsuitable timber to be cut into firewood lengths as speci-fied elsewhere.

(f) The bush, including dry dead wood, if sound,shall be thoroughly cut out to the satisfaction of thecontractor.

(a) The cutters shall cut off all branches and twigsclosely, and trim off roots, to facilitate handling andcarting of wood.

(h) In the event of wood being unsuitable to cuttersand a dispute arising as to what constitutes unsuitablewood, the contractor and the workers' representativeshall decide the question. If they cannot agree, thewood may be cut and loaded by the cutter at wagesrates.

(i) Cutters shall place their wood in heaps con-venient flir carting, and at least three horses anddrays shall be supplied when the wood is being carted.

(j) The contractor will cut and remove all scrub ontips. The cutter will cut all wood on tips suitable forfirewood. The contractor to fill any holes and leavetips suitable for loading operations. Cutters shall pegtheir own lines as directed by the contractor.

(k) When a team or teams are carting wood fromthe cutters, such team or teams, so far as practicable,shall be not be withdrawn, until all the firewood cuthas been cleaned up.

(1) Cutters may obtain advances up to 75 per cent.of the value of their wood, provided it is on accountof urgent necessity; such cases shall be decided bythe contractor and workers' representative.

(m) The firewood bought under this Agreement shallcomply with the following specifications: locally growntimber in lengths of five feet with a diameter, if un-split of not more than ten inches at either end, but ifthe firewood exceeds ten inches at both ends but doesnot exceed twelve inches at both ends, the same shall besplit in half, and should the firewood exceed twelveinches at both ends, it shall be split in four pieces.All firewood supplied shall be free from roots or dryrot.

(n) Cutters who are desirous of leaving their blocksshall give the contractor notice and their wood shallbe trucked and paid for within six days after carting,should circumstances permit. This shall also apply tocutters from whom the contractor does not desire topurchase any more wood. Should the cutters be com-pelled to wait longer than six days they shall be foundwork and paid for same at the rates applicable to thework.

(o) The contractor shall cart all wood to the rail-way and load it on trucks. Delivery of wood fromthe cutters shall be completed to the contractor whenthe wood has been loaded on drays.

(p) The trucks of wood shall be taken on the weigh-bridge and weighed in the presence of the workers'representative who shall be present on arrival of thetrain and the weight then ascertained shall be takenas final. The workers have the right to be presentwhen the wood 15 weighed and shall at all convenient

times be permitted to examine the weighbridge usedfor weighing the wood. The weighbridge shall ,betested in the presence of the workers' representativeat least once a month, and the variations (if any)posted in a conspicuous place at the main camp. Thenotice shall be signed by a representative of the Sonsof Gwalia Ltd., and of the employees.

(q) Camps shall be placed so that cutters shall nothave to walk more than one mile to the front of blockswhere they are working, and a tank shall be placedso that water shall be available within one and one-halfmiles from where cutters are working.

(r) The cutters will at the request of the contractorassist in shifting the tramline; and when so engagedshall be paid at the rates set out in the Agreement.

(s) It is agreed that wood which has dropped offthe trucks along the line shall be collected and passedover the weighbridge and paid for by the employer atthe rates prevailing in the Agreement. Wood will becollected every six months, and the value of same dis-tributed among the cutters working at the time of itscollection.

(t) Single tip shall mean wood tipped from a draywhen the wheel of the dray is not more than four feetfrom the rail when parallel with the line, and shallinclude the spread of time wood after being tipped.

(u) The loaders shall securely load the wood on therailway trucks so as to ensure safe carriage duringtransit.

(v) The contractor shall replace all broken standardsof trucks when trucks are used for other purposes thancarting wood.

(w) So far as practicable the contractor will supplysufficient trucks to keep loaders fully employed, andwill deliver the empty rake of trucks as early as pos-sible each morning when trains run.

(x.) If a cutter leaves the employment of the con-tractor without finishing a block that he has beenengaged on, the first man who cuts out, shall finish theblock that has been left unfinished, before Ile is allottedanother block.

(y) Each spurline shall be laid out by the company'ssurveyor. cha.inman shall be a representative ofthe cutters, and shall be paid by the company for thetime so employed as chainman.

18.—First Aid.The employer shall provide first-aid equipment, and

keep same fully and efficiently supplied at the head ofthe line. If no person possessed of recognised first-aidqualifications is employed at the head of the line, theemployer shall, when engaging workers, give preferenceto at least one worker so qualified. A utility truckshall be permanently stationed at the head of the lineto convey injured or sick workers to hospital, or forany other urgent matters.

19.—Water Supplies.

The workers shall be supplied with sufficient goodwater for domestic purposes, by the employer free ofcharge, which shall be placed in tanks as convenientas possible to the workers.

Tanks of water shall be placed at half 1%) mileintervals along the block frontage, and ill no case shallthe distance between tanks exceed half ( 1/2 ) mile.

20.—Stores fund Supplies.

(a) During the months of November, December,January and February of each year, meat and breadshall be delivered to the head of the line at least threetimes per week—on Mondays, Thursdays and Saturdays.

(b) During other months of the year, meat, bread,and other stores, shall be delivered to the head of theline at least two days per week—on Mondays andThursdays.

(c) When trains run three days a week, the speci-fied days for delivery of all stores shall be Mondays,Wednesdays and Fridays.

(d) Should the employer fail to make deliverieswithin twenty-four hours of the stipulated time, a pen-alty of one day 's wages shall be paid to each employeeat the head of the line. For the purpose of this clausethe time of delivery shall be four o'clock (4 p.m.).

(e) This clause shall not operate if rain or floodsmake the tramway and/or roads impassable,


21.—Shower Baths.The employer shall supply a sufficient number of

cubicles with showers for the use of the workers.

22.—Sanitary Arrangements.The employer shall supply sufficient sanitary con-

veniences of an approved type for the employees atthe head of the line.

23.—Sub-contracting.(a) All the terms and conditions hereinafter set

forth, as far as applicable to them respectively, shallbe observed and carried out by the employer himselfand by his sub-contractors, and also by the workers,anything which herein may be read to the contrarynotwithstanding.

(b) For the more effectively securing the due observ-ance and performance of the last preceding clause,and the carrying out of the terms and conditions here-inafter mentioned, the employer, so far as concerns hi9own acts, and so far as permitted by law, agrees thatno sub-contractors under him shall be allowed to operateon or use the lines, lands, and/or places, under thecontrol of the employer for the purpose of supplyingfirewood, without such person or company first havingagreed in writing to the terms and conditions of thisAgreement.

(c) Before any sub-contractor shall be allowed tocommence operations on, or use any of the said lines,lands and/or places controlled by the employer, heshall notify in writing the Secretary of the Unionwhose members are affected that such sub-contractorhas agreed in writing to the terms and conditions ofthis Agreement.

24.—Existing Customs.All existing customs and conditions prevailing at

the time of this Agreement, and not altered by thisAgreement shall not be varied, unless by mutual con-sent of the parties thereto, and the workers and theemployer shall not be deprived of any privileges orrights hitherto enjoyed, nor shall any new conditionsdetrimental to the interests of either of the parties beimposed unless specifically mentioned herein.

25.—Union Representative's Right of Access.Right of access to the premises and undertakings of

the employer shall be granted to a duly accreditedrepresentative of the Union to investigate any com-plaint.

26.—Under-rate Workers.Any worker who by reason of old age or infirmity

is unable to earn the minimum wage may be paid suchlesser wage as may from time to time be agreed uponin writing between the union and the employer.

(b) In the event of no agreement being arrived at,the matter may be referred to the Board of Referencefor determination.

(c) Pending the Board's decision, the worker shallbe entitled to work for or be employed at the proposedlesser rate.

(d) The wages of under-rate workers shall rise orfall on a pro rata basis, in conformity with the riseor fall in the basic wage.

27.—Board of Reference.(a) For the purpose of this Agreement a Board of

Reference may be appointed.Each Board shall consist of a Chairman who shall

be a person appointed by the Court or a person selectedby the representatives of the parties if such may beagreed upon; or, failing such agreement, the Resi-dent Magistrate if agreeable and willing to act, andif not, the Inspector of Forests, or an Inspector ofMines, and two other representatives, one to be chosenby the employer and the other a representative of theUnion, appointed for such purpose by the Union.

A representative may be changed at any time bythe party appointing him upon notification to the otherparty, and the Registrar.

(b) There shall be assigned to such Board the func-tions of : —

(i) Deciding matters specifically referred to inthe Agreement as being the subject matter of adecision of the Board;

(ii) adjusting any matters of difference whichmay arise between the parties from time to timeexcept such as involve interpretations of the pro-visions of this Agreement, or any of them;

(iii) deciding all matters and questions referredto in the Agreement as being the subject of mutualagreement if not agreed to;

(iv) deciding any other matter that the parties mayrefer to such Board from time to time.(c) An appeal shall lie from any decision of such

Board, in the manlier and subject to the conditionsprescribed in the Regulations to the Industrial Arbitra-tion Act, 1912-1935, which for this purpose are em-bodied in and form part of this Agreement (Regula-tion 92).

(0) There shall be no cessation of work pending thereference to, and the settlement of any dispute by theBoard.

INDUSTRIAL AGREEMENT.

THIS Agreement made in pursuance of the IndustrialArbitration Act, 1912-1941, this 10th day of December,1945, one thousand nine hundred and forty-five, betweenL. E. Dreyer, Roediger Brothers, V. M. -Stone andW. S. Bevan, Master Butchers of Northam (hereinaftercalled "the employers") of the one part, and theWest Australian Branch, Australasian Meat IndustryEmployees' Union Industrial Union of Workers, Perth(hereinafter called "The Union") of the other part,witnesseth as follows:—

1.—Area.This Agreement shall operate over an area comprised

within a radius of five miles (5) from the Post Office,Northam.

2.—Term.This Agreement shall operate for a period of one (1)

year from the date hereof.

3.—Copy of Agreement.

A copy of this Agreement, under glass, shall bekept by each employer in each shop, store, or factoryin some position accessible to all workers.

4.—Mixed Functions.

Any worker called upon to do or performing any workwhich carries a higher rate of wages than his usual rate,shall be paid such higher rate for that day.

5.—Weekly Hands.The employment shall be weekly and a week's notice

shall be given on either side to terminate the engage-ment, or a week 's wages paid in lieu of same; suchnotice may be given before 12 o'clock noon on any day.Provided that nothing in this clause shall prevent anemployer summarily dismissing a worker for miscon-duct or dereliction of duty.

6.—Casual Workers.All or any casual workers starting at any time during

the day shall be paid full rate for the day, and casualrates shall be paid unless the worker shall have beennotified by the employer before 5 p.m. on the day ofengagement that he is to be employed as a permanenthand; but in the event, of any casual hand who hasbeen engaged to start at the ordinary starting time notreporting himself for duty at the starting time, he shallbe paid proportionately for the hours worked,

7.—Time and Wages Record.The employer shall provide a time record, to be kept

where the worker or workers usually commence work,in which each worker shall enter his starting and finish-ing times each day.

The employer shall keep a record showing:—(a) Thename of each worker; (b) the occupation of eachworker; (c) the time worked by each worker; (d) thewages and overtime paid therefor; (e) in the caseof a junior worker, the age on his last birthday.

Such records shall be open for inspection by the sec-retary of the Union, or such other person authorised inwriting by the president of the Union, during workinghours in any day.

8.—First Aid.

Each employer shall keep at his shop, or factory orat each if more than one, a first-aid equipment, fullystocked, for the use of the workers.

9.—Breakdown, etc.

The employer shall be entitled to deduct payment forany day or portion of a day upon which the workercannot be usefully employed because of any strike bythe Union or Unions affiliated with it, or by any otherassociation or Union, or through the breakdown of theemployer 's machinery-, or any stoppage of work by anycause which the employer cannot reasonably prevent.

10.—Under-rate Workers.(a) Any worker who by reason of old age or in-

firmity is unable to earn the minimum wage, may bepaid such lesser wage as may from time to time beagreed upon in writing between the Union and the em-ployer.

(b) In the event of no agreement being arrived at,the matter may be referred to the Board of Referencefor determination.

(c) After application has been made to the Boardand pending the Board's decision, the worker shall beentitled to work for and be employed at the proposedlesser rate.

11.—Hours.(a) Forty-four hours shall constitute a week 's work.

No working clay shall consist of more than eight (8)hours and the working hours each day shall be con-secutive, with the exception that one (1) hour shall beallowed off for dinner on Mondays, Tuesdays, Thurs-days, Fridays, and Saturdays.

(b) The starting time for all employees shall be 8a.m. Mondays to Saturdays and finishing time shallbe 5 p.m. on Mondays, Tuesdays, Thursdays, Fridaysand Saturdays, and 12 o 'clock noon on Wednesdays.

(c) Subject to clause 12, no worker shall be on orallowed on the employers' premises before 8 a.m. onally day nor after 5.5 p.m. on Mondays, Tuesdays,Thursdays, or Fridays, nor after 12.5 p.m. on Wednes-days, nor after 545 p.m. on Saturdays.

12.—Overtime.1. Work shall not be allowed outside the limits of

clause 11 except in case of urgent necessity, for thepurpose of :—

(a) Supplying military hospitals, military camps,military depots, and shipping ;

(b) supplying State institutions whose contractsare open to public tender ;

(c) a breakdown of the refrigerating plant, whichnecessitates the worker handling the meat containedin the chamber attached thereto;

( d) placing the meat in the refrigerator for aperiod not exceeding fifteen (15) minutes.2. The rates of overtime for work done under this

clause shall be :—For the first two (2) hours, time anda half ; thereafter double time. When a worker has leftthe employers' premises and is recalled to work underthis clause he shall be paid at least two (2) hours atordinary pro rata rates.

3. In ally establishment where it is necessary to at-tend to the refrigerator at times not within the ordi-nary hours, it shall be permissible for the workers todo so on terms arranged with the employer and ap-proved by the secretary of the Union.

13.—Holidays.

New Year 's Day, Good Friday, Labour Day, Christ-mas Day, Boxing Day, and Northam Show Day, shallbe observed as closed holidays. When any of thesespecified holidays falls upon a Sunday, some other dayshall be substituted in lieu thereof.

Subject to clause 12 no work shall be done on thesedays and no deduction made from wages in respectthereof.

When Christmas Day falls upon Saturday, Sunday orMonday, and Boxing Day is observed on Monday orTuesday, work may be done on Boxing Day from 7a.m. to 9 a.m.

An annual holiday of twelve (12) clear working dayson full pay shall be granted to each worker who hascompleted one year of service, such holiday to be takenat the convenience of the employer, within three (3)months of the expiry of each twelve (12) months ser-vice.

14.—Pro rata Holiday Pay.

A worker who , has not completed twelve (12) monthsof service shall be paid holiday pay, in lieu of the an-nual holiday, at the rate of one (1) day 's wages foreach month of service.

Holiday pay shall be paid to the worker when his ser-vice is terminated regardless of the reasons for suchservice being terminated.

The foregoing provision shall not apply to casualworkers.

16.—No Reduction.

No worker who at the time of making this Agree-ment is in receipt of a higher wage than that prescribedby this Agreement for his class of work shall suffer anyreduction in wages by reason of this Agreement.

17.—Definitions.

"Shop" shall comprise retail butchers' shops and anypremises or place set aside for the manufacture and/ordelivery of smallgoods, and includes shops selling orhandling fresh, chilled, or frozen meat, in less quan-tities than a quarter of beef, or a carcase of mutton,lamb, veal, or pork, a cutting cart, or vehicle used forthe purpose of delivery.

"First shopman." In every shop where one or moreshopmen are employed, one shall be classed as first shop-man. Provided, however, that where a manager is em-ployed who works in the shop, he shall be , considered asfirst shopman.

19.—Adjustment of Certain Rates.The amounts mentioned hereinbefore for the perform-

ance of specific tasks by workers bound by the Agree-ment shall be subject to variation in accordance with thebasic wage from time to time declared by the Courtbased upon the ratio or proportion that the new basicwage bears to the old.

20.—Board of Reference.The Court may appoint, for the purpose of the Agree-

ment, a Board or Boards of Reference. Each board shallconsist of a chairman and two other representatives, oneto be nominated by each of the parties, as prescribed bythe regulations. There are assigned to each such board,in the event of no agreement being arrived at betweenthe parties to the Agreement, the function Of :—

(i) adjusting any matters of difference which mayarise between the parties from time to time, exceptsuch as involve interpretations of the provisions ofthe Agreement or any of them;

(ii) classifying and fixing wages, rates, and con-ditions for any occupation or calling not specificallymentioned in the Agreement;

(iii) deciding any other matter that the Court mayrefer to such board from time to time.An appeal shall lie from any decision of such board,

in the manner and subject to the conditions prescribed

in the Regulations to the Industrial Arbitration Act,1912-1941, which for this purpose are embodied in thisAgreement.

THE Court of Arbitration of Western Australia dothhereby make the following Award in connection with theIndustrial Dispute between the abovenamed parties:—

AWARD.1.—Scope.

This Award shall apply to all workers covered byAward, No. 5 of 1938. Except as hereinafter cancelledor amended, the provisions, regulations and requirementsof Award, No. 5 of 1938, as amended by Order, No. 59of 1944, are hereby embodied in and form part of thisAward.

"Smallgoods-man" shall mean one who actuallyperforms the work of preparing, manufacturing, ormaking up from meat smallgoods, except sausages knownas butcher's sausages, but shall not mean or include theemployer or the manager of any shop, or the memberof any firm, and in shops where only one smallgoods-man is employed, he shall be classed as first smallgoods-man.

"Cutting cart hand" shall mean one who takes nut-meat in bulk and cuts and; sells it from. the cart ormotor.

"Salter" shall mean one who is employed the greaterpart of his time in salting and curing meat.

"General butcher" shall mean one employed cuttingup meat, serving in shop, or doing rounds and cuttingmeat or general work of a butcher, or who is assistingin a smallgoods factory.

IN THE COURT OF ARBITRATION OF WESTERN18.—Apprentices. AUSTRALIA.

(1) The provisions of the Schedule annexed hereto,entitled "Apprenticeship Regulations," shall extend andapply to apprentices coming within the scope of thisAgreement.

(2) The maximum number of apprentices allowed toany employer shall be in the proportion of one appren-tice to every three or fraction of three journeymen em-ployed.

(3) Where an employer or manager usually andcustomarily works at the trade, he may be counted as ajourneyman for the purpose of this clause.

(4) The period of apprenticeship shall be five years:Provided, however, that in the case of youths who havealready had experience in the industry, this period mayhe reduced, with the consent of the Court, or by agree-ment with the Union, as to the allowance to be made outof the said period of five years for the experience pre-viously gained in the industry.

(5) Apprentices may be taken to:—(a) Generalbutchering; (b) smallgoods-making.

Where in any shop the operations of general butcher-'mg and smallgoods-making are carried on by the em-ployer, he shall undertake to teach both to the ap-prentice.

(6) Notwithstanding anything contained in thisAgreement to the contrary, if through lack of ordersor through financial difficulties, the employer is unableat any time to find employment and training for an ap-prentice, and if a transfer to another employer cannotbe arranged the obligations and duties imposed by theindenture may, with the concurrence of the apprenticeand his guardian, be suspended for a period agreedupon or, if no such agreement be arrived at, may, withthe consent of the Board of Reference, be cancelled bythe employer.

This provision shall be deemed to be included in allcontracts of apprenticeship now existing and also in allfuture contracts entered into.


2.—Area.This Award shall operate over an area comprised with-

in a radius of fourteen (14) miles of the General PostOffice, Perth, excepting, however, such portions as arecomprised within the premises occupied or worked inconjunction with the Railway Department or the Mid-land Railway Company.

3.—Sick Leave.(a) A - worker shall be entitled to payment for non-

attendance on the ground of personal ill-health, for one-half ( 1,6) day for each completed month of service:Provided that payment for such absence through suchill-health shall be limited to six (6) days in eachcalendar year. Payment hereunder may be adjusted atthe end of each calendar year, or at the time theworker leaves the service of the employer, in the eventof the worker being entitled by service subsequent tothe sickness to a greater allowance than that made atthe time the sickness occurred. This clause shall notapply where the worker is entitled to compensation underthe Workers' Compensation Act.

A worker shall not be entitled to receive any wagesfrom his employer for any time lost through the resultof an accident not arising out of or in the course ofhis employment, or for any accident, wherever sustained,arising out of his own wilful default, or for sicknessarising out of his own wilful default.

No worker shall be entitled to the benefits of thisclause unless lie produces proof to the satisfaction ofthe employer or his representative, of sickness, but theemployer shall not be entitled to a medical certificateunless the absence is for three (3) days or more.

(b) Any time in respect of which a worker is absentfrom work, except time for which lie is entitled to claimsick pay under the preceding provision, shall not countfor the purpose of determining his right to holidays.

4.—Absence From Duty.(a) Any worker not attending for duty shall lose his

pay for the actual time of such non-attendance, subjectto the provisions of clause 3 hereof as to payment forabsence on account of illness.

(b) The employer shall he entitled to deduct paymentfor any day upon which the worker cannot be usefullyemployed through any breakdown of the employer'smachinery or through any other cause beyond the em-ployer's control.

5.—Term.This Award shall operate for a period of twelve (12)

months from the date hereof.In witness whereof this Award has been signed by the

President of the Court and the Seal of the Court hasbeen hereto affixed this 19th day of October, 1945.

1—Area.This Award shall be limited to the area comprised

within a radius of 25 miles of the General Post Office,Perth.

2—Term.The term of this Award shall be for a period of

three (3) years provided that any time after the ex-piration of twelve months, on the application of anyperson or party affected by its provisions the Court mayalter, amend, or revise it in such a manner as the Courtmay deem fit.

3—Definitions.Three (3) classes of labour only shall be employed in

the industry, viz :—Seniors, Improvers, and Apprentices.(a) "Senior" shall mean—(i) a worker who is over

the age of twenty-one (21) years. (ii) A worker whohas completed an apprenticeship of four (4) years andis receiving not less than the minimum adult rate ofwages as provided in Clause 8, subclause (c).

(b) "Apprentice" shall mean a male or femaleworker in the industry who is serving articles of ap-prenticeship or who is employed in the industry witha view to becoming an apprentice.

(e.) "Improver" means a worker under the age oftwenty-one years who has completed an apprenticeshipof four (4) years but who is not in possession of aSpecial Certificate as provided in clause 8, subclause (c).

(d) "Hairdresser" shall mean any person employedin ladies' hairdressing establishments performing thefollowing work:—Head shaving, haircutting, hair re-moving, hair dressing, hair trimming, hair curling orwaving, hair singeing, shampooing, wigmaking, hairworking, hair dyeing, manicuring, face, neck or headmassaging, or other similar stimulative process or treat-ment of the hair, head, face or neck carried on, used,or employed in ladies' hairdressing salons, beauty par-lours

' or similar establishments, whether with or with-

out the aid of any apparatus, appliance, preparation orsubstance.

(e) "Worker" shall mean "Worker" as defined inthe Industrial Arbitration Act, 19124941.

4—Hours.The hours of work shall not exceed forty-four (44)

per week and shall be worked between 9 a.m. and 6 p.m.on the first five (5) days of the week and 9 a.m. and1 p.m. on Saturday.

A worker may, in order to complete the one (1)operation in relation to any one (1) customer on whichhe or she is engaged at the hour fixed for ceasing work,continue to work for a period not exceeding one (1)half-hour after the hour so fixed for ceasing work forthat day.

Provided a worker continuing to work as aforesaidshall start work one (1) half-hour or such shorter periodlater than the usual starting time on the followingworking day.

5—Overtime.Overtime shall not be worked except as provided in

clause 4.

6—Meal Hours.Every worker shall be entitled to one (1) hour for a

meal between the hours of 11.30 a.m. and 2.30 p.m.No worker shall work or be required to work so as to

lose or be deprived of any meal time or part thereof, orwork for longer than four and one-half (41/2) hourswithout such a meal time.

7—Holidays.(a) The following days, or the days observed in lieu

thereof, shall be observed as paid holidays, namely:—New Year's Day, Australia Day, Good Friday, EasterSaturday, Easter Monday, Anzac Day, Labour Day,Foundation Day, Christmas Day and Boxing Day andon these days no work shall be performed.


(b) A holiday of two (2) weeks on full pay shall begranted to each worker on the completion of each yearof service.

(c) The time of granting such holiday shall be atthe discretion of the employer; provided that, when aworker is entitled to holidays under this subclause, heor she shall receive at least two (2) weeks' notice fromhis or her employer of the date when it shall be con-venient to the employer that the worker shall take hisor her holidays.

(d) A worker not having completed one (1) year'sservice shall be granted pay in lieu of holidays in pro-portion to the length of time of his or her services:provided that such services shall have exceeded onemonth.

(e) A worker dismissed for misconduct shall lose allrights under this clause.

Provided that a worker who has completed a four (4)year apprenticeship and is in possession of a Final Cer-tificate as provided in the Apprenticeship Regulationsmay, after holding such certificate for not less than three(3) months, apply to the examiners for a SpecialExamination.

A worker failing to secure a Special Certificate inrespect of such Special Examination may re-apply forfurther Special Examinations at not less than three-monthly intervals.

The costs incidental to any Special Examinationsunder this subclause shall be borne by the worker.

Upon the issue of a Special Certificate under thissubclause the worker shall be paid the minimum rateof wages applicable to a senior and for all purposes ofthis Award shall be regarded as a senior.

(d) No person carrying on the business of ladies'hairdresser shall let any chair or cubicle in his or hershop to any other person for the purpose of the businessof a hairdresser.

(c) No employer shall employ any worker on a com-mission basis, or in any manner other than prescribedin this Award.

9—Apprenticeship.

The provisions of the Schedule thereto marked"Apprenticeship Regulations" are embodied in andform part of this Award.

(a) Persons attending the Hairdressing Departmentconducted by the Perth Technical College shall at theconclusion of their course or such shorter term be ap-prenticed to an employer to complete a period of fouryears.

(b) Upon production of evidence of the time servedat the Perth Technical College (Hairdressing Depart-ment) such time shall be deemed as time actually servedas part of their four year apprenticeship.

(c) The Board of Examiners referred to in theApprenticeship Regulations shall be persons skilled inthe practice of hairdressing as defined in clause 3 sub-clause (d).

(d) Apprentices shell be instructed in their trade attheir employers place of business and/or the Hairdress-ing Department of the Perth Technical College and inno other place.

(e) Apprentices shall at the direction of the . Ap-prenticeship Board appointed under the ApprenticeshipRegulations attend evening classes at the Perth Techni-cal College provided such direction shall only be givenwhen facilities for day classes are not available. Suchevening classes shall not exceed two (2) hours duration.

10—Tools of TradeSeniors shall provide their own tools of trade which

shall be kept in a workmanlike condition. Employersshall provide other workers with all tools of trade.Subject to fair wear and tear worn tools shall be re-placed. Lost or wilfully damaged tools shall be madegood by the worker.

11—Premiums.No person shall directly or indirectly request or permit

any other person to pay or give, or shall receive fromany other person, any premiums, bonus, considerationor payment for employing or teaching, or purportingto employ or teach such person, or any other person,any of the callings to which this irwtard applies.

12—Proportion.(a) nli, maximum number of apprentices and/or

improvers allowed to any employer in the industry shallbe in the proportion of two (2) to every one (1) seniorhairdresser employed by him or her.

(b) After the expiration of a period of six (6)months from the official date of the cessation of hos-tilities in the present war with Japan the proportionshall be one apprentice and/or improver to one seniorhairdresser.

(c) Where the employer or any partner, or manageror a manageress regularly works at the trade such per-sons shall be counted as senior hairdressers for the pur-pose of computing the number of apprentices and/orimprovers to be allowed.

13—Engagement.(a) Employment shall be on a weekly basis and

terminated by one (1) week's notice given by . eitherparty, provided that any worker may be summarily dis-missed by his or her employer for misconduct or refusalto obey orders.

(b) For a period of twelve (12) months from datehereof a worker may be engaged to work for less thanforty-four (44) hours in any week provided the writtenconsent of the parties hereto be first obtained.

(c) Where such consent is granted the wages pay-able shall be proportionately adjusted.

(d) A worker engaged under subclause (b) shall notbe counted in computing the proportion of apprenticesand/or improvers to seniors.

14—Time and Wages Book.The employer shall keep and enter up or cause to :be

kept and entered up a book •containing:—(a) the nameof each worker; (b) the class of work performed; (c)the hours worked each day; (d) the wages paid to eachworker; (e) the ages of apprentices and/or improvers.

Such book shall be open for inspection by a dulyauthorised representative of the Union not more thanonce in each week during the working hours of 10 a.m.and 4 p.m.

15—Uniforms.In the event of a worker being required to wear a

special uniform or costume, such special uniform orcostume shall be provided by and laundered at the em-ployer's expense. provided an overall shall not be re-garded as special uniform or costume. Employers she,/provide apprentices and/or improvers with overalls butthe laundering of such overalls shall be the responsibilityof the worker,

16—Sick Pay.(a) A worker shall be entitled to payment for non-

attendance on the ground of personal ill-health for onehalf-day for each completed month of service. Providedthat payment for absence through such ill-health shallbe limited to six (6) days in each calendar year. Pay-ment hereunder may be adjusted at the end of eachcalendar year, or at the time the worker leaves the ser-


vice of the employer, in the event of the worker beingentitled by service subsequent to the sickness to agreater allowance than that made at the time the sick-ness occurred. This clause shall not apply where theworker is entitled to compensation under the Workers'Compensation Act.

(b) Holiday pay shall not accrue during a worker'sabsence from duty, except on account of ill-health, inaccordance with subelause (a) hereof.

17—Preference to Unionists.(a) In this clause the term "unionist" means a

worker who is a member of the union of workers and theterm "non-unionist" means a worker who is not amember of the union.

(b) Unionists shall be given preference of employ-ment and an employer who employs a non-unionist com-mits a breach of this award if during such employmentthere are unionists competent to do the work and avail-able and ready to perform it.

(c) Unionists shall offer themselves for employmentby members of the employers' union in preference tonon-members and a unionist who seeks employment by anon-member commits a breach of this clause in seekingsuch employment while the labour requirements of themembers of the employers' union remain unfilled.

(d) It shall not be a breach of this clause for anemployer to continue to employ a non-unionist who wasin his or her employ at the date of this award but theemployment of the non-unionist shall cease not laterthan twenty-one (21) days from such date unless in themeantime the worker becomes a unionist.

(e) If during the continuance of ads award theunion, or the majority of the members of the union,shall be concerned in or take part in anything in thenature of a strike or the union by any device whatso-ever hampers or restricts the admission of any bonafide worker as a member, the benefit of this clause shallipso facto cease and determine.

(f) If any employment subsist or continue to subsistin breach of this clause both the employer and theworker concerned shall be liable to a penalty for thebreach.

18—Staff Room.

The employer shall provide a suitable room or ac-commodation for workers in which to change and keeptheir clothes while on duty.

19—Posting of Agreement.

A copy of this award shall be kept in a convenientlyconspicuous place in the staff room of the employer'spremises.

Schedule.APPRENTICESHIP REGULATIONS.

Definitions.I. (1) "Act" means "The Industrial Arbitration

Act, 1912-1935," and any alteration or amendmentthereof for the time being in force.

(2) "Apprentice" means any person of either sexof any age who is apprenticed to learn or to be taughtany industry, trade, craft, or calling to which theseregulations apply, and includes an apprentice on pro-bation.

(3) "Award" includes Industrial Agreement.(4) "Court" means the Court of Arbitration.(5) "Employer" includes any firm, company, or cor-

poration.(6) "Minor" means a person not less than fourteen

years of age and not more than eighteen years of agewho customarily works under the direction of or in

association with an employer, master, or journeymanupon the material and with the tools or implementsused in the industry.

Employment—Probation.2. No minor shall (except where provision is other-

wise made in this Award) be employed or engaged inthe industry, except subject to the conditions of appren-ticeship or probationership herein contained.

3. (1) Every apprentice shall be employed on pro-bation for a period of three months to determine hisfitness or otherwise for apprenticeship, and shall workonly for such hours per day and for such remunerationas may be prescribed by the Award. In the event ofhis becoming an apprentice such probationary periodshall be counted as part of the term of apprenticeship.

(2) The Court may in any case where it seemsexpedient to do so, order that the probationary periodof employment be extended for a further period notexceeding three months.

4. (a) Any employer taking an apprentice on pro-bation shall within 14 days thereafter register suchprobationer by giving notice thereof to the Registrarin the prescribed form. If at the date of the coininginto operation of these regulations an employer isemploying any apprentice or probationer who has notbeen duly registered as such, he shall forthwith applyfor the due registration of such apprentice or pro-bationer.

(b) At the end of the period of probation of eachapprentice, if mutually agreed upon by the employerand the legal guardian of the boy, but not otherwise,he may become an apprentice under an agreement.

5. The employer of every apprentice shall keep himconstantly at work and teach such apprentice or causehim to be taught the industry, craft, occupation, orcalling in relation to which he is bound apprentice, bycompetent instruction in a gradual and complete man-ner, and shall give such apprentice a reasonable oppor-tunity to learn the same, and receive, during the periodof his apprenticeship, such technical, trade, and generalinstruction and training as may be necessary. Andevery apprentice shall, during the period of his appren-ticeship, faithfully serve his employer for the purposeof being taught the industry, craft, occupation, orcalling in relation to which he is bound, and shall alsoconscientiously and regularly accept such technical,trade, and general instruction and training as afore-said, in addition to the teaching that may be providedby his employer.

6. The employer and the apprentice respectively shallhe deemed to undertake the duty which he agrees toperform as a duty enforceable under an Award of theCon rt.

Apprenticeship Board.7. (i .) The Court may on its own motion or on the

application of any of the parties, or on the recommenda-tion of an Industrial Board, appoint a Board for the pur-pose of dealing with all matters affecting apprenticesassigned to the determination of the Board by the Court,and in particular to perform and discharge all powersand duties in these regulations and therein to be per-formed and discharged by the Court, except such powersand duties as are specially assigned to the Court bythe Act.

(ii) The Board shall consist of the following:(a) A chairman, to be appointed by the Court, and(b) Representatives of the employers and workers

respectively, one or two on each side, as maybe decided by the Court.

(iii) The Board shall be invested with the followingpowers and functions in addition and without prejudiceto those mentioned in (i)

(a) to endeavour to promote apprenticeships under.this Award;

(b) to draw up syllabi of training and to arrangefor the periodical examination of apprentices;

(e) to permit in any special circumstances the tak-ing or employment of an apprentice by anemployer, notwithstanding that the quotafixed by the Award in any particular casemay be exceeded;

(6) to enter any factory, workshop, or place wherean apprentice is employed or appoint anyother person for that purpose and inspect theconditions under which any apprentice iseniployed;


(e) to require any employer to furnish the Boardwith any specified information relating toany trade or industry subject to this Award,or any of the workers engaged therein, witha view to determining whether there is a suf-ficient number of apprentices being trainedto meet future requirements and in the inter-ests of the community;

(f) to advise the Court as to all matters appertain-ing to apprentices.

(iv) A majority of the members of the Board, one ofwhom must be the chairman, shall constitute a quorum.

(v) The decision of the Board shall be the decisionof the majority of the members and shall be signed bythe chairman and forwarded to the Registrar.

(vi) Either party, with the consent of the Court, mayat any time alter its representative.

S. (a) No employer shall refuse employment to anyperson, or dismiss any worker from his employment, orinjure him in his employment or alter his position tohis prejudice, by reason merely of the fact that theworker is a member of the Board, or by reason merelyof anything said or done or omitted to be done by anysuch person or worker in the course of his duty as suchmember.

(b) In any proceeding for any contravention of thissubclause it shall lie upon the employer to show thatany person proved to have been refused employment, orany worker proved to have been dismissed or injured inhis employment or prejudiced whilst acting as suchmember was refused employment or dismissed or injuredin his employment or prejudiced for some reason otherthan that mentioned in this subclause.

Agreement of Apprenticeship.9. (a) All agreements of apprenticeship shall be

drawn up on a form approved by the Court, and signedby the employer, the legal guardian of the apprentice,the apprentice, and the Registrar. No employer, guar-dian, or apprentice shall enter into any agreement orundertaking purporting to add to, vary, alter or amendany such agreement without the approval of the Court.

(b) There shall be three copies of each agreement,of which one copy shall be held by the employer, oneshall be held by the legal guardian of the apprentice,and one copy shall be retained by the Registrar.

(c) The apprenticeship agreement shall be completedwithin one mouth of the termination of the probationaryperiod.

(d) Every agreement of apprenticeship shall besubject to the provisions of the Award in force for thetime being applicable to apprenticeship in the industry.

10. Every agreement entered into by the employerand the legal guardian of the apprentice shall be for aperiod of five years, or such other period as may beprescribed by the Award, but this period may be re-duced in special circumstances with the approval of theCourt.

11. Every agreement of apprenticeship entered intoshall contain

(a) The names and addresses of the parties to theagreement.

(b) The date of birth of the apprentice.(c) A description of the industry, craft, occupa-

tion or calling or combination thereof towhich the apprentice is to be bound.

(d) The date at which the apprenticeship is tocommence and the period of apprenticeship.

(e) A condition requiring the apprentice to obeyall reasonable directions of the employer andrequiring the employer and apprentice tocomply with the terms of the industrialAward so far as they concern the apprentice.

(f) A condition that technical instruction of theapprentice, when available, shall be at theemployer's expense, and shall be ill theemployer's time, except in places where suchinstruction is given after the ordinary work-ing hours.

(g) A condition that in the event of any appren-tice, in the opinion of the examiners, notprogressing satisfactorily, increased time fortechnical instruction shall be allowed at theemployer's expense to enable such appren-tice to reach the necessary standard.

(hj The general conditions of apprenticeship.

Transfer of Apprentices.12. (a) The Court shall have power to transfer an

apprentice from (a) one employer to another and/or(b) from one trade to another, either temporarily or per-m a nently-

(i) if the employer does not provide the necessaryfacilities for the apprentice to become pro-ficient in his trade; or

(ii) upon the application of the employer or theapprentice for good cause shown.

(b) The transfer of every agreement shall be made outin quadruplicate and shall, unless the Court otherwisedirects, be signed by the late employer or his assigns,the legal guardian of the apprentice, the apprentice, theRegistrar, and the new employer. The transfer formshall be completed within two months of the date onwhich the transfer is effected.

(c) One copy of the transfer agreement shall be heldby the late employer, one shall be held by the newemployer, one shall be held by the legal guardian of theapprentice, and one shall be retained by the Registrar.

13. Should an employer at any time before the deter-mination of the period of apprenticeship desire to dis-pense with the service of the apprentice he may with theconsent of the apprentice and guardian transfer him toanother employer carrying on business within a reason-able distance of the original employer's place of busi-ness, willing to continue to teach the apprentice andpay tie, rate of wages prescribed by the Court in itsAward or otherwise according to the total length oftime served, and generally to perform the obligations ofthe original employer.

14. On the transfer or termination of any apprentice-ship, from whatever cause, the employer shall give theapprentice a statement in writing setting forth the timelie has served, full particulars of the branches of thetrade or industry in which he has received instructionand the proficiency attained (see Form B hereof) ; andlie shall also notify the Registrar stating the cause ofsuch transfer or termination. On any such transfer theoriginal employer shall be relieved from all obligationsunder the contract.

15. In the event of an employer being unable toprovide work for the apprentice or to mutually agreewith the legal guardian of the apprentice to cancel theagreement or to arrange a transfer, application may bemade to the Court to arrange for such transfer or tohave such agreement cancelled.

16. Where a person is apprenticed to partners hisagreement of apprenticeship shall upon the retirementor death of any partner be deemed to be assigned to thecontinuing partner or partners.

Cancellation of Agreement.17. Every agreement shall include a provision that it

may be cancelled, by mutual consent, by the employerand the legal 'guardian of the apprentice giving onemonth's notice in writing to the Court and to the partiesconcerned that such apprenticeship shall be terminated.

18. If the apprentice shall at any time be wilfullydisobedient to the lawful orders of the employer, hismanagers, foremen or other servants having authorityover the apprentice, or be slothful, negligent, or dis-honest, or shall otherwise grossly misbehave himself, orshall not conduct himself as a good and faithful appren-tice should do, or shall not faithfully observe and keephis part of his agreement, then it shall be lawful for theemployer, with the consent of the Court, to discharge theapprentice from his service.

19. The Court may in its discretion for any causewhich it may deem sufficient on the application of anyparty to an apprenticeship agreement vary or cancel theagreement, either unconditionally or subject to suchterms and conditions as it may deem advisable.

20. No apprentice employed under a registered agree-ment shall be discharged by the employer for allegedmisconduct until the registration of the agreement ofapprenticeship has been cancelled by order of the Courton the application of the employer.

Provided, however, that an apprentice may be sus-pended for misconduct by the employer, but in any suchcase the employer shall forthwith make an applicationfor cancellation of the agreement of apprenticeship, andin the event of the Court refusing same the wages of the

apprentice or such portion thereof, if any, as the Courtmay order shall be paid as from the dateof such sus-pension, and, in the event of the application for can-cellation being granted, such order may take effect fromthe date when the apprentice was suspended.

21. Subject to the provisions of the Acts relating toBankruptcy and Insolvency and the Winding-up of Com-panies, the following provisions shall apply:

(a) The Trustee or Liquidator, as the case may be,may give written notice to the apprentice andhis parent or guardian of his intention to dis-continue the employment of the apprenticefrom a date to be named in such notice, andthereupon the agreement shall be deemed tobe terminated from the said date.

(b) Neither the apprentice, his parent or guardian,shall have any right of action against theemployer unless the Court specifically auth-orises the same after consideration of the cir-cumstances, and in any event, any proceedingsfor damages hereunder authorised by theCourt must be commenced within six weeksafter the service on the apprentice of thenotice referred to in subclause (a) hereof,otherwise any claim for damages shall bedeemed to be waived and forfeited.

(e) If the contract of apprenticeship is transferredon the bankruptcy or insolvency of the em-ployer, to another employer, the apprenticenamed in such contract shall not be countedin calculating the proportion of apprenticesto other labour.

Extension of Term.22. Subject to regulation 38, time lost by the appren-

tice through sickness or any other cause whatsoever may,with the consent of the Court on the application of anyparty, be added to the original term in the apprentice-ship agreement at the end of the year of service in whichthe time has been lost or at the termination of theapprenticeship period.

23. The term of apprenticeship may be extended bythe Court on the failure of an apprentice to pass twosuccessive periodical examinations, either by ordering acontinuation of any particular year of the apprentice-ship, in which case the next year of service shall notcommence until after the expiration of the extended period,or by adding the period of extension to the last yearof service. It shall be the duty of the examiners tomake any recommendation they see fit to the Court forthe purpose of such extension. Any extension of theterm of apprenticeship shall be subject to all the condi-tions and stipulations in the original agreement, exceptas to rates of wages, which shall be such amount as theCourt may determine. (See also regulations 31 and 35.)

Technical Education Classes.24. (a) Every apprentice shall attend regularly and

punctually a Government or other approved technicalschool vocational classes or classes of instruction, forinstruction in such subjects as are provided for his trade.This clause shall be deemed to have been complied withif the apprentice takes a course in an approved corres-pondence school: Provided, however, that attendancesshall not be compulsory when the apprentice is residentoutside a radius of 12 miles from the place where instruc-tion is given, or in the case of illness of the apprenticethe proof whereof lies on him. Provided also that iftechnical instruction is not available in the locality inwhich the apprentice is employed and is available bycorrespondence, at reasonable cost to be approved by theCourt, the Court may prescribe such correspondencecourse as the technical instruction to be taken by theapprentice and paid for by the employer.

(h) The fees for the classes attended by the appren-tice shall be paid by the employer.

(c) The period during which apprentices are to attendsuch technical school or classes if any shall be four hoursper week.

25. Any apprentice who:(a) fails without reasonable cause, the proof where-

of lies on him, to attend any technical schoolor class punctually when such is available forinstruction, at the time appointed for the

commencement of the school or class, or leavesschool or class before the time appointed forleaving, without the permission of theteacher ; or

(b) fails to be diligent or behaves in an indecorousmanner while in such school or class; or

(c) destroys or fails to take care of any materialor equipment in such school or class

shall be deemed to commit a breach of the Award andshall he liable for each such breach to a penalty notexceeding two pounds.

26. Where in any case it is shown to the satisfac-tion of the Court that any apprentice, by reason of hisengagement on country work or other good cause, can-not conveniently attend a technical school or otherprescribed classes, such of these regulations as relateto attendance at a technical school or other prescribedclasses, and to examinations, shall not apply to suchapprentice, but he shall be subject to such conditionsas the Court may direct.

27. If the examiners or the industrial union or em-ployer concerned make representations to the Courtthat the facilities provided by the technical schoolor other place of vocational training for the teaching ofapprentices, are inadequate, the Court may make suchinvestigations and such report to the Minister controllingsuch technical school, or such other place, as it deemsnecessary.

28. When an apprentice attends a technical school,vocational classes, or other class or classes of instructionduring his ordinary working hours, where such is pre-scribed, the time so occupied shall be regarded as partof the term of his apprenticeship, and the employer shallnot be entitled to make any deduction from the wagesof the apprentice for such time.

Examinations.

29. (a) Every apprentice shall be bound to submithimself to examination at the places and times appointedby the Registrar after consultation with the examiners.

(b) Every apprentice shall, prior to submitting him-self to examination, if required by the examiners, pro-duce to the examiners a certificate that he has made atleast 70 per centum of attendances at the technicalschool or other place of instruction, unless he isexempted from such attendance for good cause.

(c) The Registrar shall notify the examiners of thenames and addresses of the apprentices required to sub-mit themselves to examination and the attendances madeby them at the technical school, should such informationbe in his possession.

(d) The employer shall place at the disposal of theexaminers such material and machinery on his premisesas may he required by them, and shall in all ways facili-tate the conduct of the examination.

30. (a) The examiners shall be persons skilled in theindustry and appointed by the Court. In the event ofa disagreement between the examiners, the matter indispute shall be referred to a third person agreed to bythem or nominated by the Court or the President, atthe request of any of the examiners, and the decision ofsuch person shall be final and conclusive.

(b) It shall be the duty of the examiners to examinethe work, require the production of the certificate ofattendance, inquire into the diligence of each apprentice,and as to the opportunities provided by the employerfor each apprentice to learn, and to submit a reportto the Court in writing as to the result of the examina-tion within one month from the date of holding theexamination, but tins period may be extended by theCourt.

(c) Such examination shall, where possible, includetheory and practice as applied to the trade, industry,craft, occupation, or calling to which the apprentice isindentured.

31. The Registrar shall, after each examination, issuea certificate to each apprentice indicating the results andthe term of apprenticeship served. A duplicate of suchcertificate shall be forwarded by the Registrar to theemployer and the secretary of the union, each of whomshall keep the same in safe custody and produce forinspection by the Industrial Inspector whenever de-manded by the latter to do so.

32. Whenever it is possible so to do, the examiners,before entering upon the examination, shall draw up asyllabus showing what, in their opinion, is the stage of

proficiency which an apprentice should attain at each ofthe examinations prescribed. The syllabus shall be sub-ject to review by the Court at any time, and shall bekept as a record by the Registrar and a copy handedto the examiners before each examination. The saidsyllabus may be subject to alteration from time to timeby the examiners, who shall forthwith notify theRegistrar thereof.

33. In lieu of, or in addition to, examiners above re-ferred to the Court may appoint, wholly or partly, ex-aminers to be recommended by the Superintendent ofTechnical Education for the whole or any portion of thesubjects of instruction.

34. On the failure of an apprentice to pass any ofthe examinations, the employer may, if the examinersso recommend, withhold the increase in wages accruingto the apprentice in accordance with the scale set forthin the Award, for such period as may be recommendedby the examiners, but not exceeding twelve months. (Seealso regulation 23.)

35. Upon the failure of an apprentice to pass twoconsecutive examinations, it shall be the duty of theexaminers to report same to the Court, with a recom-mendation as to the extension of the apprenticeshipperiod, the cancellation of the apprenticeship agreement,or such other remedial measures (i.e., increased timefor technical instruction) as they may deem advisable.The Court, after notice to all parties concerned, maycancel the agreement or make such other order in thecircumstances as it may deem necessary. (See alsoregulation 23.)

36. Upon completion of the period of training pre-scribed or any authorised extension thereof, each appren-tice shall, if he has passed the final examination to thesatisfaction of the examiners, be provided with a cer-tificate to that effect by the Registrar. This certificateshall also be signed by the examiners.

Lost Time.

37. The employer shall pay the apprentice for alltime lost through sickness or the holidays prescribed bythis Award: Provided

(a) payment for such sickness shall not e:meedtotal of two weeks in each year;

(b) where the time lost through sickness exceedsfour consecutive working days, the employermay demand from the apprentice the pro-duction of a medical certificate, and afurther certificate or certificates may be re-quired if any time is lost through sicknesswithin seven days from the date of resump-tion of duty, the cost if any of such certificateor certificates not exceeding 5s. to be borneby the employer;

38. The employer shall pay the apprentice, in respectof time lost through compulsory military or naval train-ing (but not exceeding two weeks in any year of ser-vice), the amount by which the wages prescribed by theindustrial award for the trade, calling, craft, occupation,or industry exceeds the amount received by the appren-tice from the Department of Defence: Provided, how-ever, that tins clause shall not apply to military ornaval training imposed through failure to attend com-pulsory parades.

All time lost by reason of compulsory military ornaval training other than the additional training men-tioned in the above proviso shall count as part of theapprenticeship.

39. When an apprentice is absent from work forany cause other than sickness or in pursuance of theprovisions of these regulations, the employer shall beentitled to deduct from the wages of the apprentice anamount proportionate to the time so lost.

40. When an apprentice cannot be usefully employedbecause of a strike the employer shall be relieved ofhis obligations under the apprenticeship agreement dur-ing the period of the strike.

Part-time Employment.41. Where in any case an employer is temporarily

unable to provide work to employ an apprentice for hisfull time, application may be made by the employer tothe Court for permission--

(a) to employ the apprentice for such lesser timeper week or per month and at such remunera-tion as the Court may determine, being notless than the proportionate amount of therate of wages prescribed by the industrial.Award or Agreement for the trade, calling,or industry; or

(b) to suspend the contract for such period and onsuch terms as the Court thinks fit.

If the Court grants the application, holidays will bereduced pro rata.

Miscellaneous.42. (1) The Registrar shall prepare and keep a roll

of apprentices containing

(a) a record of all apprentices and probationersplaced with employers;

(b) a record of all employers with whom appren-tices are placed;

(c) a record of the progress of each apprentice, re-cording the result of the examiners' reports;

(d) any other particulars the Court may direct.

(2) These records shall be open to inspection by em-ployers and the union of workers interested upon re-quest.

43. (1) (a) For the purpose of ascertaining thenumber of apprentices allowed at any time the averagenumber of journeymen employed on all working days ofthe 12 months immediately preceding such time shall bedeemed to be the number of journeymen employed.

(b) Where the employer is himself a journeyman re-gularly and usually working at the trade he shall becounted as a journeyman for the purpose of computingthe number of apprentices allowed. In the case of apartnership each partner shall be deemed a journeymanfor the purpose of this subclause.

(c) Where a business is in operation for less than 12months the method of ascertaining the number shall beas agreed by the union and the employer, or if no agree-ment is arrived at, as determined by the Court.

(2) Notwithstanding the provisions of subclause (1)hereof the Court may in any particular case

(a) In special circumstances permit the taking oremployment of an apprentice by an employernotwithstanding that the quota fixed by theAward may he exceeded.

(b) Refuse the registration of an agreement ofapprenticeship or the taking of an appren-tice in any case when in the opinion of theCourt the circumstances are such that theapprentice is not likely to receive the instruc-tion and training necessary to qualify himas a tradesman.

44. Every industrial inspector appointed in pursu-ance of the provisions of the Industrial ArbitrationAct, 1912-1935, shall have the power to enter anypremises, make such inspection of the premises, plant,machinery, or work upon which any apprentice is em-ployed or could be employed, interview any apprenticeor employee, examine any books or documents of thebusiness relating to the wages and conditions ofapprentices, interrogate the employer in regard to anyof the above-mentioned matters.

45. With a view to determining whether the numberof apprentices being trained is sufficient to meet thefuture requirements of the industry in the matter ofskilled artisans, the Registrar may require any em-ployer to furnish him with any specified informationrelating to the said industry, or relating to the workersengaged therein.

46. In every application under clauses 15, 18, 19,20, and 41 hereof, the union of workers registeredmay intervene and make such representations at thehearing as it may deem necessary. Similarly, in thecase of an application under clause 22, the employermay intervene and, in an application under clause 23,both the employer and the union may interyeinWhere such intervention is made, a representative oragent shall be appointed in the manner laid downby section 65 of the Act.
