Minutes of 184th NRC Meeting Held from 27th June to 1st July, 2011

The 184th Meeting of the Northern Regional Committee (NRC), National Council for Teacher Education (NCTE) was held from 27th June to 1st July, 2011 at NRC, Jaipur.

In pursuance of the Gazette Notification No.213 dated 25.08.2010, NRC has been terminated under Section 21(2)(a) of NCTE Act, 1993 and the powers and duties on behalf of the Northern Regional Committee are being exercised and performed under Section 21(2)(b) by Shri Hasib Ahmad, former Member Secretary, NCTE.

The following member and convener were present:-

B.Ed. The original application of the institution, along with all other related documents, Act of NCTE, 1993, Regulations and Guidelines of NCTE published from time to time has been carefully considered by the NRC and following observations made:-

i. The institution was issued Letter of Intent prior to recognition on 26.02.2008. The institution thereafter started the B.Ed. Course after obtaining affiliation of the University and approval for appointment of faculty from the session 2008-09, without awaiting issue of formal recognition order under clause 7(11) of the NCTE Regulation. Since details of staff etc. were not submitted to the NRC, it refused recognition vide its letter dated 28.8.2009, which was set aside by the Appellate Authority on 20.8.2009. As a consequence, the NRC issued the order for recognition under clause 7(11) of the NCTE Regulation granting recognition to the institution for the B.Ed. course from the session 2009-10. However, the institution felt aggrieved as it had already admitted students for the session 2008-09 and approached the Court. The Hon’ble High Court of Allahabad in its order dated 3.5.11 upheld the contention of the institution and directed issue of recognition order to the institution from the session 2008-09.

Accordingly, the institution be recognized with effect from the academic session 2008-09 and fresh order of recognition be issued in continuation to the letter of intent prior to recognition dated 26.2.2008.

Lakmi Chand Patwari College of Education, Delhi Baghpat Road, Dundhera, Khekra, Baghpat, U.P.

B.Ed. The original application of the institution, along with all other related documents, Act of NCTE, 1993, Regulations and Guidelines of NCTE published from time to time has been carefully considered by the NRC and following observations made:-

The institution’s reply dated 1.2.2011 w.r.to the Show Cause Notice dated 19.1.2011 has been carefully considered. The main observations that the institution conducted only 20 days practice teaching during 2005 and not as required under NCTE Regulations has been replied by a certificate dated 21.1.2011 from the Coordinator Counseling and admission for the session 2004-05 of the C.C.S. University Meerut. The Certificate is based on the records submitted by the institution, which comprised of letter dated 2.5.2005 from the Principal Gandhi Vidyalaya Inter College, Rehlhda, Baghpat and Letter dated 21.5.2005 from Principal Holy Child Academy, Bagpat Certifying that 40 days teaching practice has been conducted in their school. The certificates of the two Principals suffer from following infirmities.

i. The certificates are dated May 2005, but they have been apparently made only now. The institution thus prepared the documents afresh to prove their point. The certificates could have been prepared now, based on the old records and that would have been more acceptable.

ii. The certificates does not mention the name of the L.C. Patwari College of Education in their letter but simply mentions that teaching practice was conducted from 10th March 2005 to 2nd May 2005.

iii. It is not feasible to organize practice teaching for fourty days in two schools, without sacrificing the theory classes. The numbers of practice teaching schools for the purpose are generally from 6 to 10.

It is thus clear that, as observed by the Visiting Team, the institution conducted the practice teaching only for 20 days and not for 40 days as claimed by the institution and has been conducting the B.Ed. Course in violation of the Norms prescribed by NCTE.

The recognition of the institution therefore needs to be withdrawn; however no order to that effect needs to be issued in view of the stay order of the Hon’ble Court. The above observations of NRC may be conveyed to the Appellate Authority with reference to their decision dated 27.8.2010, for their endorsement, if considered necessary by giving the institution a hearing.In case NRC’s decision is endorsed by the Appellate Authority,the matter may be placed before Hon’ble Court for getting the stay dated 21.9.2010 on the withdrawal order dated 15.4.2010 vacated.

Add. carefully considered by the NRC and following observations made:-

Consequent upon the orders of the Hon’ble High Court of Jaipur dated 17.02.2011, applications submitted by the institution for additional intake to the B.Ed. course and additional intake for BSTC course were considered afresh, for issue of letter of Deficiency, on their applications. Following observations in this regards has been made:-

1. The institution was recognized for following courses with effect from the date indicated against each.1.B.Ed. (100 seats)- 16.08.2007.2.BSTC(50seats) - 20.09.2007.

2. The institution was also recognized for a M.Ed. course in Sept 2008 for the academic session 2008-09 or 2009-10, depending on the affiliation by the University. The institution therefore did not complete three academic sessions, since then and is therefore not eligible to apply for any Additional course or any Additional Intake in its existing courses, in accordance with the provision under clause 8(2) of the NCTE Regulation 2009.

3. The institution will be eligible to apply for additional intake, after completion of three academic sessions and that too online, in accordance with the provisions of the NCTE Regulation 2009, as and when it completes three academic sessions of running of the M.Ed. course. This needs to be done online at the time prescribed in the Regulation 2009, for the purpose.

Hence, NRC decided to convey the above deficiency to the institution in its application submitted in the office of NRC, due to which his applications cannot be considered further.

B.Ed. The reply of the institution regarding experience and the Ph. D. Degree of Dr. Vinod Kumar has been considered. The institution claimed that Sri Vinod Kumar possessed 7 1/2 years of teaching experience inthree different B.Ed. colleges.In this regard , the institution inter-alia submitted an experience certificate in respect of Dr. Vinod Kumar, from the Krishna Institute of Management, Meerut for teaching in it’s Education Department for a period from 15th July 2002 to 25th March 2005. The records of NRC, NCTE reveals that the Krishna Institute of Management, Prabhat Nagar, Meerut, U.P. applied for a B.Ed. course in December 2002 and was given recognition only in April 2004. As such, it is not understood as to how shri Vinod Kumar could serve the Krishna Institute during the period from July 2002 to March 2005. It obviously means that the institution has not submitted a proper certificate to claim the experience.

Meanwhile, it has also been brought to the notice of the NRC that the applicant Society namely Arihant Education Society Village-Bhadedi, Roorkee, Haridwar-249402, Uttarakhand is already running another Teacher Training Institution with a B.Ed. course since july 2005. The details of this course/Institution was mentioned in the application of the institution, but the exact location of that institution was not given. It was mentioned only as ‘Arihant College of Education’. Now when the present application was being finally processed for a recognition order it was noticed that the name of the institution for the present application is similar i.e. ‘Arihant Education Society’. On further exploring of exact location of the two institutions, it has been noticed

that the address of the two courses/institution are as follows:-

i. Existing institution (since 2005) - Arihant College of Education, Village- Bhadedi, Rajputana, Roorkee, District-Haridwar (9Km from Roorkee Towards Haridwar).

ii. PresentApplication , Arihant Education Society, Village- Bhadedi Shantershan, Roorkee, Haridwar.

Since in the present application name of the institution has been mentioned as Arihant Education Society, the NRC felt at loss to issue a recognition order in the name of a Society instead of an institution. This lead to an apprehension that the two institution may be located at the same place and in the same village and the institution might have managed recognition ,with a little change in address, to get a recognition for another 100 seats in the same institution. The land documents of the two institution were therefore re-examined and it was noticed that the land documents and affidavit regarding land in these two cases mentioned the location of the land in the same village i.e. Bhadedi, Rajputana, Roorkee, District-Haridwar. Morever, Some of the Khasara No. of the two land papers are common e.g. Chak No. 23 and Ghata No. 431/3. This lead to clear conclusion that the recognition of 100 seats for B.Ed. course has been sought by the institution in its application either in a building at the same place or in two adjacent buildings with common land area.

The situation clearly reveals that institution is seeking recognition for 100 additional seats of B.Ed. course in the same institution by concealing full facts and with a view to circumvent the provisions in the NCTE Regulation that required accreditation from NAAC for additional intake in an existing B.Ed. course.

Even if the two institution are separate, the NRC considers this situation where two teacher training institution by one Society are proposed in the close vicinity, as commercialization of Teacher Education and NCTE is mandated curb it by NCTE Act 1993.

Hence, NRC decided to issue a Show Cause Notice under section 14(3) (b) of the NCTE Act, as to why recognition may not be refused to the institution on the above grounds.

The two documents have been found in order and as such as per appellate authority order dated 07.06.2010 formal recognition Under Clause 7(11) of the NCTE Regulations be issued for 100 seats of B.ED. Course from the academic session 2011-12. As,there is a considerable time lag since the selection was made institution be asked to furnish the list of the faculty to NRC immediately after it gets affiliation from the university and admits students .

M.Ed. The reply of the institution dated 23.6.2011 w.r.to the points of clarification have been considered. Dr. S. K. Tiwari HOD, Hindi Arya School, Jhansi Cantt is stated to have worked on deputation basis from 1.1.99 to 31.3.2004 in Dau Dayal Mahila P.G. College, Firozbad teaching M.Ed. Courses. As per another certificate issued by Army School, Jhansi, he worked as the Principal of the School from 1.4.2000 to 31.3.2005. When the two certificates are read together it leads to a conclusions that Dr. Tiwari has no experience of teaching M.Ed. course, as sucha teaching experience has to be on regular basis for being eligible to be appointed as HOD for an M.Ed. Course. Morever, the affidavit submitted by Dr. Tiwari does not mention anything about his experience. The affidavit is confined to qualifications only.

The reply is therefore not found satisfactory. Hence, NRC decided to issue Show Cause Notice under section 15(3)(b) of the NCTE Regulation for refusing recognition to M.Ed. Course on above ground.

B.Ed. The institution Letter dt.30.5.2011 w.r.to their letter of intent prior to recognition under section 7(9) dt.29.4.2011 has been carefully considered and following observations made:-

i. The institution has made selection of the faculty and sent it to the University for approval. University’s formal approval is awaited, which may be submitted before formal recognition order could be issued.

ii. A list of selected faculty member, giving details of their educational qualification, Divisions with percentage of marks obtained to verify whether they possess the requisite qualifications, as per NCTE Norms has not been submitted.

iii. None of two persons who have been selected for the post of Principal/HOD are qualified to be appointed as Principal due to following reasons:

a. Miss Mausama Qaiser is not having 10 years of experience with five years of experience of teaching in a B.Ed. Colleges. Her experience as part time lecturer in Deptt. of Education Shia P. G. College, Lucknow is not acceptable in terms of NCTE Norms. Moreover, she is not a Ph.D in Education.

b. Dr. Sudhakar Prakash is not having required experience of teaching in a B.Ed. College. His experience in Christian College, Lucknow is in the discipline of Zoology and not in Education.

Hence, NRC decided that the institution may clarify its position on the above points and submit approval of the University for the appointment of Faculty that conforms to the Norms of NCTE.

application is 764. However, it is noticed that the Plot No.763 has the dimension of 4430 sq. Meter whereas Khasra No.764 is 1.105 hectere. The building plan mentions that construction is approved on Khasra No.763. Although the land required is sufficient in Plot No.763, where the map is approved, but the CLU obtained is only for Plot No.764 and not for 763. Again affidavit is for the land having plot no.763 and not 764, contrary to the application where it is indicated as Plot No.763.

ii. The building plan does not indicate total available land on which college building is being constructed.

Hence, NRC decided to issue Show Cause Notice to the institution under section 14(3) (b) of the NCTE Act 1993 on the above points and directs the Institute to reply within 30 days.

iii. The Institutes did not submit a certified copy of the land document and no document whatsoever about ownership of the land of either of the two plots 979 or 978 has been submitted.

iv. The Affidavit about land submitted on the non-judicial stamp of Rs.100 is not in the prescribed format.

i. The building plans submitted is of the Senior Secondary School, Shiksha Bharati Campus. However, the proposed plan comprised of Senior Secondary School, Girls Hostel & Facility Centre. There is no building for the proposed BTC Course. The map was approved in 5.1.2004 and here is no indication as to how much area has been actually built up. There is no segregation and

no indication about land/building earmarked for the teacher training course. As such, the proposal is in contravention of the clasue 8(7)(ii) of the NCTE Regulation 2009. Apparently the institution is being proposed in the Senior Secondary School, which is not permissible as per said NCTE Norms.

ii. The building plan has not been submitted in original. Only a photocopy has been submitted, which is not acceptable.

iii. A certified copy of the land document has not been submitted. The photocopy submitted is not acceptable.

iv. The CLU submitted is not notarized, only a photocopy has been submitted, which is not acceptable.

Hence, NRC decided to issue Show Cause on the above ground under section 15(3)(b) of NCTE Act 1993.

Moreover, Show Cause Notice be separately issued in respect of this institution for its existing B.Ed. Course, about availability of required infrastructure both physical and instructional under section 17 of the NCTE Act.

ii. A complaint has been received in NRC that the institution has constructed a building in Plot No.448 and has applied to AICTE and CCS University, Meerut for recognition of many other courses which is under consideration of concerned body/State Govt. It has also been complained that a building has been got approved for a Polytechnic by the Society from Khurja Development Authority and proposed building is also included in that map.

This means that institution is proposing the course in the same village, with a different name and therefore has been done to circumvent the provisions under clause 8(3) of the NCTE Regulation that prohibits recognition of additional Course before completion of three academic sessions. As such, the proposal is nothing but commercialization of teacher education that the NCTE is under statutory obligation to curb.
