The Minutes of the 198th Meeting of the NRC held from 27th April, 2012 to 20th April, 2012

The 198th Meeting of the Northern Regional Committee (NRC), National Council for Teacher Education (NCTE) was held from 27th April, 2012 to 30th April, 2012 at NRC, NCTE, Jaipur.

The following were present:

The Regional Director, NRC apprised the Northern Regional Committee about the provision of the NCTE Act, Rules, Regulations and instructions issued from time to time.

With the permission of Chairperson, Dr. Ram Kishor (Convener) presented the Agenda before the Committee. Item-wise decisions taken are as follows:-

It is not clear whether the Principal possess five years experience of teaching in primary or elementary teacher education institution. It is also not clear whether the Principal has a Master’s degree in any school teaching subject with 55% marks and degree in Education with 55% marks.

A Lecturer with a post graduation degree in Fine 1


Arts/Music/Dance with fifty five percent marks has not been appointed.

Hence, NRC decided that Show Cause Notice under section 14/15 (3) (b) of NCTE Act, 1993 be issued to the Institution on the above point and direct the Institution to submit the reply as per the provisions of NCTE Act, 1993 Rules & Regulations within 30 days from the date of issue of Show Cause Notice.

Principal/HOD does not possess educational qualification and teaching experience as per NCTE norms. He is not Ph.D. in Education. Teaching experience certificate does not establish that he has teaching experience as per NCTE norms.

Hence, NRC decided that Show Cause Notice under section 14/15 (3) (b) of NCTE Act, 1993 be issued to the Institution on the above point and direct the Institution to submit the reply as per the provisions of NCTE Act, 1993 Rules & Regulations within 30 days from the date of issue of Show Cause Notice

Hence, NRC decided that the application for the said course be rejected under section 14/15 (3) (b) of NCTE Act, 1993 on the above point.

Hence submitted building plan is not acceptable.

The institution was initially started in a rented building on the address Ábove State Bank of Patiala, Bhojpur, Sunder Nagar, Dist. Mandi, HP in the year of its inspection i.e. 2003.

Experience certificate issued to Mr. Devender Kumar Sharma on September 2, 2005 shows that Institute had shifted to a new location, “Troat, PO Kanaid, Sunder Nagar, Dist. Mandi (HP) – 175137.

VTR of the inspection conducted on 18.8.2009 indicates that college has again shifted to a new location, “Village Kot, PO Chunahan, Sadar Mandi, HP.

Institution has thus shifted to new locations twice with regard to prior permission of NRC, which is a gross violation of NCTE Regulations (clause 8(11) of NCTE Regulations, 2009.)

Since the institution had not informed the NCTE (NRC) without the changes in locations. The intimation with regard to inspection of the institution u/s 17 (i) was sent on the address ‘Blooms College, Above State Bank of Patiala, Bhajpur, Sunder Nagar, Dist. Mandi, HP.

The institution expressed its inability to get the inspection of the institution done on 2.11.2010 on the pretext that it had no prior intimation.

In view of the above observations the Committee decided to withdraw the recognition of B.Ed. and D.El.Ed. (JBT) courses u/s 17(i) of NCTE Act. The orders will be effective from the end of the academic session next following the date of communication to this effect.

CONSIDERATION OF THE NCTE HQ. LETTER DATED 20.03.2012 REGARDING ONE YEAR DELAY IN RUNNING OF THE ACADEMIC SESSIONS IN SOME OF THE UNIVERSITY OF NRC REGIONAL

The NRC noted the NCTE Hq. letter No. 48-10/2012/NCTE/N&S./A 48742 dated 20th March, 2012 whereby the NCTE Hq. has brought to the notice of the NRC towards the clause 11 of the NCTE (Recognition, Norms & Procedure) Regulations, 2009:-

(i) It shall be incumbent upon the affiliating body to regulate the process of admission in teacher education institution by prescribing the schedule or academic calendar in respect of each of the courses listed in Appendix 1 to 13 of these Regulations by providing the following details, at least three months in advance of the commencement of each academic session and to give due publicity:-(a) Date for the publication of Notice inviting

applications for admissions.(b) Last date of receipt of applications for

admissions for each course.(c) Date of selection test or interview.

(d) Date of publication of 1st , 2nd and 3rd list of candidates and last date of close of admissions.

(ii) The entire process shall be completed within a period of sixty days from the date of publication of the admission notice. The affiliating body shall strictly adhere to the schedule or academic calendar notified by it. After closure of the admission, each teacher training institution shall submit the list of students admitted in each course within two days from the last date of closure of admission to the respective affiliating or examining bodies and shall be made available on the web-site of the institution.

The NCTE Hq.. vide letter dt. 11.08.2011 had issued directions to the Regional Committee consequent to the order of the Hon’ble Supreme Court of India in Civil Appeal No. 1125-1128/2011 in the matter of Bhawar Kanwar Singh Mahavidyalaya and ors. to process the pending applications after 31st July 2011 for the academic session 2012-13.

In view of the above, NCTE has directed the NRC to take up the matter with the errant Universities to adhere to the time-frame stipulated in the clause 11 of the NCTE Regulations.

It has been brought to the notice of NRC that the counselling for B.Ed. course by Kamaun University, Nainital is scheduled to be held in the month of May, 2012 for the academic session 2011-12. This academic session should be 2012-2013 as per the orders of Hon’ble Supreme Court and directions of NCTE.

It is pertinent to note here that the academic session 2011-12 is likely to end. The admissions in the month of May, 2012 for the academic session 2011-2012 are not in accordance to the orders passed by the Hon’ble Supreme Court and the directions of NCTE.

In view of the above, NRC decided that the University be asked to adhere to the time frame stipulated in the clause 11 of the NCTE Regulations, 2009. The counselling scheduled to be held in the month of May, 2012 should admit students for the academic session 2012-2013.

The land has been allotted to the institution by the DDA on a perpetual lease basis.

As per clause 13 of this perpetual lease document, the land was leased out only for running the middle school. “The clause further require permission of lessor if the same is to be used for a purpose other than middle school only with terms and conditions of lessor”.

The institution has not submitted the permission of lessor for use of the land/building for running B.Ed. programme.

The institution has not submitted the list of qualified faculty duly approved by affiliating body.

The institution did not submit details of salary paid to teachers as per clause 4(v)(d)/4(a) (d) of NCTE norms for respective teacher training course with supporting document.

Hence, NRC decided that Show Cause Notice under section 17 of NCTE Act, 1993 be issued to the Institution on the above point before withdrawal of recognition of the institution. Institution be

The institution was visited by the Visiting Team on 20.2.2012 in compliance with the orders of Hon’ble High Court of Delhi. VT has reported that B.Ed. programme was never started by the institution as affiliation by the concerned affiliating university was denied. The institution has also informed the NRC vide its letter dated 20.2.2012.

The institution was allotted land by DDA vide its letter dated 9.10.2001 to run a middle school only. The institution has not submitted the permission of DDA to run B.Ed. course in the allotted land.

Hence, NRC decided that Show Cause Notice under section 17 of NCTE Act, 1993 be issued to the

A Visiting Team constituted by NRC visited the premises of the institution on 16.2.2012. The VT reported that B.Ed. course has never been started by the institution.

In compliance of the orders of the Hon’ble High Court, the Kalka Educational Society was allotted land by DDA for higher secondary school in Alaknanda on 2.1.1986 vide DDA letter dated 8.5.2002. The land shall be used by the society for the construction of Higher Secondary/Middle School and for no other purpose whatsoever.

A VT constituted by NRC inspected the Kalka Institute on 13.2.2012 u/s 17 of NCTE Act.

Hence, NRC decided that Show Cause Notice under section 17 of NCTE Act, 1993 be issued to the Institution on the above point before withdrawal of recognition of the institution. Child Education Society, New Delhi was allotted land for establishing Sr. Sec. School on 25.3.1994 by DDA. Clause 9 of this allotment of land reads “The land shall be used by the Society for the construction of Nursery/Sr. Sec./Middle School and for no other purpose whatsoever. No residence is permitted except a small hut for Chowkidar”.

Director, Higher Education, Govt. of NCT of Delhi issued NOC to run B.Ed. course on 1st June, 1999.

The Society was given grant of recognition to start B.Ed. course (60 seats) by NRC on 31.7.2000. Further more, the Society was given grant of recognition for an additional intake of 140 seats in B.Ed. course on 26.6.2003.

NRC constituted a VT on 31.01.2012 to inspect the CES College of Education. CES informed the NRC vide its letter dated 13.2.2012 that “CES College was closed in the year 2005”. The VT inspected the college on 17.2.2012 and remarked that the B.Ed. course had been closed and B.Ed. course was not being run by the Society.

“The lessee shall not without the written consent of the Lessor carry on, or permit to be carried on, on the said land or in any building thereon any trade or business whatsoever or use the same or permit the same to be used for any other purpose than that of construction of Middle School only...”

A letter of the Foundation dated 12.3.2003 indicates that Amity Institute of Education is running B.Ed. course since 1999. However, NRC vide its order F.No. F-3/DH-01/B.Ed./2000/5327-34 dated 31.7.2000 granted recognition to Amity Institute of Education for B.Ed. of one year from the academic session 2000-2001(60 seats).

NRC granted recognition for an additional intake of 40 students in B.Ed. course on 9.3.2005.

NRC constituted VT on 17.1.2012 for inspection under section 17 of NCTE Act in compliance of the order of Hon’ble High Court. VT inspected the institute on 13.2.2012 and observed “Land is allotted on perpetual lease by DDA for Middle School’s use. No one part of land is allotted for the use of teacher education programme”.

The VT report indicates that the siz of the multipurpose hall is 885.43 sq. ft. The VT has reported that other courses namely ETE, ECCE and B.Ed. additional are being run in the same building. It has also been reported by the VT that “”Building is shared with
