Democratic Structure of the New South Wales Nurses and Midwives’ Association
Strength in numbers is one thing, but the New South Wales Nurses and Midwives’ Association also depends on the commitment of its members to make a difference. The more active and involved our members, the stronger the Association.
The Association empowers nur ses and midwives to actively participate in shaping every aspect of their profession: from pay claims and workload relief to workers’ com pen sation, professional issues, and legal protection.
Participation in demo cra tic branches through out NSW
allows nurses and midwives to con trol their
own agenda and to ensure that each workplace has a voice in the Association’s direction.
This diagram shows how indi vi
dual members can affect policy by being
involved.

OverviewThe Member Industrial Services Team (MIST) is made up of officers with a variety of disciplines, experiences and skill sets who work in combination to provide information, support and representation to members — ranging from individual matters to those affecting a particular workplace or employer to finally those issues that have an industry wide impact.
These activities generally relate to ensuring rights are upheld and compliance achieved with relevant industrial and employment obligations. However, MIST officers always in the first instance try to provide sufficient information and support to empower members and Branch officials so they may resolve the issue within their own workplace.
Within MIST we have Information Officers, Member Support Officers, Assistant Industrial Officers, Nurse/Midwife Advocates, and Industrial Officers, along with Administration staff. The effectiveness of MIST derives from the complementary strengths brought by each to the task of informing, assisting and advocating on behalf of members and Branches. And plenty of work there is to do!
Information Officers in the reporting year received some 15,692 inquiries from individual members and Branch officials. Of these, 11,181 received sufficient information and support to resolve the issue in the workplace without requiring further assistance from the Association. Member Support Officers, Assistant Industrial Officers, Nurse/Midwife Advocates, and Industrial Officers dealt and provided support and representation involving 4,471 cases. But any one of these issues and cases may have a number of officers involved at different stages of the ‘resolution journey’.
For example, a member may call and speak to an Information Officer about a direction by their employer to attend a fact finding interview. At this point the Information Officer would ensure that adequate information is provided regarding procedural fairness and whether necessary specificity has been provided to the member regarding any allegations. The Information Officer may become involved in providing further support to obtain these.
As this fact finding pertains to allegations regarding clinical issues, the member receives further assistance and support from a Nurse/Midwife Advocate, someone with a nursing and/or midwifery background. This enables Advocates to provide expert support and guidance on a wide range of issues impacting on members.
Unfortunately in this example the fact finding process results in disciplinary action against the member, which seems unreasonable and cannot be sustained on the facts. At this point the member would receive additional support and representation from an Industrial Officer, which may see the matter escalated via any dispute process with the employer to an industrial tribunal. Industrial staff in the reporting year had matters in various industrial and employment related tribunals or other courts.
Whilst this example is demonstrative only, it does reflect the measured way that skills and resources are made available for best and maximum affect. This is something greatly needed when dealing with the volume of cases received and their increasing complexity, whilst always having an empathetic eye on the member or Branch Official involved who may be under considerable stress and pressure.
NOTE: To help us achieve even higher levels of excellence, Delegates are reminded that members can submit their enquiries via our email facilities, being [email protected]. We ask that Delegates advise members that it is important that they provide their membership number, the best contact phone number or reply email address, and enough detail about their question or issue. This allows us to respond in a prompt and timely manner within one to two working days.

18 About the NSWNMA
OverviewThe Professional Services Team continues to strategically represent and influence the professional interests of nurses and midwives, and to offer valuable representation to our members to empower them and potential members through the provision of information and education.
The Professional Officers undertake to influence health change in the public, private and aged care sectors. We continue to campaign for the professions of nursing and midwifery by providing leadership and opinion in all nursing, midwifery and health care issues. We actively promote nursing and midwifery to future generations of nurses and midwives.
The Professional Services Team also provides a contemporary education program at a reasonable cost to our members and respond to member’s educational needs.
We provide representation at a wide range of forums and work strategically at multiple levels to ensure nursing and midwifery workplaces are safe and healthy.
The Legal Officers provide legal advice and representation for our members in coronial and professional practice, including Nursing and Midwifery Tribunals.
Since last year’s Annual Conference, we have said goodbye to Professional Officer Aged Care, Stella Topaz. Stella was a great advocate for aged care and the nursing profession and we wish her the best of luck in her future endeavours. We have also since welcomed to the team, Professional Officer, Amy Hargreaves in March, and WHS Officer, Veronica Black in May.

20 About the NSWNMA
OverviewThe Projects and Compliance
portfolio has responsibility for the oversight of compliance with
legislative, financial and regulatory requirements, along with managing
Association insurances, including our Journey Accident Insurance for members
and managing the production and catering of Annual Conference. The subteams within the portfolio are
Finance, Information Technology and the Information and Records Management Centre (including the Library).
The Finance Department manages and maintains the Association’s accounting systems and finances; prepares monthly management reports and other supporting data for Team Leaders, Elected Officers and Council; prepares and monitors the annual budget; and prepares annual financial statements for audit. In an environment where the probity of unions and their officials is under constant scrutiny, in 2016 the Association voluntarily adopted the Fair Work Commission requirements for audited financial statements.
The Information Technology (IT) Department is responsible for building, developing and maintaining the Association’s IT architecture and infrastructure, a task that in a modern environment touches on all facets of the Association’s operations. The role includes the production of statistical reports and analysis for the Association management and the provision of hardware, associated software and Help Desk services for all staff and maintaining disaster recovery systems backing up all the Association’s data.
The Information and Records Management Centre manages the systematic creation, receipt, maintenance, use and disposition of the Association’s records in accordance with current best practice and legislative compliance standards. In addition, the Library provides members and staff with services that include access to material for reference and research. The Library Catalogue is online and available to all members via the Association’s website.

22 About the NSWNMA
OverviewThe Strategic Industrial and Bargaining Team (SIBT) develops and implements the Association’s enterprise barganing campaigns.
The team uses a holistic approach to bargaining campaigns with members, particularly in the aged care and private hospital sectors.
Operationally, the team has responsibility for claim research, claim development, drafting, negotiating and maintaining awards and agreements, and communicating proposed and new enterprise agreements to affected members. Industrial Officers are also generally responsible for negotiation of workplace agreements and assistance to the organising stream in the membership consultation process and campaigning phases of bargaining agreement issues. The organising stream officers are responsible for all stages of membership building and organising during the bargaining cycle and pay particular attention to building sustainable activist networks.
The team is responsible for providing the union with industrywide and corporate employerlevel research to enable strategic decisionmaking for bargaining rounds and to identify leverage points for bargaining through research of employers’ operations.
The team also develops claims to advance the conditions of members in the public health system and ADHC, covered by the state industrial system.
Currently the team is organising to win in the Ramsay and Healthscope private hospital groups, in special projects designed to test new approaches aligned with the 2020 Strategic Plan.
