MANILA, August 14, 2014 (AFP) – A The Philippine evacuation ship has sailed away from war-torn Libya with 810 Fili-pinos on board, the Department of Foreign Affairs said Friday.

“Ship is now headed to Malta,” Foreign Affairs spokesman Charles Jose said.

The 1,500-seater vessel, commis-sioned by the Philippine government for $1.8 million to ferry Filipinos away from Libya, sailed to Malta after picking up the last group of 367 workers at a port in the Libyan city of Misrata Thursday afternoon. They joined 443 other Filipinos and 15 foreigners who boarded the ship from Benghazi on Wednesday.

Jose said chartered Philippine Airlines planes were supposed to leave late Friday afternoon for Malta and was scheduled to arrive on the same day the ship docks in the European state on Aug. 15.

Initially, 1,100 registered for evacua-tion by ship but more than 200 have either backed out or said they will be repatriated to the Philippines by their own employers.

Foreign Affairs Secretary Albert del Rosario had said the government will no

longer hire another ship and will instead use Libya’s land border exits with Egypt and Tunisia to bring Filipinos out of the troubled North African state.

The Philippine government ordered the mass evacuation of its 13,000 Filipinos in Libya due to the ongoing civil war, but only about 1,000 have returned home.

Many of them are reluctant to leave and continued to hold on to their jobs in Libya despite the widespread violence, citing lack of economic opportunities back home.

But the DFA said it will continue to enforce mandatory evacuation and even called on the relatives of those Filipinos who are in Libya to convince their loved ones to return to the Philippines as the violence and armed conflict showed no sign of ending.

Libya does not have a functioning government. Last month a Filipino worker was beheaded by militants while a Filipina nurse was gang-raped.(MNS)

MANILA, Aug 14 (Mabuhay) – Trans-portation Secretary Joseph Emilio Abaya on Thursday said they are still determining whether human error or failure of materials caused the coupling disconnection of the coaches of a Metro Rail Transit train that rammed through a steel barricade of the Taft Avenue Station in Pasay City before 5 p.m. Wednesday, and left at least 50 people injured.

“We have yet to find out what really happened – it could have been a human procedural error that the proper couple procedure was not followed. Although possibly, there could have been a failure in the coupling material. That is currently being investigated,” Abaya said.

At least 50 people, including a six-month-old baby, were hurt in the mishap.

Many of those injured were women, as front-end coaches of the MRT trains are reserved for women, children and the elderly, it added.

Quoting a passenger, the report said many of the passengers began to sense that something was wrong when they saw a spark while the train was passing the Magallanes station in Makati.

The MRT administration has since apologized for the incident.

When asked if the incident could have been prevented if authorities followed the

recommendations of an audit report done on the MRT system in 2013, Abaya said it has nothing to do with Wednesday’s incident.

“The rail grinding would have nothing to do with the stopper... The need for rail grinding is to ensure that the materials used from the very start was good and likewise to smoothen out the rails, so as to limit the bumps,” Abaya said.

“As regards to the procurement [of the machine], we have procured that... it’s currently ongoing... I have to check its current status. But the initial challenge there is the needed rail grinding machine was not available in the country. There was a single entity who had this, and we had to negotiate with him and make it available,” he added.

The MRT 3 is operated by a private firm, the Metro Rail Transit Corporation, in partnership with the Department of Transportation and Communications.

It connects North Avenue to Taft Av-enue in Pasay via Epifanio delos Santos Avenue. It ferries about 500,000 passen-gers a day though it has a rated capacity of only 350,000.

The train has suffered glitches in the past, and its aging coaches have been the subject of several complaints from com-muters. (MNS)

and whether you personally guaranteed or secured the debt.

Sole Proprietors and PartnershipsIf you are a sole proprietor, you and your

business are one and the same in the eyes of the law, which means you are personally responsible for all of the business’s debts. If there isn’t enough money in the business to pay these debts, creditors can take your personal assets to pay them.

Partners in a general partnership have simi-lar personal liability for business debts: Each partner is personally liable for the entirety of the business’s debts (and any partner can usu-ally bind the entire partnership to a business deal -- a scary combination). This means that if there isn’t enough money in the business to pay the debts, and your partners are broke, creditors can take your personal assets to pay all of the business’s debts, not just your share.

Corporations and Limited Liability Companies

If your business is organized as a corpo-ration or a limited liability company (LLC), your personal assets are usually protected from business creditors as a matter of law. Shareholders and LLC members have a form of asset protection called limited personal li-ability. Creditors cannot take owners’ personal assets to pay business debts, unless a business owner specifically gives up that limited li-ability protection.

Unfortunately, most small business own-ers are forced to give up their right to limited personal liability, at least for some of their business debt. Many creditors require per-sonal guarantees and/or personal security from small business owners before they will loan money or extend credit to a business. And many landlords require a personal guarantee before they will lease commercial property to a small business.

A personal guarantee is a promise by a business owner to hand over the owner’s personal assets to a creditor if the business can’t pay its debt and its assets are not worth enough to cover the debt. A creditor can also ask a business owner to secure a business debt by pledging specific personal property, such as an owner’s house, boat, or car. When you sign a personal guarantee or pledge personal property, you give up your protection against personal liability, and creditors can come after your personal assets if your business can’t pay.

The Bankruptcy OptionIf your business bank account is empty, a

bankruptcy might be a viable option. It would certainly give you some breathing room while working things out, and in the case of personal liability, a bankruptcy will protect your house, your car, and other assets.

Business vs. Personal BankruptcyIf you are a sole proprietor, you can file

for either Chapter 13 or Chapter 7 bankruptcy. Either type of bankruptcy can be used for personal debts or business debts.

If you are a corporate shareholder, LLC owner, or partner in a partnership and you have signed personal guarantees or pledged collateral for business loans, putting your business through bankruptcy will not protect your personal property.

If you have placed your personal property at risk, you must file for bankruptcy for your-self and your business separately to protect your personal assets. In this article, we assume you are considering personal bankruptcy -- because only personal bankruptcy will protect your personal assets.

Chapter 7 vs. Chapter 13 BankruptcyIf you file for personal bankruptcy, most

likely it will be a Chapter 7 or Chapter 13 bankruptcy. In a Chapter 7 bankruptcy, your assets (except for property that is exempt which for the most part, usually includes your home, car etc.) go into a bankruptcy estate to be sold, and the proceeds are distributed to your creditors. At the end of the process, all of your debts that are eligible for discharge in bankruptcy will be wiped out. In a Chapter 13 bankruptcy, you propose a repayment plan where you repay part or all of the debt over three to five years.

How Bankruptcy HelpsWhen you file for bankruptcy, something

called an automatic stay immediately stops your creditors from foreclosing on your house or any other personal property that is at risk. In some situations, this can be reason enough to file for bankruptcy, because it will buy you time, if nothing else.

Unpaid Rent. If your business owes your landlord back rent, you are probably person-ally liable for the debt. (Sole proprietors and partners are automatically personally liable for rent payments, and most small business corporations and LLCs also get stuck person-ally guaranteeing the lease payments -- check your lease. If you didn’t, give yourself a pat on the back for being a savvy negotiator.)

Filing for bankruptcy might keep the land-lord from taking your personal property to pay the debt, especially if you file under Chapter 13 and come up with a payment plan.

Ordinary, Unsecured DebtIf your business owes suppliers, you will

be personally on the hook if you operated your business as a sole proprietorship or partner-ship. Under the Uniform Commercial Code, suppliers of goods usually have the right to take the goods back. Barring that, however, they can come after you personally for the unpaid amounts. If you have a lot of this kind of debt, filing Chapter 13 could help you or-ganize a payment plan (and Chapter 7 might wipe the debt out).

If your business is a corporation or an LLC, you may be off the hook for these debts. This kind of debt is typically unsecured and is rarely personally guaranteed. If your business has no money and no assets left, the suppliers may be out of luck -- your personal liability protection should protect your personal assets. So if your corporation or LLC has only unse-cured, un-guaranteed business debt, there’s no need to file a personal bankruptcy.

MANILA, Aug 14 (Mabuhay) – Vice President Jejomar Binay on Thursday said he respects President Benigno Aquino III’s open position on the matter of seeking another term beyond 2016.

But Binay, in a statement posted on his social media accounts, also advised Aquino to make sure the supposed voice of the people calling for a term extension are not those of vested interests.

“President Aquino has been quoted as expressing openness to listen to the people on the matter of seeking another term. He added that it does not automatically mean he will seek another term. I respect the statement of the President,” he said.

He added any national leader “would want to hear the voice of the people on issues that will have far-reaching conse-quences.”

On Wednesday night, Aquino told a television interview that he is keeping his options open on calls to extend his stay in power.

“Noong pinasukan ko ho ito, ang tanda ko, one term of six years. Having said that, ang mga boss ko, kailangang pakinggan din,” the President said.

Aquino uses the term “boss” to refer to his constituents. He introduced the ter-minology he introduced in his inaugural address upon assuming the presidency in 2010.

The 1987 Constitution allows a Presi-dent to have only one six-year term.

Section 4, Article VII of the 1987 Constitution states that: “The President

shall not be eligible for any re-election. No person who has succeeded as President and has served as such for more than four years shall be qualified for election to the same office at any time.”

In cautioning the President on the sup-posed voices he supposedly has to hear, Binay said: “What is important is that the voice he hears is an authentic and genuine voice, not one manufactured by quarters with vested interests who are driven mainly by self-preservation.”

“We also need to keep our focus on pursuing our goal of improving the lives of the people for the remainder of the President’s term and beyond,” he added

Earlier in the day, militant umbrella group Bagong Alyansang Makabayan warned the prospect of a term extension, along with Charter change that may limit the powers of the judiciary, make up a “recipe for dictatorship.”

The group called for a noise barrage in Manila to protest such a recipe on Friday.

Past presidents have considered Charter amendments, but faced intense public criti-cism for attempting to extend their term of office. Aquino, who has put in place reforms in the fiscal sector that earned the country its first investment grade rating, is likely to face similar public reaction.

Some legislators, including Speaker Feliciano Belmonte Jr., have actively pushed for changes to the Constitution, particularly to economic provisions that capped foreign investments into the coun-try. (MNS)

“Atin pong ipagdasal ang ating Presidente – na talagang buksan niya ang kani-yang mga tenga sa tunay na boses ng ating mga kababayan at alalahanin niya ang ipinaglaban ng kaniyang mga magulang. Sana ang marinig niya po ay yung mga totoong boss nya at hindi yung mga boss na may pansariling interes na kailangang protektahan beyond 2016,” she added. It was during a Wednesday night television interview when President Aquino said that he is now open amending the 1987 Constitution and possibly, extending his term. He said that he would listen to the voice of his “bosses”, the Filipino people, in making his decision.

In an interview with Radyo5 on Thursday morning, Senator Binay said that all the Filipino people could do now was to pray that President Aquino would remem-ber how Senator Ninoy and President Cory fought against the Marcos dictatorship.

“PNoy witnessed history from the point of view of his parents. Senator Ninoy and President Cory fought a regime that believed it had the sole franchise to make the country great. PNoy would honor what his parents stood and died for by continuing their crusade,” Binay pointed out.

“I hope that the President would look back at history when Senator Ninoy fought a dictatorship which perpetrated itself in power and when President Cory turned down calls to run under the 1987 Constitution, even though she was legally allowed to seek a fresh term,” she said.

She added that if Aquino’s mother, former President Corazon Aquino, were still alive, she will never allow PNoy to seek a second term in office no matter how noble his intents are.

“I am praying na hindi dudungisan ni PNoy ang pangalan ng mga magulang n’ya para lang mapagbigyan ang mga taong medyo walang pagasang manalo sa isang malinis na eleksyon,” the senator said.

MANILA, Aug 14 (Mabuhay) – The Armed Forces of the Philippines (AFP) assured on Thursday that it would remain “apolitical and nonpartisan” despite calls for President Benigno Aquino III’s term extension.

“That’s something very political. We remain apolitical and nonpartisan,” said AFP Chief of Staff General Gre-gorio Catapang Jr. when asked by re-porters during the turn-over ceremony of military riffles at Camp Aguinaldo in Quezon City on the openness of Aquino to a second term.

Catapang said the calls for Aquino to make another run for the presidency are a product of a “vibrant democracy.”

“It’s just an opinion, a talk of the town,” he said.

“These things are things that are products of a vibrant democracy and the political dynamics that is now hap-pening in our country,” he added.

The military chief said it would not interfere in the political landscape of the country.

Earlier this month, a social media campaign called “One More Term: Re-Elect P-Noy for 2016” recently flooded pages on Facebook and Twitter, sup-posedly emanating from Aquino’s official Facebook account, which has more than 4 million followers.

Also, some members of the Senate and House of Representatives support-ed the idea of Aquino’s term extension.

However, for Aquino to make an-other run for the presidency after his term in 2016, the term limits set by the 1987 Constitution would have to be lifted.

He has previously consistently re-jected moves to amend the constitution. But during an exclusive interview with TV5 on Wednesday, he was singing a different tune.

Communications Secretary Herminio Coloma Jr. said at a press briefing that Aquino has always been guided by his parents’ principles in pursuing reforms for the country.

“Batid ng lahat kung paano ang pag-sisikap ng ating Pangulo na itaguyod ang mga prinsipyo na pinaglaban ng kanyang mga magulang. Kaya nga masigasig din siya sa pagsusulong ng transpormasyon ng buong bansa ayon sa matuwid na daan,” Coloma told reporters Thursday afternoon.

“It is well known that the president is

doing his best to institute reforms that will bring about the transformation of society in keeping with his parents’ legacy,” he added.

On Wednesday, Aquino said he is considering Charter change to limit the judiciary’s reach on the executive and the legislature.

The President added that some provi-sions in the 1987 Constitution – which was drafted and approved early during the term of his mother – needed fine-tuning.

Aquino also said he is willing to listen to public sentiment on calls for him to stay in power for another term.

S. Korea embassy warns PHL on crimes against nationals 

MANILA, August 13, 2014 (AFP) – South Korea has expressed alarm at a rise in crimes against its nationals in the Philippines, citing the killing of nine South Koreans this year alone.

Seoul’s embassy, in a statement dated Tuesday, said such crimes could affect growing ties between the two countries which has recently seen many South Koreans coming to the Southeast Asian archipelago.

“The rising incidence of crimes com-mitted against Koreans while in the Phil-ippines either on vacation or on business is a trend that has alarmed the embassy,” said the statement.

“It is feared that if crimes against in-nocent Koreans persist, businessmen will avoid the Philippines and seek safer places for doing business.”

The embassy cited the murder of a South Korean businessman and the abduc-tion of his wife on July 27, a crime for which their Filipino driver was arrested as a suspect.

Embassy officials had met the Philip-pine police chief as well as other key officers to express concern, said police spokesman Chief Superintendent Reuben Sindac on Thursday.

However Sindac minimised the threat, saying “it is not a cause for concern, it is not yet alarming. It is not as if Korean nationals are the only ones being threat-

ened”.He told reporters that police had

warned Koreans to check the background of their Filipino household workers after reports that some of them were involved in recent crimes against their employers.

Sindac said police assured the embassy that “we are doing our best to solve every murder case, whether it is foreign nation-als or one of our own citizens”.

He said a special task force was looking into killings of foreigners.

In recent years, many South Koreans have visited or come to live in the Philip-pines as businessmen or students.

Seoul’s embassy estimated last year that there were 100,000 Koreans living in the Philippines.

Philippine Tourism Department figures show that South Korea was the top source of tourists to the country, accounting for 22.52 percent of the total in the first half of 2014.

Crime rising vs Koreans

MANILA, Aug 14 (Mabuhay) – Crim-inal charges were formally filed with the Department of Justice against rice trader Davidson Bangayan for allegedly rig-ging the National Food Authority’s rice importation program.

Bangayan, who’s allegedly the same person as notorious rice smuggler David Tan, was charged with violation of the Government Procurement Reform Act for bid-fixing.

He was also charged with violation of Article 186 of the Revised Penal Code, penalizing monopolies and restraint of trade.

Bangayan was also charged separately for using a fictitious name or concealing true identity in violation of Article 178 of the RPC and violation of Commonwealth Act No. 142 as amended by Republic Act 6085.

“Upon investigation, the NBI dis-covered a scheme whereby certain rice traders/importers were able to corner the National Food Authority’s rice import allocations through the use of farmers’

organizations/cooperatives and single proprietorships as dummies in the NFA bidding for rice Import Allocation under the Private Sector-Financed importation thru the NFA Tax Expenditure Subsidy,” said the NBI in its complaint.

The NBI said the rice traders and importers pooled the bidders into groups and financed their individual bids for NFA rice allocations. In exchange, the bidders were given a small percentage share of a certain amount per sack of rice they were allowed to import.

“This scheme, in turn, allowed these rice traders/importers to corner the rice import allocations that were put up for bidding by the NFA, even if they were not licensed by the NFA to engage in rice importation or bidding,” the NBI said.

Charged along with Bangayan were Judilyne Lim, Elizabeth Faustino, Elea-nor Rodriguez, and Leah Echeveria, who were the owners of the single proprietor-ships and representatives and officers of the farmers’ cooperatives and organiza-tions. (MNS)

MANILA, Aug 14 (Mabuhay) – Prima-ry whistleblower Benhur Luy on Thursday admitted that he, too, received a portion of the kickbacks from the Priority Develop-ment Assistance Fund scam allegedly mas-terminded by his cousin, businesswoman Janet Lim-Napoles.

“’Pag inipon, mga P3-4M net ‘yung natanggap kong commission from 2004 to 2012,” he said.

Luy, who first exposed the scam that saw lawmakers’ pork barrel funds diverted to bogus NGOs, served as president of the Social Development Program for Farmers Foundation Inc., one of the foundations Napoles set up for the scam.

But in open court, Luy said that while he received commissions, it was far less than what was promised to him by Napoles.

“Wala kaming kita talaga [as president of NGOs] kasi foundation ni Madame Ja-net Lim Napoles ‘yun. Dapat 1.5 percent ang mapupunta sa NGO, 1 percent sa president, tapos .5 percent sa incorpora-tors. Pero ‘yung 1 percent, verbal lang ‘yun, hindi naman natutupad,” Luy said, adding that Napoles would not give his commissions when she would feign anger.

“Minsan nagpapanggap-panggap siya na nagagalit-galitan, para ‘di na kami bigyan ng komisyon. ‘Di naman ‘yun nasusunod, ‘yung 1 percent. Halimbawa kung P250,000 dapat ‘yung sa akin, [usu-ally] P30,000 or P50,000 lang binibigay niya, nalalakihan pa siya. ‘Yung remaining [of the commissions,] sa kaniya na ‘yun,” Luy added.

Luy is a prosecution witness in the bail hearings of Napoles and others accused of plunder in the Sandiganbayan First Division, including Senator Ramon Bong Revilla Jr., and his senior staffer, Atty. Richard Cambe.

Revilla and his co-accused are facing plunder and graft charges in connection with the pork barrel scam. Both Revilla and Cambe are detained at the PNP Custodial Center in Camp Crame.

On the other hand, Napoles is detained at Camp Bagong Diwa in Taguig City.

though he did not receive the full extent of the pork barrel kickbacks promised to him, he had no reason to be mad at Napoles, who took care of him as an employee.

MANILA, Aug 15 (Mabuhay) – Box-ing champ Manny Pacquiao wants the Supreme Court to stop the Court of Tax Appeals from ordering him to post a P3.2-billion cash bond or a P4.9-billion surety bond to cover a P3.289-billion tax eva-sion case filed by the Bureau of Internal Revenue.

According to the tax court, Pacquiao and wife Jinkee went to the high tribunal for help via a petition for certiorari “with urgent application for the issuance of a status quo ante order/TRO and/or writ of preliminary injunction.”

The Pacquiaos filed their petition be-fore the SC on July 24, but the tax court received a copy of the plea only this Au-gust, the CTA said.

The SC Public Information Office has yet to confirm if the Pacquiaos really filed the petition.

The BIR earlier sued the boxing champ, who is also the Sarangani representative, after assessing that Pacquiao had incurred billions of pesos in “deficiency income and value-added tax” liabilities from 2008 to 2009.

On August 1, 2013, Pacquiao filed a “petition for review for the reduction of, and the return of any excess, filing fees assessed and paid in the instant case, for lack of merit.”

Spouses Manny and Jinkee then filed on October 18 an urgent motion to lift the warrants of distraint and levy and garnish-ment against their assets and to stop BIR from collecting taxes against them.

Last April, the tax court told the BIR to lift the garnishment on Pacquiaos’ as-sets. However, the tax court also ordered the Pacquiao couple to deposit a cash bond worth over P3.2 billion or file a

MANILA, Aug 14 (Mabuhay) – The House of Representatives has approved on second reading a bill promoting and protecting the rights of internally displaced persons (IDPs) in situations of armed conflict and violence.

The House Committee on Human Rights, chaired by Rep. Guillermo Romarate Jr. (2nd District, Surigao del Norte) endorsed, sponsored and defended for plenary passage House Bill No. 4744, a consolidation of four separate bills.

The original bills are HB Nos. 239, 2247, 3003 and 3146, authored by Reps. Rene Relampagos (1st District, Bohol), Rufus Rodriguez (2nd District, Cagayan de Oro City)) and Maximo Rodriguez Jr., Gus Tambunting (2nd District, Parañaque City), Ibarra Gutierrez and Walden Bello (Party-list, Akbayan), respectively.

HB 4744, as contained in Committee Report No. 349 entitled “Rights of Inter-nally Displaced Persons Act,” seeks to afford similar protection to citizens who are non-combatants in cases where armed conflict of a non-international character is inevitable, and that they shall not be discriminated against in their enjoyment of rights and freedoms on the ground where they are internally-displaced.

“The bill defines and criminalizes acts of arbitrary internal displacement commit-ted by any person or group of persons and directed against the civilian population,” Relampagos stressed.

MANILA, Aug 14 (Mabuhay) – The Bureau of Internal Revenue exceeded its tax collection goal by P58.52 million in July.

The BIR, which accounts for two-thirds of the country’s total tax collection, said it collected P119.94 billion in July, 19.82 percent up from the same month a year ago.

Collections from BIR operations rose 21.61 percent to P115.45 billion in July, surpassing the target by P2.06 billion.

Collections from non-BIR operations reached P4.49 billion in July, nearly 13 percent lower than a year ago. This amount was also P2 billion short of the July goal.

The BIR said collections by its regional offices hit P37.92 billion in July, 15 percent more than collections made a year ago. However, this was P1.95 billion lower than the July 2014 goal.

Collections by the Large Taxpayers Ser-vice grew by 25 percent to P77.54 billion in July, exceeding its goal by P2.44 billion.

The BIR aims to collect P1.456 trillion this year. (MNS)

MANILA, Aug 14 (Mabuhay) – Four days after President Benigno Aquino III delivered his 5th State of the Nation Ad-dress last July 28 where he asked Congress to clarify the meaning of “savings” in the controversial Disbursement Acceleration Program, Budget Secretary Florencio Abad wrote a letter to House Speaker Feliciano Belmonte Jr. explaining how savings should be defined.

Abad’s letter to Belmonte, dated August 1, was only sent to members of the media on Wednesday by opposition leader Navo-tas Rep. Tobias Tiangco.

Attached accompanying letter was a copy of a proposed bill drafted by the De-partment of Budget Management (DBM) titled: “An Act Clarifying the Definition of Savings and Related Concepts and the Use and Release of the Unprogrammed Fund in the Appropriations Laws and Validating the Implementation Thereof by the Execu-tive Branch.”

Under DBM’s proposal, savings is defined as “portions or balances of any programmed items of appropriations in the appropriation laws, identified as either a program including any activity covered under it, or project, which have not been released or obligated.”

Reasons for the non-release of the funds include: discontinuance or abandonment of a project, non-commencement of the program, and the decreased cost realized by an agency as a result of the improved implementation of programs, the letter added.

Also, it said that “savings” may like-wise refer to unreleased appropriations accrued anytime during the fiscal year from unused personnel-related costs pertaining to unfiled, vacant or abolished positions; non-entitlement to allowance and benefits; leaves of absence without

pay, or unutilized pension and retirement benefits arising from death of pensioners, decrease in the number of retirees or other related causes.

Moreover it said, unspent funds for programmed projects may be pooled as savings as early as the middle of the year according to the new definition of savings in the draft bill.

According to Abad’s letter: “The pro-posed bill intends to clarify the legislative intent on what constitutes savings and the rules on augmentation, and when the Unprogrammed Fund may be utilized pursuant to the authority of Congress to legislate the foregoing concepts.”

“This will effectively clarify the effects of the Supreme Court decision in the con-solidated case of Maria Carolina P. Araullo et. Al. vs. Benigno Simeon Aquino III, et. al,” the letter added.

Abad asked Belmonte to consider the proposal a priority bill “given its impact on the disbursement of public funds following the above-cited decision.”

The draft bill may be filed by any House member.

‘Savings’ questionedThe definition of savings has been

questioned amid the controversy in the Aquino administration’s DAP.

In a unanimous vote in July, the Su-preme Court declared as unconstitutional certain acts committed under DAP, such as the withdrawal of unobligated allotments from the implementing agencies and their declaration as savings prior to the end of the fiscal year and without complying with the statutory definition of savings con-tained in the General Appropriations Act.

But Malacañang, through the Office of the Solicitor General, had filed a motion for reconsideration asking the Supreme Court to reverse its ruling.

MANILA, Aug 14 (Mabuhay) – The lawyers of retired Major General Jovito Palparan, Jr. on Thursday asked the Ma-lolos Regional Trial Court in Bulacan to let him stay at the National Bureau of Investigation detention facility.

Palparan’s lawyers filed the urgent ex-parte motion to stay in detention at NBI headquarters in Manila after Judge Teodora Gonzalez of Malolos RTC Branch 14 or-dered his transfer to the Bulacan Provincial Jail on Wednesday.

Palparan, who is facing kidnapping with serious illegal detention charges in connec-tion with the disappearance of UP students Sherlyn Cadapan and Karen Empeño in

2006, was arrested in Sta. Mesa, Manila on Tuesday morning. He has been detained at the NBI headquarters since then.

Palparan was also blamed for extra-judicial killings of suspected communist sympathizers. The retired general has denied the allegations.

Palparan’s camp filed the motion around 9 a.m. Thursday, branch clerk of court Atty. Melba Agustin David said.

“As of now, the order to transfer ac-cused Palparan in Bulacan Provincial Jail prevails… But practically, dahil nga sinabing high risk [’yung security niya] baka hindi practical [na ilipat siya],” she explained. (MNS)

MANILA, Aug 14 (Mabuhay) – Gov-ernment prosecutors on Thursday renewed the call to immediately transfer Senator Jinggoy Estrada from his present detention in Camp Crame to a regular jail.

In their motion before the Sandigan-bayan Fifth Division, the prosecutors said Estrada’s continued stay at the Philippine National Police (PNP) Custodial Center “had no legal basis and that such special treatment was bad for the justice system.”

They reiterated the PNP Custodial Center, which housed officials of the PNP Custodial Center Service Unit, is “not a detention facility.”

Government lawyers argued that the Revised Rules on Criminal Procedure provides that an accused arrested by virtue

of a warrant of arrest must be delivered to the nearest police station or jail.

The prosecution described a jail “as a facility or place of confinement undergo-ing trial and is managed by the Bureau of Jail Management and Penology (BJMP).”

The prosecution panel reminded the justices that Estrada was charged with plunder with penalty of reclusion perpetua [life imprisonment] to death, and is also being tried for graft also in connection with the alleged irregular use of his pork barrel allocation as senator, before the court.

They interpreted Estrada’s stay in Camp Crame as special treatment not enjoyed by others who are similarly situated. It also cited the controversy involving his wed-ding anniversary party inside the center.

The group highlights 10 instances in which past presidents have used their authority on selective prosecution of im-migration actions which in most instances “targeted specific populations mired in

complex and dangerous foreign policy crises.

This, according to immigration lawyers are actions that could provide sound prin-ciples on which the current administration can act.

The American Bridge memo referred to the immigration policy from the days of President Ronald Reagan through Presi-dent George W. Bush and highlighted the instances of selective enforcement.

In 1987, the Reagan administration eased immigration standards for 200,000 Nicaraguan exiles fleeing communism in 1987 with the Attorney General instruct-ing the U.S. Immigration and Naturaliza-tion Service “to encourage and expedite Nicaraguan applications for work autho-rizations” and ordered them to “encourage Nicaraguans whose claims for asylum or withholding of deportation have been denied to reapply for reopening or rehear-ing.”

In 1990, an executive order from Presi-dent George H. W. Bush made it easier for Chinese students to stay in the country “should they fear persecution upon being sent back to China”. The action stopped deportation proceedings against these students for nearly four years.

A 1991 executive order, again from Bush, delayed deportation of Kuwaiti residents for four years, following Iraq’s invasion of that country.

In 1993, President Bill Clinton, through an administrative decision, granted an 18-month extension of deferred action departure program affecting Salvadorian immigrants who were fleeing civil war in that country.

President George W. Bush’s executive order in 2001 gave 150,000 Salvadorans “the right to remain in the country 18 more

months after their country was hit by an earthquake”.

In 2002 Bush issued an executive order that expedited naturalization proceedings for those green card holders who had enlisted in the United States military, a move that eliminated the three-year wait-ing period.

President Obama has his executive op-tions in his bad which he can use if Con-gress fails to pass immigration reform bill this year to grant legal status to millions of undocumented immigrants worldwide.

SEOUL, August 13, 2014 (AFP) – Pope Francis arrives in Seoul on Thursday look-ing to fuel a new era of Catholic growth in Asia – a mission fraught with complex political challenges but huge potential rewards.

His five-day visit to South Korea is rec-ognition for one of Asia’s fastest-growing, most devoted and most influential Roman Catholic communities, and will feature a special “reconciliation” mass with a mes-sage for isolated North Korea.

But the real goal is longer-term and much wider-ranging.

The pope will bring a message about the “future of Asia” and will use his trip to “speak to all the countries on the conti-nent”, the Vatican’s number two, Secretary of State Cardinal Pietro Parolin, said in a television interview.

Early in his pontificate, Francis made it clear that Asia, which his predecessor Benedict never visited, would be a priority.

The last papal visit to Asia was by John Paul II to India in 1999, a glaring 15-year gap for a region where the Church is making some spectacular gains but where

Catholics still only account for 3.2 percent of the population.

The pope’s flight to South Korea takes him over China – potentially the greatest prize of all but also the hardest to claim. Beijing maintains a state-controlled Catho-lic Church, which rejects the Vatican’s authority.

China “is a great cultural challenge, very great,” Francis said in a recent inter-view with the Italian daily Il Messaggero.

Flying over China will offer Francis the rare opportunity to speak directly to Beijing since the pope always sends a message to leaders of those countries he travels over.

When John Paul visited South Korea in 1989, Beijing refused to let his plane fly through Chinese airspace.

China’s Communist regime broke ties with the Vatican in 1951 and they remain firmly at odds over which side has the authority to ordain priests.

Francis will have a chance to address believers across the region on Friday when he meets several thousand young Catholics gathered in South Korea for Asian Youth Day.

I remember him to be very helpful and accommodating. A year later, after I had completed my print and broadcast journal-ism course at UCLA, I saw him again. This time, it was to interview him for a story I was doing for The Filipino Channel’s (TFC) Balitang Amerika. And that’s when he introduced me to fellow kababayan Elito Santarina who was in the Carson City Council.

Over the years, I would see and meet several community leaders in Carson. Even after I moved out to live in West LA, I would still visit often, because of my parents. And when I was blessed with the means to purchase my own property, I chose to buy a place in Torrance, “the suburb of Carson,” Mayor Dear would say.

Last week, I found myself on familiar grounds as I was invited to the City Hall, to accept a proclamation. Interestingly, it didn’t feel like a “business” matter. It felt more like getting together with family. Of course, my parents, brother, niece and my husband were there to celebrate the acco-lade; but it felt like I had a bigger family. I saw familiar faces that have always been there to lend me their support through the years.

Paz Velasquez, a fixture in Carson City events and projects, was there. She had called on me a few times in the past, to help spread the word about their latest endeavors. In 2011, she asked me to be the Hermana Mayor for the city’s month-long celebration of Filipino-American His-tory Month. That’s when I built a deeper relationship with the selfless kababayans in the South Bay. I saw how a few people rolled up their sleeves to work in preserv-ing and promoting Filipino traditions in their community.

Evelyn Andamo was then President of the Filipino-American Chamber of Com-merce, in the South Bay. And journalist Fe Koons was also very active. It was a camaraderie of individuals who are proud of their heritage and are committed to making a difference in Carson City and beyond. Something that each was doing on the side, donating their time and talent, to uplift Filipinos in Carson.

Rose Ibanez was the one who told me about the proclamation. She said the com-munity of Carson City, through the council, would like to thank me for my service to kababayans. It was totally unexpected. I did my job and felt quite fortunate that my job gave me lots of opportunities to serve my community. That in itself, was already an honor. Rose’s husband, Florante, also attended the small gathering; took pictures; and told me “You did a lot for the com-munity. Thank you.”

In fact, I should be the one saying “Thank you,” not only for the recogni-tion; but more importantly, for giving me

prehensive Rehabilitation and Recovery Plan which he called CRRP specifically for the areas devastated by Mega Storm Yolanda in November last year.

According to Lacson, President Aquino was appreciative in receiving the 8,000 paged, eight-volume report presented to him last week, after the memorial event in honor of Cory Aquino, the President’s mother.

Mr. Lacson explained that the CRRP

Master Plan includes Local Government Units (LGU’s) Recovery and Rehabilt-ation Plans for the following “Yolanda” devastated areas: Leyte, Eastern and Western Samar, Iloilo and Tacloban City, encompassing 104 out of the 171 Yolanda-affected municipalities which were approved for rehabilitation by the President last month.

In closing, Mr. Lacson said that they are “hoping to achieve at least 80% completion of their priority projects be-fore the end of President Aquino’s term. However, he added that the plans include several long-term projects which would trickle down to the next administration to pursue.” On that note, Karen Davila sug-gested that Mr. Lacson should stay as the Rehab Czar to oversee the culmination of his pet project. And, for the rest of us, all we can say is – “let’s just wait and see.”

watched broadcast colleague Karen Davila’s “Headstart” Program on TFC on her very enlightening interview with Rehab Czar Panfilo Lacson.

During the interview, Ms. Davila asked Mr. Lacson on the update of his “Yolanda” rehabilitation program.

In response to her query, Senator Lacson was happy to report that he has recently sub-mitted a P 170.9 Billion Com-

Ironically, the current constitution was enacted in 1987 under his mother Corazon, who led the revolution against Marcos and then served a single term as president be-fore enthusiastically standing aside.

Asked about a possible second term should the Charter change allow it, Aquino said he would listen to his “bosses,” the people, although he qualified that this did not automatically mean he would heed their clamor for an-other term. In your eighties, you’re surprised that you’re still alive when you wake up in the morning. But thanks to Jesus, who died for our sins, we can look forward to going to heaven after we die! He has given us the gift of eternal life. I hope Robin Williams, the comic genius of Mork & Mindy, Mrs. DoubtFire & BirdCage, who killed himself yesterday at 63, has found peace and happiness with Jesus in heaven for eternity.

Let’s look at two clients who are in different age groups:

Client is 45 years old and makes a gross of $100,000 a year as a registered nurse. She has student loans of $60,000, which she pays $700 monthly. She is a single mom with a daughter who is a sophomore in high school, and a son who is in middle school. They both attend private school for which she pays $1,000 monthly. She owns a house with a mortgage payment of $3,100, and a 2nd mortgage payment of $1,000. Her house is worth $700,000 and has enough equity to cover both mort-gages. Her credit card debt is $80,000. Her former husband agreed to pay for half of the credit cards, but never did so. So, she pays $2,300 a month to keep $80,000 of credit card debt current. She pays a car loan of $600 for a 2008 Lexus SUV 3.3.

Despite her good income of $100,000 a year, client is in bad shape financially. Her net take home pay is $7,000 monthly but her payments for the aforementioned student loans, private school, two mort-gages, credit cards and car payments is already $8,400. So, even at this point, she is short $1,400 without considering food, gas and other necessities.

Client will do a Chapter 7 to discharge $80,000 of credit card debt, thus saving $2,300 a month. She will keep the Lexus the payments of which will end this year, thus saving another $600 a month. She can still save another $1,000 monthly if she decides to transfer her two children to public school. But that’s her decision to make. With bankruptcy she will keep her house, her car and her retirement account and everything else that she owns but she

will discharge all of her unsecured debt, other than her student loans, thus giving her a fresh start in life, and giving her the ability to save for her children’s college expenses and her retirement in the future. With cautious and wise portfolio investing, client will have close to $1.0 M in her hands in less than 20 years based on annual compound growth even at 6%.

With a bankruptcy fresh start with no debt to drag her down, this client will be-come a very productive individual again.

Client is 59 years old. His wife is 55 years old. They have no children. He makes $2,500 a month. She used to make $1,500 a month as a caregiver but lost her job last month. Together, they owe $40,000 of credit card debt. They still pay $1,200 a month to keep the cards current. They have had these cards for the last 15 years and each month they pay at least $1,000. fore landing on the concrete floor.Ms. Doe sustained devastating injuries

to her spinal cord and a ruptured tendon to her ankle. After two surgeries, her mobility was still limited and she continued to suffer nerve pain, muscle spasms, and weakness. Because of her injuries and limitations, Ms. Doe cannot go back to work.

Ms. Doe sued the garage owner for Building Code violations. She also sued the parking company for negligence in parking

her car in such dangerous conditions and failing to warn her about these conditions. The parties settled before trial and Ms. Doe recovered $6.5 million in damages.

Despite passage of stricter Building Code regulations, some building owners fail to comply with them. Serious accidents such as described above continue to occur. The resulting injuries severely impact the lives of the injured persons and their fami-lies. The injured will require prolonged

medical treatments, and they may be un-able to work.

However, just because someone is hurt from a fall does not mean building owners are automatically liable. It must be shown that the accident was caused by a danger-ous condition in the premises. The building owners will obviously not admit fault. As a result, getting compensation for the injured becomes an adversarial process.

SACRAMENTO, CA – The Califor-nia Applicants’ Attorneys Association (CAAA), whose members represent Californians hurt at work, today joined the California Nurses Association (C.N.A.) in calling for elimination of gender bias against female first responders in Cali-fornia workers compensation insurance through passage of AB 2616 (Skinner).

“California recognizes that some jobs are so inherently dangerous that those workers should not have to prove that certain injuries were job related,” said CAAA Women’s Caucus Co-Chair Chris-tel Schoenfelder. “First responders like firefighters and police officers who are re-quired to protect the public are presumed to be injured on the job when they get cancer or an infectious disease.

There is one group of first responders who do not receive this protection from dangerous conditions. These are hospital employees, 80% of whom are female. Like police officers and firefighters, they are routinely exposed to conditions that can lead to major health problems.”

AB 2616 intends to correct this gender imbalance by extending part of one of the fifteen exemptions that men enjoy – for MRSA skin infections, which are a major health problem in hospitals around the world.

“Nurses and other hospital employees are required to assume great risk, but unlike public safety officers we are not given the same legal protections when we get sick on the job,” said Redding Registered Nurse Kathryn Donahue, who traveled to the State Capitol to urge passage of AB 2616.

“MRSA is a virulent antibiotic-resistant staph infection. It’s a job hazard for nurses providing direct patient care in acute care hospitals. MRSA can kill you. Just like police officers and firefighters, nurses put our lives on the line every day. We don’t know if the patient we are treating has HIV, or MRSA, that we could be exposed to. We just do our job.”

One out of every six deaths in the US can be attributed to an infection acquired in a hospital. A first responder has an

obligation to perform their duties in an emergency.

Female workers are often forced to tes-tify to personal details of their lives in an effort to deny claims. As female workers experience this, it has a chilling effect on the willingness of other female workers to come forth with their claims.

“If nurses or other hospital workers who provide direct patient care get MRSA, we have to prove that it didn’t come from any place but my work,” said Donahue.

“That’s an almost impossible burden to meet. It exposes nurses to invasive ques-tioning about our personal lives – even our sexual lives – by insurers’ defense attorneys trying to defeat our claim for medical care and disability compensation.”

Schoenfelder said, “The lack of equal protection for health care workers is, in part, due to gender inequity. Public safety first responders are a predominantly male workforce, but hospital employees are a predominantly female workforce. The La-bor Code currently provides 15 categories of presumptions for various first respond-ers, and all of them are for male dominated workforces. There is not one presumption for first responders like nurses, which is primarily a female workforce. AB 2616 is intends to correct this gender imbalance by extending part of one of the fifteen exemptions that men enjoy – for MRSA skin infections, which are a major health problem in hospitals around the world.”

AB 2616 is in the Senate Appropriations Committee, and may be heard on August 14.

looked shocked and confused as we sorted through all the credit card statements on my desk and added up how much he owed. $65,000! That’s how much the statements said he owed!

How could this be? He said he remembered paying a lot of these debts off just a few years ago. When I asked him how it was possible for him to owe that much again, he replied:

MANILA, Aug 15 (Mabuhay) – Senate Minority Leader Juan Ponce Enrile had other projects supposedly implemented by dubious non-government organizations but which were not covered in the plunder and graft charges filed against him, a Commis-sion on Audit official said Friday.

Taking the witness stand, COA assistant commissioner Susan Garcia, who headed the special audit of the Priority Develop-ment Assistance Fund (PDAF) released from 2007 to 2009, said the present case of Enrile only covers 14 projects with six NGOs associated with alleged pork barrel scam brains Janet Lim-Napoles.

“Enrile has other projects and NGOs not covered in this case,” Garcia told the Sandi-ganbayan Third Division while identifying the documents they sent to Enrile for the confirmation of his and his representatives’ signatures.

One of such was the Pangkabuhayan Foundation which was one of the NGOs that was part of the P25 million fund re-leased from Enrile’s PDAF. Garcia, how-

ever, was not able to expound on the matter. Napoles’ lawyer Stephen David said

Garcia’s statement proved that there were other NGOs involved in the supposed pork barrel scam but not included in the cases.

“That will prove that my client is not the pork barrel queen,” he said.

The COA sent two letters to Enrile to ask for the confirmation of the documents they gathered during the special audit. The first one was sent July 8, 2011 and a follow-up letter sent on Feb. 28, 2012.

COA attached to the two letter the documents submitted by Enrile’s office in connection with his PDAF requests and releases.

Enrile finally answered on March 21, 2012, confirming the authenticity of his signature and that of his respresentatives, then chief of staff, lawyer Gigi Reyes, and deputy chief of staff, Jose Antonio Evan-gelista, in the documents.

Reyes is also a co-accused in the plun-der and graft cases against Enrile. She is detained at Camp Bagong Diwa in Taguig.

down your score, you can get them fixed, just in time for your much-anticipated loan closing.

One way is called rapid rescoring, a practice to help lift clients’ scores to qualify for better loans, allows borrowers to get accurate information updated into credit files within a few days, rather than waiting weeks or months for the credit bureaus to do it on their own.

That faster timetable could save you

thousands of dollars on your loan. Raising someone’s middle FICO score from 699 to 720, for example, will save them 1.25% in fees. In our residential mortgage practice, we frequently do rescores for borrowers. The cost is minimal, and the improvement in mortgage pricing is very significant. ITs good to always be prepared and know what your scores are.

When you’re in a tight lending en-vironment, every single point counts.

That’s especially true, if you have a low to soso credit score and are hoping to take advantage of today’s record-low interest rates. It’s hard to qualify for a loan, but if you qualify, the rates are still all time lows and doing your homework to get better fico scores will be worth your while.

How rapid rescoring worksA rapid rescore is essentially an unof-

ficial updating of the credit file. For example, if you pull your credit

reports and see that there are legitimate errors on them that are pulling down your credit score, a rapid rescore can help you get those errors corrected much faster than if you tried to dispute them yourself.

If you try to do it yourself by doing a dispute directly with the bureaus, then they have 30 -45 days, technically, to in-vestigate the dispute and get back to you with an answer.

However, if you have a rapid rescoring service get the errors corrected for you, they’ll provide proof to the credit reporting agencies that the errors are bogus and have your credit score recalculated to reflect the changes, usually within a few days.

Your mortgage broker may also rec-ommend a rapid rescore if you have high balances on your credit cards and just need to add a handful of points to your score to get the loan you want. “Loan officers have access to something called a ‘what-if’ simulator. “A what-if simulation is basically a mathematical model that the mortgage companies work with to say, ‘What if they paid off their credit card?’” or “What if they can remove the account past due reporting?”

If a loan officer sees that you can boost your score by enough points to qualify for a lower-interest loan, he or she may ask you to pay down your credit cards to below 30% of your credit limit and have you print out proof of your new balance. Usually, it’s good to keep your usage of your revolv-ing credit cards to a maximum of 40% of allowable limit.

That information will then be expedited

to the credit reporting agencies so they can update your file without waiting for the credit card issuer to report your updated information. There are some credit cards that report to the bureaus at the beginning of the month, some at the end of the month, some only every other month. By doing a rapid rescore, we can get that information corrected within three business days.

Rapid rescoring is not credit repairRapid rescoring is not a form of credit

repair – an industry whose bad apples promise, illegally, to erase accurate nega-tive information from consumers’ credit reports.

Rapid rescoring should only be done through a mortgage broker or lender. I’d be a little surprise actually of anything that offered a rapid rescore directly to the bor-rower. Typically, a rescore costs between $25 and $30 per bureau on each account..

It’s also important to remember that the only information you can dispute is inac-curate information, there is no magic in this. It’s purely mathematical information given to bureaus and creditors. What I find is when somebody’s got a low credit score, they have lots of excuses for why this [negative information] is on their report,. However, you can’t explain away accurate blemishes, such as missed credit card payments.

Nor can you make them magically dis-appear. A lot of people don’t realize that. They will pay off a delinquent account and expect it to fall off their report. However, it doesn’t work that way. When it comes to negative but accurate information, all you can do is wait up to seven years for the negative information to disappear. Time will heal and establishing better paying habits too.

The good news is if your complaint is legitimate, you have a good chance of get-ting it rescored when you need.

WASHINGTON, August 12, 2014 (AFP) – The number of US job open-ings hit a 13-year high in June and more workers quit their jobs, pointing to a tightening labor market, Labor Depart-ment data showed Tuesday.

Nonfarm job openings in the private and public sectors rose to 4.7 million on the last business day of June, from 4.6 million in May.

That was the largest number of open-ings since February 2001, and increases were seen across the entire country. Job openings have trended upward since Jan-uary by an average of 159,000 a month.

In June, the ratio of openings to em-ployment rose a tenth point to 3.3 per-cent, according to the department’s Job Openings and Labor Turnover (JOLTS) report.

A total of 2.53 million people quit a job in June, up from 2.49 million in May. Quits generally indicate workers’ willingness or ability to leave jobs, a positive sign for the labor market.

But the quit rate stood at 1.8 percent of total employment for the fifth consecu-tive month in June.

Total separations, or turnover, which includes quits, layoffs, discharges and other forms of separations, such as retire-

ment and disability, rose to 4.55 million in June from 4.53 million in May.

Hiring meanwhile increased by 92,000 jobs to 4.83 million.

“Quits are creeping higher, though like hires, they are not back to where they were prior to the start of the Great Recession,” said Marisa Di Natale of Moody’s Analytics.

The JOLTS report added fresh evi-dence of a firming labor market. Initial unemployment claims, a sign of the pace of layoffs, have trended lower, bringing the four-week moving average to its low-est level since February 2006.

The US economy has added more than 200,000 jobs per month from February through July, the first time since 1997 the economy has generated that many for six months straight.

The Federal Reserve says that despite the sharp fall in the unemployment rate to 6.2 percent, there remains significant slack that has left far too many Ameri-cans without jobs.

Fed Chair Janet Yellen, in testimony to Congress in mid-July, said the central bank could hike its key interest rate sooner than the current forecast for the second half of 2015 if the job market continues to make solid improvement.

The heightened standard with regard to transactions between spouses is codified in Family Code Sec. 721(b). The section provides that “in transactions between themselves, a husband and wife are subject to the general rules governing fiduciary relationships which control the actions of persons occupying confidential relations with each other. This confidential relation-ship imposes a duty of the highest good faith and fair dealing on each spouse, and neither shall take any unfair advantage of the other.”

Incidental to this fiduciary relation-ship is a rebuttable presumption of undue

influence when one spouse obtains an advantage over the other in a community property transaction – i.e. when one spouse improves his/her position, obtains a fa-vorable opportunity, or otherwise gains, benefits or profits in a community property transaction to the exclusion of the other. Marriage of Haines (1995) 33 CA4th 277, 297, 39 CR2d 673, 686. This presumption arises in connection with any interspousal property transaction in which one spouse obtained an advantage over the other. It is important to note that the presumption arises even if the transaction at issue did not result from fraud, deceit or coercion.

Marriage of Mathews (2005) 133 CA4th 624, 629-630, 35 CR3d 1, 4.

The spouse favored by such a trans-action has the burden of rebutting the presumption of undue influenc e. To rebut the presumption, he/she must show that the other spouse entered into the trans-action freely and voluntarily, with full knowledge of all the facts, and with a complete understanding of its effect. Mar-riage of Delaney (2003) 111 CA4th 991, 996-997, 4 CR3d 378, 382. If the spouse who benefited from the transaction fails to demonstrate the foregoing, the transaction may be ignored. MANILA, August 14, 2014 (AFP) – Three Filipino men have been detained after confessing to dumping the bodies of a missing Japanese man and his Filipina girlfriend at sea, the justice department said Thursday.

The men disposed of the bodies of Japanese businessman Yuji Okada and his girlfriend in early July on the orders of a Filipino suspect who remains at large, the department’s National Bureau of Investi-gation said.

The men initially buried the bodies on a sandy riverbank east of Manila, but later dug them up after a stray dog disturbed the site, said senior investigator Joel Tovera.

“They loaded the bodies on a boat and

sailed to Polillo island, where the by then bloated bodies were strapped to sandbags and dropped into the water,” he told a news conference. Okada and his girlfriend are still registered as missing as no bodies have been found, Tovera added.

The Japanese embassy in Manila could not be reached for comment late Thursday.

The grisly confessions came a day after the South Korean embassy in Manila ex-pressed alarm at a rise in crimes against its nationals in the Philippines, citing the kill-ing of nine South Koreans this year alone.

Tovera said the authorities are looking for a total of four Filipino suspects, in ad-dition to those already arrested over the couple’s disappearance.

Army general and kidnapping suspect Jovito Palparan, Malacañang on Tuesday assured that other high-profile fugitives are also being pursued.

At a press briefing, Communications Secretary Herminio Coloma Jr. said the government is determined to bring to justice high-profile suspects who remain at large.

“Ang pagkadakip kay dating Heneral Jovito Palparan ay magbibi-gay daan upang siya ay sumailalim sa mga proseso ng katarungan sa ilalim ng batas. Patuloy na sinisikap ng ating mga alagad ng batas na tugisin at mahuli ang iba pang pinaghahanap ng batas – ‘yung mga high-profile suspect,” Coloma told reporters.

“Patuloy din ‘yung pagkilos ng ating mga alagad ng batas para sila ay matunton at mapanagot,” he added.

Palparan, one of the country’s so-called “Big 5” fugitives, was nabbed in Manila earlier in the day by agents of the National Bureau of Investigation (NBI) and the Armed Forces.

The retired general is facing two counts of kidnapping and serious illegal detention before a Bulacan court for the alleged abduction of University of the Philippines students Sherlyn Cadapan and Karen Empeño.

Among the so-called “Big 5” fugitives, former Palawan Gov. Joel Reyes and his brother Mario Reyes and Dinagat Rep. Ruben Ecleo remain at large.

Already arrested earlier this year are businessman Delfin Lee, who is facing a P6.6-billion syndicated estafa case, and suspected communist leader Benito Tiamzon and his wife, Wilma.

Human rights violations At the same press briefing, Coloma stressed that the President re-

mains committed to addressing human rights violations in the country. “Matibay ang determinasyon ng ating Pangulo na iharap sa hu-

kuman at panagutin ang mga mayroong usapin sa paglabag ng mga karapatang pantao at sa paglabag ng batas,” the Palace official said.

He added that more than just going after fugitives, the administra-tion wants a stronger criminal justice system.

“Sa kabuuan, ang pinaka-layunin ng ating pamahalaan ay palaka-sin ang buong criminal justice system, pahusayin ang kapasidad ng kapulisan at ng iba pang mga law enforcement agencies, unang-una, para mapigilan mismo ‘yung pagganap ng krimen,” he said.

He added,“Dahil kapag naganap na ay meron nang buhay na nakuha, meron nang krimen na naganap laban sa kaligtasan ng mga mamamayan, kaya ‘yung buong sistema ang tinitingnan diyan, hindi lang naman ‘yung paghuli sa mga so-called high-profile suspects.”

Progressive human rights group Karapatan earlier said that it has recorded at least 192 cases of extrajudicial killings under the Aquino administration.

During US President Barack Obama’s visit to the Philippines last April, Aquino defended his administration’s human rights record.

He said the government has been taking steps to address incidents of extrajudicial killings and forced disappearances in the Philippines, including the forming of an inter-agency committee to look into these cases.

The President also earlier said that out of the 62 suspected cases of extralegal killings reported to the committee, only 10 met the criteria of what constitutes an extrajudicial killing, and only one happened under his watch. (MNS)

MANILA, Aug 13 (Mabuhay) -– There is noth-ing wrong with having a Disbursement Acceleration Program-like mechanism, Malacañang insisted on Wednesday.

In the first place, “DAP is constitutional,” accord-ing to Presidential Spokesperson Edwin Lacierda.

“Let’s lay the groundwork. DAP is constitutional, only certain acts were declared (as) not in keeping with the Constitution,” he said during a Palace press briefing. Lacierda was reacting to the signature campaign of anti-pork groups, which will culminate in a rally on August 25.

Monet Silvestre, #AbolishPork spokesperson, accused President Benigno Aquino III of attempting to institutionalize the DAP and maintain “congres-sional pork” or mechanisms similar to the Priority Development Assistance Fund (PDAF).

But Lacierda said there was nothing wrong in making the unconstitutional aspects of the DAP constitutional.

He said the problem only lies in how the execu-

tive branch interpreted savings.“So what’s wrong with redefining our savings to

make Congress also agree with it? Nobody has ques-tioned the beneficial effects,” Lacierda explained. “We know already how the Supreme Court defines it, so let’s find a way to make it constitutional, and that’s what we’re doing.”

The spokesperson also pointed out that doing away with lump sum funds was “impossible.

“For instance, you cannot define with exactitude the amount that you’re going to identify to a particu-lar storm or particular natural calamity. These things are force majeure (superior force) and we (can) only provide a fund for that,” he said.

“If you’re asking people to just say ‘put a bud-get, strict budget, for that – for this and that – for a particular natural calamity,’ that is an impossibility,” he said of the contingent funds.

Lacierda said even those critical of the lump sum funds know that funds allotted for calamities cannot be broken down into specific amounts. (MNS)

Palace to other high-profi le fugitives: We’re coming after you too

MANILA, Aug 13 (Mabuhay) – The govern-ment is confident that delays in the crafting of the Bangsamoro Basic Law will not raise tensions on the ground, and that there will still be time for a plesbiscite even if the law is passed early next year.

At a press briefing on Wednesday, presidential spokesman Edwin Lacierda said members of the 12,000-strong Moro Islamic Liberation Front (MILF) are aware that its peace panel and the gov-ernment are working toward a mutually acceptable bill.

“The MILF is also familiar that both parties are working steadfastly on making sure that the Bangsamoro Basic Law will be submitted to Con-gress,” he said.

He added that the government is optimistic that the draft law will be finished and ready for submis-sion to President Benigno Aquino III by August 18, as earlier committed by the peace panels.

“That is something that we’re working on and we certainly would like to see an agreement that we can submit it already before the Congress,” he said.

The Palace official further maintained that it is “still possible” to conduct a plebiscite and form the Bangsamoro Transition Authority – the interim ministerial government of the proposed new political entity – even if the basic law is passed during the first quarter of 2015.

Over the weekend, the peace panels “reached agreement on substantial versions” of the draft Bangsamoro Basic Law, which seeks to create a new political entity to replace the Autonomous Region in Muslim Mindanao.

The crafting of the bill has been stalled over the past weeks after Aquino’s legal team allegedly made changes to the draft submitted by the Bangsamoro Transition Commission.

The Bangsamoro Basic Law will embody the comprehensive peace agreement signed last March by the MILF and the government, aiming to end the decades-long armed conflict in Mindanao.

MILF chief negotiator Mohagher Iqbal earlier said that his group will “do everything possible” to ensure that the peace accord is implemented. (MNS)

came the latest country to declare a national emer-gency over the deadly Ebola virus on Friday, as the World Health Organisation called the epidemic that has claimed nearly 1,000 lives a global health crisis.

The WHO appealed for international aid to help afflicted countries after a rare meeting of the UN health body’s emergency committee, which urged screening of all people flying out of the affected countries in west Africa.

It stopped short of calling for global travel restric-tions, urging airlines to take strict precautions but to continue flying to the west African countries hit by the outbreak.

And it called on countries around the globe to be prepared to “detect, investigate and manage” Ebola cases if they should arise.

WHO director-general Dr Margaret Chan ap-pealed for greater help for those worst hit by the “largest, most severe and most complex outbreak in the nearly four-decade history of this disease”.

“I am declaring the current outbreak a public health emergency of international concern,” Chan said, warning of the “serious and unusual nature of the outbreak and the potential for further inter-national spread”. States of emergency had already been declared in the hardest hit countries of Guinea, Liberia and Sierra Leone. Nigeria became the lat-est on Friday. Two people have died there and five others have been infected.

President Goodluck Jonathan ordered the im-mediate release of 1.9 billion naira ($11.67 million) to fund the fight against the disease, and urged the population to avoid large gatherings.

The Ivory Coast, which neighbours Guinea and

Liberia, said it was declaring a “very high” level of alert, while Benin is also investigating a suspect patient.

ArcelorMittal said it had halted work to expand its iron ore mines in Liberia after staff were evacu-ated due to concerns over the epidemic.

In the first European case, Spain is treating an elderly priest who contracted the disease while help-ing patients in Liberia.

‘Out of control’Defining the epidemic a public health emergency

of international concern – a label only used twice before, during the H1N1 swine flu pandemic in 2009 and last May for the reemergence of polio – “alerts the world to the need for high vigilance,” Chan said.

The Doctors Without Borders (MSF) charity, which has warned the virus is “out of control”, hailed the move, but said there needed to be immediate action on the ground.

“Lives are being lost because the response is too slow,” said head of operations Bart Janssens.

Ebola had by Wednesday claimed at least 961 lives and infected nearly 1,800 people since break-ing out in Guinea earlier this year, with 29 people dying in just two days, the WHO said.

“The likelihood is that it will get worse before it gets better,” WHO health security chief Keiji Fukuda said, with the outbreak likely to last for months.

In Liberia, soldiers in Grand Cape Mount prov-ince – one of the worst-affected areas – have set up road blocks to limit travel to the capital Monrovia, as bodies reportedly lay unburied in the streets.

In Sierra Leone, which has the most confirmed infections, 800 troops were sent to guard hospitals treating Ebola patients. Two towns in the east were put under quarantine.

held today or this month, Binay will win it by a big margin against anybody, includ-ing Mar Roxas, the presumptuous LP presidential bet. Latest opinion polls for the 2016 presidential election show that Roxas is too far behind Binay.

Binay started his political career as an appointed mayor of Makati after the 1986 Edsa revolution. He became one of Presi-dent Cory’s first appointed local officials or OIC (officer-in-charge). Old timers in Makati are saying that he got his appoint-ment as a gift from former Senator Joker Arroyo, whom he financially helped during the martial law days. Arroyo was then the executive secretary of President Cory.

Binay has always been a Cory loyalist.The administration party of President B. S. Aquino are exploring all options on how they could hang on to their powers. From tinkering the constitution to extend Nonoy’s term limit to having Roxas as Binay’s running mate in the 2016 presi-dential election.

Speaking of extending his term, the latest statement issued by President Nonoy must have jolted the opposition. Even DILG Secretary Mar Roxas is ame-nable to the plan of their administration allies to amend the 1986 constitution.The president statement regarding term limit extension runs counter to his previ-ous statements his has given several times

that he is against tinkering with the 1986 constitution which was promulgated during his mother’ term.

I do not believe that Noynoy has any plans of extending his term or running for reelection. He is the type of a person that avoid long hours of hard work in his office. Everybody in the palace is saying that he would only work, at the most from 9 a.m. to 4 p.m. , and then start his drinking ses-sions with his KKK buddies.

I think this latest ploy of Nonoy allies regarding extension of term limits is a ploy to give Roxas sufficient time to improve his poor standing in opinion polls. The statement of Roxas given to a radio inter-view stating that there is a strong clamor for the president to seek reelection is pure HORSESHIT. He did not even say who are those people clamoring for Nonoy to extend his term by running again with Roxas as his running mate.

If there are really some people clamor-ing for the president to run again, these are his KKK buddies, his yellow ribbon party-mates as well as his LP “senatongs” and “tongcongressmen.”

I don’t think the Filipino people are that stupid to go along with the idea of Roxas.Right now, the most logical scenario for the LPs is to pair Roxas with Binay for him to at least have a chance to realize his goal of becoming president after Binay’s

term. That is of course if he wins the vice presidency. Then mission accomplished.

To guarantee a Roxas win as the next VP, the current administration must have practically demolished all vice presidential aspirants. Both Senators Jingoy Estrada and Bong Revilla and the ailing Sen. Juan Ponce Enrile are currently locked up in jail for their alleged involvement in the Priority Development Assistance Fund (PDAF) scam.

The administration will continue to persecute and demonize these two senators hoping that Jingoy and Revilla will eventu-ally lose their appeal to the voting public.Come 2016, it’s going to be a Binay-Roxas ticket. Binay will agree to have Roxas as his running mate. He has nothing to lose but everything to gain. Remember that politics is always about addition.

Aside from having an unlimited amount of funds for his presidential campaign, he will have both the support of the united opposition as well as the yellow party of Noynoy.

Even Noynoy’s two sisters, Balsy and Mega star Kris, stated their prefer-ence for Binay. The recent plunder and graft charges filed against Binay, his son and 21 others are mere political ploys to pressure Binay to enter into a secret politi-cal merger with the LP faction of Roxas.Binay knows that more charges and black ops are coming his way.

During his 2010 campaign for the vice presidency, he admitted having extra-

marital affair which almost caused him his marriage with his doctor wife. A picture of the woman circulated oin the Internet. Although the LP of Roxas denied having anything to do with the exposé, everyone knows that they did it to salvage whatever little hope they had of winning the vice presidency from Binay.

I know Binay is onion-skinned. He wants his good image preserved. He will do what is best for his political career. His daughter is a senator, son is Makati mayor and another daughter is a congresswoman of the 2nd district of Makati. He will try his best to shield them from any black propaganda.

Eventually, he will ultimately merge with the LP and be their presidential bet guest candidate. Roxas knows deep in his heart he has no chance against Binay. His best bet is just to run for vice president.But wait. What if Jingoy Estrada persists in running for the VP slot and remains to be in the top spot in surveys despite the PDAF scam? If that happens, this is when you see Senator Franklin “Big Boy” Drilon and Butch “The Bagman” Abad get into the act. In that case, then it’s going to be a Binay/Kris tandem. Say what?

ear nowadays. Reports have it from political sources that the LP hierarchy is inclined to adopt Binay as their presidential candidate. The camp of DiLG Secetary Roxas however were quick to deny that there is no such move being initiated by LP bigwigs.

Binay, although not con-sidered to be a hardcore op-position, is the sure bet of the United Nationalist Alliance. If the presidential election is to be

He noted Trillanes even promised to present witnesses against his father.

“May we remind the senator that this is not a trial. It is supposed to be a hearing in aid of legislation,” he said.

Binay added the hearings are already unnecessary since there is already an of-ficial audit report.

“The allegations have already been discredited as baseless by an intensive review made by Commission on Audit in response to a request made by the complainants.

“The Ombudsman has already asked the parties to comment. This means that the investigation process has started. A Senate inquiry would therefore be un-necessary,” he said.

He reiterated the building is not a park-ing building but one that houses offices and parking floors. (MNS)

In large bowl, drizzle oil over vegetables; toss to coat well. Add seasoning mixture; toss to coat well.

Place vegetables in grill basket or rack, or thread onto skewers.

Mix oil, garlic powder and pepper in large bowl. Add broccoli and tomatoes; toss to coat well. Spread in single layer on foil-lined 15-by-10-by-1-inch baking pan.

Roast in oven 13–15 minutes or until broccoli is lightly browned.

Meanwhile, mix vinegar, honey, basil and oregano in small bowl. Drizzle over roasted vegetables aft er removing from oven; toss to coat well. Serve immediately.

(Relaxnews) – Researchers at the Uni-versity of Lincoln took an interest in what they call “lucid dreamers,” those who actually know they are dreaming while the dreams play out. In the first empirical study on the subject, they found such people to exhibit better problem solving abilities in their day-to-day lives.

Lucid dreaming is not a new concept, al-though it sparked interest upon the release of the 2010 film “Inception,” in which dreamers were able to discern incongruities in the scenario of their dreams.

The film suggested that such an ability

indicates superior levels of insight, with dreamers realizing they are not in reality because things don’t make sense.

“It is believed that for dreamers to be-come lucid while asleep, they must see past the overwhelming reality of their dream state, and recognize that they are dream-ing,” says Dr. Patrick Bourke, Senior Lec-turer at the Lincoln School of Psychology. “The same cognitive ability was found to be demonstrated while awake by a person’s ability to think in a different way when it comes to solving problems.”

Problems contained three words and a solution word and the participants were tasked with linking the solution word to the others with the intent of create a com-pound word.

For example, the words ‘sand,’ ‘mile’ and ‘age’ could be linked with the word ‘stone.’

Participants had self-reported varying levels of lucid dreaming upon selection and results showed that frequent lucid dreamers were able to solve 25 percent more of the

word problems.The study was published in the Ameri-

can Psychological Association’s journal, Dreaming.

Thursday (7/17/14) – As guests started arriving in Mendocino Coast, California, welcome bags greeted them at their respective rooms. Bride and groom personally dropped off bags at hotels and inns where guests decided to book their stay for the weekend. Bags were made in the Philippines, designed by the couple. The “Keep Calm” phrase on the flap was to pay homage to Lester’s English heritage. Each bag came with scrolled personalized notes explaining the significance of the items – pencil sharpeners in the shape of the distinctive London red bus and red tele-phone stations; pencil from the couple’s favorite boutique hotel in South Kensington; loose tea leaves in tin cans that

d e p i c t p h o -tos o f tourist spots in England; coffee bags from Cavite. Philippines; and a jar of locally-made lemon curd from Mendocino, CA. There was also a personalized newslet-ter designed by Krystal Menez. It that had information about the tour that was to take place the following day.

Friday (7/18/14) – At the suggestion of their wedding coordinator, Rocio Nuyda, the couple hired a vintage trolley from the Mendocino Transport Authority, to tour their guests

around the quaint town. The trolley is normally used as public transportation in the area. But the couple hired it for the day, to introduce their guests to famous film location sites (Murder She Wrote, Dying Young, Overboard); the Mendocino headlands; Cabrillo lighthouse; Noyo Harbor; Main Street in downtown Fort Bragg; and the world-famous Botanical Garden

arrived at St. Anthony’s Church in Mendocino at 12:30p.m., for the rehearsal. Jannelle walked in wearing a white gown, designed by Carlyn Nuyda Calloway, for her BHLDN bridal collection that is yet to be launched. She also designed Jannelle’s headpiece, to match the gown.

After the rehearsal, reception followed at one of the vacation rental homes managed by Men-

docino Coast Reservations. The Bay House was the place that Jannelle and Lester first stayed at when they visited Mendocino for the first time in October 2013, at the invitation of Ligaya and Richard Sublett who owned MCR at the time.

The rehearsal reception had an English flavor, as it was hosted by Lester’s family who flew all the way from their hometown, Stratford-Upon-Avon.

The family prepared English finger foods and salads and decorated the place with Union Jack flags, along with a wall of photos documenting Lester’s life from childhood.

At the end of the reception, the couple distributed presents to members of the wedding party. Principal spon-sors received a person-alized Tiffany harmony bowl. Secondary spon-sors received a marble cheese serving set.

Sunday (7/20/14) – The wedding was scheduled for 3:00p.m.; but started a little bit late because the bride, accompanied by her matron of honor, had to go back to the house

The dress is inspired from the traditional Filipiniana terno with a modern approach. The lace is French lace acquired from a purveyor of fine lace; which was enhanced with hand made glass beading that sparkled to the touch of sunlight giving it a dreamy silhouette. This one in particular was from the House of Sophie Halette, whose intricate creations have been made into some of the most memorable gowns including Princess Kate Middleton’s wedding gown.

Ms. So’s petite frame called for a silhou-ette that did not overpower her, so I created a modified trumpet skirt gown with an empire waist line. The plissé detail at the empire waist was done in silk gossamer and the butterfly sleeves was a miniature version that complemented the bride’s dainty frame. Left unlined it showcased the delicate lacework; a design deviation from the usual.

Embroidered in silver silk thread with the finest beadwork, the two layer cathedral veil crowned the bride’s head along with a custom hair embellish-ment fashioned and patterned into the shape of the flowers from her lace. or something old and borrowed, the bride wore a 1930s Vintage Art Deco bandeau diadem which she wore as a headband; a piece from Thumbelina’s rare collection.

Little added details included a blue flower sewn into her gown for something blue. tion in Manila worsening and inspections by the Department of Homeland Security in US ports continuing, the delivery of balikbayan boxes will continue to experience delays of at least two weeks, a senior official of the Philippine American Shippers Association said on Monday.

“There is just no way balikbayan box deliveries could be delivered in the same time period as before the DHS inspections and port congestion,” said Joel P. Longares, one of the founders and advisers of PASA, an LA-based organization of Filipino cargo forwarders in the United States.

Longares, who is president and CEO of Atlas Shippers International, said with the current conditions, the earliest a balikbayan box could reach its destination in Metro Ma-nila would be at least 45 days. For provincial deliveries, he said, it could take from 60 to 75 days.

“Balikbayan box senders should be wary of cargo companies promising no delays in deliveries,” he said. “In their desire to grab a piece of the action, these companies make promises that would be near impossible to fulfill. The reasons for the two- to three-week delay are definitely beyond the control of the cargo forwarders and any company say-ing it can deliver in 30 days is fooling the customers.”

Longares said the mandatory physical inspection of all balikbayan boxes by the DHS in the Ports of Los Angeles and Long Beach and other ports in the US results in delays because it takes another two to three weeks before the boxes can finally be loaded for shipping.

With the 21-day sailing time, it takes six weeks for the boxes to reach Philippine ports.

But the biggest problem now, Longares said, is the ongoing truck bans imposed by both the City of Manila and the Metro Ma-nila Development Authority (MMDA). The truck ban has resulted in massive backlog and congestion in both the Port of Manila and the Manila International Container Port. It has also extended the turnaround time of cargo trucks from the ports and back to three days, instead of the usual one day.

This has resulted in containers with the balikbayan boxes and other imported goods being stalled in the ports’ container yards and warehouses for another two to three weeks.

“The days of the 30-day delivery time from the senders’ door to the beneficiary’s door is gone,” Longares said. “The DHS and customs inspections may be around forever and it may take some time before the Manila and MMDA officials to realize their truck ban impositions are causing a big dent on the Phil-ippine economy, not to mention the troubles it is causing the balikbayan box industry.”

The PASA is appealing to the public for patience and understanding. Longares said the PASA is continually making represen-tations with the DHS officials to institute measures to expedite inspections, and with Manila and MMDA officials to remove or minimize the truck bans.

Longares said because of protests from business organizations, importers, exporters and logistics companies, Malacanang has promised to look into the problem while the Senate has vowed to conduct its own investigation to find ways to solve the nag-ging problem.

Since October, more than 57,000 unaccompanied minors have been detained crossing the US-Mexico border, about three-quarters of them from El Salvador, Guatemala and Honduras, Central American countries where youths are fl eeing poverty and gang violence, according to Agence France Presse.

SILVER SPRING, Md., Aug 10, 2014 – While children cross the border alone, their parents in the United States are going through intense anxiety – and the only thing they can do is pray to God to protect their kids along the journey.Each successful trip is God’s doing, according to many immigrant parents who are waiting on the other side of the Rio Grande, impatient and full of faith.“What I did was put her in the hands of God and God put angels along her path to bring my girl to me,” Salvadoran im-migrant Carmen Molina told El Pregonero recently, referring to the trip her daughter Valeria made nearly three years ago.Two journeys

Carmen left El Salvador 10 years ago, crossed through Guatemala and Mexico by bus and taxi, and then crossed the Rio Grande to come to the United States. She made the journey with her brother, guided by coyotes, and says that God took care of them along the way.The worst part of the trip, she says, was the journey on the infamous train known as “La Bestia” (The Beast), but she was saved from any harm inflicted by traf-fickers. “There are a lot of deaths on the train,” she says. “Some people lose limbs, immigrants are stripped of their clothes and robbed, women are raped….”After three dangerous weeks making the journey north, Carmen was arrested by immigration authorities. She decided not to appear in court, so she remained undocumented. She had left her family and her country behind, with the goal of working to help her family back home. “I cried every day for my 6-year-old and 10-year-old daughters, who I left in my mom’s care,” says the parishioner of the San Camilo Church in Silver Spring, Maryland.She tearfully recalled the moment she said goodbye, when her younger daughter told her, “‘Take me with you, Mom… I’m going to go with you and I won’t leave your side.’”Carmen remembers Valeria’s words and the expression on her little face. “They are painful moments you’ll never forget,” she says. Since she got here, she’s been working as a housecleaner and has always been able to send her money to her mother in El Salvador.Carmen wanted her older daughter to come to the United States, but she was too scared to make the journey. Her younger daughter, who was 13 years old at the time, kept saying that she wanted to see her mother. She was excited, brave and determined to undertake the adventure of crossing three countries.

Before making the decision, the desperate mother knelt down and prayed: “My God, help me. Bring me my daughters. I miss them so much, and I can’t stand the pain….”Carmen had already gotten married in the United States and couldn’t abandon her husband and her three daughters who were born here. If she returned to El Salvador, she wouldn’t be able to get back in the country.So, between a rock and a hard place, she chose to come up with $4,500 to pay a woman who had been recommended to her to guide her daughter across the borders.The trip

Valeria set out on the trek and the wom-an didn’t leave her alone for a moment. “I wasn’t that worried because my daugh-ter would call me along the way, and tell me where she was,” says the Salvadoran mother. But she admits that she became extremely anxious when it came time for her daughter to cross the river. “As they crossed the river, I spent the whole time on my knees asking God to help my daughter.”After Valeria made it across, she had one last challenge: getting past the Border Pa-trol. So Carmen kept doing the only thing she knew how to do: pray. She knelt down again to pray to God that the agent would only look at the woman’s papers… and that’s what happened. “They just looked at us and said, ‘Go ahead,’ says Valeria.Carmen recognizes her daughter’s courage and describes all of this as God’s work. “I’m happy that everything was OK and my daughter made it to my home in 22 days.”The day of the reunion was very emotional, says the mother, who went from feeling anxiety to being at peace. Her daughter ran to her and said: “Mommy, mommy, I got to see you again. I did it. I’m here with you.” Carmen was surprised to see how thin Valeria was. “She was so skinny that she didn’t even fit into size zero pants. I just felt her bones when she hugged me and I started to cry,” recalls the mother, who says she is now finally happy.

WASHINGTON, D.C. – The Filipino Community in the United States will now be able to listen to daily news updates from GMA Network, one of the largest broadcasters in the Philippines, as part of a public diplomacy initiative being undertaken by the Philippine Embassy in cooperation with AudioNow, the world’s leading call-to-listen platform.

The Embassy announced today that as part of its efforts to better serve the diaspora, it was able to convince GMA’s premier radio station, DZBB, to offer US-based Filipinos daily five-minute news headlines on any phone through a simple telephone call.

In a statement, the Embassy said GMA Network joins other industry leaders, such as Veritas 846 AM, the Catholic Media Network, and the People’s Television Network, as a part of a public diplomacy initiative to serve the Philippine diaspora in the US with greater access to media. The pioneering initiative also

PASADENA, Calif.—The Flintridge Center introduced the Real Change Move-ment donation meter program at a press conference held at Fuller Theological Seminary on Wednesday, August 13, 2014, from 11 a.m. to 11:45 a.m. The Mayor of Pasadena, Bill Bogaard, unveiled the first officially installed meter located at, and sponsored by, Fuller Theological Seminary, 180 North Oakland Avenue, Pasadena, CA 91101.

The Real Change Movement is a new initiative, the first of its kind in Los Angeles County, to help provide homes for the homeless with the small change and credit card donations made through uniquely designed meters. The bright orange eye-catching donation meters also feature a smiley face, a symbol of help and hope. “The Real Change Movement is not just about generating donations. It’s also about raising awareness about the issue of homelessness in our community and about changing the perception and attitude of the public. That’s why we have launched a comprehensive public education cam-

paign,” said Jaylene Moseley, the President of Flintridge Center.

Through the meter program, 100% of donations received will be distributed to various service providers that work with the homeless. Donations can also be made via the website at www.realchangemove-ment.org.

The United Way of Greater Los Ange-les, through the Home For Good Funders Collaborative, will leverage the contribu-tions to maximize their use.

For all permanent resident applica-tions Canada Immigration locks in the age of a dependent child at the date that CIC receives a complete application for permanent residence. A complete applica-tion is one that is made in writing using the form provided by the Department, signed by the applicant, including all information and documentation required including processing fees.

• Refugee protection: For the purposes of determining whether a child is a depen-dent child, the lock-in date for the age of a child of a person who has submitted a claim for refugee protection inside Canada under subsection 99(3) of the Act, who has acquired protected person status and who has made an application for permanent residence is the date on which the claim for refugee protection was made.

Eddie Marquez, Southern California Edison’s (SCE) Local Public Affairs region manager, presented a certificate of procla-mation to Buena Park as a “Powerful City” in recognition of the city’s commitment to electrical safety awareness.

The “Powerful City” campaign aims to engage residents and businesses in cities with large Asian-American com-munities and provide helpful safety and emergency preparedness information in different Asian languages. The pilot for the campaign kicked off earlier this year in Monterey Park, and Buena Park was selected as a “Powerful City” particularly due to its fast-growing Korean population and flourishing business community.

“We’ve identified several events throughout the year where we can partner with the city and our community partners to promote public safety,” said Marquez. “The most important message we want to share is safety around electricity. If you see a downed power line, stay away and call 911. When in doubt, call SCE at 1-800-611-1911. We are available 24/7.”

SCE is partnering with Buena Park and two community organizations – the Korean Community Services and Orange County Asian and Pacific Islander Community

Alliance – to increase awareness about electrical safety and encourage residents to take the safety pledge at different out-reach events. Korean American Chamber of Commerce of Orange County and West Orange County Regional Chamber of Commerce are also providing their support to promote electrical safety.

At the outreach events, families and residents can play games, learn about elec-trical safety and receive a free SCE Electri-cal Safety Starter Kit. he and singer Zsa Zsa Padilla have yet to talk about settling down, renowned archi-tect Conrad Onglao revealed that it has been his dream to re-marry and to hold a grand wedding in Florence, Italy.

Onglao said: “I find that city very romantic. There’s that hotel in Fiesole Farea, there’s a hotel there called Villa San Michele. It’s an old hotel with the altar designed by Michelangelo… For me, the whole Tuscan area is very romantic, it’s just a fantasy, this dream wedding of mine, whether it will happen or not.”

Onglao said he never lost faith in mar-riage despite his failed relationship with his first wife, interior designer Ivy Almario.

“Of course [I still believe in marriage]. Unfortunately, my first marriage didn’t last, but it doesn’t mean I no longer believe in marriage and it doesn’t mean I’m less of a father,” he said. “I know I’m going to get married someday, ever since when I divorced before pa, ang tagal na rin.”

Onglao and Almario have two sons. They were divorced in the United States and obtained a legal separation and church annulment here in the Philippines.

Padilla, on the other hand, was in a long-time relationship with Philippine Comedy King Dolphy, who died two years ago.

Asked if he thinks Padilla believes in marriage as well, he said: “Yes, she believes in marriage. She really believes in long-term relationships. I recall Sharon (Cuneta) told me that she stayed with Dol-phy for 25 years, that’s something.”

“A relationship has its ups and downs, but through thick and thin, Zsa Zsa stayed with Dolphy to his last breath — it says something about her. Zsa Zsa is a woman of substance, and she values relationships,” he added.

Now four months into their relation-ship, Onglao said he treasures what he and Padilla have because neither of them expected it.

“We get along pretty well. It’s an ef-fortless relationship. Being both artists, we understand each other. It was maybe

our third date, it was lunch, I felt light and comfortable. It was a feeling of familiarity that you can’t explain, you just feel good, it’s not expected,” he said.

When prodded if talks are true that he and Padilla plan to tie the knot this year or next year, the architect said: “It’s a matter of timing. It will just unfold… I have so many women friends who want to be my ‘best man’ at my wedding.”

At this point, Onglao said he just enjoys the company of the singer-actress.

“In the entertainment world, they call her the Divine Diva, but she really has no complex. Zsa Zsa will leave the house without makeup. She never says ‘no’ to people who ask to have their pictures taken with her. She helps people and she would never even tell me — that’s the measure of a good person,” he said. (MNS)

Miguel de Leon, the son of celebrity couple Christopher de Leon and Sandy Andolong, has been diagnosed with cancer.

In her official Instagram account, Andolong confirmed that Miguel is now battling testicular cancer. But the “Home Sweetie Home” star is hopeful that it can still be cured with chemotherapy.

“He had his first chemo early this eve-ning. He is still slightly sedated often which makes it hard to for us to find the right tim-ing to show him that we are beside him and to talk to him. But on the second day of our visit, he was a little lucid and the minute he heard my voice he reached for my hand to squeeze and I saw the most beautiful smile I’ve ever seen in him,” Andolong recalled.

“When it was my husband’s turn he was just so overwhelmed to see his tatay who kept kissing him and broke into tears with no sound but with so much relief and love not only on his part but ours as well,” she said. Andolong then extended her ap-preciation to their family and friends for their support during what she described as “the greatest challenge” they have to face as parents. “This recent adversity our fam-ily had to face made our faith in our good and merciful GOD extremely stronger, our love for each other immensely deeper,” Andolong wrote in the caption.

She also said they “wholeheartedly ac-cepted God’s test, hard as it may be, and placed our full and complete trust in Him!”

“Our faith never wavered or waned. Thanks be to God, which giveth us the victory through our Lord Jesus Christ,” Andolong said.

Based on Andolong’s posts, they are in San Francisco, although De Leon flew back to Manila. The veteran actor is part of Book 2 of the hit primetime series “Ikaw Lamang” with Kim Chiu and Coco Martin.(MNS)

American coach Thomas Dooley on Thurs-day kicked out a European-based mainstay of the Philippines’ national football team and left the future of two other players in doubt following a highly public social media spat.

Midfielder Stephan Schrock and fel-low mainstay Dennis Cagara declared on Twitter and Facebook this week they had played their last match under Dooley, amid speculation they were unhappy over a policy perceived to favour younger players.

Schrock got the boot, while the interna-tional careers of goalkeeper Neil Etheridge and left-back Cagara are in limbo after Dooley revealed neither was invited to the Azkals’ training camp for an invitational Peace Cup tournament in Manila next month.

Dooley accused them of being “selfish and putting themselves in front of every-thing”.

“If somebody does this it’s the worst thing that could happen to a team.... Even if the best player does something like this it kind of poisons the team, so we have to go against that,” Dooley told a news conference.

But the German-born coach reserved most of his venom for Schrock.

“You cannot have a player like this in the team. It makes a mess everywhere to me. So it’s clear to me: He’s not playing for me anymore.”

The row began in last May’s AFF Chal-lenge Cup in Maldives, when Dooley said injuries reduced Etheridge and Cagara to bit parts.

The Azkals went all the way to the final, narrowly losing to Palestine after Schrock was substituted at halftime.

After the final, Dooley highlighted the strong performance of younger players throughout the tournament although he insisted there was still a role for veterans.

Dooley said Thursday some senior play-ers did not like it when he began to push younger players, as well as players based in the Philippines, into his starting 11.

LOS ANGELES, August 13, 2014 (AFP) – Former Microsoft CEO Steve Ballmer officially became the new owner of the Los Angeles Clippers Tuesday in an estimated $2 billion deal after months of legal wrangling, the National Basketball Association said.

Ballmer said he was “humbled and honored” after the transaction was sealed when a California court order went into effect confirming that Shelly Sterling had the authority to sell the team.

The team went on the block after the NBA slapped a life ban on her estranged husband and its owner, Donald Sterling, who bought the club in 1981 for $12.5 million. The action was in response to a video aired on celebrity website TMZ that showed Donald Sterling criticizing his girlfriend for having her picture taken with black people.

In the storm that followed, the 80-year-old billionaire initially agreed to the sale of the team, but then abruptly withdrew his support.

His wife Shelly, however, moved to sell the Clippers as a trustee of the family trust that owned the team after Sterling had been declared mentally incapacitated.

The NBA Board of Governors had previously approved the sale and Ballmer now takes on the title of Clippers Governor.

Ballmer thanked Clippers fans for remaining “fiercely loyal to our franchise through some extraordinary times.”

“I will be hardcore in giving the team, our great coach, staff and players the sup-port they need to do their best work on the court,” he said.

“And we will do whatever necessary to provide our fans and their families with the best game-night experience in the NBA.”

‘Wonderful new owner’ -Ballmer is expected to travel to Cali-

fornia later this week and have dinner with head coach Doc Rivers and the players,

then meet with Clippers employees and fans at an event next Monday.

Rivers said they can now focus on win-ning a first title.

“This is an amazing new day in Clippers history,” Rivers said. “I couldn’t be more excited to work together with Steve as we continue to build a first-class, champion-ship organization.

“I am already inspired by Steve’s pas-sion for the game, his love of competition and desire to win the right way, and I know our players and fans are going to be inspired as well.” On Monday, the NBA filed a counterclaim in US federal court saying Donald Sterling caused “incalcu-lable harm” to the league.

The counterclaim says that Shelly Ster-ling signed an agreement three months ago on behalf of the family trust, indemnifying the NBA for any litigation costs in connec-tion with the sale of the Clippers.

The suit also notes that similar indem-nification agreements are in the league’s constitution and in another document signed by Donald Sterling in 2005.

Ballmer’s purchase would make the Clippers the second most expensive fran-chise in US professional sports. It is the highest price ever paid for an NBA team.

On July 28, after a three-week trial, Judge Michael Levanas gave the green light to the sale, finding no evidence of a secret plot against Sterling.

Sterling contended he had been duped by his wife into submitting to the medical tests as part of a plot to have him ousted from the trust so the sale could move for-ward.

Donald Sterling appealed the decision to a court in Los Angles, but it was rejected.

LOS ANGELES, August 13, 2014 (AFP) – Robin Williams’ death prompted an outpouring of tributes and memories from the North American sports world, includ-ing from his good friend and fellow cycling enthusiast Lance Armstrong.

Armstrong said he formed a strong bond with the Oscar-winning comedian and actor over the last dozen years thanks to their shared love of cycling.

Armstrong said they would ride bikes together and Williams would travel over-seas to watch Armstrong race. They also took part in United Service Organization (USO) shows for American troops and their families stationed around the world.

“He was always cracking jokes. He was a special man and there was obviously a lot going on there,” Armstrong told American news channel CNN on Tuesday.

“It was a weakness of his that he could never say no. He would stretch himself so thin. He wanted to make people happy. The guy was a giver. That is the best way I could some it up.”

In recent years, both Armstrong and Williams have had their problems put under the public microscope – Williams for addiction and Armstrong for his admission that he doped, which led to a lifetime ban from competitive cycling.

Asked by CNN if they ever talked about their joint struggles, Armstrong said Williams did open up to him.

“His challenges, yes,” Armstrong said.Armstrong said he once travelled to Oregon to visit Williams at a rehab facility

where the comedian was being treated.“I lived with him through some of the previous challenges when he was sober

and then fell off,” said the disgraced cyclist Armstrong, who vacated his Tour de France titles.

“I visited him outside of Portland...Life is messy and we all sort of find our way. This last year or so Robin was in a place where I don’t think many people knew, and it was terrible.”

Williams’ body was found in a bedroom of his San Francisco-area house on Monday. Police are investigating the death but officials say the evidence they have so far is pointing towards a suicide.

Other American sportsmen paid tribute to Williams on Tuesday. Cyclist Tyler Hamilton used Twitter to express his heartfelt sympathies.

“Robin Williams - u will be greatly missed. Thx for all the smiles that u gave so many people over the years. U will never be forgotten. RIP.”

Williams was also an avid baseball fan, often attending San Francisco Giants baseball games.

He supported tennis star Andre Agassi’s annual ‘Grand Slam for Kids’ event which raised money for Agassi’s Las Vegas charter school.

“2001 Grand Slam for Children. Robin Williams was one of the kindest, most generous people we have ever known...,” Agassi said on Twitter.

mans are mad about cars and Germany is ranked the most fuel-efficient country on the planet, but when it comes to electric vehicles, Europe’s top economy is in the slow lane.

And moves by the government last week to try to jump-start public interest in the technology are unlikely to change much, experts say.

In 2009, Chancellor Angela Merkel set an ambitious target for one million electric cars to be on the road in Germany by 2020,

and this in a country where some motor-ways are free of any speed limit.

“We’re confident that we’ll reach that goal,” Transport Minister Alexander Do-brindt said as recently as last week when he launched a number of new electromobility initiatives.

But for Ferdinand Dudenhoeffer, ex-pert at the CAR Center for Automotive Research at Duisburg-Essen University, the target was totally unrealistic.

Merkel “might have just as easily said that we would have 100,000 cars driving on the moon by 2020,” he said.

According to CAR data, about 16,900 electric cars were in use in Germany in the first half of 2014, or four cars for every 10,000 standard fuel-driven ones.

As a comparison, the ratio in France is 10 electric cars for every 10,000.

Electric cars are already exempt from road tax for a period of 10 years, but that appears to have provided little incentive so far, so the government unveiled new draft legislation last week aimed at giving the sector a boost.

Under the initiatives, electric cars would be allowed to use inner-city bus lanes. They

would also be able to park free of charge, and parking spaces close to recharging stations would be reserved exclusively for electric cars.

Scepticism remains -However experts believe such initia-

tives do not go far enough, not least because they are in the hands of the mu-nicipal authorities. “Lots of towns and cities remain sceptical,” not only about the idea of free parking, but also opening up bus lanes to electric cars, since that could slow down buses, said Stephan Articus of the Association of German Cities.

Select Honda pre-owned vehicles recognized as safer choices for teen drivers by IIHS

(Relaxnews) – Described by US co-median Seth Meyers as “the cigarette of personal mobility” because it looks cool but it’s going to kill you, a motorbike can be risky at the best of times. But, thanks to the Skully AR-1 Helmet, riding a motor-bike is about to get a lot smarter, and safer.

The idea for a crash helmet with a heads-up display for navigation and an integrated rear-view camera was dreamt up by the company’s CEO, Marcus Weller, Ph.D, while he was recovering from a motorcycle crash in 2011. The accident happened because, while riding, Weller glanced up to see a road sign and in doing so failed to see the car in front of him had come to a sudden halt.

Two years later, the company show-cased the prototype helmet at the Demo Fall 2013 emerging technology and trends event in Silicon Valley in October, where it scooped a host of awards because of its potential to save lives.

Its integrated heads-up display provides riders with turn-by-turn navigation, smart-phone alerts and notifications – such as incoming calls and texts – as well as access to the device’s music library, contacts and dialer, all via voice command.

However, the smartest feature is the rear-facing ultra-wide-angle video camera, the feed from which is also integrated into the heads-up display. It captures a 180-de-gree view of everything happening behind the rider, making for a potentially blind spot-free riding experience, even when cornering or overtaking.

Therefore it was less than a surprise that, when the company opened up a beta testing program to get the helmet ready for a consumer launch, it received requests from over 100,000 riders.

And, after 10 months for further devel-opment and testing, the helmet is ready to go into production and Skully is using In-diegogo as a way of taking initial orders and of funding mass production.

When the AR-1 arrives in stores next May it will do so with a $1,499 price tag – making it $1 cheaper than Google Glass – but riders who reserve one now can save up to $100 on a single helmet or get a $349 discount on a set of two.

Skully started taking orders on Mon-day and set a funding target of $250,000. Within 24 hours reservations totaled more than $800,000 and counting.

(Relaxnews) – In May, the British sportscar company announced that after a 50-year hiatus it was reviving a project it started back in 1963: to finish building the missing six examples from a set of 18 very special hand-built GT-E-Type cars.

The GT-E-Type was a phenomenal racing car and in recent years has be-come a highly sought-after collectible. But in order to take to the track, Jaguar had to homologate it by building a num-ber of models for customers. It set out to create 18 but had only completed and delivered 12 by the end of 1964.

Realizing that it had designated six chassis numbers from 1963, Jaguar decided to finish the project and build the remaining cars to the exact specifi-cations of the original 12. Each will be hand-crafted from aluminum and when

completed will be FIA compliant for historic motorsports events.

Not surprisingly, Jaguar expects demand from collectors to be high for these perfect reproductions and hopes that interested parties will form an or-derly queue.

The company is yet to reveal pricing but has said that it will give priority to established Jaguar collectors, especially those with historic race car interests.

BMW 3 Series ranks No.1 in Kelley Blue Book’s ‘10 Best Certifi ed Pre-Owned Luxury Cars Under $30,000’

(Relaxnews) – A GT car that predates the concept of the grand tourer, the 540 K Streamliner was automotive light-years ahead of its time.

Today sports car and super car compa-nies spend much of their time espousing the benefits of using aluminum as a way of making their latest cars both strong and lightweight and dedicate hours to testing new designs in the wind tunnel as if both are new developments.

However, that’s exactly how the Streamliner got its remarkable shape back in 1938 – a wind tunnel and hand-formed aluminum panels.

Underneath its wonderfully curved ex-terior is an in-line eight cylinder 5.4-liter engine and a supercharger, and although total output is just 180hp, that was good enough to achieve a 185kph (115mph) top speed. OK, it wouldn’t be able to outrun a Ford Fiesta ST with that sort of perfor-mance, but back in the 1930s, those figures were racing car territory.

For some perspective, in 1948, Jaguar unveiled the similarly aluminum-bodied XK120 sports convertible, which, with a

top speed of 120mph (193kph), held the record of being the world’s fastest produc-tion car.

Like the Jaguar, the 540K Streamliner was conceived first and foremost as an endurance race car and, if it had had the chance to race and go into production, things might have been very different.

Unfortunately, the competition in ques-tion, the long-distance Berlin-Rome race, was initially postponed—it was scheduled for 1938 and then moved to a 1939 start date – but the outbreak of the Second World War kept that from happening and the car never, ever got the chance to perform. That is until now. Mercedes-Benz’s classic car and restoration arm took it upon itself to restore the car to its former glory and the fruits of its labor will be seen for the first time ever at Pebble Beach in California over the weekend.

The fully restored car was rebuilt under strict guidelines. The team responsible for bringing it back to life was prohibited from using modern materials or techniques, making the end result all the more impres-sive.
