The Badger Herald obtained these documents via Wisconsin's open records laws. Some information was redacted to protect the identity of individuals involved.The University has redacted these records to withhold certain confidential information, which identifies or could lead to the identification of students, pursuant to the Family Educational Rights and Privacy Act (FERPA). FERPA (20 U.S.C. § 1232g; 34 CFR Part 99) is a federal law that protects the privacy of student education records, and personally identifying information from those records. The law applies to all schools that receive funds under an applicable program of the U.S. Department of Education (such as this University) and prohibits the release of information from a student's education record without prior written permission from the student. The University is required to inform you that to the extent that this amounts to a denial of your request it is subject to review by mandamus under Wis. Stat. § 19.37(1)(a) or by application to the attorney general or district attorney pursuant to Wis. Stat. § 19.37(1)(b).

Mon. Feb. 23, 2015 Associate Dean of Students Kevin Helmkamp and TJ Sargent met with all pledges and gave them24 hours to notify the university if they would like to amend their previous statement as we believed that most of thesestatements were not completely truthfulTues. Feb. 24, 2015 15 newmembers and 4 active members contacted the university to amend their statement. 1 newmember and 1 active member finally responded to request for initial interview.

Allegation #1 – Member targeted NewMember• Affirmed in interview -­‐ Member said in interview with Steve Rogers that New

Member was around the house “all the time” as a pledge. Member said inretrospect letting Member handle the coffin for New Member was “not agood decision in the end.”

• Affirmed in group text -­‐ Member states in a group text “6 biggest guys on[New Member lets rock him

• Affirmed in group text -­‐ Member states in a group text “Only evidence I haveagainst [New Member ] is sorority girls hate him and he stole my slam forthe date party and made her cry. Real class act.”

• Confirmed in group text -­‐ Member states in a group text after sharing thatvarious sororities did not like Chi Phi because of [New Member ], “We needto educate him to the ends of the earth.”

• Confirmed in group text -­‐ Member states in group text, “Really I just want him[NewMember to suffer.”

• Confirmed in group text -­‐ Member states in group text, “It’s not even funnyhow dead [New Member ] is and howmuch he screwed me over.”

Allegation #2 – Member was drunk at time of injury• Affirmed in group text -­‐ Said to [New Member ] by another member after

[New Member ] was injured, “In his [Member ] defense, he is reallydrunk.”

• Affirmed in interview -­‐ Member stated in his interview that some members“not in the best state of mind” when various comments in group text werewritten,

• In additional statement, New Member shared that he thought some of theactive members were drinking [on Saturday], and there was alcohol available atthe house

Allegation #3 – Injured during ritual with coffin• Confirmed -­‐ All those present indicated that the coffin was used for ritual with a

lid – 17 newmembers and 11 active members

• Confirmed -­‐ All confirmed that [New Member ] was injured by [Member ]stepping or stomping on the coffin. In conversation with the National Office whohad seen the coffin, it would have taken great force to break the coffin.

• Confirmed through interviews -­‐ Active members wore masks during the coffinceremony.

• Confirmed through interviews -­‐ Coffin ceremony has been part of ritual as farback as Spring 2011, which was shortly after the group came back to campus.

Allegation #4 – From Thursday through Saturday had to go to house and could only leavefor class (accompanied by an active member). Laptop and Cell phones were taken away.

• Affirmed in interviews -­‐ Interviews of new members indicate that all newmembers stayed at house on Friday night. One description said that they were“strongly encouraged to stay at the house on Friday night”

• NewMember stated that when arrived at the House that all cell phones andlaptops were taken away from the pledges

• NewMember had asked permission to go toand was denied.

• After February 23, 2015 and by the time the packet was created, 4 newmembersconfirmed that this occurred. New Member shared in his amended statement,cell phones and watches were not available at any point Thurs./Fri./Sat.

Allegation #5 – Made to sleep in attic in tight space• Confirmed in interviews -­‐ After showing pictures of attic – 2 newmembers

confirmed sleeping in the attic• Confirmed in interviews -­‐ Active members confirmed that pledges slept in attic• Picture of attic space where pledges were confirmed to have slept• Affirmed in group text where, Student states, “Give them bins to poop and per

in and they can’t leave the attic.”• In 2nd interviews with newmembers after Feb. 23 meeting, confirmation that

pledges were forced to sleep in the attic behind some orange fencing.

Allegation #6 – Only given oatmeal to eat and overall limited food and water• Confirmed in interviews -­‐ Many newmembers describe eating oatmeal on

Saturday morning, while a couple stated that they went elsewhere for food• Affirmed in text where Member states, “Obviously saying “eat this oatmeal

don’t insult and his dream to go to culinary school” isn’t meant to scarethem.”

• Confirmed in interview with where he states that a loaf of bread andcandy canes were all that were given to pledges on Friday night to eat.

• In 2nd interviews with newmembers after Feb. 23 meeting, confirmed that weforced to eat unpalatable oatmeal on Thursday and Friday nights

Allegation #7 – Member took NewMember and other pledges and made eatunpalatable food at Gordon Commons

• Confirmed by another newmembers that they were required to eat cereal withsome hot spices in it

• Affirmed in text – Member stated, “I had to remake his Gordon’s surprise thatungrateful shit.”

• Confirmed in second interviews with newmembers after Feb. 23 meeting

Allegation #8 – NewMember placed in a hood for 8 hours on Saturday• confirmed that he had knowledge of new members being “hooded”

prior to the coffin ritual.• In second interviews with newmembers after Feb. 23 meeting, confirmed that

pledges were hooded on Friday night in between and during activities, includingduring “eye of chi phi”; also confirmed being hooded on Saturday before

which started around 1pm

Allegation #9 – Pledges were given alcohol• Affirmed in text where Member states, “Just made [New Member ]

shotgun a 4Loko.” 4Loko is an alcoholic drink. also states, “He beat you[Member ] and you had a beer mr big shot.”

• Confirmation from NewMember ininterview on 2/16/15.

• In second interviews with newmembers after Feb. 23 meeting, confirmed thatthe 20 pledges were forced to consume 60 beers in an allotted time frame. Andconfirmed on Friday night that they were required to participate in “BeerOlympics” with active members

• In second interviews with newmembers after Feb. 23 meeting, confirmed that. Some declined due to health

concerns.

Allegation #10 – Pledges were forced to drink out of a “tubestroker” (a male sex toy)• Confirmation by NewMembers that there was a tubestroker – both

denied that they drank from it• In second interviews with newmembers after Feb. 23 meeting, confirmed that

pledges were asked to drink from the sex toy

Allegation #11 – NewMember had to bring coffee to Member and others• Affirmed in group text exchanged – Member states, “Do pledges deliver to

the lib?” Member responds, “[New Member ] does.”• Affirmed in group text exchanged – unidentified person states, “Tell [New

Member ] I need some coffee.” responds, “Too late he just got herewith a ton and it’s gone.” Unidentified person responds, “Tell him to go back.”

• Affirmed in group text exchanged – unidentified person states, “Gotta love [NewMember ’s dedication. 1:00 in the morning and he’s still here.” Memberresponds, “He’ll be back at 8:45am with a coffee for me too.” Member thenstates, “I have a personal beef with him and he literally texts me when do youwant your next coffee”

Allegation #12 – Pledges were forced to do line ups• Affirmed in text where Member states, “That’s what I was trying to do. Idk

about you but couldn’t stop laughing during line ups and then got shit for it. Idon’t know what you’re talking about.” Next one from Member “Obviouslysaying “eat this oatmeal don’t insult and his dream to go to culinary school”isn’t meant to scare them.

• In second interview with newmembers after the Feb. 23 meeting, confirmedthat pledges were forced to do line ups. One newmember described these asasked to recite ridiculous information, yelled at, pushups, or mean looks if theydid not answer correctly. These were confirmed to occur Thursday night, Fridaynight and Saturday morning right after the pledges woke up.

Allegation #13 – Eye of Chi Phi – Pledges forced to participate in an event where they areblindfolded after seeing an active member with his pants down and then asked to sticktheir finger in the active member’s anus. Then actually have them stick their finger in a jarof Nutella. New Member stated that pledges were so shaken up that they were cryingduring this incident

• Confirmed by in interview with Steve Rogers. From Rogersinterview, “He ] knew, in general, that it [Eye of Chi Phi] had to dowith fooling the pledges into believing they’d be touching someone’s butt, whenthey would really touch something else (he confirmed Nutella by nodding).”

• Confirmed by 2 active members that they had participated in something similarbut not as bad when they were initiated.

• Confirmed by – “ ] was present for “eye of chi phi” incident.Tried to minimize, not fully disclose, but eventually admitted incident happenedas described (see above). Said jar was of peanut butter and that multiplemembers had taken turns holding it. Said the active with his pants down was

].• Affirmed when unidentified person in group text states, “The guy [New Member

] pulled out a condom on his feet for eye of chi phi. That’s an impressivefucking feat thinking on his feet.”

• Confirmed in 2/23/15 interview with Member• Confirmed in newmember meetings after Feb. 23.

Allegation #14 – Members tried to come up with a cover story when [New Memberwas injured.

• Affirmed from group chat – Student states, “Just curious, what’s [NewMember ]’s story for the ER?”

Allegation #15 – Alumni said something to the effect of “regarding the incident,this is one of those things where you have to make up a story and stick with it.”

• NewMember stated in an interview with Steve Rogers that he did notremember specifically what was said by alumna beyond it was unfortunate, thatthose attending made sure NM was ok, it was unintentional and the chaptershould not let anything like this happen again.

• NewMember stated in an interview with Steve Rogers that he thought[Alumni touched briefly on the incident and said it was an unfortunatecircumstance.

• NewMember stated in an interview with Steve Rogers that he remembered[Alumni talking about the incident at a recent chapter meeting.[Alumni “touched on” the incident and said the members should “takeit in stride and learn” from the experience.

• NewMember confirmed that an alumna spoke and said the alumna’smessage was to learn from this and not to let it happen again.

• Others remembered only the alumna talking about scholarships and additions tothe chapter house.

Allegation #16 – During the fall semester [Member had [New Member and anotherpledge named [New Member steal street signs.

• In 2nd interview with Assistant Dean Cox on 2/16/15, New Member deniedstealing signs

• In interview with Member on 2/23/15, Member confirmed that NewMember had stolen street signs.

Other AllegationsAllegation #1 – Group text chat would indicate an intent to haze newmembers by theleadership and members of Chi Phi

• Confirmed in interview with that new members were forced toparticipate in “eye of chi phi” activity. Also confirmed that pledges given only aloaf of bread and candy canes to eat on Friday at the house. Finally, states that hehad knowledge of pledges being hooded and in rooms waiting for ceremony.

• National Office’s investigation confirmed everything that was in the initial reporthad happened as reported except possibly the wasabi in the oatmeal.

• Confirmed in interview with that “eye of chi phi” activity didoccur but was not there at the time. Instead, he was “getting theattic ready”.

• Confirmed in interview with Member Regarding the “eye of chi phi”,[Member said that in his 2013 pledge class they had experienced somethingsimilar but “not as bad” as what this year’s pledges apparently experienced.
